학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 이승종. ; 민선 5기 지방선거 이후 우리나라 지방자치는 새로운 양상으로 진행되고 있다. 지방자치의 정치화, 지방정치의 중앙화가 가속화되었으며 특히 무상급식이라는 정책이슈가 지방자치의 주류 현안으로 등장하게 되었다. 이 논문은 무상급식 이슈가 대표적인 양대 지방자치단체인 서울시와 경기도에서, 유사한 정책 환경에도 불구하고 전혀 다른 정책결과를 낳은 점에 주목하였다. 이를 위해 서울시와 경기도의 무상급식과 관련된 정책 환경의 공통점과 차이점을 알아보고 어떤 요소에 의해 상이한 정책결과가 나타났는지를 분석하고자 하였다. 급식정책 실시 결과라는 종속변수에 영향을 주는 독립변수로는 지방선거 결과, 지방의회 특성, 자치단체 재정규모, 마지막으로 단체장의 특성을 설정하였다. 연구 결과 두 지방자치단체는, 단체장의 정당배경 및 무상급식에 대한 소신, 지방의회의 정당간 분점정도, 의회규모, 의원 보수, 자치단체 재정규모 면에서 극히 유사하였으나 단체장 특성 가운데 정당배경 및 성장배경 보다는 갈등해결 전략에서 차이가 있음을 알 수 있었다. 그 결과 경기도에서는 김문수 지사가 명분을 지키면서도, 의회와 타협하여 상생의 길을 모색하였고 서울시에서는 오세훈 시장과 의회가 강경대응으로 일관하여 시장 사퇴라는 나쁜 선례를 남기고 말았다. 또한 당초 설정된 '단체장의 특성에 따라 급식정책은 영향을 받을 것이다' 라는 가설이 확인되었다. 정책적 함의로 첫째는 '지방선거의 지방화'를 위해 정치권이 노력해야한다는 점을 들 수 있다. 6.2 지방선거에서는, 행정학자들이 우리나라 지방정치의 문제점으로 거론해 온 지방정치의 중앙화 현상이 더욱 극심해진 결과를 보여주었다. 중앙당은 지방선거를 중앙선거의 대리전 또는 전초전으로 간주하는 태도를 버려야 할 것이다. 둘째는 정당들이 더욱 정책개발에 노력할 필요가 있다는 것이다. 민선 5기 선거는 무상급식 이슈가 전국을 휩쓴 선거로서, 여야 정당들은 지방차원의 정책 개발보다는 선거이슈 선점에 따른 공세 및 방어에 급급한 모습을 보여 주었다. 교육정책에는 무상급식 외에 절실한 문제들이 많이 있음에도 불구하고 마치 과거 민주화항쟁 당시의 대통령 직선제 요구를 방불케 하는 양자택일 양상으로 진행되었다. 또한 근거 없이 무상급식 요구를 포퓰리즘으로 매도한다거나, 선별적 급식지원 정책이 아이들에게 눈칫밥을 먹이는 것이라고 선동하는 것은 지방선거에서 우선 승리하고 보자는 식의 후진성을 보여주는 사례라고 할 수 있다. 정치권이 더욱 성숙해질 필요가 있다. 셋째 복지정책은 개별 지방자치단체의 재정상황 여건에 따라 추진할 필요가 있다. 연구결과 복지 선진국들도 국가별, 지역별로 다양한 급식 정책을 실시하고 있음을 알 수 있었다. 또한 지방자치단체와 의회는 일방적인 '힘'의 논리만 앞세우지 말고 서로 화합하여 선진 지방자치 문화 정착에 기여하여야 할 것이다. ; After the 5th local election by popular vote, Korea's local autonomy is taking on a new aspect. Party politics and centralization of local politics are accelerating. Especially free meals policy has become the mainstream issue of local autonomy. This paper paid attention to the fact that free meals issue brought about different outcome in two big typical local governments such as Seoul city and Gyeonggi province. For this research, first I tried to discern similarities and differences related to free meals policy environment and to analyze what factors brought about different outcome. I set up the local election result, financial ability of local government, and characteristic of local government head as independent variables which have influence on school meals policy. This reserch finds out that there was significant difference in characteristic of local government head, particularly conflict solving strategy rather than political backgrounds although there were many similarities in their parties, belief on free meals policy, inter-party domination structure, size of assembly, annual salary, local finance of the two local governments. In Gyeonggi province, Governor Kim negotiated with local assembly for peaceful coexistence, in Seoul city Mayor Oh and city assembly called for tighter controls. Finally Mayor Oh resigned because of the low turnout in inhabitant's poll on free meals policy. This is a bad precedent in local autonomy history. Also the hypothesis that free meals policy will be influenced according to the characteristic of local government head was confirmed. This study implies, first, all politicians should make a greater effort for localization of local election. In the 5th local election by popular vote, centralization of local politics which many scholars have mentioned so far