This article examines the institutional changes in 22 post-communist countries during the 1990-2020 period. The objective of the study was to find out why some countries achieved democracy while others failed to establish or strengthen democratic institutions, and what factors influenced the political stability of post-communist countries. During the study, available statistical information on the functioning of the main institutions was collected and processed. The analysis shows that the most significant institutional changes were observed among the non-democratic countries and those that fell into the category of hybrid political regimes. The correction of the initially chosen form of government is evidence in support of the theory of endogenous change, indicating "path-dependency". The influence of endogenous factors determines the quality of democratic change and the level of political stability in post-communist countries. Democratic changes in the countries of Central and Eastern Europe were associated with a commitment to rapid reform in the early stages, and Euro-Atlantic integration only supported the democratic quality of the institutions. The institutional framework of the countries, that embarked on the path of European integration, was relatively stable during the period under the study, and did not deal with changes in the system of power distribution. While the countries of the former Soviet Union most often resorted to changes in the primary law of the country, and these changes were related to the redistribution of powers between the branches of power and the extension of the time in the office of the President. In addition to the overall level of democratization of the country, the level of emancipatory values and the weight of presidential power have the greatest impact on political stability. ; Ten artykuł analizuje zmiany instytucjonalne w 22 państwach postkomunistycznych w latach 1990-2020. Celem badania było znalezienie odpowiedzi na pytanie, dlaczego niektóre kraje osiągnęły demokrację, podczas gdy inne nie zdołały stworzyć lub wzmocnić instytucji demokratycznych oraz jakie czynniki wpłynęły na stabilność polityczną państw postkomunistycznych. W trakcie badania zebrano i opracowano dostępne informacje statystyczne na temat funkcjonowania głównych instytucji. Analiza pokazuje, że najbardziej znaczące zmiany instytucjonalne zaobserwowano w państwach niedemokratycznych oraz tych, które zaliczały się do kategorii hybrydowych reżimów politycznych. Korekta początkowo wybranej formy ustroju jest dowodem na rzecz teorii zmian endogenicznych, wskazującym na "zależność od ścieżki" (path-dependency). Wpływ czynników endogenicznych determinuje jakość przemian demokratycznych i poziom stabilności politycznej w państwach postkomunistycznych. Przemiany demokratyczne w państwach Europy Środkowo-Wschodniej wiązały się z zaangażowaniem w szybkie reformy na wczesnym etapie, a integracja euroatlantycka jedynie wspierała demokratyczną jakość instytucji. Struktura instytucjonalna państw, które wkroczyły na drogę integracji europejskiej, była w analizowanym okresie względnie stabilna i nie dotyczyła zmian w systemie podziału władzy. Z kolei państwa byłego Związku Radzieckiego najczęściej uciekały się do zmian w ustawie zasadniczej państwa, a zmiany te dotyczyły redystrybucji kompetencji między gałęziami władzy oraz wydłużenia kadencji prezydenta. Obok ogólnego poziomu demokratyzacji państw, największy wpływ na stabilność polityczną ma poziom wartości emancypacyjnych oraz waga władzy prezydenckiej. ; В статье рассматриваются институциональные изменения в 22 посткоммунистических странах в течение 1990-2020 годов. Целью исследования было выяснить, почему одни страны достигли демократии, а другие не смогли создать или укрепить демократические институты и какие факторы влияли на политическую стабильность посткоммунистических стран. Во время исследования была собрана и обработана доступная статистическая информация о функционировании основных институтов. Анализ показывает, что наиболее существенные институциональные изменения наблюдались среди недемократических стран и тех, которые попали в категорию гибридных политических режимов. Коррекция исходно выбранной формы правления свидетельствует в пользу теории эндогенных изменений, указывающих на «зависимость от выбранного пути» (path-dependency). Влияние эндогенных факторов определяет качество демократических изменений и уровень политической стабильности в посткоммунистических странах. Демократические изменения в странах Центрально-Восточной Европы были связаны с приверженностью к быстрому проведению реформ на ранних этапах, а евроатлантическая интеграция лишь поддерживала демократическое качество институтов. Институциональная основа стран, которые стали на путь европейской интеграции, была относительно стабильной в течение исследуемого периода и не касалась изменений системы распределения власти. В то же время страны бывшего Советского Союза чаще всего прибегали к изменениям основного закона страны и эти изменения касались перераспределения полномочий между ветвями власти и продления срока пребывания президента у власти. Кроме общего уровня демократизации страны, наибольшее влияние на политическую стабильность имеет уровень эмансипативных ценностей и вес президентской власти.
Jerzy Giedroyc published monthly magazine "Kultura" from 1947 to 2000 by the Literary Institute in Maisons Laffitte near Paris. Gradually, "Kultura" become a particular political center based on journalistic writing of authors such as: Juliusz Mieroszewski, Bohdan Osadczuk, Leopold Unger. Juliusz Mieroszewski was the creator of the so-called "eastern concept", postulating good neighbourly relations of sovereign Poland with independent states of Ukraine, Lithuania and Belarus, which will emerge as a result of the collapse of the USSR. The concept was born in the 1950s, and the term ULB was used for the first time in 1973. The influence through journalism consisted in convincing the public opinion to rationalize historical disputes and recognize the aspirations for independence of nations that in the past formed the Republic of Poland. After the geopolitical and political changes in Europe at the end of the XX century, it was recognized that "the eastern concept" of "Kultura" has a current dimension and