There are now more than 5,000 ethnic and 2,500 language groups in the world, while there are virtually no monoethnic states left. Almost all states have interethnic problems, which determines the severity of the problem and its relevance. The relevance of the topic is: 1) to gain experience of Brazil, Canada, India in solving the problem of the constitutional status of indigenous peoples; 2) in emphasizing the need to provide them not only with language rights, but also with an appropriate level of well-being; 3) in the ability to help stabilize the domestic political situation in Ukraine and strengthen relations with neighboring countries and the European Union. The purpose of the article – an attempt to conduct a comparative analysis of the constitutional status of the indigenous peoples of Brazil, Canada and India on the basis of studying the relevant provisions of the Constitutions, special international documents, scientific papers. The Conventions of the United Nations and the International Labor Organization of 1957, 1982, 1989 «On protection and integration of indigenous and other peoples leading tribal and semi-tribal lifestyles in independent countries», «On indigenous peoples and peoples leading tribal way of life in independent countries» were considered and analyzed. An analysis of the Constitutions and Constitutional Acts of Brazil, Canada and India, which reflect the reaction of these states to these Conventions, was also conducted. There are similar and distinctive features in the formation of the constitutional status of the studied ethnic groups. Similar features: centuries-old cruel treatment of the colonizers, the corresponding influence of international documents on the design of the constitutional status, the introduction of their requirements into the constitutions. Distinctive features: different attitude of the colonizers to the aborigines – expulsion and destruction in Brazil, enslavement, forced assimilation in Canada, the fight against tribes living in the mountains, forests and ...

The resources of Customary Forest play an important role for Talang Mamak Indigenous People to survive. The exploitation of the forest by private company and investor has caused a violent conflict. The situation of the indigenous people becomes worsen since local government does not fully protect their rights on the forest. Even, Local government tends to defend private company and investor in addressing the conflict. Customary forest of Talang Mamak indigenous people is in the oligarchs grip and conflict of interest with their elder. The Indigenous people are in crossroad, to preserve or to release their heritage and right. This study aims to determine the efforts of Talang Mamak Indigenous People to maintain their existence in the customary forest resources battle with private company and investor. This study used qualitative descriptive method. The data collection were documentation analysis and other relevant literature. This study used Theory of Oligarchy (Winters 2011) as grounded theory. The result found that the efforts of the indigenous people to fight for their rights getting weak. Political participation is the participation of society or certain parties in political activities. And when politics is defined as a policy and when we associate with public participation then we will arrive at how public participation in making a policy. Politics Partisipas actively in policy-making becomes an absolute requirement, since participation would give birth control community over the course of government. This study aimed to describe the political participation of indigenous village of Kuta in public policy formulation in the Village District Karangpaningal Tambaksari Ciamis district. Research method used is descriptive qualitative method. In this study the techniques of data collection was done by in-depth interviews (Indeepth Interview), direct observation and documentation, purposive sampling technique is a technique used for sampling. Data analysis using the method of interactive analysis and validity of data used is the technique of data triangulation. The results of this study show that, this result shows that the growing political participation of indigenous peoples in the village of Kuta in policy formulation can be viewed in two processes. First, political participation in the process of internal policies in indigenous communities, and second, political participation in policy formulation processes at the village level. Political participation in indigenous communities, are more closed to the elitist model, Kuncen was instrumental in setting policy, while in access planning, policy control indigenous communities are not involved at all, it is in because of the strength of tradition Kuncen positioned as the main actor who issued the customary policy . While political participation in policy formulation process stages or levels in the Village Karangpaninggal already running with the following democratic values. This means that in this process of political participation open space area . However, space for perpartisipasi is not utilized optimally. This is because the human resources and the level of understanding of the political partisitisipasi low.