was intensified. Central parties have to come off regarding local elections as proxy war and skirmish of the central general election. Second, parties should develop policies. The 5th local election was only for free meals policy issue all over Korea. Most of parties manage to cope with electoral situation related to free meals issue rather than policy development of local level. Free meals policy was considered as the only matter like direct presidential election system issue in 1987 although there are other urgent matters except free meals policy in education policy field. Also the ruling party politicians denounced free meals policy as populism, otherwise the opposition party politicians condemn selective welfare policy for vulnerable groups as discrimination of the poor. These cases are backward behaviors which aim at short-term election victory. All politicians must be more mature. Third, welfare policy need to be carried out depending on each local government's financial conditions. As mentioned earlier, even advanced countries implement various school meals policy on a case by case basis. Also local governments and local assemblies should cooperate each other for establishing desirable local autonomy culture not depending on the unilateral power. ; Master

본 논문은 대외정책 분야에서 드러나는 미국 대통령제의 운용원칙인 권력분립을 미국식 민주주의의 사각지대로 접근하는 시각을 제시하여 선행연구와 차별성을 추구한다. 구체적으로 헌법이 천명하는 권력분립 원칙에도 불구하고 오히려 그 권력분립의 기제인 상호간 독자적 선거제에 의해 미국의 유권자 전체가 선출한 대통령은 각 지역구에서 선출된 입법부 구성원이 내세우는 집합적 통치 위임과 확연하게 구별되는 유일한 공공리더십(public leadership)을 정책결정과정에서 독점할 수 있다는 점을 주시하고자 한다. 결국 미국 대통령제의 과제는 미국식 민주주의의 주요 통치원칙인 권력분립을 중시하는 동시에 성공적 통치를 위해 권한공유의 묘(妙)를 찾는 부단한 노력을 경주해야만 가능하다는데 있다. 특히 국내정책 분야보다 대외정책 분야에서 이 난제의 해법을 모색하는데 있어서 법제도적 및 정치적 장애물이 가로막혀 있다. 게다가 선거결과와 무관하게 통치 위임을 생성하는 정치의 사법화가 입헌 대통령제의 근간을 흔들 수 있는 위험성을 목격했다. 이에 본 논문은 대외정책 분야의 미국 대통령제에 대한 평가를 권력분립의 양면성, 즉 권력분립은 권력공유를 전제로 한다는 패러독스에 중점을 두고 대통령의 우위에 대한 주장을 가능하게 하는 헌법적 및 정치적 근거를 대조하면서 미국식 민주주의의 사각지대를 재조명하고자 한다. ; In this paper, I argue that the principle of separation of power in foreign policy under presidentialism invites a blind spot in American democracy. Although the Constitution specifies separation of power both in the conduct of domestic and foreign affairs, independent elections of President and legislators differentiate the kind of collective mandates on Capitol Hill from the unitary mandate bestowed upon President, thus prompting him to proclaim public leadership. The key to a successful governing, then, lies in the art of pursuing "separated institutions sharing powers" persistently. However, the realm of foreign affairs poses a more challenging task, both constitutionally and politically, than its counterpart in domestic policy. Furthermore, we came to witness a modern presidency whose relentless claim on mandate, or what is dubbed as judicialization of politics, was found irrelevant to the electoral outcome itself, thus creating a peril in constitutional presidency. 학위논문 (석사) -- 서울대학교 대학원 : 사범대학 사회교육과(일반사회전공), 2020. 8. 이미나. ; 본 연구는 청소년의 정치효능감과 디지털 리터러시 수준이 정치 참여에 미치는 영향을 알아보고, 디지털 리터러시 수준이 정치효능감과 정치 참여 활동 사이의 관계에 조절변인으로 작용하는지를 살펴보고자 한다. 궁극적으로 디지털 미디어의 활용에 적극적인 청소년의 정치 참여 방안을 찾는데 기여하는 것을 목적으로 한다. 위와 같은 문제인식을 바탕으로 본 연구는 다음과 같은 연구 문제를 제기하였다. 1. 정치효능감이 높은 청소년일수록 정치 참여에 적극적인가? 