La tesi di dottorato "Unione Europea e Sanità" è uno studio sistematico del diritto alla salute e della protezione della sanità pubblica nell'ordinamento giuridico dell'Unione Europea. Il primo capitolo analizza le competenze sanitarie dell'Unione Europea, introdotte per la prima volta dal Trattato di Maastricht e definitivamente sistemate all'art. 168 TFUE. La norma identifica alcuni settori specifici nei quali l'Unione può agire e altri, quali l'organizzazione dei sistemi sanitari e la fornitura di cure mediche, che rimangono in capo agli Stati membri. Il secondo capitolo esamina le deroghe e le esigenze imperative connesse alla salvaguardia della salute nel mercato interno ed è suddiviso in tre sezioni dedicate alla libera circolazione delle merci, al diritto di stabilimento e alla libera prestazione dei servizi. Nella prima ci si è occupati dello sviluppo della legislazione farmaceutica. Nella seconda si sono analizzati il mutuo riconoscimento delle qualifiche professionali e le legislazioni statali che restringono il diritto di stabilimento degli operatori sanitari transfrontalieri. Nella terza si è rivolta l'attenzione alla mobilità dei pazienti che, attraverso la giurisprudenza della Corte di Giustizia, è stata trasfusa in un atto di diritto derivato. Il terzo capitolo si concentra sul ruolo del diritto alla salute nell'ordinamento giuridico dell'Unione Europea in considerazione del valore vincolante della Carta dei diritti fondamentali. Coerentemente, si è scelto di mantenere una struttura tripartita. Nella prima sezione, ci si interroga sull'esistenza di tale diritto alla luce dei pochi casi presenti. Nella seconda, lo si analizza per il tramite delle obbligazioni di proteggere, rispettare ed adempiere, enucleate attraverso alcuni strumenti internazionali e si verifica il ruolo del principio di non discriminazione in relazione all'accesso alle cure. Nella terza, infine, si verifica il ruolo del consenso informato rispetto alla sperimentazione clinica ed alla donazione di materiale biologico. ; The thesis aims at analysing the right to health and its protection in the legal order of the European Union. The first chapter assesses EU's health competences, introduced for the first time by the Maastricht Treaty and now codified into art. 168 TFEU. It identifies some specific sectors in which the EU can act and others, as the organisation of national health systems, that remain on the scope of domestic legislation. The second chapter examines health related derogations and mandatory requirements concerning the free moment of goods, the right of establishment and the freedom to provide services. For this reason it is divided into three sections. The first is devoted to pharmaceutical products. The second analyses the mutual recognition of medical qualifications and the domestic hindrance to the establishment of health operators. The third concerns patients' mobility and how the case law of the Court of Justice has been transposed in a piece of secondary legislation. Taking into consideration the binding value of the Charter of fundamental rights, the third chapter focuses on the role of the right to health in EU law. The structure is thus consistently threefold. The first section, in the light of the few cases so far appeared, questions the existence of the right to health. In the second one, it is analysed using some international conventions in order to assess the impact of the obligations to protect, to respect and to fulfil and, eventually, the link between the principle of non-discrimination vis-á-vis the access to healthcare. The last section examines the right to informed consent in clinical trials and the donation of biological materials.
This handbook is the result of three years of teaching European Union Transport Law to the law students of the University of Roma Tre.The course falls within the "Studying Law at Roma Tre" programme, which includes 14 classes entirely taught in English.Following these lines the handbook is divided into three modules, reflecting areas where the intervention of EU law has been most significant: air transport, rail transport, and passengers' rights. To each module we have annexed the most relevant judgments and decisions by the EU Courts and Commission which we found particularly useful to illustrate, from a practical point of view, the policies underlying EU transport law and the conflicting interests of the various stakeholders.Obviously there are other aspects which are touched by EU law, especially in the field of movement of goods, port infrastructures, and road safety, but we have preferred to focus, at least in this first edition, on the three aforementioned aspects.We hope that this primer – which is made available by Roma TrE-press to the whole European academic community on a freely accessible basis – will contribute to the development of the subject as a course offered to students who are and increasingly will be the main beneficiaries of the growing transport networks in the EU.