An analysis of Australia's governmental policy towards indigenous peoples has been done. The negative consequences of the colonization of the Australian continent have been revealed, in particular, a significant reduction in the number of aborigines due to the spread of alcohol and epidemics, the seizure of their territories. It is concluded that the colonization of Australia was based on the idea of the hierarchy of human society, the superiority and inferiority of different races and groups of people, and accordingly - the supremacy of European culture and civilization. It is demonstrated in the creation of reservations for aborigines and the adoption of legislation aimed at segregating the country's white and colored populations and assimilating certain indigenous peoples into European society, primarily children from mixed marriages. It has been proven that, considering the aborigines an endangered people and seeking to protect them from themselves, Europeans saw the way to their salvation in miscegenation - interracial marriages and the isolation of aboriginal children from their parents. This policy has been pursued since the end of the XIX century by the 1970s and had disrupted cultural and family ties and destroyed aboriginal communities, although government circles positioned it as a policy of caring for indigenous Australians. As a result, the generation of aborigines taken from their parents and raised in boarding schools or families of white Europeans has been dubbed the "lost generation". The activity of A.O. Neville who for more than two decades held the position of chief defender of the aborigines in Western Australia and in fact became the ideologist of the aborigines' assimilation policy has been analyzed. He substantiated the idea of the biological absorption of the indigenous Australian race as a key condition for its preservation and extremely harshly implemented the policy of separating Aboriginal children from their parents. It is concluded that the policy towards the indigenous population of Australia in the late XIX – first third of the XXcentury was based on the principle of discrimination on racial grounds. ; Здійснено аналіз урядової політики Австралії щодо корінного населення. Розкрито негативні наслідки колонізації австралійського континенту, зокрема значне зменшення чисельності аборигенів внаслідок поширення алкоголю й епідемій, захоплення їхніх територій. Зроблено висновок, що колонізація Австралії ґрунтувалась на ідеї ієрархії людського суспільства, вищості і нижчості різних рас і груп людей, а відповідно – зверхності європейської культури і цивілізації. Її унаочненням стало створення резервацій для аборигенів і прийняття законодавства, спрямованого на сегрегацію білого і кольорового населення країни і асиміляцію окремих представників корінного народу в європейське суспільство, у першу чергу – дітей від змішаних шлюбів. Доведено, що, вважаючи аборигенів вимираючим народом і прагнучи його захистити від самого себе, європейці бачили шлях його порятунку у міцегенації – міжрасових шлюбах та ізоляції дітей аборигенів від батьків. Така політика здійснювалась з кінця XIXст. до 1970-хрр. і призвела до порушення культурних і родинних зв'язків і руйнування общин аборигенів, хоча урядові кола позиціонували її як політику турботи про корінних австралійців. У зв'язку з цим, покоління аборигенів, яких забрали від батьків і передали на виховання в інтернати або сім'ї білошкірих європейців, отримало назву «втраченого покоління». Розкрито діяльність А.О.Невілля, який більше двох десятиліть обіймав посаду головного захисника аборигенів у Західній Австралії і фактично став ідеологом політики їхньої асиміляції. Він обґрунтував ідею біологічного поглинання корінної австралійської раси як ключової умови її збереження і надзвичайно жорстоко впроваджував політику відділення дітей аборигенів від їхніх батьків. Зроблено висновок, що політика щодо корінного населення Австралії кінця XIX – першої третини ХХст. будувалась на принципі дискримінації за расовою ознакою.

Визначено історичні, соціально-економічні, політичні детермінанти становлення та розвитку освіти корінного населення у США і Канаді; показано взаємозв'язок особливостей функціонування системи освіти корінного населення з процесами колонізації північноамериканських земель європейцями; розкрито сутність політики асиміляції корінного населення, яка породжувала расову дискримінацію корінного населення країн, посилювала їх маргіналізацію і деградацію; закцентовано увагу на діяльності шкіл-інтернатів для дітей корінних народів як однієї з форм освітньої асиміляції, показано їх негативний вплив на виховання дітей корінних народів; виявлено, що сучасною тенденцією освітньої політики щодо корінних народів є перехід від політики асиміляції до політики інтеграції; показано, що сучасна освіта корінних народів у США і Канаді базується на принципах мультикультуралізму, демократії, гуманізму, на націоналістичному підході, урахуванні освітніх потреб та потреб ринку праці. ; The article identifies and analyzes the determinants of formation and development of the education of indigenous peoples of the United States and Canada, identifies the features of functioning of boarding schools and their impact on the education and training of indigenous peoples' children. In order to achieve the aim, we used a retrospective analysis that helped track the emergence and development of the education of the indigenous peoples of the United States and Canada; structural-logical analysis which contributed to the study of legislative provision for the indigenous population; structural-functional analysis which allowed determining the specific features of education of indigenous peoples in the United States and Canada, to find out the features of the functioning of boarding schools; systemic-structural and comparative analysis which contributed to the definition of the common and distinctive in the countries under study. It has been established that the problem of indigenous education in the US and Canada has deep historical roots since the discovery of the American continent; the main determinants of development of indigenous peoples education in the North American countries are socioeconomic, political, historical, socio-cultural factors which are closely linked to the colonization of American lands by Europeans; the policy of indigenous assimilation was carried out in various forms, in particular, a policy of paternalism, the main purpose of which was the so-called "civilization of wild nations" and the policy of termination, which was aimed at eliminating the personal status of indigenous people, the abolition of federal care and waiver of obligations to provide financial assistance; the policy of indigenous assimilation proved to be ineffective, gave rise to racial discrimination of the indigenous people of the country, increased their marginalization and degradation. It was found out that the policy of assimilation was applied to educational policies concerning the indigenous population; boarding schools for indigenous children have become one of the forms of educational assimilation that have irreparably damaged the indigenous culture, their purpose was to destroy the values, principles, customs, and the language of indigenous peoples. It is revealed that the current tendency in educational policy is transition from assimilation policy to integration policy. It is shown that modern education of indigenous peoples in the USA and Canada is based on the principles of multiculturalism, democracy, humanism, nationalist approach, taking into account educational needs and labor market needs.

