The value of intellectual property is now growing by the day in view of globalization of economic processes and integration of the Russian Federation into the world economy. The need for development of legislation in the field of intellectual property, improvement of legal mechanisms to protect the intellectual deliverables is dictated by a market economy, changes in social relations, as well as the inconsistency of regulatory enforcement, which prevents from proper implementation of the individual's rights in the sphere of intellectual property realization. Over the past decade, the entrepreneurial activity has demonstrated an increase in a number of facts of recognition of the intellectual property created by an employee as work for hire (WFH). Under these procedures, both employers and employees often make mistakes that subsequently lead to such items being non-protectable. The point is that the current legislation has no procedure or criteria to recognize the intellectual property created by employees as WFH. However, failure to observe the procedures regulated by tax legislation when recognizing the results of an employee's intellectual activity as WFH poses a high risk for instituting administrative action against the employer. In this paper, we will try to determine the procedure and criteria for recognizing the results of an employee's intellectual activity as WFH.
Summary The discussion on the fundamentals that legitimise intellectual property often focuses on two main approaches: iusnaturalists and utilitarists. The former argue that it is possible to justify ownership of intellectual creation by relying on John Locke's liberal property theory. The latter converge around the so-called "progress clause" and the incentive argument. This work analyses whether or not intellectual property can be justified on the basis of such approaches, concluding that, given the paradoxes identified, these are insufficient. ; Resumen La discusión sobre los fundamentos que legitiman la propiedad intelectual se suele centrar alrededor de dos grandes planteamientos: iusnaturalistas y utilitaristas. Los primeros sostienen que es posible justificar la propiedad sobre la creación intelectual recurriendo a la teoría liberal de la propiedad formulada por John Locke. Los segundos convergen en torno a la llamada "cláusula del progreso" y el argumento de los incentivos. En este trabajo se analiza si es posible o no justificar la propiedad intelectual sobre la base de dichos planteamientos, concluyendo que, dadas las paradojas identificadas, éstos resultan insuficientes.
This document makes an analysis of intellectual property from its origins to the chapters in Free Trade Agreements (WIPO-plus), which includes a review of the role of different international organizations concerned with intellectual property, a review of discussions that are at the origin of the WTO inmatters related to intellectual property (TRIPS), an analysis of intellectual property as a market failure. We propose that Intellectual Property has evolved from inexistent protection to rigid legislation that favors the interests of the economies of economic powers. It also suggests that the evolution of the Intellectual Property system contradicts the initial objectives of promoting scientific production, artistic creation and transfer of technology to promote development, turning it into a monopoly of knowledge ; En este documento se analiza la Propiedad Intelectual (PI) desde sus orígenes hasta los capítulos en los Tratados de Libre Comercio (ADPIC-plus), se hace un recuento del papel de diferentes instituciones internacionales relacionadas con la PI, se revisan las discusiones que dieron origen a la OMC en referencia a la PI (ADPIC), se estudia la Propiedad Intelectual como una falla demercado, se plantea que la evolución del sistema de PI contradice los propósitos iniciales de fomentar la producción científica, la creación artística, y la transferencia de tecnología para estimular el desarrollo, convirtiéndose, en cambio, en una herramienta para el monopolio del conocimiento.
Este artículo da cuenta de la evolución de la protección de los derechos de autor (IPR, por sus siglas en inglés) con relación a las acciones antipiratería realizadas por el gobierno mexicano. La 'guerra contra la piratería' está fundada en la estructura legal del comercio mundial. El argumento central del autor es que la criminalización de la piratería no resulta de un proceso de interés nacional que tenga como objetivo promover e intensificar la propiedad intelectual o el estado de derecho, sino que surge de una perspectiva punitiva emanada de las redes de intereses internacionales y actores transnacionales propios del neoliberalismo global. ; This article examines the evolution of intellectual property rights (IPR) protection in relation to anti-piracy actions undertaken by the Mexican government. The 'war against piracy' is based on the world trade legal structure. The author's central argument is that the criminalization of piracy is not the result of a process of national interest which has as its objective the promotion and intensification of intellectual property rights or the rule of law but, rather, emerges from a punitive perspective emanating from networks of international interests and transnational actors characteristic of global neoliberalism.
