Eine zunehmend größere Zahl von russischen Bürgern wendet sich mit ihren Beschwerden an den Europäischen Gerichtshof in Straßburg. Dies ist Ausdruck der Tatsache, daß sich die Haltung zu den Menschenrechten in Rußland grundsätzlich zu wandeln beginnt. In dem Beitrag werden ausführlich die Europäische Menschenrechtskonvention erläutert und die Aufgaben und Funktionsweise des Europäischen Gerichtshofs beleuchtet. Darüber hinaus wird über die rechtlich angemessene Vorgehensweise bei der Einreichung einer Beschwerde beim Europäischen Gerichtshof informiert.(BIOst-Mrk)
The article deals with a topical question of law and party regulation of inner-party responsibility. The aim of the article is to develop a theoretical concept of two-level regulation of inner-party responsibility. The author`s concept is based on clause 3 of Article 55 of the Constitution of the Russian Federation. The article gives a detailed analysis of modern concepts of restriction of rights and freedoms. It generalizes the enforcement practice of clause 3 of Article 55 of the Constitution of the Russian Federation by supreme juridical institutions. It also describes in short the practice of the European Court of Human Rights. Theoretical conceptions and enforcement practice are the basis of authors concept of regulation of inner-party responsibility, which includes two parts. The first part is aimed to find out grounds of admissibility of state intervention into party relations (criteria of validity and necessity). The second part is aimed to find out limits of state intervention (minimum security criteria and preservation of the essence of law criteria). ; Статья посвящена актуальной на сегодняшний день проблеме правового и партийного регулирования ответственности членов политических партий. Целью статьи является разработка теоретической концепции, применение которой легло бы в основу построения сбалансированного двухуровневого регулирования внутрипартийной ответственности. В качестве нормативной базы для разработки концепции автор предлагает использовать положения ч. 3 ст. 55 Конституции РФ. В статье проанализированы существующие в настоящее время концепции ограничения прав и свобод человека и гражданина. Обобщается практический опыт применения высшими судебными инстанциями положений ч. 3 ст. 55 Конституции РФ в отношении внутрипартийной деятельности. Автор дает обобщенную характеристику европейской концепции ограничения прав и свобод человека и гражданина, применяемую Европейским судом по правам человека. На основании анализа теоретических концепций, а также привлечения отечественной и зарубежной практики правоприменения автор разрабатывает концепцию регулирования внутрипартийной ответственности, включающую две системы критериев. Первая система критериев направлена на выявление допустимости государственного вмешательства в сферу внутрипартийных отношений (критерии обоснованности и необходимости ограничений). Вторая на выявление пределов государственного вмешательства (критерии минимальной достаточности ограничений и недопустимости искажения существа ограничиваемого права).
The subject. The article examines the refraction of the doctrine of legal procedure in relation to the activities of parliament.The purpose of the article is to confirm or disprove hypothesis that parliamentary procedure is the kind of legal procedureThe methodology. The author uses formal legal interpretation of Russian legislative acts and decisions of Russian Constitutional Court and European Court of Human Rights as well as such general scientific methods as analysis, synthesis, systemic approachThe main results, scope of application. The author draws attention to the fact that at the present stage of the development of the theory of law, it can be stated that procedural social relations have developed in the parliamentary bureaucracy, which are not only regulated, but must also be regulated by procedural norms, which confirms the conclusions of the authors of a "broad" approach to the theory of legal process. However, there will be a window of opportunity for the supporters of the "narrow" approach in the parliamentary process. In accordance with the conclusions of the ECHR and the Constitutional Court of the Russian Federation, which have prerequisites even in the works of Montesquieu, the parliament, as a body with jurisdictional powers, must comply with the appropriate procedure in their implementation. Hence, the author deduces the tasks of further improving both the doctrine of parliamentary procedure and the need for clear and competent regulation of legal procedures in parliament, the ultimate goal of which is to observe and implement the rights, freedoms and constitutional guarantees of participants in the parliamentary process.Conclusions. The procedures governing the work of the Parliament and its organs are legal procedures in the broad sense of the term. This does not negate the understanding that the legal procedures of the parliament, corresponding to its quasi-judicial powers, has the nature of the jurisdictional process. This conclusion is consistently confirmed in the jurisprudence of the European Court of Human Rights and the Constitutional Court of the Russian Federation. ; Рассматривается преломление учения о юридической процедуре применительно к деятельности парламента. Внимание заостряется на том, что на современном этапе развития теории права можно констатировать, что сложились процессуальные общественные отношения в парламентской бюрократии, которые должны быть урегулированы процессуальными нормами, что подтверждает выводы авторов «широкого» подхода к теории юридического процесса. Однако и для сторонников «узкого» подхода в парламентском процессе найдется окно возможностей. В соответствии с выводами ЕСПЧ и Конституционного Суда РФ, имеющими предпосылки еще в работах Монтескье, парламент как орган, обладающий юрисдикционными полномочиями, – должен при их реализации соблюдать соответствующую процедуру. Отсюда выводятся задачи как дальнейшего совершенствования учения о парламентской процедуре, так и четкого и грамотного регулирования юридических процедур в парламенте, конечной целью которых является соблюдение и реализация прав, свобод и конституционных гарантий участников парламентского процесса.
