Den Themen "Immigration" und "Integration" kommt ständig wachsende Bedeutung zu. Die Globalisierung und die größere Durchlässigkeit der Grenzen haben dazu beigetragen, dass weltweit Wanderbewegungen eingesetzt haben, die in der jüngeren Geschichte beispiellos sind. Flucht vor kriegerischen Auseinandersetzungen und Verfolgung, aber auch vor Umweltkatastrophen haben diese Entwicklung weiter verschärft. Die Reaktion der Staatenwelt auf diese Herausforderung war bislang sicherlich unzureichend. In diesem Band untersucht eine Reihe von Wissenschaftlern dieses Phänomen aus völkerrechtlicher, europarechtlicher, staatsrechtlicher und soziologischer Perspektive. Dabei werden neueste Regelungsansätze dargestellt. Insgesamt wird zum Ausdruck gebracht, dass diese Materie eine verstärkte internationale Kooperation erfordert. La detenzione amministrativa degli stranieri, pur condividendo il carattere tipicamente afflittivo e stigmatizzante delle pene, non si fonda sulla commissione di un reato e non gode delle medesime garanzie previste dal sistema della giustizia penale. Nel nostro ordinamento l'inadeguatezza della legislazione, l'ampio margine di discrezionalità rimesso all'autorità di pubblica sicurezza, nonché il debole potere di sindacato giurisdizionale rimesso all'autorità giudiziaria, raggiungono il loro apice problematico nell'ambito delle pratiche di privazione della libertà personale che hanno per destinatari gli stranieri maggiormente vulnerabili, ossia quelli appena giunti sul territorio e il cui status giuridico non è ancora stato accertato (c.d. situazione di pre-admittance). E' proprio sulla loro condizione che il presente lavoro si focalizza maggiormente. Le detenzioni de facto degli stranieri in condizione di pre-admittance sono analizzate, nel primo capitolo, a partire dal "caso Lampedusa", descritto alla luce dell'indagine sul campo condotta dall'Autrice. Nel secondo capitolo viene ricostruito lo statuto della libertà personale dello straniero sulla base dei principi costituzionali e, nel terzo capitolo, sono analizzati i principi che informano il diritto alla libertà personale nell'ambito delle fonti sovranazionali, con particolare riferimento al diritto dell'Unione Europea e al sistema della Convenzione Europea dei Diritti dell'Uomo. Sulla scorta dei principi indagati, nel quarto capitolo è tracciata l'evoluzione legislativa in materia di detenzione amministrativa dello straniero in Italia e, nel quinto capitolo, è approfondito il tema dei Centri dell'immigrazione e delle regole che li disciplinano. Nelle conclusioni, infine, sono tirate le fila del percorso tracciato, attraverso la valutazione degli strumenti di tutela in grado di prevenire le pratiche di privazione della libertà informali e di garantire uno standard minimo nella tutela della libertà individuale, anche nelle zone di frontiera del nostro ordinamento. ; This thesis focuses on the issue of the legality of migrants' detention immediately following disembarkation on EU shores. Under Italian practice, this phase is one of those where access to justice and legal advice are poorly protected, so that under the justification of necessity and urgency, cases of unlawful deprivation of liberty frequently take place without any legal basis and judicial review. This has been the case at the Immigration Centre located on Lampedusa Island in recent years, where under the label of 'reception' in reality migrants have been subjected to unlawful detention. As personally observed by the author, who carried out some fieldwork research within this Centre, the above situation has represented a case of arbitrary detention in breach of the principles established in the Italian Constitution and in International Conventions, in primis in the case law under the European Convention of Human Rights. This thesis builds on the Lampedusa case study with the aim of suggesting better ways to protect migrants' personal liberty. Starting from the evaluation of the general legal safeguards available in the field of immigration detention in Italy, this thesis criticizes the habeas corpus system, specifically addressed to those who are in limbo' between the arrival at the border of Europe and the determination of their individual legal status. It concludes that in Italy a migrant's right to personal liberty is undermined by the lack of legal remedies in the Italian system.
