Ö Z E TYakın tarihimizin önemli noktalarından sayılan, "Musul Meselesi" çözümünün adil olmadığı, günümüzde daha açıklık kazanmıştır.Yapılan haksızlıklardan en büyük huzursuzluğu da,bölgedeki toplumlar arasında, Irak Türklerinin yaşadığı söylenebilir. Birinci Dünya Savaşı'nda Osmanlı Devleti ve müttefiklerinin yenilmesi ile Anadolu ile Arap yarımadası arasında bulunan Mezopotamya bölgesinde İngiliz İmparatorluğu'nun petrol çıkarları doğrultusunda,yapay sınırlarla Irak Devleti kurulmuştur. Musul ve Kerkük bölgesi Misak-ı Milli kapsamında olmasına ve burada yaşayan Türklerin de nüfusun çoğunluğunu teşkil etmesine rağmen, bölge, İngilizlerin çeşitli hile ve entrikalarıyla Türkiye'den kopartılmıştır. Lozan ve Haliç konferansları sonuçsuz kalınca, bölgenin kaderi Milletler Cemiyeti'nin vereceği karara bağlanmak istendi. Milletler Cemiyeti'nin kararını Türkiye kabul etmedi ise de, sonunda 05 Haziran 1926 Ankara Antlaşması'nı imzalayarak, bugünkü Musul, Kerkük, Erbil ve Süleymaniye illerini kapsayan o dönemin Musul vilayetini İngiliz mandası altında Irak'a bıraktı.Ancak 1932 yılında, manda rejiminden sonra, Irak Türklerinin hakları tanınmış, kendi dilleriyle eğitim hakkı, Türk bölgelerinde Türkçe'nin de resmi dil olması, görev yapacak memurların imkan nispetinde aynı bölgelerden seçilmeleri garanti altına alınmıştı.Fakat,Irak, Milletler Cemiyeti garantisi altında taahhüt ettiği bu hakları Türklere hiç uygulamamıştır.Saddam diktatörlüğü döneminde ise, Türk toplumuna yapılan haksızlıklar artmış,siyasi ve kültürel hakları çiğnenmiş,vatandaşlık hakları Türklerden esirgenmiştir. Her iki savaştan sonra Irak'taki durum,Türkmen toplumunun endişelerini arttırmıştır.Türkmenler,hem yeni Irak yönetiminin,hem de Kürt liderlerin yanlış politikalarına maruz kalmıştır.Irak'ın önümüzdeki günlerde alacağı şekil Türkmenler ve dolayısı ile Türkiye için çok önemlidir. 2004 Haziran ayında oluşturulan ve Temmuz ayı başından itibaren yönetimi üstlenen hükümet içerisinde sadece bir Türkmen bakan yer alabilmiştir.O'na da bilim ve teknolojik gelişmelerle ilgili sorumluluklar,yani Irak'ta etkisi ve uygulaması hiç bulunmayan hususlar bağlanmıştır.Yeni kurulacak Irak Devleti'nde Türkmenler açısından en tercih edilen yönetim,yeni devlet otoritesinin bütün ülke sınırları içerisinde sağlanmasını müteakip,toplumların nüfuslarına göre temsil edildikleri demokratik bir yapıya kavuşulması olacaktır.Eğer Irak Devleti üniter değil, federasyon olacaksa,bunun da etnik veya dini esaslara göre değil,coğrafi esaslara göre yapılması gerekir,Irak Türkleri ve bölgenin geleceği için en faydalı olan yapılanma düşünülüyorsa,bu yönetim şekillerinden birisi uygulanmalıdır. SUMMARY Today it is more obviously understood that the implemented solution for "Mousul Conflict", which is accepted as one of the milestone events of our recent history, is not fair. It can be easily uttered that of all the injustice made among the local communities, Turks in Iraq faced the worst.With the defeat of Ottoman Empire and its Allies in the First World War, Iraq is established with artificial borders in the region of Mesopotamia ,which is placed between Anatolia and Arabian Peninsulas, through the petroleum benefits of the Great Britain Empire. Although the Mousul and Kirkuk is within the borders defined in the National Pact and the majority of the population who lives there were Turks, this region was segregated from Turkey by the various ruses and intrigues of the Great Britain Empire.Since the Lousanne and Golden Horn Conferences did not come to a solution, the faith of the region was depended on the Nations Association's decision. Although turkey did not agree with the Nations Association's decision, in the end in 05 July 1926 signed the Ankara Treaty and left the Mousul City, which includes today's cities of Kırkuk, Mousul, Erbil, Süleymaniye , to Iraq under the mandatory of Great Britain Empire.However, after the mandatory regime in 1932, rights of the Turks in Irak including education rights in native language were given formally, and to accept Turkish as formal language in Turkish regions and to select the employees from the same regions were relatively guaranteed. But, Iraq has never implemented these rights of Turks accepted under the guarantee of Nations Association by them. As for the Saddam dictatorship, injustices acted to Turks had been increased, political and cultural rights were violated, citizen rights of Turks were not given. After both fights, situation in Iraq increased the anxieties of Turkmen. Turkmen were subjected to wrong politics of both Iraq government and Kurdish leaders. Act of Iraq government in following days is essential for Turkmen and so Turkey. There was only one Turkman minister within the government that was formed in June 2004 and took on the administration from the start of July. He was responsible for science and technologic developments, that is to say, the points which do not have any effect or application. The most preferable regime in the new form of Iraq amongst the Turkmen is a democratic structure that is represented according to the societies' population percentages after providing government authority within the whole country. If Iraq Government will be a federation but not unitary, this also must be done depending upon geographical foundations but not ethnic or religious foundations. If the most profitable reform for the Turks in Iraq and future of region is considered, one of these regimes must be implemented.
Kurumsallaşma, her konuda iletişim ve karşılıklı etkileşimin sağlandığı, kuralların egemen olduğu yapıları ifade etmektedir. Profesyonel yönetimin etkin olduğu, görev tanımlarının ve dağılımlarının yapıldığı, iş yapış şekilleriyle ilgili standartların belirlendiği, kurumun sürekliliğin sağlandığı ve çalışanların uyum içerisinde çalıştığı bir yapıyı ifade etmek için kurumsallaşma kavramı kullanılmaktadır. Kurumsallaşma sürecini tamamlayan kurumların daha şeffaf, hesap verebilir ve katılımcı bir anlayışla yönetileceği ifade edilebilir. Kurumsallaşma ile birlikte belediyelerde kurumsal süreklilik sağlanarak, yönetimlerin gelecek seçimden sonrada hizmete devam edebilmelerinin önü açılabilecektir.Son yıllarda özel veya kamu farketmeksizin kurumların birçoğu kurumsallaşmaya önem vermeye başlamışlardır. Ancak Türkiye'deki literatür incelendiğinde belediyelerde kurumsallaşmaya yönelik yeterli çalışma olmadığı tespit edilmiştir. Bu nedenle belediyelerde kurumsallaşmaya etki eden faktörlere alan araştırması kapsamında değinilerek bu konudaki çalışma eksikliğini gidermek için bu tür bir çalışmaya gereksinim duyulmuştur. Bu tez, kurumsallaşmaya etki eden faktörlerin belediyelerdeki durumunu ve uygulanabilirliğini belirlemeye yönelik teorik ve ampirik bir araştırmadır.Tezin amacı, belediyelerde kurumsallaşmaya etki eden faktörleri ortaya koyarak, bu faktörlerin belediyelerde ne ölçüde uygulandığını tespit etmektir. Tezin kapsamında kurumsallaşmaya etki eden gerek özel gerekse kamuda genel olarak kabul edilen faktörler açıklanarak bu faktörler belediyeler özelinde incelenmiştir. Teorik açıklamaların uygulamadaki yansımalarını analiz edebilmek amacıyla da alan araştırması yapılmıştır. Araştırmanın örneklemini İstanbul Avrupa Yakası sınırları içerisinde bulunan bir ilçe belediyesinde çalışan; memur, sözleşmeli personel, iştirak personeli ve işçiler oluşturmaktadır. Araştırmanın ve modellemenin bu ilçe belediyesi özelinde gerçekleştirilmesiyle köklü geçmişinin ve aynı siyasi parti tarafından çok uzun süredir yönetiliyor olmasının kurumsallaşmasına olumlu yansıyıp yansımadığının tespit edilmesi de hedeflenmiştir. Araştırmada yöntem olarak anket kullanılmıştır.Araştırmanın bulgularından, kurumsallaşmanın belediyeler için kritik önem arz ettiği sonucuna ulaşılmıştır. Katılımcılardan alınan verilere göre çalışanların kurumun denetim ve mali sistemi hakkında yeterli bilgiye sahip olmadıkları ve bu konular hakkında daha fazla bilgilendirilmeleri gerektiği görülmüştür. Ayrıca çalışanların iç denetim ve bütçe hazırlama süreçlerinde daha aktif rol almaları gerekliliği de tespit edilmiştir. Liyakatsizliğin kurumda aşılması gereken en önemli sorunlardan olduğu görülmüş, işe alımlarda ve terfilerde yazılı sınav usulünün şeffaf, tarafsız ve hesap verebilir çerçevede yapılması ve sözlü mülakat usulünden vazgeçilmesi bu sorunun çözümüne öneri olarak sunulmuştur. Çalışmanın belediyelerde kurumsallaşma konusunu derinlemesine bir bakış açısıyla irdelemesi çalışmayı önemli kılan bir unsurdur. Tezde son olarak, kurumsallaşma konusunda gelecekte çalışma yapacak araştırmacılar için bir takım önerilere yer verilmiştir. --- Institutionalization refers to the structures in which communication and mutual interaction are provided and rules are dominant. It refers to the structure in which professional management is effective, job descriptions and distributions are made, standards regarding the way of doing business are determined, the institution is maintained and its employees work in harmony. It can be stated that the institutions that have completed the institutionalization process will be managed with a more transparent, accountable and participatory approach. Along with institutionalization, institutional continuity will be provided in municipalities, and it will be possible for administrations to continue to serve after the next election.In recent years, many institutions have started to attach importance to institutionalization regardless of whether they are private or public. However, it was determined that not enough efforts to institutionalize the municipality reviewing the literature in Turkey. For this reason, such a study was needed to address the lack of work on this issue by addressing the factors affecting institutionalization in the municipalities. This thesis is a theoretical and empirical research aimed at determining the situation and applicability of factors affecting institutionalization in municipalities.The aim of the thesis is to identify the factors that affect institutionalization in municipalities and to determine to what extent these factors are applied in municipalities. Within the scope of the thesis, the factors that affect institutionalization, both private and publicly accepted, have been explained and these factors have been analyzed by municipalities. Field research was also conducted to analyze the reflections of theoretical explanations in practice. The sample of the research is working in a district municipality within the borders of Istanbul European Side; civil servants, contracted personnel, participation personnel and workers. It is also aimed to determine whether the rooted past and the fact that the long-run ruling by the same political party has had a positive effect on the institutionalization by conducting the research and modeling for this district municipality. The survey was used as a method in the research.From the findings of the research, it was concluded that institutionalization is critical for municipalities. According to the data to be taken, the employees should be sufficient about the audit and financial system of the institution and they should be informed about these issues. In addition, it was determined that employees should take a more active role in internal audit and budget preparation processes. Injustice appears to be one of the most important problems to be overcome in the institution, and in recruitment and promotion, the written examination procedure should be carried out in a transparent, impartial and accountable framework, and the oral examination should be abandoned. Studying the issue of institutionalization in the municipalities from an in-depth perspective is an important factor for the study. Finally, there are some suggestions for future researchers on institutionalization.