1) 내적 정치효능감이 높은 청소년일수록 정치 참여 행위에 적극적인가? 2) 외적 정치효능감이 높은 청소년일수록 정치 참여 행위에 적극적인가? 3) 내적 정치효능감이 높은 청소년일수록 정치 참여 의지가 클 것인가? 4) 외적 정치효능감이 높은 청소년일수록 정치 참여 의지가 클 것인가? 2. 디지털 리터러시 수준이 높을수록 정치 참여에 적극적인가? 1) 디지털 리터러시 수준이 높은 청소년일수록 정치 참여 행위에 적극 적인가? 2) 디지털 리터러시 수준이 높은 청소년일수록 정치 참여 의지가 클 것인가? 3. 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정치 참 여에 미치는 영향이 클 것인가? 1) 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정 치 참여 행위에 미치는 영향이 클 것인가? 2) 디지털 리터러시 수준이 높을수록 정치효능감이 청소년의 정 치 참여 의지에 미치는 영향이 클 것인가? 첫 번째 질문은 정치효능감이 청소년의 정치 참여에 미치는 영향을 측정하기 위해 설정하였다. 두 번째 질문은 디지털 리터러시 수준이 정치 참여에 미치는 효과를 측정하기 위해 설정하였다. 마지막 세 번째 질문은 디지털 리터러시 수준과 정치효능감이 청소년의 정치 참여에 미치는 상호작용 효과를 측정하기 위해 설정하였다. 본 연구를 통해 다음과 같은 결과를 알 수 있었다. 첫째, 정치효능감이 청소년의 정치참여에 미치는 영향을 검증한 결과, 내적 정치효능감이 청소년의 정치참여에 유의미한 영향을 미치고 있었다. 상세하게 살펴보면, 내적 정치효능감이 정치 참여 행위와 정치 참여 의지에 유의미한 영향을 미치는 것으로 나타났다. 반면에 외적 정치효능감은 정치 참여 행위와 정적인 영향 관계를 보이지만, 그 값이 유의미 하지는 않았다. 외적 정치 효능감은 청소년의 정치 참여 의지에는 유의미한 영향을 주는 것으로 나타났다. 정치효능감과 정치 참여 전체를 대상으로 한 회귀 분석에서는 정치 효능감이 정치 참여에 유의한 것으로 나타났다. 둘째, 디지털 리터러시는 정치 참여 행위와 정치 참여 의지에 유의미한 영향을 끼치는 것으로 나타났다. 디지털 리터러시가 정치 참여에 유의한 영향을 끼친다는 결론은 디지털 세대인 청소년들에게 커다란 의미를 가진다. 청소년들은 디지털 미디어를 통해서 정치에 관한 정보를 접하고, 정치에 참여한다. 따라서 디지털 리터러시 함양을 위한 정치 교육 자료를 개발하고 활용할 필요성을 말해 준다고 볼 수 있다. 특히 연구대상이 된 청소년들에게 디지털 리터러시를 정보 활용 능력, 비판적 사고 능력, 의사 소통 능력, 규범 준수 능력의 하위 요인으로 구분하여 질문하였기에 이와 같은 하위 요인에 포함된 리터러시 능력을 키워주는 일이 중요하다고 하겠다. . 셋째, 정치효능감과 디지털 리터러시 수준의 상호작용 효과를 살펴본 결과, 그 영향력이 크지 않아 모든 가설이 기각되어 정치 효능감과 디지털 리터러시가 정치 참여에 유의미한 상호 작용 효과를 가지지는 않는 것으로 나타났다. 이러한 연구 결과를 바탕으로 청소년의 정치 참여 활성화를 위한 몇가지 교육적 제안을 하고자 한다. 첫째, 청소년들은 정부의 반응에 따라 정치 행위에 참여하기보다는 본인이 정치에 영향을 끼칠 수 있다는 믿음에 따라 정치 행위에 참여하는 것으로 보인다. 따라서 청소년의 내적 정치효능감을 키울 수 있는 정치 교육 자료를 계발할 필요성이 있다. 둘째, 본 연구에서는 디지털 리터러시 수준이 청소년의 정치 참여 행위와 정치 참여 의지에 모두 긍정적인 영향을 끼치는 것으로 나타났다. 이는 디지털 미디어를 적극 활용한 정치 교육에 대해서 많은 자료를 개발하고 활용할 필요성을 말해 준다고 볼 수 있다. 셋째, 청소년의 정치 참여를 위한 교육적 지원 방안 또한 필요하다. 청소년 중에서도 고등학생은 성인이 되기까지 1∼3년 남은 준 성인에 해당한다고 할 수 있다. 실제 만 18세 이상의 고등학생은 참정권까지 보장받았다. 그러나 청소년을 대상으로 하는 정치 교육은 학교 교육 외에는 선거연수원에서 실시하는 '민주주의 선거교실'이 유일하다. 그리고 고등학교 통합 사회에는 정치 참여와 관련한 단원이 없고, 정치와 법은 선택 과목으로 10% 미만의 학생만 수업을 듣는다. 따라서 고등학생들의 정치 참여를 위한 첫 번째 방안으로 고등학교 통합사회 안에 정치 참여와 관련한 단원을 포함시켜야 한다. 주요어 : 청소년, 정치효능감, 디지털리터러시, 정치참여 학 번 : 2017-29900 ; Abstract The Effect of Political Efficacy and Digital Literacy on Adolescents Political Participation Inhae, Song Department of Social Suties Education The Graduate School Seoul National University In the revised social studies curriculum of 2015, democratic citizens are those who develop democratic values based on knowledge and participate with a sense of responsibility. Therefore, it can be said that raising students who are actively participating is a core element of social studies. In recent years, in terms of the political climate of our society, adolescents who participated in the election of the National Assembly directly appeared after the election age was reduced to 18, and the number of adolescents participating in candlelight vigils and Internet petitions is increasing. According to previous studies, it can be seen that political efficacy is a major factor influencing adolescents's political participation. Political efficacy is a direct motivation for individuals to participate in politics. It is said that individuals with high political efficacy