В статье правозащитная деятельность рассматривается как явление, составляющее неотъемлемую часть правового общества. Выявляются проблемы теоретического и практического характера, связанные со сложностями в данной сфере, вызванные как пандемией COVID-19, так и иными причинами. Предпринята попытка оценить правовые и морально-нравственные стороны столь необходимой деятельности на современном этапе развития общественных отношений, уделяется внимание позиции международных органов относительно правозащитной деятельности, ее целям и задачам. Важность и актуальность темы объясняется тем, что, по мнению самих правозащитников, вся система защиты прав человека, созданная после одного из самых страшных периодов в современной мировой истории, переживает на данном историческом этапе кризис, который все больше обостряется под влиянием многочисленных проблем политического и экономического характера. Военные конфликты, миграция, пандемия ярко демонстрируют очевидную необходимость обращения к вопросу сущности правозащитной деятельности, в том числе ее морально-нравственной составляющей. ; The article considers human rights activities as a phenomenon that constitutes an integral part of the legal society. It identifies problems of a theoretical and practical nature associated with difficulties in this area, caused by both the COVID-19 pandemic and other reasons. An attempt has been made to assess the legal and moral and ethical aspects of such a necessary activity at the present stage of the development of public relations, attention is paid to the position of international bodies regarding human rights activities, its goals and objectives. The importance and relevance of the topic is explained by the fact that, in the opinion of human rights defenders themselves, the entire system of human rights protection, created after one of the most terrible periods in modern world history, is going through a crisis at this historical stage, which is increasingly aggravated under the influence of numerous problems of political and economic nature. Military conflicts, migration, a pandemic clearly demonstrate the obvious need to address the issue of the essence of human rights activities, including its moral and ethical component.
The subject of study. The article examines certain aspects to realize freedom of thought and expression, as well as the acceptable limits. Freedom of thought, speech and expression issues are considered separately in the context of the religious component, its characteristics in the Islamic religion. The provisions of the main sources in the Muslim system of law – the Holy Quran and the Sunnah of the Prophet and Messenger of Muhammad (May Allah bless him) have been studied in sufficient details. The legal analysis on the issues under consideration was carried out based on doctrinal opinions, the current Russian and international legal acts, judicial practice, including the practice of the European Court of Human Rights. The article describes extremism through the prism of freedom of thought, speech and expression. It is noted that extremist activity is one of the consequences of misinterpretation, true awareness and perception of freedom of thought, speech and expression.The purpose of the study. The main purpose of the study is to clarify the origins of conflicts in the process of realizing freedom of thought, speech and expression, and substantiate the hypothesis that freedom of thought, speech and expression should have certain boundaries, especially in context of the influence of the religious factor.The methodology of the study. The study is based on a dialectical approach to the disclosure of legal phenomena and processes using general scientific methods (systemic method, logical method, method of analysis and synthesis) and special scientific methods. Among the latter there are formal legal method, linguistic method, comparative legal method, which have found their application in the legal analysis to realize freedom of thought, speech and expression.Conclusions. As a result, it is emphasized that freedom of thought, speech and expression is the achievement of modern mankind, one of the foundations of a democratic system and an element of civil society. The state-guaranteed opportunity for individuals to exercise these freedoms in society is a guarantee of a "healthy" society in the legal sense. However, as practice shows, unlimited freedom leads to its abuse, thereby infringing on the freedoms of other individuals and therefore, freedom of speech and its expression presupposes the existence of boundaries outlined by the state in the interests of society. The specifics of freedom of thought, speech and expression in the Muslim system of law based on the Holy Quran and the Sunnah of the Prophet (May Allah bless him), is that this freedom ends where the border line begins, designated by the law of the Most High. ; Предмет исследования. Исследуются отдельные аспекты реализациисвободы мысли, слова и выражения мнения, а также приемлемые границы ее