Joga kot investicija v človeške vire ; Yoga as an investment in human resources

Danes živimo zelo hiter tempo življenja pri katerem pozabljamo nase in soljudi. Pozabljamo na potencial, ki ga skriva človek. Človek je najbolj prefinjen mehanizem, ki ga poznamo, vendar upravljanja le tega se še da naučiti. Uporabe se lahko naučimo skozi jogo. Joga je zelo širok pojem, zato smo ji posvetili celotno poglavje, kjer je podrobneje razložena. Tudi človeški viri so zelo kompleksna tematika. Vsi tipi organizacij se srečujejo z vprašanjem vodenja ljudi oziroma organizacije človeških virov. Na tem mestu smo videli priložnost povezave dveh kompleksnih tematik, ki sovpadata, saj se organizacije srečujejo z mnogimi vprašanji za katere joga ponuja rešitev. V nalogi na začetku opredelimo človeške vire, kjer obravnavamo neotipljivi kapital, človeka in znanje. Na to se posvetimo razlagi upravljanja s človeškimi viri, ki zajema načrtovanje, zaposlovanje in razvoj zaposlenih. V poglavju investicija v človeške vire predstavimo človeške vire kot kapital podjetja, medosebne odnose, dobro počutje zaposlenih, trajnostni razvoj in politiko podjetja. Tretje poglavje zajema opis joge, njeno psihologijo in filozofijo. Nadaljujemo z zgodovinsko razlago joge in njenih poti ter jogo pripeljemo vse v današnji čas, kjer prestavimo različice joge danes. Joga nam med drugim nudi pet podanih načel, ki so pravilna sprostitev, pravilni telesni položaji, pravilno dihanje, pravilna prehrana, meditacija in pozitivno razmišljanje. Primere prakse joge pa najdemo tudi v organizacijah, te smo podali, zraven opisa koristi joge v organizaciji. Na koncu smo naredili kvalitativno raziskavo s pomočjo intervjuja ter opisali sodelujoče organizacije pri raziskavi, podali smo izvedbo raziskave, predstavili rezultate, preverili hipoteze in zapisali ugotovitve. Investicija v človeške vire se nam zdi danes nujna za uspešno poslovanje organizacije. Investiranje v človeške vire mnoge organizacije še vedno smatrajo kot strošek, vendar na tam mestu lahko uporabimo rek »kdor ne investira, ne profilira«. Strošek ali investicija, se lahko vprašamo pri marsikaterem izdatku. Pomembno si je postaviti prioritete in se zavedati pomembnosti ljudi znotraj organizacije. V kolikor se zavedamo pomembnosti ljudi v organizaciji, bomo izdatek za človeške vire poimenovali investicija brez premisleka. Investicije so lahko različne, vendar mi priporočamo jogo, saj je tako široka in fleksibilna vsebina, ki se jo da aplicirati v katerokoli organizacijo. ; Today we live a very fast life and at this tempo we often forget ourselves and fellow humans. We are forgetting about the potential that lies within each and every one of us. Our body is the most sophisticated mechanism we know, but it's proper management is yet to be learned. Properly using our body can be learned thru yoga. Yoga is a very broad concept, so we have devoted an entire chapter to this topic, where it is explained in more detail. Human resources are also a very complex topic. All types of organizations face the issue of managing people or organizing human resources. At this point, we have seen the opportunity of linking two complex themes that coincide, as organizations are confronted with many issues for which yoga offers a solution. In the beginning of this research we define human resources, where we deal with an intangible capital, man power and knowledge. The next part is devoted to explananing the management of human resources, which covers the planning, employment and development of employees. In the chapter on investment in human resources, we present human resources as capital of a company, interpersonal relations, employee well-being, sustainable development and company policy. The third chapter covers the description of yoga, its psychology and philosophy. We continue with the historical overview of yoga and its paths, and continue to our present time, where we present different types of yoga used today. Yoga, among other things, offers us five principles, which are proper relaxation, proper bodily positions, proper breathing, proper diet, meditation and positive thinking. Examples of yoga practice can also be found in organizations, which we have outlined, besides describing the benefits of yoga in the organization. In the end, we made a thorough research with the help of an interview and described the participating organizations in the survey. We presented the results and data from our research, examined the hypotheses, and recorded the findings. We believe that investment in human resources is necessary for running a successful organization. Investing in human resources is still considered by many organizations as an expense, but in this case we can say no risk no reward. Cost or investment, is a debate in most of expenses. It is important to set priorities and be aware of the importance of people within the organization. If we are aware of the importance of people in the organization, we will call the expenditure for human resources an investment without consideration. Investments may be different, but we recommend yoga, as it is both a wide and flexible content that can be applied to any organization.

