Application of DPSIR framework (Drivers, Pressures, States, Impacts and Responses) aims to assess the current impact of the environment through a process starting with "driving forces" through "pressures" to "states" and "impacts" eventually leading to political "responses" in mineral mining in Luc Yen district. Research results show that the main drivers in Luc Yen are resources consumption (Wi = 3.675), the demand for industrial development (Wi = 3.575), followed by diversification and size of mines (Wi = 3.250). The environmental pressures are solid (Wi = 4.025), dust (Wi = 3.900) and wastewater (Wi = 3.625). The current state of environment is the most affected by air (Wi = 3.400). The soil and water are almost unaffected. The current environmental impacts have positive and negative social, economic and environmental impacts. Specifically, the positive impacts are employment opportunities, income (Wi = 3.325) and an increase in state budget (Wi =3.000). There are no positive improvements of the environment related to mining activities, such as negative impacts on ecological landscape (Wi = 3.050) and infrastructure (Wi = 3.075). Improving environmental quality and mitigating environmental impacts have been applied, including innovative technology (Wi = 3.175), pollution monitoring and environmental quality monitoring (Wi = 3.400). Communication activities to enhance community participation in Luc Yen area were also highly appreciated by people (Wi = 3.375). ; Việc ứng dụng mô hình DPSIR (Drivers, Pressures, States, Impacts and Responses) nhằm mục đích đánh giá tác động môi trường theo một quá trình từ động lực, áp lực, hiện trạng và tác động đến đáp ứng để giải quyết vấn đề môi trường liên quan đến hoạt động khai thác khoáng sản tại huyện Lục Yên. Kết quả nghiên cứu cho thấy động lực dẫn tới hoạt động khai thác đá vôi trắng tại huyện Lục Yên là nhu cầu sử dụng tài nguyên (Wi = 3,675), nhu cầu phát triển hoạt động công nghiệp (Wi = 3,575), tiếp đến là sự đa dạng, quy mô các mỏ khoáng (Wi = 3,250). Áp lực môi trường là chất thải rắn (Wi = 4,025), tiếp đến là bụi (Wi = 3,900) và nước thải (Wi = 3,625). Hiện trạng môi trường tự nhiên hiện nay tại khu vực Lục Yên chịu ảnh hưởng mạnh nhất là không khí (trọng số Wi = 3,400), môi trường đất và nước gần như chưa bị tác động. Tác động môi trường hiện nay tại huyện Lục Yên thể hiện qua tác động đến môi trường xã hội và môi trường tự nhiên. Cụ thể, tác động giải quyết việc làm, tăng thu nhập (Wi = 3,325) và tăng ngân sách nhà nước (Wi = 3,000). Tác động tiêu cực tới cảnh quan sinh thái (Wi = 3,050) và cơ sở hạ tầng (Wi = 3,075). Các giải pháp cải thiện và giảm thiểu tác động môi trường đã áp dụng hiện nay là đổi mới công nghệ khai thác theo hướng tiên tiến (Wi = 3,175), giám sát ô nhiễm và quan trắc chất lượng môi trường (Wi = 3,400). Giải pháp truyền thông tăng cường sự tham gia của cộng đồng tại khu vực Lục Yên cũng được người dân đánh giá cao với trọng số (Wi = 3,375).

Import and export activities have contributed greatly to the development of the Lao People\'s Democratic Republic over the last years. By means of descriptive statistical analysis, comparison, comtrast, synthesis, and generalization of the data released by the National Statistical Bureau and world's financial institutions such as the International Monetary Fund (IMF) or the World Bank (WB), this paper will clarify the successes in the economic developments of Laos, the successes and shortcomings of import and export activities, the impacts of the results of the import and export activities on the country\'s economic growth. Finally, the article will make implications of the country\'s import development policies of the Lao People's Democratic Republic in the years to come. ; Hoạt động xuất nhập khẩu đóng góp rất lớn vào sự phát triển của nước Cộng hòa Dân chủ Nhân dân Lào trong những năm qua. Bài báo này bằng phương pháp phân tích thống kê mô tả, so sánh, đối chiếu, tổng hợp và khái quát hóa các số liệu của Tổng cục Thống kê nước này và của các định chế tài chính thể giới như Quỹ tiền tệ thế giới - IMF hay Ngân hàng thế giới WB. Từ đó bài báo đã làm rõ được những thành công trong phát triển kinh tế của Lào, những thành công và yếu kém của hoạt động xuất nhập khẩu, tác động từ kết quả của hoạt động xuất nhập khẩu tới tăng trưởng kinh tế của quốc gia này. Nội dung cuối cùng của bài viết là các hàm ý chính sách phát triển xuất nhập khẩu của nước Cộng hòa Dân chủ Nhân dân Lào trong những năm tới.

학위논문 (석사)-- 서울대학교 대학원 : 외교학과, 2012. 2. 신범식. ; 본 논문의 핵심 질문은 색깔 혁명 발생으로 민주화에 성공한 그루지야와 우크라이나의 이후 민주주의 발전 양상은 왜 달랐는가이다. 색깔 혁명 이후, 우크라이나의 민주주의는 진전을 보였지만, 그루지야는 그렇지 못했다. 본 연구는 색깔혁명 이후 미국과 러시아의 갈등 구도와 양국의 대(對) 그루지야, 우크라이나 정책이 각국의 국내 엘리트-대중 관계에서 엘리트 자율성, 그리고 민주화에 미친 영향에 주목하였다. 9.11 테러 이후 미국과 러시아는 협력 체제에 있었지만, 색깔 혁명의 발생으로 인해 양국은 갈등 구도에 들어서게 된다. 그루지야와 우크라이나는 미․러 갈등 구도의 중심에 있었다. 활용가능성의 요인으로 인해, 그루지야는 우크라이나보다 전략적 가치가 더 큰 곳이었다. 미․러 갈등 구도 속에서 그루지야 집권 엘리트들은 높은 엘리트 자율성을 가질 수 있었다. 미국은 그루지야에게 큰 경제 원조, 정치적 지원을 하였다. 또한 그루지야-러시아 관계 악화와 2008년 전쟁 발발은 정권의 권위주의 정책을 정당화하고 국내를 결집시키는 기제로 작용하여 그루지야 집권 엘리트들이 높은 자율성을 갖게 해주었고, 이는 민주화 저해로 이어졌다. 우크라이나는 그루지야와 반대였다. 미․러 갈등 구도 속에서 우크라이나 엘리트들은 낮은 자율성을 가졌다. 우크라이나의 집권 엘리트들은 서방과 러시아 양측 모두로부터 확고한 정치적, 경제적 지원을 얻을 수 없었다. 오히려 러시아의 정책으로 인해 국내의 반 오렌지, 대항 엘리트가 공고해지면서, 집권 엘리트의 자율성은 낮아졌다. 엘리트들의 낮은 자율성과 대중에 대한 높은 의존성은 대중 영합주의 정책과 정국 불안의 결과를 낳았으나, 이는 오렌지 혁명 이후 우크라이나 민주주의의 발전을 제한적으로나마 가능하게 해주었다. 본 연구는 민주화 연구에서 그동안 비교적 주목을 덜 받아온 국제적 요인을 다루고, 외교 정책, 국내 엘리트-대중 관계, 민주화의 연계를 통합적으로 보여준다는 점에서 함의가 있다. 본고는 많은 기존 연구들이 상정해 온, 민주화에 대한 서구 민주화 증진 정책의 긍정적 영향과 권위주의 국가의 부정적 영향이라는 단순한 명제의 한계를 드러내주고 있다. 또한 민주주의 지원 정책에서 민주화 단계별로 정책을 달리할 필요성에 대해서 시사한다. ; What caused the difference in democratic trajectories between Georgia and Ukraine after the Color Revolutions? Since the occurrence of the Color Revolutions, Georgia's democracy has laid in tatters, whereas Ukraine has achieved a relatively successful democracy. Georgia and Ukraine share similar domestic determinants which have been discussed in previous democratization literature. This study, however, focuses on the international factor as an explanation for the different democratic fates of democracy between the two countries. Comparing both countries, this thesis uses a framework that integrates international factors, elite autonomy in domestic elite-mass relations, and democratization. The study argues that international factors, specifically the foreign policies of the US and Russia, provide an explanation for the difference in democratic outcomes for the two countries. Following the events of September 11, 2001, US-Russian relations improved. However, the occurrence of the Color Revolutions caused deterioration in the ties between the two countries, and both started to adopt different foreign policies towards the post-Soviet region. Caught in the middle of this conflict between the two great powers were Georgia and Ukraine. The unconditional US support for Georgia and Russia's assertive policy towards Georgia which culminated in the Russian-Georgian War in 2008 enabled the Georgian elites to attain high elite autonomy, thus resulting in democratic stagnation for Georgia. In contrast, Ukraine did not garner the support of either the US or Russia; rather, it was pressured by Russia. The anti-Orange elites in Ukraine were effectively supported by Russia, and, thus, were able to function as a forceful political opposition to the incumbent elites. Therefore, the Ukrainian elites only garnered low autonomy, which resulted in democratic progress in Ukraine despite domestic political chaos. This study contributes to further understanding of the impact of international factors upon democratization. In addition, this thesis creates implications for democracy promotion policy. The conclusion of the thesis challenges the predominant assumption that Western democracy promotion is conducive to actually democratization, and that authoritarian countries' authoritarian promotion policy is harmful to democratization. In the process of democracy promotion policy, policymakers and implementers need both careful monitoring of the process of democratic assistance and coordination with other countries. ; Master

