Eine normative Sozialstaatsbegründung kann nur gelingen, wenn der Sozialstaat sich auf der Grundlage unserer menschenrechtlichen Überzeugungen als rechtlich unabdingbar erweist und der vage Orientierungsbegriff der sozialen Gerechtigkeit Kontur gewinnt.Vor diesem Hintergrund vergleicht der Verfasser vier Begründungsmodelle, in denen soziale Gerechtigkeit und das ihr zuarbeitende Sozialstaatsprinzip ausgelegt wird als Daseinsfürsorge, als Freiheitsfürsorge, als Gleichheitsfürsorge und schließlich als Demokratiefürsorge, das heißt: Versorgung Selbstversorgungsunfähiger auf der Grundlage zivilgesellschaftlicher Solidarität, zur Sicherstellung gleicher politischer Autonomie und gleichberechtigter Selbstbehauptung aller im öffentlichen Raum. Die sich solcherart der Demokratiefürsorge verschreibende solidarische Versorgungsformation kann freilich nicht mehr als Sozialstaatsmodell bezeichnet werden: sie ist dezidiert antietatistisch und antibürokratisch und möchte das duale Schema von Markt und Staat durch das Dazwischentreten einer selbstmächtigen, sich selbst organisierenden Zivilgesellschaft aufbrechen.Im Ergebnis zeigt sich, daß es gute Gründe gibt, sich für eine freiheitsrechtliche Sozialstaatskonzeption zu entscheiden.