can form the basis for political actions. Poland, as the leader of these changes, took over the function of Ukraine's advocate in the European Union. The coincidence of internal circumstances (political fight in Ukraine) and external (changes in the EU, change of priorities) have caused that Ukraine did not become a member of the EU, despite the verified social potential. "The eastern concept" of "Kultura" gave strong grounds for Ukraine independence recognition and support during the Orange Revolution. Giedroyc' stwin-track activities in the field of shaping political views and changing stereotypes led to very good scientific, cultural and social cooperation. The border regions cooperation is developing. Mieroszewski był twórcą tzw. koncepcji wschodniej, zakładającej dobrosąsiedzkie stosunki suwerennej Polski z niepodległymi państwami: Ukrainą, Litwą, Białorusią, które wyłonią się wskutek rozpadu ZSRR. Koncepcja ta zrodziła się już w latach 50. XX wieku, a termin ULB został użyty po raz pierwszy w 1973 roku. Oddziaływanie przez publicystykę polegało na przekonaniu opinii publicznej do racjonalizacji sporów historycznych i uznania aspiracji niepodległościowych narodów tworzących w przeszłości Rzeczpospolitą. Po przemianach geopolitycznych i ustrojowych w Europie u schyłku XX wieku uznano, że koncepcja wschodnia "Kultury" ma wymiar aktualny i może stanowić podstawę działań politycznych. Polska jako lider tych zmian przejmowała funkcję orędownika Ukrainy w Unii Europejskiej. Splot okoliczności wewnętrznych (walka polityczna w Ukrainie) i zewnętrznych (przemiany w UE, zmiana priorytetów) spowodował, że Ukraina nie została członkiem UE, mimo zweryfikowanego potencjału społecznego. Koncepcja wschodnia "Kultury" stanowiła jednak mocną przesłankę za uznaniem niepodległości Ukrainy i wsparciem podczas pomarańczowej rewolucji. Dwutorowe działania Giedroycia w sferze kształtowania poglądów politycznych i zmiany stereotypów spowodowały, że bardzo dobrze funkcjonuje współpraca naukowa, kulturalna i społeczna. Rozwija się współpraca w regionach pogranicznych. Znaczenie tej wojny było i jest bardzo często spychane na margines historii Europy, podczas gdy były to zmagania decydujące dla przyszłości kontynentu europejskiego, a przede wszystkim ładu wersalskiego. Nie sposób sobie nie wyobrazić jego załamania i sowietyzacji przynajmniej wschodniej i środkowej części Europy, gdyby wojna ta zakończyła się klęską armii polskiej. Książka Nowaka nie jest jednak analityczną monografią wojny polsko-sowieckiej, lecz studium nad ustosunkowaniem zwycięskich mocarstw Zachodu wobec tego konfliktu. Wśród tych mocarstw decydujące znaczenie odrywała Wielka Brytania. Autor doszedł do przekonania, iż w polityce tej wolno widzieć prefigurację późniejszego appeasementu z lat trzydziestych XX w. Rząd Zjednoczonego Królestwa czynił w 1920 r. wszystko, aby doprowadzić do ugody polsko-sowieckiej, która w istocie rzeczy byłaby równoznaczna z hegemonią sowiecką nad odbudowaną Polską. The monograph provides a new analysis of the international aspects of the Polish-Soviet War (1919–1920). The conflict has often been marginalised in the history of Europe, while being decisive for the future shape of the European continent, and first and foremost for the Versailles governance. A collapse of the Versailles governance and sovietisation of at least Eastern and Central Europe are difficult to imagine but would have become a reality if the Polish-Soviet War had ended with a defeat for the Polish army. Nowak proposes a study of attitude of the winning Western superpowers to that conflict rather than an analytical monograph. Among the superpowers, Great Britain had the decisive voice. The author perceives the British policy as a prefiguration of appeasement applied in the 1930s. In 1920, the government of the United Kingdom used every effort to facilitate a Polish-Soviet settlement, what in fact would have turned into Soviet hegemony over reborn Poland. The victory of the Polish army in the Battle of Warsaw thwarted the plan. In spite of the word "treachery" in the title and as mentioned by the author in the introduction, the monograph is not a "treatise on morality". No attempt is made to judge the architects of foreign policies pursued by the world's superpowers, which have no obligation to serve the interest of Poland. The author merely undertakes an analysis of a phenomenon in international relations, which does not only belong to history, but continues to resonate throughout the world today. The book may be unfairly considered too Polocentric, yet the author shows awareness of the reality in which the British foreign policy was shaped, and always applies the audiatur et altera pars principle. The work is based on unknown or little examined British archive records. The author introduces the concept of appeasement towards the Soviet Russia in 1920. The book provides a thorough analysis of the attitude of Western elites to reborn Poland, and in this sense constitutes a review of the 20th century political imagination. It casts a new light on Poland's victory in the Battle of Warsaw. Owing to this victory, the Versailles governance was saved and strengthened by the Treaty of Riga (1921) – a fact which remains unnoticed in the historiography of Western nations.

Rozwój koncepcji amerykańskiego systemu obrony przeciwrakietowej jest procesem sięgającym w swej historii epoki zimnej wojny. Szybki rozwój techniki wojskowej i skomplikowana sytuacja polityczna na arenie międzynarodowej sprawiły, iż groźba ta była jak najbardziej realna. Odpowiedzią na narastające zagrożenie stały się kolejno tworzone programy Nike-Zeus, Nike X, Sentinel oraz Safeguard. Przełomem w tworzeniu coraz to nowocześniejszych systemów obrony stał się podpisany 26 maja 1972 roku w Moskwie roku "Układ między Związkiem Socjalistycznych Republik Radzieckich a Stanami Zjednoczonymi Ameryki o ograniczeniu systemów obrony przeciwrakietowej". Powrót do idei stworzenia systemu obrony przeciwrakietowej nastąpił za prezydentury Ronalda Reagana i trwa do dzisiaj. Zmianie uległy jednakże zadania stojące przed takim programem. Po zakończeniu zimnej wojny i upadku ZSRR zagrożenia nie stanowiło już jedno wrogie państwo komunistyczne, lecz tzw. "państwa zbójeckie. Rozmowy na temat rozmieszczenia "tarczy antyrakietowej" w