The author of the article raises the important questions concerningthe education and teaching of the students in the institutes of highereducation. The need for democratic style of education is grounded. Theauthor emphasizes the influence of social and organizationalcharacteristics of the institute of higher education on the mental health ofstudents.The factors, influencing drug addiction, are analysed and necessityof preventive programs, such as guaranteed psychological support forstudents and development and application of the programs on stresscontrol training, is noted. ; В статье поднимаются важные вопросы, связанные с обучением и воспитанием студентов в вузе. Обосновывается необходимость демократических основ воспитательного процесса. Особое внимание автором уделяется влиянию социальноорганизационных характеристик вуза на психическое здоровье студентов. Анализируются факторы, оказывающие влияние на наркотизм и отмечается необходимость профилактических мероприятий: обеспечение возможности для студентов получить психологическую помощь; разработка и внедрение программ по обучению управлением стрессом.
Раздел "Международные отношения" - рубрика "Зарубежный опыт" ; Должностные лица, работающие в уставных государственных учреждениях, обладают особым социальным статусом. Результаты их служебной деятельности формируют мнение о государстве в целом. С давних времен считается, что профессиональная бюрократия (структуры со строгой дисциплиной) должны быть опорой, держащей сильную модель государства и народа. Значит, развитие общества, вызовы цивилизации и культуры, прежде всего, оказывают действие на анализируемую область. В первую очередь, эту особенность предрешает единство властных и социальных услуг в демократическом обществе. Понятие уставной государственной службы охватывает не только публичное администрирование, но и требование в оказании соответствующих социальных услуг. С другой стороны, социальные услуги оказываются многими государственными и негосударственными учреждениями. Поэтому необходимо анализировать различия и способы предоставляемых услуг (деятельность и совокупность контроля над деятельностью и критериев оценки), в виде которых реализуются эти услуги. Итак, уставные службы карьеры современности необходимо анализировать в общем контексте служащих обществу государственных институтов, обосновывая важность условий подготовки и службы уставных должностных лиц – определяя понятие уставного должностного лица карьеры с точки зрения социальных наук (напр., права, политологии, этики). Автор в данной статье не стремится дать ответов на вопросы современности, а пытается выдвинуть гипотезы, побудить самого читателя подключиться к научно-исследовательской деятельности, искать ответы, как решать проблемы на основе методологии, сформулированной классиками публичного администрирования. Поэтому, в силу ограниченного объема статьи, автор основное внимание уделяет только анализу проблем формирования и управления персонала государственной службы в историческом аспекте, и пытается раскрыть одну из особенностей, предполагающую исключительность статуса должностных лиц уставной службы, - методологию контроля и оценки служебной деятельности. Автор статьи надеется заинтересовать читателя тематикой исследования, поэтому аргументация предназначена для выдвижения гипотез, выполнения научного анализа администрирования уставных служб. Личность развивается при участии трех «членов» взаимодействия: субъекта деятельности, условий деятельности и третьего «члена» - самой деятельности. В статье проблема рассматривается, используя теоретические источники и опыт других стран. Уставные службы демократического государства - деполитизированы, правовыми средствами отделены от влияния политических производных. Они выполняют важные функции государственного управления, поэтому необходимо согласиться с тем, что управление этих служб в большой части зависит от общей государственной политики, оно определено конституцией страны. Это важное обстоятельство, которое необходимо учитывать при решении внутренних проблем этих служб, намечая вехи политики кадров. Другое важное обстоятельство – быстро растущая требовательность общества к профессиональности должностных лиц, к их компетенции в области поддержки демократических тенденций развития общества, и это меняет содержание служебной деятельности, предполагает разнообразие концепций контроля над служебной деятельностью. В статье делается предпосылка, что условия деятельности, особенности функций этих служб одновременно требуют нестандартной точки зрения на деятельность должностных лиц, требуют по-своему моделировать мотивацию, стимулы их деятельности. = Officials who work in statutory state services have a special social status. The state as such is judged by officials' service activities. Since long ago, the notion that the bureaucracy (institutions of strict order) is supposed to be the backbone that maintains a strong model of the state and nation. Thus, the development of society, the challenges of civilisation and culture first of all affect the issue concerned. Foremost, this peculiarity is determined by the unity of the administrative and social service in a democratic society. The notion of the statutory state service includes not only public administration but also the requirement to perform respective social services. On the other hand, many other governmental and non-governmental institutions render social services. That is why it is necessary to analyse the services' differences and modes (the activity, its control and evaluation criteria), in which these services are rendered. Thus, modern-day career statutory services have to be analysed in a general context of state institutions serving the society, by giving grounds for statutory officials' preparation, for importance of service conditions- by