HEGEMONY, MORALITY AND EMOTIONS: POWER IN THE NEURAL ARCHITECTURE OF THE HUMAN MIND

The current debate on the crisis of democracy needs firm epistemological premises for the interpretation of election results and the manifestation of power as consent. In the article, a biopsychosocial model of hegemony is presented as a tool for the manifestation of power in the human mind. Hegemony as conceptualised by Gramsci is developed with the concept of power as both repression or spontaneous generation, as proposed by Foucault. The concept is developed with the paradigm of the embodied mind and insights from psychology and neuroscience about memory formation and meaning creation, stressing the role played by emotions in the process. ANALIZA RAZVOJA LJUDI V IZBRANIH DRŽAVAH ; ANALYSIS OF HUMAN RESOURCE DEVELOPMENT IN SELECTED COUNTRIES
Razvoj družbe je nujen in za dosego razvoja je treba največ pozornosti nameniti ravno razvoju ljudi. Če konceptu razvoja ljudi dodamo mednarodno perspektivo, dobimo celosten pogled na trenutno stanje v družbi. Ravno mednarodna perspektiva razvoja ljudi in celotna obravnava tematike sta botrovali k izvedbi analize razvoja ljudi v izbranih državah. Z metodo analize so bili pridobljeni vsi potrebni podatki, ki so celotno analizo zaokrožili. Prek analize pridobljenih podatkov so bile države razvrščene v tri skupine. Pri tem so vse razvite in tranzicijske države zajete v vzorec, v primeru razvijajočih se pa so bile države izbrane tako, da so zajeti predstavniki vseh delov Afrike, Azije ter Latinske in Karibske Amerike. Rezultati analize so precej nedvoumni. Izkazalo se je, da samo indeks razvoja ljudi in politična stabilnost države ne zagotavljata močne medsebojne povezave. Pomembno vlogo igrajo tudi pretresi iz začetka 90. let 20. stol. in t. i. svetovni policisti razvitih držav, kar vnaša določeno mero neravnovesja. Na drugi strani pa je bilo pričakovati padec moči povezanosti med razvojem ljudi in izobraževalnim indeksom od razvitih k razvijajočim se. Izkaže se, da je moč povezave največja v tranzicijskih državah, sledijo razvite in na koncu razvijajoče se države. Ugotovitve analize imajo širše učinke za družbeno okolje. Razvoj omogoča oblikovanje razvite družbe in uveljavitev človeku dostojnega življenja. Na osnovi tega bo v prihodnosti mogoče prilagoditi programe razvoja ljudi predvsem v tranzicijskih državah in ostalih delih sveta, ki so precej nestabilni in brez zunanje pomoči. Dejstvo pa je, da so nekatere razvijajoče se države lahko zgled kakovosti primarnih razvojnih programov. ; Development of the country is necessary and for achieving it the biggest focus must be on human development. If we add international perspective to human development, we get a fairly comprehensive view of the current situation in society. It was precisely the addition of an international perspective to the human development and the overall treatment of the topic that contributed to the design of the analysis of human resource development in selected countries. Using the analysis method all necessary data were obtained, which rounded the analysis into a whole. By analysing the data obtained, the countries were classified into three groups. In this, all developed and transition countries are included into the sample, and in the case of developing countries, the countries have been selected to include representatives of all parts of Africa, Asia, Latin America and the Caribbean. The results of the analysis are quite unequivocal. It turned out that only human development index and the political stability of the country do not guarantee a strong interconnection. Shouts from the early 90s of the 20th century and the role of so-called world-wide police officers of developed countries also play an important role, which introduces a certain amount of imbalance. On the other hand, the drop in the strength of the relation between the human development index and educational index from the developed to the developing was expected. It turns out that the power of connections is greatest in transition countries, followed by the developed and ultimately developing countries. The findings of the analysis have broader effects on the social environment. Development enables the creation of developed society the promotion of a decent man's life. On this basis, in the future, human development programs can be adjusted in the transitional countries and other parts of the world, which are rather unstable and without external assistance. It is true that some developing countries can serve as an example of the quality of primary development programs.

