En este artículo se procura dar cuenta del proceso generado a partir de la sistematización de la experiencia del programa Rafaela Más Sustentable, desarrollado en Rafaela (Santa Fe, Argentina) y liderado por el Gobierno Municipal. Con ese fin se presentan algunas de las dimensiones más importantes de la investigación realizada, con especial énfasis en los aprendizajes surgidos desde la puesta en marcha de esta política ambiental territorial, en el año 2008, hasta la creación del Instituto para el Desarrollo Sustentable, a fines de 2015, como hito fundamental que da cuenta de la consolidación y la permanencia de esta política pública. ; This article intends to give an account of the systematization process of the "More Sustainable Rafaela Program", developed in Rafaela, Santa Fe, Argentina, and led by the Municipal Government. To this end, we present some of the most important dimensions of the research carried out, with special emphasis on the learning that emerged from the implementation of this territorial environmental policy, from its beginnings in 2008 to the recent creation of the Institute for Sustainable Development at the end of 2015, as a fundamental milestone accountable for the consolidation and permanence of this public policy. This reflective article considers the design of environmental policies in Colombia, which has focused on the use of natural resources as pool of materialsand energy to generate economic growth. In this sense, it becomes clear thatcollective concern for environmental supply management as cornerstone for sustainable development established in the political constitution, has failed mainly by the reagent and coercive approach to policies and regulations coupled with little promotion for the transformation of national consumer life style, this has generated a rebound effect increasing use and consumption of natural resources (especially non-renewable) limiting energy efficiency; for example, this can be seen in the national mining and energy sector. Whereas there is a global concern for sustainability, it is necessary that the design of national environmental policies away from the economic and technological optimism of the current economic model and certainly incorporate in their political the strategies that balance the relationships between supply and demand of environmental services that support national development, while encouraging the responsible consumption in the Colombian population, in addition to include the community initiatives on regulation and social inclusion in the management of environmental godos and services to generate strong sustainability processes. ; En este artículo de reflexión, se analiza el diseño actual de las políticas ambientales en Colombia, las cuales se han centrado principalmente en el aprovechamiento de los recursos naturales como fuentes de materiales y energía para generar crecimiento económico. En este sentido, es evidente que la preocupación colectiva por el manejo de la oferta ambiental, como base para el desarrollo sostenible establecido en la Constitución, no ha logrado implementarse de forma efectiva, principalmente por el enfoque reactivo y coercitivo de las políticas y normativas vigentes, aunadas a un escaso fomento para la transformación del estilo de vida consumista nacional, situación que ha generado un efecto rebote incrementando los niveles de uso y consumo de los recursos naturales (especialmente de los denominados no renovables) y limitado la eficiencia energética; por ejemplo, esto puede observarse en el sector minero-energético nacional. Considerando que existe una preocupación global por la sostenibilidad, es necesario que el diseño de las políticas ambientales nacionales se aleje del optimismo económico y tecnológico del modelo económico vigente e incorpore, de forma cierta en sus políticas, estrategias que permitan equilibrar las relaciones de oferta y demanda de los servicios ambientales que sustentan el desarrollo nacional, alentando, al tiempo, el consumo responsable de la población colombiana, además de atender las iniciativas comunitarias de regulación e inclusión social en el manejo de los bienes y servicios ambientales para generar procesos de sostenibilidad fuerte.
Hace falta para América Latina y específicamente para Colombia, mayor desarrollo de marcos analíticos dirigidos al entendimiento de la relación entre Estado, sociedad y entorno, y al desarrollo del análisis de políticas públicas como disciplina. El presente artículo aporta al desarrollo de estos análisis, estudiando el cambio de la política ambiental colombiana después de la promulgación de la ley 99 de 1993 1 . Se sigue para ello el enfoque de las "Tres I", que reivindica la conveniencia de movilizar tres dimensiones de análisis, usadas comúnmente de forma separada en los análisis políticos: las ideas, los intereses y las instituciones; para evitar considerar, a priori, que alguna de las dimensiones prima sobre las demás, como lo hacen las corrientes clásicas de análisis de políticas públicas. (Heclo, 1994; Hall y Taylor, 1996; Palier y Surel, 2005). Se plantea la hipótesis de que el análisis desde cada dimensión es suficiente para explicar completamente el cambio de la política. Los resultados son contrastados posteriormente para verificar la validez de la hipótesis y se identifica el tipo de relación sobreviniente entre las tres dimensiones, así como su capacidad explicativa. Se concluye sobre la conveniencia de desarrollar herramientas analíticas desde contextos latinoamericanos y de hacer uso de enfoques que superen los límites comunes de las disciplinas e incluso los marcos clásicos de análisis. Se propone para ello, el uso de la teoría de campos de Pierre Bourdieu (Bourdieu, 1976:112). ; A higher development of analytical frameworks for the understanding of the relationship amongst State, society and environment, and for the development of policy analysis as a discipline, is necessary for Latin America and specifically for Colombia. This article contributes to de development of these analyses, by studying the change of the Colombian environmental policy after the enactment of the 99 law of 1993. The "three I" framework is used, which stands for the convenience of mobilizing the three dimensions of analyses, commonly used in a separate way in politic analyses: ideas, interests and institutions; to avoid considering, a priori, that any of them is more important than the others, as the main stream of policy analyses does (Heclo, 1994; Hall and Taylor, 1996; Palier and Surel, 2005). The hypothesis that the analysis from each dimension is enough to fully explain the policy change is stated. The results are then compared to verify the validity of the hypothesis. The resulting relationship amongst the dimensions and their explicative capability is identified. A conclusion is drawn on the convenience of developing analytical tools from Latin American contexts and the use of frameworks that overcome the common boundaries of disciplines and classical analytical frameworks. For that, the use of Pierre Bourdieu"s theory of fields is proposed.