Immigrants from outside the European Union in Italy have higher reported crime rates, especially illegal immigrants, than the Italian population. For some crimes, such as pushing drugs or exploitation of prostitution, hich provide requested services and are crimes without victims, the higher rates might be explained by noting that illegal markets are typically marginal and find their workers among marginal groups in society. There are then two possible consequences of the larger involvement of immigrants in these illegal markets: the immigrants substitute for native labor an the amount of crime remains the same, or they add their own activity to the existing illegal activity and the total amount of crime increases. With aggregate data for the 95 Italian provinces for the nineties (1991-2000) the paper considers whether, controlling for previous years crime rates the (growing) presence of immigrants contributes to the total amount of crime. The five crimes considered are exploitation of prostitution and drug offenses, as the main crimes involving illegal services, car theft as a crime in which the number of unreported crimes is minimal, murder and robbery. Crime rates and presence of strangers are modeled as separate endogeneous processes, and only positive links between these two processes provide evidence that immigrants contribute to crime rates beyond had would be predicted by the substitution hypothesis. Only in the case of exploitation of prostitution there was a relationship between the percentage of immigrant and the rate of crime; for the other crimes the substitution hypothesis has been confirmed. ; Gli immigrati extracomunitari in Italia, soprattutto se irregolari, sono caratterizzati da una frequenza di denunce penali superiore a quella degli italiani. Per reati "di servizio" quali la vendita di droga o lo sfruttamento della prostituzione, le più alte frequenze di denunce possono essere spiegate dal fatto che i mercati illegali sono spesso condotti da persone marginali, il cui accesso a lavori regolari è limitato. Il coinvolgimento degli immigrati nella criminalità può comportare una sostituzione degli italiani nelle attività criminali (ipotesi della sostituzione), ovvero una aggiunta di nuovi reati a quelli preesistenti (ipotesi della addizione). Utilizzando dati aggregati relativi alle 95 Province italiane negli anni '90 (1991- 2000) questa ricerca valuta se, controllando per la criminalità preesistente, la crescita della presenza degli immigrati contribuisce alla crescita dei reati. I cinque reati considerati sono alcuni reati "di servizio" come lo spaccio di droga e lo sfruttamento della prostituzione, ma anche reati che suscitano grande allarme sociale, come l'omicidio e la rapina, ed un reato che viene sempre denunciato, il furto d'auto. I tassi di denunce dei reati e la presenza di stranieri sono modellizzati come processi endogeni separati, e soltanto legami positivi tra questi due processi costituiscono una prova che la presenza di immigrati implica un contributo ai tassi di reati che va al di là dell'ipotesi della sostituzione. Solo nel caso dello sfruttamento della prostituzione vi è una relazione tra l'incremento degli immigrati e l'aumento dei reati; per gli altri quattro reati l'ipotesi della sostituzione è confermata
The shift from the continent of emigration to the continent of immigration marks the change of an era for Europe. Since 1945, tens of millions of immigrants have reached Western Europe, at first from other European regions, then from every corner of the world. Thus, a remarkable social transformation took place: the (ultimate) birth of multi-national, multi-racial, multi-cultural, multi-religious societies. For a long time, governments and companies demanded that immigrants be only temporary, so as to have a mass of precarious, barely integrated, vulnerable workers. Such demand, strongly restated over the past few years, was fiercely opposed by immigrant populations, who responded with a wider social rooting. The same applies to the similar demand by the powers that be to impose on immigrants differential exploitation and any sort of discrimination, opposed by a long chain of struggles and upheaval. Over the course of decades, set on the background of the unsolved great crisis of 2008, this conflict has escalated, until the "question of immigration" has turned into a military question, to be fixed with the intervention of the navy and border police. This paper states that the stakes are now too high: either we go back to a model of society and state based on brutal "racial" and class oppression, or we go towards a society finally freed from any kind of oppression. ; Il passaggio dal continente di emigrazione al continente di immigrazione è stato un enorme cambiamento per l'Europa. Dal 1945, decine di milioni di immigrati sono arrivati in Europa occidentale, prima di altre regioni europee, dopo dei quattro angoli del mondo. Così si è verificata un'enorme trasformazione sociale: la nascita (definitiva) di società multinazionali, multirazziali, multiculturali, multireligiose. Per molto tempo i governi e le aziende hanno voluto che gli immigrati fossero solo temporanei, per avere una massa di lavoratori precari, poco integrati e vulnerabili. Questa rivendicazione, tornata con forza negli ultimi anni, ha incontrato l'orgogliosa resistenza delle popolazioni immigrate, che hanno creato un sempre maggiore radicamento sociale. Lo stesso vale per l'analoga rivendicazione dei poteri istituiti di sottoporre le popolazioni e i lavoratori migranti a uno sfruttamento differenziato e ad ogni tipo di discriminazione, che sono state affrontate con lotte e ribellioni. Per decenni, nel fondo minaccioso della grande crisi irrisolta del 2008, questo conflitto si è aggravato fino a trasformare la "questione immigrazione" in una questione militare, che deve essere risolta con le marine militari e la polizia di frontiera. Questo articolo spiega che c'è tanta cosa in gioco: o torniamo a un modello di società e stato basato sulla più brutale oppressione "razziale" e di classe, oppure passiamo a una società definitivamente liberata da queste e altre forme di oppressione ; A passagem de continente de emigração a continente de imigração foi para Europa uma mudança enorme. Desde 1945, chegaram è Europa ocidental dezenas de milhões de imigrantes, antes de outras regiões europeias, depois dos quatro cantos do mundo. Assim se verificou uma transformação social enorme: o nascimento (definitivo) desociedades multinacionais, multirraciais, multiculturais, multirreligiosas. Durante um longo período, os governos e as empresas pretenderam que os imigrantes só fossem temporâneos, para poder dispor de uma massa de trabalhadores precários, pouco integrados, vulneráveis. Esta pretensão, que tem voltado com força nos últimos anos, encontrou a orgulhosa resistência das populações imigrantes, que criaram um enraizamento social cada vez maior. O mesmo vale para a pretensão similar dos poderes estabelecidos de submeter as populações e os/as trabalhadores/trabalhadoras migrantes a uma exploração diferencial e a todo tipo de discriminações, que foram encaradas com lutas e rebeliões. Durante décadas, no fundo ameaçador da grande crise não resolvida de 2008, esse conflito piorou até transformar a "questão imigração" numa questão militar, que deve ser solucionada com as marinhas militares e as polícias de fronteiras. Este artigo explica que há muita coisa em jogo: ou voltamos a um modelo de sociedade e estado baseado na mais brutal opressão "racial" e de classe, ou vamos para frente para uma sociedade definitivamente liberada dessas e outras formas de opressão.