Climate change has been affecting to livelihoods of communities in the coastal plain of the Vietnamese Mekong Delta (VMD). Surface water management in the coastal plain was considered to be limited, especially in enforcement. Therefore, the research aimed to assess the stakeholder involvement, identify the conflict in using the surface water and mechanism to solve and avoid the conflict. The directive interview farmers and governmental staffs was implemented to collect the necessary data. The descriptive statistic was applied in order to analyze the collecting data through farmer survey. The questionnaire was built based on the governance assessment framework "Ten-building Block". The results showed that the governmental group (including the people committee and the Provincial department) was the highest participatory in the management process both in decision-making level and interested level. The surface water users, especially the farmers participated with the average rate because of their low capacity in making the decision for a new policy or a new agricultural model. Besides, different groups of stakeholders as the non-governmental organization and governmental organization (the local Youth Union, Famer's and Women's Association) played an important role in raising the water user's awareness. The remaining group, including nonagricultural company or traders, nearly were not concerned about the surface water changes. In addition, there were two main types of conflicts identified: between the farmers in the same kind (1) and different kind (2) of cultivation. As the consequence of the natural salinity and the impacts of output water from shrimp pond to the rice cultivation zone, the conflict was about the inefficient water regulation and distribution for each water user. These conflicts were mostly solved through self-negotiating and self-engaging between the farmers. In fact, there was no rule or principle to solve and prevent the potential water use conflict. Thus, this could be a great challenge for the surface water management in the agricultural zone as Soc Trang in the context of increasing the extreme climatic phenomenon. ; Biến đổi khí hậu đã và đang tác động lớn đến sinh kế của các cộng đồng ven biển đồng bằng sông Cứu Long (ĐBSCL). Công tác quản lý tổng hợp tài nguyên nước mặt tại vùng ven biển được cho rằng còn tồn tại nhiều hạn chế, nhất là trong triển khai và thực thi. Vì vậy, nghiên cứu được thực hiện tại Sóc Trăng (một tỉnh ven biển ĐBSCL) nhằm đánh giá sự tham gia của các thành phần có liên quan, xác định các mâu thuẫn trong sử dụng nguồn nước mặt cũng như các giải pháp giải quyết và phòng tránh mâu thuẫn. Phương pháp phỏng vấn trực tiếp nông hộ, tham vấn chuyên gia quản lý và thống kê mô tả được áp dụng để đánh giá các mục tiêu đặt ra của đề tài. Các thông tin khảo sát được xây dựng dựa trên bộ mười tiêu chí đánh giá quản trị tài nguyên nước (van Rijswick et al., 2014). Kết quả cho thấy nhóm chính quyền địa phương (bao gồm UBND và các Sở/Ngành) có vai trò và mức độ tham gia cao nhất trong chu trình quản lý. Người sử dụng nước mặt, nhất là nông dân đóng góp sự tham gia tương đối do mức đô ra quyết định về thiết lập chính sách và lựa chọn mô hình canh tác thấp. Mặt khác, các nhóm đối tượng khác như các tổ chức phi chính phủ, Đoàn thể, Hội nông dân và Hội phụ nữ đóng góp vai trò quan trọng trong nâng cao nhận thức và kêu gọi cộng đồng sử dụng hiệu quả nguồn nước mặt. Các nhóm tổ chức kinh tế như doanh nghiệp, tiểu thương gần như không quan tâm đến nguồn nước mặt. Bên cạnh đó, các mâu thuấn về sử dụng nước mặt cũng được xác định. Các mâu thuẫn được phân chia thành 2 nhóm: cùng loại hình canh tác và giữa các loại hình canh tác khác nhau. Các mâu thuẫn chủ yếu về vấn đề điều tiết nguồn nước không hợp lý và thiếu cân bằng trong phân phối nước ngọt cho các đơn vị canh tác do xâm nhập mặn tự nhiên, xả thải nước mặn vào vùng ngọt và khai thác không đồng đều. Các mâu thuẫn này chủ yếu được giải quyết thông qua thương lượng và thỏa thuân giữa các đối tượng có liên quan chứ chưa có bất kỳ một cơ chế hay quy định nào nhằm giải quyết cũng như phòng tránh các mâu thuẫn tiềm tàng. Vì vậy, đây sẽ là một thách thức lớn cho công tác quản lý nguồn nước mặt tại vùng sản xuất nông nghiệp thâm canh như Sóc Trăng trong bối cảnh gia tăng cực đoan khí hậu.

학위논문(석사)--서울대학교 대학원 :인문대학 국사학과,2019. 8. 정용욱. ; This paper analyzes the organization and activities of the UNKRA(United Nations Korean Reconstruction Agency), which was established and operated under the UN General Assembly in the 1950s for Korean rehabilitation and reconstruction. Through this, this research tries to understand the problem of economic reconstruction in Korea after the Korean War. When UNKRA was founded, the United Nations forces anticipated military success and an early cessation of hostalities. However, Chinese intervention in Korea might prolong hostilites and hamper rehabilitation and recovery indefinitely. In the early years, UNKRA could not fully implement the reconstruction program until the military situation had settled down. Instead, it operated under military supervision. During the war, UNKRA mainly seconded its experts to the UNCACK(United Nations Civil Assistance Command in Korea). After September 1952, CINCUNC, UNKRA and the Government of the Republic of Korea agreed to start as much basic rehabilitation and reconsruction program as the military situation would allow. Nevertheless, the general situation had made it necessary to accord the first priority to the importation of consumer goods. Furthermore, UNKRA proceeded to develop comprehensive plans and programs in the support of the UN specialized agencies and the Nathan Associates. The Nathan Associates developed the Five-Year Plan for the reconstruction of Korea, which meant Korea could achieve economic independence in five years. It suggested that the major portion of investment would go into sectors of physical production and distribution where the direct, measurable impacts on national output would be heaviest and quickest. However, despite of the desirability of a large social investment programs in Korea after the Korean War, they did not emphasize upon social investment because of limited resources for reconstruction. After Armistice in July 1953, UNKRA actually launched the reconstruction program. However, UNKRA could not take over responsibility for all relief and rehabilitation activities because the United States developed a defense support program for South Korea after the war. That is, UNKRA was assigned a certain segment to operate and the rehabilitation of the war was coordinated through the OEC(Office of the Economic Coordinator). Nevertheless, UNKRA was independent from the defense support program of the United States and could emphasize on non-military areas of the economy. UNKRA's largest over-all investment allocation was made in the idustrial field. UNKRA undertook the reconstruction of the major industrial plants and the construction of new manufacturing facilities in the important sectors of manufacturing industries. In spite of many problems in operation and shortages of funds, it provided the capital and engineering for industrial expansion in Korea. ; 본고는 1950년대 한국의 전후 재건과 부흥을 위해 유엔 총회 산하에 설립되어 활동했던 유엔한국재건단(UNKRA: United Nations Korean Reconstruction Agency)의 조직과 활동을 고찰하였다. 