This document has as its main purpose the review of various theoretical issues regarding the relationship between environmental policy and post-agreement in Colombia seen from the perspective of corporate social responsibility. The general agreement for conflict termination and peace building, and a relational analysis of the ONU seventeen goals of Sustainable Development, as well as the main guidelines on the subject proposed by the Colombian government, has been addressed in this paper. The findings seek for attention of the challenges ahead posed by the subject of study and the general alternatives analyzed. ; Este documento tiene como propósito general la revisión de diversos aspectos teóricos de la relación entre política ambiental en Colombia y el pos-acuerdo, vista desde la perspectiva de la Responsabilidad Social Empresarial (en adelante RSE). Se aborda el acuerdo general para la terminación del conflicto y la construcción de la paz, y se hace un análisis relacional de los diecisiete objetivos del desarrollo sostenible que plantea la Organización de Naciones Unidas, así como de las principales directrices que, en el tema, ha propuesto el Gobierno Colombiano. Los hallazgos buscan llamar la atención frente a los retos de los escenarios por venir que plantea el objeto de estudio y se analizan alternativas generales.
Las transformaciones productivas y territoriales ocurridas en el agro latinoamericano y argentino desde finales del siglo XX han dado lugar a crecientes disputas en torno al ambiente y al uso y aprovechamiento de los "recursos naturales". En noviembre de 2007 fue sancionada en Argentina la Ley Nacional Nº 26.331 ("de bosques"), instando a cada provincia a realizar un Ordenamiento Territorial de Bosques Nativos. This paper looks at environmental damage definition stipulated by Peruvian General Environmental Law as well as its implications for the environmental policy development. It also outlines complexities involved identifying environmental damage as much as designing and implementing public policies according to Peruvian legislation processing. ; El presente ensayo analiza la definición de daño ambiental querecoge la Ley General del Ambiente, así como sus implicancias para el desarrollo de la política ambiental. Describe las complejidades presentes en la identificación del daño ambiental así como en el diseño y aplicación de las políticas públicas relacionadas a su tratamiento en la legislación peruana.
Since the 1990s, Latin America has experienced an expansion of trade and investment regimes that suggest important challenges for environmental management. This document argues that, in order to favour export oriented sectors and attract foreign investment, these trade regimes may: i) Influence environmental management to reflect the needs of the trade community; ii) Superimpose investment rights and protection measures upon public environmental concerns and national environmental laws; iii) Erode the capacity of governments and the willingness of decision-makers to approach key environmental problems that result from trade and investment activities. The representative cases of NAFTA and Mercosur are analysed.
The need for an environmental foreign policy in Ecuador derives from the global character of environmental issues, the country's responsibility towards its privileged mega diversity, the unavoidable link between poverty and environmental degradation as well as from international commitments. While an environmental foreign policy must be centrally commanded by a government agency, it should be designed through a participatory process capable of engaging all the actors who are actually involved in environmental issues. This article suggests several concrete themes that should be part of the Ecuadorian environmental international agenda. ; La necesidad de una política exterior ecuatoriana en lo ambiental surge de la naturaleza global del medio ambiente, de la responsabilidad del Ecuador como país privilegiado por su megadiversidad, de la vinculación inevitable entre la pobreza que le aqueja y la degradación del ambiente y de los compromisos internacionales por él adquiridos. Una política exterior ambiental debe resultar de un proceso de diseño en que participen todos los actores de la temática ambiental, aunque su ejecución debe estar centralizada en un órgano gubernamental. Se sugieren algunos temas específicos que deberían formar parte de una agenda internacional del Ecuador en lo ambiental.
