V okviru aktualnih procesov v mednarodni skupnosti je mogoče opaziti večje poudarjanje vloge nedržavnih akterjev v tradicionalnih državocentričnih oblikah vladanja. Aktivnosti slednjih so zaznane na področju problematike, povezane z oskrbo z globalnimi okoljskimi dobrinami. Magistrsko delo poskuša ovrednotiti vlogo nedržavnih akterjev, natančneje mednarodnih nevladnih okoljskih organizacij (MNVOO) v okviru mednarodnih okoljskih režimov, saj lahko aktivnosti MNVOO kritično vplivajo na učinkovito delovanje režimov samih. Predmet proučevanja je vpliv MNVOO v državocentričnih mednarodnih okoljskih režimih, primarni cilj pa je ovrednotenje vpliva MNVOO na spremembe v teh režimih. Vplive MNVOO bomo ovrednotili skozi zrcalo treh teoretskih perspektiv mednarodnih režimov. S podrobnejšo analizo Evropske unije kot pomembnega akterja mednarodnega režima za boj proti podnebnim spremembam, konkretno njenega sistema za trgovanje z emisijami (EU ETS), – in s to analizo povezanimi odzivi evropskih MNVOO na delovanje EU ETS – bomo dosegali cilj magistrskega dela. Ugotovitve pokažejo, da je vloga MNVOO v fazi oblikovanja mednarodnih okoljskih režimov manj pomembna kot v fazi implementacije. Realizem se pokaže kot najprimernejša teoretska perspektiva v fazi oblikovanja mednarodnih okoljskih režimov, saj ti kažejo posledice strukturnega izražanja moči med državami. Ker liberalizem poudarja pomen večjega vključevanja nevladnih akterjev v fazi implementacije mednarodnih režimov, se ta teoretska perspektiva izkaže kot najbolj primerna za obravnavo izbranega mednarodnega okoljskega režima. Liberalizmu se pridruži šibkejši kognitivizem, saj temelji na medsebojnem učenju ter delitvi informacij. ; Within the current processes of the contemporary international community, academic research observes a greater emphasis being placed on the role of international non-state actors in generally state-centered forms of governance. Their activities are manifested in the field of problems related to the supply of global environmental goods. This master's thesis aims to evaluate the role of non-state actors, (i.e. environmental non-governmental organizations (ENGOs)) in internationalenvironmental regimes (IERs), as ENGOs' activities can significantly contribute to a more effective operation of IERs. Thesis seeks to examine the impact of ENGOs on IERs, whereby its primary goal is to assess the actual ENGOs' influence on changes within state-centric IERs. ENGOs influence will be evaluated through the lens of three theoretical perspectives on international regimes. The set goal will be achived through detailed analysis of the European Union – and its emissions trading system (EU ETS), respectively – as one of the leading players within the international climate change regime – and through associated response of European ENGOs on EU ETS. Thesis shows that ENGOs play greater role at the IERs implementation phase in comparison to IERs formation phase. Realism proves to be the most applicable theoretical perspective at the IERs formation phase, as newly established IERs demonstrate structural power relations between the states. Placing greater emphasis on the ENGOs involvement at the IERs implementation phase, liberalism attests to be the most suitable theoretical perspective for this master's thesis case study. Being based on mutual learning and information sharing, liberalism is joined by weak cognitivism.
Organizacije morajo zaradi vse večje konkurence in prostega nastopa na trgu stremeti k čim večji tržni prednosti oziroma prepoznavnosti in uspešnosti, ne glede na področje poslovanja. To velja tudi za neprofitne organizacije, ki svojemu neprofitnemu poslanstvu profitno sledijo in ga neprofitno uresničujejo. Med neprofitne organizacije spada tudi Obrtno-podjetniška zbornica Slovenije, ki v slovenskem prostoru deluje že 47 let in je nastala na podlagi skupnih interesov takratnih obrtnikov zaradi omejevanja države pri razvoju obrti in dandanes predstavlja obrtno-zbornični sistem. V teoretičnem delu smo na kratko predstavili neprofitne organizacije, management neprofitnih organizacij in njegove temeljne funkcije. V nadaljevanju smo obravnavali in opredelili strategijo, vizijo in poslanstvo, ki je vodilo delovanja vseh organizacij, še posebej pa neprofitnih, ki ne obstajajo zaradi ustvarjanja dobička, ampak zaradi uresničevanja skupnih interesov določenih skupin. Pravilno postavljeni cilji so vodilo za uresničevanje strategije, izvrševanja poslanstva in sledenje viziji neprofitne organizacije. Ker neprofitne organizacije večinoma delujejo na storitvenem področju, smo opredelili storitve, zagotavljanje njihove kakovosti in merjenje. V nadaljevanju smo na kratko opredelili človeške vire, saj so zaposleni najpomembnejši kapital v vseh storitvenih organizacijah, v neprofitnih organizacijah pa predstavljajo edini kapital, s katerim razpolagajo takšne organizacije. V tretjem poglavju smo predstavili delovanje zborničnega sistema v Evropski uniji in njegovega