The purpose of this article is to interpret the political developments in Europe in the late 1980s and early 1990s and at the same time to discuss the use of theory in such "macro-interpretations" of the present changes. First, elements of the "process of Europeanization" are identified, followed by a discussion on how "world-system theory", "neorealism" and "the school of interdependence" might be used in the understanding of the process of Europeanization. The discussion focuses especially on the concepts of "security complex" and "regime". Some of the main theoretical deficits in the use of theories are pointed out. It is claimed that we need a better understanding of changes in power structures and improved concepts for analysis on the "middle" level between structural-level and state-level analysis. On the basis of the theoretical discussion the article presents an interpretation of the present changes in Europe. The interpretation is based on reflections on the kind of structural changes which are taking place in the present international system. It is claimed that there are tendencies which form a new international regime for overall security and internal change in Europe. The European Community is seen as adopting an increasing role in this all-European process. The main obstacles to such a new stability regime in Europe are seen as a possible setback in the Soviet Union and/or a destabilizing revitalization of the German problem.

Die USA, Deutschland, Frankreich und Großbritannien stehen für jeweils unterschiedliche sowie international viel beachtete Modelle der Hochschul- und Berufsbildung. Es gibt keinen globalen Konsens darüber, welche Kriterien für den Erfolg nationaler Bildungssysteme gelten oder welchem Vorbild gefolgt werden soll. Gegenwärtige europäische Reformen, wie die Bologna- und der Kopenhagen-Prozesse, sollen die Wettbewerbsfähigkeit Europas im Vergleich zu den USA erhöhen. Doch auf welchen zentralen Vorstellungen basiert das in diesen Prozessen verbreitete, im Entstehen begriffene europäische Bildungsmodell? Mit einer Inhaltsanalyse europäischer Dokumente (Deklarationen und Kommuniqués) gehen wir der Frage nach, ob die Ideale, Ziele, Legitimationen und Standards dieses Modells eher auf eine Amerikanisierung oder auf eine bricolage verschiedener aus Europa stammender Modelle hindeuten.

Mehr als 13.000 Einträge zählt das Transparenzregister der europäischen Institutionen in Brüssel. Damit ist das inoffizielle Zentrum der EU nach Washington D.C. der zweitgrößte Schauplatz von Interessenvertretungen in der Welt. Einige Integrationsforscher sprechen gar von einer "Explosion" der Lobbyingaktivitäten in der EU (Berkhout und Lowery 2010: 449 f.). Diese Entwicklung hat sich auch in der Forschung niedergeschlagen. In den letzten zwanzig Jahren entstand eine Vielzahl von Grundlagenwerken, die sich mit der Europäisierung von Interessenvertretung auseinandersetzen (Klüver 2012: 1 ff.; Hofmann 2017: 279 ff.). Dennoch finden sich Lücken in der EU-Lobbyismusforschung, denn häufig stehen die besonders integrierten Politikfelder, vor allem die Wirtschafts- und Finanzpolitik und die damit verbundenen Interessenorganisationen, im Mittelpunkt (Bunea und Baumgartner 2014: 1412 ff.). Eines dieser Politikfelder ist die Kulturpolitik und das Verbandswesen, das sich in den letzten zwanzig Jahren dort entwickelt hat. Dies ist erstaunlich, da die Europäische Kommission die Kulturetats, insbesondere die Förderprogramme "Creative Europe" und "Media", fortlaufend vergrößert hat und der Dialog mit den Akteuren der Kultur- und Kreativindustrie ausgeweitet wurde. Daneben wird im Arbeitsplan der EU-Kommission, der "European Agenda for Culture" von 2018 und in der Neuauflage des Programms "Creative Europe", von der Bedeutung der Kreativindustrie für die zukünftige EU-Ökonomie gesprochen (Europäische Kommission 2019c). Damit verbunden hat auch die Zahl der Interessenorganisationen im Kultursektor auf europäischer Ebene zugenommen. Kulturpolitik ist auf der europäischen Ebene ein Politikfeld, das maßgeblich von Soft-Power-Instrumenten wie dem strukturierten Dialog mit der Zivilgesellschaft, der Offenen Methode der Koordinierung und der Fördermittelverteilung durch Programme wie "Creative Europe" geprägt ist (Europäische Kommission 2019a). Abstract
This article provides an analysis of the functions performed by constitutional identity in constitutional discourses of both the EU and its Member States, in the context of emerging post-Westphalian and supranational constitutionalism. The analysis tries to demonstrate that constitutional identity may serve as one of the key normative ideologies, legitimation strategies and ordering schemes of EU constitutionalism. It reasserts through functional analysis the suitability of constitutional identity for organizing and explaining multiple constitutional orders in a non-hierarchical and inclusive way.
The article is based on a socio-legal approach, deliberately avoiding the predominant legal realist and legal positivist discourses. This is due to the fact that a functional analysis presupposes admitting the existence of ideal, legal and socio-legal dimensions of constitutional concepts and institutions and the taking into account of social implications produced by their functioning. The article deliberately takes a constitutionalist stance on the EU and the EU integration. It is focused on the contribution of constitutional identity for the further constitutionalization of the EU from a socio-political and constitutionalist perspective.