determining the notion of a statutory official in the view of social sciences, for example- the law, political sciences, ethics). The article does nor aspire to give answers to modern- day questions, but it tries to put forward hypotheses, to encourage the reader to get involved into scientific research, and to look for answers, how to solve the problems through the methodology formulated by the classics of public administration. Since the scope of the article is limited, the author has focused on the analysis of the state service staff forming and management problem in the historical aspect, he also tries to reveal one of the peculiarities which affects the singularity of statutory officials' status — i. e., the methodology of service activity's control and evaluation. The author of the article also hopes to make the reader interested in the topic of his research, therefore, arguments are intended for hypotheses to be put forward and for the scientific analysis of statutory services' administration to be carried out. The personality evolves if three «parties» are involved in the process: the subject of the activity, conditions of the activity, and the third «party» — the activity itself. The «parties» in the article are analysed using theoretical sources and the experience of those democratic countries where statutory services are separate from the influence of political factors. They perform very important functions of the state management; therefore, we must agree that the management of these services depends to a great extent upon the general state policy, which is determined in the Constitution of the State. It is an important factor, which has to be regarded when solving internal problems of these services, when designing the guidelines for the personnel policy. Another factor of importance is a speedily growing exact requirements of the society for the professionalism of civil servants, for their competence in maintaining the tendencies of democratic society development. This changes the content of the service operation, and presupposes a diversity of service activity control. The article formulates the view that the activity conditions, the peculiarities of these services functions require at the same time a non-standard approach towards the officials' activity, they also require special modelling of their activity motivation and incentives.
Раздел "Международные отношения" ; Post-socialist transformation of the CES Countries has become a regular process requiring the appropriate economic strategy and policy. It can already be stated that democratization and market relations are deeply rooted in these countries. That does not mean however that the process itself is over. There is the question of what impact the hard consequences of transition to a market economy will make on united Europe which already includes almost all former socialist allies. Belarus is also implementing reforms aimed at the creation of an efficient market economy which sufficiently competitive on the international level to meet the demands of the overwhelming majority of its people. The end of the reforms depends essentially not on the success of the hit-and-miss attempts. Belarus has considerable opportunities to assess the mistakes other countries made during their structural reforms, in the process of their establishing the institutions of a market economy and of solving social issues. It was also able to evaluate their chances for integration into the European and global economy and to avoid its own mistakes. The integration policies adopted by the Western neighbours which have only until recently been Belarus' friends and partners within the socialist system united by the Council of Economic Mutual Assistance (COMECON) give a good chance to considerate their controversial nature as well as the prospect of development of the other CES states. The governments of these countries declared the accession to the EU to be their priority, regarding it as one of the main guarantors of stable economic development and security (along with NATO). By the end of the 1990s the economies of almost all post-socialist countries started to suffer from serious «growth fatigue». Major manufacturers of material goods (the people, in other words) of these countries expressed a growing dissatisfaction with the methods of reforms. It is obvious that a psychological factor worked here: there is a big gap between expectations and the level of their satisfaction. The people tend to think that the economy is not working well, even if the rate of consumption rate is growing. However, these societies believe that within the EU it will be easier to overcome the challenges of globalisation which has become an unevitable and necessary process and is understood as a means of integration of capital, goods and labour markets the currently which are functioning separate from each other. The experience of involvement into the globalisation processes is extremely important for Belarus. There is no alternative to this involvement (nor to the general market economy model) and this applies more strongly to Belarus than to its neighbours. But the final result will depend on its own development strategy level and the growth policy; however the risk of globalization damage may be higher. The experience of the Belarusian neighbours shows that such government actions as the rapid «shattering» of state foundations during the transition to the market economy without any proper preparation for the loosening of state control over the economy as well as the extremism and incompetence of the authorities themselves has led to negative and unwanted consequences which eventually resulted in corruption corruption and crime in management and the unreadiness of legislation to be systemically transformed.