Polsce i Czechach wywołały protest w Rosji, która obawia się zbliżenia infrastruktury amerykańskiej do swoich granic, co znacznie skomplikowało proces negocjacyjny. Dodatkową trudność spowodowała decyzja Kongresu, który przyznanie pieniędzy na projekt uzależnił od podpisania z krajami europejskimi odpowiednich umów międzynarodowych, a także zmiana partii rządzącej w Polsce. Przyszłość amerykańskiego systemu obrony przeciwrakietowej zależeć będzie przede wszystkim od wyniku wyborów prezydenckich, które odbędą się w USA w listopadzie tego roku. Podejście kandydatów ubiegających się o ten urząd jest różne i od tego, kto zwycięży, zależeć będą dalsze losy koncepcji obrony strategicznej. ; Развитие концепции американской системы противоракетной обороны – это процесс, корни которого исходят к эпохе холодной войны. Быстрое развитие военной техники и сложная политическая ситуация на международной арене делали реальными многие угрозы. Ответом на возрастающие угрозы было соз- дание программ Nike-Zeus, Nike X, Sentinel и Safeguard. Переломом в гонке за всё более современными системами обороны стал подписанный 26 мая 1972 года в Москве «Договор между Союзом Советских Социалистических Республик и Соединёнными Штатами Америки об ограничении систем противоракетной обороны». Возвращение к идее создания системы противоракетной обороны наступило во времена президентуры Рональда Рейгана и продолжается по сей день. Изменились однако задачи стоящие перед такой программой. После окон- чания холодной войны и развала СССР опасность уже не представляет одно вражеское коммунистическое государство, а так называемые «государства оси зла». Переговоры на тему размещения «противоракетного щита» в Польше и Чехии вызвали протест России, которая опасается приближения американ- ской инфраструктуры к своим границам, что значительно осложнило перего- ворный процесс. Дополнительные осложнения вызвало решение Конгресса, который признание финансирования проекта сделал зависимым от подписания с европейскими странами соответствующих международных договоров, а также смена правящей партии в Польше. Будущее американской системы противора- кетной обороны, прежде всего, будет зависеть от результатов президентских выборов в США, которые состоятся в ноябре этого года. Подход к проблеме кандидатов на этот пост остается разным и от того, кто победит, будет зависеть дальнейшая судьба концепции стратегической обороны. ; The development of the concept of American National Missile Defence (NMD) system is a process rooted in the time of the Cold War. The fast development of military technology and the complex political situation on international stage made the threat of attack real. The response to the permanently escalating threat have been a succession of programmes: Nike-Zeus, Nike X, Sentinel, and Safeguard. The breakthrough in the development of increasingly modern defence systems was the Treaty Between the United States of America and the Union of Soviet Socialist Republics on the Limitation of Anti-Ballistic Missile Systems signed on 26th May 1972 in Moscow. The return to the idea of developing a missile defence system took place under Ronald Reagan. Even though the programme has continued to this day, its objectives have changed. With the conclusion of the Cold War and the fall of the USSR, the threat was no longer a single enemy communist state but the so-called 'rogue states'. The talks on the deployment of the elements of the NMD system (the so-called 'US missile shield') in Poland and Czech Republic resulted in a protest from Russia fearing the approach of American infrastructure to own borders, which greatly complicated the negotiations process. Additional obstacles arose when first US Congress made signing appropriate international agreements with the European states the condition for awarding the money to the project, and later the governing party in Poland changed. The future of the American system of missile defence system will primarily depend on the results of the Presidential Elections that will be held in the US this November. The positions of US presidential candidates on the NMD system varies, and it is on the winner of the presidential race that the future of strategic defence hinges.
Central Europe is part of the continent with its historical and cultural identity and a unique geopolitical role (geopolitical wedge between Germany and Russia). Central Europe includes the Ukrainian and Belarusian lands, which for centuries have been the subject of rivalry between Poland and Russia and the area of influence of powers neighboring this region. Depending on the results of this rivalry, the status of Ukrainian-Belarusian territories varied between the "great borderland" and the periphery of various powers, most often the Republic of Poland or the Russian Empire. However, their role was different for both countries. For the Commonwealth, they constituted a necessary resource for maintaining its subjectivity, sovereignty and, consequently, independence. However, for Russia they were a route to master Central Europe and to influence Western Europe. In the history of the Ukrainian-Belarusian lands, three alternative variants of concentration and political rivalry were possible. The first – the formation in this subregion of Central Europe of the countries with high political subjectivity, based on significant demographic, geopolitical and economic resources. The second – the occupation of the Ukrainian-Belarusian border entirely by one of the neighboring powers as a result of military actions or EU agreements, which made them a "great borderland", strengthening the potential of the country of its belonging. The third – the division of Ukrainian-Belarusian lands between state organisms with high subjectivity (the loss of the status of "great borderland" in favor of being peripheries), actually preventing internal political consolidation, but deepening the diversity of the subregion in terms of religion, religion, ethnicity, culture and language, mental, and consequently also socio-economic. In the historical process, all three scenarios were implemented, which contributed to giving the Ukrainian-Belarusian lands as a constitutive feature of the "Central European syndrome", however questioned in the international environment, primarily by Russia recognizing