evropskega združenja ter primerjali podobne zbornične sisteme v državah EU s slovenskim obrtno-zborničnim modelom ter ugotovili podobnosti in razlikovanja v njih. Opisali smo tudi podporno podjetniško okolje v Sloveniji, katerega del je tudi Obrtno-podjetniška zbornica Slovenije in njene območne zbornice in smo ga v magistrski nalogi podrobno obravnavali. V raziskovalnem delu magistrske naloge smo poleg nekaterih socio-demografskih podatkov in vprašanj o delovanju obrtno-zborničnega sistema preverjali raziskovalne hipoteze, ki se nanašajo predvsem na ugotavljanje zadovoljstva zaposlenih in uspešnost delovanja obrtno-zborničnega sistema. Naredili smo tudi SWOT analizo obrtno-zborničnega sistema. Rezultati raziskave kažejo, da zaposleni v obrtno-zborničnem sistemu ne kažejo izrazitega zadovoljstva oziroma nezadovoljstva glede delovanja le-tega. A večina zaposlenih se strinja, da bi ta lahko deloval bolje, saj ima ustrezno usposobljen strokovni kader v območnih zbornicah in dobro svetovalno službo v krovni organizaciji. Primeri dobre prakse v drugih državah EU so pokazali, da ni popolnoma primerljivega modela, ki bi bil enak slovenskemu obrtno-zborničnemu sistemu, še najbližja in najbolj podobna sta javnopravna sistema zbornic v Nemčiji in na Hrvaškem. V zaključku naloge smo na podlagi izhodišč raziskave, primerjave nekaterih zborničnih sistemov in SWOT analize podali predloge za izboljšanje delovanja obrtno-zborničnega sistema, ki so smernice za zaposlene in vodstvo obrtno-zborničnega sistema. ; Due to increasing competition and free market entry, organizations must strive for the largest possible market advantage or recognisability and performance, irrespective of the area of operation. This also applies to non-profit organizations, which follow their non-profit mission in a profit manner and realize it in a non-profit way. Chamber of Craft and Small Business of Slovenia is also a non-profit organization, which has been operating in the Slovenian space already for 47 years and it was established on the basis of common interests of craftsmen of that time and because of the limitations of the state in the development of crafts. In the theoretical part we presented non-profit organizations in short, the management of non-profit organizations and their basic functions. Further on we addressed and defined the strategy, the vision and the mission, which are guides for the operation of all organizations, especially the non-profit ones, which do not exist to make profit but due to the realization of common interests of certain groups. Properly set goals (short-term or long-term) are guides for the implementation of the strategy, the implementation of the mission and the pursuance of the vision of a non-profit organization. Since non-profit organizations operate mainly in the service sector, we have defined services, their quality assurance and measuring. In the continuation we defined human resources in short because employees are the most important asset in all service organizations, and in non-profit organizations they represent the only asset of such an organization. In the third chapter, we briefly presented the operation of the chamber system in the European Union and its European associations, and we compared similar chamber systems in the EU countries with the Slovenian craft chamber model and we established their similarities and differences. Within this part we briefly described the supportive business environment in Slovenia, a part of which is also the Chamber of Craft and Small Business of Slovenia and its regional units – regional chambers of craft and small business. In the continuation we discussed and described the craft chamber system in Slovenia in detail. In the research part we verified research hypotheses, beside certain socio-demographic data and some current questions about the operation of the craft chamber system, we made a SWOT analysis with which we defined the strengths and weaknesses of the craft chamber system as an organization, and threats and opportunities that the craft chamber system has in the external business environment. We have established that the employees in the craft chamber system are not satisfied nor dissatisfied with the system's operation, but the majority of employees agree that it could function better as it has well-versed professional staff in regional chambers of craft and small business and good counselling service in the umbrella organization. Good practice cases in other EU countries have shown that there is no completely identical case that would be the same as the Slovenian craft chamber system ; however, the closest and the most similar are the public-law systems of chambers in Germany and Croatia. In the conclusion of the thesis, we made proposals to improve the operation of the craft chamber system, which are guidelines for the employees and the management of the craft chamber system on the basis of the research, system comparison and SWOT analysis.