Для захисту й просування інтересів корінних народів дуже важливо розвивати політичні інститути, які дозволяють їм відкрито виражати свою думку і будуть надавати їм певного впливу в канадському поліетнічному суспільстві. Незважаючи на те, що виникнення таких інститутів обумовлено особливістю політичних реалій Канади, їхній досвід може бути застосовано і для інших країн світу. ; Для защиты и продвижения интересов коренных народов очень важно развивать политические институты, которые позволяют им открыто выражать свое мнение и будут предоставлять им определенное влияние в канадском полиетничному обществе. У статті досліджено основні шляхи врегулювання правового статусу корінних наро­дів України. Розглянуто основні законопроекти стосовно правового регулювання про­блематики корінних народів в Україні, проаналізовано роль іноземного досвіду в про­цесі їх підготовки. Визначено подальші перспективи законодавчого закріплення пра­вового статусу та механізму реалізації права на самовизначення і представництво корінних народів України, зокрема в аспекті підготовки змін до Розділу Х Конституції України. ; В статье исследуются основные пути урегулирования правового статуса коренных народов Украины. While studying disintegration tendencies in Northeast India (the armed struggle of the peoples of Bodo, Kuki-chin) the processes of ethnopolitical integration and disintegration were identified rater as ethnotransformational than as ethnoevolutionary because they affect whole ethnic groups, not only their components, cause the changes in the ethnicity of the whole ethnos and are accompanied by reviewing the borders of the states in which these ethnic groups reside. At the same time, they contain signs of the ethnoevolutionary process – they cause changes in some components or parameters of an ethnic group (language, culture, consciousness, ethno-cultural environment). An example of an analysis of the ethnonational situation in South-East India demonstrates the mixed ethnoevolutionary and ethnotransformational effects of disintegration.A comparative analysis of the essence and political and legal content of the national instrument of the scheduled tribes in India and the international legal mechanism for the protection of the rights of autochthonous ethnic groups – indigenous peoples is fulfilled. The similarity of the status of adivasi and indigenous peoples has been established, their common and distinctive features have been studied. Both are called upon to contribute to the preservation and protection of "positively discriminating" ethnic groups that are in a more vulnerable socio-economic, cultural situation due to their dependence on the traditional way of life. India has not sighned the ILO No. 169 Indigenous and Tribal Peoples Convention, instead created its own mechanism of scheduled tribes aimed to counteract the ethnopolitical disintegration of the country and to neutralize the separatist demands of radical ethnic groups for the withdrawal from the state. ; На прикладі вивчення дезінтеграційних тенденцій в Північно-Східній Індії (збройної боротьби народів бодо, кукі-чін) визначено процеси етнополітичної інтеграції та дезінтеграції скоріше як етнотрансформаційні, оскільки вони зачіпають етноси, а не лише їх компоненти, призводять до зміни етнічної належності цілих етноспільнот та супроводжуються переглядом кордонів держав, в яких проживають ці етноси. Водночас вони містять ознаки етноеволюційного процесу – спричиняють зміни в деяких компонентах або параметрах етносу (мова, культура, свідомість, етнокультурне середовище). На прикладі аналізу етнонаціональної ситуації в Південно-Східній Індії продемонстровано змішаний етноеволюційний та етнотрансформаційний вплив дезінтеграції.Здійснено порівняльний аналіз суті та політико-правового наповнення національного інструменту зареєстрованих народів Індії та міжнародно-правового механізму захисту прав автохтонних етносів – корінних народів. Встановлено подібність статусу адівасі та корінних народів, досліджено їх спільні та відмінні риси. Обидва покликані сприяти збереженню та захисту, «позитивно дискримінуючи» етноси, які перебувають у більш вразливому соціально-економічному, культурному становищі внаслідок залежності від традиційного способу життя. Індія не приєдналася до Конвенції МОП «Про корінні народи, які ведуть племінний спосіб життя в незалежних країнах» № 169, натомість створила власний політико-правий механізм зареєстрованих народів, покликаний протидіяти етнополітичній дезінтеграції країни і нейтралізувати сепаратистські вимоги радикально налаштованих на вихід зі складу держави етносів. В кінцевому підсумку його застосування, починаючи з середини 20 ст., сприяло забезпеченню макронаціональної єдності, етнополітичної інтеграції такої територіально розрізненої та етнічно строкатої держави, як Індія.

