The article notes that despite the existing research in the field of the formation and development of financial markets, it is still important to search for ways to improve it. The measures taken to further develop and improve the financial market are not always effective. And the adopted normative and legislative acts often ignore each other. Analyzing the current state of the regional financial market, it is necessary to note the tendency for the sale of state shares in joint-stock companies, which often leads to a change in the form of ownership of enterprises, which in turn also affects the further development of the financial market.
Purpose: the article examines the main problems associated the new regulatory acts of Malaysia – the Financial Services Act of 2013 and the Islamic Financial Services Act of 2013; The characteristics of the legal status of the "Ombudsman for financial services" are listed, types of financial disputes subject to settlement under the "financial ombudsman scheme" are listed, parties to the financial dispute are identified. To achieve this goal, the article must solve the following tasks: to determine whether there are institutions in Malaysia that provide services for resolving financial disputes; to investigate the main problems associated with the definition of the concept and types of financial dispute, the conditions for the transfer of a financial dispute to the competent authority. Methods: this article is based on an interdisciplinary concept of research, which allowed to distinguish the distinctive features of the legal regulation of the settlement of financial disputes in Malaysia. Results: according to the provisions of the new laws of Malaysia, namely the Financial Services Act of 2013 and the Islamic Financial Services Act of 2013, a financial dispute should be understood as a dispute, to which the parties are a financial consumer and a financial service provider provider. Financial disputes include disputes in the field of insurance and Islamic insurance, as well as disputes over bank cards, bank accounts, ATMs, Internet banking, mobile banking, and others. The main body for the settlement of financial disputes is the Financial Ombudsman. The competence of the financial ombudsman is limited by the amount of the claim of 250,000 ringgit (about 4.5 million rubles), under insurance claims – 10,000 ringgit, in the field of unauthorized transactions – 25,000 ringgit. The procedure for resolving a financial dispute, which in Malaysia is referred to as the "scheme of a financial ombudsman", is established by the Central Bank of Malaysia. Conclusions and Relevance: the materials presented in the article show the special role of arbitration in resolving domestic and international financial disputes. К финансовым спорам относятся споры в области страхования и исламского страхования, а также споры по поводу банковских карт, банковских счетов, банкоматов, интернет-банкинга, мобильного банкинга, и другие. Основным органом по урегулированию финансовых споров выступает Финансовый омбудсмен. Компетенция финансового омбудсмена ограничена ценой иска в 250 тысяч ринггит (около 4,5 млн руб.), по искам в области страхования – 10 тысяч ринггит, в области несанкционированных транзакций – 25 тысяч ринггит. In this paper we introduce the results of the research about the impact of financial development on the decrease in deviation of the real inflation rate from the central bank's stated target inflation rate. Using methods of cluster analysis and panel procedures on a sample of the countries, which at the moment of writing the research officially stated to adhere to a policy of inflation targeting, we show that improving characteristics of financial development benefit the success of an inflation targeting regime (in terms of achieving its desired goal). It is also stated that for emerging economies the most vital channels of this mechanism are the increases in the efficiency and in the stability of financial markets and institutions.

The financial uncertainty is a new institution of financial law and, at the same time, a new phenomenon of financial and legal science. Although the elements of financial uncertainty as the economic phenomenon are not new and are known to the practice of financial legal relations and the norms of financial legislation.Since the system of financial law is multi-spectral, especially in modern economic conditions, the institution of financial uncertainty, like many other institutions of financial law, is multifaceted and has its own characteristics in the framework of tax law, budget law, institutions of financial and legal regulation of banking and insurance, as well as other. For the general part of financial law, it is necessary to determine the definition of the concept of "financial uncertainty", its signs and elements. It is important to distinguish between the content of the institution of financial uncertainty in the legal regulation of fiscal interests of the state, as well as the interests of the state in public law regulation of finance of the private sector of the economy. In addition, to understand the problems of the institution of financial uncertainty in the subject of financial law, it is important to distinguish between financial and monetary relations. In all cases, the key, initial condition for scientific discourse is the risky nature of financial planning and forecasting. It is the principle of planning as one of the important principles of financial law that must be studied in the development of the desired institution.Conclusions. Financial uncertainty as a legal institution is complex because uncertainty and risks permeate the entire sphere of public financial activity: fiscal, parafiscal, monetary (including payment). In this