this area as part of its own civilization and cultural circle. ; Europa Środkowa jest częścią kontynentu z własną tożsamością historyczną i kulturową oraz unikatową rolą geopolityczną (geopolitycznego klina między Niemcami i Rosją). Do Europy Środkowej należy zaliczyć ziemie ukraińskie i białoruskie, które przez wieki były przedmiotem rywalizacji między Polską i Rosją oraz obszarem wpływów mocarstw niesąsiadujących z tym regionem. W zależności od wyników tej rywalizacji status ziem ukraińsko-białoruskich wahał się między "wielkim pograniczem" a peryferiami różnych mocarstw, najczęściej Rzeczypospolitej lub Imperium Rosyjskiego. Jednak dla obu tych państw ich rola była odmienna. Dla Rzeczypospolitej stanowiły one konieczny zasób dla utrzymania jej podmiotowości, suwerenności, a w konsekwencji – niepodległości. Natomiast dla Rosji były szlakiem do opanowania Europy Środkowej oraz oddziaływania na Europę Zachodnią.W dziejach ziem ukraińsko-białoruskich były możliwe trzy alternatywne warianty koncentracji i rywalizacji politycznej. Pierwszy – ukształtowanie w tym subregionie Europy Środkowej państw o wysokiej podmiotowości politycznej, opartej na znacznych zasobach demograficznych, geopolitycznych i gospodarczych. Drugi – zajęcie ukraińsko-białoruskiego pogranicza w całości przez jedno z sąsiednich mocarstw w wyniku działań militarnych lub układów unijnych, co czyniło z nich "wielkie pogranicze", wzmacniające potencjał państwa swojej przynależności. Trzeci – podział ziem ukraińsko-białoruskich między organizmy państwowe o wysokiej podmiotowości (utrata statusu "wielkiego pogranicza" na rzecz bycia peryferiami), faktycznie uniemożliwiający wewnętrzną konsolidację polityczną, lecz pogłębiający zróżnicowanie subregionu pod względem religijno-wyznaniowym, etnicznym, kulturowo-językowym, mentalnym, a w konsekwencji również społeczno-gospodarczym. W procesie historycznym były realizowane wszystkie trzy scenariusze, co przyczyniło się do nadania ziemiom ukraińsko-białoruskim jako cechy konstytutywnej "syndromu środkowoeuropejskiego", jednak kwestionowanego w środowisku międzynarodowym, przede wszystkim przez Rosję uznającą ten obszar za część własnego kręgu cywilizacyjno-kulturowego. ; Центральная Европа является частью континента с его исторической и культурной самобытностью и уникальной геополитической ролью (геополитический клин между Германией и Россией). Центральная Европа включает в себя украинские и белорусские земли, которые на протяжении веков были предметом соперничества между Польшей и Россией и зоной влияния держав, граничащих с этим регионом. В зависимости от результатов этого соперничества, статус украинско-белорусских территорий варьировался между «великой границей» и периферией различных держав, чаще всего Речи Посполитой или Российской империи. Однако их роль была разной для обеих стран. Для Речи Посполитой они являлись необходимым ресурсом для поддержания ее субъективности, суверенитета и, следовательно, независимости. Однако для России это был путь к овладению Центральной Европой и влиянию на Западную Европу.В истории украинско-белорусских земель были возможны три альтернативных варианта концентрации и политического соперничества. Первый – формирование в этом субрегионе Центральной Европы стран с высокой политической субъектностью, основанных на значительных демографических, геополитических и экономических ресурсах. Второй – оккупация украинско-белорусской границы целиком одной из соседних держав в результате военных действий или союзных соглашений, которые сделали их «великой границей», усиливая потенциал страны своей принадлежности. Третий – разделение украинско-белорусских земель между государственными организмами с высокой субъектностью (утрата статуса «великих пограничных территорий» в пользу периферии), фактически предотвращающее внутриполитическую консолидацию, но углубляющее разнообразие субрегиона с точки зрения религии, этнической принадлежности, культуры и языка, менталитета, а следовательно, и социально-экономической дифференциации. В историческом процессе были реализованы все три сценария, которые способствовали тому, что украинско-белорусские земли стали характерной чертой «центральноевропейского синдрома», хотя и подвергались сомнению в международной среде, в первую очередь в связи с тем, что Россия признала этот район частью своего цивилизационно-культурного круга.
Zmiana instytucjonalna jest nieodłącznym procesem wpisującym się w rozwój społeczeństwa i gospodarki. Najistotniejszym procesem w ramach transformacji instytucji wydaje się dopasowywanie (się) instytucji formalnych i nieformalnych. Jest to niezbędne, aby system instytucjonalny działał sprawnie, aby generował odpowiednie bodźce na rzecz aktywności gospodarczej (niski koszt transakcyjny, przewidywalność, zaufanie). Efektem takich dostosowań jest ład instytucjonalny, który jest warunkiem trwałości rozwoju gospodarczego. Cechą instytucji jest długookresowe trwanie, choć jednocześnie odbywa się ich nieprzerwana ewolucja. Powstaje pytanie, w jaki sposób kształtuje się ład instytucjonalny, jaką rolę odgrywają w nim instytucje nieformalne. Za cel artykułu przyjęto określenie roli instytucji nieformalnych w kreowaniu ładu instytucjonalnego. Można wysunąć przypuszczenie, że instytucje nieformalne wraz z upływem czasu stają się trwałą podstawą ładu instytucjonalnego. W artykule wskazano również przejawy niesprawności systemu instytucji w Polsce, w tym instytucji nieformalnych. ; Institutional change is an integral process in the development of the society and economy. The seemingly most significant process in the transformation of institutions is the adjustment (also, mutual adjustment) of formal and informal institutions. This is critical to the proper functioning of the institutional system, so that it generates sufficient stimuli for economic activity (low transaction costs, predictability, trust). The result of such adjustments is institutional order which is a prerequisite of sustainable economic growth. One of the features of imitations is their longevity, even though they are constantly evolving. The question arises about how institutional order is formed and what the role of informal institution in this process is. The aim of the article is to determine the role of informal institutions in the formation of institutional order. It