Sen. Bernie Sanders (I-Vt.) took another step in his effort to place conditions on future aid to Israel on Thursday, by introducing legislation that could force the State Department to release a report detailing potential human rights violations during the ongoing war on Gaza.The resolution was made pursuant to Section 502B(c) of the Foreign Assistance Act, meaning that it is privileged and that Sanders can force a vote on it 10 days after it is introduced in committee. Sanders has been one of the most vocal supporters of conditioning aid to Israel. In November, he wrote in a New York Times op-ed that "[t]he blank check approach must end," and that the United States "must make clear that while we are friends of Israel, there are conditions to that friendship and that we cannot be complicit in actions that violate international law and our own sense of decency."He later voted against President Joe Biden's $110 billion emergency supplemental because, he said, it included $10.1 billion with "no strings attached" for the Netanyahu government's "inhumane" war against Gaza. He and a number of Senate Democrats also sent an open letter to Biden last week calling for stronger oversight of the U.S. weapons being sent to Israel. Sanders's latest effort, if approved by the Senate, would force the State Department to release a report containing "all available credible information concerning alleged violations of internationally recognized human rights by the Government of Israel" and the steps Washington has taken to "promote respect for and observance of human rights as part of the Government of Israel's activities." Sanders is also asking for evidence that no Israeli security forces that have received American assistance are guilty of committing any human rights violations. According to Section 502B, if the State Department does not produce the report within 30 days of passage, the target country does not receive any security assistance.A report from Amnesty International published earlier this month found that U.S-made munitions were used in two unlawful Israeli strikes in Gaza in October. "The organization found distinctive fragments of the munition in the rubble of destroyed homes in central Gaza following two strikes that killed a total of 43 civilians – 19 children, 14 women and 10 men," reads the report. "In both cases, survivors told Amnesty International there had been no warning of an imminent strike."This week, the Biden administration did offer some pushback on weapons sales to Israel, when it delayed the 20,000 assault rifles over fears of settler violence in the West Bank. Reports say that the administration is seeking stronger assurances from the Israeli government that the weapons will not be given to settlers. Section 502B(c) is a rarely used national security tool. It has not been successfully employed to get a report from the State Department since 1976, and it was most recently tried earlier this year when Sens. Chris Murphy (D-Conn.) and Mike Lee (R-Utah) introduced a resolution that would have investigated Saudi Arabia's human rights violations. The resolution has not yet been brought to a vote, though Murphy and Lee could in theory still force one until the end of this congressional session. "Senator Sanders' resolution marks a historic invocation of Section 502B, a potent but underused human rights oversight tool," John Ramming Chappell, a fellow at the Center for Civilians in Conflict, said in a statement. "The resolution provides a pathway to meaningful scrutiny of U.S. security assistance to Israel as U.S. weapons contribute to devastating harm to civilians in Gaza."The Biden administration has maintained that it is not tracking Israel's compliance with the laws of war in real time, but, according to a Politico report on Thursday evening, the U.S. has already begun to collect data and intelligence that could help make these determinations."State Department officials are also collecting reports of potential Israeli violations through a system unveiled in August called the Civilian Harm Incident Response Guidance, or CHIRG, according to Josh Paul, who quit the department over concerns about its approach to the war," reports Politico. "Paul said some officials within the department's Bureau of Political-Military Affairs have asked State's legal wing to 'provide information about their potential international law exposure as a result of approving these sales.'"A senior American official told the Washington Post last week that the U.S. government was unable to make these judgements as events happen because they lacked access to the necessary Israeli intelligence. But Brian Finucane, a former state department lawyer, told Politico that this is not the case. "It's really disingenuous for people in the government to claim that it's too hard or we can't do this in real time," Finucane, now a senior adviser at the International Crisis Group, said. "It's simply a choice. They choose not to do this." If the Senate were to approve Sanders' resolution — which seems unlikely given the widespread support for Israel in Congress — and the State Department were to produce a report, Congress would then have the opportunity to adopt a resolution that would restrict or end security assistance to Israel. Such legislation would have to go through both chambers of Congress and be signed by the president.

In its military campaign in Gaza, Israel faces a seemingly endless list of alleged human rights violations. International monitors argue the Israel Defense Forces have starved Gazans, targeted journalists attempting to cover the carnage, tortured detainees, and attacked hospitals full of wounded civilians.