Din olgusunun kişisel ve toplumsal etkilerinin büyük olması, tarihsel süreç içerisinde değişen koşullara da eklemlenmesini beraberinde getirmiştir. Bu eklemlenmeyi Orta Doğu'da özellikle İslam dininde görmek mümkün olmuştur. Küreselleşen ve modernlik kazanan dünya düzeninde meydana gelen siyasi-politik düzlemde, entegrasyon ve liderlik düsturuyla bölgedeki içsel dinamikler, yarı değişken yapılarla harekete geçirilmiştir. Bu yarı değişkenliğin değişmeyen tarafı dogmatik ve tarihi kültürel bağlar olurken, değişken tarafı ise entegrasyon yolunda oluşturulan doktrin ve yapılanmalar olarak vuku bulmuştur. Özellikle Sünni ve Şii mezheplerinin siyasi tasavvurunda, bu manada bölgede etkinlik içerisinde olduğu görülmüştür. Türkiye ve İran'ın bölge politikaları, bu iki mezhep dahilinde, din olgusuna uygun şekillendiği iki örnek olarak öne çıkmıştır. Dolayısıyla 2000'li yıllarda İslam dini, mezheplerin yarı değişken yapısıyla Türkiye ve İran tarafından politik bir hüviyet olarak kullanılmıştır. Bu sayede hem bölgedeki içkin kültürden doğan bazı gruplara -Hizbullah, Hamas, Müslüman Kardeşler, Özgür Suriye Ordusu vb.- hitap etme işlevinin hem de siyasi ihtirasın ifa edilmesi amaçları gerçekleştirilmeye çalışılmıştır. Türkiye ve İran, bölgesel vizyonda Filistin Sorunu ile dini-kültürel yaklaşımını sürdürmede ısrarcı davranırken, Orta Doğu'da başlayan Arap Baharı sürecinde bu ısrarcı davranışlarını politik eksende arttırmaya koyulmuşlardır. Özellikle İran, Arap Baharı sürecinin hemen başında net bir tavır ortaya koyarken; Türkiye, Avrupalı devletlerle beraber hareket etme kararı doğrultusunda, "tedbirli hareket etme" tarzında bir politik yaklaşım içerisinde olmuştur. Türkiye'nin bu yaklaşımı, bölgeye yönelik politikasında bazı "git-gel"lere neden olduğu gibi, birtakım olguların da beklenerek görülmesini sağlamıştır. Suriye İç Olayları, Soğuk Savaş Dönemi'ni andırır tarzda uluslararası sistemde güç mücadelesinin doruğa çıkmasına ve ülkesel bazda her aktörün pragmatik bir bakış açısıyla kendi güç unsurlarını tekrardan gözden geçirmesine neden olmuştur. Suriye'deki bu olayların başlaması; Türkiye'yi Arap Baharı'yla yakından ilgilenen baş aktörlerden biri haline getirirken, İran'ın Batı'ya ve bölge sınırlarında kendisine karşı savaşanlara yönelik mücadele ritmini arttırmıştır. Bu iki ülke kendi güç unsurlarını, mezhepsel anlayışları da kapsayacak şekilde "ortak din, ortak kültür, ortak tarih" üzerinden belirlemeye devam etmiştir. Ilımlı-radikal, modernist-anti modernist gibi birbirinden farklı format ve anlayışları barındıran bu unsurlarla politik eksenini oluşturan Türkiye ve İran, "avantaj" kıstası çerçevesinde, Batılı devletler nazarında ilişkilerin seyri konusunda önemli yer tutmuşlardır. ; The fact that the personal and social effects of the phenomenon of religion have been great have brought about the articulation of the changing conditions in the historical process. In this way, the aim is to realize the function of addressing some groups born from the inner culture in the region - Hezbollah, Hamas , Muslim Brotherhood, Free Syrian Army etc. - as well as political ambition. Turkey and Iran, regional vision on the Palestinian question with persistent religious-acting maintain the cultural approach in the process of starting the Arab Spring in the Middle East have set out to improve this persistent behavior of the political axis. Iran, in particular, showed a clear attitude at the beginning of the Arab Spring process; Turkey, in line with the European countries decided to act together, "cautious movement" has been in a political approach to style. Turkey's approach, on the basis of policy towards the region "go to work for it" s as to cause, by waiting in enabling seen a number of cases. Syrian Internal Events have led to the climax of the power struggle in the international system in the style of the Cold War, and every actor on a national basis has revisited its own elements of power through a pragmatic perspective. These two countries continued to identify their own elements of power on the basis of acak common religion, common culture, common history, including sectarian approaches. Demokratik sistemlerde seçimin önemi ve yeri tartışılmaz bir gerçektir. Seçimler ile halk kendisini yönetecek kişileri seçmektedir. Seçim yarışına giren adaylar herhangi bir siyasi partinin adayı ya da bağımsız aday olabilirler. 13 Mart 2018 tarihinde yapılan yasa değişikliğine kadar yapılan bütün seçimlerde siyasi partilerin seçim sürecinde yasa gereği ittifak yapmaları yasaktı. Yapılan yasa değişikliğiyle seçim ittifaklarının önündeki engeller kaldırılarak, siyasi partilerin seçimlerden önce ittifak yapmalarının önü açılmıştır. Dolayısıyla seçim ittifakları seçim sonuçlarını etkileyen önemli bir unsur haline gelmiştir. Seçim ittifakı birden fazla partinin seçimlerden önce veya seçim sırasında kalıcı ya da geçici güç, iş ya da eylem birliği yapması şeklinde tanımlanmaktadır. Seçim ittifaklarının seçim öncesi ittifaklar ve seçim sonrası ittifaklar türlerinin dünyada birçok örneği bulunmaktadır. Ülkemizde ise resmi olarak seçim ittifaklarıyla ilk kez 24 Haziran 2018 seçimlerinde karşılaşılmıştır. Yasa değişikliği sonrasında Türkiye'de yapılan seçimlerde ittifakların seçim sonuçlarına olan etkisi bu çalışmada kapsamlı bir şekilde ele alınmıştır. Bu çalışma ile seçim ittifaklarının bölgeler ve iller bazında siyasi partilerin oy dağılımı üzerinde önemli bir etkisinin olduğu belirlenmiştir. Seçim ittifakının, oy oranı yüksek olan AK Parti ve CHP gibi siyasi partiler üzerindeki etkisinin daha düşük olduğu; baraj altında kalan İYİ Parti, SP ve BBP ve oy oranı düşük olan MHP gibi siyasi partiler üzerinde ise olumlu etkisinin daha fazla olduğu görülmüştür. Bu durum küçük partilere siyasi çizgilerine yakın olan ve baraj sorunu olmayan partiler ile pazarlık masasına oturma fırsatını sunmaktadır. HDP ise ittifaklardan bağımsız olarak girdiği son seçimlerde önceki seçimlere göre oy sayısını arttırmıştır. Ayrıca seçim ittifakları tüm siyasi partilere mecliste temsil edilme fırsatını da sunmaktadır. Seçim ittifakları Türk siyaset tarihine katkı sağlayarak siyasi partiler arasında yaşanan oy geçişlerini kolaylaştırmaktadır. Sonuç olarak siyasi partiler olanaklarını ve güçlerini bir araya getirerek yalnız başlarına ulaşamayacakları siyasi hedeflerine seçim ittifakları ile ulaşma şansı yakalamıştır. Seçim ittifakları hükümetlerin kurulmasında, meclisteki sandalye sayısının belirlenmesinde ve diğer siyasi süreçlerde siyasi partilerin aktif olmalarına olanak sağlamaktadır. Türkiye'nin kozmopolitik nüfus yapısı göz önünde bulundurulduğunda farklı siyasi partilerin ve bu partileri destekleyen farklı kitlelerin olduğu söylenebilir. Dolayısıyla seçim ittifakları farklı etnik yapıda ve inançtaki siyasal görüşlerin bir araya gelmesine de imkân sağlamıştır. Seçimlere katılım oranı 2015 yılında .6 iken, 2018 yılında ise .37 olarak gerçekleşmiştir. Seçimlere katılım oranında %0.77 birimlik artış, ittifaklara dâhil olan küçük siyasi partilerin mecliste temsil edilme şansının olacağı ümidiyle söz konusu partilerin seçmenlerinin sandığa gitmelerinden kaynaklanmaktadır. Dolayısıyla seçim ittifakları ülkemizde seçimlere katılım noktasında da önemli katkı sağlamıştır. With the elections, the people choose the people who will manage itself. Candidates entering the election race can enter to the elections as candidates for any political party or as independent candidates. Till the elections held until March 13, 2018, political parties were forbidden to make alliances in the election process, but with the amendment made on this date, the obstacle to the election alliance was removed and the way for political parties to make alliances before the elections was opened. So, the election alliances have been an important issue affecting the election results. The election alliance is defined as the fact that more than one party cooperates with permanent or temporary power, work or action before or during elections. There are many examples of the election alliances in the world, before and after the election. In Turkey, official election alliances were applied in the June 24, 2018 elections, the first time. In the elections after the amendment of the law, the effect of the alliances on the election results is comprehensively discussed in this study. By the study, it was determined that the election alliances had a significant effect on the distribution of votes of political parties on the basis of regions and provinces. HDP increased the number of votes compared to previous elections in the last elections it entered independently from alliances. It was observed that the election alliance had a lower impact on political parties such as the AK Party and the CHP which had a high voting rates, and had a positive effect on the political parties such as the IYI Party, the SP and the BBP that under the election threshold and the MHP with a low voting rate. This gives small parties the opportunity to sit at the bargaining table with parties that are close to their political lines and have no election threshold problems Election alliances also offer to all political parties the opportunity to be represented in parliament. Election alliances contribute to the history of Turkish politics and facilitate voting transitions among political parties. As a result, by bringing together the possibilities and powers, political parties have the chance to reach their political goals, which they could not reach alone, through election alliances. Election alliances enable political parties to be active in establishing governments, determining the number of seats in parliament, and other political processes. It can be said that there are different political parties and different fans who support these parties, when considering Turkey's cosmopolitan population structure. Therefore, the election alliances also allow to come together political views which different ethnicities and beliefs. While the rate of participation in the elections was 86.6% in 2015, it was 87.37% in 2018. The 0.77% increase in the participation rate is due to the small political parties' voters going to the polls. Because with the participation of these parties in the alliances, also the hope of party fans to be represented in the parliament will increase. Siyaset ve iletişim kavramları günlük hayat ilişkilerini yönlendirmektedir. Bu iki kavramın bir araya gelmesiyle oluşan siyasal iletişim ise, en çok uğraş verilen çalışma alanları içerisinde yer almaktadır. Bu açıdan bakıldığında siyasal adayların, seçmenleri etkilemek amacıyla siyasal iletişim uygulamalarına daha çok önem verdikleri görülmektedir. Bu bağlamda yerel seçimlerde siyasal adayın imajı ve bu imajın seçim döneminde seçmenler üzerindeki etkisi, araştırılması gereken bir konu olarak karşımıza çıkmaktadır.Bu çalışmayla 2014 Konya Yerel Seçimleri sürecini siyasal iletişim kavramları açısından incelemeye yönelik olarak, seçmenin kararında etkili olan, adayların imajına etki eden faktörlerin ne olduğu ve nasıl değiştiği üzerine odaklanılmaktadır. Çalışma bu yönüyle, hem adaylar hem de seçmenler açısından, siyasal iletişimde ortaya çıkan sorunların tespiti ve çözümü, daha sağlıklı bir seçim sürecinin oluşumu için alan araştırmasına dayalı veriler sunmaktadır.Araştırmanın evrenini, Konya merkezde yaşayan ve oy verme hakkına sahip olan vatandaşlar oluşturmaktadır. Örneklem seçiminde rastlantısal örneklem alma tekniği esas alınmıştır. Araştırmada katılımcılara yüz yüze anket uygulanmış, 388 anketin analiz için uygun olduğuna karar verilmiştir. Verilerin analizinde; faktörlerle çeşitli değişkenler (katılımcıların parti bağımlılığı, oy verme karar zamanları, siyasal kimlikleri, oy vermede etkili faktörler, aday yüz yüze görüşme durumu ve 2014 Yerel Seçiminde oy verilen parti) arasındaki ilişkinin anlamlılığını ortaya koymak için Tek Yönlü Varyans Analizi (ANOVA) kullanılmıştır. Çoklu karşılaştırmalarda Tukey Testi esas alınmıştır. Cinsiyet ile faktörler arasındaki ilişki ise Bağımsız Örneklem T- Testi ile ortaya konulmuştur.Araştırma bulgularına göre Konya'da yaşayan seçmenler yerel seçimlerde adayın partisini ve adayın kendisini oy verirken daha çok önemseyerek tercihlerini bu yönde kullanmaktadırlar. Araştırmaya katılanların partiye olan bağlılıkları güçlendikçe, oy vermede adayın kendisini daha etkili bulmaktadırlar. Yine seçmenlerin siyasal kampanya ve konulara ilgi düzeyleri arttıkça, parti bağlılık düzeylerinde de bir artış yaşandığı tespit edilmiştir. Katılımcıların siyasal kampanya ve konulara orta düzey ilgi gösterdikleri dikkat çekmektedir.Siyasal bilgilenme açısından takip edilen ve önemsenen kitle iletişim araç ve yöntemleri incelendiğinde; aritmetik ortalama değeri açısından önemsenen iletişim araçları içerisinde televizyon ilk sırada yer almaktadır. Bunu adayın miting ve toplantıları, aile ve yakın çevre izlemektedir.Araştırma sorularına cevap veren seçmenlerin büyük çoğunluğu belediye başkanlığı seçimleri için adayın mesleğinin çok önemli olmadığını ve bunun yanında mimar ve mühendisliğin aranan bir meslek olduğunu ifade etmektedirler.30 Mart 2014 Konya Büyükşehir Belediye Başkanlığı seçimlerinde en çok oy verilen partiye bakıldığında katılımcıların yüzde 58.2'si AK Parti'yi desteklediklerini ifade etmişlerdir. Yine araştırmaya katılanların yüzde 63.6'sı sağ seçmen grubunda yer almaktadır. Konya örneğinde yürütülen bu yerel seçim araştırmasının bulguları; katılımcıların yarıdan fazlasının seçim öncesinde hangi partiye oy vereceği belli olan seçmenlerden oluştuğunu göstermektedir. ; The concepts of politics and communication are directed the everyday life. The political communication which is blended with these two concepts, is included one of the field of occupation. Within this scope, it is clear that political candidates give more importance to political communication practices in order to influece the voters. Therefore, the style of political candidates and the impact of the style over the voters during local election are the subject to be analysed.This article focuses on the factors affected on the decisions of voters and the factors affected on political candidate with the scope of political communication concepts observed during 2014 Konya Local Elections. The article submits the date based on field survey regarding the problems and solutions occured in the political communication both the perspective of voters and candidates together with healthier voting process.The population is included the citizens who live in Konya city center and carry the right to vote. Accidental sampling is based on for the sampling process. Face to face questionnarie was conducted during the research and 388 of the surveys was evaluated as applicable. One-Way Analysis of Variance (ANOVA) was conducted in order to reveal the meaningfulness the relation within the various variables such as the political party dependency of the attendees, voting decision time, political identification, the factors affected on voting, the status candidate of face to face interaction, the political party voted at 2014 Local Election. Tukey's test is based on for multiple comparisons. The factors related with gender is based on Independent Sample T- test. In accordance with the findings, the voters loceted in Konya give more importance and prefer the party of the candidate and the candidate himself while voting. It was observed that the stronger the voter advocate the political parties, the more possible the voter vote for the candidate. Furthermore, if the attention of voters go up towards the election campaigns, it was analysed that their independency level goes up, too. However; it was pointed out that the attendees show moderate interest in election topics and campaign.As per analysing mass media and its methods which are followed and minded for political informing by voters, television takes place on the top based on the arithmetic avarage. It is succeeded by "public demonstration" and "family and immediate environment". The majority of the attendees do not regard the occupations of the candidates as an important factor for mayorship election. However, the occupations such as artchitecture, engineering are prefered. When the most voted party is analysed at Konya Metropolitan Municipality Election on 30th March, 2014, 58.2 % of attendees stated that they voted for Justice and Development Party (AK Parti). The findings based on the related local election, shows that the attendees consist of the voters who take their choice before the election occurs. Besides, 63.6 % of the attendees are on the right wing.
