The Atmosphere of an Ecological Civilization: A Study of Ideology, Perception and Action in Chengdu, China
近幾年,中國人民每天都要面對多種環境問題,環境保護促成新的社會運動及實政方式 。數十年來,中國政府一直以強調經濟發展為先,因此,如何能將環境管理與中國社會的其他部分相協調仍沒有一個清晰的答案。本文將以中國西部城市成都為例,分析環保意識在不同社會族群中的興起。 ; 本文通過三個要素來檢驗環境意識:意識形態、感知和行動。自千禧年始,中國政府開始宣傳"生態文明"的觀念,它是中國共產黨給出的有關如何進行可持續發展的意識形態方面的答案。"生態文明"作為一個單一維度結構,特別強調要在不影響經濟增長的前提下加強對環境的保護。這個概念通過地方政府、非政府組織的項目、學術研究及媒體報道等多種方式滲透中國社會。通過利用民族志的研究手法來探討成都市民日常要面對的交通問題、消費主義、食品安全及城市化等議題,本論文著重研究"生態文明"作為一個單維觀念,是如何與普通市民讓成都變得"更灰"或"更綠"的方式相協調的。市民讓成都變得"更灰"是因為相關行為可幫助他們維持或積累更多社會資本。而讓成都變得"更綠"則是一種草根的環保意識形態,通常被描述為"很環保"。"很環保"是個自相矛盾的講法,一方面它帶有"過時"的意味,而另一方面它又帶有"上流"的感覺。 ; 本研究針對245 戶人進行了社會調查,結果顯示相較底層社會的市民而言,上層社會的市民普遍認為環境的好壞對他們生活的影響更大。類似於垃圾分類、節約用水、減少空氣污染等環保行為不同程度的與受訪市民的社會階層、年齡及居住地點有關。一方面,調查顯示市民們對於"生態文明"的理解五花八門,伸展至多個維度,另一方面,通過檢驗環境意識形態、對環境的感知和環保行動三者的交集後,我們發現,在環保問題上,中國民眾可被分為三大不同族群 。這包括,發展組,他們因國家宣傳的單維"生態文明"政策而受益;環境組,他們最受"很環保"這個意識形態的影響;以及"不知所從"組,他們因環保行動又"過時"又"上流"的雙面性而感到不知所從 。大部分身處權利中心的人都屬於發展組,理論上講,由發展組人士組成的國家可借引入"生態文明"這個單維結構而變得更穩固,因為"生態文明"的結構單維性讓"不知所從"組的人更樂意接受一個集權政府,並寄希望於後者可以替他們解決環境問題。但是,由於國家無法從多個維度介入民眾對於"生態文明"的地方詮釋,更多的市民因此將會趨於加入環境組人士,持與他們類似的對抗態度,而這將會讓國家陷入難以走出的困局。 ; In recent years, as the Chinese people have had to face environmental issues in their everyday lives, environmental protection has come to stimulate new social movements and forms of governance in China. After decades of state emphasis on economic growth, it has yet to be made clear how this new concern for environmental governance resonates with different segments of Chinese society. Thus, this thesis analyzes the rise of environmental consciousness among different social groups in the Western Chinese city of Chengdu. ; Environmental consciousness is examined according to three components: ideology, perception and action. Pandemic and New Division of the World
The COVID-19 pandemic brought on the so-called "coronacrisis," a global crisis event enormous in size and force. The crisis questioned the ability of states and instruments of international governance to respond quickly and effectively to the global threats. It is noteworthy that there was no strong correlation between crisis management efficacy and the type of political system of a country. However, the countries with elaborated and well-financed health systems, were able to struggle with the devastating consequences of the coronacrisis better than those with systemic, structural and financial problems of their healthcare sectors. It is obvious that the ability to manage the coronacrisis is not related to the type of political governance or ideology, but to the state administrative resources and competence of the cabinet / leaders. That potentially gave an opportunity for countries with different ideological foundations to neglect their tensions and unite the efforts in the containment of the SARS-CoV-2 virus (e.g. create mutual programmes of vaccination and medicine distribution). The main forces are the Transatlantic alliance, Russia and China. Unfortunately, no visible COVID-19-related agreement between them ever happened so far. Instead, the coronacrisis situation was used by the political rivals to intensify their aggressive rhetoric against each other (e.g., USA and Russia, USA and China) or profit from it in deepening international collaboration not connected with the pandemic itself (e.g., Russia and China). We do not observe any real mutual efforts of liquidating the pandemic consequences even within an ideological block, to say nothing about different blocks. The US–EU relationships worsened during the pandemic, especially at the background of Trump's cool attitude towards international organisations and his decision to leave the World Health Organization in the midst of the pandemic and his threatening words that US may also abandon the NATO. 無法無天, 一手遮天: 張憲初分析中國法律之不足及改善之法 ; A law unto themselves: the Chinese government has acknowledged that corruption in the judiciary is a serious problem