The U.S. — a passionate backer of civilian protections in Ukraine — has struggled to find the right way to address these claims while still standing by its long-time partner. The bombing has been "indiscriminate," says President Joe Biden, but perhaps it will improve tomorrow. Killing more than 10,000 women and children in two months is not "genocide," argues White House spokesperson John Kirby, but Hamas' brutal Oct. 7 attacks were.
If human rights are fundamentally a matter of world consensus, then what does it tell us that the United States threatens to cast a second veto against a United Nations Security Council resolution begging for a humanitarian suspension of fighting? What does it mean when a supposed champion of human rights seems to jettison them when it becomes inconvenient? For that matter, why should Israel care about human rights when it perceives its fight as existential?
Kenneth Roth has a unique perspective on these questions. Roth, considered by many to be a dean of the human rights movement, spent nearly three decades as the executive director of Human Rights Watch before stepping down last year to become a visiting professor at Princeton University. Under his leadership, HRW drew flak for, among other things, declaring Israel's occupation of Palestinian territories to be apartheid, all while documenting in meticulous detail abuses committed by Palestinian groups, including Hamas.
RS spoke with Roth to get his thoughts on human rights at a time of crisis. The following conversation has been edited for length and clarity.
RS: How would you rate the Biden administration's handling of the Gaza crisis from a human rights perspective?
Roth: The Biden administration has been far too deferential to the Israeli Government, despite the pretty clear commission of war crimes in Gaza. And while the administration has pushed to ameliorate some of those war crimes — by pressing for humanitarian access, by urging greater attention to avoiding civilian casualties — that rhetorical push has not been backed by the use of the leverage that the administration has that might have really put pressure on the Israeli government to stop, whether that would be withholding or conditioning ongoing arm sales or military assistance, or even allowing a Security Council resolution to go forward.RS: What would a better approach look like?Roth: The initial problem was that Biden pretty unconditionally wrapped himself in the Israeli government's response to the horrible October 7 attacks by Hamas. If you look at his initial comments, while there were caveats written in about the need to respect humanitarian law, there was no emotional punch behind them. It was pretty clear that Biden simply stood with Israel and was giving it a green light to proceed with its military response to Hamas without much effort, at least during the first few weeks, to ensure that that response really did comply with humanitarian law. So I think the Israeli government got the message that the references to humanitarian law were necessary for certain audiences, but that the administration's heart was not in them.
RS: Would a more forceful form of messaging at the start have led to different results?
Roth: Obviously, it's hard to know the counterfactual. But the U.S. government, which has the greatest leverage of any external actor, didn't really use that leverage to ensure that its periodic rhetorical commitment to the need to respect humanitarian law was matched by its much more forceful embrace of the Israeli military response to Hamas.
RS: I've seen some reporting that the State Department has done internal inquiries as to whether U.S. officials could be legally complicit if Israel is found to have committed war crimes in Gaza. Do you have any thoughts on that question?
Roth: Well, they could be. Biden's references to the Israeli military conducting indiscriminate bombing were clearly not just a verbal slip. It probably reflected the internal conversations that the administration has. The second one even seems to have been somewhat deliberate. And the significance of that is that indiscriminate bombardment is a war crime. As any administration lawyer would know, continuing to provide weapons to a force that is engaged in war crimes can make the sender guilty of aiding and abetting war crimes.
That is not some crazy, wacko theory. That was the basis on which former Liberian President Charles Taylor was convicted by an internationally backed tribunal, the so-called Special Court for Sierra Leone, for providing weapons to the Sierra Leonean rebel group known as the Revolutionary United Front, a group that was notorious for chopping off the limbs of its victims. Because Taylor kept providing arms in return for the RUF's diamonds while he knew the RUF was committing these war crimes, this internationally-backed tribunal found him guilty of aiding and abetting, convicted him, and sentenced him to 50 years in prison, which he is currently serving in a British prison.