is possible that, given time, informal institutions become a solid foundation of institutional order. Po zakończeniu zimnej wojny wydawało się, że świat na trwałe wchodzi w okres stabilizacji, pokoju i współpracy. Szybko jednak okazało się, że świat narastającej globalizacji ma różne oblicza, także negatywne, co rzutuje na każdą sferę życia, także na bezpieczeństwo. Spadło co prawda zagrożenie wojną nuklearną, ale pojawiły się nowe zagrożenia oraz nasiliły te, które przedtem były przesłonięte rywalizacją Wschód - Zachód. Chodzi głównie o konflikty etniczno-religijne, kulturowe i cywilizacyjne, w tym rozlewające się konflikty wewnętrzne w państwach słabych i upadłych, proliferacja broni masowego rażenia, niebezpieczne ambicje państw dyktatorskich i autorytarnych. Ogromny wpływ na bezpieczeństwo międzynarodowe miały zamachy 11 września 2001. Zmieniły one percepcję zagrożeń dla bezpieczeństwa, a ogłoszona przez prezydenta Busha wojna z terroryzmem doprowadziła USA i prawie cały Zachód do zaangażowania w dwie wojny: w Iraku i Afganistanie. Sytuacja w Afganistanie i odpowiedzialność NATO za bezpieczeństwo tego kraju nadal budzi ogromne zaniepokojenie przywódców państw zachodnich, rzutuje na stan bezpieczeństwa międzynarodowego. Dotyczy to szczególnie regionu Bliskiego i Środkowego Wschodu, gdzie coraz większą rolę odgrywa rywalizacja między Indiami, Pakistanem i Iranem. Rosnący niepokój budzą ambicje nuklearne Iranu, a także otwarte wyzwania, jakie kraj ten rzuca społeczności międzynarodowej, podobnie jak w innej części świata polityka Korei Północnej. Coraz większe ambicje w polityce międzynarodowej mają Chiny i dążąca do odzyskania mocarstwowej pozycji Rosja. Jednocześnie wbrew programom i zapowiedziom proces osiągania przez Unię Europejską pozycji gracza globalnego nie materializuje się. Postępuje proces odwrotny: komplikuje się sytuacja finansowa w strefie euro, a kryzys ten oddziałuje na całą Unię. Postrzegana jako oaza gospodarczej stabilizacji UE stała się w ostatnich latach źródłem dodatkowych perturbacji w gospodarce światowej. Zachodzące w niej procesy, takie jak gwałtowne wzrosty cen surowców, rozchwianie rynków finansowych, pogłębiające się dysproporcje między bogatymi i biednymi, rosnące obszary głodu, daleko idąca deregulacja i kryzysogenne praktyki inżynierii finansowej, problem światowego zadłużenia, stają się czynnikiem globalnej destabilizacji i zagrożeń także dla bezpieczeństwa. ; Twenty years after the end of the Cold War the world still undergoes the process of deep changes. The collapse of communism and disintegration of the Soviet Union put an end to a bipolar system and the new era begun in international politics. Many state controlled economies, especially in Central and Eastern Europe, became democratic and market oriented countries. Through over one decade the United States was recognized as a unique superpower. Rapidly spreading globalization has made countries strictly interdependent, especially in economy, but also mutual dependence in the field of security has substantially increased. It happened so because of new threats for security, like international terrorism, WMD proliferation, growing number of ethnic-cultural conflicts. There is no threat in the world of global nuclear war or big state to state aggression on a large scale, but new threats, especially terrorism and cyber-attacks , are becoming very probable. In the contemporary world, with all economic freedom, especially international production factors movement, there are good as well as weak points which make international economy and the economy of different countries very vulnerable to crises, as we could see in 2008-2009 period. It is so because of uncontrolled activity of so called non-state actors, as for instance international financial corporations. Also European integration, especially in the Euro-zone, because of the world financial crisis impact, rising public debt and imperfect euro-mechanisms, is in trouble. Under such conditions, economic security is becoming so crucial that together with many other aspects of security [terrorism, cyber-attacks, impact of climate changes] it forms a new picture of the world security - a new paradigm. The article addresses the major international and regional security problems, the position of the USA in more and more multi-polar system, rising ambitions and roles of China and Russia. The approach of the author to the presented problems is interdisciplinary. ; После окончания холодной войны казалось, что мир на долго входит в период стабилизации и сотрудничества. Однако вскоре оказалось, что мир растущей глобализации имеет разные стороны, в том числе также отрицательные, что отражается в каждой сфере жизни, в том числе и на безопасности. Хотя и уменьшилась угроза ядерной войны, однако появились новые угрозы и усилились те, которые раньше, в связи с противостоянием Восток - Запад, находились на втором плане. Прежде всего здесь идёт речь о этническо-религиозных, культурных и цивилизационных конфликтах, в том числе и разрастающихся внутренних конфликтах в слаборазвитых государствах, распространении оружия массового уничтожения, опасных амбициях диктаторских и авторитарных государств. Огромное влияние на международную безопасность оказали события 11 сентября 2001 г. Эти террористические акты изменили восприятие угроз безопасности, а провозглашенная президентом Бушем война с терроризмом вынудила США и почти весь Запад к ведению двух войн: в Ираке и Афганистане. Ситуация в Афганистане и ответственность НАТО за безопасность этой страны, по-прежнему вызывает огромное беспокойство лидеров западных государств, отражается на состоянии международной безопасности. Прежде всего это касается района Ближнего и Среднего Востока, в котором большую роль играет также соперничество между Индией, Пакистаном и Ираном. Растущее беспокойство вызывают ядерные планы Ирана, а также открытый вызов, который эта страна бросает международному сообществу. Такую же политику в другой части света проводит Северная Корея. Большие амбиции в международной политике имеет также Китай и стремящаяся восстановить позиции сверхдержавы Россия. На ряду с этим, вопреки принятым программам и заявлениям политиков, процесс становления Европейского Союза в роли мирового игрока остается только проектом. Более того, в связи с усложняющейся экономической ситуацией в еврозоне, в Евросоюзе сегодня имеют место противоположные процессы. ЕС, который рассматривался как экономической оазис хозяйственной стабилизации, в последние годы стал источником дополнительных проблем в мировой экономике. Происходящие в мировой экономике процессы, напр. быстрый рост цен на сырье, нестабильность финансовых рынков, углубляющиеся диспропорции между богатыми и бедными, проблемы голода, далеко идущая дерегуляция и кризисные практики финансовой инженерии, проблема мировой задолженности, становятся фактором мировой дестабилизации и несут угрозы безопасности.
