The inauguration of Nelson Mandela as South Africa's first democratic president on 10 May 1994 became a symbol of the end of apartheid and the beginning of a new chapter in the country's history. As South African society was deeply divided, the 1993 Interim Constitution expressed the need for reconciliation between the people of South Africa and the reconstruction of its society. The legacy of apartheid was to be addressed based on 'a need for understanding but not for vengeance, a need for reparation but not for retaliation, a need for ubuntu but not for victimization'. Due to its introduction into the Constitution, ubuntu – a philosophy of unity, cooperation, compassion and respect for human dignity, which originated in small African communities – became a source of values for the whole legal system. The goal of the text is to present the ubuntu philosophy and to describe its role in the South African transitional justice process and in selected areas of South African law (criminal law, evictions and defamation). On the whole, South Africapresents a unique case in which both the political transformation and the legal system were strongly shaped by the said philosophical and ethical concepts, which bear close resemblance to the idea of restorative justice. ; Zaprzysiężenie 10 maja 1994 r. Nelsona Mandeli na pierwszego demokratycznie wybranego prezydenta Republiki Południowej Afryki stało się symbolem końca apartheidu i otwarcia nowego etapu w historii tego państwa. Wobec istniejących w społeczeństwie głębokich podziałów przejściowa Konstytucja RPA z 1993 r. wyrażała potrzebę pojednania pomiędzy obywatelami RPA, a także rekonstrukcji wspólnoty. Przezwyciężenie spuścizny apartheidu miało być oparte na potrzebie "zrozumienia, a nie zemsty", "rekompensaty, a nie odwetu" oraz "ubuntu, a nie wiktymizacji". Filozofia ubuntu (wywodząca się z małych afrykańskich wspólnot filozofia jedności, kooperacji, współczucia i respektu dla ludzkiej godności), do której odwołanie zamieszczono w Konstytucji – stała się rezerwuarem wartości dla całego systemu prawa. Celem artykułu jest przedstawienie filozofii ubuntu oraz omówienie jej roli w rozliczeniach z przeszłością w Republice Południowej Afryki i w wybranych obszarach południowoafrykańskiego prawa: w prawie karnym, regulacjach dotyczących eksmisji z nielegalnie zajmowanego gruntu oraz w regulacjach przewidujących odpowiedzialność deliktową za zniesławienie. RPA jawi się przy tym jako wyjątkowy kazus, w którym zarówno polityczna transformacja, jak i system prawny kształtowały się pod istotnym wpływem omawianych koncepcji filozoficznych i etycznych, silnie nawiązujących do idei sprawiedliwości naprawczej.

To ensure the highest level of political leadership, 11 sitting Heads of State and Government, as well as a Special Advisor, were invited to lead the panel for a two-year period till March 2018. Celem artykułu jest zanalizowanie miejsca, jakie w kalkulacjach i polityce zagranicznej i bezpieczeństwa Iranu odgrywa Afryka Subsaharyjska. W tym celu zostaną zanalizowane takie aspekty jak ewolucja podejścia do tego subregionu, jego znaczenie w geostrategicznych kalkulacjach Teheranu oraz porównanie założeń z faktycznymi sukcesami. Hipotezą badawczą jest stwierdzenie, że Afryka Subsaharyjska zyskała w ostatnich latach na dużym znaczeniu w polityce Iranu (podczas prezydentury Mahmuda Ahmadineżada), ale polityczna i gospodarcza słabość tego państwa, a także celowe działania Arabii Saudyjskiej, w drastyczny sposób ograniczają możliwość penetracji tego kontynentu przez Iran oraz wyznaczają granice afrykańsko-irańskiego zbliżenia, szczególnie na płaszczyźnie politycznej i militarnej. W ramach prowadzonej analizy istotne są następujące pytania: w jakim zakresie i dlaczego Afryka Subsaharyjska jawi się z perspektywy niektórych irańskich decydentów jako atrakcyjny sub-region? W jakim zakresie i dlaczego poszczególni decydenci (prezydenci) Iranu różnią się w ocenie znaczenia Afryki? As part of the analysis, the following questions are relevant: to what extent and why does sub-Saharan Africa appear from the perspective of some Iranian decision makers as an attractive sub-region?; to what extent and why do particular Iranian policy makers (presidents) differ in assessing the importance of Africa?; to what extent does Iranian-Saudi competition impact the effectiveness of Tehran's policy?

Assembly of the Union Thirty-Second Ordinary Session 10 - 11 February 2019 Addis Ababa, Ethiopia ; The various terrorist groups operating in certain parts of the continent remain active and continue to threaten peace, security, stability and social cohesion, particularly in the Sahel-Saharan region.

