The historical experience of India in search of its own concept of punishment is unique. It was greatly influenced by the country's colonial past and the Anglo-Saxon legal culture as well as the philosophical, religious, ethno-linguistic, caste, tribal and other factors. The Indian Penal Code of 1860 uses an original penological construct and a system of punishments. It was influenced by the historical and theoretical factors described in this article, by criminal policy in British India and by its post-colonial development. The country's penological discourse, influenced by the criminal law doctrine of the metropolitan state, has two distinct features. Firstly, it is the diversity of types of punishment and judge's discretion in choosing them to individualize liability. Secondly, the humanitarian orientation of the institute of punishment and the reduction in the number of crimes punishable by death penalty. English lawyer Th.B. Macaulay, the creator of the Indian Penal Code of 1860, considered general prevention, or deterrence, to be the main goal of punishment, while specific prevention through the physical isolation of the criminal and his correction was viewed as a complimentary goal. It was important for the colonial criminal policy to obtain tangible results from the penological theory and the practices of punishment in order to suppress the local ritual crimes (cult «thuggism») and traditional ritual sacrifices (sati ritual). After a large-scale sepoy rebellion and the spread of dacoity crimes, the repressive functions of punishment began to prevail over other penological theories. The so-called «white terror» was commonly used against political opponents fighting for religious freedoms and independence of colonial India. Modern India is a good example of the controversial experience of the search for the effective criminalpenological theories that is a considerable addition to the classic (westernized) criminology. The special historical concepts and practices of punishment in the countries of the «global south», including India, are now studied by the new field of «Southern Criminology ». The Indian government is promoting a complex criminal-penological approach to counteracting domestic crimes and transnational threats. © 2018, Baikal National University of Economics and Law. The October Revolution of 1917 profoundly influenced the course of the Indian freedom movement in multiple ways. It gave impetus to Indian political aspirations, widened the base of the freedom struggle by making industrial workers and peasants active participants, and endowed the movement with a progressive outlook. The revolution's principles resonated deeply among the people and leaders of the Indian freedom movement. In fact, many of the values enshrined in our Constitution, adopted post-independence, were inspired by the lofty ideals of the Russian Revolution. The most important event in Russia, influencing the course of the freedom movement in India, was the October Revolution in 1917. The revolution, its ideology, V. I. Lenin and his deep involvement with the issues confronting the people of the East, the transformation of Russia post 1917, and the overall attitude of the Soviet government and the Comintern towards India's freedom struggle deeply influenced both the people and the leaders of the Indian freedom movement. Though the multiclass national movement did not get converted completely to the cause of socialism, the fact remains that the legacies of the October Revolution influenced the course of the freedom struggle in multiple ways. Some of its legacies got imprinted in the Constitution that India adopted post-independence. The socialist component of the Constitution of India did not happen by accident. It was the outcome of the massive ideological churning that took place within and outside the Indian National Congress and that which by no small measure was triggered by the emancipatory ideals of the Russian Revolution of 1917. The Constitution of the Republic of India, adopted on 26 January 1950, was based on a set of principles and ideas that would achieve socialist reconstruction of society through democratic means. The right balance of the proper socio-economic rights with guaranteed democratic and civil liberties, based on the majority principle along with the right of minority opinions to exist and flourish in a secular state became the cornerstones of the Constitution that independent India adopted. Many of these values were clearly inspired by the lofty ideals of the Russian Revolution.