The article discusses the theoretical and methodological problems of actively developing in modern conditions ecological culture, determining its place in the system of humanities. The growing importance of new conception of scientific research and sociocultural practices in the context of the global problems of our time is determined.It is necessary to know the experts' opinion which environmental problems are being identified as most significant. Only afterwards we can find the ways to solve them. Thereby based on the analysis of materials of the Russian scientific-practical conference with international participation "Environmental protection as a factor of the socio-economic development of municipalities: experience and problems" (2017, Rostov-on-Don, Kurgan), and the results of the Russian expert opinion research conducted by scientists of Rostov scientific elitological school it was concluded that there is an objective necessity to create a unified structure of natural resource management and environmental protection in territorial entities (Vorontsov, Mamychev, Ponedelkov, Yanguzin and Vildanov, 2017; Ponedelkov, Starostin, Mamychev, Grigoryan and Verenich, 2018). At the same time, the prerequisites and trends, the problematic aspects of the development of environmentally-oriented processes in modern Russian conditions determine that the organization of an effective environmental protection policy as a factor of socio-economic development and mechanisms of the implementation its strategic goals in the field of environmental development existing public administration system is possible only if appropriate conditions are created for the dynamic development of the system of environmental education and upbringing, as well as the necessity of developing the implementation of a new civilizational paradigm as a new eco-human behavioral paradigm
This work presents several different points of view regarding the role of environmental innovation as the driving force of public policy designed to promote sustainabilityand reduce environmental impacts. Environmental innovation is analyzed byexamining concrete practices such as sustainable design, green branding, eco-labeling, the use of medicinal plants, and improved plant varieties, among other things, and the individual and collective intellectual property rights that protect and promote these kinds of innovations. While this thematic diversity is directly proportional to the complexity of the author's presentation, it does not detract from the conceptual unity of the text. On the contrary, by examining the concepts as applied in a variety of contexts, the author highlights not only the challenges that must be faced in order to protect the general interest, but also proposes alternative solutions that promise to improve the structure, emphases, and priorities of these rights. This work represents the culmination of a valuable research project that benefited from the cumulative experience of the author and will be of great interest to scholars in the field, It is an important theoretical contribution to the formulation of strategies for environmental mitigation, adaptation, and recovery.
In today's Ecuador, historically, in the provinces of Manabí and Esmeraldas on the Coast; Azuay and Cañar in the Sierra, were the most developed mining. In the decades of the 80s and 90s, the British Mission performed geological research in the Eastern (Real) and Western Ranges, concluding with the publication of maps at different scales. The competencies of the Sector Ministry are to exercise the rectory of the public policies of the geological-mining area, to issue the administrative agreements and resolutions that require their management; Evaluate policies, plans and projects for the development of the mining sector; Define, in coordination with the governing body of national planning, the National Development Plan for the Mining Sector. The Mining Law, in force since January 2009, established a new institutional structure, made up of: Sector Ministry (Ministry of Non-Renewable Natural Resources), considering Artisanal Mining and Small-scale Mining. For 2012, Ecuador initiated large-scale mining activities. The Ecuadorian Government, through the National Secretariat for Planning and Development (SENPLADES), defined five strategic mining projects: Fruta del Norte, Mirador, Project awarded to the company Gold Gold, Río Blanco and Panantza San Carlos. Prior to their exploitation, concessionaires of these projects must sign a mining contract with the State. The environmental aspect considers: Direct or indirect impact on the environment. Depending on the effect; Short or long term. Be reversible or irreversible. The five projects, plus the Llurimagua project, located in Imbabura, should attract investments of about USD 8 billion up to 2024, presenting optimism for the mining industry, but the challenges are in mitigating environmental impacts and training productive labor. ; En el Ecuador de hoy, históricamente, en las provincias de Manabí y Esmeraldas en la Costa; Azuay y Cañar en la Sierra, fueron las que más desarrollaron la minería. En las décadas de los 80s y 90s la Misión Británica realizó trabajos de investigación geológica en las cordilleras Oriental (Real) y Occidental, concluyendo con la publicación de mapas a diferentes escalas. Las competencias del Ministerio Sectorial son ejercer la rectoría de las políticas públicas del área geológico-minera, expedir los acuerdos y resoluciones administrativas que requiera su gestión; evaluar las políticas, planes y proyectos para el desarrollo del sector minero; definir en coordinación con la entidad rectora de la planificación nacional, el Plan Nacional de Desarrollo del Sector Minero. La Ley de Minería, vigente desde enero de 2009, estableció una nueva institucionalidad, conformada por: Ministerio Sectorial (Ministerio de Recursos Naturales No Renovables), considerando La Minería Artesanal y La pequeña Minería. Para 2012, Ecuador inició actividades mineras a gran escala. El Gobierno ecuatoriano, a través de la Secretaría Nacional de Planificación y Desarrollo (SENPLADES), definió cinco proyectos mineros estratégicos: Fruta del Norte, Mirador, Proyecto concesionado a la empresa lam Gold, Río Blanco y Panantza San Carlos. Previo a su explotación, los concesionarios de estos proyectos deben firmar con el Estado un contrato de explotación minera. El aspecto ambiental considera: Impacto directo o indirecto sobre el medio. Según sea el efecto; a corto o largo plazo. Sea reversible o irreversible. Los cinco proyectos, más el proyecto Llurimagua, ubicado en Imbabura, deberían atraer inversiones por cerca de USD 8000 millones hasta 2024, presentándose un optimismo de la industria minera, pero los desafíos están en mitigar los impactos ambientales y capacitar la mano de obra productiva.