Pravica državljanov, da sodelujejo pri opravljanju javnih zadev, je eno od tistih demokratičnih načel, ki bi moralo biti skupno vsem državam sodobnega sveta in je zapisana v uvodu Evropske listine o lokalni samoupravi (MELLS). To načelo lahko najneposredneje uresničujemo na lokalni ravni.Prenos pristojnosti, odgovornosti in finančnih virov iz države na organe lokalnih oblasti (lokalne skupnosti) je demokratičen proces (fiskalne) decentralizacije. MELLS je mednarodna pogodba, veljavna tudi v Sloveniji. Občine so v Sloveniji temeljne enote lokalne samouprave, torej predstavljajo tisto raven oblasti, ki je najbližje državljanom. Odgovorne so za zagotavljanje široke palete javnih dobrin in storitev. Z nalogo preverjamo skladnost veljavnega sistema financiranja lokalnih skupnosti (občin) v Sloveniji z osnovnimi usmeritvami iz teorije (fiskalne) decentralizacije ter z načeli MELLS. Pri tem proučujemo področje pokrivanja stroškov nalog občin, njihovo strukturo ter stopnjo medsebojne povezanosti med računsko dodeljenimi sredstvi v okviru mehanizma primerne porabe in zbranimi podatki o stroških po občinah. Na teh podlagah želimo ugotoviti, ali sistem financiranja lokalne samouprave, ki je v veljavi v Republiki Sloveniji, izpolnjuje načelo sorazmernosti virov sredstev z nalogami, ki jih lokalne skupnosti izvajajo. Glede na rezultate lahko ugotovimo, da so načela MELLS zadovoljivo vgrajena v pravni red države. Odstopanja pa ugotavljamo na finančnem področju, kjer načelo sorazmernosti ni ustrezno upoštevano. V obdobju 2010 do 2014 občine niso bile ustrezno financirane glede na njihove naloge. Povprečni stroški na prebivalca so v tem obdobju povprečno za 1,8 odstotka višji od virov na osnovi zakonsko določene primerne porabe. Občine so odvisne predvsem od dohodnine, kot deljenega davka, stopnja avtonomija glede lastnih davkov in njihovih stopenj je nizka. Odhodki občin so se v proučevanem obdobju v povprečju zmanjšali za 6 odstotkov, vendar pa skrbi, da je glavni vzrok tega zmanjšanja v znižanju investicijskih odhodkov za 17,2 odstotkov in investicijskih transferov za 21,8 odstotkov, tekoči odhodki so se znižali za 1odstotek, povišali pa so se transferni odhodki za 4,6 odstotka. Skupaj so se tekoči stroški, ki se upoštevajo pri izračunu povprečnine v razmerju 2014/2010 zvišali za 1 odstotek, sama povprečnina pa se je znižala za 2,5 odstotka. To dokazuje, da se je bistveno poslabšala naložbena sposobnost občin, kot najpomembnejši element izvajanja razvojnih nalog občine. Obseg dodeljene primerne porabe po občini pa se je v povprečju zmanjšal za 1,14 odstotka, in zaostajal za dejansko občinsko porabo. Skupna zadolženost občin je sprejemljiva in znaša 899,2 mio EUR, kar pomeni 2,41odstotka BDP, v skupnem dolgu države pa 2,8 odstotkov. Delež občinskih investicij v skupnem BDP je narastel na 2,4 odstotkov BDP. Občine so investicije financirale predvsem z lastnimi viri (55 odstotkov), s sredstvi EU (24 odstotkov) in z zadolževanjem (5 odstotkov), s sredstvi države pa 16 odstotkov investicij. Glede na določila iz nove finančne perspektive EU za obdobje 2014 - 2020 se bistveno zmanjšujejo možnosti in sredstva za sofinanciranje občinskih investicij, kar bo imelo posledice za zmanjšanje občinskih investicij. Če teh virov ne bo možno nadomestiti, lahko pričakujemo iz tega naslova negativni vpliv na BDP države in razvojnih razlik med občinami. V primerjavi z obdobjem 2007 do 2009 ugotovimo povečanje trenda negativnega razkoraka sredstev primerne porabe in stroškov za izvajanje nalog občin. To kaže na to, da je potrebno izboljšati obstoječi model financiranja. ; The right of citizens to participate in the conduct of public affairs is one of those democratic principles which should be common to all countries of the modern world. And this right is also enshrined in the introduction of the European Charter of Local Self-Government (MELLS). This principle can be most directly exercised at local level, through democratically elected local authorities. The transfer of powers, responsibilities and financial resources from the state to local authorities (local communities) is the democratic process of (fiscal) decentralization. The exercise of MELLS affect the financial relationships between the central and local authorities, since it is necessary to provide such funding of local communities that these will be effective and sufficiently independent in satisfying the public needs of the local population and increasing prosperity of society as a whole. Municipalities in Slovenia are basic units of local self-government. The thesis checks compliance of the current system of funding local communities (municipalities) in Slovenia with the basic guidelines of the theory of (fiscal) decentralization and the MELLS principles. The area of covering the costs of municipal tasks is being discussed, their structure and the degree of interconnection between the allocations in the framework of the mechanism of statutory spending and the data collected on the costs of the municipalities. Based on the results we can conclude that the MELLS principles are satisfactorily integrated into the legal system of the country. However, deviation is observed in the financial sector, where the principle of proportionality is not observed. In the period from 2010 to 2014 the municipalities had not been adequately funded according to their tasks. The average cost per capita in this period is by 1.8% more than the resources on the basis of statutory spending. Municipalities depend mainly on income tax and the rate of autonomy regarding their own taxes and their rates is low. In the observed period, expenditure of municipalities on average decreased by 6%, worrying is the fact that the main cause of the decrease is in the reduction of capital expenditures by -17.2% and capital transfers by - 21.8%, the current expenditure decreased by -1% while the transfer expenses increased by + 4.6%. Together, the running costs that are taken into account when calculating the lump sum in proportion 2014/2010 increased by + 1%, and the lump sum itself decreased by 2.5%. This demonstrates that the investment capacity of municipalities significantly worsened and this is the most important element of the implementation of the development tasks of the municipality. The volume of statutory spending of the municipality dropped by 1.14%, and lagged behind the actual municipal budget. The total indebtedness of municipalities is acceptable and amounts to 899.2 million euros which represents 2.41% of GDP, and 2.8% in the total debt of the country. The share of municipal investments in total GDP has increased to 2.4% of GDP. The municipalities financed the investments from its own resources (55%), EU funds (24%) and debt (5%), with funds from the state 16% investment. According to the provisions of the new EU financial perspective for 2014-2020, the opportunities and funding for co-financing municipal investments is significantly reducing, which will have implications on the reduction of municipal investments. If these resources will not be possible to replace, we can expect a negative impact on the country's GDP and developmental differences between municipalities. In comparison with the period 2007 to 2009, an increase in the trend of negative gap has been noticed between the statutory spending and the cost for carrying out the tasks of municipalities. This shows the need to improve the existing model of financing.