THE ROLE OF THE STATE IN THE PROTECTION OF BASIC HUMAN RIGHTS AND FREEDOMS

Abstract. The article addresses the question of the role of the state in the protection of human rights and freedoms. Like states, rights and freedoms are also created on the basis of social conventions, and any reference to the universal nature or natural character of rights and freedoms is only an ideological moment in the pursuit of political goals. The basic prerequisite for the protection of rights and freedoms is the establishment of organised coercion in the form of state power which brings under its authority the multitude of different interests and diverse ways of implementing justice. The conclusive findings show that for its successful introduction into the lives of individuals, the moral discourse of universal human rights and freedoms needs effective state authority that embeds these rights and freedoms into the foundations of the legitimacy of its own existence. STATE-CENTRISM IN INTERNATIONAL RELATIONS: EXAMINING THE CONSTRUCTION OF NONSTATE COLLECTIVE ACTORS IN HUMAN RIGHTS SCHOLARSHIP

This article addresses the deficiency in the area of human rights scholarship in International Relations (IR) by examining the theoretical advancements in IR theory that have led to the emergence of non-state collective actors as a pertinent research topic. It provides a review of the trajectory of the constructivist theoretical approach, which has brought major advancements in how international non-state actors are conceptualised in the human rights IR literature. This considers the limitations and implications of side-lining collective non-state actors within IR theory, arguing that expanding the theoretical understanding of how different collective actors are constituted and attributed with agency can enrich IR human rights scholarship. The article also proposes a potential way forward with respect to non-state collective actors in human rights in IR by identifying a research programme based on practiceoriented approaches to help broaden the ability of scholars to foster interdisciplinary conversations. Expanding along these lines would bridge the existing boundaries within scholarly and disciplinary contexts. INDICATORS OF HUMAN SOCIALITY IN SLOVENIA AND THE NETHERLANDS: EVIDENCE FROM EXPERIMENTS WITH STUDENTS

with volunteers designed to detect differences in behavioural characteristics among Slovenian, Dutch and
international students. Using eight standard tasks from
experimental economics, we investigate the differences
using experimental measures of solidarity, trust, cooperation, positive and negative reciprocity, competition,
honesty, and risk attitudes. No significant cohort effects
in any of the eight decisions are found when we compare the Slovenian and international cohorts. Still, when
comparing the Dutch and Slovenian cohorts, Dutch
students are found to exhibit lower levels of solidarity,
generosity and honesty. This points to differences in sociality between institutionally similar yet ideologically distant countries like Slovenia and the Netherlands.

PLATFORMISATION AND HUMAN RIGHTS: DOES USE OF THE SLOVENIAN #OSTANIZDRAV APP BYPASS PRIVACY RIGHTS?

Abstract. The article aims to explore the public's fear of data being misused when using European Covid-19 contact-tracing applications. The point of departure lies in considering the research question of whether the Covid-19 pandemic has influenced the platformisation of traditional institutions, i.e., whether the design of Europe's proximity-tracing applications mimic the dataintensive web services of commercial platforms, namely commercial APIs and their data policies, in order to bypass the right to privacy. We accordingly argue that is vital to address the public's fears of governmental and corporate dataveillance as well as data misuse while using such apps. The investigation entails of a critical analysis of the Exposure Notification System framework designed by Apple and Google (or GAEN) and the #OstaniZdrav application. The article rejects the justification of the public's fear of governmental dataveillance, while recognising the possibility of corporate data misuse. REGULATION OF THE USE OF FACIAL RECOGNITION TECHNOLOGY –LIMITATIONS AND CHALLENGES FROM A HUMAN RIGHTS PERSPECTIVE

Abstract. The aim of this article to identify and highlight limitations and challenges of the legal regulation of the use of facial recognition technology for surveillance purposes. The UN and the EU are seeking to develop robust human rights safeguards to regulate such practices, whereas civil society calls for a complete ban on it use for mass surveillance. The type of this technology makes it difficult to impose legal and democratic control over its lawful use and to prevent abuse. We conclude that the regulation of this area, no matter how restrictive, amounts to tacit approval of the mass use of this type of technology that opens the door to various ways of abusing human rights and freedoms, and whose justification from the perspective of the public interest is questionable.