Milli Güvenlik Kurulu, "devletin milli güvenlik siyasetinin tayini, tespiti ve uygulanması ile kararların alınması ve gerekli koordinasyonun sağlanması" çerçevesinde, silahlı kuvvetler komuta kademesi ile hükümet üyelerinin Cumhurbaşkanı'nın başkanlığında biraraya gelerek, karşılıklı görüş alış verişinde bulundukları ve görüş belirdikleri bir organdır. Özellikle kriz dönemlerinde dönemlerinde Türk siyasal hayatında oldukça etkili bir işlev görev Milli Güvenlik Kurulu, uygulamada oynadığı bu rol nedeniyle, zaman zaman ülkenin "en üst karar organı" nitelemelerine maruz kalmaktadır. Milli Güvenlik Kurulu (MGK), 1961 Anayasası'yla faaliyete başlamıştır. Türkiye'de Milli Güvenlik Kurulu'ndan önce de çeşitli savunma kurulları faaliyette bulunmuştur. Bunlar; Harb Encümeni(1922), Yüksek Müdafaa Meclisi ve Umumi Katipliği (1933) ve Milli Savunma Yüksek Kurulu(1949) dur. Ancak bunların görev alanları askeri savunmaya yönelik sınırlı bir alanı kapsamaktadır. Türkiye'yi bu tür bir organ arayışına iç siyasi gelişmeler ve dengeler ile dış dinamikler ve konjonktür götürmüştür. Dış dinamiklerin başında, özellikle İkinci Dünya Savaşı'ndan sonra ABD öncülüğünde bütün dünyada meydana gelen savunma konseptindeki değişiklik gelmektedir. Bu savaştan sonra milli savunma, kavramından daha kapsayıcı bir kavram olan milli güvenlik kavramına geçilerek, ABD örneğindeki Milli Güvenlik Konseyi(National Securty Cuoncil) gibi milli güvenliği sağlamakla görevli organlar kurulmuştur. Ancak Milli Güvenlik Kurulu uygulamasına Türkiye açısından bakıldığında, mevzuat ve geleneklerden hareketle, iç dinamiklerin belirleyici bir rol oynadığını görmek mümkündür. Bu nedenle Türkiye uygulaması, Batı ülkelerinden önemli ölçüde farklılıklar göstermektedir. Ülkemiz örneğinde asker ve sivillerin eşit oranda temsil edildiği MGK'nda milli güvenlik kavramı çerçevesinde ülkenin ekonomik, siyasal ve sosyal ve kültürel bütün sorunları müzakere edilmekte, toplantı sonucunda alınan kararlar, "alınması zorunlu görülen kararlar" amir hükmüyle Bakanlar Kurulu'na bildirilmektedir. Bu durum, askeri otoritenin devlet yapısı ve siyasal karar süreçleri içindeki özerkliği ile kendisini Batı ordularından ayıran aşırı merkezi yapısının bir sonucudur. Milli Güvenlik Kurulu, mevcut yapısı ve işleyişiyle, üç önemli soruna yol açmaktadır:1-Milli güvenlik kavramının kapsamının müphem ve muğlak bırakılması, uygulamada temel hak ve özgürlüklerin kısıtlanmasına yol açmaktadır.2-Kurul'a katılan kuvvet temsilcileri vasıtasıyla ordu iç politikaya müdahaleyle karşı karşıya bırakılmaktadır.3-Sivil idareyi devamlı gözetim altında tutan bir mekanizma görevi gören Milli Güvenlik Kurulu, yürütmenin gücünü kırmakta, enerjisini tüketme, zayıf ve etkisiz bırakmaktadır.Anayasa'da ve ilgili mevzuatta düzenlenen Kurul'un yapısı yeniden ele alınmalıdır. Kurulun amacı, statüsü, görevleri tartışmalara imkan vermeyecek şekilde, net bir şekilde ortaya konulmalıdır. Yapılacak yeni düzenlemede Kurul, asker -sivil hesaplaşma alanı olmaktan çıkarılma ve bir "danışma kurulu" statüsünü aşmamalıdır.THESIS SUMMARYThe National Security Council is an organ, consisting of the armed forces command rank and goverment members, who convene within the frame of "determination, designation and application of state's national security policy, taking decisionds and providing the necessary coordination", under the presidency oy the Head of State and mutually exchange views and state opinions. The National Security Council, whic performs a quite efective function especially in crises periods, due to the role it plays in application, is being exposed from time to time to " the highest decision organ" of the country description. The National Security Council (MGK), began activity by the Constitution of 1961. Before the National Security Council in Turkey there had been other various defence committees. These were War Council (1922), High Defence Assemly and General Clerkship (1933) and National Defence High Council (1949). However, the duty scopes of these cover a limited area directed towards military defence.Turkey has been carried to the search for such an organ by the internal and external development and balances and by external dynamics an conjunture. The most important of the external dynamics ist the change in the defence concept, that occurred around the world especially after the Second World War in the leadership of the USA. After this var it has been passed from national defence concept to national security, which concept is more comprehensive and as with the example of the USA's National Security Council, organs, appointed to ensure the national security have been established. When looked at the National Security Council application from the viewpoint of Turkey, however, starting from the regulations and customs, it is possible to see that the internal dynamics play a determining role. Therefore the application in Turkey shows substantial differences from the Western Countries. In our country's example in the National Security Council, where the military and civils are represented equally, within the frame of national security concept, economic, political, social and cultural and all problems ar negotiated. Decisions, taken at the end of the meeting, "decisions, regarded as compulsory" are communicated to the Council of Ministers by a superior's order. This situation is a consequence from the autonomy of the military authority from the state structure and political decision mechanism and from its excessive centralized structure, whic distinguishesit from the Western Armies. The National Security Council, with its present structure and functioning, opens the way to three important questions:1-Leaving the national security concept vague and confusing results practinally in the restriction of the basic rights and freedoms. 2-Through the power representatives joining the Council, the army is left face to face with intervention in domestic politics. 3-The National Security Council, which functions as a mechanism, holding the civil execution constantly under supervision, breaks down the strength of he execution, exhausts its energy, leaves it weak and unefective. The Council's structure, coordinated in the constitution and reladet regulations, must be handled anew. The Council's purpose, its status, and duties must be determined in a neat manner, which leaves no ways for debates. The Council in this new arrangement, should stop being a form of military-civil accounts-settling and should not exceed its status of "consulting comittee".

Böyle bir kar?ıla?tırma, hem genel yönetim hem de yerel yönetimler olarak her iki ülkenin farklılıklarını ve benzerliklerini ortaya koymakta, her iki ülkenin yerel yönetimler konusundaki tecrübesi aydınlatılmakta ve demokrasinin önemli kurumlarından olan yerel yönetimlerin daha da geli?tirilmesi açısından her iki ülkenin birbirlerinin tecrübelerinden faydalanabilmesinin yolu aranmaktadır. Günümüzde birçok ülkenin yönetimi, merkezden yönetim ve yerinden yönetim ilkelerine göre düzenlenmektedir. Kamu hizmetlerinin tek bir merkezden v yönetilmesine merkezden yönetim denirken yerinden yönetim ise kamu hizmetlerinin merkez hiyerar?isi dı?ındaki kamu tüzel ki?iliklerince görülmesidir. Türkiye'deki gibi doğrudan halk tarafından seçilmemektedir. ; In this study it is aimed to analyze general administrative structure and the local governments within the general administrative structure of Turkmenistan, one of the CIS countries, which have gained independence after collapsing of USSR and which are in transition period from the remnants of socialism and totalitarianism to democracy. Before such an analysis, the local governments in Turkey which has rich historical experience of democracy and local governments are studied, and then Turkmenistan?s general administrative structure and local governments are discussed and in the light of these discussions local governments of Turkey and Turkmenistan are compared. Such a comparison gives differences and similarities of countries from the standpoint of general administration and local governments and the local government experience of both countries are enlightened and the way of benefiting from both countries? local government experience from the standpoint of improving local governments as one of the important institutions of democracy is sought. In our days many countries are governed with principles of centralization and decentralization. In centralization public services are governed from one center and in decentralization the public services are rendered by public corporations out of the viii center hierarchy. States have established public corporations separate from central government organization hierarchy, but nevertheless controlled by the central government in order to render local services and to meet local needs of local people within the historical development due to the insufficiency of the centralization for rendering public services. Therefore the states had both central and local government organizations within time. Namely, government systems have been transformed into mixed system of government and such a mixed system of government is adopted by many countries. Turkey?s local government institutions are special provincial administrations, municipalities and village administrations. Special administrations can be established for large settlement places and metropolitan municipalities are the result of such arrangements. In Turkey a separate law was passed for each of these local government forms, and their foundation, duties, organs, organizations and other issues related with them are subject to these laws. The main local government form foreseen in the Constitution of Turkmenistan is municipalities. In accordance with 16th Article of the Constitution of Turkmenistan the civilian administration divisions are consisted of provinces, cities with status of provinces, counties, cities with status of counties, cities in counties, towns and gengeshliks. Local services in the level of provinces, cities with status of counties, counties are rendered by governorships established based on the rule of delegation of authorities. Municipalities are established in the cities in counties, towns and gengeshliks. Gengeshliks are formed by the union of one or more villages. There aren?t any institutions like special provincial administrations in Turkey and which are established based on decentralization. Moreover, there is no special act passed for village administrations in Turkmenistan. Therefore, the local government system of Turkmenistan is mainly consisted of municipalities. Special government forms like metropolitan municipalities also do not exist in Turkmenistan. Instead, there exist city governorships similar to metropolitan municipalities. Cities with population more than thirty thousand people gain the county status and such cities are governed by city governorships. Municipalities in Turkmenistan are established in gengeshliks, towns with population more than two thousand people and in cities within counties and their boundaries are the boundaries of related civil administration divisions. In Turkmenistan mayors are representatives of the central government and the also the head of the municipality, the local government. Mayors are responsible to governor by their duty as representatives of central government. Mayor is elected by municipal council among the members of the municipal council. They are not elected by the people directly like in Turkey.