В одних странах концепции внешней политики принимаются как нормативно-правовые документы правительств, в других — как законодательные акты, в ряде случаев — как стратегии (доктрины) национальной безопасности. Можно предложить определение концепции внешней политики как системы взглядов, способа понимания, общего замысла, руководящей идеи, конструктивного принципа международной деятельности государства. С точки зрения внутриполитического развития страны, концепция — это форма национального самоопределения, принятия национальных интересов и достижения общенационального консенсуса. Концепция имеет также политико-правовое (дополняет право необходимой политической ориентацией) и управленческое значение (формулирует систему и технологию принятия внешнеполитических решений). С точки зрения международного взаимодействия, концепция имеет большое репрезентативное значение — представляет государство, декларирует принятие им ценностей современного мира и оценивает систему международных отношений, формулирует рамки реализации национальных интересов. = The process of developing and implementing the state foreign policy presupposes its political and legal frameworking at the national level. In some states, foreign policy concepts are adopted as governments' normative-legal documents; in others, they are laid down in legislative acts; in a number of cases, they provide strategies (doctrines) of national security. The foreign policy concept can be defined as a system of views, a mode of understanding, general plan, leading idea, constructive principle of the international activities of states. In terms of internal political development of a country, the concept is a form of national self-determination, adoption of national interests and attainment of national consensus. The concept has also a political and legal significance — it adds political orientation to the law; and a managerial aspect — it formulates the system and technology of foreign policy decisions making. In terms of international cooperation, the concept has a great representative meaning – it represents the state, declares acceptance by it of the values of the modern world, estimates the system of international relations, and identifies the scope of realization of national interests.

Раздел "Международные экономические отношения" ; В статье раскрывается сущность международного туризма, его роль в мировом масштабе и значение для национальных экономик отдельных стран. Рассматривается необходимость и специфика государственного управления международным туризмом на современном этапе развития мирового хозяйства. Потребность в процессе регулирования международной туристской отрасли со стороны административных органов обосновывается исходя из характерных особенностей туризма как вида экономической деятельности (сезонность, гетерогенность, статичность предложения и динамичность спроса, трудоемкость и т. д.) и основных тенденций его развития, существующих на сегодняшний день (быстрый рост отрасли, появление новых туристских регионов, повышение запросов туристов, дифференциация, индивидуализация и диверсификация туристского продукта и т. п.). Актуальность данной проблематики находит свое отражение и в необходимости обеспечения устойчивости в развитии международного туризма, что невозможно без соответствующего контроля со стороны государства. Туристская политика страны направлена на повышение привлекательности и конкурентоспособности туристского региона. Автором раскрываются теоретические аспекты данных понятий и подчеркивается принципиальная разница между ними. Конкурентоспособность рассматривается как способность туристского региона производить качественный продукт, удерживать свои позиции на международном рынке туризма и по возможности со временем расширять сферу своего влияния, не нарушая при этом принципов устойчивого развития. Привлекательность туристского региона определяется с точки зрения ее способности привлекать к себе внимание и вызывать интерес потенциальных туристов. Проанализированы факторы, определяющие конкурентоспособность туристского региона, и предложено новое представление о критериях привлекательности национального рынка для международного туризма. Делается вывод о том, что туристская политика государства должна строиться с учетом всех особенностей и качественных и количественных преобразований в сфере международного туризма в современных условиях трансформации его структуры. = The article reveals the essence of international tourism, its role on a global scale and importance for national economies of some countries. The author explores the necessity and specific features of state control of international tourism at the current stage of world economy development. The necessity in regulation of international tourism field of industry by government bodies is substantiated by characteristic features of tourism as a form of economic activity (seasonality, heterogeneity, the static character of supply and dynamic nature of demand, labour-intensiveness etc.) and current main trends of its development (the rapid growth of this field of industry, emergence of new points of destination, new requirements of tourists, differentiation, individualization and diversification of tourist product etc.). The topicality of this issue is also proved by the necessity of providing sustainability in international tourism development, which is impossible without control from the state. The tourist policy of a country is aimed at raising the attractiveness and competitiveness of the tourist region. The author reveals the theoretical aspects of these notions and emphasizes fundamental differences between them. Competitiveness is considered as capability of the point of destination to produce a high-quality tourist product, to hold its positions in the international tourist market and, if possible, to expand the sphere of its influence without violating the principles of sustainable development. Attractiveness of the point of destination is determined by its ability to attract attention and be of interest to potential tourists. The author also gave the analysis of the factors determining competitiveness of a tourist region and offered a new conception of the criteria of attractiveness of a national market for the international tourism. The author made a conclusion that tourist policy of a state should include all particular features and take into consideration qualitative and quantitative changes in the international tourism sphere in the modern conditions of transformation of its structure.