RS: My next question is a little tricky, but I'm curious how you approach it. Israel claims that this war is a fight for its very survival. Why should a country that views itself as being in that position care about respecting human rights?Roth: Well, I think the question is why should it care about adhering to international humanitarian law and protocols. It's worth noting that humanitarian law was not drafted by a bunch of human rights activists and peaceniks. This was drafted by the world's leading militaries. It was designed for war, for situations where governments often feel that they are existentially at risk, and these were the limits that the world's leading militaries imposed on themselves. Israel has signed on to these standards, and it claims to abide by them. It has many capable lawyers who could be applying them. It just isn't applying them.
It probably requires a certain psychological analysis to figure out why, but some of the signals being sent from the top indicate a willingness to disregard the requirements of humanitarian law. When you have Defense Minister [Yoav] Galant referring to the residents of Gaza as "human animals," when you have [Prime Minister Benjamin] Netanyahu invoking the biblical story of Amalek in which there's a divine injunction to not spare the men, women, children, or animals, these are not-so-subtle signals that the top political and military leadership in Israel doesn't care that much about civilian casualties. This has seemed to have manifested itself in the indiscriminate and disproportionate attacks that the Israeli military has carried out in Gaza.
RS: It seems to me that focusing on war crimes or potential war crimes can sometimes lead to really bad policy outcomes. In this case, Israel is really spotlighting Hamas' alleged war crimes. You think back to the war in Iraq, where there was a lot of highlighting of Saddam's alleged war crimes. How can advocacy for human rights avoid supporting unfettered militarism?
Roth: First, I think it's important to note that war crimes by one side do not justify war crimes by the other. If a warring party could cite the other side's war crimes, you would quickly have no more Geneva Conventions because allegations of war crimes are often made in the passions of conflict. The fact that some people have committed war crimes — in this case, both sides — doesn't justify that others resort to criminal conduct. Now, in terms of military action, few people contest that Israel had every right to respond to Hamas' military attack. It was an extraordinarily lethal military attack. It was ruthless, with widespread murder, rape, abduction, and indiscriminate bombardment. So with an attack of that sort, no one should be surprised that the Israeli government responds. The only real question was, will it respond consistent with humanitarian law? Or would it flout that law?RS: What does all this mean — especially the fact of the U.S. seemingly taking a step back in advocacy for the protection of human rights — what does all this mean for the state of human rights today?
Roth: It is harmful because the U.S. government is such a powerful voice, and when it does seem to make an exception in its human rights advocacy for a close ally like Israel, it discredits the U.S. as a voice for human rights around the world. Now, I should say this is not the only instance of inconsistency on the part of Washington. We're seeing it as well as the Biden administration tries to build alliances to oppose Russia's invasion of Ukraine or to contain China. So while the administration has spoken numerous times about its fundamental commitment to human rights, it's been a very inconsistent commitment. And that inconsistency is probably most visible in the Middle East, which has been essentially a black hole in the administration's human rights policy. It's very difficult to be so permissive of human rights violations in one region of the world and have a whole lot of credibility on human rights in other parts of the world.
This means that one of those powerful voices we have has weakened itself. It's not the first time that has happened. Under [former President Donald] Trump, the U.S. essentially abandoned any pretense of enforcing human rights. Prior administrations have had comparable inconsistencies. The U.S. still has been able to be a useful voice for human rights, despite these inconsistencies, in some cases, but it is a much weaker voice than if it had really been principled and consistent.
RS: How do you see the future of the push to get states to protect human rights? Are we in a moment of crisis that galvanizes change?
Roth: If you look at the various efforts to uphold human rights, they've been quite vigorous in certain cases. There has been a very strong response to Russian war crimes in Ukraine, complete with multiple General Assembly resolutions, the Human Rights Council standing up a commission of inquiry, the International Criminal Court launching an immediate investigation and actually charging Putin and one of his aides with war crimes.
A place where it's been weaker has been, say, China's crimes against humanity against the Uyghurs and other Turkic Muslims in Xinjiang, where we came within two votes of putting on the agenda a discussion of then-UN High Commissioner for Human Rights Michelle Bachelet's very strong report on what she called possible crimes against humanity. But we didn't even get that agenda item, so that's a place where the world has been much weaker.