Glavna obravnava v upravnem sporu kot človekova pravica ; The main hearing in an administrative dispute as a human right
Magistrsko diplomsko delo z naslovom Glavna obravnava v upravnem sporu kot človekova pravica celovito obravnava vprašanje (ne)izvedbe glavne obravnave v upravnem sporu. Mednarodni in slovenski predpisi predvidevajo javne sodne postopke z neposrednim ustnim obravnavanjem zadev. Prvi odstavek 6. člena Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin določa, da je javna obravnava sestavni del pravice do poštenega sojenja. Ustava Republike Slovenije posredno ureja glavno obravnavo v upravnem sporu, in sicer zlasti v 22. členu (enako varstvo pravic), 23. členu (pravica do sodnega varstva) in 24. členu (javnost sojenja). Glavno obravnavo kot zakonsko materijo podrobneje urejajo določbe Zakona o upravnem sporu in Zakona o pravdnem postopku. Izhajajoč iz ugotovitev Evropskega sodišča za človekove pravice, Ustavnega sodišča Republike Slovenije in Vrhovnega sodišča Republike Slovenije v magistrskem diplomskem delu zagovarjam dosledno izvedbo glavne obravnave, predvsem v primeru spornega dejanskega stanja in ko stranka njeno izvedbo izrecno zahteva. Vrhovno sodišče Republike Slovenije in Ustavno sodišče Republike Slovenije sta v novejši sodni praksi zavzela enotno stališče, da ima glavna obravnava v upravnem sporu enako naravo in smisel kot glavna obravnava v katerem koli drugem sodnem postopku. Ustavno sodišče Republike Slovenije je pravico do glavne obravnave v upravnem sporu opredelilo kot samostojno človekovo pravico, ki jo zagotavlja 22. člen Ustave Republike Slovenije. Pravica ni absolutna, zato morajo biti posegi vanjo zakonsko določeni ter prestati ustavna testa legitimnosti (tretji odstavek 15. člena Ustave Republike Slovenije) in sorazmernosti (2. člen Ustave Republike Slovenije). ; The master's thesis titled The main hearing in an administrative dispute as a human right comprehensively deals with issues regarding decision-making in an administrative dispute. International and Slovenian legal acts envisage public legal procedures with direct oral proceedings. The right to an oral hearing is an integral part of the right to a fair trial, as guaranteed by Article 6 of the European Convention on Human Rights. The Constitution of the Republic of Slovenia indirectly regulates the right to a main hearing in an administrative dispute, especially in Article 22 (Equal Protection of Rights), Article 23 (Right to Judicial Protection) and Article 24 (Public Nature of Court Proceedings). The right to a main hearing is specified in the Administrative Dispute Act and the Contentious Civil Procedure Act. Building on the findings of the European Court of Human Rights, the Constitutional and the Supreme Court of the Republic of Slovenia, the master's thesis advocates for the consistent execution of the main hearing, particularly in cases where facts are being disputed and when a party explicitly demands it. The Constitutional and the Supreme Court of the Republic of Slovenia agreed that the main hearing possesses the same nature and meaning in an administrative dispute as it does in any other judicial proceeding. The Constitutional Court of the Republic of Slovenia has declared the right to a main hearing in an administrative dispute as an independent human right, which is guaranteed by Article 22 of the Constitution. As the right is not absolute, the absence of the main hearing is only permissible in duly justified cases prescribed by law and when the Constitutional tests of legitimacy (paragraph 3 of Article 15 of the Constitution) and proportionality (Article 2 of the Constitution) are passed.