Today's debates around the exhaustion doctrine it's characterized by the confrontation between old and new conceptions of the intellectual property system. Notwithstanding, such tensions do not differ from the longstanding coexistence between the property and market rules. This review article aims to identify the origin of the exhaustion's explanatory theories in the United States, the European Union and Colombia targeting the current tensions of this figure. ; Las tensiones que actualmente sufre la figura del agotamiento de los derechos de propiedad intelectual se han caracterizado como una pugna entre viejas y nuevas concepciones del sistema de regulación de la propiedad intelectual; sin embargo, estas no son nada distinto a las expresiones actuales de la antigua convivencia entre las explicaciones de propiedad y de mercado. The article analyses the impact of legislation and new technologies on libraries in relation to intellectual property. This regulation is governed by the Political Constitution of Colombia, the international treaties ratified by Colombia, the laws, decrees and other norms that regulate the use and assurance of intellectual property, applicable to the relations of generation of knowledge, cooperation and association that carry out in development of the functions the Autonomous University of Bucaramanga.
Introduction: Protection of intellectual property rights using current legal mechanisms has as its main objective to encourage invention and innovation, facilitating commercial exploitation. On the other hand, free competition has the mission of promoting, protecting and guaranteeing the freedom to compete in order to ensure the efficient functioning of the market and consumer welfare. Methods: The authors completed a bibliographic review using journal databases and collections of Honduran and foreign laws regarding intellectual property and the right to free competition with respect to exclusive rights. Results: We show characteristics, differences, points of divergence and convergence between the two Honduran legal bodies and consider the importance of achieving a balance of the common goals pursued by these legal figures. Conclusion: There exists a need to make legislation known to the public and follow up with continuous improvement of such legislations to promote the collective well-being of the country, companies, and consumer; this resulting, ideally in the introduction of greater competitiveness to the market, promotion of innovation, a more efficient economy and above all to ensure consumer welfare; a right that the State must guarantee. ; Introducción: La protección de los derechos de propiedad intelectual usando los mecanismos legales actuales, tiene como su principal objetivo incentivar la inventiva y la innovación, facilitando la explotación comercial. Por otra parte, la libre competencia tiene la misión de promover, proteger y garantizar la libertad para competir a fin de procurar el funcionamiento eficiente del mercado y el bienestar del consumidor. Métodos: Se hizo revisión bibliográfica en bases de revistas y en colección de leyes hondureñas y extranjeras referentes a la propiedad intelectual y el derecho de libre competencia con respecto a los derechos exclusivos. Desarrollo: Se muestran características, diferencias, puntos de divergencia y convergencias entre ambos estamentos legales de Honduras, en donde se considera la importancia de lograr un equilibrio de los fines comunes que persiguen estas figuras jurídicas. Conclusión: Debe socializarse y seguir una mejora continua de dicha legislación para procurar el bienestar colectivo (país, empresas, consumidores) introduciendo mayor competitividad al mercado, impulso de la innovación e invención, economía más eficiente, y sobre todo velar por el bienestar del consumidor, derecho que el Estado debe garantizar.
The intellectual property as legal space brings the disciplines of Copyright and Industrial Property that make up a set of legal rules that aim to protect the artistic creator, scientist and businessman. It is in the commercial that intellectual property has transpired, from the origins of the property until its recognition of intangible assets, which in turn become the object of likely international trade to be exported and imported, and that necessarily have to be legalized by the competent authority. In Venezuela, all customs and tax administration system provide the competent authority with the power to authorize the entry and exit of those goods protected by intellectual property, which are traded internationally. This study aimed to analyze the system of protection of Intellectual Property Rights in Venezuelan customs legislation. For this, it conducted a documentary legal research, descriptive. The technique used as a methodology for the analysis of the results is deductive. The investigation concludes that the customs system, recommendation, you must activate a series of laws to protect intellectual property rights violated; application is questioned in this investigation mechanisms. The recommendations were about the reform of the law by the National Assembly, the restructuring of the system through collaboration of public bodies and the scientific community for the strengthening of knowledge on the subject. ; El derecho de propiedad intelectual como espacio jurídico, reúne las disciplinas de Derecho de Autor y Propiedad Industrial que conforman un conjunto de normas jurídicas que tienen como finalidad proteger al creador artístico, científico y al comerciante. Es precisamente en lo comercial que la propiedad intelectual ha trascendido, desde los orígenes de la propiedad hasta su reconocimiento sobre bienes inmateriales, que a su vez se convierten en objeto del comercio internacional susceptibles de ser exportados e importados, y que necesariamente tienen que ser legalizadas por la autoridad competente. En Venezuela, la aduana y todo el sistema de administración tributaria constituyen la autoridad competente con la facultad para autorizar la entrada y salida de aquellos bienes protegidos por la propiedad intelectual, los cuales son objeto del comercio internacional. El presente estudio tuvo como objetivo analizar el sistema de protección del Derecho de Propiedad Intelectual en la legislación aduanera venezolana. Para esto, se llevó a cabo una investigación jurídica documental, de tipo descriptiva. La técnica utilizada como metodología para el análisis de los resultados es la deductiva. De la investigación realizada se concluye que el sistema aduanero, por recomendación internacional, debe activar una serie de mecanismos legales a fin de proteger los derechos intelectuales vulnerados, aplicación que se pone en duda en la presente investigación. Las recomendaciones fueron en torno a la reforma de la ley por parte de la Asamblea Nacional, la restructuración del sistema mediante la colaboración de los entes públicos y a la comunidad científica para el reforzamiento de los conocimientos sobre la materia.