ограничения. Отдельно рассматриваются вопросы свободы мысли, слова и выражения мнения в контексте религиозной составляющей, а именно ее характеристики в исламе. Достаточно подробно изучаются положения основных источников мусульманской системы права – Священного Корана и Сунны Пророка, да благословит его Аллах и приветствует. Юридический анализ по исследуемой проблематике проведен опираясь на доктринальные мнения, действующие российские и международные нормативно-правовые акты, позиции судебной практики, в том числе и Европейского Суда по правам человека. Приведена характеристика экстремизма через призму свободы мысли, слова и выражения мнения. Отмечено, что экстремистская деятельность выступает одним из последствий неверной интерпретации истинного осознания и восприятия свободы мысли, слова и выражения мнения.Цель исследования. Основной целью исследования является выяснение причин, являющихся источниками происхождения конфликтов в процессе реализации свободы мысли, слова и выражения мнения, и обоснование гипотезы о том, что свобода мысли, слова и выражения мнения должна иметь определенные границы, особенно в контексте влияния религиозного фактора.Методология исследования. Исследование построено на основе диалектического подхода к раскрытию правовых явлений и процессов с использованием общенаучных (системный, логический, анализ и синтез) и частнонаучных методов. В числе последних формально-юридический, лингво-юридический, сравнительно-правовой, которые нашли свое применение при правовом анализе проблематики реализации свободы мысли, слова и выражения мнения.Выводы. В качестве итога подчеркивается, что свобода мысли, слова и выражения мнения – это достижения современного человечества, одна из основ демократического строя и элемент гражданского общества. Гарантированная государством возможность реализации указанных свобод индивидами в социуме является залогом «здорового» в правовом смысле общества. Вместе с тем, как показывает практика, безграничная свобода приводит к ее злоупотреблению, тем самым к ущемлению свобод других индивидов, в связи с чем свобода слова и ее выражение предполагает наличие границ, которые очерчивает государство в интересах социума. Специфика реализации свободы мысли, слова и выражения мнения в мусульманской системе права, основанной на Священном Коране Сунне Пророка, да благословит его Аллах и приветствует, состоит в том, что такая свобода заканчивается там, где начинается линия границы, обозначенная посредством закона Всевышнего.
The article analyzes the experience in the solution of human resources problem for the Soviet court system within New Economic Policy by the governing Communist party. The author emphasizes the fact that a court system is a part of a state mechanism which is the reason for a basic requirement to the judiciary which is to follow political course of the Communist party. Special attention is paid to implementation of class party policy of the Soviet judiciary recruitment. Based on the analysis of methods of human resources recruitment the author comes to the conclusion of a practical binding of a judicial and executive power as well as judicial and part power binding. ; В статье проанализирован опыт решения правящей коммунистической партией кадровой проблемы для советской судебной системы в годы нэпа. Автор отмечает, что судебная система являлась частью государственного механизма, поэтому основное требование, предъявлявшееся к судейскому корпусу, заключалось в следовании политическому курсу коммунистической партии. Особое внимание автор обратил на реализацию классово-партийного подхода к подбору работников советского суда. Анализ способов подбора кадров советского суда приводит автора к выводу о практическом сращивании судебной и исполнительной властей, а также сращивании судебной власти с партийной.

The article examines mechanisms of the intellectual property rights protection within the European Union. The author considers basic legal acts responsible for the protection of the intellectual property rights, in particular EU directives and regulations. The article also analyses the importance of the main bodies in the field of intellectual property rights protection, mainly the European Union Intellectual Property Office and the European Patent Office. The new measures taken by the European Commission and aimed at encouraging EU enterprises to invest in innovative and creative processes are mentioned. ; В статье проведено исследование механизмов защиты прав интеллектуальной собственности в рамках Европейского Союза. Автор рассматривает основные нормативно-правовые акты, отвечающие за охрану прав интеллектуальной собственности, в частности, директивы и регламенты ЕС. В статье также показана роль основных органов защиты прав интеллектуальной собственности в ЕС, а именно, Ведомства по интеллектуальной собственности Европейского Союза и Европейского патентного ведомства. Упомянуты новые меры, принятые Европейской Комиссией, направлены на стимулирование предприятий ЕС к инвестициям в инновационные и творческие процессы.