have a strong willingness to participate in politics and actively participate in political activities such as voting. Adolescents needs literacy to become a meaningful activity and exercise of rights. In particular, digital literacy is indispensable in times of increasing political participation through digital media such as these days. Digital literacy refers to the level of critical thinking required by all users to properly evaluate the value of information found on the Internet, and the ability to understand and use various types of information found from various sources and to newly combine it for their purposes ( Gilster, 1997). The purpose of this study is to examine the effect of adolescents' political efficacy and digital literacy level on political participation, and to examine whether digital literacy level acts as a moderating variable in the relationship between political efficacy and political participation. The purpose of this study is to contribute to finding ways to actively participate in politics of adolescents in the use of digital media. Based on the above problem recognition, this study raised the following research problems. 1. Are adolescentss with higher political efficacy active in political participation? 1) Are adolescentss with higher internal political efficacy active in political participation? 2) Are adolescentss with higher external political efficacy active in political participation? 3) Is the willingness to participate in politics greater as the adolescents with higher internal political efficacy? 4) Is the willingness to participate in politics greater for adolescents with higher external political efficacy? 2. The following results were found through this study. First, as a result of examining the effect of political efficacy on adolescents's political participation, it was found that internal political efficacy had a significant effect on political participation behavior and willingness to participate. On the other hand, it was found that external political efficacy had no significant effect on political participation, but only on the will of political participation. Political efficacy was found to be significant in political participation in the regression analysis of political efficacy and political participation. Second, digital literacy was found to have a significant effect on political participation and willingness to participate. 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. Some might, with good reason, conclude from the results of the negotiation that the existing major parties were concerned only for their upcoming struggle for power and thus made haste for an insufficient outcome. But on the other side, this course of revision led the Constitution to become stable in spite of periodic interchange of power between the political factions. This enabled people to compare the performances between the factions under largely static insitutional settings, and then choose between them to hold the worse one politically responsible. 학위논문 (박사) -- 서울대학교 대학원 : 법학전문대학원 법학과, 2020. 8. 전종익. ; 우리나라의 제9차 개정헌법인 현행 헌법으로의 개정이 이루어진 지 만 32년이 지난 지금, 당시 헌법개정을 둘러싼 논의가 어떠한 과정을 통해 이루어지고 그것이 어떻게 지금 우리에게 적용되고 있는 헌법규정들을 낳았는지를 구체적으로 확인하는 일은, 그 해석을 위한 자료를 제공할 수 있을 뿐 아니라 그 양상에 대한 평가를 통해 현행 헌법 그 자체에 대한 평가를 보충할 수 있을 것으로 기대된다. 