The book contains a thorough analysis of the European Union institutional system as a specific, sui generis international organisation, in the context of its legitimization (its validity and legitimacy). The book is mainly theoretical. Primarily, the author aims at presenting a reliable depiction of the EU institutional system legitimization through the prism of the theoretical output concerning legitimization of the political power, including and accentuating the indicated specificity of the EU as a distinct international organisation. Secondly, he took into consideration the changes introduced into the legal foundations of the EU functioning, pursuant to the Lisbon Treaty – the latest treaty reforming the structures of the Union. In the context of the main theme of the present study, these changes are important not only in terms of the EU institutions themselves, i.e. their competences and reciprocal relations, but also with regard to the fundamental change of the legal character of the EU, and the alterations introduced into the individual Union politics. Thirdly, the author attempts to present the problem of the EU institutional system legitimization in the special circumstances, i.e. in the situation of the most profound economic crisis that the EU members have faced since the beginning of the integration process. The EU is regarded as a specific structure, being neither a state nor a typical international organisation. Such an approach was the starting point for the main premise of the present book – the idea that the thesis about the deficiency of democracy in the EU, formulated in the literature on the subject and in the public debate, is a certain simplification, and the characteristic features of the EU and its institutions, which provoked the formulation of such a thesis, should be considered in a broader context, such as the problem of the EU institutional system legitimization and, alternatively, the deficiency of that legitimization. For the direct democratic legitimization is only one of many sources of legitimacy of the EU institutional system and of the Union as a specific international organisation in general – an extremely important source, perhaps the most important, yet not the only one. Thus, the legitimization of the EU and its institutions should be analysed in a broader perspective, which also includes other sources of legitimization – as it is done in case of every political power which, striving for its legitimization to be as strong as possible, attempts to derive it from the largest number of sources. According to the author of the book, to base the EU institutional system legitimization only on the grounds of the direct democratic legitimization characteristic of a democratic state, would be tantamount to a certain disruption of the right order. It would rather be a symptom of too advanced an integration on the "institutional" level in comparison to the extent of the "material" integration. Until the EU is a structure sui generis, in which case it is a combination of features characteristic of an intergovernmental, international organisation, a supranational organisation or a state, the nature of legitimization of this structure should also be specific. The most important role should be played by the democratic legitimization, which should be completed with other sources, owing to which the functioning of the EU institutional system, and the whole EU, could be recognised as legally valid. Apart from the main thesis also other theses and hypotheses are posed in the book. The first chapter is a certain theoretical introduction and a basis to the deliberations presented in the further parts of this study. In the first subsection, with reference to the literature on the subject, the problem of legitimization (legitimacy) of the political power, i.e. the concept, classifications and sources of legitimization (legitimacy) of the political power, have been synthetically depicted. In another part of chapter one, the author attempts to relate the problem of legitimization to the EU as a specific international organisation and to formulate his own definition of legitimization deficiency with regard to EU institutional system. Bearing in mind that the problem of legitimization deficiency in the EU (EC) has not been discussed on a larger scale until certain stage of development of integration process was reached, in 1.3. subsection, the author raises some questions concerning: the sufficiency of legitimization of the integration process during the first few decades after the Second World War, the grounds for that legitimization and the reasons why, at a certain stage of the EU (EC) development the legitimization of the Union's institutional system started to be considered insufficient, which was manifested in the opinions acknowledging the democracy and legitimization deficiency. The first chapter ends with a passage devoted to the importance of the EU institutional system legitimization, whereas the significance of legitimization to the political power and political institutions in general, consitutes its reference point. The second chapter (subsections 2.3.