There is a continuing struggle between the demand of a market economy for judicial efficiency, impartiality, and professional conduct on the one hand, and the resistance of the traditional ideology to judicial reform, on the other. The current discipline campaign, as a temporary movement, will undoubtedly reduce the incidence of corruption scandals and result in the punishment of violators over a short period. The tougher job, nevertheless, is to reform the current system by introducing a supervisory scheme thai will deter and deal with abuses effectively in the long run. This will improve the quality of the entire judiciary and further develop true judicial independence in China. In terms of the big picture, the upgrading of judicial performance will not be achieved in isolation, but to a large degree, depend on the progress of the rule of law in China. ; published_or_final_version

學者研究中國上古時期政治思想,往往以漢武帝以後的儒家思想作為國家權力正當性的基礎,但是此理論的缺憾是,如果只以儒家思想作為國家意識形態的標誌,就難以解釋西漢武帝以前的國家權力正當性是如何運作的。其實早在作為中國最早期實行帝制的秦王朝,已憑著統一的法律標準與有利於專制王權實行管治的官僚機構,確立國家專制權力的基本模式。 ; 本文試圖從儒法之爭的框架跳出來,從法律思想的角度,考察先秦至秦代的法律觀念、法律與國家官僚機構的關係及法律原則與「國家意識形態」的關係等議題。為了更貼近自秦至秦知識分子的「生活世界」,本文採用回到文本本身的研究方法,找出反映儒、道、法各家思想特徵的文本及其中的思想如何互相對話與融合,並從中探討戰國中後期至秦的知識分子與國家官僚對法律與政治觀念的表達,及其中的政治關懷。 ; 本文將從法律思想與國家意識形態的角度,更緊密地考察法律觀念背後反映的政治權力意識,從先秦至秦「刑」、「法」的觀念與實踐的起源、秦國家法律標準、秦法律原則與官僚政治道德的關係三方面探討秦代國家專制權力的正當性基礎。 ; Conventional studies on Ancient Chinese political thoughts consider Confusianism as the basis for legitimising the ruling of the state. However, this theory fails at explaining the period before Han Wudi(漢武帝) officially proclaimed the supreme status of Confusianism. As early as Qin Dynasty(秦朝), the state has established a centralised authoritarian government through its standardised legal practice and complex bureaucratic system. ; Therefore, this study avoids the orthodoxy in explaining political thoughts with the struggle between Confucianism and Legalism and investigates the relationship of laws and the bureaucratic system as well as that of legal principals and state ideology in pre-Qin and Qin period. By scrutinising the contemporary thoughts through careful textual analysis, this study expounds the encountering of Confusianism, Daoism, and Legalism and also their synthesis. Upon this, it moves on further to examine how the literati and the bureaucrats in later Warring-States period(戰國時代) to Qin Dynasty delineated laws, political beliefs, and the political concerns therein. ; From the perspective of state ideology, this study aims at analysing the conception of political power as reflected by the legal thoughts in three dimensions: 1) the origin and practice of "xing"(刑) and "fa"(法) in Pre-Qin and Qin period; 2) the historical image and the relationship between legal standard and state ideology as embodied in the reform of Shang Yang(商鞅變法) in the Qin state(秦國); and 3) the legal principles and the political morality of the state bureaucrats in the later ...
