This is an Open Access book. Amid the growing debate about models of judicial governance and their relationship to democratic quality, this book offers a systematic and empirical study of this relationship. The book thereby contributes to filling in this gap for the European continent. Taking an interdisciplinary politics and law perspective, and combining empirical and theoretical considerations, the book addresses the important link between democracy and judicial governance. In particular, it provides for three interconnected contributions. First, the book provides for a comprehensive classification of European countries into different models of judicial governance. Second, the book analyses empirically the relationship between the design of judicial governance and the quality of democracy. Third, building on those findings, the book presents policy reflections for the reform and improvement of mechanisms for judicial governance in European countries. The book seeks to refine our knowledge about the relationship between judicial governance and democracy, making an important academic and social contribution. In an era in which many democracies backslide and deconsolidate, it assesses to what extent existing mechanisms for judicial governance have contributed to the stability and quality of democratic systems in which they are implemented. Furthermore, the book puts forward reflections to improve the role of organs for judicial governance in fostering the quality of democracy. Since the book introduces in an accessible form key concepts of Judicial Governance, it will be of interest for the general public as well as academics and students in the fields of Law and Political Science. The book also addresses policy makers, as based on our empirical knowledge about the interaction judicial governance and democracy it puts forward ideas for a design of judicial governance that is more capable of protecting democratic systems of government.

Globalisation has been an important factor in accelerating democracy's growth in recent decades. In this globalised world, rapid development and global proliferation of new technologies and telecommunications, and integration of the world economy through trade and investment, have increased the role and power of regional and global institutions (Cheema and Maguire, 2004). This promoted and strengthened the spread of democracy while also providing the leverage for good governance. Globalisation impacts on the mode of governance that a country operates either as a symbol of universality or for uniformity. This unstoppable trend has homogenised governance on a global scale while depicting authoritarianism as unproductive political modernity.

Each stage of our national development has had a distinctive form of public policy. And each has faced a core tension between the dictates of governance and the constraints of democracy. Economic or social interests, and advantage-seeking politicians, forge policies. Countervailing interests, or changing times, or the limits of state capacity see to it that those policies rarely if ever live up to the expectations of their progenitors. But then no one ever said that the American polity, to say nothing of its democratic ideal, is a neat or orderly thing.

Multistakeholder governance is proposed as the way forward in global governance. For some leaders in civil society and government who are frustrated with the lack of power of the UN system and multilateralism it is seen as an attractive alternative; others, particularly in the corporate world, see multistakeholder governance as offering a more direct hand and potentially a legitimate role in national and global governance. This book examines how the development of multistakeholderism poses a challenge to multilateralism and democracy. Using a theoretical, historical perspective it describes how the debate on global governance evolved and what working principles of multilateralism are under threat. From a sociological perspective, the book identifies the organizational beliefs of multistakeholder groups and the likely change in the roles that leaders in government, civil society, and the private sector will face as they evolve into potential global governors. From a practical perspective, the book addresses the governance issues which organizations and individuals should assess before deciding to participate in or support a particular multistakeholder group. Given the current emphasis on the participation of multiple actors in the Sustainable Development Goals, this book will have wide appeal across policy-making and professional sectors involved in negotiations and governance at all levels. It will also be essential reading for students studying applied governance.