regard, it can be argued that aspects of financial uncertainty relate, in fact, to each link of the financial, credit, monetary, and payment systems, and, accordingly, to each institution of a special part of financial law. ; Анализируется понятие и содержание финансовой неопределенности как нового института финансового права и, одновременно, нового феномена финансово-правовой науки. Purpose: the article examines the main problems associated with the extension of arbitration of domestic and international financial disputes in Singapore. The characteristics of the development of international commercial arbitration in Singapore, including the role of the Singapore International Arbitration Center SIAC, examined the new SIAC Arbitration Rules - the Arbitration Rules of 2016 and the Investment Arbitration Rules of 2017, as well as the Arbitration Regulations of the Singapore Exchange 2006 and the Arbitration Rules Singapore Exchange on the Derivatives Trade 2005. In order to achieve this goal, the article must solve the following tasks: to determine whether there are institutions providing services in Singapore and on the arbitration of financial disputes; to study the main problems of transferring a cross-border financial dispute to international arbitration; to study the practice of international arbitration on this issue.Methods: this article is based on an interdisciplinary concept of research, which allowed to distinguish the distinctive features of the legal regulation of the settlement of financial disputes in Singapore.Results: the provisions of the Arbitration Rules of 2016 and the Investment Arbitration Rules of 2017 are innovative not only for the SIAC Center, but for all international commercial arbitration as a whole. The new regulations of the SIAC Center enshrined provisions for the consolidation of arbitral proceedings in disputes from two or more treaties; on attracting additional parties; the refusal of claims or objections at an early stage if the claim or objection is manifestly unfounded from a legal point of view or the claim / objection is obviously beyond the jurisdiction of the Arbitration Tribunal; on delocalization of the place of arbitration; additions to the provisions on extraordinary arbitration and the procedure for accelerated production. The new Arbitration Rules came into force on January 1, 2016 and proved itself from the very best side. The statistics of the SIAC Center for 2016 were unprecedented.Conclusions and Relevance: the materials presented in the article show the special role of arbitration in resolving domestic and international financial disputes. Для достижения поставленной цели в статье необходимо решить следующие задачи: выявить, имеются ли в Сингапуре учреждения, предоставляющие услуги по арбитражному разрешению финансовых споров; исследовать основные проблемы передачи трансграничного финансового спора в международный арбитраж; исследовать практику международных арбитражей по данному вопросу.Методология проведения работы: Данная статья основана на сравнительно-правовом методе исследования, который позволил выделить отличительные особенности правового регулирования разрешения финансовых споров в Сингапуре.Результаты работы: Положения Арбитражного Регламента 2016 г. и Регламента инвестиционного арбитража 2017 г. являются новаторскими не только для Центра SIAC, но и для всего международного коммерческого арбитража в целом. В новых регламентах Центра SIAC были закреплены положения о консолидации арбитражных разбирательств по спорам из двух и более договоров; о привлечении дополнительных сторон; об отказе в требованиях или возражениях на ранней стадии, если требование или возражение является очевидно необоснованным с правовой точки зрения, или требование/ возражение очевидно выходит за пределы юрисдикции Состава арбитража; о делокализации места арбитража; дополнения в положения о чрезвычайном арбитраже и процедуре ускоренного производства. The article notes that in recent years the Government of India has implemented a number of reforms aimed at liberalizing, strengthening regulation and strengthening the financial industry. Current transition to mega-regulation is the main trend of the financial regulatory reform. The paper examines this transition in a historical context as a natural result of evolution of the industrial organisation under globalization and conglomeration of financial sector. Alternative models of mega-regulation are dicussed: the "integral" approach, under which regulatory functions are concentrated within a single body, and the model of "twin peaks", when regulatory mandates are distributed between two institutions on the functional principle (macro stability and consumer financial protection). We prove that despite current bias towards integrated approach, demerging of regulators within the framework of the "twin peaks" model has a key advantage of eliminating intra-institutional regulatory trade-offs.
Growing demand for financial services, especially for smallholders in rural areas of developing and transforming countries is opening up challenges and opportunities for governments that they should consider for smoothing of rural poverty alleviation. By understanding of these calls the governments have started to develop incentives toward outreach of necessary financial services to the poor in rural population. Evidence from Uzbekistan has shown that in general government's incentives in expanding of affordable financial services to the poor were positive, however, there are still some concerns of reaching financial services to smallholders. In this paper, several financial innovations and theories have been explored and as an effective financial institution, credit cooperatives are proposed for linking smallholders to financial services.

