Die Vorbereitungen laufen bereits viele Jahre, nun liegt er endlich vor: der Entwurf der Europäischen Kommission für ein Gemeinsames Europäisches Kaufrecht als Optionales Instrument. Beteiligte an den Vorarbeiten und wichtige Kritiker derselben setzen sich in diesem höchst empfehlenswerten Buch mit dem Kommissionsentwurf auseinander. Wie wird die Harmonisierung des europäischen Vertragsrechts durch den Entwurf vorangetrieben? Wie "schlägt" sich der Entwurf im Vergleich zum BGB, zum DCFR oder zu den Acquis-Principles? Revenue autonomy is one of the fundamental pillars of self-government in the economic sense. The assurance of LSUs to a significant share of own revenue should be based on their character, above all the impact on their size, the predictability, the freedom of disposal and the independence of local governments from the state budget. The level of fiscal autonomy of self-government is a derivative of national solutions adopted in Poland, the level of decentralization, the amount, type and efficiency of self-government income sources combined with the spatial distribution of the tax base and the scope of taxation power of the self-government sector. It largely determines the development opportunities of local communities. Hence, it is important to address this topic in various aspects. This work aims to analyze the level of revenue autonomy of local government units in Poland against the background of selected European Union countries, indicating the importance of taxation power in creating this autonomy. ; Samodzielność dochodowa stanowi jeden z podstawowych filarów samorządności w wymiarze ekonomicznym. Zapewnienie JST istotnego udziału dochodów własnych powinno wynikać z ich charakteru, przede wszystkim z możliwości oddziaływania na ich wielkość, przewidywalność, możliwość swobodnego dysponowania oraz uniezależnienia JST od sytuacji budżetu państwa. Poziom samodzielności dochodowej samorządu jest pochodną przyjętych w kraju rozwiązań w zakresie organizacji państwa, poziomu decentralizacji zadań, ilości, rodzaju i wydajności źródeł dochodów przyznanych JST w połączeniu z przestrzennym rozmieszczeniem bazy podatkowej oraz zakresu przyznanego sektorowi samorządowemu władztwa podatkowego. W znacznym stopniu decyduje on o możliwościach rozwojowych wspólnot samorządowych. Stąd ważne jest podejmowanie tego tematu w różnych aspektach. Celem opracowania jest poddanie analizie stopnia samodzielności dochodowej jednostek samorządu terytorialnego w Polsce na tle wybranych krajów Unii Europejskiej ze wskazaniem znaczenia władztwa podatkowego w kształtowaniu tej samodzielności.

It goes probably from the connection between the energy sector and interference into the natural environment, the exploitation the natural sources and its high emission, what has a special meaning nowadays. that is why European Union starts to thing about special meaning of this issue, can we find this in its strategy documents. The main aim of this work is the attempt assessment the level of realization the sustainable development in climate change and energy area in Poland and comparing that to the other European countries. The sustainable development in the climate change and energy has been shown in Polish and European countries strategy. The comparative analysis Poland to the other EU countries has been done. The state documents and study literature have been used in this article. The comparative analysis were based on data form Eurostat. ; Współcześnie problematyka związana ze zmianami klimatycznymi i pozyskiwaniem, wykorzystaniem energii jest szeroko dyskutowana tak na arenie międzynarodowej, jak i krajowej. Wyrazem obecności tej tematyki w dyskursie publicznym jest ujmowanie jej w wielu dokumentach międzynarodowych, krajowych (także tych o charakterze strategicznym). Stanowi ona także jeden z obszarów omawianych w kontekście zrównoważonego rozwoju poprzez zwrócenie uwagi m. in. na pozyskiwanie energii ze źródeł odnawianych, zużycie energii pierwotnej, czy też wielkość emisji gazów cieplarnianych. The criminal treatment of juveniles in the European Union was regulated in earlier times and has evolved by national legislation of Member States, international treaties, documents of the Council of Europe, as well as by European Union Treaties, European Parliament Resolutions and Press Releases of the European Commission. The regulatory divergence of criminal treatment of juveniles in EU countries implies the need to elaborate certain minimum rules to prevent and to combat juvenile delinquency, oriented to education of minors and their punishment.