This paper, having the Sea Watch case as its cornerstone, traces the body of national, treaty and international rules on immigration, especially for what concerns the saving of lives at sea. The objective of the investigation is to answer the following question: is it possible, on the basis of national and international legislation, to prevent the docking of boats, especially if coming from Libya, on which shipwrecked or non-European citizens travel, by rejecting them collectively and preventing them to apply for international protection? The outcome of the investigation, which may appear obvious on the basis of the most recent decisions, nevertheless raises questions regarding the difficult situation in the Mediterranean, in particular, following the riots that occurred in Libya and in the northern part of the African continent starting from 2011. ; Il presente contributo, avendo come pietra angolare il caso Sea Watch, ripercorre il corpo di norme nazionali, pattizie ed internazionali in materia di immigrazione, in particolar modo per ciò che attiene il salvataggio delle vite in mare. L'obiettivo dell'indagine è rispondere alla seguente domanda: è possibile, sulla base della normativa nazionale e internazionale, impedire l'attracco di imbarcazioni, specie se provenienti dalla Libia, su cui viaggino naufraghi o comunque cittadini non europei, respingendoli collettivamente ed impedendo loro di presentare domanda di protezione internazionale? L'esito dell'indagine, che può apparire scontato sulla base delle decisioni più recenti, ci pone comunque interrogativi rispetto alla difficile situazione del mediterraneo, in particolar modo, in seguito ai tumulti verificatisi in Libia e nella parte nord del continente africano a partire dal 2011.
A Malta, come in molti altri Paesi dell'Europa meridionale, i flussi migratori degli ultimi anni hanno reso le scuole molto più multietniche e multilingui rispetto a quanto lo erano in passato. La presenza dei migrant learners richiede l'impiego di misure didattiche inclusive e di politiche linguistiche che possano facilitarne l'integrazione e far sì che la scuola valorizzi le loro esperienze personali, anche a beneficio dei discenti di nazionalità maltese. In questo lavoro si prende in considerazione il caso specifico della scuola maltese, prendendo spunto anche da esperienze di altri paesi del bacino mediterraneo. Si constata che il numero crescente di migrant learners ha stimolato uno sforzo notevole da parte delle autorità educative locali per migliorare il quadro normativo delle politiche di integrazione a favore degli alunni migranti e delle loro famiglie. Tuttavia, sono necessarie ulteriori misure pratiche e utili per la scuola, sia per portare ad una conoscenza più approfondita del fenomeno e dei vantaggi che se ne possono trarre, sia per migliorare la preparazione di presidi e di insegnanti e i rapporti che essi instaurano con i genitori dei migrant learners. ; peer-reviewed
Italy has a long history of immigration, which has become part of the country's landscape in a complex and varied way, and has led to significant changes in important contexts such as in the school, the work place, and in the provision of welfare services. And yet, immigration policies still consist in emergency measures that do not recognize the phenomenon in its long -standing and structural dimension. In addition, public opinion is concerned as a result of the alarmist distortion of this issue, as shown by the gapbetween data on immigration and perceived immigration. Since in this research we take into consideration collusively shared experiences, these misunderstandings can not be corrected by providing more information on the real data; we posit that the emotional scope must be recognized in order to address this issue. In particular, we asked ourselves how this context -changes brought by immigration, public opinion, and government policies -is repre sented within the migrant Accordingly, we interviewed a group of reception staff from the Roman area on the type of service that they think they are offering. The results show how, in their experience, this complex reality of immigration is not evoked: the experience within the services is isolated from the Italian narrative and context. However, the voice of migrants and their point of view, emerge as a resource within these services, as openness rather than isolation.