But there's been greater mobilization, greater willingness to speak out on a range of other situations, whether that be Myanmar or Iran, Saudi abuses in Yemen for a time, Sudan, Ethiopia for a time, Venezuela, Nicaragua. So the idea that because there's this black hole in U.S. human rights policy, therefore nothing can get done, that's just not true. A lot gets done, but the defense of human rights is weaker because the U.S. has been an inconsistent supporter of the effort.

Today, Afghanistan is a nightmarish place for many Afghans, marked by a lack of rights and opportunities. It's crucial to recognize this reality. However, it's also important to acknowledge that numerous predictions from Washington did not materialize as expected. For all the admonishments of the Biden administration, Afghanistan has not become a gift for China or Russia, or a hotbed of transnational terrorism.President Biden faced relentless criticism for the withdrawal, decried as squandering "20 years of blood and sacrifice" by Republican Senator Jim Risch and branded "fatally flawed" by Democratic Senator Bob Menendez. Former Secretary of Defense Leon Panetta, who oversaw the end of the U.S. surge in Afghanistan during President Obama's tenure, likened the evacuation to the infamous Bay of Pigs fiasco, even before the tragic loss of 13 U.S. service members and at least 170 Afghans in an ISIS attack. Meanwhile, former Secretary of State Mike Pompeo, who less than one year earlier had proudly stood for a photo op with the Taliban's chief negotiator, after agreeing to withdraw U.S. troops, told Fox News that the "Biden administration has just failed in its execution of its own plan." In April, the Wall Street Journal's Editorial Board partly attributed Russia's invasion of Ukraine to "U.S. surrender in Afghanistan" and during a Congressional hearing in July, Congressman Michael McCaul labeled the withdrawal "a mistake of epic proportions." Failure is, indeed, an orphan.One of the most frequently cited reasons for why the U.S. military had to remain in Afghanistan was rooted in counterterrorism efforts. Indeed, fighting terrorism was the reason for the authorization for the use of military force that allowed U.S. troops to be deployed to Afghanistan in the first place. President Biden drew criticism from certain pundits when he asserted on August 16, 2021, that "Our only vital national interest in Afghanistan remains today what it has always been: preventing a terrorist attack on [sic] American homeland." He emphasized that the original mission was, in fact, a response to a terrorist attack and had a primary focus on counterterrorism. Some pundits might find this fact inconvenient, especially those who have come to believe that our presence in Afghanistan was primarily about nation-building, rather than acknowledging that nation-building itself was an ill-conceived strategy within the context of the War on Terror. In the lead-up to the withdrawal, the notion of over-the-horizon counterterrorism capabilities was often ridiculed as ineffective. During the fall of 2021, the Pentagon assessed that the Islamic State-Khorasan Province (ISKP), an ISIS offshoot in Afghanistan, could potentially launch an attack on the U.S. within as little as 6 months. Yet, nearly two years later, no ISKP attack originating from Afghanistan has targeted U.S. soil. Furthermore, senior analysts at the National Counterterrorism Center (NCTC) recently evaluated that the group relies on "inexperienced operatives in Europe" to carry out attacks abroad. In other words, the next generation of 9/11 hijackers is not being trained in Afghanistan. The Biden administration showcased its ability to secure significant over-the-horizon victories against terrorists, such as when a U.S. drone killed al-Qaeda chief Ayman al-Zawahiri in a Kabul apartment on July 31, 2022. As of last March, Nicholas Rasmussen, the Department of Homeland Security's counterterrorism coordinator, viewed the likelihood of a 9/11-style attack as "almost inconceivable." The world of today is different than on the morning of September 11, 2001. Back then, Afghans had extremely limited communication with the outside world. In contrast, today, over 60 percent of adults own a cell phone, with more than 80 percent having access to one. This trend holds true for other once-isolated parts of the world as well. This connectivity will pose challenges to the Taliban's ability to enforce their draconian restrictions over the long-run. It has also changed the way terrorists operate. In the realm of terrorism, the world is indeed flat. Extremist ideologies can be disseminated, and terrorists can recruit overseas operatives to inflict harm. But this may not be such a big win for terrorist groups like ISKP. While their capacity for recruitment is more substantial than in the past, their ability to train and direct quality recruits without interference is actually diminished. Meanwhile, the capacity of potential target nations to intercept such plots is stronger than ever before. Instead