Ombudsman, unlike the court, cannot make binding decisions, but usually public authorities follow its recommendations, otherwise he may bring the case to the attention of politicians and the public by informing Parliament. The link between the two fundamental European institutions, the Court of Justice of the European Union and the Ombudsman, may be defined as a strong direct link between the problems of EU citizens. Requests to each institution represent an interest of each petitioner, which is intended to be solved by matching laws with moral rules and general principles of law.
This paper is an attempt to analyse European leadership and the role played by a reunited Germany in the European Union. The author proposes five fundamental theses: 1) the reunification of Germany ruined the balance of power in Europe; 2) the Eastern enlargement of NATO and the EU has moved the zone of political and military influence of the USA to the line of the Bug river; 3) the Germans have confirmed their position as a European power; 4) the foreign policy of Angela Merkel is a continuation of Gerhard Schroder's policy, meaning a transfer of the focus from European policy to prioritising German national interests; 5) the German issue has remained open. ; This paper is an attempt to analyse European leadership and the role played by a reunited Germany in the European Union. There is some useful literature on the subject but this needs be to completed. The main purpose of the paper is, therefore, to research the possibilities and methods of legal and extrajudicial cooperation betweentwo continents which are very distant from each other. The article is an analysis of European Union legislation on conservation and protection of biodiversity. It emphasizes the achievements of the activity of the EU in this area, mainly the establishment of the Natura 2000 Network, examining the obligations of the Member States that are stipulated in the Birds and Habitats Directives. It points out to the integration of biodiversity protection in other fields of EU sectoral policies as well.
The European continent, under the urge of the events generated by the process of building Europe that has led to an enlargement of the external European Union borders towards the east, undergoes a process of alteration. No matter on which side of the EU border they may be, the citizens of the European countries are entitled to enjoy the fruit of welfare, security and freedom. The development of a coherent neighbourhood policy in Brussels becomes an imperative resulting from the need for communication and cooperation amongst people and countries. No matter the view on the European Union external border, the dialogue on all levels of the society through the means of inter-university cooperation is a factor providing the communication needed for good neighbourhood. Thus, the stiff borders fade away. By setting up a university network comprising both partners from within and outside the European Union, a bond is established over the external border of the community. From this point of view, inter-university cooperation at the external borders of the European community turns into a promoter of good neighbourhood values.

Ewolucja systemu doradztwa rolniczego miała indywidualny przebieg w poszczególnych krajach Unii Europejskiej, co spowodowało ukształtowanie różnych form systemu doradztwa – od państwowego, przez półpaństwowy, aż do prywatnego. Zmiany te z jednej strony były odpowiedzią na potrzeby rolników, z drugiej zaś wynikały ze specyfiki i możliwości budżetowych danego kraju. W ogólnym ujęciu, doradztwo jest działalnością zmierzającą do optymalnego rozwiązywania rodzących się problemów. Doradztwo (ang. extension or advisory) wiąże się z czynnością praktyczną – doradzaniem, które jest zdarzeniem społecznym polegającym na doraźnym działaniu udoskonalającym zachowanie jednostek lub grup, przez udział doradzającego (doradcy) w rozwiązywaniu problemów osób, którym się doradza, problemów dostrzeżonych nie tyle przez te osoby lub grupy, ile przez doradzającego. Z kolei doradztwo rolnicze to multidyscyplinarna dziedzina wiedzy łącząca w sobie elementy wielu nauk, między innymi: pedagogiki (andragogiki), psychologii, socjologii, ekonomii, zarządzania, marketingu. ; Summary: Modern farm advisory systems of the European Union countries were formed under the influence of evolutionary change and institutional transformations which have been made in the recent decades. The evolution of the farm advisory system had a unique course in different countries which resulted in shaping different forms of the advisory system from public, through semi-public to private. The aim of this study is to confirm that the farmers from the most industrialized countries eagerly use the instruments of common agricultural policy in the field of advisory services. It is widely assumed that the proper use of the farm advisory system affects the effectiveness of agricultural production in a specific country, sector or specific trade. The result of the conducted analysis is a thesis that highly developed countries of the Western Europe