재건단 원조는 1950년대 대한원조의 주축이었던 미국의 대한원조와는 독립된 방식으로 운영되었다. 그러므로 본고는 재건단의 설립과 위상변화 과정, 재건구상과 활동의 실제를 살펴보고 그 의미를 밝히고자 하였다. 유엔한국재건단은 한국전쟁에서 유엔군이 승리하여 조속히 전투가 종료되고 통일이 이루어질 것이라는 전망 속에서 설립된 기구였다. 재건단은 전투 종료 이후 통일된 한반도에서 긴급 구호와 기초시설의 재건, 생산성 확대에 이르기까지 대한원조 전반을 총괄하는 기구로서 수립되었다. 그러나 1950년 12월 1일 수립 이후 전쟁이 장기화되면서 독자적인 활동영역을 확보하지 못하였고, 유엔군사령부가 경제원조를 포함하여 한국에서의 전반적인 권한을 보유하는 가운데 재건단은 주로 유엔사의 활동을 보조하는 위치에 머물렀다. 그리하여 전시에 재건단은 본격적인 사업에 돌입하지 못하는 대신, 유엔사 산하에서 구호와 단기복구를 담당하는 기관인 유엔한국민사처(UNCACK)에 민간인력을 파견하는 것으로 주요 활동을 대체하였다. 1952년 중반 이후 전선이 안정되고 한국 경제의 위기가 심화되면서 유엔사, 한국정부, 재건단 사이에 본격적인 재건사업이 시작되어야 한다는 합의에 이르렀지만, 극심한 인플레이션으로 인해 재건단의 활동은 일부 소비재를 수입하는 것에 그쳤다. 이와 더불어 전시 재건단은 전쟁 종료 후 본격적인 재건사업에 돌입하는 단계를 준비하며 각종 조사를 실시했다. 재건단의 의뢰에 의해 유엔 전문기구들은 농·수산업, 교육, 보건 등 분야별 조사를 담당하였고, 네이산 협회는 이를 포괄하는 전반적인 재건계획을 제출하였다. 재건단의 의뢰로 작성된 네이산 보고서는 한국에서 5년 간의 재건계획을 수행하여 전전과 비슷한 생활수준을 회복하고, 국제수지의 균형을 맞출 수 있을 것으로 전망하였다. 이를 위해 생산영역에 집중적으로 투자하면서, 농산물, 수산물, 광물 등 자연자원을 개발하여 수출을 증진한다는 계획을 제시하였다. 전후 한국사회에서 주택, 보건, 복지 등의 분야에 대한 필요가 절실했지만, 사회서비스나 복지 분야는 직접적인 생산력 증대를 불러오는 분야가 아니라는 점에서 재건계획 상 상대적으로 후순위에 배치되었다. 1953년 7월 휴전협정 체결 이후 재건단은 본격적으로 재건사업에 착수하였다. 그러나 이때에도 재건단은 한국 재건사업에서 전반적인 권한을 보유하지 못했는데, 미국의 전후 구상에 따라 방위지원을 주축으로 하는 미국의 대한원조가 중심이 되고 유엔 원조기구의 위상이 상대적으로 축소되었기 때문이다. 결국 재건단은 미국 원조기관과의 협의에 따라 한정된 영역에서만 사업을 진행할 수 있었다. 그럼에도 재건단은 독자적인 조직을 유지하며 담당 부문에서 자체 사업을 진행하였고, 원조의 내용에서도 미국 원조와는 다른 특성을 보였다. 즉 미국 원조가 주로 소비재 판매대금을 통해 막대한 국방비를 충당하고 경제를 안정화하는 데 초점을 맞추었던 것과 달리, 재건단은 장기적으로 한국경제의 생산력을 증진시키는 것이 필요하다고 보고 시설투자와 기술원조가 결합된 형태의 원조를 주로 진행하였다. 재건단 원조에서 전시기에 걸쳐 가장 많은 비중을 차지한 것은 공업 부문이었다. 재건단의 공업 부문 원조는 소비재에서 생산재까지 여러 분야에 걸쳐 진행되었고, 노후화된 기존 시설을 대체하고 전쟁으로 파괴된 시설을 복구하는 것 이상으로 신규투자를 통해 새롭게 공장을 건설하기도 했다. 특히 재건단은 중소규모 기업에 자금과 기술, 시설을 제공하는 한편, 면방직 공업이나 시멘트 공업, 판유리 공업과 같은 몇몇 분야를 전략적으로 성장시켜 국내 생산을 증가시키고 수입을 대체하고자 했다. 이와 같은 재건단의 원조는 운영상의 여러 문제점을 노정하였으나, 한국의 초기 전후 복구 과정에 상당 부분 기여했다. ; 머리말 1 一. 전시 유엔한국재건단의 설립과 재건구상 7 1. 재건단의 설립과 유엔군사령부와의 관계 정립 7 2. 전후 재건구상 18 二. 전후 유엔한국재건단의 조직과 활동 25 1. 휴전 이후 재건단의 대외적 위상 변화 25 2. 재건단 내부의 조직운영과 예산 구성 34 3. 재건단의 활동 분석―공업 부문을 중심으로 47 맺음말 59 참고문헌 62 Abstract 67 ; Master

Bearing in mind the distinctive features of prepetition claims and postpetition claims where the former are generally classified as insolvency claims subject to restrictions as per insolvency procedures while the latter as administration claims granted the rights to be paid irrespective of insolvency procedures, one may well assert that the actual amount of realized payment will consequently be different by a significant margin. Thus, it does matter to classify straddle claims before and after the order for relief. In South Korea, the part-fulfillment test(일부구비설) is widely accepted as a common view. In pursuant to the part-fulfillment test, once a particular debt in question is affirmatively established as insolvency claims, other claims that do not fall into the category of insolvency claims but nevertheless fulfill the requirement of administration claims are deemed administration claims. Even if the claims are unliquidated, contingent, unmatured, disputed, they can be classified as insolvency claims when the significant part of the claims are fulfilled prepetition. It seemingly is due to the reception of the Japanese insolvency acts which has eventually resulted in South Korean insolvency frameworks adopting the relevant Japanese legal theories and precedents that developed on the basis of the part-fulfillment test. But the word 'the significant part of the claims' is too vague to establish a clear and consistent criterion. Among the cases of the Supreme Court of South Korea, some cases contradict each other. In Japan, a scholar following the part-fulfillment test even admits that the test has its defects as some cases of the Supreme Court of Japan are inconsistent. The 'theory of deduction(控除説)' in Japan, based on the study of history of theories about classifying claims, criticizes the present common view in Japan, the part-fulfillment test, and suggests that the claims subject to insolvency risks be insolvency claims and the claims free from insolvency risks be administration claims. It may sound like a tautology, but it pinpoints that the present part-fulfillment test is far from realizing the essence of treatment and disposition of claims, using the word 'the significant part of the claims'. However, the theory of deduction also leaves much to be desired to set a clear and consistent criterion. In the United States, timing problems of claims in insolvency have been an important research theme, making use of a substantial balancing test. Thus, the arguments in the United States serve as a good reference. The theories of the United States do not apparently dichotomize, but virtually distinguish contractual claims from non-contractual claims. When it comes to contractual claims, the claimants voluntarily enter the contracts considering insolvency risks, so it is easy to determine whether the claimants bear the insolvency risks in accordance with their intention. In contrast, as of non-contractual claims, the claimants often get the claims involuntarily. It is hard to determine, based only on the claimants' intention, whether they should be burdened with insolvency risks. Therefore, dichotomy is desirable. In case of contractual claims, almost all federal courts of appeals and scholars adopt the performance test in the United States. As of non-contractual claims, there are the accrued state law test, the conduct test, the relationship test, and the fair contemplation test in the United States. Most of federal courts of appeals follow the relationship test, while most of scholars support either the conduct test or the fair contemplation test. For contractual claims, including the ones based on executory contracts, we can accept the performance test as it is. The part contributed to a debtor prepetition by a claimant abandoning exceptio non adimpleti contractus is subject to the insolvency risks and should be treated as insolvency claims. The part induced to do business with a debtor postpetition is beneficial for the estate and thus should be treated as administration claims. For efficiency, prepetition claims should be cut off from post-insolvency as sunk costs, while postpetition claims should receive priority to induce entities to enter new business with a debtor so as to foster reorganization. In case of non-contractual claims, it is hard to tell whether the claims are supposed to bear insolvency risks or not. It is a matter of policy. Unless it is the case where Debtor Rehabilitation and Bankruptcy Act in South Korea excludes explicitly the non-contractual claims from insolvency claims, prepetition claims should be classified as insolvency claims and postpetition claims administration claims. While the meaning of 'claims' for insolvency is defined in a unique sense under the United States Bankruptcy Code so as to put a great weight on that specific point of time, Debtor Rehabilitation and Bankruptcy Act in South Korea yet omits to define the meaning of 'claims' for insolvency, making it unnecessary to be obsessed with as to when a claim arises. For insolvency in South Korea, I hereby propose the relationship test that does not stick to the point when a claim arises. Rather, I suggest a more flexible solution that allows bifurcation of claims. If the part of the claim occurring before the order for relief creates a relationship, such as contact, exposure, impact, or privity, between the claimant and the debtor, then the part of the claim is insolvency claim. At the same time, the purposes of the acts on which the claim is based, the entity benefitted by the expense, and so forth, should be considered. Prepetition claims should be cut off to encourage a fresh start of the debtor, but that does not mean that the debtor is free to commit torts or gain unjust enrichments. Though it is quite theoretical, postpetition claims that the claimant gains involuntarily because the debtor fails to block a relationship between them should be treated as administration claims so that the estate shoulders the expense. As a result, insolvency can proceed with efficiency and equity. The representatives and the social insurance programs for future claimants can satisfy due process concerns. 