The paper clarifies the concept of local elections and identifies their types and features. The legal basis of elections to local self-government bodies is analyzed. The financial and organizational and legal support of local elections is described. The conditions and procedure for registration of candidates for deputies of local councils and for the position of village, settlement, city mayor have been studied. Campaigning is described as one of the stages of local elections. The peculiarities of voting and establishing the results of local elections have been clarified. Proposals for improving the legislation on local elections have been developed. ; У роботі уточнено поняття місцевих виборів та виявлено їх види і ознаки. Проаналізовано правову основу виборів до органів місцевого самоврядування. Охарактеризовано фінансове та організаційно-правове забезпечення місцевих виборів. Досліджено умови і порядок реєстрації кандидатів у депутати місцевих рад та на посаду сільського, селищного, міського голови. Охарактеризовано передвиборну агітацію як один з етапів місцевих виборів. З'ясовано особливості голосування та встановлення результатів місцевих виборів. Розроблено пропозиції щодо удосконалення законодавства про місцеві вибори.

The article analyzes one of the debatable issues related to the violation of human rights - the practice of the use of the death penalty. Today, the death penalty institution is predominantly recognized as inhuman and is not used as a punishment. However, despite the marked tendency to abolish the death penalty, some countries not only have a legislative basis for this institution, but also use it in practice. The study found that the institution of the death penalty, although it is considered a violation of fundamental human rights and is actively condemned by international organizations, is used both in countries with authoritarian political regimes and with democratic ones. One such state is the United States of America. The practice of this country on the application of such punishment as the death penalty is analyzed. It is established that, in contrast to the beginning of the 19th century, when the death penalty in the United States was used for a significant part of crimes, today this type of punishment is not overly common. Legal norms to some extent limit the use of the death penalty in relation to certain categories of citizens, however, official statistics indicate the annual execution of about thirty relevant sentences. The analysis showed a wider practice of using the death penalty as a punishment in authoritarian countries. Moreover, the analysis of statistical data in them is difficult due to the official prohibition of disclosure established by the authorities. Unlike states with a totalitarian political regime, in authoritarian countries, in practice, it is possible to be exempted from such a punishment as the death penalty by amnesty on behalf of the head of state. The study also showed the vigorous activity of international organizations, in particular the UN, in the field of promoting the complete abolition of the death penalty in the world. The article analyzes the political and legal aspects of the functioning of the Institute of Ukrainian presidency in the system of the higher bodies of state authority. It is determined that the quality of the head of state depends on the constitutionally established powers, normative vested rights and responsibilities as well as the individuality of a person occupying the president's position. The methodological basis of the study was the use of the historical method which allowed to identify the factors that influenced on the changes of Ukrainian polity in the period of independence, comparative method to determine the level of confidence changes of the presidents of Ukraine at the beginning of their cadence, a year later and in the year of re-election, and the system method helped determine the prospects for the development of the Institute of Presidency in Ukraine, taking into account the chosen model of the parliamentary republic. It is proved that the socio-political perception of the Ukrainians, excessive individualization and paternalism in relation to the position of the President of Ukraine directly affect the distribution of authority in the country, concentrating it in the hands of a single person. As a result of the analysis, it was possible to determine the mechanisms that can help Ukraine to avoid the processes related to the processes associated with usurpation of power, accumulation of powers in one decision-making centre at the present stage of democratization: a definitive constitutional distribution of powers, reducing the political dependence of the law enforcement system from the commander-in-chief, eliminating "immunity to corruptions" of the Ukrainians, preservation the Independence of the media and creation a nationwide state development strategy. The article considers the problems of the establishment and development of the institute of reconciliation in the criminal legislation of Ukraine. The rules and recommendations of international legal acts on this issue have been considered. The concept of contract as a criminal legal category and international experience of conclusion of contracts in criminal proceedings is considered. The study of the norms of the Criminal Code, the Code of Criminal Procedure and specialized literature on this subject shows that the application of conciliation procedures in criminal legislation corresponds to the world trends that have developed in recent decades. UN recommends the use of informal dispute resolution mechanisms, including mediation, arbitration or local practice, to promote reconciliation and redress for victims (para. 7 of the Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power). The EU Council Decision "On the Situation of the Victim in Criminal 14 Proceedings" contains obligations for all EU countries to extend mediation in criminal proceedings and to ensure that any transaction between the victim and the offender reached in the mediation process is accepted. Since the important task of our State is to join the EU, one of the requirements is to implement and apply European legislation into national legislation. The article is devoted to the historical and philosophical analysis of the unique and paradigmatic role of the H.S. Skovoroda Institute of Philosophy, National Academy of Sciences of Ukraine in the philosophical life of Ukraine for 75 years since its foundation. The authors outline its role in the process of institutionalizing philosophy in Ukraine from the time of the domination of the dogmas of Soviet Marxism to the introduction of current research traditions in modern Ukrainian philosophy. The continuity and peculiarities of the change of generations of researchers in the field of philosophy and the involvement of Ukrainian philosophical thought in the world intellectual discourse are studied. The article's authors reveal the gradual formation of the Kyiv philosophical tradition, the role of the Institute's leadership in the style and nature of scientific research of certain periods. Particular attention is paid to the institutionalization of new research areas at the Institute, such as political philosophy, philosophy of language and speech, which belong to the leading paradigm of modern philosophy. Attention is paid to the cooperation of the Institute with domestic scientific and educational institutions, its international relations. The status of the leading professional publications, which became significant both in Soviet times and during independence, is highlighted. The article deals with historical development of the human rights institute through concept positions of the most popular figures of the researched period. Creative heritage of Georg Wilhelm Friedrich Hegel has been analyzed. The subject of his works was a human being, his rights and freedoms as well as the role in the state. According to Hegel the person as a member of society and a part of the state should bear responsibility for his/her acts to avoid general arbitrariness and violation of the rights and freedoms of other people which could have a big impact on the development of the researched institute. John Locke has basic principles of human rights in his works such as freedom, equality and the right to life, the state is some guarantor for achievement of protection of these rights. The philosopher presented a new idea that the person could protest against the government which could not satisfy the interests of population and replace it with a new one which could accomplish this goal. Integrity of the philosopher regarding restriction of the arbitrariness of the state power and its division in parliamentary, federal and executive for satisfaction of people's interests. Samuel von Pufendorf developed the idea of natural law and duties of the person and citizen. Pufendorf considered representation of natural law in the person's behavior and friendly features which he/she had and described that he/she had to behave the way to benefit society. Charles Louis de Montesquieu drew particular attention to interpretation of difference between positive and natural law by concluding that (positive) law could be fair only if it complied with natural law. Jean-Jacques Rousseau stated that laws should be created by people to keep the highest virtue which are represented in freedom and equality lying in economic and legal development of the state.