A selection and a brief commentary on the main European and international documents on cultural heritage published between 2014 and 2019 are presented here.
C'è molta discriminazione di genere nella società, che è suddiviso in diverse categorie come il divario salariale di genere, la differenza salariale e il divario retributivo di genere. La società genera molti stereotipi nella forza lavoro tra uomini e donne, razza, religione e così via, infatti,la ricchezza è la chiave per poter conoscere la quantità di disuguaglianza retributiva di genere, che ha un impatto psicologico e sociologico sulla vita delle persone. In questo ambito, spiegherò cos'è la teoria dei salari e le sue forme, e parlerò di come il divario retributivo di genere esista ancora nel mondo di oggi illustrando le cause e tipi di disuguaglianza di genere nell'Unione europea e nel mondo in generale.
This handbook is the result of four years of teaching European Union Transport Law to the law students of the University of Roma Tre.The handbook is divided into four modules, reflecting areas where the intervention of EU law has been most significant: air transport, rail transport, port services and passengers' rights.With the evolution of transport regulation in the EU in these last years and thanks to the success of the first edition (over 2000 downloads in 18 months), we have considered it useful to expand the topics presented in this primer. In particular we have added in this second edition a specific module on the painstaking process of opening port services to competition. Furthermore a paragraph has been added on the Single European Sky (SES) programme. The second part of the handbook includes the most relevant judgments and decisions by the EU Courts and Commission which we found particularly useful to illustrate, from a practical point of view, the policies underlying EU transport law and the conflicting interests of the various stakeholders.
Il coordinamento tra sistemi impositivi è una questione originaria e tipica del diritto comunitario. La tesi ne esplora le conseguenze sotto più aspetti. ; Income tax systems' co-ordination is a relatively recent issue in the globalizing economy. In fact, a tendence to tax co-ordination begins, essentially, with the EU Law. Since 2006, European Institutions feel the urgence to solve problem of double imposition and non imposition phenomena left unsolved by the member states themselves, or by means of Double Taxation Conventions (DTCs). The tax co-ordination envisages means to do so. The theme is firstly envisaged by the unilateral and bilateral perspective, underlining the deficiencies of sovereignity methods in fronting the economies' integration problems. The theme is then pointed out by the perspective of EU Law. At a first level, by considering tax systems co-ordination methods envisaged by the Directives in matter of group-taxation. Then, monitoring the outgoing of co-ordination considered by three EU Communications dated 19 December 2006 (respectively targeted to the general problem of tax co-ordination, to the co-ordination between member states upon exit taxation, to the co-ordination upon consideraton of intra-EU losses). The issue is also considered by the point of view of the European Court of Justice. In this perspective, it's relevant to estabilish whether the ECJ has the power to compel the member states to structure each other their income tax systems, based on the application of the EU freedoms, with a view – in particular – to exit taxation policies, to intra-EU losses: a theme strictly linked to the view that is optioned out for the interpretation of EU non-discrimination clause (an overall approach facing the opposite per-country approach).