학위논문(석사)--서울대학교 대학원 :행정대학원 공기업정책학과,2019. 8. 금현섭. ; 본 연구는 국민이 가지는 정부에 대한 신뢰는 정책의 수용과 지지에 영향을 주는데 그 중 특정 정책인 부동산 정책시행에 따른 부동산 가격에 미치는 영향을 실증적으로 분석하고자 하였다. 먼저 정부신뢰와 부동산 정책에 대한 이론적 배경을 확립하고, 정부신뢰, 부동산정책과 신뢰, 부동산 가격요인, 부동산 정책의 효과에 대한 선행 연구를 검토하였다. 본 연구의 목적에 따라 독립변수로 정부신뢰를, 통제변수로는 사회·경제적 요인(물가, 지역내총생산)과 국제경제적 요인(환율)을, 조절변수로 정책변수(각 정부별 부동산 정책)인 연구모형을 수립하였다. 그리고 이를 분석하고자 회귀분석방법을 이용하였다. 연구결과를 요약하면 다음과 같다. 첫째, 사회ㆍ경제적 요인과 국제경제적 요인, 지역, 정부신뢰를 통제한 상태에서는 부동산 정책은 부동산 가격지수에 정(+)의 영향을 미친다. 이명박과 박근혜 정부의 부동산 정책은 효과가 있는 반면 문재인 정부의 부동산 정책은 효과가 없는 것으로 나타났다. 둘째, 정부에 대한 신뢰는 정책의 지지와 수용, 협력을 이끌어내며, 이러한 정책이 정책의 성공으로 이어지는 데에는 시차를 두어야 한다는 것이다. 셋째, 각 정부별 정부신뢰의 차이가 실제로 부동산 가격에 영향을 미치는지를 실증 분석한 결과, 차이는 존재하지만 특정 정부가 모든 부동산 가격에 영향을 미쳤다고 말할 수 없었다. 넷째, 사회ㆍ경제적 요인(지역내총생산, 환율)과 정책적 요인(각 정부별 부동산 정책), 정부신뢰를 통제하고 본 지역별 부동산 가격변화에서 수도권과 비수도권이 크게 달랐다. 다섯째, 여러 요인들을 통제하고 시차별, 정부별, 지역별 정부신뢰와 부동산 가격간의 관계를 살펴보았을 때, 일관되게 부(-)의 영향관계가 있었다. 종합하면, 그동안의 부동산 정책 중 가격활성화 정책은 어느 정도 효과가 있었으며, 정부신뢰에 따른 정책의 효과는 시차를 두고 나타나며, 정부신뢰 및 부동산 정책에 따른 부동산 가격변화는 지역에 따라 달리 나타난다. 본 연구 결과를 통해 도출한 시사점은 다음과 같다. 첫째, 정부신뢰의 중요성에 대한 연구는 많았지만, 실증적으로 정부 신뢰가 어떤 영향을 미치는지를 살펴본 것은 적었다. 하지만 정부신뢰의 영향을 분석하였다는 점과 정책수용자인 국민들이 정책에 순응·지지하는 데는 시간이 필요하다는 것을 실증적으로 보여주었다는 점에서 의의가 있다. 그리고 이는 정책이 가진 정책의 효과보다 정부신뢰로 인한 해당 정책에 대한 지지와 수용이 달라져 정책의 효과·성과가 더 크게 나타난다고 볼 수 있다. 둘째, 부동산 정책 중 가격활성화 정책은 부동산시장에 효과가 있었다. 다만 가격활성화 정책에 대한 정책수용 측면에서 살펴보면 정부신뢰와 부동산 가격 간에는 부(-)의 관계가 존재한다. 셋째, 지역별로 구분하여 살펴본 분석결과 전세가격이 매매가격보다 민감하게 반응한다는 점인데, 주거복지 측면에서 부동산 정책에 대해 제고해야 한다는 것을 보여준다. ; This study was intended to empirically analyze the impact of the public's trust in the government on real estate prices under certain policies: real estate policy implementation. First of all, the theoretical background on government trust and real estate policy was established, and then the prior study on the effects of government trust, real estate policy and trust, real estate price factors, and real estate policy was reviewed. In accordance with the purposes of this study, a research model was established, which is Government trust as an independent variable, Social, economic and international economic factors as a control variable, government policy(real estate policise for each administration) as a moderator variable. And the regression analysis method was used to analyse. The results of the study are summarized as follows. First, the real estate policy has a positive effect on the real estate price index under the control of socioeconomic factors, international economic factors, region and government trust. The real estate policies of Lee Myungbak and Park Geunhye are effective, but the real estate policies of Moon Jaein government are not effective. Second, trust in the government leads to the support, acceptance and cooperation of policies, and time differences should be placed in the way that these policies lead to the success of the policies. Third, after empirical analysis of whether the differences in government trust in each government actually affect property prices, it was not possible to say that a particular government had influenced all real estate prices, although differences existed. Fourth, social and economic factors (GRDP(Gross Regional Domestic Product), exchange rate) and policy factors (real estate policies for each government) and government confidence were controlled, and the capital and non-capital areas were significantly different in real estate price changes for each region. Fifth, when controlling various factors and looking at the relationship between government confidence and real estate prices by time lag, each government and region, there was consistently a negative influence. In sum, the price revitalization policy of the past real estate policy has had some effect, the effect of policy on government trust appears at a time lag, and changes in real estate prices according to the government trust and real estate policy vary depending on the region. The implications of this study are as follows. First, Although there have been many studies on the importance of government trust, few have examined how government trust affects empirically. However, it is significant that the analysis of the influence of government trust and the fact that the people who are policy adopters need time to conform and support the policy. This suggests that the effectiveness and the performance of the policy are shown to be larger because the support and acceptance of the policy is more different than the effect of the policy. Second, the price revitalization policy among real estate policies was effective in the real estate market. Though terms of policy acceptance of price activation policy, there is a negative relationship between government trust and real estate prices. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱. ; 본 연구는 1970년대 이후 미국의 통상정책 결정과정에서 주된 절차적 기제로 작용해온 신속처리절차(Fast-track procedures)가 2002년 무역법을 통해 무역증진권한(Trade Promotion Authority; TPA)으로 재입법되는 과정의 동학을 의회-행정부 관계를 중심으로 설명하는 것을 목적으로 한다. 신속처리절차는 대통령이 비관세장벽 관련 내용이 포함된 무역협정을 체결하고 이행법안을 의회에 제출하면 양원은 수정안 제출 없이 가부만을 결정해서 90일내에 처리해야 한다는 규정으로 1974년 무역법에서 처음 도입된 이래 30년 간 미국의 무역정책결정과정에서 중요한 위치를 차지해왔다. 하지만 자유무역정책에 대한 양당의 합의가 약해지면서 1994년 만료되었고, 2002년 8월 6일 부시 대통령이 법안에 서명을 하면서 8년 만에 통상정책결정과정에 다시 등장했다. 그렇다면 어떠한 맥락에서 클린턴 행정부 시기에는 부결되었던 연장 법안이 부시 행정부 때는 성공할 수 있었을까? 기존의 연구들은 1997년과 2001년 표결 분석을 통해 의원 차원에서 이익집단ㆍ유권자들과의 관계, 정당 차원에서 단점정부를 그 요인으로 지적한다. 하지만 입법과정에서 의회의 행태는 의원 개인, 정당 두 차원 외에도 행정부와의 관계에서 입법부로서의 의회를 강화하고자 하는 유인의 영향을 받는데 본 논문은 마지막 차원에 주목한 설명을 제시하고자 한다. 즉 의회는 국내외 경제적 상황, 유권자와 이익집단에 대한 고려, 행정부 등 다양한 요구에 대응하는 과정에서 입법부로서의 지위 강화를 위해 행정부와의 관계에서 개입을 증대하는 동시에 실패했을 경우에 부담해야 하는 비난, 지지기반의 이탈과 같은 손실을 최소화하는 방향으로 정책을 입안하려고 했고, 그 결과로 2002년에 무역증진권한이 다시 입법되었다는 것을 보이고자 한다. 입법 과정을 보면 초기에는 기존 연구 결과에서 나타나듯 의원 개인의 차원에서는 재선을 위해 유권자와 이익집단을 고려했고 정당 차원에서는 다수당이 되려는 선거 정치에 대한 고려와 이익집단과의 관계에서 통과와 저지의 공을 주장하려는 의도에서 정당 간 대립이 나타나기도 했다. 하지만 입법과정이 본격화되고 상원에서 안데스 산맥 국가들에 대한 무역특혜협정, 무역조정지원과 포괄법안의 형태로 입법되는 것으로 논의되면서 양당의 지도부는 의회가 미국의 전반적인 무역정책의 수립에 어떻게 개입해야 하는가에 대한 고민을 시작했다. 의회는 무역개방이 필요하다는 방향성에는 전반적으로 동의하고 있었고 WTO Doha Round가 임박해오고 있는 상황에서 행정부에 권한을 위임하지 않았다가 미국의 무역과 경제 상황이 악화된다면 그에 대한 책임을 온전히 부담해야 하기 때문에 무역증진권한의 입법을 통해 책임을 공유할 필요가 있었다. 이 경우 직접적인 권한 행사 주체는 행정부이기 때문에 실패했을 때는 행정부에 책임을 전가할 수 있는데다 권한의 위임범위와 재량권을 더욱 축소하고 적극적으로 개입해 무역 정책을 수립할 수 있기 때문에 의회의 입장에서는 결과에 대한 직접적인 책임을 회피할 수 있다. 동시에 절차의 적용 요건을 강화하고 감독기구를 늘리고 등의 조치를 통해 협상과정에 의회가 능동적으로 개입할 수 있는 통로를 확대하고, 행정부가 의회의 의사와 반하는 협상을 할 여지를 줄이기 위해 재량의 범위를 제한했다. 하지만 2002년 무역법에서 의회의 무역정책수립에 대한 적극적인 개입 의지가 가장 강하게 드러난 부분은 주도적으로 무역개방으로 인해 피해를 입은 부문에 대한 보상정책을 수립했다는 점이다. 무역조정지원에서 규정한 정책들은 분배정책적인 특성으로 인해 수혜자들에게 공을 주장하기는 쉽지만 비난을 받거나 실패할 확률은 낮기 때문에 의회의 입장에서는 헌법상 수임기관으로서 무역정책을 적극적으로 수립하는 의무를 다하고 있다고 주장하기에 효과적인 조치였다. 