The article discusses the plight of women - surrogate mothers from the lower castes of India, which is the result of legislative regulation of surrogate motherhood. The low cost of services of surrogate mothers and legal regulation advantageous for the genetic parents, attract clients from abroad, making India the world centre of surrogacy. The consequence is a humiliating situation of surrogate mothers, their vulnerability, and contrary to the declared democratic values enshrined in the Constitution of India. The protection of democratic values and consolidation of the old caste are natural of India, which is also enshrined in the legislation. In November 2016, a new bill prohibiting surrogacy on a commercial basis was presented. Currently the bill is pending. The article shows that if the bill is passed, it will solve some of the problems associated with the humiliated position of surrogate mothers, but will not solve problems related to 1) the autonomy of surrogate mothers; 2) protection of the rights of women of the lower castes applying for the job of a surrogate mother. In addition, the bill may cause new social and economic problems. Firstly, the introduction of the bill will hit "reproductive tourism" in India, seriously reducing the industry. Secondly, the ban on surrogate motherhood on a commercial basis will be a significant part of the medical staff of IVF clinics. A new bill will require considerable powers of Executive authorities and police, since the ban applies on a well-developed industry in medicine, having gained international fame. Otherwise, the introduction of the bill may create a black market of surrogacy. The article provides a number of alternative measures to solve problems caused by "reproductive tourism", such as diagnosis, medical aid to surrogate mothers after childbirth, control over the content of surrogate mothers and the protection of their rights. Similar measures have already been successfully used in the field of experiments with the participation of the people, and have international legal framework. ; В статье рассматривается положение женщин - суррогатных матерей из низших каст Индии, которое обусловлено законодательным регулированием суррогатного материнства. Низкая стоимость услуг суррогатных матерей и законодательное регулирование, выгодное для генетических родителей, привлекают клиентов из-за рубежа, сделав Индию мировым центром суррогатного материнства. Последствиями этого является униженное положение суррогатных матерей, их незащищенность, что противоречит декларируемым демократическим ценностям, закрепленным в Конституции Индии. Защита демократических ценностей и закрепление старой кастовой системы характерны для Индии, что также закреплено в законодательстве. В ноябре 2016 г. был представлен новый билль, запрещающий суррогатное материнство на коммерческой основе. В настоящее время билль находится на рассмотрении. В статье показано, что, если билль будет принят, он хотя и решит некоторые проблемы, связанные с униженным положением суррогатных матерей, но не решит проблем, связанных: 1) с автономией суррогатных матерей; 2) защитой прав женщин низших каст, прибегающих к работе суррогатной матерью. Кроме того, билль может вызвать новые социальные и экономические проблемы. Во-первых, внедрение билля сильно ударит по «репродуктивному туризму» в Индию, серьезно сократив отрасль. Во-вторых, запрет на суррогатное материнство на коммерческой основе оставит без работы немалую часть медицинского персонала ЭКО-клиник. Новый билль потребует немалых сил органов исполнительной власти и полиции, поскольку запрет распространяется на хорошо развитую отрасль в медицине, получившую международную известность. В противном случае внедрение билля может спровоцировать появление теневого рынка суррогатного материнства. В статье приводится ряд альтернативных мер с целью решить проблемы, вызванные «репродуктивным туризмом», такие как диагностика, оказание медицинской помощи суррогатным матерям после родов, контроль за содержанием суррогатных матерей и защитой их прав. Подобные меры уже давно и успешно используются в сфере экспериментов с участием людей и имеют международную законодательную основу.

This is an article on the phenomenon of strategic partnership, which is understood to be a special type of geopolitical and geo-economic cooperation, which, in the author's opinion, might become a fundamental element of the current globalized world's composition in the very near future. A general characteristic is given to the theoretical underpinnings of the issue, which brings us to the fact that there are no concrete definitions for the term "strategic partnership", as well as no criteria that would allow for separating the scientific perception of the term from its purely decorative application in political discourse. The author insists that each and every specific strategic partnership is developed and sustained based on a unique combination of supporting factors, and as a result the study of such processes requires using the appropriate individualized (ideographical) methods. The article offers an example in the form of analyzing one of the most telling cases of this sort – the genesis and development of strategic partnership relations between Russia and India. This study examines the emergence of "special relations" between the two nations, which have deep historical roots, while analyzing the specific profile of this relationship during the time of British dominion, and looking into the process of establishing contacts between intellectual circles. Considerable focus is dedicated to these relations turning into bilateral political cooperation after India declaring its independence, and to the dynamic of said cooperation. Based on the experience of Russia and India, certain general conditions for building strategic partnerships are formulated. While analyzing the future prospects of the strategic partnership between the Russian Federation and India, the author considers the geopolitical significance of the "Moscow-Deli- Peking" triangle, as well as the potential it bears in terms of transforming Eurasia into a territorial entity tied together by large-scale infrastructural and environmental protection projects.

