بررسی تعهدات زیستمحیطی دولتها در خصوص محصولات تراریخته در پرتو اصول حقوق بینالملل محیط زیست، اتحادیه اروپا و ایران ; The Studying of Governments' Environmental Obligations on Genetically Modified Organism (GMO) in the light of the International Environmetal Law, European Union and Iran
زمینه و هدف: کمبود مواد غذایی، تغییرات اقلیمی و دیگر عوامل سبب شده تا تولید گیاهان تغییر شکلیافته ژنتیکی (محصولات تراریخته) از دهه 90 میلادی مورد توجه قرار گیرد. تولید این گیاهان همانگونه که موجب امیدواری در رفع گرسنگی بود، به دلیل تأثیر احتمالی بر محیط زیست موج نگرانی را نیز برانگیخت. هدف از این تحقیق، بررسی تعهدات زیستمحیطی دولتها در حوزه محصولات تراریخته در پرتو اصول حقوق بینالملل محیط زیست، اتحادیه اروپا و ایران است. مواد و روشها: نوشتار حاضر به شیوه توصیفی ـ تحلیلی ابتدا اصول پیشگفته حاکم در حقوق بینالملل محیط زیست را بررسی میکند تا دریابد تعهدات زیستمحیطی دولتها درباره محصولات تراریخته از نظر اصول حقوق بینالملل چگونه است و سپس رویکرد اختصاصی اتحادیه اروپا را بررسی و تطبیق داده و بالاخره گذرا این وضعیت را در ایران مرور میکند. یافتهها: اتحادیه اروپا برخلاف ایالات متحده دیدگاهی احتیاطآمیز توأم با سختگیری در حمایت از مصرفکننده و محیط زیست پیش گرفته که ریشه در اصول کلی حقوق بینالملل محیط زیست دارد. اصولی مانند توسعه پایدار، اقدام احتیاطی، ارزیابی و اطلاعرسانی که به جمع رعایت مصالح دولتها در دستیابی به توسعه و پیشرفت و حفظ محیط زیست میانجامد، در حالی که در ایران از سویی قوانین حمایتی از محیط زیست به صورت کارآمد تصویب نشده است و یا اینکه در برخی موارد محیط زیست و حمایت از آن مغفول مانده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری، رعایت شده است. نتیجهگیری: نتایج این جستار نشان میدهد که دولتها در خصوص محصولات تراریخته متعهد به رعایت اصول کلی یا عرفی توسعه پایدار، اقدام احتیاطی، ارزیابی و اطلاعرسانی بوده و رعایت اصول مزبور بهترین راهکار جهت صیانت از حقوق مصرفکننده و حمایت از محیط زیست است. ; Background and Aim: Food scarcity, climate change and other factors have led to the production of genetically modified crops (transgenic crops) since the 1990s. The production of these plants, as they had hoped to eliminate hunger, also raised concerns about the potential impact on the environment. The purpose of this study is to examine the Governments' Environmental Obligations on Genetically Modified Organism (GMO) in the light of the International Environmetal Law, European Union and Iran. Materials and Methods: The present paper is descriptive-analytical paper and firstly examines the aforementioned principles of international environmental law in order to understand what is the environmental commitment and obligation of governments in the process of cultivation and supply for transgenic products from the perspective of international law. Then, it examines and applies the EU-specific approach and finally reviews this situation in Iran. Findings: The European Union, unlike United States, has taken a cautious approach to consumer and environmental protection. This approach is rooted in the general principles of international environmental law. Principles such as sustainable development, precautionary principle and the principle of notification that bring together the interests of governments in achieving development, improvement and environmental protection, while in Iran,It has not been enacted environmental laws effectively on the GMO or in some cases the environment and its protection have been neglected. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: The results show that governments are committed to adhering to the general or customary principles of sustainable development, precautionary principle and the principle of notification in the process of cultivating and supplying for Genetically Modified Organism (GMO), and adhering to these principles is the best way to safeguard consumer rights. Relativization od european national minority politics – Case study Bosnia and Herzegovina ; Relativizacija evropskih manjinskih politika – studija slučaja Bosna i Hercegovina
The author discusses the reasons for relativization of the national minorities protection policy of the Council of Europe and the European Union in light of the problems with national minorities protection in Bosnia and Herzegovina. The minorities protection policies in Bosnia and Herzegovina had implications for minority rights protection in Hungary and Croatia after Croatia's accession to the EU . The European Union, the Council of Europe and other European institutions defined their position towards minority rights in light of the European Court for Human Rights decision in the Sejdić and Finci case. The decision specified mandatory constitutional changes in terms of equal protection of national minority rights. According to the demanded constitutional