The analysis of information sources about the history and current peculiarities of the regulatory framework and functioning of the ethical review system for biomedical research in Lithuania are presented in this paper. The information used in this article has been obtained during the visit of Pakharyna S.V. to the Republic of Lithuania partially supported by the Fogarty International Center, National Institute of Health (NIH), US Grant No.R25 TW007084. It has been found that nowadays there is a two-level system of biomedical research ethical review in Lithuania. In accordance with the local regulatory requirements any biomedical research should be subjected to ethical review and can be started only after receiving the approval from the regional (for local studies) or central (for trials of medicines, medical devices or other multicenter studies) Ethics Committee. The peculiarities of the Lithuanian ethical review system are the legislative framework that is constantly updating and regulating all major types of biomedical research; studies with the broad ethical support and moderate cost of resources; transparency of the Lithuanian Bioethics work. As a result of our analysis a number of approaches for public discussion and implementation in practice of the Ukrainian system of biomedical research ethical review have been suggested. ; Проведен анализ информационных источников об истории создания, современных особенностях регуляторной базы и о функционировании системы этической экспертизы биомедицинских исследований в Литве. Информация, использованная в данной статье, получена в ходе визита Пахарины С.В. в Литовскую Республику при частичной поддержке Международного Центра Фогарти, Национального Института Здоровья (NIH), США, грант №R25 TW007084. Установлено, что в настоящее время в Литве функционирует двухуровневая система этической экспертизы биомедицинских исследований. В соответствии с локальными регуляторными требованиями любое биомедицинское исследование должно быть подвергнуто этической экспертизе и может начаться только после получения положительного заключения регионального (для локальных исследований) или центрального (для исследований лекарственных препаратов, медицинских устройств или других многоцентровых исследований) этического комитета. Особенностями литовской системы этической экспертизы являются: постоянно обновляемая законодательная база, регулирующая проведение всех основных видов биомедицинских исследований, широкое покрытие этическим сопровождением исследований при умеренных затратах ресурсов, прозрачность функционирования Литовского Биоэтического Комитета. В результате проведенного анализа предложен ряд подходов для общественного обсуждения и внедрения в практику украинской системы этической экспертизы биомедицинских исследований. ; Проведено аналіз інформаційних джерел щодо історії створення, сучасних особливостей регуляторної бази та про функціонування системи етичної експертизи біомедичних досліджень в Литві. Дані, наведені в цій статті, отримана в ході візиту Пахарини С.В. до Литовської Республіки за часткової підтримки Міжнародного Центру Фогарті, Національного Інституту Здоров'я (NIH), США, грант №R25 TW007084. Встановлено, що в теперішній час у Литві функціонує дворівнева система етичної експертизи біомедичних досліджень. Відповідно до локальних регуляторних вимог будь-яке біомедичне дослідження повинно бути піддане етичній експертизі і може розпочатися тільки після отримання позитивного висновку регіонального (для локальних досліджень) або центрального (для досліджень лікарських препаратів, медичних пристроїв або інших багатоцентрових досліджень) етичного комітету. Особливостями литовської системи етичної експертизи є: постійно оновлювана законодавча база, що регулює проведення всіх основних видів біомедичних досліджень, широке покриття етичним супроводом досліджень при помірних витратах ресурсів, прозорість функціонування Литовського біоетичного комітету. В результаті проведеного аналізу запропонований ряд підходів для громадського обговорення та впровадження в практику української системи етичної експертизи біомедичних досліджень.