have been using various forms of agricultural production support for years, including all instruments related to the farm advisory system which favours their agricultural development. The first part of the article deals with questions concerning the oncoming enlargement of the European Union by former eastern-bloc countries such as Poland, Hungary, the Czech and Slovakian Republics, Romania, Bulgaria as well as Slovenia and the three Baltic states. It focuses upon the "europe-Treaties" which the European Union has concluded or is going to conclude the countries obove. The question being raised is whether these treaties can be regarded as sufficient preparation for future membership in the European Union. The treaties' specific deficiencies, such as the existence of a safeguard-clause, as well as the exclusion of a unitary competition right and of the agrarian market are mentioned. The enormous differences between the GDP per capita of the most advances Vysehrad-countries and least developed members of the European Union, as well as the non-compatible structure of these countries' national economies are expected to cause extraordinary problems of adjustment. Furthermore the question is raised if the option of further integration without membership would not be a viable alternative for the oncoming 8 to 10 years. The second part of the article deals with the future perspective of an enlarged Union. First the specific three-structure of the Union is described; the Union being characterized as a "compound" of supranational and intergovernmental elements. Questions concerning the oncoming reforms of the institutions are raised. Furthermore, the article deals with the aspect of a guiding principle for future political development of the Union. The Author concludes that the idea of a European State cannot be regarded as a realistic perspective for the oncoming decades. The objective of a general supranationalisation in the field of European cooperation would inevitably lead to a fundamental conflict with the principles of democracy; this being due to the lack of a unitary European nation as the sovereign and the subject of democracy. A mixed structural "compound" not unlike the present three-pillared structure is therefore the only realistic alternative in the foreseeable furure. Po przeszło 12 latach realizacji EPS i dwóch wstrząsach politycznych – kryzysie ukraińskim i arabskiej wiośnie, nadszedł czas kompleksowej oceny i rewizji niektórych założeń.W 2015 r. rozpoczęły się konsultacje dotyczące nowego kształtu EPS, tak by polityka ta z jednej strony nadal wypełniała swoją zasadniczą funkcję wspierania i promocji praw człowiekai demokracji w państwach sąsiedzkich, ale z drugiej strony by UE mogła efektywniej wpływać na swoje bezpieczeństwo zewnętrzne. Po ponad półrocznym okresie konsultacji, w których udział wzięły zarówno instytucje UE, państwa członkowskie, a także organizacje pozarządowe, w listopadzie 2015 roku Komisja Europejska przedstawiła założenia reformy EPS, które można określić jako nową Europejską Politykę Sąsiedztwa. W artykule przedstawiony zosta dotychczasowy model EPS, w tym także przesłanki ustanowienia polityki w 2004 r., następnie ukazana została ewolucja EPS, a w kolejnej części artykułu omówione zostały założenia nowej EPS na podstawie analizy dokumentów instytucji UE. ; After over 12 years of implementation of the European Neighbourhood Policy and the two political upheavals – Ukrainian crisis and the Arab Spring, it is time for its comprehensive assessment and review of certain assumptions. In 2015 began consultations on a new shape of the ENP, so that the policy on the one hand might continue to fulfill its essential function of supporting and promoting human rights and democracy in neighboring countries, but on the other hand, the EU can effectively influence their external security. After more than six months of consultations, which was attended by the EU institutions, Member States and non-governmental organizations in November 2015, the European Commission presented the principles of the reformof the ENP, which can be described as the new European Neighbourhood Policy. The paper presents the current model of the ENP, including evidence to establish policy in 2004., then isshown the evolution of the policy and in the next part of the article is discussed the establishment of a new ENP based on analysis of documents of the EU institutions.
Attracting of foreign direct investments (FDI) has becoming increasingly researched worldwide as they contribute to the economic growth of countries. The most important factors determining the choice of firms to expand internationally through FDI are: access to local resources, access to the domestic market, a high level of efficiency and strategic asset acquisition. The FDI flows of the European Union are still influenced by the global economic and financial crisis. In 2012 the FDI outflows decreased with 53 % as compared to 2011, registering their lowest level since 2004. The recovery will take longer than expected, mostly because of global economic fragility and policy uncertainty.