Il lavoro intende dimostrare che lo sviluppo giurisprudenziale del principio di equilibrio istituzionale, il rapporto tra detto principio e il principio di leale cooperazione, il riconoscimento istituzionale e giurisprudenziale dell'importanza della scelta della base giuridica nella tutela dell'equilibrio istituzionale hanno concorso a determinare la dinamicità dell'evoluzione dell'assetto interistituzionale della Comunità e dell'Unione. Focalizzata l'attenzione sulle nuove basi giuridiche introdotte dal Trattato di Lisbona, sono stati definiti gli assetti del nuovo equilibrio istituzionale analizzando, da un lato, il nuovo quadro istituzionale definito dal titolo III del Trattato sull'Unione europea e, in particolare la "costituzionalizzazione" del principio orizzontale di leale cooperazione. In conclusione, si rileva che con l´entrata in vigore del Trattato di Lisbona le dimensioni politica e giuridica dell'equilibrio istituzionale sono state interessate da due mutamenti di ampia portata. In primo luogo, il completamento del processo di revisione dei trattati apertosi con la dichiarazione di Laeken ha definito un nuovo quadro istituzionale, che si è riflesso in rinnovati meccanismi di funzionamento dell'architettura istituzionale. In secondo luogo, la risposta dell'Unione alla crisi economica e finanziaria ha messo al centro dell'agenda il suo bilancio, la programmazione pluriennale e l'Unione economica. Nel primo caso un'analisi dell'articolo 295 TFUE ha costituito la base di una riflessione sulle modalità di codificazione delle relazioni istituzionali attraverso accordi e sul rapporto tra questi ultimi e il titolo III TUE. Si è rilevata, in particolare, un'incongruenza tra gli obblighi di leale cooperazione orizzontale sanciti dall'articolo 13(2) TUE e gli strumenti finalizzati alla loro istituzionalizzazione. Nel secondo caso, invece, è stato evidenziato come il preminente ruolo del Consiglio europeo, al quale il Trattato di Lisbona ha riconosciuto lo status d'istituzione, abbia modificato gli equilibri, determinando un ritorno del ricorso all'integrazione differenziata rispetto a politiche disciplinate dai Trattati. ; The institutional balance can be envisaged in two different ways. On one hand, as a general principle of EU law, developed by the Court of justice since the Meroni ruling; on the other, as a dynamic concept, depicting the inter-institutional relations connected with the implementation of the treaties and the treaty changes concerning the institutional framework and the legal basis governing legislative and budgetary procedures. The thesis is aimed at analysing the evolution of the institutional balance in both judicial and practical spheres and it has been organized in two main parts composed respectively of 4 chapters. In the first part the most relevant principle governing the interinstitutional relations have been assessed considering their evolution from the beginning of the integration process until the entry into force of the Lisbon Treaty. After having defined the new institutional framework set-up by the title III of the TEU, the second part focused on the new legal basis of the TFUE modifying the EU decision-making process. The study was conducted through the analysis of the European Court of justice case-law, treaty' s reforms and institutional practice, including the evolution of the interistitutional agreements. The thesis concludes that the institutional balance is in a permanent state of evolution and this process did not come to an end after the entry into force of the Lisbon treaty. Despite the fact that the Lisbon Treaty was adopted after fifteen years of debate and reflection on institutional reforms, not only the legal instrument provided in order to implement the interinstitutional cooperation are inadequate, considering the high-level interaction required to achieve the objectives of the Treaty, but also the reforms failed to eliminate the structural tension which intrinsically characterized the institutional interaction in the past.

Gli strumenti che costituiscono il 'pacchetto' negoziale finalizzato alla adesione dell'UE alla CEDU sono:a) progetto di Accordo;b) progetto di Dichiarazione;c) progetto di disposizioni integrative del regolamento del Comitato dei Ministri per la supervisione dell'esecuzione delle sentenze e dei termini di composizione amichevole laddove l'UE sia parte in causa;d) modello di memorandum d'intesa;e) progetto di rapporto applicativo dell'Accordo di adesione.