Исследуется вопрос о возможности разрешения третейскими судами индивидуальных трудовых споров. Анализируются действующее законодательство, научные точки зрения, правоприменительная практика, правовые позиции Конституционного Суда Республики Беларусь. Сделан вывод о том, что третейские суды вправе рассматривать индивидуальные трудовые споры. В связи с этим предлагается внести в законодательство ряд изменений и дополнений, в частности указать в трудовом законодательстве третейские суды среди органов рассмотрения трудовых споров; перечислить категории неарбитрабильных трудовых споров; уточнить регулирование вопросов недействительности третейского соглашения; изменить подходы к регулированию дерогационного эффекта третейского соглашения; усовершенствовать порядок взаимодействия третейской и судебной форм защиты права по вопросам доказывания и доказательств, обеспечения иска, преюдициальности, исполнения третейских решений. = The question of the possibility of arbitration courts to consider individual labor disputes is being investigated. The author analyzes the current legislation, scientific points of view, law enforcement practice, legal positions of the Constitutional Court, and comes to the conclusion that arbitration courts have the right to consider individual labor disputes. In this regard, the author proposes to introduce a number of changes and additions to the legislation, in particular, to indicate in the labor legislation arbitration courts among the bodies for the consideration of labor disputes; to list categories of non-arbitrage labor disputes; to clarify the regulation of issues of invalidity of the arbitration agreement; to change approaches to regulating the derogation action of the arbitration agreement; to improve the order of interaction of the arbitration and judicial forms of protection of the right on the issues of proof and evidence, securing the claim, prejudiciality, execution of arbitral awards.
The study of problems that are associated with the realization of human rights and freedoms is always relevant since their implementation affects the immediate vital interests of the individual. A special role is played by ensuring human rights and freedoms, mechanisms and procedures for their protection, that is corresponding positive and negative obligations of the state. We believe that civil and political rights of a person, usually characterized as negative rights, cannot be ensured only by negative obligations of the state. To ensure them, States still need to assume corresponding positive obligations, the proper fulfillment of which directly affects the effectiveness of ensuring guaranteed human rights and fundamental freedoms. In this regard the study of the positive obligations of the states of the European Union in the field of ensuring political and civil rights is relevant. The object of the master's work is public relations that arise in connection with the implementation of positive obligations of the states of the European Union in the field of ensuring political and civil rights at the international level and the level of European Union law. The purpose of the master's work is to analyze the peculiarities of the positive obligations of the states of the European Union in the field of ensuring political and civil rights at the international level and the level of the European Union law. Tasks of the master's work: 1) to analyze the sources of the main political and civil rights of citizens of the European Union; 2) to characterize the system and content of basic political and civil rights; 3) to give a definition and to consider the ratio of positive and negative obligations of states; 4) to give a definition and to characterize the scope of application of the positive obligations of a state in the field of ensuring the political and civil rights of citizens under the European Convention; 5) to analyze the problem of ensuring the political and civil rights of citizens of the European Union and their judicial protection; 6) to determine the responsibility of states for violation of obligations in the field of human rights protection in European law. There were used dialectical, historical methods, the methods of formal logic, the comparative legal method, the system method and other methods of cognition. The sources of the basic political and civil rights of citizens of the European Union have been established. Among them there are the documents adopted before the creation of the European Union and the documents of the European Union. The problem of the implementation of modern legal standards in the field of human rights has been revealed. The system and content of the basic political and civil rights of citizens of the European Union are considered. The ratio of positive and negative obligations of states is considered. It has been revealed that not only negative, but also positive obligations of states are required to ensure negative rights. The specific positive obligations of states to ensure civil and political rights are considered, the examples are supported by judicial practice. It has been revealed that the state has a triad of obligations in the field of human rights: obligations to respect, obligations to provide and obligations to protect. The principle of the responsibility to protect includes the following obligations: the obligation to prevent; the obligation to respond; the obligation to recover. Some scholars add the obligation to punish the guilty. It has been established that the responsibility of a state for harsh and massive violations of human rights arises before the international community as a whole. On this basis all states can demand the cessation of these violations and the provision of appropriate compensation to their victims making appropriate claims against the violating state. The scientific novelty of the study lies in the fact that it is a complex scientific work, in which a theoretical study of the relationship between positive and negative obligations of states is carried out, as well as specific positive obligations of states to ensure civil and political rights. The master's work can be useful to researchers, lecturers, lawyers and students.