revisions, the representatives of national minorities would have a right to compete for legal and executive positions in the entire Bosnia and Herzegovina. Before the ECHR decision, only representatives of the three constituent peoples – Bosniaks, Serbs and Croats could be nominated for positions in the legislature and in the executive institutions. The Council of Europe mediated by CoE Parliamentarian Assembly and Committee of Ministers threatened to suspend BiH membership to the CoE until the decision was implemented. At the same time, coordinated European Union institutions made the ratification of the Stabilization and Association Agreement (SAA) negotiated with Bosnia and Herzegovina in 2008 conditional upon the implementation of the Sejdić and Finci decision. The threat wasn't carried through and BiH became presiding country of the Committee of Ministers of the Council of Europe in 2014. In the meantime, the newly elected European Parliament as well as recently appointed European Commission accepted the SAA although the Sejdić-Finci decision was not incorporated in the constitution of Bosnia and Herzegovina. ; Evropska unija, Savjet Evrope i druge evropske institucije bitno su odredile svoj odnos prema Bosni i Hercegovini u odnosu na primjenu Odluke Evropskog suda za ljudska prava "u slučaju Sejdić i Finci", koji nalaže obavezu ustavnih promjena u pravcu zaštite jednakosti prava pripadnika nacionalnih manjina. Tim promjenama i predstavnici nacionlanih manjina imali bi pravo da budu kandidovani na sve pozicije zakonodavne i izvršne vlasti u Bosni i Hercegovini. Do odluke u spomenutom slučaju, poznatom kao "Sejdić – Finci", samo su pripadnici tri konstitutivna naroda u Bosni i Hercegovini – Srba, Bošnjaka i Hrvata, mogli da budu kandidovani za te funkcije. U više navrata Savjet Evrope je posredstvom Parlamentarne skupštine ili Komiteta ministara prijetio suspenzijom, čak i izbacivanjem Bosne i Hercegovine iz ove međunarodne organizacije. Istovremeno, čak i koordinisano, institucije Evropske unije raznih nivoa uslovljavale su ratifikaciju Sporazuma o stabilizaciji i pridruživanju (SAA ), postignutog još 2008. godine, isto primjenom navedene odluke. Prijetnja se odnosila na nepriznavanja izbornih rezultata na lokalnim izborima 2012. i opštim izborima 2014. godine. To se nije desilo, a u međuvremenu BiH je bila zemlja – predsjedavajuća Komiteta ministara Savjeta Evrope. Novoizabrani saziv Evropskog parlamenta i nova Evropska komisija prihvatili su Sporazum o stabilizaciji i pridruživanju nakon opštih izbora u BiH 2014, iako odluka Evropskog suda za ljudska prava nije primijenjena. Predmet rada biće razlozi relativizacije manjinskih politika Savjeta Evrope i Evropske unije u politikama zaštite prava nacionalnih manjina u BiH. Time su postale vidljive i upozoravajuće i druge politike relativizacije položaja i prava nacionalnih manjina, poput Mađarske i Hrvatske, do čega je došlo nakon prijema ove dvije države u Evropsku uniju.

Maģistra darba mērķis ir izvērtēt Āfrikas Savienības (ĀS) nozīmi miera un drošības uzturēšanā, darba sākumā izvirzot apgalvojumu, ka ĀS lielākie izaicinājumi miera uzturēšanā un konfliktu risināšanā ir nespēja nodrošināt nepieciešamo resursu mobilizāciju un spēku ģenerēšanu. Darba teorētiskajā ietvarā tiek aplūkoti miera uzturēšanas un konfliktu pārvaldības principi, kā arī reģionālo organizāciju loma miera uzturēšanā. Darba tālākajā gaitā tiek aplūkoti drošības izaicinājumi Āfrikā, ĀS izveides vēsturiskais konteksts un tās galvenie darbības principi un miera uzturēšanas un konfliktu pārvaldības instrumenti. Pētījuma analīzes daļā tiek izvērtētas ĀS miera uzturēšanas misijas Burundi, Sudānā un Somālijā, analizējot ĀS ieguldījumu šo konfliktu risināšanā. Darba noslēgumā tika apkopoti ĀS miera un drošības uzturēšanas ierobežojumi un izaicinājumi. ; The main aim of this thesis is to assess the role of the African Union (AU) in the maintenance of peace and security in Africa. This study focuses on the argument that the main challenge affecting the AU's peacekeeping and conflict resolution capabilities is the inability to provide the necessary resource mobilization and force generation. The theoretical basis of this thesis consists of peacekeeping, conflict management and resolution principles, as well as the role of regional organizations in the maintenance of peace and security. Further discussed topics are the security challenges in Africa, the establishment of the AU, as well as its key operating principles and peacekeeping and conflict management tools. The analysis section focuses on the AU peacekeeping missions in Burundi, Sudan and Somalia, which were selected to evaluate the role of the AU.