of participating in a global campaign of terrorist whack-a-mole, it is our domestic defenses that are best positioned to protect the homeland. This isn't meant to downplay the potential of ungoverned spaces to serve as breeding grounds for adept and motivated terrorists. However, concerning the case of Afghanistan, NCTC analysts concluded that the Taliban's activities have "prevented the branch [ISKP] from seizing territory that it could use to draw in and train foreign recruits for more sophisticated attacks."While it's true that terrorism can be managed and nation-building wasn't the purpose of going to war, it was still shocking for many Americans to witness the swift collapse of a government that so many U.S. lives, tax dollars, and lives of our Afghan partners had contributed to building. One reason for the astonishment shared by lawmakers, media, and the American public over the evacuation debacle, the vanishing of Afghan security forces, and the hasty departure of the Ghani administration, stems from a steady flow of falsehoods regarding the war. Rather than a deliberate effort of intentional deceit, it was more of a collective exercise in self-deception, omission, and hopeful exaggeration. As the U.S. war in Afghanistan trudged onward, a carefully curated liturgy of talking points was repeated in Washington. Our leaders were well aware that Afghanistan was an archipelago of cut-off cities and forward operating bases, while the Taliban dominated the countryside, roads, and the night. It was no secret that Ashraf Ghani was surrounded by a circle of sycophantic advisors. The economy was sustained by a continuous flow of aid and war-related industries. Yet, speaking candidly about this was rare until after the Afghan government collapsed.A cognitive dissonance made it acceptable for U.S. lawmakers, foreign elites, military-aged men who had fled their conflict-ridden countries, and even human rights organizations to not only call for the perpetual deployment of American soldiers but to claim we owed such a commitment. Of course, the U.S. military was more than enthusiastic to oblige. And for soldiers, there is an unrelenting desire and pressure to deploy. I too volunteered to deploy. However, the enthusiasm of young warfighters shouldn't grant a blank check for putting them in harm's way.Since the U.S. withdrawal, unsettling truths emerged. Although tens of thousands of Afghan soldiers made the ultimate sacrifice, when push came to shove — even before the Americans' departure — Afghan forces fell to the Taliban. Their supplies ran out and corrupt leaders in Kabul left them to die or surrender. The strongman warlords, elevated by Washington and summoned by Ashraf Ghani to save the republic, fled to neighboring countries. Over the years, the Taliban were dismissed as a proxy of Pakistan, disconnected from Afghan society, yet, it was the Afghan government, created through an international conference in Bonn, Germany, and supported with billions of U.S. aid, that failed to inspire Afghans to fight for its survival at a crucial moment. Many observers, myself included, were confident that Afghans would fiercely resist the Taliban and the country would rapidly descend into civil war. The country has instead fallen into a haunting silence.One prediction that has come true is the dire situation for women under the Taliban's rule that can only be described as gender apartheid. They have progressively restricted girls'and women's right to education, closed gathering places and livelihoods like beauty parlors, and even banned women from a national park. Their actions seem more driven by an obsession with control of every aspect of women's lives than religious doctrine. Additionally, the Taliban have stifled dissent and used torture against rivals. We must confront these harsh realities and take meaningful actions, but we must also avoid making promises we cannot fulfill, both for the sake of Afghans and our own credibility.Today, Afghanistan is not at war for the first time in twenty years, with violent deaths decreasing from well over 20,000 per year in the years leading up to the U.S. withdrawal to under 2,000 last year. The country hasn't turned into a narco-state. The Taliban also haven't abandoned their extremist beliefs, disavowed al-Qaeda, or restrained the Pakistani Taliban. However, their current focus seems to be inward on Afghanistan. The Afghan economy is struggling, partly due to Taliban mismanagement, though it doesn't appear to be much worse than the previous government at management, and their corruption seems to be less. Their cruelty, however, seems unfailing.It's worth reflecting on why so many of our predictions were inaccurate. The U.S. facilitated Afghanistan's development, but it also prolonged the war. Now, Taliban rule and the isolation it creates has plunged Afghans into deeper poverty and created a nightmare for women, a bargain from hell, created by Washington and its partners in Kabul, but that ultimately can only be resolved by Afghans themselves.