From bibliographical analysis, legislation and interviews to key informants, a proliferation and complexity of devices is identified: the Law of Seeds and the various attempts to modify it; attempts to patent transgenic seeds; the disputes over the collection of the RR soybean royalties; the bilateral contracts signed by Monsanto and the producers in relation to the Intacta soybean; and the resolutions tending to reduce the own use of the seeds. These processes did not occur in a linear way and were crossed by tensions and conflicts. The problematic is still open and, therefore, the seeds in Argentina are an element of important debates and multiple disputes. ; El objetivo de este artículo es examinar la forma en que se expresan los procesos de cercamiento jurídico en torno a las semillas en Argentina. Throughout history the university has undergone academical, scientifical, administrative and political changes due to the influence of its national and international environment, in accordance with the predominant economical model, however it has not been able to keep up with the socio economical development dynamics, and even worse, while the productive sector is permanently innovating, the university sticks to its professionalizing tradition, sometimes even ignoring the real social demands, forming professionals in traditional careers with obsolete knowledge and limited possibilities to compete in the market, with a very few exceptions.Universities that resist change and permanent improvement are destined to be illegitimate and limited in their own growth. They will have very few social reasons to exist as such. The challenge is to rethink itself according to the knowledge society. This, of course, implies the assumption of serious commitments in different areas, beginning with an analysis of its strengths and weaknesses, overcoming those weaknesses and consequently assuming its fundamental role of producing, transmitting and publishing knowledge. The university has to responsibly perform its fourth mission that is added to the traditional activities of teaching, research and extension, defined in terms of "usage, application and exploitation of knowledge".The university has the historical responsibility of surpassing the old paradigm of simply transmitting knowledge, of passively observing reality and describing social, economical and environmental problems. It must challenge its own tradition constructing a proactive leadership defined by innovation and the intensive usage of new technologies, both in the educative function as well as in the intangible assets mediated by intellectual property and strengthening the productive and social tissue. Ha seguido arrastrando un rezago en función de la dinámica del desarrollo socio-económico y, lo que es peor, mientras el sector productivo se innova permanentemente, la universidad se aferra a la tradición profesionalizante, incluso desconociendo la demanda real; formando profesionales en carreras tradicionales con conocimientos en franca obsolescencia y limitadas posibilidades de competir en el mercado, salvando desde luego las escasas excepciones.Las universidades que se resisten al cambio y a la mejora continua, están destinadas a la deslegitimización y la autolimitación en su propio desarrollo, y tendrán muy pocas posibilidades en su justificación social de existir como tales. El reto está planteado y es repensarse a sí mismas de conformidad a la denominada sociedad del conocimiento. Desde luego que esto implica asumir compromisos serios en diferentes ámbitos; empezando por conocer sus fortalezas y debilidades, superar las debilidades y, consecuentemente, asumir el papel fundamental de producir, transmitir y difundir el conocimiento, desarrollando con responsabilidad la cuarta misión, que se suma a las tradicionales de docencia, investigación y vinculación, definiéndola en términos de "uso, aplicación y explotación del conocimiento".La universidad tiene la responsabilidad histórica de superar el viejo paradigma de simple transmisora de conocimientos, observadora pasiva de la realidad y descriptora de problemas sociales, económicos y ambientales. Debe desafiar su propia tradición; construyendo un liderazgo propositivo, definido por la innovación y el uso intensivo de las nuevas tecnologías, tanto en la función de educadora como en la transferencia de activos intangibles mediados por la propiedad intelectual y fortaleciendo el tejido productivo y social.