의회는 이처럼 무역조정지원 법안을 통해 적극적으로 개입해 직접 무역정책을 수립하고 무역협정체결과정에서 개입을 증대하는 동시에 권한을 위임하지 않았을 경우 WTO Doha Round에서 미국의 협상지위 약화로 미국의 무역과 경제 상황이 악화될 수 있다는 우려 때문에 개입의 정도를 자제하고 행정부에 직접적인 무역협정체결권한을 위임하는 내용의 무역증진권한을 입법한 것이다. ; The purpose of this study is to analyze the dynamics of legislating the Trade Act of 2002 which granted Trade Promotion Authority, previously called fast-track negotiating authority, to the President of the United States focusing on the relations between the executive and Congress. Fast-track procedures were set forth in the Trade Act of 1974, stipulating that once the president formally submits a bill implementing a trade agreement concerning non-tariff barriers, both houses must vote on the bill without any amendments or filibusters. Being continuously in effect for 30 years, they have acted as a principal procedural mechanism for enacting trade agreements since 1970's. As the bipartisan consensus on free trade was eroded by the emergence of social issues like labor and environment in trade talks, however, they expired in 1994 due to failure to reach an agreement on how these issues should be handled. In 2002, a long and enthusiastic debate in both houses finally ended and the procedures were restored after a 8-year hiatus during the Bush presidency. If that is the case, in what circumstances was it possible for president Bush to regain the authority that president Clinton failed to win? The existing studies which conducted a comparative analysis on the roll-call voting that took place in 1997 and 2001 pointed out that representatives' consideration of constituents including pressure from interest groups and divided government had a noticeable effect in the different consequences. But besides these two, the respective members and party, a motive to reinforce the legislative branch as an institution has a impact on the behavior of Congress. This study aims to propose an explanation focusing on the third dimension from a view of interbranch politics. Then, responding to both domestic and international economic condition, demand from interest groups and constituents, and request from the executive branch, Congress approved the measure as a consequence of reflecting the intention to improve its status by increasing engagement with the process of decision making in the executive branch and minimize the loss such as the blame from the public or decrease in support accompanying failure of certain policy at the same time. In the early stage of legislation congressmen's consideration of constituents for winning reelection and partisan rivalry prevailed as other studies predicted. But as the actual legislative process progressed, the situation changed. With the Senate Democrats insisting on enactment of the omnibus trade bill incorporating TPA and two other bills, Andean Trade Preference Act and Trade Adjustment Assistance, concern over how Congress should engage with the establishment of generic trade policy spread throughout the party leaders. Congress agreed with the executive branch on the need of trade expansion and delegating the power to negotiate trade agreements for imminent WTO Doha Round because it would make them share the responsibility for possible deterioration in economy and trade in the future. The fact that the direct agent of exerting the authority was the executive branch had Congress make up its leeway as it could shift all the blame onto the other branch. Furthermore, when the economy got worse Congress could curtail the limit of the delegation and discretionary power given to the executive and establish trade policy firsthand. Delegating the authority, Congress expanded the means to actively involve in negotiating process by reinforcing its role of oversight, downsizing the discretionary power to prevent the executive from concluding the agreement despite congressional opposition, and tightening up the conditions to meet for the application of the fast-track procedures. But the most impressive part of the Trade Act of 2002 is TAA which reflected Congress's intension to play a leading role in making compensation policy for the people who got injured by trade. In conclusion, a broad agreement that TPA should be extended spread over Congress as it would consolidate the firm standing of the United States in trade talks including the upcoming WTO Doha Round. Moreover, Congress did not want to take full responsibilities or blame for the potential deteriorating economy. But at the same time Congress wanted to increase its engagement with trade policy making with the authority originally given to it by Constitution and its grown capabilities. The effort to restore the fast-track negotiating authority; TPA during the Bush presidency was feasible as it was linked to TAA bill, a measure taken by Congress to expand its involvement in trade policy making, and some steps to increase its engagement with the process of negotiation were taken. In other words, the Trade Act of 2002 was legislated as a result of Congress' struggle to balance between two motives, desire to avoid blame and increase its engagement with policy making. ; Master

Specifically, this study empirically analyzes how the quantitative and qualitative levels of the resident participation system influenced the democratic performance of local governments. The involvement of residents in the policy process of local government is an essential element for decentralization and actual operation of local autonomy, which is the complementary means of representative democracy. Resident participation plays a role in improving the practical problem-solving ability by preventing local government policies from violating reality. It is also known that civic involvement in the policy process plays a positive role in improving the responsiveness and effectiveness of administration. Therefore, local governments consider various measures to promote participation of residents. There are many ways to promote participation. Among them, the institutional introduction and continuous operation of the means of involvement of the residents has a positive effect on the invigoration of the involvement of the residents, as it provides the basis for the participation of the residents and broadens the scope of participation. In addition, the resident participation system can serve as a mechanism for maintaining and supporting appropriate resident participation in the policy process. Therefore, institutionalization of participation in local government is meaningful, and this study deals with civic involvement system based on such discussion. If so, is it good to have a lot of participation systems in the policy process at the basic level of local government? In reviewing previous studies, the introduction of a new resident participation system has the effect of activating resident participation or enhancing government performance. Therefore, it emphasizes the necessity of introduction to local governments that have not yet introduced the participatory system, and suggests methods for successful operation of the participant system. Previous studies have shown that the effects after the introduction of the new resident participation system or the qualitative nature of the participation system have a positive effect on the activation of resident participation and government performance. Point out that this will be a helpful option in terms of promoting participation or improving government performance. Yet another preliminary study suggests that the essential reason for local governments to introduce participatory participation systems may not be the expansion of participatory participation or the improvement of government performance. In other words, it is a formal means to show that local government officials are at work, or as a means of demonstrating that they are not falling behind in competition