Chris Fomunyoh: I'm Chris Fomunyoh, senior associate and regional director for Central and West Africa at the National Democratic Institute for International Affairs, NDI. Welcome to this edition of DemWorks.
Again we're joined by Ambassador Johnnie Carson, a proud member of the board of directors of The National Democratic Institute, NDI with a 37 year career in the U.S. Foreign Service focus on Africa. In our previous episode, you spoke about the risk of back sliding. So for this episode, we will focus on the steps that can be taken to strengthen democracy in Africa.
I'd like us to pivot a little bit to the Sahel because in Tanzania we see the back sliding that's coming from political actors themselves, but there's something happening in the Sahel, which is a region in which we see a lot of political commitment to democratic governance, whether it's from the leaders and activists in Niger Republic, in Burkina Faso and in Mali, but at the same time these countries are coming under tremendous pressure from violent extremists who are coming across the desert and destabilizing what would be an emerging democracy and what concerns do you have and how do you think organizations like NDI, like USIP and others that have the self-power expertise, so to speak can contribute to the efforts to counter violent extremism like Sahel and also the whole of Africa?
JC: Chris you're absolutely right and we should all be concerned about outside forces that can come in and destabilize a country, its politics, its economy and its society and across the Sahel we in fact see this happening. The challenges to stability, to democracy to holding free and transparent and creditable elections and having democratic systems that work, are not only challenged by sometimes authoritarian leaders seeking to maintain power and control, we also can see this emerging as a result of exogenous forces coming in from outside, and here we see non-state actors undermining stability across the Sahel, which is creating tension for democracies and tensions for states.
I think one of the things that is absolutely critical in addressing the problems with the Sahel is for government to reconnect with their citizens, to put in place the kinds of services that citizens are looking for and are demanding and expecting. They need to be responsive to the needs that they, citizens believe are not there and they have to have these connections in order to build up resilience, to build up strength against the ideologies and to the negative forces that are brought in by extremist groups.
It is extremists groups across the Sahel are taking advantage of the absence of good services and good connectivity between government and citizens and one of the things that must accompany the security response is in fact a development and government response. Security alone cannot end the problems in the Sahel. It's an important ingredient but the most important ingredient is government going in and establishing responsible connections, providing services, education, healthcare, sanitation, water cattle feeding stations and services that citizens require and are being deprived of.
So one of the things that must be hand in hand and be out front is not the military response and the security response but the governance response, the social service response and if that is absent, the security response will be deficient and will not work.
CF: In fact, I'm so thankful you say that, because I know that you and other members of our board, Secretary Albright, in particular the chair of our board, you've been emphasizing reinforcing this message about democracy and development component as part of the toolkit in conquering violent extremism and in fact, that's the approach that NDI is taking to its work in the Sahel because we currently have ongoing programs in Niger, Mali and Burkina Faso, and our focus, the main focus of that piece of work is on people, processes and the politics and trying to create platforms where governments can reconnect with citizens at a grassroots level.
So in a number of cases we've set up platforms where civil society with legislatures and members of the executive branch, including representatives of the security services get together regularly to figure out what the challenges are in various communities and how to foster inter-communal dialogue and better relationships between the security services and the populations that they seek to serve, because you may remember there was a UN study that said that in many of the cases where violent extremism persist, that 70% of the people who join extremist organizations, are reacting to poor performance by security services and you have paid a lot of attention to Nigerian and the whole Boko Haram phenomenon.
I don't know how this would fit into our conversation with regards to the Sahel as well.
JC: I think it also very pertinent for Nigeria, and I too have seen studies of some very distinguished organizations, Mercy Corps and others that talk about why people are recruited and indeed, the authoritarian sometimes brutal nature of security forces towards communities that they should be protecting drives individuals away from the government and into the hands of Boko Haram.
Even the origin of the current violence in Northern Nigeria has its origins in the brutal extrajudicial killing of Boko Haram's first leader in 2009. His apprehension, his questioning, his interrogation, torture and mistreatment were all recorded on someone's cellphone and became widely seen throughout the country and throughout the north. Two years later, after that event in 2009 we saw and upsurge in 2011 and the activities of Boko Haram and indeed people continued to say that the brutal nature in which the security forces sought to root out Boko Haram, in fact generated more recruits for Boko Haram than it did for support for the government's efforts.