Земельная реформа началась в Украине 14 лет назад и является одним из наиболее важ- ных факторов влияющих на процесс трансформации бывших государственных аграрных предприятий в предприятия с рыночной ориентацией. В результате проведения земель- ной реформы в Украине произошли значительные изменения в землепользовании и фор- мах собственности на землю: Отменена государственная монополия на землю, проведена широкомасштабная приватизация сельскохозяйственных угодий, граждане Украины по- лучили земельные участки в собственность, прошли первые транзакции на рынке сельско- хозяйственной земли и т.д. В этом выпуске "Дискуссионных материалов" систематизированы фактические мате- риалы касательно реформирования земельных отношений в Украине с особенным вни- манием на создании условий для формирования и перспективного развития рынка сельскохозяйственной земли в Украине. Также представлено текущее состояние украинс- кого рынка земли сельскохозяйственного назначения и его законодательное регулиро- вание. ; Land reform started in Ukraine 14 years ago became one of the most important issues in transformation of large state agricultural enterprises into market oriented agricultural enterprises. Significant changes in land use and land ownership has happened as a result of land reform implementation in Ukraine. Namely, state monopoly on land was eliminated, agricultural land was privatized, citizens of Ukraine received land plots in possession, first land transactions have happened at agricultural land market etc. Actual data regarding Ukrainian land relations reformation is systematized in this Discussion paper with especial focus on establishing the prerequisites of further formation and perspective development of the agricultural land market in Ukraine. Additionally, a current situation is described at the Ukrainian agricultural land market and its legislative regulations.

Выявлены закономерности формирования и функционирования национальных инновационных систем развитых стран, отражающие усиление роли государства в регулировании инновационного развития, создание сетевых структур, повышение роли регионов в развитии инновационных процессов, интеграцию национальных инновационных систем в наднациональные инновационные системы. Рассмотрены основные периоды формирования НИС в европейских государствах: послевоенный; завершение «холодной войны» и ликвидация противостояния Запад—Восток; объединение европейских НИС в единую гиперсистему и создание единого исследовательского пространства в Европе. Приведена обобщающая методика анализа инновационной деятельности ЕС, включающая систему показателей, разбитых на четыре группы: человеческие ресурсы; генерация знаний; распространение и использование знаний; инновационные финансы, рынки и результаты. Проанализирован опыт функционирования Европейской бизнес-сети, бизнес-инновационных центров, финансовых структур, информационной деятельности Европейского патентного ведомства и системы патентной информации Германии. Дана характеристика информационных ресурсов свободного доступа, финансируемых из средств ЕС: система CORDIS, поддерживаемая программой Европейской комиссии по инновациям, малому и среднему бизнесу; специальная информационная система LIFT, предназначенная для оказания услуг по подготовке проектов. Сделан вывод о происходящей в настоящее время в Европе интеграции национальных инновационных систем стран — членов ЕС в единое научно-технологическое и инновационное пространство и возможности использования имеющегося опыта формирования инновационной инфраструктуры при создании архитектуры белорусской инновационной системы. = The article explores institutional aspects of development and interaction of national innovation systems (NIS) of the EU member-states. It outlines the regularities of formation and functioning of national innovation systems in developed countries, reflecting the strengthening of the role of the state in regulation of innovation development process, creation of network systems, growth of the role of regions in development of innovation processes and integration of innovation systems into supranational innovation systems. The author considers the main periods of NIS formation in European states: after the Second World War; the end of the Cold war and West-East confrontation; unification of European NIS into a single hypersystem and, finally, creation of a single space in Europe. He uses summarizing methods of analysis of the EU innovation activity including the system of indicators divided into four groups: human resources; generation of knowledge; distribution and use of knowledge; innovation finances, markets and results. The author analyzed the experience of European business network, business innovation centres, financial structures, information activity of the European Patent Agency and German patent information system. He gives characteristics of free access to information resources, financed by the EU funds: the CORDIS system, supported by the European Commission System on Innovations, Small and Medium Business; the special LIFT information system for rendering service in preparation of projects. The author draws conclusions on the integration underway in Europe of national innovation systems of the EU member-states into a single science and technology as well as innovation space, the possibility to use the experience of formation of innovation infrastructure in the creation of Belarusian innovation system architecture.