V magistrskem delu obravnavam vpliv svetovne finančne in gospodarske krize, ki je nastala leta 2007 v Združenih državah Amerike ter se nemudoma globalizirala po vseh celinah, na delovanje nevladnih organizacij. V prvi vrsti gre za pereč problem sodobnega sveta, pri čemer pa je za nevladne organizacije, ki delujejo v človekovo dobrobit, značilno, da so večinoma še bolj aktivne v času raznih kriz. Glavni cilj magistrskega dela je ugotoviti, kako je svetovna finančna in gospodarska kriza vplivala na financiranje ter posledično delovanje nevladne organizacije Greenpeace ter s kakšnimi izzivi se dandanes srečujejo nevladne organizacije. Glavne uporabljene metode raziskovanja so metoda pridobivanja podatkov, statistična metoda in primerjalna analiza. Rezultati analize pokažejo, da je obdobje pred nastankom svetovne finančne in gospodarske krize (od leta 2005 do leta 2007) zaznamoval presežek prihodkov nevladne organizacije Greenpeace nad njenimi odhodki. V obdobju med svetovno finančno in gospodarsko krizo (od leta 2008 do leta 2009) je prišlo do upada presežka njenih prihodkov nad odhodki, obdobje po nastanku svetovne finančne in gospodarske krize (od leta 2010 do leta 2015) pa je zaznamovalo konstantno nihanje presežka njenih prihodkov nad odhodki. Na podlagi ugotovitev je nevladna organizacija Greenpeace v obdobju od leta 2008 do leta 2009 zaradi vpliva svetovne finančne in gospodarske krize beležila upad subvencij, dotacij, regresov, kompenzacij in drugih prihodkov ter posledično namenila manj finančnih sredstev za globalne okoljevarstvene aktivnosti. ; This master's thesis discuss the impact of the global financial and economic crisis, that emerged in 2007 in the United States and immediately globalized across all continents, to the functioning of non-governmental organizations. It represents a pressing problem of the modern world, wherefore non-governmental organizations are more active in times of various crises. The main goal of the master's thesis is to find out how the global financial and economic crisis affected non-governmental organization's Greenpeace financing and functioning and furthermore with what kind of challenges are non-governmental organizations encountered these days. The main methods of research used are the method of data acquisition, statistical method and comparative analysis. The results of the analysis show that the period preceding the onset of the global financial and economic crisis (from 2005 to 2007) was marked by a surplus of the non-governmental organization Greenpeace. In the period between the global financial and economic crisis (from 2008 to 2009) the surplus reduced. The period after the onset of the global financial and economic crisis (from 2010 to 2015) was marked by a constant fluctuation in the surplus. On the basis of the findings non-governmental organization Greenpeace due to the impact of the global financial and economic crisis (from 2008 to 2009) recorded a decline in subsidies, grants, regressions, compensations and other revenues, wherefore devoted less financial resources to global environmental activities.