ABD'nin ulusal güvenlik politikalarında ve askeri yapılanmasında ağırlıkları ve öncelikleri nedir,gelecekte ne olacaktır?Tezin hazırlanmasında bu konuda mevcut olan literatür; kütüphane, devlet arşivleri, açık basın vepiyasada mevcut olan kitaplar araştırılarak toplanmış ve okunduktan sonra çözümlenerek,yorumlanmıştır. Literatür taramasına ek olarak NATO ve BM görevlerine katılmış askeripersonel ile görüşmeler yapılarak bu tür silahların kullanımına tanık olup olmadıkları sorulmuş,tanık olduklarını beyan edenlere ise ne tür etkiler gözlemledikleri tekrar sorulmuştur.Bulgularımızın neticesinde şunu söyleyebiliriz ki; bu silahlar sahip oldukları önemli avantajlarınyanında, en az onlar kadar güçlü dezavantajlara sahiptir. Bu silahlara yönelik eleştiriler ise; çok gizlişekilde araştırılmaları ve geliştirilmeleridir. Bir başka eleştiri ise etkilerini tam olarak belirlenmedenüretip kullanılmaları başlığında yoğunlaşmaktadır. Özellikle ABD 1940'lı yıllardan beri bu silahlarlailgili her çalışmayı gizliyor, gizliliği kanunlarla koruyarak erişimi engelliyor. Yine de bu silahlarsavaşın, çatışmanın, kargaşanın vahşi ve de acımasız yüzleri için bir umuttur. En kapsamlı kullanımları1995 yılında Somali'de gerçekleşti. They have gained popularity and have varied systematicaly after the large scale warsleft its place to the small scale operations such as peace-support, peace enforcement, peacekeeping and humane aid opreationswhich are executed for limited objectives and regions. Presence of relatively more civilian people in the center of theseoperations needs different weapons and strategies to use. Availibity of information in common use, increasing pressure ofmedia and public-interest force goverments search for new and more humani and less risky ways, tools to provide security.Countries, give much attetion to these new technologies because they reduce the risks of death, permanet injuries andhandicaps in military operations, humanitarian operations and riot control operations and they give less damage to thematerial and infrastructure. Their costs are another advantage too. It seems that we will confront with them more frequently inthe affairs of security in near future. Some defence expert claim that these weapons will be multiple-force in every securitysituations. Their presence in the forms of biological, chemical, conventional, electric-electromanyetic, radio waves laserweapons is the prof of their potential.The scope of study is widened to know more about the NLW?s and to understand USA politics as well. The first two sectionof the study will provide large scale knowledges on these weapons.This study is conducted to examine the NLWs with their history , to search waether these Technologies are really good-hearted, to understand what the USA thinks, aims, does for these weapons.We can define the subgoals of theseobjectives as follows;How are these weapons defined, their types classified?a.What are their impacts on human-animals-plants, material-equipment,and infrastructure?b.What are the purposes, areas of employment?c.What are the Technologies that provide these weapons?d.What are the controversies and anxiety for them?e.What are the aims and priorities of the USA for the security and military policy and what will it be in future?f.While searching answers to these questions, the literature (books ,reports, concepts, comments, articles, treaties andprotocols) on this subject have been scanned and interpreted. Besides , interviews have been conducted withMilitary personnel who have participated in BM and NATO misions especially to make use of theirexperience, if they have witnessed any such incidents.From what we have derived .so far, we can conclude that these weapons have critical distadventages too, besidesthe advantages they have.Since 40s USA has spesifically restricted accesion to the researches on this matter by lawkeeping them as secret which makes their objectives and policies uncertain to the rest of the world. However theyare hope for the wild, bloody conflicts and wars. They were widely used in Somalia in 1995. 1. Introduction Important political, administrative and economic changes occurred in Turkey and the world in the last 50 years, especially during post-1980 neo-liberal era. Decentralization, rapid urbanization and metropolization processes that emerged by means of these changes have boosted authority, spending and responsibility of local governments. Local governments gradually came to the fore in the process of service delivery. However, especially, allocation of self-income and resources to local governments have not shown a similar level of increase. In this study, this dilemma is analyzed in cases of municipalities in Turkey. The purpose of this study is to reveal the contradiction between the increased burden of duty and income of the municipalities. By this way, it is aimed to provide a scientific basis for policy makers in solving self-income problems. In this context, the situation of the municipalities in Turkey has been analyzed. The case is studied with both theoretical and numerical data and the problem has been clearly demonstrated. 2. Trends of Fiscal Autonomy, Fiscal Decentralization and Decentralization Although a single, universal and unique definition cannot be made, decentralization is generally defined as the transfer/assignment of decision-making responsibility, power and authority of resource creation from higher level administration (central government) to lower levels of administration (regions, local governments and NGOs) (Cheema & Rondinelli, 2007: 1, Leung, 2004: 1, Edquist, 2005: 9, Yuliani, 2004, Hinsz vd., 2006: 2, Eryılmaz, 2002: 225). According to the definition of Litvack ve Seddom (1999: 2) and World Bank, decentralization is the transfer of authority and responsibility for public functions from the central government to subordinate or quasi-independent government organizations or the private sector (Keskin, 2008: 2). Fiscal decentralization forms the financial aspect of devolution to regional and local administrations. Moreover, European and American writers use terms like "centrallocal (or intergovernmental) financial relations" and "fiscal federalism" in order to refer to fiscal decentralization. The first phase of fiscal decentralization is the division of spending responsibilities and revenue sources between levels of government (national, regional, local etc.). The second phase is the amount of discretion given to regional and local governments to determine their expenditures and revenues (both in aggregate and detail). This discretion gives regional and local governments the ability to determine their budgets by levying taxes and fees and allocating resources (Davey, 2003: 1). The essence of fiscal decentralization is the authority and responsibility of subnational governments to finance their local services to a certain extent (Ebel & Yılmaz, 2002: 34). In other words, fiscal decentralization occurs when higher levels of government cede influence over budgets and financial decisions to lower levels (Sharma, 2008). Decentralization and fiscal decentralization trend that has developed in the framework of thinking that local governments should be strengthened has also created the infrastructure of financial autonomy. Fiscal Autonomy aims to enable local governments to have adequate, healthy and sustainable resources in order to ensure the institutionalization of democracy and effective implementation of their services. In that framework, it is defined as local governments' fulfillment of their duties and responsibilities independently from the center. To achieve this aim, local governments manage/spend assets and resources in line with their laws (in accordance with the interests of the local population). They also make budgets and borrowings (Ulusoy & Akdemir, 2009: 260-265, Yontar & Dağ, 2014: 150, Çelik, 2013: 22). 3. Increased Responsibility of Municipalities as a Result of Urbanization and Metropolization in Turkey The urbanization rate was very slow in the early years of the Republic of Turkey. The population living in rural areas began to migrate to urban areas in the 1950s due to improvements in transportation infrastructure, change of the land ownership regime, mechanization and modernization of agriculture, technological developments, increase in industrialization, and other economic/social changes. In particular, migration to cities increased in line with the population growth. This accelerated the need for better highway networks and settlement areas, and new housing (Tosun, 2015: 202- 203, Şahin, 2013: 79). There have been serious population increases in cities such as Istanbul, Izmir, Adana, Ankara and Bursa. This trend caused significant problems in terms of urban services in these cities (Keleş, 2009: 289). Local governments and especially municipalities took on the most important tasks of on-site analysis of the mentioned problems and solving them with practical - permanent proposals. 4. Comparative Analysis of Revenues and Expenditures of Municipalities in Turkey Municipalities became center-dependent units from financial, political and administrative aspects. It is mainly due to inefficient income structure that is dependent on central transfers, not on self-income. It is clear that this situation causes many negative effects on the functioning of municipalities. However, inadequacy of self-income or dependency needs to be demonstrated with numerical data in order to see the adverse trend in a concrete way. This enables a comparison in an international scale and identification of appropriate sample countries for the planned changes for these comparisons. Furthermore, it becomes possible to analyze financial interdependence among different municipal levels and all municipalities. Through detailed assessments, the dilemma between metropolization and fiscal decentralization in Turkey has been put forward in this study. 5. Basic Financial Problems of Municipalities in Turkey The main financial problems of the municipalities can be listed as lack of sustainable revenue sources, ineffective use of available resources, over-dependence on shares transferred from general budget tax revenues collection, inadequacy of self-income sources (Yüksel, 2004). Because of these financial problems, there are many negative situations faced at the local level. 6. Conclusion There is a trend of urbanization and metropolization in Turkey. 93% of the total population lives within the municipal boundaries. 84% of the population within municipal boundaries is within the borders of the metropolitan municipalities. Metropolitan municipalities have the highest burden of responsibilities. Then comes the provincial municipalities, district and town municipalities. However, amount of incomes is in the opposite order. This situation, prevents municipalities from enjoying the benefits of fiscal autonomy and fiscal decentralization. Instead, they become highly dependent on the central government. To get rid of this dilemma, a three-stage policy must be followed. Firstly, efficiency in spending should be achieved. Secondly, steps should be taken to make the most out of available income sources. Finally, municipalities should be provided with new sources of revenue in order to get rid of the fiscal dilemma. While these steps are being taken, rather than applying a general method, political characteristics and administrative, economic, cultural of Turkey should be taken into consideration and Turkey-specific system should be established.
Yerel demokrasi kavramı ile bağlantılı kavramlardan biri olan ve literatürde kimi zaman yerel demokrasi ile eşdeğer anlamda kullanılan "yerel özerklik" kavramı, en genel anlamıyla; bir yerel topluluğun, yerel nitelikteki işleri, kendi başına, kendi organları eliyle görebilmesi ve buna olanak verecek kaynaklara sahip olabilmesidir (Keleş, 2000: 49). Avrupa Yerel Yönetimler Özerklik Şartı'nın üçüncü maddesi, "özerk yerel yönetim" kavramını, "yasalar çerçevesinde kamu hizmetlerinin önemli bir bölümünü yurttaşlarının yararı doğrultusunda ve kendi sorumluluğunda yerine getiren, hukuki ve yönetsel yeteneklere sahip yerel tüzel kişilik" olarak tanımlamaktadır. Aynı maddenin ikinci fıkrasında ise bu hakkın, üyeleri serbest, gizli, eşit, doğrudan ve genel seçimle oluşturulan konseyler ya da meclisler tarafından kullanılacağı ifade edilmektedir (Mengi, 1998: 70).halkın karar alma süreçlerine katılımını çok büyük oranda sınırlayan katı merkeziyetçi yapılardan uzaklaşarak yerel yönetimlerin yetkilerinin artırılması ve katı, hantal, bürokratik bir anlayış yerine üretken, gerçek anlamda eşitlikçi halk katılımına dayanan bir anlayışın hâkim kılınması, küreselleşmenin ve neo-liberalizmin yıkıcı etkilerine karşı bir alternatif oluşturabilecektir. Öte yandan, yerel yönetimlerin yetkilerinin artırılması ve güçlendirilmesi özellikle Türkiye'nin en önemli sorunlarından biri olan Kürt sorununun çözümüne de önemli ölçüde katkı sunabilecek bir potansiyel taşımaktadır. Cumhuriyet tarihi boyunca yerel yönetimler, özellikle de belediyeler, yerel demokrasinin sağlanmasından ziyade, yerel hizmetlerin etkin, verimli ve daha az maliyetle sağlanmasının aracı olarak görülmüştür. Ancak bu yaklaşım yerine, Fransa'nın 1951'den itibaren yaptığı gibi, ulus-devletin katı merkeziyetçi sistemini gevşeterek yerel yönetimlere anlamlı oranda yetki devri yapmak yoluyla hem ülke içinde eşitlikçi bir bütünleşme sağlanabilecek, hem bölgeler arası sosyo-ekonomik dengesizlikler aşılabilecek, hem de farklı yerelliklerin kendi farklılıklarını korumalarına olanak tanıyacak çoğulculuk sağlanabilecektir. Bu yolla halkın yönetimde yer alma olanaklarının geliştirilmesini sağlayacak mekanizmaların kurulması, yerel yönetimlerin toplumun bütün sorunları ile ilişkilendirilmesi, sosyal, ekonomik, tarihsel ve kültürel varlığın korunması ve geliştirilmesinde yerel yönetimlerin bir özne olarak değerlendirilmesi mümkün hale getirilebilecektir. Bu anlayışa ek olarak ise, söz konusu yerelliklerin hem gelişmişlik oranlarına göre denge sağlayıcı bir biçimde merkezi bütçe tarafından desteklenmesi, hem de kendi ekonomik kalkınmalarını sağlayabilmelerine imkân tanıyan olanakların (kooperatifleşme gibi) verilmesi, yani bir nevi ortaklaşma ve ürettiğini tüketebilme, kendine yetebilme imkânı tanınması, neo-liberal sistemin halk için değil sermaye için esas aldığı "küreselleşmeci yerelleşme" anlayışının alternatifi olabilecektir. Bu esaslara dayanan bir "yerel özerklik" anlayışı ile liberal yaklaşım tarafından savunulan yerel yönetimlerin merkezi yönetimin müdahalesinden uzak olması ile sınırlandırılmış olan "yerel özerklik" anlayışı arasındaki fark ise ortadadır. ; The concept of -local autonomy-, frequently used synonymously with local democracy, is broadly defined as `the possibility of a local community to independently handle its local tasks using its own means` (Keles, 2000: 49). The third entry in the European Charter of Self-Government defines the concept of self-government as `a local legal entity that owns legislative and governing capability to perform a significant quantity of public services within legal boundaries and under its own responsibilities in line with its public's interests`. The second article of the same entry, on the other hand, states that this capability is used by councils or assemblies whose members are elected via independent, confidential and direct general elections (Mengi, 1998: 70) As one of the frequently debated issues, the demand for more autonomous local governments is restricted to being repressed and independent of the central government by liberal approaches which aim to privatize local services, to increase the power of global capital flows by distributing public services, and to provide suitable conditions for the implementation of neo-liberal policies. In addition to ignoring general public participation, such an autonomy demand of localism seeks to adapt democracy to fit the needs of sovereign powers and to create a local governing platform where everything is subcontracted, transferred to the global capital via neo-liberal policies, and then left to the conscious of capitalism which, referring to Marx; -. cuts down the tree if its shadow cannot be sold-. Particularly today, an increasing promotion of global localization is witnessed while being moved away from the central government often equals to giving in to the wheels of the global capitalism and entering into a competitive localism with its global companies. However, this should threaten neither the existence of a local government as a self-governing unit nor the local public's right to participate in decision-making processes. The firm centralist approach, more or less like the neo-liberal approach, is an obstacle against local governments to become participatory autonomous units. Throughout the human history, all communities have been organized according to their own needs. Today, it is clear that self-governments are vital for the top-down expansion of democracy and the coordination of social development. In this respect, moving away from firm centralist bodies that cause obstructions and restrict the possibility of public participation in decision-making processes seems crucial to create an alternative against the destructive effects of globalization and neo-liberalism. This can be achieved by empowering the authority of local governments and by adapting a true egalitarian participatory approach rather than a firm, clumsy, bureaucratic method. However, increasing and empowering the authorization of local governments has the potential of contributing greatly to the solution of Kurdish issue as one of the important knots in Turkey. Throughout the history of the Republic, local governments and municipalities have been considered as effective tools in providing cost-efficient and prevalent public service rather than maintaining local democracy. Nevertheless, instead of adapting this approach, transferring significant amount of authority to local governments and loosening the firm centralist system of nation-state, as France has been doing since 1951, will not only create an integration in the country and reduce the unbalanced socio-economic conditions among the regions but it will also sustain the plurality by maintaining the differences of each local community. It will then be possible to establish mechanisms to enable public participation, to relate local governments with the problems of the whole society, and to include local governments in the protection and the development of social, economic, cultural, and historical assets. In addition, supporting local governments by the central budget in line with their growth rate, providing them with the autonomous possibilities of improving economically (e.g. becoming a cooperative); that is, giving them the opportunity to cooperate, consume what they produce, and be self-sufficient, could be an alternative for neo-liberal system's -global localization- approach adapted not for public but for the capital. The difference between such a -local government- and the one advocated by liberal approach repressed from central government is self-evident.
