The political and legal theory of Giorgio Agamben, specifically his concept of homo sacer, can be usefully deployed to understand the regulation and treatment of sex offenders. It is argued that the sex offender can be conceived of as a non-citizen or bare life — the homo sacer — and that this elucidates the degrees of violence and forms of abjection visited upon sex offenders in western societies. Through the institution of laws aimed at protecting communities from sex offenders, specifically community notification and civil commitment laws, there is the production of a ban, whereby the sex offender is displaced into a lawless space — a camp. In this `camp', the sex offender is subjected to GPS electronic monitoring, surgical/chemical castration and various other forms of sovereign violence at the hands of professionals and anti-paedophile vigilante groups. This article shows that in the exertion of sovereign power, where the sex offender is placed in the ambiguous terrain of the camp, there is a restoration of order and maintenance of the sacred.

Mit diesem Buch schliesst der italienische Philosoph sein Hauptwerk "Homo sacer" ab, das um die Frage nach dem Verhältnis des Menschen zur staatlichen Macht kreist. Für Agamben besteht seit Aristoteles eine Spaltung der menschlichen Identität in Existenz und gesellschaftliches Sein. Unter Fortführung von Gedanken unter anderem M. Foucaults konstatiert er die Selbstentfremdung des Menschen, den immer totalitäreren Zugriff des Staates auf die körperliche Existenz und die Tendenz zu einem dauerhaften "Ausnahmezustand" um des Machterhalts willen. Hier nun verfolgt Agamben die Spuren dieser Spaltung durch die Geistesgeschichte und denkt über deren Überwindung nach. Utopisches Ziel: eine Politik jenseits des Staates, in der Existenz und bewusster Seinsentwurf in einer "Lebens-Form" zusammenfallen

This article presents a study of one of the key authors of the contemporary political philosophy and political theology of the XX-XXI centuries of Giorgio Agamben. The first part of the article gives short biographical information about Agamben. It also describes the place of Agamben on the field of modern philosophical discourse. In the second part, using the example of the classification "hedgehog-fox" classification we tried to reveal Agamben's method of thinking. Books of this author go beyond the same theme and have their own logic and their own vocabulary. Agamben tries to find special ways of looking at a large number of things and phenomena. The third part is an entry into the critically-political project "Homo Sacer". Homo Sacer is an attempt to prove the inability to divide zoe from bios, private and public spheres of life. Agamben analyzes sovereign power, which is closely linked to the religious structures of Western monotheism. Over the course of two decades, from 1995 to 2015, Giorgio Agamben published a series of nine books, not in sequence but conceived from the beginning as parts of a project sharing the title of its first volume, Homo sacer. These nine books have now been collected into a single volume edition in French (2016), English (2017), and Italian (2018), rendering visible the extent to which the project as a whole amounts to a radical revision of Western philosophy yet also enacted a painstaking self-revision in its course. With the entire trajectory of Homo sacer now evident in its completed arch and rearranged order, the symposium sets out to explore crucial concepts and issues at stake in the project and the new contours they reveal within the larger framework, while also interrogating the hidden spots in the work, unresolved points from which new researches will depart, as Agamben himself has incessantly done with his ever-growing meshwork of references and interlocutors. As he vowed in 1995, at the very outset of his endeavor: '… many of these notions demanded — in the urgency of catastrophe — to be revised without reserve.' The day-long symposium includes a morning workshop with Luca Di Blasi and others on the last text Agamben added to the single-volume edition, well after the individual publication of its last book Stasis — a fourteen-page 'Note on War, Play, and the Enemy', in which Agamben takes a newly measured distance from Carl Schmitt's understanding of the political as resting on the possibility of violent conflict. For this morning workshop, a registration is required, the text in question will be sent to registered participants. The day itself will consist of two panels with short presentations and time for discussion. The symposium will conclude with an evening event — in German — with Bettine Menke and Francesca Raimondi, a discussion revolving around the relationship between Agamben's project and its historical context, the urgencies and catastrophes he sought to address, as well as alternative modes ...