V uvodnem poglavju magistrskega dela smo opredelili problem, namen, cilje in hipoteze. Zapisali smo predpostavke in omejitve ter predstavili predvidene raziskovalne metode. V drugem poglavju smo predstavili prostovoljstvo in program Evropske prostovoljne službe. Ker je program Evropske prostovoljne službe vezan na mednarodni prostor, smo pozornost namenili tudi mednarodnemu prostovoljnemu delu. Predstavili smo celoten program Erasmus +, ki financira tudi program Evropske prostovoljne službe. Ker program Evropske prostovoljne službe zahteva tesno sodelovanje med zaposlenimi in prostovoljcem, smo v tretjem poglavju obdelali modele zadovoljstva pri delu, ker po našem mnenju zadovoljstvo zaposlenih vpliva na sodelovanje s prostovoljci. V nadaljevanju v četrtem poglavju smo predstavili razlike med kulturami, saj v našem primeru govorimo o mednarodnem prostovoljnem delu. Poznavanja in spoštovanje razlik med kulturami, lahko doprinese k uspešnemu sodelovanju med različnimi kulturami. V petem poglavju smo predstavili dve organizaciji, Društvo center za pomoč mladim iz Slovenije, in Občino Kuopio iz Finske. Organizaciji sta akreditirani za izvajanje projektov Evropske prostovoljne službe. Z predstavnikoma organizacije smo izvedeli intervju. S pomočjo intervjujev smo spoznali izkušnje in pomanjkljivosti organizacij pri pripravi, izvedbi in evalvaciji projektov Evropske prostovoljne službe. Na podlagi odgovorov intervjujev smo izvedeli SWOT analizo. V nadaljevanju pa pripravili predlog programa za pripravo zaposlenih na delo s prostovoljci iz tujine, kar smo si kot glavni cilj zadali v uvodu magistrskega dela. ; In the introductory chapter of the master thesis we have identified the problem, purpose, objectives and hypotheses. We have wrote assumptions and limitations. We have present the intended research methods as well. In the second chapter we have presented the volunteering and the European Voluntary Service. Since the program European voluntary service is linked to the international area, we have also focused on the international volunteer work. We presented the entire program Erasmus +, by which European voluntary service is funded. Since the European Voluntary Service program requires close cooperation between employees and volunteers, in the third chapter we have analyzed models of job satisfaction because, in our view, employee satisfaction has impact on the cooperation with volunteers. In the fourth chapter, we present the differences between cultures, as in our case, we are talking about international volunteering. Knowledge of and respect for differences among cultures, may contribute to the successful cooperation between different cultures. In the fifth chapter, we present the two organizations, the Youth Aid Center Association from Slovenia, and the Municipality of Kuopio from Finland. The both organizations are accredited for implementation of European Voluntary Service. We have make an interview with the representatives of the both organizations. Through interviews we have learned about experiences and shortcomings of organizations in the preparation, implementation and evaluation of projects of European Voluntary Service. Based on the responses of interviews we have make SWOT analysis. After that we have prepare a draft of program for preparing employees to work with volunteers from abroad, which we have set as a main objective for the thesis in the introduction chapter.
Magistrsko delo obravnava temo mobinga na delovnem mestu. Mobing je eden od najresnejših in najhujših oblik nasilja na delovnem mestu. Prisoten je praktično v vseh organizacijah po svetu. Predmet obravnave in cilj naloge je izdelava primerjave mobinga na delovnem mestu v Sloveniji z drugimi članicami Evropske unije. Natančneje smo raziskali in opredelili pojem mobinga, pojavne oblike in razvojne faze mobinga ter vrste mobinga in opisali najpogostejše žrtve ter storilce mobinga. Opredelili smo tudi posledice mobinga za posameznika, sodelavce, organizacijo in družbo ter predstavili načine in ukrepe za preprečevanje le-tega. Preverili in analizirali smo tudi že obstoječe domače in tuje raziskave na temo mobing na delovnem mestu. V Sloveniji ni bilo opravljene večje raziskave na to temo, razen nekaj manjših. V okviru Evropske fundacije Eurofound pa je izvedenih več raziskav, v katere so zajete vse države članice Evropske unije. Za nas so v magistrskem delu raziskave EWCS (Evropske raziskave o delovnih razmerah) ključnega pomena. Dobljeni rezultati nam prikazujejo, da je v Sloveniji mobinga veliko več kot na splošno v Evropski uniji. Najpogostejše žrtve mobinga so mlajše ženske, v Sloveniji celo v večji meri, kot je povprečje Evropske unije. Največ nasilja pa se izvaja na srednji organizacijski ravni. Rezultati tudi kažejo, da je mobing prisoten prav v vseh državah Evropske unije, kar opozarja na resnost tega problema. ; This master's thesis deals with the mobbing at the workplace. Mobbing is one of the most serious and a worst-case of violence at the workplace. It is presented in almost all of the organizations around the world. The subject under discussion and the aim of this assessment is to make a comparison about the mobbing at the workplace in Slovenia with the other members of the European Union. We have defined in details a definition of mobbing, its reflection and the development phases of mobbing and all types of mobbing. We have also described the most frequent victims and persons who have committed mobbing. We have also determined some of the consequences of mobbing for individuals, colleagues, organization and the society. We have presented the methods and actions for prevention of the mobbing. We have checked and analyzed existing home and foreign researches about mobbing at the workplace. There hasn't been made any bigger research about the mobbing in Slovenia, just some smaller ones. In the context of European foundation (Eurofund) there have been conducted several researches, containing all of the members of the European Union. In this master's thesis are the researches of the EWCS (European Working Conditions Surveys) of key importance. The obtained results indicate that mobbing in Slovenia is in general more presented than in the European Union. The most common victims are women ; this is also above the European average. There is the most violence at the medium organizational level. The results also show that mobbing is presented in all of the members of the European Union, which shows the seriousness of the problem.