However, unlike other countries of the Asia-Pacific region, consumers of financial services can be both physical and legal entities. Conclusions and relevance: the materials presented in the article show the special role of "Designated Dispute Resolution Organizations" in resolving domestic financial disputes in Japan. Purpose - to analyze the current trends in the international market for financial investment and wealth management services and characterize the impact of digital technologies on the development of the investment market. Results. The economic essence of the concept of "private capital management" and the consequences of the impact of digital innovations on it were explored. The problem of the outlined tendency to decrease the growth rates of assets under the management of financial institutions has been considered. The specificity of the Ukrainian market of wealth management services was determined. Based on the analysis, the directions for further development of the international market for financial investment and private capital management services in the medium term have been identified. Theoretical implication. The issues studied in the work should contribute to speeding up the solution of problems of the impact of digital technologies on the international market for financial investment and private capital management services and integrating digital technologies into investment markets. Originality / value of the research. A distinctive feature of this work is the abundance of factual material about the results of the activity of the world's largest financial institutions - leaders in the field of services for managing financial investments and private capital. Article on methodological grounds and the establishment of new institutional theory. Author updates the new methodological horizons opened up by the use of tools new institutional theory in economic analysis.
The article analyzes the main reasons for the slow adoption of blockchain technology, in particular, in the financial sector. The authors critically analyzed the main declared properties of blockchain technologies: trust, security, decentralization, immutable data storage, lack of intermediaries, hardware protection against attacks, and openness. The aim of the study are to show that these blockchain properties are overestimated, the expectations of its adoption are inflated, and the delays in its adaptation outside of cryptocurrencies, in particular, in the financial sector, are natural. The article is based on a methodology for the qualitative and quantitative analysis of scientific publications and statistical sources on the blockchain adaptation from the perspective of the theory of diffusion of innovations, the conditions and the specifics of economic and sociological approaches for consensus-building. The study resulted in the following new systemic findings. Blockchain and distributed ledgers are not fundamentally new technologies. In general, they do not have the properties of the immutable data storage, trust, anonymity, low transaction and adoption costs. All current consensus technologies have fundamental faults. Cryptocurrency technology is original, but it was a private experimental solution to a specific ideological problem of the libertarian political agenda. Consensus does not provide trust. Delayed blockchain adoption, in particular in traditional financial institutions, is natural, since the technology does not show better results than current digital solutions, and traditional economic institutions have greater public trust. The practical implications of the findings are that they may be used by investors. ; В статье исследуются причины медленного внедрения технологии блокчейна в финансовой сфере. Авторы критически проанализировали основные декларируемые свойства блокчейн технологий: доверие, безопасность, децентрализация, неизменность хранения данных, отсутствие посредников, встроенная защита от атак, открытость. Цель исследования — показать, что декларируемые свойства блокчейна переоценены, ожидания от внедрения завышены, а задержки его адаптации за пределами криптовалют, в частности в финансовой сфере, закономерны. В основу статьи положена методология качественного и количественного анализа научных публикаций и статистических источников, посвященных адаптации блокчейна с позиции теории диффузии инноваций, условий достижения консесуса и особенностей реализации экономико-социологических подходов к достижению консенсуса. В результате исследования сделаны следующие новые системные выводы. Блокчейн и распределенные реестры не являются принципиально новыми технологиями и в целом не обладают приписываемыми им свойствами неизменности хранения данных, достижения доверия, анонимности, низкой стоимости транзакций и дешевизной внедрения. Все существующие технологии консенсуса обладают фундаментальными недостатками. Технология криптовалют оригинальна, но была частным экспериментальным решением конкретной идеологической проблемы либертарианской политической повестки. Консенсус не обеспечивает доверия. Задержка внедрения блокчейна в традиционных финансовых институтах закономерна, поскольку технология не показывает результатов лучше, чем текущие цифровые решения, а традиционные экономические институты имеют большее общественное доверие. Практическая значимость выводов исследования заключается в том, что они могут быть использованы инвесторами.