–2.8.) presents a synthesis of the evolution of the EU (EC) institutional system in the context of its legitimization, from the moment of the EC founding treaties ratification, till the time the changes pursuant to the Lisbon Treaty were introduced. The author focused here mainly on the competences of the particular EC (EU) institutions and their reciprocal relations, which should make it possible to observe two main tendencies in the dynamics of changes taking place in this field, and present its specificity and distinctiveness in comparison to the systems of democratic states. At the beginning of this chapter, a thesis has been formulated (simultaneously, becoming an extension of the attempt to determine why, at a certain stage of the integration process, the issue of democracy/legitimization deficiency started to be discussed – a question that was raised in the first chapter), which states that the legitimization of the EU institutional system will be sufficient, if the law regulations and political practice of their functioning are convergent with the level of advancement of the integration process in various spheres of social life; in other words, the "institutional" integration should correspond with the "material" integration (that is the Union politics). To that end, the author made an attempt to present, in a synthetized form, the development of the "material" integration (subsection 2.1.), which he completed with an analogical endeavour to illustrate the evolution of the EU (EC) institutional system in the context of its legitimization (subsection 2.9). For in accordance with the increasingly common approach, the EU institutions are treated as a system, the concept and principles of which have been presented in 2.2. subsection. In the third chapter, the author presents the EU institutional system in its current form, that is with the changes introduced under the Lisbon Treaty. Here, the selected aspects regarding competences and functioning of the particular EU institutions have been depicted, as well as the relations between them in the context of legitimization. Additionally, three selected problems regarding the EU institutional system have been raised, which are especially important in the context of its legitimization (the relation between the EU institutional system and the institutions of the EU member states, the question of transparency in the functioning of the EU institutions, as well as the Union budgets in the consecutive years). In the last subsection (3.9.) the specific features of the EU institutional system, significant in the context of its legitimization, have been identified. The fourth chapter is devoted to the functioning of the EU institutional system in the perspective of four basic sources of its legitimization, i.e. indirect and technocratic, direct and democratic, utilitarian, and one consisting of "values". The chapter ends with a conclusion outlining the specificity of the EU and its institutional system with regard to the sources of its legitimization, which is especially important in the context of the book's main thesis. The fifth chapter concerns the problem of legitimization of the EU institutions in the context of the economic crisis, which the EU member states struggle with since around the year 2008. The sixth chapter, in turn, regards the so called subjective (empirical, social) dimension of the EU institutions' legitimization, that is, the way this problem is perceived by the citizens of the EU member states. It has been based on the results of opinion polls conducted for the use of Eurobarometer, from among which these questions and answers were selected, which could be applied to illustrate the way the EU citizens perceive the Union institutions in the context of their legitimization. The closing remarks include the most important conclusions drawn from the conducted analyses and the potential reforms and modifications of the EU institutional system, which may allow for the reinforcement of its legitimization, primarily in its democratic aspect. In 2015 we celebrate the twenty-fifth anniversary of the first free local elections to self-governing bodies. Those elections activated local citizens initiatives and greatly contributed to the transformation in our social awareness, leading to real change in Poland's political regime. The underlying rationale of free local elections, however, was the package of laws adopted on 8 March 1990 which created real self-government, enabled the elections to commune and municipality councils of 27 May 1990 and introduced a new dynamic to the process of the decentralisation of the state.Changes are always the result of dreams and our ability to realise them. It is possible to make them if there exist organisational structures and institutions which allow such changes to be made. The need for political transformation had long been felt and deliberated on by those involved in spatial development or and for whom the state monopoly status quo was unacceptable. To quote the late and much missed Professor Jerzy Regulski, the implementation of self-governance was departure from the monopoly of central government, which in turn meant an actual change in the political regime. The reform of 1990 broke up five monopolies of an authoritarian state which had existed in Poland since the end of the World War II: the political monopoly of one party, of centralised power, of uniform state ownership, of public finances and the state budget, and of the uniform public administration of the state.However, it must always be remembered that the possibility of realising dreams of a change in the nature of the state was shaped in the first triumphant stage of the Solidarity period in 1989, and later became a stable basis for the future in the resolution of the First National Congress of Solidarity Delegates and in the 'Samorządna Rzeczpospolita' (A Self-governing Republic) document. The success of the real change of 1990 was rooted in the long term determination and persistence of those whose personal experiences were involved in the quest for rationality in land management. Both Professor Jerzy Regulski and Professor Michał Kulesza drew their inspiration to change the political regime from the need to ensure that society worked in a way that would allow the local needs and initiatives be articulated, and inhabitants having the ability to take concrete decisions about the surrounding environment. In this way, the existing possibility of active involvement in local initiatives, incapable of being realised in the former political system, would become a reality and the citizens would be able to make collective decisions about their local area. This would also give a chance to oppose formally the investment logic resulting from the central planning of those times.The analytic work aimed at the transformation