Vprašanje kolektivnih pravnih sredstev v Evropski uniji je v zadnjih letih zaradi pobud evropskih institucij pridobilo veliko pozornosti. V praksi se ja namreč pokazalo, da je intervencija Evropske unije na tem področju potrebna, saj se instituti kolektivne tožbe v državah članicah zelo razlikujejo. Razlikujejo se po vrsti kolektivne tožbe, ki je na voljo, aktivni legitimaciji, uporabi sistema vključitve ali izključitve, financiranja tožbe itd. Heterogenost na tem področju je problematična, saj niso vsi državljani držav članic Evropske unije deležni enake pravne zaščite v primerih množičnih oškodovanj. Različne ureditve držav članic pa imajo tudi negativni vpliv na enotni notranji trg. V nalogi sem analizirala izbrane postopke s kolektivnimi tožbami v državah članicah Evropske unije in osvetlila razlike med njimi. Ugotovila sem, da je ukrepanje organov Evropske unije potrebno, da se zagotovi ustrezno urejene in uravnotežene mehanizme, ki prispevajo k učinkoviti zaščiti in izvrševanju pravic v primerih množičnih oškodovanj. ; The issue of collective redress procedures in the European Union has received a great deal of attention in recent years due to initiatives by the European Union institutions. In practice, however, it has become clear that the European Union intervention in this area is necessary, as institutes of collective redress vary greatly from one-Member State to another. They differ in type of collective action available, legal standing, use of an opt-in or an opt-out system, financing of the action, and so on. Heterogeneity in this area is problematic, as not all citizens of the Member States of the European Union enjoy equal legal protection in cases of mass harm. Moreover, different Member States arrangements also have a negative impact on the single internal market. In this thesis, I have analysed selected collective redress procedures in the Member States of the European Union and highlighted the differences between them. I have identified the need for actions by the European Union institutions to ensure that mechanisms are properly regulated and balanced to contribute to the effective protection and enforcement of rights in cases of mass harm.
Evropska unija (EU) je Bosni in Hercegovini (BiH) obljubila podpis stabilizacijsko-pridružitvenega sporazuma pod pogojem, da BiH prestrukturira svoj razdrobljen policijski sistem po treh načelih EU, ki predvidevajo centralizirano in enotno policijo. Ker pa policije v različnih državah članicah EU niso vedno centralizirane, so lokalni akterji izkoristili argument neenotnih standardov pri upravičevanju odpora do predvidene reforme. V magistrskem delu raziskujem razsežnosti učinkov, ki jih ima odsotnost skupnega normativnega okvira na prizadevanja mednarodne organizacije po prenosu norm v tretje države. Raziskava temelji na preseku teoretskih sklopov reforme varnostnega sektorja¬ ter prenosa norm ; skozi to prizmo analiziram pristop EU k reformi varnostnega sektorja ter študijo primera reforme policije v BiH, z modelom zunanjih spodbud pa učinke neenotnih standardov v državah članicah EU na to reformo. Foucaultovski pristop k fenomenu prenosa norm omogoča, da proces pogojevanja razumemo kot dinamično in kompleksno razmerje moči med EU in lokalnimi akterji. Ugotavljam, da lahko odpor lokalnih akterjev do prenosa norm resno ošibi moč EU, kadar ta ne temelji na močnih normativnih temeljih. V primeru reforme policije v BiH je visoki predstavnik za BiH, avtor treh načel EU, zanemaril, da EU pri svojem zunanjem delovanju nastopa kot normativna moč. Ob odsotnosti normativnega okvirja, torej odsotnosti enotnih standardov na področju policije, pa je bila moč EU ohromljena, posledica tega pa je bila neuspešna reforma policije v BiH. ; The reform of a fragmented police system according to three European Union (EU) principles, which foresee a centralized and unified police force, was set as a condition by the EU to sign the Stabilization and Association Agreement with Bosnia and Herzegovina (BiH). However, as the police in the different EU Member States are not always centralized, local actors have used the argument of divergent standards to justify their resistance to the envisaged reform. This Master's thesis effects of the absence of a common normative framework within an international organization on the norm diffusion to a third country. The research is based on the convergence of theories dealing with security sector reform and norm transfer. Through such a lens, I analyse the EU approach to security sector reform and contextualise it via the study of police reform in BiH. The Foucault's approach to norm transfer understands the process of conditionality as a dynamic and complex power relation between the EU and local actors. Findings show that genuine resistance from local actors can seriously undermine the EU's normative power when the latter is not based on strong normative foundations. In the case of police reform in BiH, the author of the three EU principles – the High Representative for BiH – neglected the EU's role of normative power in its external action. The absence of a normative framework, in this case, the absence of harmonized standards regarding policing undermined the power of the EU and resulted in the failure of police reform in BiH.