Türkiye'de son yıllarda tartışılan hatta tartışılmaya devam eden en önemli konuların başında kuşkusuz "Türkiye-İsrail İlişkileri" gelmektedir. Türkiye'nin özellikle 1990'lı yıllardan sonra İsrail'le yakınlaşması Türkiye'nin Orta Doğu denkleminde farklı açılımlara girdiğini göstermektedir. Türkiye'nin güney komşularıyla kökleri eskiye uzanan bir güvenlik sorunu bulunmaktadır. 1970'li yıllarda PKK terör örgütünün de ortaya çıkmasıyla, bu güven sorunu iyice belirginleşmeye başlamıştır.Türkiye, bölgedeki jeopolitik konumu nedeniyle, komşuları tarafından âdeta ateş çemberine alınmış durumdadır. Kuzey'de Rusya'nın yakın tarihe kadar Türkiye üzerindeki yayılmacı emelleri, batıda Yunanistan ile yaşanan Ege ve Kıbrıs sorunları, Türkiye'yi en çok zora sokan ve uğraştıran sorunlardır. Rusya'daki rejim değişikliği ile birlikte ikili ilişkiler normal seyrine dönmüşse de, tarihî Rus yayılmacı plânlarının sona erdiği söylenemez. Yunanistan ile özellikle Ağustos 1999 depremiyle birlikte iyi ilişkiler sürecine girilmiş, ama Kıbrıs sorunu ve Avrupa Birliği gibi çözülemeyen konular nedeniyle hâlâ özlenen, arzulanan ilişkiler sağlanamamıştır.Türkiye için hayatî önem taşıyan güvenlik sorunlarından biri de kuşkusuz güney komşularıyla ilgili olanıdır. Türkiye'nin güney komşularıyla her dönemde sorunları olmuş ve bir türlü Türkiye'nin bu komşularıyla ilişkileri normalleşememiştir.Türkiye 1970'li yıllarla birlikte en büyük darbeyi terör nedeniyle güney bölgesinden almıştır ve doğal olarak savunma ve iş birliği konusunda kendini güvende hissetmek ve güney bölgesini saldırgan ve yayılmacı düşüncelerden arındırıp garantiye almak amacıyla farklı arayışlara girmiştir. Bölgede, Müslüman olmayan ve kurulduğundan bu yana komşularıyla sorunlar yaşayan İsrail de, tıpkı Türkiye gibi bölgede kendini yalnız hisseden bir ülke konumundadır. Bu nedenle Türkiye ve İsrail, hemen hemen aynı çekinceler nedeniyle yakınlaşmış ve özellikle 1990'ların başında Arap-İsrail barışının sağlandığı dönemlerde ilişkilerini geliştirmişlerdir. İki ülke arasındaki ilişkiler, 1994 yılından itibaren gözle görülür biçimde artmıştır. Bu dönemde iki ülke arasında hemen hemen her alanda yoğun trafik yaşanmış, savunma sanayii ve askerî alanlarda iş birliği yapılmıştır. İki ülke arasında gerçekleşen yoğun diplomatik ilişkiler ve temaslar bu iş birliğini iyice pekiştirmiştir.Orta Doğu'da bu iki ülkenin yakınlaşması, bölgenin Arap-Müslüman kesiminde büyük bir tedirginlik meydana getirmiştir. Türkiye'nin bölgeyle olan tarihî yakınlığı, o bölgeye uzun yıllar hükmetmesi ve daha da önemlisi Türkiye'nin Müslüman oluşu gibi nedenler, bölge ülkelerinin tepkilerini -yapılan iş birliği nedeniyle- Türkiye'nin üzerine çevirmesine neden oldu. İkili iş birliği bölge ülkeleri tarafından stratejik ittifak -yani kendi güvenlikleri için bir tehdit unsuru- olarak algılanmış ve bu durum, söz konusu ülkelerin Türkiye'yi eleştirmelerine neden olmuştur.İki ülke arasındaki ilişkilerin dışarıda olduğu gibi içeride de sürekli tartışma konusu olduğu görülür. Türk basınında ikili ilişkiler, anlaşmaların imzalandığı yıllardan itibaren tartışılmaya başlanmış ve güncel bir mesele olması nedeniyle bu konudaki tartışmalar hâlen de sürmektedir. Bu çalışmamızın amacı, Türkiye-İsrail ilişkilerinin Türk yazılı basını tarafından nasıl karşılandığı ve bu ikili ilişkiyi basının kamuoyuna hangi argümanlarla duyurduğudur. Bu bağlamda Türk basın camiasının fikrî plânda bölünmüşlüğü ve de olaylara farklı bakış açıları gibi nedenlerden dolayı sadece bir gazeteyi değil, farklı düşünceleri ve politik yaklaşımları temsil eden dört gazeteyi inceledik: Cumhuriyet, Milliyet, Sabah ve Yeni Şafak.'The relationship between Turkey and Israel' has been certainly one of the most important issues which have been discussed and even gone on to be discussed in last a few years in Turkey. Turkey and Israel have got closer especially after 1990s and it shows that Turkey has been dealing with different expansions in the Middle East equation. Turkey has got a security problem with its southern neighbours that its origin lies in the old times. With arising of the terror organisation PKK in 1970s, this security problem completely has begun to become clear.As its geopolitical position, Turkey has been taken into nearly a fire circle by its neighbours. In the north Russia's aims of spreading in Turkey until the near times and in the west the problems with Greece about the Aegean and Cyprus are the most difficult matters which make Turkey struggle. Although the dual relationships got normal with the change of regime in Russia, it can not be said that their old plans of spreading ended. There has been occurred a good relationship between Turkey and Greece after 1999 August earthquake. Nevertheless the relations that are demanded and missed have not realised yet because of the problems which can not be solved about Cyprus and the European Community.One of the most important security problems of Turkey is surely with the southern neighbours. Turkey has have problems with them all the time and the relations with these neighbours can not get better. Turkey was damaged by the southern region because of the terror in 1970s. As a result Turkey has begun to find different solutions to feel secure about defence and collaboration and also to protect the southern region by purifying it from the thoughts of spreading and attacking. In that area just like Turkey, Israel is a country which is not muslim and has have problems with its neighbours since the foundation and feels itself alone. So because of the same menaces Turkey and Israel have become closer and improved their relationships especially in the beginning of the 1990s - the time of the peace between Arabian countries and Israel. The relations between the two countries have been improved clearly since 1994. In this term the two countries got in touch about almost every subject and collaborated in the area of military and industry of defence. These intensive diplomatic relations and contacts between the two countries highly consolidated the collaboration. Getting closer of these two countries in the Middle East created a disturbance in the Muslim-Arabian part of the region. Turkey had managed this region for a long time and has got a historical nearness to that area. Moreover It is a muslim country. Because of these reasons Turkey was reacted by these countries about -the collaboration-. This dual collaboration was considered as a strategic agreement - in other words a menace reason -, hence Turkey was criticised by these countries.It is obviously seen that the relations between the two countries are also discussed inside like the outside of Turkey. These dual connections have begun to be discussed by the Turkish Press since the agreements were signed and as this is a current issue, the discussions are going on. The aim of this study is to state how the relation between Turkey and Israel was reacted by the Press and how they announced this dual connection to the public opinion. In this concept there are various points of view and a separation in the thoughts of The Turkish Press. Because of that we studied not only one but four newspapers which represent different ideas and political attitudes : Cumhuriyet, Milliyet, Sabah and Yeni Şafak.