La prevenzione delle fratture da fragilità nelle persone anziane è diventata una priorità dovuta al rilevante impatto sanitario, finanziario e sociale che comportano. Le strategie più appropriate per fare fronte a questo importante problema di salute pubblica sono ancora materia di discussione. Negli ultimi anni l'approccio tradizionale centrato quasi univocamente sulle terapie farmacologiche e sulla valutazione della densità minerale ossea (DMO) è cambiato alla luce del riconoscimento del ruolo di altri fattori di rischio per le fratture da fragilità che sono indipendenti della DMO e che possono essere di maggior rilievo in popolazioni anziane, nelle quali si verificano tre quarti di tutte le fratture da fragilità vertebrali e più di tre quarti delle fratture femorali. Tra i più importanti fattori DMO-indipendenti ricordiamo tra gli altri: a) il rischio di cadute, b) la sarcopenia, c) le alterazioni della mobilità e d) la perdita di peso. Il rapporto costo-efficacia di un approccio farmacologico per il trattamento dell'osteoporosi è in discussione. Alcuni farmaci hanno dimostrato una accertata efficacia nel ridurre il rischio di fratture in soggetti osteoporotici con T-score inferiore a -2.5 DS e fratture prevalenti, anche se i trials che hanno dimostrato tale efficacia non includevano solo persone anziane e spesso escludevano gli anziani più fragili. Nel Aprile 2016, l' "Interest Group on Falls and Fracture Prevention" della "European Union Geriatric Medicine Society (EUGMS)" insieme all'International Association of Gerontology and Geriatrics-European Region (IAGG-ER), all'Unione Europea dei Medici Specialisti (EUMS), all'International Osteoporosis Foundation, all'European Society for Clinical and Economic Aspects of Osteoporosis and Osteoarthritis, hanno pubblicato uno statement che delinea la loro opinione sui punti principali nel (del?) dibattito in corso in relazione alla prevenzione primaria e secondaria delle cadute, alla diagnosi e il (al?) trattamento della fragilità ossea, e all'implementazione di servizi multidisciplinari ("Liasson Services") per la prevenzione delle cadute e delle fratture nelle persone anziane. Questo statement sostiene una strategia globale e suggerisce: 1) una migliore informazione sia per le persone anziane che per gli operatori sanitari per quanto riguarda lo stile di vita generale e misure mediche per ottimizzare la salute ossea e la prevenzione delle cadute; 2) un miglioramento delle conoscenze su screening e un'ottimizzazione della gestione delle persone anziane con fragilità ossea o ad alto rischio di cadere sia nelle cure primarie che nelle istituzioni; e 3) una forte collaborazione tra i "Fracture Liasson Services", i reparti di medicina geriatrica (Liasson Services di cadute e fratture) e le cure primarie. I decisori politici dovranno svolgere un ruolo importante nello sviluppo di programmi comunitari e istituzionali sulla prevenzione delle cadute, nello stabilire i "Liasson Services" di cadute e fratture e nel sviluppare percorsi adeguati per la prevenzione delle fratture che includano sia la valutazione che la gestione delle persone anziane che cadono frequentemente e l'ottimizzazione della gestione medica nelle persone con fragilità ossea.

La diffusione dell'economia digitale, quale catalizzatore di processi, ivi compresi quelli di politica fiscale, pone nuove sfide per il legislatore e per la cooperazione internazionale ed europea. Le soluzioni offerte differiscono in relazione alle esigenze maggiormente avvertite da ciascun operatore trovando alternativamente punti d'incontro e contrasti senza pervenire ad una soluzione complessiva, e soprattutto definitiva, del problema. La presente indagine mira ad approfondire le conseguenze e l'adeguatezza delle proposte avanzate dall'Ue e dall'Oecd in materia di tassazione dell'economia digitale nonché ad ipotizzare possibili soluzioni alle problematiche emerse fino ad oggi. La tesi cercherà di individuare lo strumento più efficace che meglio si adatti all'assetto dell'Unione Europea al fine di contrastare la cosiddetta "Pianificazione Fiscale Aggressiva" posta in essere dalle multinazionali, spesso rientranti nella categoria delle società dell'economia digitale. La questione centrale cui si cercherà di dare risposta concerne, dunque, la possibilità e la convenienza di rinunciare a parte della sovranità fiscale riservata agli Stati al fine di implementare un sistema fiscale comune in seno all'Unione Europea. La dottrina maggioritaria propende inevitabilmente per una soluzione coordinata tra le singole nazioni ma, a prescindere da quanto sostenuto nelle sedi istituzionali, è opportuno predisporre un ragionamento che tenga in considerazione anche le questioni essenziali e le proposte che non hanno trovato spazio nel pensiero maggioritario. ; The spread of the digital economy as a catalyst for processes, including fiscal policy, poses new challenges for the legislator and for international and European cooperation. The solutions offered differ in relation to the needs most experienced by each operator by finding alternating points and contrasts without reaching a complete and, above all, definitive solution to the problem. The present survey aims to investigate the consequences and the adequacy of the proposals put forward by the EU and the OECD regarding the taxation of the digital economy and to hypothesize possible solutions to the problems that have emerged to date. The thesis will try to identify the most effective tool that best fits the structure of the European Union in order to counter the so-called "Aggressive Tax Planning" set up by multinationals, often falling within the category of digital economy companies. The main question to which we will try to answer concerns, therefore, the possibility and the convenience of renouncing part of the fiscal sovereignty of States in order to implement a common tax system within the European Union. The majority of commentators inevitably inclines towards a coordinated solution among the single nations, but, irrespective of what is stated in the institutional forums, it is opportune a reasoning that takes into consideration also the essential questions and the proposals that have not found space in the majority thought.