Los resultados del "1º Taller Provincial de Educación Ambiental" en Mendoza en 1996 han sido punto de partida para que el Instituto CIFOT de la Universidad Nacional de Cuyo desarrolló el poster educativo Cuyún con el título "Mendoza es tu naturaleza. Sé tú como el Cuyún." La Cooperación Técnica Alemana financió en 1998 la edición de 40.000 unidades para su distribución en las escuelas de la Provincia. El objetivo del poster era difundir los conocimientos geográficos sobre el territorio mendocino y alertar sobre la problemática ambiental existente. Cuyún entonces fue adoptado por parte del gobierno provincial como mascota oficial del medio ambiente. Actualmente los problemas ambientales son más diversos que en la época de los 90. El cambio climático tomó un protagonismo importante en todo el mundo. En el año 2007 la Agencia de Cambio Climático creada dentro del Gobierno de la Provincia y La UNCuyo investiga sobre la aplicación de tecnologías de energías renovables. 18 profesionales de la UNCuyo e instituciones del Gobierno de la Provincia retomaron el éxito histórico del Cuyún. La imagen de la mascota fue modernizada. Bajo el título "Mendoza es tu casa – Ayuda al Cuyún en la lucha contra el cambio climático" el poster refleja a partir de 2010 los siguientes temarios: 1) Marco geográfico de la provincia. 2) Hechos y hábitos que contribuyen al cambio climático. 3) Efectos del cambio climático. 4) Acciones en contra del avance del cambio climático. 5) Tecnologías y políticas perdurables en beneficio al uso de energías renovables. 6) Temas ambientales de la Provincia de Mendoza. La Embajada de Alemania en Argentina financió la impresión de 33.000 posters y la Dirección General de Escuelas colabora en la distribución en las aulas de las 1.800 escuelas de la provincia. (2) Facts and habits that contribute to climate change. (3) Effects of climate change. (4) Actions against climate change advancement. (5) Technologies and enduring policies in benefit of renewable energy use. (6) Environmental issues in the Province of Mendoza. The German Embassy in Argentina funded the printing of 33,000 posters and the Schools General Direction collaborates on the distribution in classrooms of 1,800 Province schools. It presents the historical processes that influenced the Environmental Education Policy in Colombia between 2002- 2010, taking as axes the transformation processes of the Ministry of the Environment and the so-called Education Revolution. The research is qualitative, with a historical hermeneutic and the technique used is the documentary research. As a result, it was identified a historical context characterized by economic vision, a warlike position at the expense of social needs and a modification of structural issues at the political system in Colombia. It is concluded that these processes have affected the evolution delay and since the nineteen seventies and especially from the Constitution of 1991, settled in the various attempts to solve environmental problems. ; Se presenta1 el marco histórico de los procesos que incidieron en la Política de Educación Ambiental entre 2002 y 2010 en Colombia, tomando como ejes los procesos de transformación del Ministerio del Medio Ambiente y la denominada Revolución Educativa. La investigación es de tipo cualitativo, con un enfoque histórico-hermenéutico, y la técnica utilizada es la investigación documental. Como resultado, se identificó un contexto histórico caracterizado por una visión economicista, una posición guerrerista en detrimento de las necesidades sociales y una modificación de aspectos estructurantes en el sistema político de Colombia. Se concluye que estos procesos han generado retraso y afectado la evolución que desde la década de los años setenta del siglo XX, y en especial a partir de la Constitución de 1991, se instalaron en procura de solucionar las diversas problemáticas ambientales.
The article addresses the basic concepts of administrative liability for environmental crimes based on international experience and practice through the investigative method of sociological analysis. Administrative sanctions that have a positive effect on the existing legislation of countries and those that have a positive effect only in certain regions were identified. It is argued that there are administrative and legal norms that do not have much influence and effectiveness in addressing environmental problems based on the structural and comparative research methods of the system. The issue of the consciousness of man and society in violation of environmental law is emphasized as a kind of administrative responsibility due to logical-semantic and formal-logical research methods. The key elements of the effectiveness of administrative responsibility in the field of environmental crimes are highlighted. It is concluded that the analysis of the implementation of environmental policy and its relationship with the practice of administrative responsibility for environmental crimes through the use of a dialectical research method ensures maximum efficiency in the identification of the topics of this study.