In order to generalize foreign experience in the field of state price policy, the practical experience of the Republic of India on the use of state price regulation tools has been considered. A review of the legislation has been conducted, the mechanism has been revealed, and the pros and cons of certain state price control measures have been highlighted, in particular the use of a list of vital goods, the establishment of a mandatory maximum market price for all packaged goods, and the protection of the competitive environment of the national market. The results of the state policy of price regulation, as well as the dynamics of key indicators of the Indian economy over the past five years have been analysed. Further prospects and directions of development of the economy of the Republic of India have been outlined.The scientific research methodology has been based on a systems approach. Depending on the nature of the problems being developed, the methods of causal analysis, economic-statistical, monographic, abstract-logical and comparative have been applied. The regulatory legal acts of the Republic of India, statistics, electronic resources, as well as operational primary information of the ministries and departments of the Central Government of India make up the information base of the study.It has been concluded, that the state-built model of price regulation provides protection not only to consumers, ensuring the availability of necessary goods, but also to producers, ensuring redistribution of profit in their favor. The problems of the functioning of individual instruments of the state pricing policy have been indicated, however, based on statistical data, a generalized conclusion has been made, that they are not critical and do not undermine the country's economy or the free functioning of the market. The prospects for the use of certain elements of the state price policy of India in the Russian economy have been evaluated. ; С целью обобщения зарубежного опыта в сфере государственной ценовой политики рассмотрен практический опыт Республики Индии по использованию инструментов государственного регулирования цен. Проведен обзор законодательства, раскрыт механизм, а также выделены плюсы и минусы тех или иных государственных мер контроля над ценами, в частности использование перечня жизненно необходимых товаров, установление обязательной максимальной рыночной цены на все упакованные товары, защита конкурентной среды национального рынка. Проведен анализ результатов государственной политики регулирования цен, а также динамики ключевых показателей индийской экономики за последние пять лет. Обозначены дальнейшие перспективы и направления развития экономики Республики Индии.Научная методология исследования базирована на системном подходе. В зависимости от характера разрабатываемых проблем применены методы причинно-следственного анализа, экономико-статистический, монографический, абстрактно-логический, сравнительный и другие методы. Информационную базу исследования составляют нормативно-правовые акты Республики Индии, статистические данные, электронные ресурсы, а также оперативная первичная информация министерств и ведомств Центрального Правительства Республики Индии.Сделан вывод, что выстроенная государственная модель регулирования цен дает защиту не только потребителям, обеспечивая доступность необходимых товаров, но и производителям, способствуя перераспределению прибыли в их пользу. Обозначены проблемы функционирования отдельных инструментов государственной ценовой политики, однако на основании статистических данных сделан обобщающий вывод, что они не являются критичными и не подрывают экономику страны или свободное функционирование рынка. Даны оценки перспектив применения отдельных элементов государственной ценовой политики Республики Индии в отечественной экономике.