The increasing scarcity of public funds, as well as the continued efforts in improving the quality and efficiency of public services, have made the public-private partnership a legal-economic scheme more attractive both for States and for industry stakeholders. Indeed, PPPs, which were developed initially because of the public budgetary constraints, have subsequently proved its suitability in allowing the retrieval of additional resources to those strictly necessary for the basic realization of projects of general interest and to operate efficiencies of the system. From this point of view they can be considered an effect of economic globalization which identifies the increasing costs that systems must support to compete into a competitive economic arena. EU Member State Governments do not seem to longer regard themselves as having a purely national dimension in an internationalized context where every entity is more inclined to act like a market player (1) (Osborne S. P., Public–private partnerships: theory and practice in international perspective, Routledge, London, 2003), nevertheless citizens demand public services with higher quantity and quality despite being willing to pay for them a consistently lower price. As detailed in this work, the European Union does not expressly provides a definition of public-private partnership, indeed all forms relate to the works, services, supplies, shall be "positively" included in the public procurement legislation. In particular, the trend towards establishing PPPs in research & development occurred and increased in various contexts to address market failures and to benefit of different spillover effects. In comparison with other policy instruments pursuing similar goals, this one respond better to the latest trends in research and innovation processes, i.e. increased scientific content of technological development, increasing dependency on external knowledge for innovation generation, changing business R&D strategies (e.g. open innovation) and rapidly evolving social needs (2) (Guinet, J., (2005), 'Public-Private Partnerships for Research and Innovation. The experience of OECD countries', Science and Technology Policy Division, OECD, Paris (unpublished paper)). The cases analyzed, both the "JTIs" (Joint Technology Initiatives) and the "cPPPs" (Contractual Public Private Partnerships) constitute absolute specificities in the PPP general domain, first for the intrinsic characteristics of the scientific & technological research (long-term nature of returns and uncertainty of outcomes), secondly because the public operator does not act in order to obtain or provide public goods but for the pursuit of its institutional goals, such as public scientific research. They cannot be considered totally as public-private partnerships at least in terms of positive law, but our cases fall down in the atypical scheme as referred for the first time by the European Commission guidelines in 2003 when the different major categories were outlined involving more or less private sector involvement (3) (DG Regional Policy: guidelines for successful public-private partnerships, March 2003). Moreover, the private component is identified, as in classic ppp cases, not by means of public evidence but on the basis of a political-strategic selection. Original goals of this work is to make a useful reconstruction of all the European Commission PPPs in research & innovation, focusing on the behavior and performance of three cases of contractual PPPs under the framework program FP7 and Horizon 2020 managed by directorate D (Industrial Technologies) of DG Research & Innovation (RTD) in which I have been professionally involved as civil servant for the years 2014 and 2015. Due to the fact that few of the projects funded have not yet been completed and the research outputs are not yet definitive, the analysis has been carried through a qualitative approach obtaining qualitative indicators extrapolated by the previous assessments done by the Commission, primary internal department sources and successful ended projects with high impact results, unstructured interviews. The research objective is to explain their ability to be attractive for the private sector and to be an effective tool to reach the EU policy targets compared to the "no PPP option", for instance the standard framework programme (FP7 and Horizon 2020). The aspect of the "attractiveness" in particular is missing in the literature of the research PPPs elaborated, therefore this work hopes to give a contribution, even if minimum, to the efforts currently in place in the academic and management community to design and configure and ideal PPP framework for effective interaction between public institutions and market players which shall feed the service of scientific and technological research targets established at European Union policy level.