It is absolutely critical, it's absolutely critical that security forces recognize that they have a responsibility to protect the civil liberties and the human rights of the citizens of the state that they are protecting and that the way they treat the individuals in areas that they go into, may have an impact on their ability to ultimately win the conflict, but one thinks of Nigeria and particularly of the North East and there again weak institutions of corruption of lack of social services are all playing a major part in why the conflict in that region continues.
In the north east of Nigeria particularly and the three most affected states, Borno, Yobe and Adamawa. Those three states have the lowest social indicators of any of Nigeria's 36 states, less access to education, to healthcare, to water resources and to jobs and access and this all plays out as well. Governments needs to be responsive to their citizens and while a security response is important, governance and providing social services and the needs to citizens to build resilience is critical as well.
CF: This seems like a good place to take a short break. For well over 35 years NDI has been honored to work side by side with courageous and committed pro-democracy activists and leaders around the world to help contribute to develop the institutions practices and skills necessary for democracy's success.
I realize it's many countries to cover but in the few minutes that are left, I just see if you have any parting words for four countries that we haven't really focused that much on and those are Ethiopia, Kenya, The Democratic Republic of Congo and we'll exit with Cameroon. What are your thoughts?
JC: My thoughts on Ethiopia. It is absolutely essential that those of us who support a democracy and democratic progress lend all of our efforts to those of the Ethiopian government to ensure that the democratic experiment that is underway is successful. Prime Minister Abiy won the Nobel Prize for bringing about peace with Eritrea but the more important thing is that we, outside step up our effort to help him ensure that his legislative elections, this year, are successful and that we do what we can to strengthen his country's democratic progress.
He has appointed and outstanding leader, Birtukan, former opposition leader, spent many years in jail as his country's election commissioner. We need on the outside to provide the kind of technical and financial and advocacy support that she might need to put in place the architecture for running the country's elections. It will in fact be the first real serious elections in that country since the collapse of the Derg in the early 1990s. So it's important that we help do this.
Ethiopia is Africa's second most populous country behind Nigeria and it's important that we help democracy there. It's also a key and strategic state in the region bordering a number of other countries that will look to the success of what happens here. So we need to support.
Kenya, will have elections next year. It is important that there be a continuation in the improvement of the country's electoral agencies. The shadow of the flawed and failed and controversial and violent elections of 2007 and 2008 continue to be a shadow. The controversies associated with the last elections and court decisions there continue to hang over. It is important to continue to support civil society, support the electoral commission and work with the Kenyan government to ensure an outcome.
It appears very clearly that President Kenyatta wants to leave a positive legacy of progress, economically, politically and electorally. This will be a challenge but we should support the process moving forward. The features are still there.
CF: In fact, I should say before end up with the last two countries that for listeners, Ethiopia has got a parliamentary system of government. That's why the parliamentary elections are extremely important, the national elections for Ethiopia and also with regards to Kenya, as you say, President Uhuru Kenyatta would like to leave a good legacy. He's coming to the end of his second term and NDI working with partners on the continent has been very strong on the issue constitutionalism, respect for rule of law. In fact, we had a continent wide conference in Niamey, Niger Republic last October on the whole question of presidential term limits and we'll be having a second conference in Botswana in June to discuss term limits with former African heads of states and various other partners on the continent.
Just to say that, as leaders relinquish power when their terms come to an end, they help consolidate and strengthen democratic practices and institutions. So, with the two remaining countries-
JC: I applaud President Kenyatta for saying very early on that he would adhere to the constitution, he would serve two terms and step down. This is an important message for the most important country in East Africa, especially looking at the neighboring states, particularly Burundi, Rwanda and Uganda where leaders there have found ways to extend themselves in office. He recognizes the importance of transition at the top and allowing the citizens of the country to select new leadership on a constitutional basis rather than trying to alter the constitution to eliminate term limits, age limits and perpetuate themselves in power.
So I hope others in the region are in fact looking at Kenya's model. One jumps across to West Africa and looks at President Paul Biya who's been in power for three decades, plus shows no desire whatsoever to leave office. Here is a man who has lost touch with his citizens and the communities of his country and because he has lost touch with his citizens, because there have been structural deficiencies and weaknesses and the institutions that he is responsible for, we now see a country that is suffering from three or four major political crisis, crisis with the English speaking portion of this country in the south west, the emergence of Boko Haram and radicalism across the border from Nigeria in the north west and problems of herders and farmers driven by drought and climate conditions.