The history of development the ethical and legislative tools for regulation the biomedical research in the states-members of Commonwealth of Independent States (CIS) in the frame of the close collaboration the Forum for Ethics Committees in the Commonwealth of Independent States (FECCIS) and Inter-Parliamentary Assembly CIS (IPA CIS) is demonstrated in this article. The collaboration between FECCIS and IPA CIS stands on the unique experience of IPA CIS in the building of the new, humanistic legislation in the field of health care and on the initiatives of FECCIS to create a single legal space inside and outside of the CIS region. The necessity to promote the dignity, rights, and well-being of human participants in health research was the real reason for creation the Model Law «On the Protection of Human Rights and Dignity in Biomedical Research in the CIS». The process of the law creation, its direction, structure, compliance with international ethical standards and implementation in the local legislation of CIS states are analysed by the main authors of Model Law «On the Protection of Human Rights and Dignity in Biomedical Research in the CIS» and presented in this review. ; Представлены материалы по истории формирования этического регулирования биомедицинских исследований в государствах-участниках СНГ в рамках сотрудничества Форума комитетов по этике государств - участников Содружества Независимых Государств (ФКЭСНГ) и Межпарламентской Ассамблеи государств - участников СНГ (МПА СНГ). Основу сотрудничества составили уникальный опыт динамического правового строительства в сфере здравоохранения, накопленный МПА СНГ, и творческая инициатива ФКЭСНГ по созданию единого этического пространства в региональном и глобальном масштабе. Реальная необходимость наличия действенной нормативной базы по защите прав человека в биомедицинских исследованиях, послужила концептуальным базисом разработки ФКЭСНГ первого законотворческого документа в форме Модельного закона (МЗ) МПА СНГ «О защите прав и достоинства человека в биомедицинских исследованиях в государствах-участниках СНГ», что полностью воплотило гуманитарную миссию ФКЭСНГ по обеспечению этического комфорта для участников исследований. В данной статье разработчиками модельного закона «О защите прав и достоинства человека в биомедицинских исследованиях в государствах - участниках СНГ» освещены и подвергнуты глубокому авторскому анализу процесс создания Модельного закона, его стратегическая направленность, взаимосвязь с международным арсеналом этического регулирования и влияние на становление национального законодательства в сфере защиты прав человека в отдельных государствах СНГ.

The object of the master's thesis is an informed consent of a person for any kind of medical intervention. The main aim of the research is to analyze the issue of consent as a fundamental principle of human rights protection in the field of biomedicine. The main objectives are: to determine the correlation and interaction between the Oviedo Convention and the European Convention on Human Rights; to specify the sources and necessary requirements of consent; to consider historical and modern contexts of sterilization as a form of personal autonomy intervention; to determine significance and criteria of the consent validity in the context of applying sterilization measures to persons belonging to a vulnerable group; to examine the current systems of organ donation and their legal implementation; to identify the legal basis of presumed and informed consent systems as well as their strengths and weaknesses; to analyze presumed consent system in the framework of the European Court of Human Rights. The implementation of these tasks has led the author of this work to a conclusion that, despite the fact that no special mechanisms for the protection of rights related to biomedicine have yet been established at the universal or regional level, effective results have been achieved within the Council of Europe and the European Union. The informed consent of a person is a primary principle, the absence of which will prevent any kind of intervention. Its demand is based on the principle of autonomy, that is to say, respect for a person's ability to make their own decisions about their body. Informing person in a proper way is a crucial element of consent. In certain cases, medical intervention may be performed without the patient's consent. Forced or compulsory sterilization constitute a gross violation of human rights and medical ethics and can be considered as acts of torture and cruel, inhuman or degrading treatment. The main components of this problem are: the lack of adequate legal remedies to obtain redress; the impunity of those who unlawfully perform sterilization; the lack of respectful and effective communication between medical practitioners and women in obtaining informed consent, and the need for an independent committee to examine the full extent of the harm caused by involuntary sterilization. Nowadays, the issue of organ and tissue donation of human origin is regulated by two legal systems (presumed consent and informed consent). Both systems are aimed at solving the problem of shortage of donor organs. However, the system of informed consent is the one which is recognized as more successful because on the one hand it respects personal autonomy and on the other – public interest expressed by an act of good will on the part of the donor. At the same time, one of the main reasons for criticism of the system of presumed consent is that the removal of organs without explicit consent is a violation of bodily integrity and, as a result, autonomy.