with other local governments. In such cases, the introduction of the resident participation system may have a negative impact on the welfare or government performance. Why is it important to measure government performance at the level of local government, and why do we consider the resident participation system as a major influencer of local government performance in this study? In general, government performance means making policy decisions that respond to citizens' policy needs and implementing them efficiently. Participation through the participatory system as a formal channel of participation not only guarantees the continuity of policy process participation, but can also reflect democratic, transparent, and responsive policies and public services because it can reflect diverse interests and communication. Therefore, the resident participation system is a channel and a means to guarantee continuous and stable resident participation. Most of the existing studies evaluate that participatory participation system acts as a catalyst for local autonomy and is justified in terms of improving government performance. Nevertheless, some studies question the effectiveness of the resident participation system, including the fact that the policy reflection rate through the resident participation system remains low at the local government's policy process and the effectiveness of the resident participation system is low. In addition, some previous studies have cited the inability to accurately measure the effect of citizen participation through resident participation system. In other words, it was difficult to determine whether the resident participation system directly influenced the government performance improvement or whether the resident participation system affected the society and the government performance improved as a result. However, it is clear that the purpose of the resident participation system is to enhance the democratic outcomes of local governments and ultimately improve the quality of life of residents. This fact is more evident when examining the Basic Ordinances on Participation of Residents, which are established by Ordinance by some local governments, which states that the purpose of the citizen participation is to promote administrative transparency and responsiveness. In other words, the purpose of the resident participation system is to improve the democratic performance of local governments. If so, it would be necessary to take a step further from the existing studies and use variables that can measure how transparent, democratic and responsive the administration has been due to the operation of the actual participatory system. Based on the above discussion, this study measured the quantitative level of the resident participation system introduced from 2005 to 2017 when the actual operation of the resident participation system was confirmed for 226 local governments in 2019. Next, the quality of the participation system was measured by categorizing the individual participation system based on the scope and intensity of participation. Type III systems are the ones with the highest intensity of delegation with the participation of the general population among the total residents participation system. Finally, the democratic achievements of local governments were divided into transparency, responsiveness and effectiveness of each basic local government. Transparency of local governments was measured by the Comprehensive Integrity Index, and responsiveness was measured by the total number of complaints handled per government official, and by the share of grievances and other complaints. Effectiveness was measured by the ratio of social welfare budget to the total budget and the quality of life index of residents. As a method of analysis, fixed effect panel analysis was used. The summary of the analysis is as follows. First, the increase in the quantitative level of the resident participation system for the local government at the basic level has a significant negative effect on the transparency of administration, while the increase in the share of the Type III resident participation system has a positive effect on the transparency of the administration. It was also confirmed that the transparency of administration did not decrease as the total number of operation of the resident participation system increased, but that the slope converged to zero when the quantitative level of the participation system reached a certain level. On the other hand, in the local governments at the County level, it was found that when the resident participation system fell short of the average number of operations, it had a negative effect on the transparency of the administration, while exceeding the average number of operations had a positively significant effect on the transparency of the administration. Second, the increase in the quantitative level of the resident participation system has a negative effect on administrative responsiveness, and the increase in the quality level has no statistically significant effect. However, the quantitatively appropriate level of the resident participation system, which improves administrative responsiveness, was confirmed in the case of the District level of local government. Although the total number of operation of the participatory system reached a certain level, it had a negative effect on administrative responsiveness, but beyond that level, it was found to have a positive and significant effect on responsiveness. Third, the increase in the quantitative level of the resident participation system has a positive effect on the effectiveness of administration. As the total number of operation of the resident participation system increased, both the proportion of social welfare budget and the quality of life of the residents increased. However, the statistical significance of the quantitative and qualitatively appropriate levels of the resident participation system to enhance the effectiveness of administration could not be confirmed. Based on this, the implications of this study are as follows. As discussed above, most existing studies analyze the effect of each participatory system implemented by local governments or their impact on the performance of specific sectors of local governments, or the effects of implementing participatory systems on individual municipalities. In addition, existing researches are only on comparative studies between local governments operating specific participatory systems and on the possibility of revitalization of participatory systems. In other words, there is a limitation in that not only the collective effects of various participation systems used in local government policy processes but also the effects of accumulated participation systems over time are not considered. In order to overcome these limitations, this study approached the resident participation system at the collective level and focused on the direct effect of the institutional factor on the government performance. Theoretical implications of this study are as follows. First, this study expanded the spatial and temporal scope of analysis to overcome the limitations of the analytical objects of previous studies. Second, the participation system was analyzed from various angles. Various types of typology of resident participation system suggested in the previous study were summarized, and it was confirmed that the effect on government performance also appeared differently according to the kind of participatory system. Third, this study attempted to measure government performance on a democratic