Magistrska diplomska naloga nosi naslov Odločanje Sodišča Evropske unije o pristojnosti. V nalogi sem sprva opisala temeljna načela, ki so vodilo delovanja Sodišča Evropske unije, ter se seznanila z njihovo uporabo in razlago v praksi. Ugotovila sem, da med pravnim redom Evropske unije in pravnimi redi držav članic velja načelo nadrejenosti ter da je pravni red Evropske unije superioren. Sledilo je raziskovanje, kako Sodišče Evropske unije odloča o pristojnosti, pri čemer sem spoznala, da ima Sodišče Evropske unije zelo pomembno vlogo, ko odloča o razmejitvi pristojnosti med državo članico ter Evropsko unijo. S sodno prakso namreč riše mejo med avtonomnostjo države članice ter posegi v njeno avtonomnost s strani Evropske unije. Nato sem opisala in spoznavala kakšne so njegove pristojnosti ter kakšni so postopki, ki jih Sodišče Evropske unije uporablja pri svojem odločanju. Ugotovila sem, da je temeljna naloga Sodišča Evropske unije skrbeti za enotno razlago in uporabo prava Evropske unije. Ugotovila sem, da Sodišče Evropske unije skozi sodno prakso čedalje bolj širi svoje pristojnosti in krepi svojo vlogo v razmerju do držav članic, čeprav v praksi vse države članice temu niso prav naklonjene. Na koncu naloge sem opisala in pojasnila, kako so se pristojnosti Sodišča Evropske unije okrepile po sprejemu Lizbonske pogodbe, ter poskušala poiskati razlike ter podobnosti med sistemom delitve oblasti v Evropski uniji ter sistemom delitve oblasti v zvezni državi, predvsem s strani odločanja Sodišča Evropske unije ter njegovih pristojnosti. ; In this assignment, I first described the fundamental principles that constitute the functioning of the Court of Justice of the European Union, and took note of their application and interpretation into practice. I have discovered that the principle of superiority is applied between the legal order of Member States and the rule of European Union in which the legal order of the European Union is superior. This was followed by a study of how the European Court of Justice decides on jurisdiction, and I realized that the Court of Justice of the European Union plays a very important role in deciding on the delimitation of competences between a Member State and the European Union. Through its case-law the Court of Justice of the European Union draws the boundary between the autonomy of a Member State and interference with Member States' autonomy by the European Union. I then described and learned about what its competences are and what are the procedures used by the Court of Justice of the European Union in its decision-making. I have found out that the fundamental task of the Court of Justice of the European Union is to ensure uniform interpretation and application of European Union law. I have found that the Court of Justice of the European Union increasingly expands its jurisdiction through jurisprudence and strengthens its role vis-à ; -vis Member States, although in practice all Member States do not favor this right. At the end of the thesis, I described and explained how the jurisdiction of the Court of Justice of the European Union was strengthened after the adoption of the Lisbon Treaty, and sought to find differences and similarities between the system of division of power in the European Union and the system of division of power in the federal state, notably through the decision-making of the Court and its powers.
V želji po globalnemu in gospodarskem napredku ter iskanju rešitev za okoljske izzive je Evropska unija ustanovila skupno Evropsko kohezijsko politiko, ki izvršuje ukrepe in instrumente na nacionalni ravni. Ena izmed posledic skupne Evropske kohezijske politike v Sloveniji so posebni centri, ki omogočajo stičišče različnih organizacij, kjer se nove ideje prenašajo v gospodarski trg. Gre za inovacije predvsem na področju mobilnosti, trajnostnega okolja, tehnologije, kemije, farmacije. Takšne inovacije prinašajo večji izkoristek materialov, storitev in boljše zdravje, z velikim poudarkom na nizkoogljično družbo. S takšnimi instrumenti se poveča dodana vrednost finančnega vlaganja v takšne centre, hkrati pa spodbuja sodelovanje gospodarske, akademske in raziskovalno razvojne sfere. Namen naloge, da z analizo Javnega razpisa za sofinanciranje vzpostavitve in delovanja kompetenčnih centrov za razvoj kadrov v dveh izvedenih obdobjih dokažemo, kako pomembno je financiranje takšnih instrumentov. Ustvarjajo visoko stimulativno okolje za iskanje rešitev in odpravljanja izzivov, s takšnim načinom dela pa ljudje pridobijo reference, kompetence, višajo konkurenčnost svoje države in pridobijo izkušnje s širšim razmišljanjem in sodelovanjem. ; In pursuit of global and economic progress or finding solutions to environmental challenges, the European Union has set up a common European cohesion policy that implements measures and instruments at national levels. One of the consequences of the common European cohesion policy in Slovenia are special centers, which enable the junction of various organizations, where new ideas are transferred to the economic markets. These are innovations mainly in the field of mobility, sustainable environment, technology, chemistry and pharmacy. Such innovations bring greater use of materials, services and better health services, with a strong emphasis on low–carbon society. Such instruments increase the added value of financial investment in such centers, while encouraging the participation of economic, academic and research development spheres. The purpose of the task is to demonstrate the importance of financing such instruments by analyzing the Public Tender for Co–financing the Establishment and Operation of Competence Centers for Personnel Development in two implemented periods. They create a highly stimulating environment for finding solutions and tackling the challenges, and with this way of working people acquire references, competences, increase the competitiveness of their country and gain experience with wider thinking and cooperation.