Oggetto della ricerca è l'analisi della gestione del conflitto sindacale nelle relazioni industriali nell'Unione europea, e in particolare l'assenza del riconoscimento dello sciopero tra le materie legislative di competenza della Comunità europea. Lo studio è strutturato in tre capitoli. Il primo è dedicato all'esame degli aspetti fondamentali del sistema di relazioni industriali in Europa; in particolare vengono ripercorse le tappe dell'evoluzione del dialogo sociale, i principali attori e regole, le differenti modalità di organizzazione delle parti sociali, le forme di partecipazione dei lavoratori nonché il sistema delle relazioni industriali nell'Unione Europea. Il secondo capitolo è incentrato sul tema del riconoscimento all'interno dei diritti sociali fondamentali "comunitari", del diritto di sciopero. In particolare, nei paragrafi centrali l'attenzione si incentra, sul diritto dei lavoratori a ricorrere ad azioni collettive per la difesa di propri interessi, così come sancito nella Carta dei Diritti Fondamentali dell'Unione Europea, (proclamata a Nizza il 18 dicembre 2000). Nonostante tale importante riconoscimento, la regolamentazione del diritto di sciopero non rientra tra le materie legislative di competenza della Comunità europea (art. 137.5, del TUE, ora art. 153.5 TFUE). L'esclusione può essere letta come espressione della volontà politica degli Stati membri di rispettare gli standard nazionali, rinunciando a qualsiasi interferenza del diritto comunitario su un terreno nel quale è difficile prospettare armonizzazioni normative, in ragione della eccessiva difformità delle discipline nazionali. Tale scelta ha, tuttavia, determinato una grande differenziazione tra le discipline nazionali, con particolare riferimento alla regolamentazione dello sciopero nei servizi pubblici essenziali. Il tema dell'esclusione si è riproposto e acutizzato negli ultimi anni a seguito di una serie di pronunce della Corte di Giustizia, relative ai casi Viking, Laval e recentemente Commissione vs Germania. In particolare, nel secondo paragrafo sono analizzate le sentenze Viking e Laval, abbinate non solo dal contenuto, ma anche dalla prossimità temporale, la prima dell'11 dicembre, la seconda del 18 dicembre 2007 che registrano un cambiamento rispetto alla precedente fase di indifferenza, in quanto per la prima volta, il diritto di sciopero è riconosciuto come diritto fondamentale dell'Unione europea. L'attenzione è posta anche sulla recentemente pronuncia della Corte di Strasburgo sul diritto di sciopero che con la sentenza Enerij del 21 aprile 2009 marcherebbe una netta evoluzione giurisprudenziale, in quanto si potrebbe sostenere che la Corte abbia ritenuto che il diritto di sciopero, fintantoché è esercitato per sostenere la contrattazione collettiva, è ugualmente essenziale alla libertà sindacale e pertanto direttamente riconosciuto e tutelato dall'art. 11 della Convenzione Europea per i Diritti dell'Uomo. Il terzo capitolo, infine, si propone, pertanto, di analizzare comparativamente le soluzioni legislative adottate dall'ordinamento italiano, francese, inglese e tedesco, riguardo la disciplina dell'azione di autotutela collettiva e del diritto di sciopero nei servizi pubblici essenziali nei principali Paesi dell'Unione Europea dove, i differenti ordinamenti nazionali rendono difficile un confronto teso al raggiungimento di una disciplina comune. In particolare, la legislazione italiana con la previsione di una apposita Commissione di garanzia, quale autorità pubblica indipendente, cui sono affidati compiti di verifica e anche di statuizione in relazione alle prestazioni indispensabili da effettuare per garantire ai cittadini la possibilità di continuare a fruire, seppure con delle limitazioni, dei propri diritti costituzionalmente tutelati, rappresenta un caso unico in Europa che pone l'Italia sotto questo profilo in una posizione più avanzata rispetto all'Europa. ; Object of the search is the analysis of the management of the trade-union conflict in the industrial relations in the European Union, and in particular the absence of the acknowledgment of strike between the legislative matters of competence of the European Community. The study is structured in three chapters. The first one is dedicated to the examination of the fundamental aspects of the system of industrial relations in Europe; in particular they go over again the stages of the evolution of the social dialogue, the main actors and rules, the different kind of organization of the social parts, the forms of participation of the workers let alone the system of the industrial relations in the European Union. The second chapter focuses on the topic of the