level. Since the ultimate goal of the resident participation system is to realize local autonomy and to promote democracy, this paper analyzes the transparency, responsiveness, and effectiveness of administration focusing on the democratic dimension of government performance. Fourth, this study tried to make the analysis accurate by conducting fixed effect panel analysis that can control individual specificity such as endogenous local government's effect and time effect which was not controllable in the cross-sectional analysis used in the existing research. In terms of policy, the implications of this study are as follows. First, this study considered the quantitative and qualitative level of the resident participation system as a major influencing factor of government performance. Increasing the quantitative and qualitative levels of the resident participation system had a significant influence on the democratic performance of local governments. In particular, it was found that in order for the resident participation system to have its original effect, it must be an institution with an interactive attribute including a means for communicating with the government and delegating authority to the residents. Second, this study diagnosed the quantitative and qualitative levels of the local participation system, which is currently operated by local governments, and suggested the basis for the selection and concentration of future participation system. Third, although the administrative implications of the research on the performance of local governments are considerable, empirical research is insufficient. This seems to be because the performance of local governments is not only objectively measurable, but also limited in obtaining usable variables. Therefore, this study limited government performance to democratic performance, and analyzed total democratic performance of local government using various variables that can be measured. The limitations of this study are as follows. First, since the quantitative and qualitative levels of the resident participation system were measured at the collective level, the individual characteristics of each resident participation system could not be reflected in depth in measuring the quality level. Next, due to the limitations of the data available to local governments at the basic level, this study could only reflect the use of subjective indicators to measure democratic government performance such as 'quality of life of residents' in Seoul Metropolitan Government. In this regard, the results and methods of this study are based, and it will be necessary to approach in various ways how and in what circumstances the participation system has a significant effect on government performance. ; 본 연구의 목적은 주민참여제도가 지방정부의 성과에 미치는 영향력을 확인하는 것이다. 구체적으로는 지방정부가 도입하여 현재 시행 중인 주민참여제도의 양적 및 질적 수준이 지방정부의 민주적 성과에 어떠한 영향을 미쳤는지 실증적으로 분석하고자 한다. 지방정부의 정책과정에서 주민의 참여는 대의민주주의의 보완적 수단인 동시에 지방자치제도 도입의 궁극적 목적이라고 할 수 있는 지방분권과 주민자치의 실질적 작동을 위한 필수적 요소이다. 주민참여는 지방정부의 정책이 현실로부터 유리되는 것을 방지하여 실질적인 문제해결 능력을 향상시키는 역할을 한다. 또한, 정책과정에서 주민참여는 행정의 대응성과 효과성을 향상시키는 긍정적 역할을 한다고 알려져 있다. 그러므로 지방정부는 주민참여를 활성화하기 위한 여러 방안을 고민한다. 주민참여를 활성화하는 방안에는 여러 가지가 있다. 그중에서도 주민참여 수단의 제도적 도입과 지속적 운영은 주민참여가 발생할 수 있는 기반을 마련해주고 참여의 폭을 넓혀주는 역할을 하므로 주민참여 활성화에 긍정적 영향을 미친다. 더불어 주민참여제도는 정책과정에서 적절한 주민참여를 유지하고 지원할 수 있는 기제의 역할을 할 수 있다. 그러므로 지방정부 내 주민참여의 제도화는 의미가 있으며, 본 연구는 이러한 논의를 바탕으로 주민참여제도를 다루고 있다. 그렇다면 다양한 특성을 가진 주민참여제도들이 많이 시행되면 좋은 것일까? 선행연구를 검토해보면 새로운 주민참여제도의 도입은 주민참여를 활성화하거나 정부성과를 높이는 효과를 가져오기 때문에, 아직 도입이 안 된 지방정부에는 도입의 필요성을 강조하고, 시행 중인 지방정부에는 참여제도의 실질적 운영을 위한 방법을 제시한다. 그러므로 새로운 주민참여제도를 도입한 이후의 효과 또는 참여제도의 속성이 주민참여의 활성화 혹은 정부성과에 긍정적으로 유의미한 영향을 주었다는 기존의 연구결과들은 지방정부가 앞으로 더 많은 주민참여제도를 도입하는 것이 주민참여의 활성화나 정부성과 제고 측면에서도 도움이 되는 선택이 될 것을 말해준다. 하지만 또 다른 선행연구에 의하면, 지방정부가 주민참여제도를 도입하는 이유가 주민참여의 확대나 정부성과의 제고에 있다는 것은 부차적인 문제일 뿐이라고 주장한다. 그뿐만 아니라 지방정부의 관료가 일하고 있다는 것을 보여주기 위한 형식적 방법, 다른 지방정부와의 경쟁에서 뒤처지지 않고 있다는 것을 증명하는 하나의 수단으로 주민참여제도를 도입, 운영하기도 한다는 것이다. 이럴 때 주민참여제도의 도입은 오히려 주민 복리 또는 정부성과에 부정적 영향을 미칠 수 있다. 한편, 지방정부 수준에서 정부성과를 측정하는 것은 왜 중요하며, 본 연구에서 지방정부 성과의 주요 영향요인으로 주민참여제도를 고려하는 이유는 무엇인가? 일반적으로 정부성과는 시민의 정책적 요구에 반응하는 정책 결정을 하고, 이를 효율적으로 집행하는 것을 의미한다. 참여의 공식적 통로인 주민참여제도를 통한 주민참여는 정책과정 참여의 지속성을 보장할 뿐 아니라 다양한 이해관계와 의사소통을 반영할 수 있으므로 민주적이고 투명하며, 대응성 높은 정책과 공공서비스를 산출할 수 있도록 유도하는 역할을 할 수 있다. 다시 말해 주민참여를 지속적이고 안정적으로 보장할 수 있는 통로이자 수단이 바로 주민참여제도인 것이다. 대부분의 기존연구들은 주민참여제도가 지방자치의 촉매제 역할을 하며, 정부성과 제고 측면에서도 정당성이 높다고 평가한다. 그런데도 일부 연구들은 실제 지방정부의 정책과정에서 주민참여제도를 통한 정책반영비율은 낮은 수준에 머물러 있고, 주민의 참여제도에 대한 효능감도 떨어지는 등 주민참여제도의 효과성에 의문을 제기한다. 또한, 주민참여제도를 통한 주민참여의 효과를 정확히 측정할 수 없기도 하거니와 주민참여제도가 정부성과 제고에 직접적 영향을 미친 것인지, 주민참여제도를 통해 주민참여가 활성화됨으로써 사회에 영향을 미치고 결과적으로 정부성과가 향상된 것인지 판단하는 데 어려움이 있었다. 그러나 확실한 점은 주민참여제도의 목적이 지방정부의 민주적 성과를 제고하여 최종적으로는 주민의 삶의 질 향상에 있다는 사실이다. 이러한 사실은 일부 지방정부가 조례로 제정한 「주민참여에 관한 기본조례」를 살펴보면 더욱 확실히 나타나는데, 주민참여가 행정의 투명성과 대응성을 증진하고자 하는 목적이 있음을 명시하고 있다. 즉, 주민참여제도의 목적은 지방정부의 민주성 성과의 향상인 것이다. 그렇다면 기존연구에서 확인한 바와 같이 주민참여제도가 가지는 효과의 측정을 재정이나 예산자료를 활용하여 양적으로 측정한 연구에서 한 걸음 더 나아가 실제 주민참여제도 운영으로 인해 얼마나 행정이 투명하고 민주적이며 대응적으로 변화했는지를 측정할 수 있는 변수를 활용해야 할 필요가 있을 것이다. 이상의 논의를 바탕으로 본 연구는 2019년 기준 226개 기초단위의 지방정부를 대상으로 주민참여제도의 실제 운영이 확인되는 2005년부터 2017년까지 도입된 주민참여제도의 양적 수준을 측정하였다. 더불어 개별 주민참여제도를 참여의 범위와 강도를 기준으로 유형화하여 시행 중인 전체 주민참여제도 중 일반적 주민이 참여하면서, 권한위임의 강도가 가장 큰 참여제도들(제 Ⅲ형 제도)이 전체 시행 중인 주민참여제도에서 차지하는 비중을 주민참여의 질적 수준으로 측정하였다. 다음으로 지방정부의 민주적 성과를 각 기초 지방정부의 투명성, 대응성, 효과성으로 구분하고 종합청렴도지수, 공무원 1인당 전체 민원처리 건수, 고충 민원과 기타민원의 합이 전체 민원에서 차지하는 비중, 전체 예산대비 사회복지예산의 비중, 주민의 삶의 질 지수로 측정하였다. 분석방법은 고정효과 패널 분석을 활용하였다. 분석결과를 요약하면 다음과 같다. 첫째, 기초단위의 지방정부 전체를 대상으로 주민참여제도의 양적 수준의 증가는 평균적으로 행정의 투명성에 부정적으로 유의미한 영향을 미치지만, 제 Ⅲ형 주민참여제도 비중의 증가는 행정의 투명성에 긍정적으로 유의미한 영향을 미쳤다. 또한, 주민참여제도의 총 운영 건수가 증가할수록 행정의 투명성이 지속해서 감소하는 것이 아니라, 참여제도의 양적 수준이 일정 수준에 이르면 그 기울기가 0에 수렴함을 확인하였다. 한편, 군 단위의 지방정부에서는 주민참여제도가 평균 운영 건수에 미치지 못할 때는 행정의 투명성에 부정적 영향을 미치지만, 평균 운영 건수를 넘어서면 오히려 행정의 투명성에 긍정적으로 유의미한 영향을 미치는 것으로 확인되었다. 둘째, 주민참여제도의 양적 수준의 증가는 행정의 대응성에 부정적으로 유의미한 영향을 미치는 것으로 나타났으며, 질적 수준의 증가는 통계적으로 유의미한 영향력을 가지지 못하는 것으로 확인되었다. 그러나 구 단위 지방정부의 경우 행정의 대응성을 제고하는 주민참여제도의 양적 적정 수준이 확인되었다. 참여제도 총 운영 건수가 일정 수준에 이르기까지는 행정의 대응성에 부정적 영향을 미치는 것으로 나타났지만, 그 수준을 넘어서면 대응성에 긍정적으로 유의미한 영향을 미치는 것으로 확인되었다. 셋째, 주민참여제도의 양적 수준의 증가는 행정의 효과성에 긍정적으로 유의미한 영향을 미치는 것으로 나타났다. 주민참여제도의 총 운영 건수가 증가할수록 전체 대비 사회복지예산의 비중과 주민의 삶의 질 모두 증가하는 것을 확인하였다. 그러나 행정의 효과성을 제고하는 주민참여제도의 양적 및 질적 적정 수준의 통계적 유의미성은 확인할 수 없었다. 이를 바탕으로 본 연구의 함의를 제시하면 다음과 같다. 앞서 논의한 바와 같이 대부분의 기존연구들은 지방정부에서 시행하는 각각의 주민참여제도가 가지는 효과 또는 지방정부의 특정 부문의 성과에 미치는 영향력을 분석하거나, 개별 지방자치단체를 사례로 참여제도 시행의 효과 분석, 특정 참여제도를 운영 중인 지방정부 간 비교연구, 참여제도의 활성화 가능성에 관한 연구에 머무르고 있다. 다시 말해, 지방정부 정책과정에서 활용되는 다양한 주민참여제도의 집합적 효과뿐 아니라 시간이 흐름에 따라 누적된 참여제도가 미치는 효과 또한 고려하지 못했다는 한계가 있다. 본 연구는 이러한 한계를 극복하고자 집합적 수준에서 주민참여제도에 접근하였고, 주민참여제도라는 제도적 요인이 정부성과에 가지는 직접적 효과에 주목하였다. 구체적으로 본 연구의 함의를 이론적 측면에서 살펴보면 다음과 같다. 첫째, 본 연구는 선행연구가 가진 분석대상의 한계를 극복하기 위해 분석의 공간적, 시간적 범위를 확장하였다. 둘째, 주민참여제도를 다양한 각도에서 분석하였다. 먼저, 선행연구에서 제시한 주민참여제도의 다양한 유형화 방식을 종합적으로 정리하였으며, 어떤 속성을 가진 참여제도인지에 따라서 정부성과에 미치는 효과 또한 차별적으로 나타난다는 것을 확인할 수 있었다. 셋째, 정부성과를 민주적 차원에서 측정해보고자 하였다. 주민참여제도가 가지는 궁극적 목적이 바로 지방자치의 실현과 민주주의의 제고에 있으므로 정부성과의 민주적 차원에 초점을 두어 행정의 투명성, 대응성, 효과성을 분석하였다. 넷째, 본 연구는 기존연구에서 활용한 횡단면 분석에서 통제 불가능했던 개별 지방정부 고유의 효과 및 시간 효과와 같은 개별특이성을 모두 통제 가능한 고정효과 패널 분석을 시행함으로써 분석의 정확성을 꾀하고자 노력하였다. 다음으로 정책적 측면에서 본 연구의 함의는 다음과 같다. 첫째, 본 연구는 정부성과의 주요 영향요인으로서 주민참여제도의 양적, 질적 수준을 고려하였다. 주민참여제도의 양적, 질적 수준의 증가는 지방정부의 민주적 성과에 유의미한 영향력을 미치는 것을 확인할 수 있었다. 특히 주민참여제도를 설계할 때 제도가 본래의 효과를 가지기 위해서는 정부와 주민이 상호작용할 수 있고, 주민에게 권한을 위임할 수 있는 수단이 포함된 교호적 성격을 가진 제도여야 한다는 것을 알 수 있었다. 둘째, 기초 지방정부 수준에서 개별 주민참여제도가 가지는 속성이 민주적 정부성과에 영향을 줄 수 있음을 확인한 바와 같이 지방정부가 현재 시행 중인 주민참여제도 전반의 양적 및 질적 수준을 진단하여 향후 주민참여제도의 선택과 집중에 도움이 될 수 있는 근거를 제시하였다. 