The author analyses the relationship between the constitutional law and the political reality. Using the historical material of the German constitutional legal practice to analyze this relationship, the author concludes that a good constitution can function solely in the setting of a good political culture of state's citizens. Der Autor geht von der These Carl Schmitts vom Bürgerkrieg als dem Wesen der liberalen Demokratie aus. Innere und äußere Sicherheit vor einem Kriegszustand blieben immer instabil. Der Krieg auf dem Balkan habe nun gezeigt, daß Europa nicht mehr (wie von 1945 an bis dahin) in der Lage sei, mit dem Einsatz sekundärer Mittel einen Konflikt zu lösen, da es über solche im Rahmen der bisherigen europäischen Integration nicht koordiniert verfüge und zu ihrem Einsatz auch gar nicht bereit sei. Der neue Balkankrieg müsse daher Anstoß zu einer Umorientierung der europäischen politischen Integration sein. Für das Erreichen einer Stabilität gebenden europäischen politischen Größe sei dabei eine "republikanische Korrektur der liberalen Demokratie" (S.99) unabdingbar. (SOI-Clw)

In the course of its history, Europe has structured itself by means of two models. The first was based on the territorial expansion of regional forces that used violence to break down the resistance of their weaker neighbors and establish the balance of power. In this way, at least temporarily, the way was paved for more radical changes in their polities. This model was in use until the end of World War II. The second model has been built around European integration. The aim of this process has not been the expansion of regional powers and the territorial conquest of their neighbors; it is based on the initiative of the weak to join the organizations that can satisfy their interests and goals. The process of integration excludes coercive methods. However, there is certain asymmetry in the relationship between the center and the periphery (the strong and the weak). The countries that belong to the center define the membership standards for the 'periphery' and evaluate their implementation. The 'central' countries are in a better position than the peripheral ones since the process of integration bolsters their collective identity, while the weaker states - by accepting the standards of stronger countries - have to alter their original identity. These are the basic considerations for understanding the process whereby Slovenia is forming a new national security network, both internally and on the international level, and for following Slovenia's endeavors to participate in European integration and NATO and the European Union.