그리하여 이 연구는 최근까지 나온 사료들을 가급적 망라하여 개별 헌법규정들의 개정논의 과정을 재구성하고 그 부문별 양상을 고찰함으로써 개정의 의미내용에 대한 평가를 시도한다. 새로운 헌법에 대한 필요는 유신헌법에 이어 국민의 의사와 국가권력의 성립·유지가 괴리되어 있었던 1980년 헌정체제의 성격으로부터 제기되었다. 그러나 기존 헌법상의 절차에 따른 개헌은 종전 집권세력과의 공존을 수반하는 것이었기 때문에, 헌법문제의 해결을 위한 대안으로 처음부터 대통령직선제 개헌이라는 방편에 대한 사회적 합의가 이루어지지는 못하였다. 직선제를 향한 요구와 그에 대한 수용으로 그에 대해 여야뿐만 아니라 범사회적인 합의가 이루어지는 것은, 전두환 정권과 그에 대한 저항세력 모두 기본적인 정치체제에 대한 여타의 대안을 각자 제시하고 그 모두를 서로 받아들일 수 없음이 분명해진 뒤에 비로소 가능했다. 여야 정당들과 기타의 사회주체들 모두 개헌시안을 마련함에 있어서 시민사회의 요구를 광범위하게 반영하는 구체적인 구상을 제시하지 못하였고, 그보다는 종전의 구상들을 답습하거나 임시방편적으로 수용하는 경향을 보였다는 점을 확인한다. 이는 양대 정당의 경우 정권의 획득이나 유지가 보다 중요했기 때문이라고 볼 수도 있다. 하지만 보다 근본적인 관점에서 이는 강력한 물리력을 배경으로 정부가 국민의 자유의사에 따른 개헌을 가로막는 한 아무리 구체적으로 개헌구상을 입안하더라도 그것이 현실화할 전망이 없기 떄문이기도 하였다. 연구의 후반부를 이루는 각 헌법 부문별 논의 과정은 1987년 초반부터 야당뿐 아니라 저항세력 전반에까지 수렴된 대통령직선제 개헌이라는 대안이 정부와의 극한대립 끝에 6. 29 선언을 통한 수용으로써 합의로 넘어간 당시의 상황을 반영한다. 헌법의 기본성격, 그리고 헌법을 통해 보호해야 할 영역을 획정하는 것으로서 정치제도 못지않은 중요성을 지니는 전문과 기본권에 대하여는 양대 정당의 의견이 서로 과정과 내용의 면에서 모두 대체로 대등한 수준에서 반영되었다. 특히 전문에 관한 양대 정당의 논의는 양자의 어느 쪽도 정치적 우위를 점하지 못하고 중립적인 타협을 이룬 새 헌법의 성격을 잘 보여준다. 한편 정치제도에 관하여는 국회해산권의 폐지나 국회의 일부 권한에 관하여 치열한 논쟁이 벌어지기도 하였지만, 결국 국회의 국정감사권과 헌법소원제도가 헌법상 규정된 등의 몇몇 성과를 논외로 하면 전반적인 수준에서 국회나 정부의 지위에 대한 변혁이 이루어졌다고 보기는 어려운 것으로 평가된다. 이와 같은 개헌논의의 결과에 대하여는 기성의 양대 정당이 정권획득을 둘러싼 경쟁질서에만 관심을 가졌기 때문에 급속하고 불충분한 타협만이 이루어졌다는 평가도 가능할 것이나 다른 한편 현행 헌법은 이로써 이후의 정권교체에 불구하고 안정성을 확보할 수 있었다. 이는 국민의 선택에 따라 정치적 책임을 지는 집권세력이 국민의 기본권으로부터 통제되는 헌법으로서의 규범력이 강화된 만큼, 종전의 헌정체제들과 달리 현행의 체제에서는 국민의 책임성 또한 강화되었음을 간과해서는 안 될 것이다. ; 32 years have passed since the 9th revision to the current Constitution in 1987. The author deems the time ripe enough to say that now we give a careful look into how this Constitution was deliberated in what process, and how it led to the provisions that apply to our lives today. Hopefully it can provide new grounds for interpretation thereof, as well as tools to supplement previous evaluations on the Constitution at large, with retrospect to the general trends of the discussion. As no small amount of historical records have been disclosed recently, this study attempts to make as extensive use of them as available, so to reconstruct the discussions pertaining to each provisions amended, and to set forth a reevaluation of the implications to the revision itself, based on contemplations on the tendencies of discussions on each constitutional sphere. A successor to the Yushin system, the 1980 constitutional system formulated and buttressed the Chun Doo Hwan regime which was divored from the will and support of the people, and that was the main source of the necessity to found a new constitutional regime. However, in which way to achieve this was the question unsolved up to 1986. A revision following the existing constitutional procedures leaving the current ruling clique intact was not readily accepted by the resisting social groups as an alternative, whether or not it provided for direct presidential election. It was acknowledged as the only choice only after both the Chun regime and resisting groups had exhausted all other alternatives and it became mutually clear that neither of them could accept any other option. In the course of the struggle before constitutional revision with direct election was mutually