The article focuses on theoretical issues of the government control in the financial sector, the trends in legislation development, as well as forms and methods of financial monitoring. The recent decade has seen the rapid development of scientific concepts exploring financial control issues. The authors and leading scholars discuss the essence of the concept of "financial monitoring", its characteristics and classifications. The legal regulation for financial monitoring purposes is rapidly developing along with academic approaches. The article offers a comprehensive review of trends in the development of the financial monitoring institution and genesis of legal regulation. The author suggests ways to improve the financial monitoring legislation. The methodological basis of the article uses the latest achievements in the cognitive theory. The study employed the following methods: general philosophical, systematic, analysis, synthesis, analogy, deduction, as well as traditional legal methods (formal-logical, comparative legal) and expert estimates. The main conclusion drawn from the results of the study is that there is a need to harmonize the forms and methods of control activities; systematize and unify risk analysis tools applied in the process of government control in the financial sector; amend the regulatory legislation, since financial monitoring is just a kind of government control. The novelty of the paper is in developing proposals towards further development of the financial monitoring institution. ; Предметом статьи являются теоретические проблемы института государственного контроля в финансовой сфере, тенденции развития законодательства, закрепляющие формы и методы финансового контроля. Последнее десятилетие ознаменовалось активным развитием научных концепций, исследующих финансовый контроль. Авторы вступают в дискуссию с ведущими учеными о сущности понятия «финансовый контроль», его признаках и классификациях. Наряду с научными подходами интенсивно развивается нормативно-правовое регулирование финансового контроля. В статье комплексно рассматриваются как научные тенденции развития института финансового контроля, так и тенденции генезиса нормативно-правового регулирования. Предлагаются пути правового совершенствования финансового контроля. Методологическую основу статьи составили современные достижения теории познания. В процессе исследования применялись общефило- софский, системный методы, анализ, синтез, аналогия, дедукция, традиционно правовые методы (формально- логический, сравнительно-правовой), а также экспертные оценки. Основной вывод, который сделан по ито- гам исследования, состоит в том, что необходимы унификация форм и методов осуществления контрольной деятельности, систематизация и унификация применяемых инструментов риск-анализа при осуществлении государственного контроля в финансовой сфере. Основной вывод, который сделан авторами в статье, - необходимость развития и унификации нормативно-правового регулирования финансового контроля как раз- новидности контроля государственного. Новизна статьи заключается в разработке предложений по дальней- шему развитию института финансового контроля.
The current trends of the national market for financial services, which are interconnected with some features of the functioning of the global financial services markets, are investigated in the article. Imperatives of their development are: the internationalization of financial markets and the globalization of financial flows, increasing concentration of monetary and industrial capital, expanding the scope of activities of financial corporations, activation of trading activities of non-financial corporations as financial services providers, have been identified as fundamental. The study identified factors that determine the essential characteristics of the national financial services market at the macroeconomic level, its organizational and institutional structure, as well as the mechanism of interaction between its elements (by certain specialized financial institutions, financial assets, business entities, the legislative bodies and specific well-established connections between market participants). It was also proposed the anti-crisis strategy for the development one of the financial intermediaries of financial services market, if the market doesn't perform its primary function. The implementation of this strategy make possible to survive financial intermediaries in crisis and receive positive financial result that will provide their competitive and efficiency of financial services market as a whole. ; В статье исследованы современные тенденции развития национального рынка финансовых услуг, которые взаимосвязаны с некоторыми особенностями функционирования мировых рынков финансовых услуг. Определены основополагающие императивы их развития: интернационализация финансовых рынков и глобализация финансовых потоков; усиление концентрации денежно- промышленного капитала; расширение сферы деятельности финансовых корпораций; активизация торговой деятельности нефинансовых корпораций по оказанию финансовых услуг. А также, выявлены факторы, определяющие существенные характеристики национального рынка финансовых услуг на макроэкономическом уровне, его организационную и институциональную структуру, а также механизм взаимодействия между его элементами (отдельными специализированными финансовыми институтами, финансовыми активами, субъектами хозяйствования, законодательными органами и определенными устоявшимися связями между участниками рынка). Предложена антикризисная стратегия развития одного из финансовых посредников рынка финансовых услуг, в том случае, если рынок не выполняет своей основной функции. Реализация данной стратегии позволит выжить финансовым посредникам в условиях кризиса и получить положительный финансовый результат, что обеспечит их конкурентоспособность и эффективность деятельности рынка финансовых услуг в целом. ; У статті досліджено сучасні тенденції розвитку національного ринку фінансових послуг, які взаємопов'язані з деякими особливостями функціонування світових ринків фінансових послуг. Визначено основоположні імперативи їх розвитку: інтернаціоналізація фінансових ринків і глобалізація фінансових потоків; посилення концентрації грошово-промислового капіталу; розширення сфери діяльності фінансових корпорацій; активізація торговельної діяльності нефінансових корпорацій з надання фінансових послуг. А також, виявлено чинники, що визначають суттєві характеристики національного ринку фінансових послуг на макроекономічному рівні, його організаційну та інституційну структуру, а також механізм взаємодії між його елементами (окремими спеціалізованими фінансовими інститутами, фінансовими активами, суб'єктами господарювання, законодавчими органами і певними сталими зв'язками між учасниками ринку). Запропоновано антикризову стратегію розвитку одного з фінансових посередників ринку фінансових послуг, в тому випадку, якщо ринок не виконує своєї основної функції. Реалізація даної стратегії дозволить вижити фінансовим посередникам в умовах кризи і отримати позитивний фінансовий результат, що забезпечить їх конкурентоспроможність та ефективність діяльності ринку фінансових послуг в цілому.