of the political regime that Professor Regulski started in the 1970s during his employment at the University of Lodz were subsequently continued at the Economic Institute of the Polish Academy of Sciences and led to the formation of a group of individuals for whom self-governance became a core value of the new regime and a way of looking at the modern state. The change that took place in 1990 was the beginning of the building of a de-centralised, modern state, the status of which was subsequently confirmed when Poland adopted the Council of Europe Framework Convention for the European Charter of Local Self-Government. Self-government is never an institution whose constitution is ever finished. This was shown during the reform carried out by Prime Minister Jerzy Buzek's government, which continued the break-up of the monopoly of power and implemented subsidiarity principles at the regional level enabling them to exercise powers locally, in newly created districts (powiat), as well as in the later legislative changes pertaining to the regulations governing the election of mayors (wójt or burmistrz) or the work of the Komisja Wspólna Rządu i Samorządu (Joint Committee of the Government and Self-Government). Today, after 25 years of our experience with self-government, we are much more aware of the changes needed in the self-governing system. They include the strengthening of actual independence of self-government achieved through the ensured free choice of the manner in which self-government bodies will carry out their tasks, guaranteed revenues and the possibility given to commune and municipality authorities of exercising real influence on their size, improved cooperation between communes and municipalities (gmina) and districts (powiat), and, fore and foremost, by ensuring all citizens a chance of co-decision on matters which directly affect them. Changes in the regime of self-governance are a consequence of its assessment by external, independent experts but are also motivated by the natural dynamics of the changes resulting from the very essence of self-governance and its institutions, communes and municipalities (gmina), districts (powiat) and regions (voivodships).In 2010 associations of self-governing units realised the need for change and amendments to the law on self-governance. Thus, they formulated a number of proposals which were included in a document called 'Requests to the President of the Republic of Poland to commence work on the white book of territorial self-government in the year of the 20th anniversary.' This document initiated work on a draft law which in 2013 became the subject of a legislative initiative put forward by President Bronisław Komorowski. The purpose of the new law on the collaboration of self-governing bodies in local and regional development is to strengthen the role of the citizen as well as the community in the work of self-government in Poland. The effort that Professors Jerzy Regulski and Michał Kulesza in their capacity as Advisors to President Komorowski put into the legislative work remains invaluable. It is believed that the involvement of individual citizens constitutes the strength of self-government and is a guarantee of its role at the service and in the interest of communities, individual inhabitants and businesses. Hence the need for enhanced collaboration and the partnership of different bodies of self-government and the increased involvement of citizens. There is draft law that contains regulations supporting these activities.Under the draft law, a local referendum is seen as an important tool to ensure the participation of citizens in decision-making processes, including those concerning local development plans. Local referenda should constitute a mechanism used to solve local issues of material importance to residents. Their result should be binding regardless of the turnout.Self-governance helps to create and strengthen the natural inclination of individuals to act together in areas where because of their social, business or cultural ties, a local community spirit develops. In today's world of global challenges and competition, we are looking for a space for the individual which provides a feeling of security. Another important value of self-governance is the possibility of creating affiliations with a community as well as individual entrepreneurship, social activity and a regard for the collective memory of the symbols of a place. The ability to participate in community life is inseparable from the functioning of democracy at a local level, with the consultation process, election of public officers, or participation in referenda.Self-governance is a special value which gives each of us a chance to exercise a real influence on local matters. It therefore occupies a very special place where politics has a personal dimension. The variety of self-governance means at the same time a variety of development policies since there are different communities, with different emotions, different experiences or ability to participate in democratic management. This variety is a special asset in the process of the stabilisation of the state as a whole. The diversity of opinions and experiences, appointments to public office of citizens not affiliated to or necessarily recommended by any party creates the solid foundations of a democratic state. This feeling of freedom within self-governing communities must be continued and promoted.The authors of many of the texts published in this issue of Ruch Prawniczy, Ekonomiczny i Socjologiczny devoted to self-governance are, at the same time, authors of the transformation of Polish law and Poland's administration in the last 25 years. Contributions submitted by, among others, Prof. dr hab. Irena Lipowicz, Prof. Jerzy Stępień, Prof. dr hab. Jerzy Buzek, Prof. dr hab. Leon Kieres or Prof. dr hab. Hanna Gronkiewicz-Waltz are the best proof of the capital importance that self-governance plays in a democratic state. I thank Professor Teresa Rabska and the editorial staff of Ruch Prawniczy, Ekonomiczny i Socjologiczny for their active involvement in questions of self-government from the very beginning. This issue is entirely devoted to a range of legal, economic and sociological aspects of new challenges facing self-government and its regime.