accepted, the dynamics among and inside each of the major political actors including the leading parties and other social movements show that they had failed to incorporate the various social needs into their designs, and rather chose to follow previous lines or adopt a new one only as an expedient measure. It should be admitted that, at least for the political parties, taking or retaining power was the primary issue at hand. But we would also have to admit that as long as the strong military government denied the possibility of constitutional change based on the will of people, the more 'realistic' vision that a constitutional plan could give was a prospect of political change, which could only then realize other more pluralistic needs. After the June Uprisings had exhausted all other alternatives for Chun regime, time left for deliberation on the content of Constitution was no longer than a month and a half. A detailed retrospect and a phased-in induction on the tendency shows that the negotiation, in its process and content as well, was tailored to make a roughly equal balance between the two major participants. The pattern of constitutional provisions largely attests to this. The preamble, initially a symbolic battlefield of political powers, was diluted to signify more neutral values. Discussion on fundamental rights was, with a few exceptions where major political interests were involved, a relatively smooth interchange of mutual suggestions, which led to an accommodation at least to the most urgent needs raised in the Chun regime. As for political institutions, the most urgent questions were tacitly solved as the plans of both parties accorded to each other. Thus relatively residual needs were answered in the course of negotiation, which led to a few institutional progress including parliamentary power to inspect the government and the newly devised jurisdiction for constitutional complaint. But aside from those, neither legislative or administrative power can be said to have been subject to thorough change. 학위논문(박사)--서울대학교 대학원 :환경대학원 환경계획학과,2020. 2. 윤순진. ; The current national energy policy in Korea concerns promoting energy transition, focusing mainly on the increase of renewable energy, which requires the decentralization of energy administration. Although the experience of the local government system has been accumulated through the past seven local elections, the energy policy has been adopted mainly by the central government. Recently, Seoul has insisted on taking responsibility as an energy-consuming city and actively adopted energy-transition policies. As a part of the energy-transition policy, Seoul has focused on solar energy, a renewable source of energy feasible for large cities. Seoul set out to expand its distribution of solar energy, and has adopted the 'Mini-PV subsidy policy', which consists in providing subsidy for installing solar panels in small spaces. The Mini-PV subsidy policy has been nationally diffused, since it started in Seoul in 2014. The voluntary diffusion led to the policy enforcement at the level of the central government in 2017, which counts as an upward diffusion, and the central government's policy has been diffused to local governments. In March 2019, the budget for