The article analyzes the transformation of the policy of the ruling Bharatiya Janata Party (BJP) in India towards religious minorities. The evolution of the attitude of Hindu nationalists towards Muslims is investigated — from denying the right of Muslim political representation to the intention to demonstrate the multiconfessional nature BJP. Special attention is given to the motives that induce a significant minority of Muslims to vote for the party, many of whose leaders at various times were noted for Islamophobic statements. The case of cooperation between BJP and Indian Shi'a community is being considered separately. The final part of the article is devoted to the situation after 2014 Indian general election. There is a number of issues that directly affect the interests of the Muslim community and require a reaction from Muslims within BJP — the abolition of the special status of Jammu and Kashmir, The Citizenship (Amendment) Act, 2019 and the decision on the Ayodhya dispute. The conclusion is dedicated to the prospects of the relations between Indian Muslims and the ruling party. ; В статье анализируется трансформация политики правящей в Индии Бхаратия джаната парти (БДП) применительно к религиозным меньшинствам на примере мусульманской общины. Исследуется эволюция позиции индусских националистов в отношении мусульман — от отрицания права религиозных меньшинств на политическое представительство до стремления продемонстрировать мультиконфессиональный характер собственной партии. Особое внимание уделяется мотивам, побуждающим значительное меньшинство мусульманских избирателей голосовать за партию, многие деятели которой в разное время допускали исламофобские заявления. Вместе с тем обозначается характер связи мусульман с другими политическими партиями и движениями, прежде всего с Индийским национальным конгрессом (ИНК). Рассматривается политическая ситуация в отдельных штатах, противоречия внутри самой индийской мусульманской общины и особенности агитационных кампаний националистов по привлечению на свою сторону избирателей- мусульман. Отдельно исследуются причины поддержки БДП индийскими шиитами. Анализируются особенности биографий политических деятелей- мусульман, в разное время состоявших в партии. Также изучается ситуация, сложившаяся после победы БДП на общенациональных выборах в 2014 г. и прихода к власти Нарендры Моди. В связи с этим ставится ряд актуальных вопросов, напрямую затрагивающих интересы мусульманской общины и требующих реакции мусульман внутри БДП. Это прежде всего отмена особого статуса Джамму и Кашмира, изменение законов о гражданстве и решение вопроса о строительстве храма Рамы в Айодхье. В заключении говорится о перспективах взаимоотношений между индийскими мусульманами и правящей партией при условии дальнейшего сохранения власти БДП на общенациональном уровне.

The article focuses on two contradictory trends of Muhammad Shah's reign in India (1719–1748), namely, the increasing political decline of the once mighty Mughal Empire along with a palpable cultural growth of its capital. ; В статье ставится вопрос о соотношении двух противоречивых тенденций, проявившихся в период правления в Индии падишаха Мухаммад-шаха (пр. 1719–1748): нарастания признаков политического упадка некогда могущественной Могольской империи и — одновременно с этим — позитивных перемен, происходивших в культурной жизни ее столицы.

The book is focused on the potentials, actual practice, as well as restraints of the trilateral interaction among Russia, India and China (the RIC format functioning since 2002). This subject is presented through the analysis of the global and regional roles being played by each of the three countries, as well as through juxtaposition of similarities and differences featuring their respective international interests.