Through the public procurement rules, protection of competition, equality of choice & transparency of the procedure in relationships between the public & private sectors are provided, to the greatest extent possible, in the EU rules. All the contractual relationships between the public & private sectors cannot be subject to strict & formal rules on public procurement primarily due to the special nature of business operations, complexity & duration of the relationships. Concessions or public-private partnerships of a concessionary nature are excluded from the legal regime that applies to public procurement. Sodba ESČP mora biti ustrezno implementirana na nacionalni ravni, zato bodo uporabljeni nadzorstveni mehanizmi Sveta Evrope. Ko ESČP izda zoper državo obsodilno sodbo, je posredovana Odboru ministrov, ki mu je na podlagi EKČP zaupana naloga nadzora nad izvršitvijo dokončne sodbe. Odbor ministrov ugotavlja v običajnem ali v razširjenem postopku, ali je država sprejela vse potrebne ukrepe za izvršitev naloženih obveznosti iz pravnomočne sodbe. Če je država izpolnila vse obveznosti iz sodbe, Odbor ministrov sprejme resolucijo, s katero konča nadzor. Združeno kraljestvo in Rusija sta državi, ki v zadnjih letih močno kljubujeta avtoriteti ESČP in zavračata izvršitev nekaterih sodb tega sodišča. V Rusiji so sprejeli sporni Zvezni ustavni zakon z dne 14. 12. 2015 št. 7-FKZ, ki je omogočil Ustavnemu sodišču Ruske federacije, da presoja skladnost sodb ESČP z Ustavo Ruske federacije. V primeru ugotovitve neskladnosti lahko Ustavno sodišče prepreči izvršitev sodbe ESČP. V Združenem kraljestvu že več let kljubujejo sodbi v zadevi Hirst proti ZK, tako da zavlačujejo s sprejemom zakonodajnih sprememb, ki jih je zahtevalo ESČP. Neizvrševanje sodb ima v obeh državah skupno točko – obe sta namreč ogrozili učinkovitost izvrševanja sodb ESČP ravno zaradi volilne pravice zapornikov. Kljubovanje ESČP je v Združenem kraljestvu ostalo na politični ravni, medtem ko je šla Rusija po drugačni poti, saj je sprejela zakonodajne spremembe prav z namenom, da ne bo izvrševala protiustavnih sodb ESČP. V Rusiji ne gre samo za razpravo o razmerju med strasbourškim sodiščem in domačimi sodišči tako kot v Združenem kraljestvu, ampak za kljubovanje države odločitvam v celoti, kar je zaskrbljujoče. Če hočejo ohraniti učinkovit sistem varstva človekovih pravic, si morajo Svet Evrope in njegove članice odločneje prizadevati za dosledno uresničevanje sodb ESČP. ; A judgment of the European Court of Human Rights (abbreviated as ECtHR) must be properly implemented on a national level. For that reason, supervisory mechanisms of the Council of Europe will be used. When the ECtHR delivers a judgment against a state, it is passed on to the Committee of Ministers, which is entrusted with a task of supervising enforcement of a final judgment. The Committee of Ministers finds whether the State has taken all necessary measures to comply with obligations imposed by a final judgment. If the State has fulfilled all obligations, the Committee of Ministers shall adopt a final resolution. The UK and Russia are countries that have strongly defined authority of the ECtHR in the recent years. In several occasions, both states refused to enforce judgments. In Russia, they adopted controversial Federal Constitutional Law of 14 December 2015 no. 7-FKZ that has enabled the Constitutional Court to assess compliance of judgments of the ECtHR with the Constitution of the Russian Federation. If the Constitutional Court finds that a judgment of the ECtHR is not in compliance with the Constitution of the Russian Federation, it may prevent execution of a judgment. For many years, the UK has defied execution of a judgment in the case of Hirst v. the UK by delaying adoption of legislative changes that were required by the ECtHR. Failure to enforce judgments is a common point in both countries. In the UK, resentment against the ECtHR remains at political level. While in Russia, they implemented legislative changes with clear intention not to implement unconstitutional judgments of the ECtHR. If we want an effective system of human rights protection, we must continue to strive toward consistent implementation of judgments of the ECtHR.
The paper gives an analysis of the system for implementing the regional policy in the Republic of Croatia. Proceeding from increasingly large development disparities in the Republic of Croatia, the paper evaluates the level of readiness of the territorial administrative system for conducting regional policy efficiently. Particular emphasis is being placed on the analysis of the three elements that are in a positive correlation with the efficient conduct of regional policy. They are: a legislation framework of regional policy, institutional structure with a special emphasis on the mechanisms of horizontal & vertical coordination, & the system of local & regional self-government. All three variables include relevant limitations that influence the efforts for additional improvement of the overall capacity for conducting regional policy & for stimulating the development of the country. The author analyses & justifies the need for adoption of a special regional development system act. He points to some basic issues that should be solved; he maintains an attitude that an institutional framework should be created & emphasizes the need for reform of local & regional self-government that should be transformed from a retarding element into a generator of development. The regionalization of Slovenia implies that it is about a demanding professional & political project, which is expected to be completed in 2008 by establishing the regions. The beginning of their functioning is planned as from 1 January 2009. In order to provide this process, some constitutional amendments were introduced in 2006 The regional legislation with its associated implementing regulations should implement them. The bills on regions, their financing, regional elections & establishment of regions (these bills are already being discussed in the National Assembly of the Republic of Slovenia) are a touchstone for introduction of regions & for a successful beginning of their functioning. There is a variety of challenges & dilemmas regarding regional competences & the number of regions, own tax resources, regional authority organization & other issues. Very few international standards & good local & regional self-government principles are adhered to in Slovenia. For this reason, some criticism has come from the Council of Europe & the European Union. Although regionalization is an internal matter of the states concerned, the European principles regarding the objectives of regionalization, division & sharing of powers between levels of government, the scope of regional self-government, sharing of tax revenues & public finance, the connection between the regionalization processes & European & world processes, etc. cannot be avoided.