Раздел "Международное право" - рубрика "Вопросы теории" ; На основе анализа критериев признания государств рассматриваются вопросы, касающиеся преждевременного признания; делаются выводы о правомерности применения этого термина в современной международно-правовой литературе. Критерии своевременности признания, которые использовались в классической доктрине международного права (критерии предварительного предоставления признания бывшей метрополией и фактического завершения военных действий), утратили свою юридическую значимость. Критерии признания, приводящиеся в современной международно-правовой литературе, также не являются юридически обязательными. В современном международном праве существует лишь один непреложный критерий для признания нового государства — критерий международной законности, в соответствии с которым не допускается нарушение императивных норм международного права как в процессе создания государства, так и при предоставлении ему признания. Этот критерий, однако, не имеет ничего общего с моментом предоставления признания. Таким образом, автор приходит к выводу о том, что использование термина «преждевременное признание» становится необоснованным ввиду отсутствия в современном международном праве критериев, на основании которых можно было бы определять своевременность предоставления признания. = Analysing of the criteria of recognition of states the article considers the questions of premature recognition and the applicability of this term in modern international law literature. The criteria used in the traditional doctrine to determine whether the act of recognition was committed in proper time (the criterion of granting recognition only after that of «a parent state» and the criterion of the end of the struggle) have lost their legal value in modern international relations. The elaboration and assignment of the basic principles of international law have made it possible to evaluate the process of creation of states and the acts of recognition with the relation to the legal norms. The criteria described in the modern doctrine (criterion of effectiveness of the government of a state, criteria for statehood elaborated in the 1933 Montevideo Convention on the Rights and Duties of States) are not legally binding in international law. The only obligatory criterion for recognition is international legality. According to this criterion the breach of peremptory norms jus cogens is not permitted in the process of creation of a new state, as well as in the process of granting a recognition to it. This criterion, however, does not have anything to do with the moment of recognition. Thus, the author comes to a conclusion that the use of the term «premature recognition» becomes illegitimate because of the absence of the criteria which would allow to determine the timeliness of the recognition act in modern international law.