acknowledgment inside of "communitarian" fundamental of the social rights and of the strike right. In particular, in the middle paragraphs the attention is focused on the right of the workers to resort to collective actions for the defense of own interests, thus like sanctioned in the Paper of the Fundamental Rights of European Community, (proclaimed in Nizza 18 December 2000). Although such important acknowledgment, the regulation of the strike right is not included between the legislative matters of competence of European Community (art. 137.5, del TUE, ora art. 153.5 TFUE). The exclusion can be read like expression of the political will of the Member States to respect the national standards, renouncing to any interference of the communitarian right in a branch in which it is difficult to show normative agreements in reason of the excessive difference of the national disciplines. Such chosen it has, however, determined a great differentiation between the national disciplines, with detail reference to the regulation of strike in the essential public services. The topic of the exclusion has been reproposed and intensified during the last few years as a result of a series of judgment of the Law court, relative to the cases Viking, Laval and, recently, Commission vs Germany. In particular, in the second paragraph are analyzed the Viking and Laval sentences, matched not only by content but also by the temporal proximity, the first of 11 December, the second of December 18 2007. They records a change regarding the precedence phase of indifference, as for the first time, the strike right is recognized like fundamental right of the European Union. The focus is also on the recent ruling by the Strasbourg Court on right to strike, in its judgment of 21 April 2009 Enerij would mark a clear development of the case, as it could be argued that the Court has held that the right to strike, as long as it is exercised to support collective negotiation, it is equally essential to freedom of association and therefore directly recognized and protected by art. 11 of the European Convention on Human Rights. The third chapter, at last, proposes, therefore, to analyze comparatively the legal approaches adopted by the Italian, French, English and German rules, about the discipline of the collective self-defense and the right to strike in essential public services in main countries of European Union, where the different national rules make difficult a compare aimed to the reach of a common framework. In particular, the Italian legislation with a provision for a special Commission of guarantee, represents a unique case in Europe and place Italy in a more advanced position than the member States. Indeed, to this authority, are entrusted assessment tasks and regulatory in relation to essential services, that must guarantee to the citizens the possibility of continuing to enjoy, albeit with some limitations, of their constitutionally protected rights. ; Dottorato di ricerca in Persona, impresa e lavoro: principi e tutele di diritto interno, internazionale, comunitario e comparato (XXIII ciclo)
Oggetto della ricerca è l'analisi del quadro normativo comunitario e interno relativo alla circolazione delle libere professioni, e, in particolare, al reciproco riconoscimento dei titoli accademici e professionali sia in generale, sia con particolare riguardo a talune categorie professionali: i medici e i docenti universitari. Nel primo capitolo, dopo aver analizzato l'istituto della libertà di circolazione delle attività professionali nell'economia del disegno comunitario originario, vengono ripercorse le tappe attraverso le quali si è giunti al mercato unico delle attività autonome, quale punto di arrivo, peraltro non definitivo, di un percorso al quale hanno contribuito sia l'attività legislativa che la giurisprudenza della Corte di Giustizia Europea. In particolare si analizza come il legislatore comunitario ha abbandonato il primo approccio c.d "settoriale", a favore di uno "generale" che prevede il reciproco riconoscimento dei titoli con potere di adattamento (o diritto di compensazione) da parte dello Stato ospite. La parte centrale del capitolo è incentrata sull'esame della direttiva 2005/36/CE con la quale si è inteso ampliare le ipotesi di esercizio della professione in virtù del titolo originario. La direttiva, che contiene il regime disciplinare attualmente vigente in tema di riconoscimento delle qualifiche professionali è stata recepita in Italia con il d.lgs. 9 novembre 2007, n. 206, al quale è dedicato l'ultimo paragrafo del capitolo. Nel secondo capitolo l'attenzione si sposta sulle professioni mediche, sulla considerazione che, in