ÖZETBu çalışma, 1980 sonrası Mısır'ında sivil toplum kavramının yeşerdiği ortamın temel dinamiklerinin neler olduğunu, bireysel özgürlüklere dayanan sivil toplum anlayışının demokratikleşmeyi nasıl etkilediğini araştırma amacıyla seçilmiştir. Bu inceleme, sivil toplum kavramının tarihsel ve terminolojik gelişiminden yola çıkarak, Ortadoğu toplumlarının sivil toplumu ve kurumlarını oluşturmadaki kriterlerini tartışmayı amaçlar. Genelde Ortadoğu, özelde ise Mısır toplumu ve kültürü tartışmanın eksenine oturtularak, bu kültürün meydana gelen gelişmeler karşısındaki temel özellikleri gözler önüne serilmeye çalışılmıştır. Sivil toplum anlayışı salt bireyin öyküsünden filizlenen bir kavramdır. Mısır olgusu mercek altına alındığı zaman ise, burada sivil toplum anlayışının fertlerin tek tek kendilerini mensup hissettikleri yapılardan kaynaklandığı görülür. Mensubiyetlerden de birey değil, grup, aşiret, cemaat, kitle ve taraftar olguları vurgulanır. Bu itibarla kendini bir yere ve/veya yerlere ait kabul etme üzerine kurulu sivil toplum kavramının ortaya çıkmasındaki güçlükler son derece açıktır. Bu ülkede sivil toplum daha çok gruplar, kitleler ve cemaatler tarafından savunulmuştur. Bu sebeple de ortaya çıkma aşamasında bazı güçlüklerle karşılaşılmıştır. Özellikle de Mısır'daki İslami cemaatler ve gruplar bunun öncülüğünü yapmıştır.Seksenli yıllarda Doğu Avrupa'da gerçekleşen değişimler, Ortadoğu'nun otoriter devletlerinde demokratik bir değişime yönelik umutları canlandırdı. Ancak liberalleşme bölgenin birkaç devletinde, o da basın sansürünün gevşetilmesi, yarım yamalak serbest seçimler yapılmasının ötesine geçemedi. Bununla birlikte sivil toplum örgütleri iyiden iyiye kıpırdanmaya başladı.Bu araştırmada, Mısır devletinin sosyo - kültürel yapısı ve geçirdiği siyasi süreçler incelendi. Sivil toplum örgütlenmesinin tezahür biçimleri analiz edilerek sivil toplumun demokratikleşme sürecindeki rolünün ne olduğu ortaya çıkarılmaya çalışıldı. Aynı zamanda bir sivil toplumun ortaya çıkışını hangi faktörlerin engellediği araştırıldı. "İslamcılık" ve "Kökten Dincilik" in sivil toplumun gelişimine etkisi anlatılmaya çalışıldı ve bu eksende İslami cemaatler yoğun olarak ele alındı.İki bölümden meydana gelen bu incelemenin birinci bölümünde, ana konuya destek niteliğindeki diğer alt konular da yer almaktadır. Burada sivil toplumun terminolojik ve tarihsel geçmişinden bahsedilmekte, sivil toplumun dünyada, Avrupa'da, Ortadoğu ve Türkiye'deki gelişimlerine kısaca değinildikten sonra araştırmanın temel konusunu teşkil eden, Mısır'da Sivil Toplum bölümüne geçilmiştir.İkinci bölümde ise Mısır toplumunun tarihsel ve sosyo - kültürel açıdan tanıtılması amacıyla, Mısır tarihine yer verilmiş ve bu bölümde kısaca bugünkü Mısır'ın tarihine değinilmiştir. Daha sonra araştırmamızın temelini teşkil eden Mısır'da sivil toplum konusuna girilmiştir. Mısır'daki sivil toplum gelişmelerini daha iyi anlayabilmek için öncelikle Arap Körfezindeki ya da Ortadoğu'daki sivil toplumu irdelemeye çalıştık. Buradaki ekonomik, politik ve sosyal organizasyonların hangi boyutlarda gerçekleştiğine değindikten sonra, Ortadoğu'da sivil toplum tartışmaları adı altında Laik Tartışma, Liberal Sivil Toplum Modeli Tartışmaları, Arap Sol Milliyetçilerinin Sivil Toplum Tartışmaları, İslamcılar ve Sivil Toplum konuları ele alınmıştır. Mısır'da Sivil Toplum, Devlet ve Ekonomi başlığıyla sivil toplum örgütlerinin devlet yönetimi ile ilişkisi, Sivil Toplum - Ordu İkilemi başlığıyla da asker sivil ilişkilerinin hangi boyutlarda olduğu, sivil gücün artırılması için neler yapılabileceği araştırılmaya çalışıldı. Üçüncü bölümün sonunda ise Mısır'da Demokrasi, Sivil Toplum ve İslam başlığı adı altında ise, Mısır'daki demokrasi anlayışı ve liberal demokratikleşme, sivil toplum ve İslam, İslami cemaatler ve bunlar içinde özellikle Müslüman Kardeşler örgütü incelenmeye, araştırılmaya çalışılmıştır.ABSTRACTTHE SOCİAL CHANGİNG AND CİVİL SOCİETY İN EGYPT AFTER 1980This study has been chosen in order to understand the basic dynamics of the environment in which the concept of civil society emerged, and to examine how the mentality of civil society, which is based on individual freedom, influenced the process of the democratization of the Egyptian people after the year of 1980. Depending on the historical and terminological evolution of the concept of civil society, this study is aimed to discuss the criterions of the Middle Eastern societies in their establishment of civil societies and their institutions. The discussion is concentrated on the societies and cultures of Middle East in general, and of Egypt in particular. This investigation is directed to evaluate how these societies and cultures reacted to new social and cultural developments that are originated in other parts of the world.The concept of civil society stems from the idea of individualism. As far as the case of Egypt is concerned, it is understood that the idea of civil society relies on the social structures that individuals feel themselves as members of these groups. The nature of membership is not based on individuals but on various tribal, religious, and political groups. Thus it is quite understandable that the emergence of the concept of civil society is fraught with many difficulties, for in its real sense the idea of civil society relies on individuals themselves rather than various oriented groups. In this country, the idea of civil society is defended by certain social and religious groups. For this reason, in its emergence and development, the concept faced with many difficulties. Especially Muslim religious groups in Egypt represented themselves as pioneer activists in favoring civil society.In the eighties, social and political changes emerged in the Eastern European countries inspired Middle Eastern society in order to make similar social and political changes in their autocratic governments in the direction of democratic developments. The strives of democratization, however, were limited to some improvements in the field of press to a certain extend, and some premature free political elections in a couple of Middle Eastern countries. Nevertheless, the civil society supporters of these communities began to play more significant roles in their countries.In this study, the socio-cultural structure and its historical developments in Egyptian state is examined. The organizations of civil society and their social consequences are analyzed, and the role of civil society in the course of democratization is investigated. At the same time, the factors that hindered the emergence of civil society are evaluated. The influence of the concepts "Islamism" and "fundamentalism" on the development of civil society is questioned and in this case Egyptian Muslim religious groups are investigated.The study consists of two main chapters. The first chapter includes subdivided complimentary arguments that support the main topic. In this part, terminological and historical background of the idea of civil society is mentioned. Then various civil society cases in the Europe, Middle East, Turkey and other countries are briefly introduced, and Egyptian civil society case, which is primary subject of this study is elaborated.In the second chapter, in order to understand the historical and socio-cultural background of the Egyptian society a general Egyptian history is summarized, and modern history of Egypt is briefly presented.Again in the second chapter, the primary topic of this study, Egyptian civil society experience is investigated. In order to present a more comprehensive analysis of civil society developments, other cases from other Arab and Middle Eastern countries are examined. Economic, political, and social organizations are explored. Next, in the Middle Eastern societies, the discussions on the concept of civil society are analyzed surrounding Secular Discussions, the discussions on Liberal Civil Society Model, civil society discussions of Arab Left Nationalists, and Islamists. Under the title of Civil Society; State and Economy in Egypt, the economic relationship between the civil society organizations and government is examined. Under the title of Civil Society Military Dilemma, the relationship between civil citizens and military is questioned and some suggestions to improve the influence of civil power are analyzed.At the end of the third chapter, under the title of Democracy, Civil Society, and Islam in Egypt, the Egyptian way of understanding democracy, liberal democratization, civil society and Islam, Muslim religious groups, and among them Muslim Brothers organization are examined.
Güney Afrika'da 1948 yılında başlayan Apartheid rejimi 27 Nisan 1994 yılında gerçekleştirilen ülkenin ilk ve çok partili demokratik seçimlerine kadar hâkim yönetim anlayışı olmuştur. Apartheid rejimi hükümetleri medyayı kendi kontrolleri altında tutmak için hem yasalardan hem de idari kontrol gücünden yararlanmıştır. Daniel François Malan ile başlayan ve 1960'larda zirveye ulaşan Apartheid rejimi basını ve tüm medyayı kontrol altına almıştır. Afrikaanca dilinde yayın yapan basın kuruluşları rejimin sözcüsü gibi hareket ederken, muhalif İngilizce basın sansüre maruz bırakılmıştır. Radyo ve televizyon sektörleri de Güney Afrika Yayın Kurumu (South African Broadcasting Corporation – SABC) tarafından kontrol edilmiş ve kurum tam anlamıyla 1980'lerin ikinci yarısından itibaren başlayacak olan liberalleşme dalgasına kadar televizyon ve radyo alanında ülkedeki tekel konumunu korumuştur. Sinemada durum bundan farklı değildir. A Şeması ve B Şeması sübvansiyonlarıyla Apartheid hükümetleri sinema sektörünü kontrol etmiş ve filmlerin otosansüre bağlı olmasını sağlamıştır. Apartheid ideolojisine aykırı filmlerin veya eleştirel filmlerin özgür bir şekilde halka gösterilmesi mümkün olmamıştır. Örneğin, eleştirel bir filmin yönetmeni olan Gibson Kente, How Long (1976) filminin içeriği yüzünden tutuklanmıştır. 1980 – 1990 döneminde üçüncü sinema ve eleştirel filmlerin yükselişe geçmesi ülkenin içinde bulunduğu siyasal ortamla direkt olarak bağlantılıdır. Apartheid rejiminin zayıflaması üzerine üçüncü kuşak sinema ve eleştirel filmler mevcut rejime karşı çok önemli bir sanat aracı olarak karşı durmuştur. Sistem ve hükümet eleştirisi yapmışlardır. Eleştirel filmler ve üçüncü sinema Apartheid rejiminin çözülme yıllarında demokrasi mücadelesini destekler nitelikte Apartheid eleştirisi yapmışlardır. Bu kuşağın en önemli özelliği rejim ve sistem eleştirisi yapmasıdır. Sinema alanına özgürlüğü getiren iki husus vardır. Birincisi, Güney Afrika'nın 1980'lerden itibaren büyük bir yıkıma sebep olabilecek bir iç savaşa doğru sürüklenmesidir. Bundan çekinen Apartheid hükümetleri sadece sinemayı değil, basın ve televizyon olmak üzere birçok medya alanını kısmen de olsa özgürleştirmiştir. Baskıları hafifletmiş ve muhalif gazetelerin yayınlarına izin verilmiştir. Bu ortamdan faydalanan yönetmen ve yapımcılar 1980 – 1990 döneminde üçüncü sinema kuşağını ve eleştirel filmleri beyaz perdeye aktarmışlardır. Sinema alanına özgürlüğü getiren ikinci ve en önemli husus siyasal dönüşümdür. Siyasal dönüşümün neticesinde demokrasiye geçilmesinin temel sebepleri uluslararası baskı, Güney Afrika'ya uygulanan ambargolar, siyahların silahlı mücadelesi ve ülkenin uluslararası toplumdan izole edilmesidir. Sinema Apartheid döneminde hükümetlerin baskısı altındayken siyasal dönüşümden sonra özgürlük ortamına kavuşmuştur. Siyasal dönüşümün en önemliayağı olan anayasa çalışmaları neticesinde 1996 Anayasası yapılmıştır. Bu anayasada medya ve ifade özgürlüğü garanti altına alınmıştır. İfade özgürlüğünün anayasal garanti altına alınması ırksal çeşitliliği ve demokrasisi sayesinde 2000'lerin başında gökkuşağı ulusu olarak nitelenen Güney Afrika'da sinemacıların özgür bir şekilde sanatını icra etmesine olanak tanımıştır. Siyahlar sinemada ayrıma ve ırksal kategorizasyona bağlı olmadan özgür bir şekilde sanatçı ve yapımcı olarak faaliyet göstermeye başlamışlar ve eleştirel yönü kuvvetli filmler çekebilmişlerdir. Makalenin amacı Güney Afrika'da sinemanın Apartheid döneminde ve sonrasındaki değişimini, bu değişimde üçüncü sinema dalgasının etkisini ortaya koymaktır. Bunu anlatabilmek aynı zamanda Apartheid rejiminin siyasal tarihine de değinmeyi gerekli kılar. Güney Afrika'da sinema siyasetten ayrı düşünülemez. Apartheid rejimi sinemayı sansür ve başka araçlarla kontrol altında tutmuştur. Apartheid hükümetlerinin baskısı yumuşadıkça sinemada özgür sesler duyulabilmiştir. Apartheid rejiminin çökmesiyle sinema aktörleri ve yapımcılarının özgürleştiğini görüyoruz. Makalede bu amaca uygun olarak yöntem seçiminde hassasiyetle davranılmış ve gelenekselci – tarihselci yöntem seçilmiştir. Sinemanın gelişimini ve değişimini sosyal ve siyasal bağlamından kopartamayız. Bu sebeple sosyal vakaları bir laboratuvar ortamında çalışmayı öneren davranışsalcı yöntemin yerine tarihsel ve sosyal bağlamında değerlendiren gelenekselci – tarihselci yaklaşım benimsenmiştir. Raymond Aron sosyal bilimlerde ve uluslararası ilişkiler çalışmalarında gelenekselciliği benimseyen bilim insanlarından biridir. Aron'a göre, sosyal vakalar yaşanan sosyal ve siyasal bağlamından kopartılamazlar. Bu sebeple makalede sinemanın gelişimi tarihsel ve sosyal olaylar bağlamında ele alınmış ve gelenekselci yöntem benimsenmiştir. ; In 1948, National Party won the elections under the leadership of Daniel François Malan. François Malan was the founder of Apartheid regime in South Africa. He wanted to divide the country into different races. In this system, black people were isolated from all segments of society and also government of the country. Afrikaans government exploited natural resources of the country and made black people slave and ordinary workers. African National Congress and blacks were organized by Nelson Mandela and his revolutionary friends to topple the regime. In 1980s and 1990s, Apartheid regime was weakened by international isolation, embargoes, economic recession, and armed attacks of African National Congress because of its racist stance. Upon this desperate situation, President of South Africa of that time Frederik Willem de Klerk started the era of political transformation by releasing Nelson Mandela and political prisoners from jail and opening the doors for negotiations. After hard negotiations between governing National Party and African National Congress, on 27 April 1994, African National Congress won the elections and Nelson Mandela was elected as the President of South Africa. In 1996, a new constitution was written. With this constitution, freedom of expression and media was taken under the guarantee of the constitution. This environment freed cinema and other types of media from Apartheid regime's fences. Since that time, South Africa has been called the rainbow nation for its various races, languages, and religions. During Apartheid regime, cinema and other types of media were controlled by Apartheid governments and Afrikaans people. Afrikaans press was the mouthpiece of the governing National Party. English press was censored by Apartheid governments and bureaucrats. Critical press and films were censored. South African Broadcasting Corporation (SABC), which was established in 1936 with an official act, has been the state monopoly of radio and television until the mid-1980s. Also, SABC was the mouthpiece of Apartheid governments. Cinema also has been censored until the mid-1980s. Apartheid governments created and used A Scheme and B Scheme Subsidies to control cinema sector. While A Scheme Subsidy was for English and Afrikaans films, B Scheme Subsidy was created for black films including black actors and languages. Films, which benefited from these subsidies, couldn't become critical of Apartheid governments. Critical films were censored and maybe banned according to their degrees. For instance, Gibson Kente, an important director of Apartheid era, was arrested because of his film called How Long (1976) and its critical context. However, political transformation, which was born because of economic recession, international isolation and armed struggle of African National Congress, changed this desperate situation. In 1980s and 1990s, third cinema and critical films developed in South African cinema. These films and third cinema criticized the system of Apartheid and governments. Also, father figure of state was criticized because of its brutal killings. These films were My Country My Hat (1983), Mathata (1984), Mapantsula (1988), the Chicken Man (1990), and Midnite Rush (1990). These cinema milestones criticized Apartheid regime and the system. Thanks to political transformation, which commenced in the late-1980s by National Party and African National Congress, South African cinema has seen an important freedom environment to produce films until today. While Apartheid regime was preventing black people from being actors and directors of films, in new rainbow nation black people can reach these positions while not being isolated by the whites of society. Ramadan Suleman, Khalo Matabane, Teddy Mattera, Zola Maseko, Ntshavheni Wa Luruli, John Kani, and Madoda Ncayiyana are important actors and directors of the new period. Moreover, in this new period black people can reach the presidency of South Africa. After Apartheid, the National Film and Video Foundation was founded to equally support film directors and actors whatever their races or religions. Today, South African cinema provides equal opportunities for blacks and whites. Blacks can take reasonable share from cinema sector today. The purpose of this article is to show changing nature of cinema during and after Apartheid, and impacts of the wave of third cinema on this changing nature. Being able to explain this also makes it necessary to touch upon political history of the Apartheid regime. Cinema in South Africa can't be separated from politics. The Apartheid regime controlled cinema through censorship and other means. As the pressure of the Apartheid governments decreased, free voices could be heard in the cinema. With the collapse of the Apartheid regime, we see the liberation of cinema actors and producers. In the article, the selection of the method in accordance with this purpose has been carefully treated and the traditionalist – historicist method has been chosen. We cannot isolate the development and change of cinema from its social and political context. Because of this reason, the traditionalist - historicist approach, which evaluates social cases in historical and social context, has been adopted instead of the behavioralist method that suggests working social cases in a laboratory environment. Raymond Aron is one of the scientists who embraced traditionalism in social sciences and international relations studies. According to Aron, social cases cannot be detached from their social and political context. For this reason, the development of cinema is discussed in the context of historical and social events in the article and traditionalist method has been adopted.