셋째, 지방정부 성과에 관한 연구가 가지는 행정학적 함의는 상당한데도 실증연구는 부족한 실정이다. 이것은 지방정부의 성과가 객관적으로 측정하기 어려울 뿐 아니라 활용할 수 있는 변수를 획득함에서도 한계가 있기 때문으로 보인다. 그래서 본 연구는 정부성과를 민주적 성과로 한정하였고, 이를 측정할 수 있는 다양한 변수를 활용하여 지방정부의 민주적 성과를 총체적으로 분석하였다. 한편, 본 연구의 한계는 다음과 같다. 먼저, 주민참여제도의 양적 및 질적 수준을 집합적 수준에서 측정하였기 때문에 질적 수준의 측정에 있어 각각의 주민참여제도가 가지는 개별적 속성을 심층적으로 반영하지 못했다. 다음으로 본 연구는 기초단위의 지방정부에서 활용 가능한 데이터의 한계로 인해 '주민의 삶의 질'과 같은 민주적 정부성과를 측정하는 주관적 지표 활용을 서울특별시 자치구를 대상으로밖에 반영하지 못했다. 이러한 부분에서는 본 연구의 Background Low-quality services of emergency medical institutions, unclear function of institution classification, and overcrowding of emergency departments (ED) of regional emergency medical centers (regional centers) have been major problems in the Korean emergency medical services system (EMSS). In 2015, the Middle East Respiratory Syndrome (MERS) outbreak spread from patients waiting for hospitalization in the overcrowded ED. The MERS outbreak was an event that revealed the vulnerability of EMSS and opened the policy window to solve the problem of EMSS in Korea. Several policies for EMSS improvement were implemented after the 2015 MERS outbreak focusing the improvement of emergency medical services (EMS) delivery system and ED infection control. This study investigates the policy processes for improving emergency EMSS and infection control program after the MERS outbreak. The purpose of this study was to examine the policy processes regarding EMSS from the view of policy actors and draw lessons for improving the EMSS in Korea. 2. Methods A mixed method was utilized to identify and explain the complex subject of the policy processes of Korean EMSS during and after the MERS outbreak in 2015. As a quantitative study, changes in EMSS after MERS were investigated according to the WHO's model of a national health system infrastructure. Literature review and data analysis of Korean Health Insurance Service (NHIS) database were conducted. In Korea, the NHIS covers all citizens. A quantitative analysis was performed on 16,965,755 cases using ED during 2014-2016. In-depth interviews were conducted on 30 experts, who were involved in the emergency medical policy process, including clinicians, policy experts, and hospital management experts. The total interview time was 55 hours and 4 minutes. Changes in EMSS and the policy process after the MERS outbreak were evaluated from the view of policy actors. In this study, quantitative data was interpreted qualitatively, and independent qualitative evaluation was conducted, as well. Therefore, this research is a mixed-methods study focusing on qualitative research. SAS version 9.4 was used for the quantitative analysis and NVivo 12.0 was used for the qualitative analysis. 3. Results The quantitative analysis results showed that in the area of EMS delivery system, the human resource of ED and number of regional centers have been increased and facility, equipment, and manpower standards have been revised in order to expand emergency medical resources. As a result, the number of medical personnel and emergency intensive care units in regional centers increased and profitability of ED improved as well. The number of monthly ED visits temporarily decreased during the MERS outbreak but then recovered afterward. As ED overcrowding indicators were emphasized in the evaluation of EMS institutions, monthly mean ED length of stay of regional centers was decreased. However, despite the emphasis on providing critical care, transfer rate of severe emergency patients was not decreased. In the policy processes of EMS, experts evaluated that EMS delivery system was set up as a pseudo-agenda and exploration and comparison of policy alternatives were not sufficiently carried out. As a result, the physicians did not comply with the policy implementation and policy goals were not achieved. In the area of ED infection control program, the human resources for infection control and the number of isolation unit of ED were increased. Budgets for emerging infectious disease management were increased and profitability of infection control was also improved. The EMS Act was revised to respond to emerging infectious diseases and indicators related to infection control were strengthened in evaluation of EMS institutions. In the qualitative research, experts said that since the ED infection control program was such an intuitive and obvious problem, it was easy to become a policy-agenda. Despite the resistance of small hospitals, ED infection control program was implemented by powerful policy measures such as the revision of the Law. As a result, policy goals of expanding the infection control resources and improving the infection management environment were able to be achieved. From results of observing EMS policy process, the following characteristics of policy actors were found. First, there was difference of opinions within the physician subgroup as well as between government and medical professionals. ED staff, other department staff, and hospital executives, who have different views on policy alternatives could have all served as veto points in the policy process. Second, while the EMSS expert organization, which was an unofficial participant in the emergency medical policy process, could have played both roles of cause group and sectional group in the policy process, their sectional position has been emphasized, thereby weakening their insider status during policy process. Third, policy actors understood the publicness of EMS differently in terms of its ownership and function. The ED staff insisted that government support is needed because emergency medical care is based on public interest, however, some staffs were unwilling to provide less profitable cares, leading to conflict. Main characteristics of the emergency medical policy process that made it difficult to successfully implement are as follows: First, there was lack of consideration regarding variation of EMSS in Korea, such as distribution of medical resources among different regions, incentives to hospitals, and understanding of functional variations in ED. Second, the problem of the EMS delivery system was a problem of the low quality of emergency medical care. Third, the lack of professionalism in some physicians has lowered the capacity of emergency medical care, as well as trust between patient and doctor, therefore made the problem more difficult to solve. 4. Discussion Based on the analysis of the policy processes of the EMSS after the MERS outbreak in Korea, following lessons are suggested. First, setting the goals of EMS from the perspectives of citizen is warranted. The final performance goal should focus on improving health status of citizen and satisfaction with emergency medical care. Second, to close the gaps among policy actors in understanding policy content and policy process, actors should work together to explore the root causes of the problems and establish a policy agenda together. Third, a policy alternative should be causal in solving the problems in EMSS considering variation of EMS. Fourth, compliance with policies could be secured by internal persuasion among policy actors with proper incentives and reasonable punishment, especially EMSS expert organization. Fifth, policy outcomes should be evaluated based on both policy output and side effects together to identify policy impact. Sixth, policy governance regarding EMSS should be established and the roles of EMSS expert organization should be strengthened as the cause group rather than sectional group. This study examined the emergency medical policy processes from the view of policy actors through the 2015 MERS outbreak in Korea.