In the article, the author explored ways to ensure the fulfillment of obligations in the historical aspect. The author came to the conclusion that the institution for ensuring the fulfillment of obligations owes its origin to the law of Ancient Rome, where a harmonious system of such methods was created. The first mention of securing compliance can be found in the Justinian Code of 529. The types of obligations that can be secured by a deposit are determined. The ratio of the deposit and advance is established. The legal consequences of the violation and the termination of the obligation secured by the deposit are analyzed. Attention is drawn to the presence of gaps in civil legislation regarding the regulation of deposits and ways to fill them by introducing appropriate changes to the Civil Code of Ukraine are suggested.Keywords: provision of fulfillment of obligations, deposit, functions, legal nature ; У статті автором було досліджено способи забезпечення виконання зобов'язань в історичному аспекті. Автор прийшов до висновку, що інститут забезпечення виконання зобов'язань завдячує своїм походженням праву Стародавнього Риму, де було створено струнку систему таких способів. Перші згадки про забезпечення виконання зобов'язань можна віднайти ще в Уложеннях Юстиніана 529 р. Визначаються види зобов'язань, що можуть бути забезпечені завдатком. Установлюється співвідношення завдатку та авансу. Аналізуються правові наслідки порушення та припинення зобов'язання, забезпеченого завдатком. Звертається увага на наявність прогалин у цивільному законодавстві щодо регулювання завдатку та пропонуються шляхи їх заповнення шляхом внесення відповідних змін до Цивільного кодексу України.Ключові слова: забезпечення виконання зобов'язань, завдаток, функції, правова природа.

The article is devoted to the research of the institute of responsibility of public servants in the system of service law of Ukraine. It is emphasized the importance of legal support for the functioning of the public service system, in particular the regulation of the mechanism of responsibility of public servants. It is noted that the institution of responsibility is a mandatory element of the system of every branch of law, including official, because it is this legal entity whose task is to ensure the proper implementation of the legal status of every public servant. Considering the responsibility of public servants from the standpoint of social and legal content, the author emphasizes that the views of scholars on this issue are very different, as they reflect the palette of the worldview of each individual researcher and characterize the various aspects of public relations. In a wide sense, responsibility is a legal relationship between public authorities in the person of its authorized bodies and subjects of law, for the accurate and conscientious implementation of the requirements contained in the relevant rules of law. Analyzing the scientific views of scholars on responsibility, it is emphasized that in general, the liability of public servants should be understood as a procedurally established application of coercive measures of coercive influence on a particular public person for committing an offense. It is stated that the content of the legal nature of the institute of disciplinary responsibility of public servants, in particular in the system of service law of Ukraine, which needs proper research, remains important and extremely necessary for law enforcement and human rights activities of authorized subjects. Based on the analysis of scientific achievements of local and foreign scholars on the legal system, it is emphasized that currently there are different approaches to understanding the systemic structure of legal branches, in particular some scholars remain on the views developed in our time, while others try to adapt European researchers-lawyers on the system of law on modern Ukrainian realities. As a result, the author emphasizes that we can now state that each branch of law, which we call general, special or special law, always contains a list of legal norms in the appropriate relationship and sequence and thus ensuring the ability of the subject of rule-making, law enforcement or human rights activities to achieve the desired result – to create or harmonize existing social relations, giving them the status of legal relations.