Sivil Toplum, sivil toplum kuruluşları, Sivil toplum kuruluşlarının devlet içerisindeki yeri, demokrasi, devlet, devlet kurumları, emniyet teşkilatı, Polisin Sivil Toplum kuruluşlarına bakış açısı, özgürlükler, Avrupa birliği kavramları dünyanın olduğu gibi ülkemizin gündemini de uzun süre meşgul etmiştir. Küreselleşen dünyada devletler etkisini kaybetmekte, özgürlükler alanı genişlemektedir. Toplulukların devlet gibi düşünmediği veya devletin düşünmediği konularda bir araya gelerek organize oldukları, devletin boş bıraktığı alanlarda faaliyet gösterdikleri, devletin bazı yetkilerini kullandıklarını görmekteyiz. Ülkemizde sivil toplum kuruluşlarının gelişme dönemi 1980 yılından sonra olduğu görülmekle birlikte, topluma hizmeti görev kabul etmiş bir sivil toplum kuruluşu olan vakıfların kuruluş tarihinin asırlar öncesine dayandığını söyleyebiliriz. Türkiye'de 1995 yılında çeşitli Sivil Toplum Kuruluşları arasındaki ilişkilerin serbest bırakılması önemli bir karar olmakla birlikte 2004 yılında dernekler kanununda yapılan değişiklik ve emniyet teşkilatından bağımsız yapılanma imkânı tanınması, sivil toplum kuruluşlarının gelişmesi ve faaliyetlerinin çeşitliliğinin artması bakımından önemlidir. Bu çalışmamızda sivil toplum, sivil toplum kuruluşları ve bağlantılı terimlerin açıklanmasının yanında görevi sivil toplum kuruluşlarının faaliyetlerini yasalar çerçevesinde güvenli bir şekilde yapmasını sağlamak, yasa dışı söylem ve hareketleri yargıya intikal ettirmek olan Polisin sivil toplum kuruluşlarına bakışını ele alacağız. Emniyet Müdürlüğü bünyelerinde kuruluşu bulunan Güvenlik Şube Müdürlüğü Sivil Toplum Kuruluşları ile yasalardan kaynaklanan ilişkiler kurmak zorundadır. Aynı ilişki kurma zorunluluğu sivil toplum kuruluşları içinde geçerlidir. Polis ilişkilerini kurarken sivil toplum kuruluşlarını kategorize eder ve yasaların izin verdiği ölçüde görev niteliğine bakılarak iletişim içine girer. Bu iletişim ve ilişki sınırlı ve ölçülüdür. Bu çalışmamızda sivil toplum kuruluşları ile Polis ilişkisini incelerken ilgili yasaların neler olduğunu bu yasaların güncelliği ile birlikte eksiklerini, yasalardan kaynaklanan ilişki bozukluklarını inceleyeceğiz Sivil Toplum Kuruluşları demokrasi hayatı ve kültürü için ne kadar önemli olursa olsun faaliyetlerinin belli ölçüde sınırlandırılmasının gerektiği bunun demokrasinin gerekliliği olduğu ve demokrasi hayatının gelişmesinde Polisin davranışı ve yasaların özelliğinin ne kadar önemli olduğudur. Ülkemizdeki Sivil toplum kuruluşları ile Dünya'daki sivil toplum kuruluşları arasında büyük farklılıklar vardır. Bunun çok yönlü sebepleri olsa da demokrasi kültürünün tam anlamıyla yerleşmemiş olması en büyük sebeptir. Ankara Emniyet Müdürlüğü Güvenlik Şube Müdürlüğü bu eksikliğin farkında olarak hareket etmekte, sivil toplum kuruluşlarının faaliyetlerinde davranışları ve iletişimiyle örnek olmaya çalışmaktadır. Bu davranışlar başkente özel ve kişilere bağlı olsa da Türkiye'de uygulanması gereken davranış özelliğini kazanması açısından önemlidir. Çalışmamızda polis teşkilatının tamamının görüşünü yansıtmasa da resmi ve sivil çalışan polislere uyguladığımız ankette; Türkiye'de Polisin ilişki kurduğu sivil toplum kuruluşlarına nasıl baktığı, onları nasıl değerlendirdiği, faaliyetlerdeki tutumu yasaların sivil toplum kuruluşlarına tanıdığı özgürlükler polisin bu konudaki düşünceleri incelenmeye ve bir çerçeve çizilmeye çalışılmıştır. Sivil toplum kuruluşları denince polisin aklına ilk gelen düşüncenin sokaklarda eylem yapan, kaldırım taşlarını söküp kendisine taş atan öğrenci grupları, illegal söylemleri dile getiren, polis ile çatışmaktan çekinmeyen öğrenci platformları ve sendikalar gelir. İllegal örgütlere altyapı sağlayan dernekler, vakıflar, devlet değerlerini ve sistemini tanımayan, yazılı olarak kanuna uygun parti kabul edilen ama söylemlerinde devlete karşı tavır alan veya bölücü, irticai faaliyetleri bulunan siyasi partilerin de bulunduğunu unutmamak gerekir. Her Sivil toplum kuruluşu göründüğü kadar masum değildir. Bu masumiyet halkımız tarafından zamanla anlaşılmakta ve tepkisini yeri geldiğinde ortaya koymaktadır. Kuruluş amacı doğrultusunda hareket eden yasalara saygılı, dürüst, topluma hizmet eden Sivil Toplum Kuruluşlarının polis ile olan ilişkisi sadece evrak üzerinde kalmakta veya güvenlik talebi şeklinde kalmakta ve sorun yaşanmamaktadır. Türkiye'nin küreselleşen dünyanın saygın bir üyesi olabilmesi için, STK'larının çok sayıda, değişik türde ve ölçekte, yüksek potansiyeli, dünyaya açık, işlevlerini başarıyla yerine getirebilen, kendilerine güven duyulan bir biçimde gelişmesini sağlayabilmesi gerekir.Bu çalışma sonucunda elde edilecek verilerle demokrasi kültürüne katkı sağlayacağımızı düşünerek sivil toplum kuruluşlarının polis ile ilişkilerinin ne kadar önemli olduğunu, faaliyet istatistikleri ve Emniyet verileri kullanılarak açıklanmaya çalışılmaktadır. Bu ilişkilerin geliştirilmesinin demokrasinin gelişimi, demokrasi kültürünün topluma ve kurumlara hakim olması için şart olduğu değerlendirilmeleri yapılacaktır ; Civil Societies, Civil Society Institutions, place of the Civil Society Organizations within the State, democracy, state, state institutions, Police Organization, point of view of the Police organization Civil Societies, liberties, and European concept employed our country agenda as well of the world for a long time. States are loosing their effectiveness and widening liberties field in the globalize world. We begin to recognize that Civil Societies are performing their activities within the field?s state desolated and they are not thinking like the state. Progression period of the Civil Society?s Institutions in our country is after 1980?s. However, we can mention the history of the foundations that are accepted serving to society are based to centuries ago. While the important decision has been taking during the year 1995 on the release of relations between the various civil societies Institutions, changes made on the club law at 2004 it also important regarding to structuring independently from the police, given also self developing possibility to civil society organizations and in increasing variety of activities. In this study, we will undertake point of view of the police forces which are in obligation to provide to civil societies organizations to perform their activities safely within the legal frame work, beside to explain affiliated terms, civil society?s organizations and civil society . Security Department Directorate of the Police organization is obliged to establish relation with the Civil Society Organizations sourced from the laws. Same obligation is stand still for the Civil Society Organizations. Police, while establishing relation categorizes Civil Society organizations and enters in to the communication according to the nature of the duty and the laws are allowed. This communication is limited and moderate. In this study, while examining relation between the Police organization and Civil Society Organization, we will also study up to datedness these laws together with relation failures sourced from the law.Their activities necessary to be limited within the certain measures no matter how much important the Civil Society Organizations for democratic life and culture, and this limitation is also necessity of democracy and importance of the Police behavior and the characteristics of the laws. There is a large difference between Civil Society Organizations of our country and the Civil Society Organizations of the world. Notwithstanding multi-dimensional reasons, main reason is, democracy culture is not established in a proper sense. Ankara Directorate of Police, Security Department Directorate is acting well aware of this absence and runs to set a good example with his behavior and communication during the activities of the Civil Society Organizations. However, these behaviors in the Capital city, special and linked to the persons, it is important that behaviors gains necessary characteristics to apply in Turkey. In this study, even not reflecting the entire point of view of the Police Organization, we tried to draw an outline, on the police opinion and their evaluation on the liberty has been granted to the Civil Society Organizations the laws ad they are communicating with. We must not forget that when we speak about the Civil Society organizations, first thing considered by the police, are the students groups throwing pavement stones, students platforms with illegal pronunciations, syndicates not hesitating to clash with the police, clubs providing substructure to the illegal organizations, and the political parties considered legal according to laws, but not recognizing state values and system and with an attitude and pronunciations against the state in their speeches. Each Civil Society Organizations are that innocent as we are seen fro outside. However, this innocence understands by our public within the time and they betray their response in time. Relation of the Civil Society Organizations acting toward their constitutional aims, respecting laws, honest, and giving their services to the society with the police is only on the paper works such demand of security and posing no problems. Meşrutiyet döneminin önemli isimlerinden biri olmuştur. Kökü 16. yüzyıla uzanan, Süleymaniye şehrinin kurucusu ünlü Kürt aşireti Baban ailesine mensuptur. İslamcılık düşüncesinin güçlü temsilcilerinden Babanzâde Ahmed Naim'in kardeşidir. Hukuk Mektebi'ni bitirdikten sonra Mülkiye ve Mühendis Mektepleri'nde hocalık; İkdam, Tanin, Şura-yı Ümmet gibi gazetelerde köşe yazarlığı yapmıştır. Hukukla ilgili eserlerinin yanı sıra Bismarc biyografisi ve Dreyfus Meselesini anlattığı kitapları da bulunmaktadır.Meclis-i Mebusan'da Bağdat (1908) ve Divaniye (1912) mebusu olarak yer almış, İbrahim Hakkı Paşa Kabinesi'nde Maarif Vekilliği (1911) siyasi kariyerinin en üst noktası olmuştur. 26 Aralık 1913'te, henüz 37 yaşında iken ders verdiği sırada vefat etmiştir.Meşrutiyet düşüncesini resmetmeye çalıştığım bu tezde onu tanımlayabilecek temel kavramlar; itidal, tedrici tekâmül, meşruiyet,parlamenter sisteme bağlılık, teamül , uzlaşma kültürüdür.Babanzâde, Meşrutiyet'i demokrasi ile eşanlamlı bir yönetim olarak gördüğü için yazılarını, demokrasiyi oluşturan temel unsurları (çoğunluk, çoğulculuk, yasama, yürütme, yargı, güçler ayrılığı, basın özgürlüğü, hukukun üstünlüğü vb.) esas alarak sınıflandırdım.Nitekim 1909 Ağustos'unda yayınlanan Şeyhülislamlık Beyannamesi'ni değerlendirdiği yazılarında; hâkimiyet-i milliye, iktidarın denetlenmesi, güçler ayrılığı, müsavat kavramlarını vurguladığı görülmektedir.Yaşanan olaylara sosyolojik izahlar getirmesi, akademik kimliğinin yazılarına akseden önemli bir parçasıdır. Etki-tepki kanunu, değişimin kaçınılmazlığı, parça-bütün ilişkisi, evrimci yaklaşım, bazı sorunların ancak toplumsal olgunlaşma ile çözülebileceği, yeniliklerin somut ihtiyaçlardan başlaması gerektiği bunlardan birkaçıdır. İttihad ve Terakki Partisi'nin güçlü olduğu dönemde, siyasi rakiplerinin kürsü dokunulmazlığı ve emeklilik haklarını savunması demokrasiye olan bağlılığındaki samimiyeti gösterir.Sultan Reşad'ın cülus yıldönümlerinde kaleme aldığı yazılar, Meclis'te hanedanın damatlarının -onurlarının korunabilmesi için- ödeneklerinin artırılması teklifini desteklemesi onun saltanata karşı olduğu iddiasını çürütmektedir. Ancak sistem içerisinde padişaha biçtiği rol de oldukça sınırlıdır: Milletin birliğini ve ülkenin bütünlüğünü temsil eden, siyasi yetkileri azaltılmış sembolik bir makam.Ona göre; halk Meşrutiyet yönetimiyle beraber iktidara ortak olmuştur. Ancak sınırsız bir özgürlük elde etmemiştir. Hakkını kurallar içerisinde aramalıdır. Rüşvet, tembellik, düzensizlik gibi toplumsal hastalıkların tedavisi için siyasi ve medeni terbiyenin yükselmesi gereklidir.