quest'ambito, il tema del riconoscimento dei titoli professionali riveste profili di particolare interesse, in quanto connesso con la tutela di un diritto fondamentale quale quello della salute. Il terzo capitolo è incentrato sul tema dell'internazionalizzazione dell'università e della mobilità dei docenti. Il sistema dell'alta formazione è un nodo strategico per l'integrazione sociale e culturale europea: infatti, le università svolgono un ruolo fondamentale nell'azione di promozione e garanzia della crescita e dell'arricchimento intellettuale della società. Nel primo paragrafo vengono sono descritti i principali interventi delle Istituzioni comunitarie che, sulla base dei suddetti presupposti, mirano alla promozione e al miglioramento della qualità e della competitività fino alla "modernizzazione" dei sistemi di istruzione superiore; viene, poi, esaminata l'azione del cd. Processo di Bologna, un progetto intergovernativo finalizzato alla costruzione del cd. Spazio europeo dell'istruzione superiore e della ricerca. Vengono, infine, trattate le questioni del riconoscimento dei titoli accademici per lo svolgimento di una professione non regolamentata o per la prosecuzione degli studi e ripercorsi i diversi programmi di mobilità europea rivolti ai docenti universitari. Al fine di rivedere i punti di criticità del sistema di riconoscimento, previsto dalla direttiva 2005/36/CE, è, attualmente, in corso un processo di revisione della stessa: il 19 dicembre 2011 è stata, infatti, pubblicata una proposta di modifica. La promozione della libera circolazione delle professioni è, infatti, considerato come uno strumento essenziale del potenziale di ripresa economica, dell'incremento occupazionale e della crescita sociale dell'Europa di oggi. ; The research focuses on the anlysis of the EU and the internal regulatory frameworks concerning free movement of liberal professions and, in particular, the mutual recognition of academic and professional qualifications both in general and with particular regard to certainf professional groups: doctors and university teachers. In the first chapter, after analyzing the institution of freedom of movement of professional activities within the original EU outline, the author thinks back to the steps through which the single market of the autonomous activities has been reached, as a point of arrival, however not definitive, of a path which both the legislative activity and the jurisprudence of the European Court of Justice have contributed to. In particular, the analysis shows how the Community legislator has abandoned the first approach, the so-called "sectoral" approach, in favour of a "general one" which envisages mutual recognition of qualifications with power of adjustment (or right of set off) by the host Government. The central part of the chapter focuses on the examination of Directive 2005/36/EC with which it was intended to broaden the assumptions of practice of profession under the original title. The Directive, which contains the regulatory regime currently in force in terms of recognition of professional qualifications has been implemented in Italy by Legislative Decree of 9 November 2007 n. 206, which the last paragraph of the chapter is dedicated to. The second chapter focuses on the medical professions, considering that in this context the issue of recognition of professional qualifications is of particular interest, as it is related to the protection of a fundamental right, namely the right to health. The third chapter focuses on internationalization and mobility of university teachers. The system of higher education is a strategic hub for the European social and cultural integration: in fact, the universities play a key role in the activities of promotion and guarantee of intellectual growth and enrichment of society. The first section describes the main steps of the Community institutions: on the basis of the above-mentioned assumptions, they aim at promoting and improving the quality and competitiveness in order to fulfill the "modernization" of higher education systems; furthermore, the so-called Bologna Process is examined: it is an intergovernmental project aimed at building the so-called European area of higher education and research. The issue of recognition of academic qualifications for carrying out unregulated professions or continue their studies is eventually dealt with, together with the various European mobility programs addressed to university teachers. The Directive 2005/36/EC is currently undergoing a review process in order to review the critical points of its recognition system: on 19 December 2011, in fact, a proposed amendment was published.