Among many conflicts between United States and Soviet Union during the cold war era, one of the longest were Namibia's independence war and civil war in Angola. In the historiography, especially South Africa's literature, both of them are linkaged and known as Border War. However, Namibians had begun their struggle in 1966, twenty years later there was no perspective to finisz the war. The major breakthrough appeared in 1987–1988 thanks to series of meetings between president of the US, Ronald Reagan and general secretary of the Soviet Union, Mikhail Gorbachev. The key role played the year 1988. One year later United Nations has implemented Resolution 435 of Security Council from 1978. From that day, South Africa Defence Forces were beginning withdrawal from Namibia's territory. This article refers about the most characteristic and important aspects of United States' and Soviet Union' negotiations in 1987–1988, especially before and during Moscow summit in May and June 1988. ; Spośród wielu sporów istniejących między Stanami Zjednoczonymi a Związkiem Sowieckim w czasie zimnej wojny jednymi z trwających najdłużej była wojna o niepodległość Namibii i wojna domowa w Angoli, w literaturze traktowane niekiedy jako jeden konflikt, nazywany południowoafrykańską wojną o granice. Walka Namibijczyków o wolność trwała od 1966 r., jednak 20 lat później wciąż nie było widać perspektyw szybkiego zakończenia konfliktu. Przełom nastąpił w latach 1987–1988 dzięki seriom spotkań i negocjacji, jakie odbyły się między administracją prezydenta USA Ronalda Reagana i sekretarza generalnego KPZS Michaiła Gorbaczowa. Dla rozwiązania kwestii Namibii kluczowym rokiem był 1988 dzięki podpisaniu w Nowym Jorku grudniowych porozumień między władzami Angoli, Kuby i RPA. Rok później rozpoczęto realizację Rezolucji Rady Bezpieczeństwa ONZ nr 435, a wojska południowoafrykańskie zaczęły stopniowo opuszczać terytorium Namibii. Artykuł ma na celu wskazać najważniejsze aspekty negocjacji między USA i ZSRS w sprawie Namibii w latach 1987–1988, głównie przed szczytem i w czasie jego trwania (Moskwa, przełom maja i czerwca 1988 r.).

Problem granic w Afryce nie wiąże się z nieprawdziwym faktem, iż są one "sztuczne" czy "młode" – jako że są w większości starsze niż granice państw europejskich – ale z tym, iż stanowiły dzieło Europejczyków i że nawet do tej pory nie został jeszcze zakończony proces ich delimitacji, a szczególnie demarkacji. O ich trwałości z kolei świadczy zaakceptowana zasada uti possidetis, podkreślana wielokrotnie w wyrokach Międzynarodowego Trybunału Sprawiedliwości i w rezolucjach ONZ. Inne natomiast traktowanie granic w Afryce może prowadzić do rewizjonizmu terytorialnego i konfliktów, a nawet wojen. ; The problem of borders in Africa is not related to the false fact that they are 'artificial' or 'young', for in their majority they are older than those of European countries, but to the fact that they were created by Europeans and even today the process of their delimitation, and especially demarcation, has not been completed. Executive Council Thirty-Fourth Ordinary Session 7 – 8 February 2019 Addis Ababa, Ethiopia ; As a result of protracted armed conflict, Somalia remains as one of Sub-Saharan Africa's most underdeveloped county. Following the collapse of the central government in 1991, the country has been plagued with violent conflict and insurgency, extreme and widespread poverty, acute food shortage, and political instability, economic underdevelopment, and recurring natural disasters such as droughts and floods. Somalis to date lack: essential healthcare, education, food security, safe drinking water, hygiene and adequate sanitation, and have very limited employment and livelihood opportunities. The Federal Government of Somalia (FGS) and sub national tiers of government have meagre resources to meet the country's pressing needs.

The government of the South Kalimantan Province moved the provincial capital from Banjarmasin to Banjarbaru at the end of 2011. However, there has not been a clear decision as to what the government's old building will be used for. One thing is clear, the utilization has to be optimized by considering the local government regulations. The aim of the research is to examine the highest and the best alternatives of utilization that can be adopted for such an asset. Non-probability sampling method was used in the research to find the alternatives. The alternatives were analyzed by using the highest and the best use analysis as the relevance test instrument for each of them. After analyzing the alternatives, the benefit-cost ratio (BCR) analysis was conducted to analyze the alternatives prior to determining their feasibility. Legal analysis, physical analysis, financial analysis, and the maximum productivity analysis were the stages conducted on the research based on highest and best use analysis. Based on the result of the research, the alternative which is feasible to do is that the building is used for other governmental or public purposes. Through the analysis, the alternative meets the criteria of the analysis as mentioned before with NPV Rp. 747,439,143 and BCR 1.024. Furthermore, according to 42.5 percent of the respondents, the building is best used for UPT offices and other institutions.