Çoğulculuk kavramına çok erken sayılabilecek bir dönemde vurgu yapması onun demokrasi çıtasının yüksekliğini göstermektedir. Ona göre azınlıkta kalan siyasi hareketler ancak sağlam ve tutarlı fikirlerle hayatta kalabilirler.Karmaşık seçim sisteminde en iyi sonucu alabilmek için İttihad ve Terakki'nin hem seçmenlerine hem adaylarına hem de parti yöneticilerine tavsiyelerde bulunur. Bu tavsiyeler günümüzde dahi yerleşmemiş olan parti içi demokrasi anlayışı açısından oldukça önemlidir.Dini inançların seçim malzemesi yapılmasına karşı çıkar. Siyasi cinayetlere şiddetle karşıdır. Partisinin seçim başarısını açıklarken güçlü bir analizci olduğu görülmektedir.Basının halkın sesi olduğuna dair iyimserliği siyasi rekabetin labirentlerinde kaybolur. Bu alandaki düzensizliğin önlenmesi için bir Matbuat Cemiyeti kurulmasını ve bir Matbuat Nizamnamesi hazırlanmasını önemsemiştir. Yabancı basının iç politikada taraf olmasına karşı çıkar.Osmanlı Devleti'nin azınlıkları Türkleştirmeye çalıştığı ithamını bir iftira olarak görür. Ancak herkesi ortak vatan ve ortak vatandaşlık çatısı altında bir araya getirecek Osmanlıcılık politikasının da gerekli olduğunu savunur. Eşitlik talep eden azınlıkların eski ayrıcalıklarının devam etmesini istemelerini ise bir çelişki olarak görür. Kültürel amaçla kurulan Kürt Teavün ve Terakki Cemiyeti'ne (1908) üye olması ve bu Cemiyet'in gazetesinde yazı yazması, azınlıkları Türkleştirmenin yanlış olacağını savunması kendisinin Türkleşmiş Kürt olduğu iddiasını çürütür; Osmanlıcılık idealine samimiyetle bağlı Kürt kökenli bir aydın olduğunu gösterir.Arnavutluk'un Osmanlı Devleti'nden ayrılış süreci tam bir travma etkisi doğurur. Çünkü bu ayrılış "ümmet" anlayışına vurulan ilk darbedir. Arap siyasi hareketlerine, bu süreçte yaşananları bir ibret olarak hatırlatır.Devleti oluşturan unsurlardan başta yasamayı (Meclis) öne çıkarırken daha sonra yürütmeyi ilk sıraya geçirmiştir. Bir hükümet kurulurken padişah-sadrazam-Meclis arasında güvenoyu alınmasını sağlayacak bir işbirliğini gerekli görür. Bugünkü tabirle teknokrat bir koalisyon hükümeti kurulmasına, yürütmeyi zayıflatacağı için karşı çıkar.Örfi İdarenin hatalarının üstünü örtme çabası ve muhalefetin sesini daha gür duyurabileceği açık alan mitinglerine karşı çıkması onun demokrasi anlayışında tespit edebildiğimiz nadir kırılmalardır. Halaskarân Zabitan tehdidi karşısındaki dik duruşu ise takdire şayandır.Ona göre, yasama organının diğer parçası olan Ayan Meclisi'nin varlığı -aristokratik bir geçmişe dayanmadığı için- sadece bir sebeple anlamlıdır: Kanunların hazırlanması sürecinde ihtiyaç duyulan teenniyi sağlaması. Buna rağmen zaten Meclis'in feshinde onay hakkına sahip olan Ayan Meclisi'nin bir de hükümeti düşürebilecek istizah (gensoru), kendi üyelerini seçme gibi haklara sahip olursa sistemdeki tek güç olacağı uyarısını yapar. Meclis müzakerelerinin uzamaması için yaptığı teklifler tam bir uzman görüşüdür. Muhalefet milletvekillerinin iktidarın istediği kanunları engellemek için başvurduğu obstrüksiyon (engelleme) yöntemlerini demokrasi dışı uygulamalar olarak tanımlar.Ocak 1912'de Meclis'in ilk feshinin ardından aynı yıl Ahmet Muhtar Paşa Kabinesi döneminde yeniden feshedilmesi çabasına şiddetle karşı çıkar. Bu amaçla dile getirilen Meclis'in ömrüne dair fikirleri ustaca çürütür.Güçler dengesi bağlamında Meclis'in istizah hakkına karşılık hükümetin cevabın ertelenmesi hakkının hangi dengede olması gerektiğini izah eder. İstizah, güven oylaması ile sonuçlanan bir yöntem olarak kullanıldığı için iktidarın denetlenmesinde daha hafif bir yöntem olarak sual yöntemini teklif eder. Meclis'in adem-i itimad oyuna karşılık Hükümet'in Meclis'i feshetme hakkını düzenleyen 35. maddenin değiştirilmesi meselesi, güçler dengesi başlığının en önemli konusudur. Anayasa'da yapılan 1909 tadilatıyla bu denge İttihad ve Terakki tarafından Meclis lehine bozulmuştur. 1912'de dengenin yeniden kurulması için yapılan teklifin de İttihadçılardan gelmesi muhalifler tarafından şiddetle eleştirilmiştir.Babanzâde, yargı alanında reform ihtiyacını kabul etmektedir. Ancak bunun da tedrici bir şekilde olması gerektiğini savunur. Mahkemelerin tekliği esas olmasına rağmen bir süre daha memurların yargılanması için idari mahkemelerin varlığını sürdürmesi gereklidir. Gezici sulh mahkemelerinin kurulması adi suçların çözümünü hızlandıracaktır. Hâkimlerin ilmi yeterliliklerini artırmak için hukuk mekteplerinin sayısı artırılmalı, gayret eksikliğini gidermek için görevde yükselme şartlarını belirleyen objektif kriterler getirilmelidir.Ordu ve adliye mensubu memurların politikadan uzak durması şarttır. Ancak bu sayede saygınlıklarını koruyabilirler. Küçük düzeydeki memurların halkı bilgilendirmek amacıyla politikayla ilgilenmesi yanlış olmaz, aksi takdirde siyasi güç kısa zamanda yerel zorbaların eline geçer. Constitutionalizm as an effective intellectual, politician, journalist and an auther.He is a member of Baban Family which is a famous Kurdish tribe in 16. Cc. The founder of Suleymaniye city. He is the brother of Babanzâde Ahmet Naim who is the most powerful represantative of Pan-İslam. After graduation from law school,he worked at Mülkiye and Engineering Schools and wrote articles to İkdam, Tanin, Şura-yı Ümmet newspapers. In addition to his Works about law, he wrote Bismarc biography and the book which he told about Dreyfus matter.He worked as a representative of Bağdat and Divaniye in Grand National Assembly (Mebusan Meclisi). He worked as an Education Minister with İbrahim Hakkı's Goverment. This position was his top career. While he was teaching ,26 th December 1913 at 37 years old he died.When I want to describe his constitutionalism with this thesis, I can say these terms: moderate, improving step by step, legitimacy, devotion on the system of parliament, customs, culture of reconcile.As Babanzâde has seen constitutinalism and democracy the same, I classified his writings as the basic items: majority, pluralism, legislation, propulsion, judgement the diversity of powers, the freedom of press and dominiant of law.In his writings which criticized Şeyhülislam Declaration in 1909 August, it is seen that he focused on soverignity, inspecting the power goverment, the diversity of power and equality.His sociological way of describing the events is important part of his career. Effect and cause, inevitable change, the relation of part and whole, evolutionist approach, the thing that some problems can only be solved by the maturity of the society and the necessity that the innovation must started by the concrete need are some of them.When İttihad and Terakki Party was powerful, his defensing the rivals seat untouchable position of its and the rights of being retired shows his dependancy on democracy.In Sultan Reşat's ascending the throne anniversary writings his supporting increasing the subsidy of sons in law on the behalf of protecting their honour in the assembly refutes the idea of opposition against the throne. But the role of the Sultan is very limited in his system it is a symbolic stage which represents the unity of the nation and the unity of whole country.According to him the people participated in the political power with constitutinaolism. However,they couldn't get endless freedom. They have to look for their right according to the rules and law. The social disorders like bribery, laziness, untidiness can be solved by increasing the level of political and civilized understanding of society.His focusing the concept of pluralism at early period shows his improving the idea of democracy for him weak political movements can only stay alive by strong and coherent ideas.He has some suggestions both to the candidates and voters of İttihad and Terakki in order to be succesful on the complicated voting system. These suggestions are very important for the today's changeable party and democracy understanding.He is opposed to misusing of religious beliefs. He is strongly object to political murders. While he is describing his party's voting success, he is seen to be a strong analisist.The optimism of the press about being the voice of the nation disappears in the labyrinth of political competition. He gave importance to the foundation of press and to the event of preparing a press declaration in order to prevent the disorders in this field. He opposes to foreign press's side in inside policy.The minorities of Ottoman Empire sees the accusation of making them Turkish as a slander. On the other hand,he thinks that the Ottoman policy which will make all the natives and non-natives United is a most that the minorities who demands equality and also demanding their old privilages is seen as a contradiction by him. The event of being a member of the Kurdish Teavün and Terakki Association founded with the aim of culture (1908) and writing many articles in this association's newspaper and defending that it would be wrong to make Kurdish people Turkish refutes that he is a Kurdish. It shows that he is a Kurdish-rooted, intellectual person who is strongly devoted himself to Ottoman idealism.The period in which Albania seperated from Ottoman Empaire reveals a real travma. Because this parting is a real blow for the Muslim Community. He sees it as a sample for the Arabic political movements.He gives importance to legislation but then he finds carrying a law more important than legislation. He thinks a cooperation providing with winning a vote of confidence among Sultan-Grand Vizier and Assembly is necessary. He objects to today's technocrat coalition goverment, because of its dangerous effects on carrying out the law.His effors to conceal the faults of cencorship and his objections to opposition party's demonstrations are his defects of his democracy understanding. However,his standing upwright against the threat of Halaskarân is worth to appreciating.In his opinion, existing Ayan Assembly another part of legislation is only meaningful -because of not depending on the aristocratic past- while laws being pirepared the needed calmness is because provided. Neverthless he warns that if Ayan Assembly has the right to select its own members and to give interpellation in Parliment, it will be the unique power.His suggestions not to last the parliment discussions are totally expert ideas. He identifies the methods which the opposition party's members applied for preventing the power's laws are out of democracy.He is strongly against to the efforts of repealing during Ahmet Muhtar Paşa Kabinet period again after the first repealing of parliment in January 1912. He eliminates the ideas of the life-span of the Assembly.He explains the necessary balance between assembly's interpellation right and goverments delaying right to answer. As interpellation is a method used for voting for trust he proposes as a light method "questioning method" to inspect the goverment.The problem which is about the changing of the 35. Matter the right of repealing the goverment is the most important subject of the power balance. The change in 1909 constitution ,this balance was ruined against the Parliment by İttihad and Terakki. In 1912 the proposal by İttihad and Terakki to rebuild this balance was strongly criticized by the opponents.Babanzâde accepts the need for a change in judgement. But he defends that is should be step by step. Although the courts are the only way to judge, managerial courts must exist to judge the officers for a while. Founding portable peace courts will make the solution the vulgar crimes faster. The number of law schools should be more in order to develop the judge's careers and there should be some objective criteria to improve on their careers and to prevent the effort deficiency.It is a condition for army and judge staff to be away from the policy. Providing that they can protect their esteem. Low-level officers' dealing with the policy is not wrong, otherwise political-power can be subsituted with local tyrants. The officer's union rights have disappeared today.