Food security is still becoming a crucial issue in developing countries nowadays, either in urban or rural areas. There are many factors triggered this condition, such as the increase in population pressure and conflict, privatization and changing tenure arrangements, poverty, social differentiation and also environmental degradation. It's undeniable that food security is a multidimensional problem, especially for people who lived in rural or isolated areas. In Mentawai Islands, a district located in the western part of Indonesia, the indigenous people depend on forest product (sago) as their main source of food. However, since 2012, the government has destroyed their food culture by establishing the 'National Food Security Improvement Program' and conducting the agricultural intensification as well as establishing 600 hectares of new rice fields in six sub - districts; South Pagai, North Pagai, Sikakap, South Sipora, North Sipora, and South Siberut. This study is conducted comprehensively using the Food Security and Vulnerability Analysis (FSVA) to understand and describe the exact profiles of food-insecurities and vulnerable households. Furthermore, it also identified the risks and vulnerabilities of food consumption in Mentawai communities. Findings depict that shifting or transforming the food culture from sago to rice is a serious issue because socio-cultural aspects influence it and surely the government has to make a parallel policy that can accommodate the people needs, not only prioritize the national development agenda. ; Food security is still becoming a crucial issue in developing countries nowadays, either in urban or rural areas. Акцентується увага на створенні правових основ для регулювання та реалізації державної політики щодо забезпечення права кримськотатарського народу як корінного народу України. ; The article deals with the issue of determination of the legal status of Crimean Tatar people as indigenous people of Ukraine. The current state of the legislative base concerning the regulation of Crimean Tatar issue is researched. Attention is paid to the creation of the legal base for regulation and implementation of the state policy in ensuring the right of Crimean Tatar people as indigenous people of Ukraine.

Literary critics began to pay more attention to highlighting the particularities of specific Indian nations, which led to the emergence of such a phenomenon as "the literary nationalism of American Indians". The researcher began to focus on the analysis of the indigenous literary critique dynamic development, because it reflected the traditional perception of Native reality, made possible to trace the patterns of Native identity structure in literature. The attention of researchers has shifted from identifying the features of authenticity, hybridization, intercultural influences on the search for intellectual, cultural, political, and historical origins of Indigenous literatures. The literary nationalism of indigenous peoples is aimed to support the intellectual and political sovereignty of indigenous communities. Researchers associate a striking shift in priorities with the return of most Native Americans to the faith of their great-grandfathers. In this regard, the question arises as a non-radical reader should become accustomed to and understand the texts of indigenous writers. Proceeding from this, the author of the article is convinced that in the Indian critique the past and present are virtually indistinguishable, they actively coexist, becoming "a reflection" of the national consciousness of indigenous peoples. The indigenous society of Lampung is divided into two large groups; Saibatin and Pepadun. Both societies has many diversities in origins, so the local government arrangements is stimulated in the consultative mechanism represented by punyimbang at each level within the representative agency called Perwatin ( Proatin ). With anthropologic analysis , this paper would like to emphasize the meaning , role and function of institutional of Perwatin and Kepunyimbangan for indigenous peoples of West Lampung, its relevance to contemporary of democratic values, and the opportunities and the existence of the traditional institutions in the implementation of the reform of Regional Autonomy Law . According to the findings of the research, prowatin and punyimbangan are still very important to be implemented in local communities in West Lampung. This is case due to democratic values and local wisdom in prowatin institutions and kepenyimbangan accordance with the conditions of the community and institutional environment in which it arise.
