This book deals with expropriation and other measures affecting property rights as set out in the awards of the Iran-U.S. Claims Tribunal, and thus examines the relation between general international law and the lex specialis, viz., the provisions of the Algiers Declarations and the Treaty of Amity between the Governments of Iran and the United States. It studies what rights have been considered as property rights capable of being independently expropriated or affected by other measures, and what rights have not been so qualified, although they might have been considered as forming an element of valuation. Furthermore, the liability and attributability issues are discussed, as are the methods of compensation and of valuation
For decades, local governments have used the power of eminent domain to evict low-income residents across the United States. Reversing this trend of government-sanctioned displacement, the City of Richmond, California has developed an innovative use of eminent domain to keep residents in their homes and prevent foreclosure. By using the power of eminent domain to purchase underwater mortgages developed during the housing bubble at today's market value, Richmond could save residents thousands of dollars and allow them to stay in their homes. This approach has met with strong resistance from Wall Street, where these mortgages have become profitable investment vehicles. 2013 Summer. ; Includes bibliographical references. ; As an artist with a background in politics, my work is propelled by a need "to do something". I am particularly interested in the crossroads of action and inaction. My work history, the political actions I have organized and participated in, and my transition to the art world lead up to my final body of work. Domain: Eminent is an installation of abstracted claw forms that is a reliquary to fossil fuels. The dueling political tensions between curbing climate change and expanding economic prosperity inspired and motivated this work. The installation honors the beauty and benefits these fuels have brought to our world while at the same time symbolically putting them in their "restful" space as an untouched material.