President Biya has lost touch with the needs of his citizens and his government has not been responsive to anyone but himself and a small political elite. I think it is important for the international community to point out the failures and the flaws of his governance, the corruption that underpins it and to support those internally who are pushing for a constitution and political policies that fundamentally change the nature and structure of society, political architecture in society.
CF: You're so right, because that's one country that it's got tremendous potential but that it's not pulling its weight at all and because of its strategic location, invariably weakens other countries in the central Africa sub region, as well as in West Africa too and it's now taking full advantage of what could be real opportunities to improve the wellbeing of its citizens.

And let's end with the country right in the heart of the continent, The Democratic Republic of Congo. I was in Kinshasa in October and met with political leaders and opinion leaders across the board, civil society, religious leaders who are very powerful in the Congo, very influential and I came away, I should say, a little more optimistic than I was going in. I was quite apprehensive given what has transpired in the 2018 presidential elections but after talking to the Congolese, I got a sense that a genuine attachment to reform.
Everybody wants some reforms of the political process or the electoral process and the key question is whether they are going to be able to set aside their personal agendas and actually get together to help this country, which has got tremendous resources and tremendous potential get back on its feet. I was very impressed by the fact that most of the leaders in Congo are pretty young. I know that you and I have talked about Congo for many, many times and when you were still in the administration you had to deal with some of their crisis.
I don't know what you take is on the present leadership and the present challenges but also the opportunities that present themselves in the Democratic Republic of Congo.
JC: Let me say that The Democratic Republic of the Congo has more unrealized potential than any other large state in Africa and that potential has continued to be in held in check and not realized because of the poor nature of the politics that have occurred there since the 1960s.
The 2018 elections were deeply flawed and irregular and not representative, I think, of the vote of the people. The one thing that one can say about the process that it did lead to President Kabila stepping down and a new younger president, Tshisekedi coming into power. There was immediately after the election a strong feeling that Tshisekedi was going to be instrument of Kabila going forward in that his leadership and his authority and his ability to do things would be substantially constrained. Tshisekedi has shown some degree of independence.
It is again important to recognize that there is little we can do to rerun that election or to reverse it but there is something that all of us can do going forward, and that to put pressure on President Tshisekedi to ensure that the electoral commission is strengthened, it has more independence, more technical capacity and more of an ability to deliver a more responsible, fair and transparent election going forward.
It is also important that he continue the fight against corruption, that he begin to put in place the kind of economic reforms that are going to unleash the potential of the Congo and to provide the people, The Democratic Republic of the Congo an opportunity to realize so many of the opportunities that they have been denied in the past. He has shown more independence than I thought but it is important that he not stop, that he continue to move forward, that he open up political space and continue to open it up for civil society, for the opposition, for the media, that he not constrain but unleash the country's potential and that he continue to show both in reality and fact his independence away from Kabila and those who were around him in the past.
He will be judged on the next four years very keenly, but it's important that the institutions of democracy to the extent that we can help civil society strengthen them, that they be nurtured and pushed forward. Elections and democracy...Democracy doesn't depend essentially, solely on elections. It is institutions that must be strengthened and we can help the DRC and civil society move those forward.
Again, working effectively with religions groups, Catholic Church, a very powerful instrument, working with women's groups, with working youth groups across the DRC and working with an emerging entrepreneurial class of young Congolese as well. We have to nurture and strengthen and push them forward. These next elections will be able to tell us whether there's been progress. President Tshisekedi needs to continue to move forward.
CF: Thank you very much Ambassador Johnnie Carson. It's really been an honor to have you do this tutor for us on the entire continent. Of course there still would always be ground to cover. As you were speaking, I thought about what late President John F Kennedy said about democracy as a never ending endeavor, and so NDI and similar organizations will continue to work side by side with our African partners to make sure that we can support them, give them the support and share experiences that they need so that we can all collectively, continue to work to strengthen and support democracy in countries like the DRC, Ethiopia, Sudan and across the entire continent.