mini-PV subsidy has been curtailed in the Congress, which led five metropolitan councils to discontinue the policy. The policy diffusion among local governments has seen a rapid surge until 2018 but has been decreasing afterwards. Although the number of local governments implementing the mini-PV subsidy policy reduced from 153 to 104 in 2019, the number of subsidized households has increased compared to the previous year. This indicates that the "snowball effect"has taken place, which is a characteristic feature of policy diffusion. As the number of local governments increased, the central government has enforced the mini-PV subsidy policy in 2017 and 2018, which triggered the nationwide diffusion and made it possible for the policy to continue to be implemented even without the enforcement at the level of the central government. The spatial autocorrelation of mini-PV subsidy policy shows that Seoul, Incheon, the capital area in the South Gyeonggi Province, and some regions in Busan, formed a hot-spot cluster. The size of the hotspot in the capital area has decreased in 2019, while the hotspot in Gyeongnam, centered around Busan, has expanded. This result runs contrary to the research trend in foreign policy diffusion, according to which policy diffusion's forming a geographic cluster is outdated. The reason for this can be as follows: Korea has a small land area; around 50% of the population lives in the capital area; and it is adjoining a government that is socioeconomically similar. The policy diffusion route reveals that a vertical diffusion has taken place from metropolitan cities to the central government. As for horizontal diffusion, there has been diffusion based on geographic adjacency and socioeconomic similarities. The likelihood of the mini-PV subsidy policy diffusion turned out to be proportional to the population, income, the rate of mini-PV household in the previous year, the number of the Democrats in councils. Local governments can be put into four different categories, depending on whether they voluntarily adopted the subsidy policy. Taking this as a dependent variable, I have investigated the factors of policy diffusion. As for the political factor, it turned out that the more committed the governor is to energy transition, the more likely it is for the policy to be voluntarily adopted. As for the socioeconomic factor, the education level, the proportion of apartments, and the number of civil servants had a positive effect on the probability of the voluntary adoption of the mini-PV policy. Whereas local governments with sufficient executive and administrative resources, such as metropolitan cities and major cities, voluntarily decide on adopting the policy, other local governments are more likely to conform to the decision made by the higher authorities. Since the policy adoption by the higher authorities and the financial support have influence on the policy adoption by local governments, it is important to establish an energy transition policy at the provincial level. Moreover, the governors should be committed to energy transition and related policies. The governors should identify the kind of renewable energy that is appropriate for their areas and adopt consistent policies to expand its use.