The political and economic context for India based on the results of the Regional Comprehensive Economic Partnership Agreement (RCEP) signed in November 2020 is considered. The benefits of strengthening economic cooperation for the participating countries from its signing are characterized. The hypothetical advantages for India in the case of its entry into RCEP are analyzed. In connection with country's opting out of RCEP the authors have highlighted three segments of reasons for studying (political, legal and economic) that caused such India's decision. Among the political reasons for India's opting out of RCEP the problem of the Indo-Chinese border conflict over disputed territory escalating is emphasized. Among the legal reasons that determined opting out of the treaty, the issues of investment policy and intellectual property outside the World Trade Organization frameworks are noted. The economic reasons offset the benefits of RCEP for India are investigated. The connection between all three segments of causes is demonstrated. The experts' forecasts is evaluated for India's entry into third place in the world economy in terms of the gross domestic product contribution and the prerequisites for this are studied. It is concluded about the possibility of achieving the goal if a number of conditions are met and a set of necessary measures is carried out. ; Рассмотрен политико-экономический контекст для Индии по результатам подписанного в ноябре 2020 г. Проанализировано влияние Октябрьской революции 1917 г. на индийское освободительное движение. Отмечено, что она дала импульс индийским политическим устремлениям, расширила базу освободительного движения, превратив промышленных рабочих и крестьян в активных участников борьбы, и наделила движение прогрессивным мировоззрением. Принципы революции вызвали резонанс среди рядовых борцов за независимость и лидеров индийского освободительного движения. Сделан вывод о том, что многие ценности, закрепленные в Конституции Индии, принятой после обретения независимости, были вдохновлены высокими идеалами российской революции. Сама революция, ее идеология, В. И. Ленин и его глубокая озабоченность проблемами, стоящими перед народами Востока, преобразования в России после 1917 г., отношение советского правительства и Коминтерна к борьбе за независимость Индии оказали сильнейшее воздействие как на народ, так и на лидеров индийского освободительного движения. Хотя многоклассовое национальное движение не преобразовалось в социалистическое, фактом остается то, что наследие Октябрьской революции повлияло на ход освободительной борьбы. The world system is undergoing a period of transformation and refragmentation, the disintegration of a single political space into spheres of infl uence formed by the great powers. India, which forms such a sphere around itself, is faced with the problem: a serious economic and military lag behind China, trying, following the ideasof the Indian elites, to achieve hegemony in Southeast and South Asia and the Indian Ocean region. To fend off these attempts, India has put forward two concepts: Security and Growth for All in the Region (SAGAR) and the Indo-Pacifi c Oceans Initiative (IPOI). The article is devoted to the analysis of the problems that New Delhi is trying to solve with the help of these concepts, and the consideration of the very process of their implementation. The author notes that both SAGAR and IPOI are not developed strategic documents, but a type of 'vision' typical for Indian foreign policy discourse. At the same time, the active assistance provided by India to the countries of the Indian Ocean region within the framework of SAGAR demonstrates that Indiaperceives these countries as part of its sphere of infl uence and is trying to tie them to itself both politically and economically. On the contrary, the concept of ITOI aims to form partnerships and informal alliances with ASEAN countries and Australia. The author believes that Indian regional concepts are of interest to Russia, allowing it to use the Indian experience and to participate in Indian initiatives. ; Мировая система в настоящий момент переживает период трансформации и рефрагментации ‒ распада единого политического пространства на сферы влияния, образующиеся вокруг великих держав, которые с их помощью обеспечивают экономическую и военную безопасность. Индия при попытке сформировать собственную сферу влияния столкнулась с рядом проблем, основной из которых стало серьезное экономическое и военное отставание от Китая, пытающегося, как считают индийские элиты, добиться гегемонии в Юго-Восточной и Южной Азии и регионе Индийского океана. Чтобы парировать эти попытки, Индия выдвинула две концепции: «Безопасность и развитие для всего региона» (SAGAR) и «Индо-Тихоокеанскую инициативу» (IPOI). Статья посвящена анализу задач, которые Нью-Дели пытается решить при помощи этих концепций, и рассмотрению процесса их реализации. При этом активная помощь, оказываемая Индией странам региона Индийского океана в рамках SAGAR (передача кораблей и вооружений, предоставление кредитов и оказание помощи во время пандемии COVID-19), демонстрирует, что Индия воспринимает эти страны как часть своей сферы влияния и пытается привязать их к себе политически и экономически. Напротив, концепция IPOI нацелена на формирование партнерских и неформальных союзнических отношений со странами АСЕАН и Австралией и представляет из себя «партнерство на основе общих проблем», предполагая добровольное участие стран Индо-Тихоокеанского региона в их разрешении. Автор приходит к выводу, что индийские региональные концепции представляют интерес для России, позволяя ей, с одной стороны, использовать индийский опыт для оформления своей сферы влияния, с другой ‒участвовать в индийских инициативах.