Раздел "Международное право" - рубрика "Международные экономические отношения" ; Выставочно-ярмарочная деятельность давно превратилась в один из главных инструментов развития мировой экономики, своеобразный полигон для проверки качества товаров и услуг. В отличие от ряда других стран в Беларуси отсутствует единый закон, который регулировал бы все аспекты выставочно-ярмарочного дела. Постановление Совета Министров от 22 июля 2004 г. № 890 является по настоящее время основным нормативно-правовым актом, который прямо устанавливает процедуру планирования, подготовки и проведения всех видов выставок и ярмарок в Беларуси и за рубежом, определяет права, обязанности и ответственность участников этой сферы деятельности. Вместе с тем, остаются неурегулированными ряд аспектов, относящихся к выставкам и ярмаркам. Более того, не в полной мере задействован механизм выполнения Беларусью международных обязательств, вытекающих из многосторонних договоров, в частности в области транзита грузов, в том числе выставочного характера, участницей которых является страна. В статье содержатся предложения, направленные на совершенствование современной законодательной базы в этой сфере. Автор предлагает осуществить присоединение Республики Беларусь к Киотской международной конвенции об упрощении и гармонизации таможенных процедур. Наконец, по мнению автора, созрела необходимость принятия в стране законодательного акта всеобъемлющего характера, который сформулировал бы перечень прав и обязанностей для организаторов и участников выставочно-ярмарочного дела. = Exhibition and fair industry has long become one of the major instruments of development of the world industry, a certain ground for testing the quality of goods and services. Unlike some other countries, Belarus does not have a single law that regulates all aspects of the exhibition and fair business. The government's decree N 890 dated July 22, 2004 has so far been the major legislative act that directly establishes the procedure of planning, preparing and holding of all kinds of exhibitions and fairs in Belarus and abroad, defines the rights, duties and responsibility of actors in this sphere of activity. However, a number of factors relating to fairs and exhibitions continue being unregulated. Moreover, the mechanism of implementation by Belarus of its international obligations arising from multilateral treaties to which the country has been a party, particularly in the field of transit of goods including exhibition items, has not been fully enacted. A part of the article deals with proposals aimed at upgrading the current legislative fundamentals in this field. A suggestion has been made for the Republic of Belarus to accede to the Kyoto International Convention on the simplification and harmonization of customs procedures. Ultimately, the author claims, the country needs a legislative act of comprehensive nature intended to outline the range of rights and obligations for exhibition and fair's organizers and participants.
Раздел "Международное право" - рубрика "Международное частное право" ; В настоящее время все увеличивающееся число государств, столкнувшись с перетеканием части налогооблагаемой базы в зарубежные юрисдикции, в одностороннем порядке отказывается от применения своей налоговой юрисдикции в отношении некоторых зарубежных доходов резидентов. Эффективные односторонние методы избежания двойного налогообложения позволяют сделать государство более привлекательным для международного бизнеса в качестве государства-резидента. Обычно государства применяют следующие три метода избежания двойного налогообложения: вычета, освобождения и зачета. В статье дается их краткая характеристика, приводится анализ преимуществ и недостатков, а также описывается сфера применения каждого из этих методов на примере государств — членов Европейского союза. Республика Беларусь с недавнего времени исключила возможность применения односторонних мер по избежанию двойного налогообложения. Подобная позиция белорусского законодателя может быть обоснована тем, что в сфере международного налогообложения существует развитая договорная база. Тем не менее, опыт ведущих экономически развитых государств показывает, что применение односторонних мер наряду с международными соглашениями демонстрирует свою эффективность. = At present, an increasing number of states faced with the escape of tax base to foreign jurisdictions unilaterally refrain from exercising their tax jurisdiction over certain foreign incomes of their residents. Effective application of unilateral methods for the avoidance of double taxation makes it possible for a state to become more attractive as a seat for international businesses. Usually states apply the following three double taxation avoidance methods: the deduction method, the exemption method and the credit method. This article gives a brief description, provides an analysis of advantages and disadvantages and describes the scope of application of these methods by using the examples of the European Union member states. The Republic of Belarus has recently excluded the application of unilateral double tax avoidance measures. Such position of Belarusian law-makers can be justified by the fact that there is a developed treaty network in the field of international taxation. At the same time, the examples of the leading developed nations show that the application of unilateral measures for the avoidance of double taxation proves to be effective.
The process of formation of a single government politics in the sphere of industrial property is discussed. It is pointed out that economical significance of the objects of IP is rising because of priority orientation of the Russian science and industry on making scientific, good production. The questions of effective legal protection and commerce realization of the IP objects are also touched. It is settled that support and development of the patent service in the institutions of higher education are necessary. ; Обсуждается процесс формирования единой государственной политики в области промышленной собственности. Подчеркивается возрастающая экономическая значимость объектов ИС в связи с приоритетной ориентацией отечественной науки и промышленности на создание наукоемкой, конкурентоспособной продукции. Затрагиваются вопросы эффективной правовой охраны и коммерческой реализации объектов ИС. Обосновывается необходимость поддержки и развития патентной службы в составе вуза.
