Its most important & represented form is trade in patent rights. Possession of patent rights is an increasingly important factor of competitiveness on the international market. Fikri mülkiyet haklarının yükselişinde gelişmekte olan ülkelerin uyguladıkları stratejilerin küresel politik ekonomi yönünden analizi - ilaç sektörü örneği-
Tez ÖzetiBu tez çalışmasında ilaç sektörü özelinde fikri mülkiyet haklarının küresel ölçekte yükselişi ve bu yükselişe paralel olarak farklılaşan devlet stratejileri analiz edilmiştir. Çalışmanın temel amacı temel "ilaçta fikri mülkiyet haklarının global ölçekte sıkılaştırılmasına bazı gelişmekte olan ülkeler direnç gösterirken diğerleri neden göstermemiştir?" sorusuna cevap bulmaktır. Bu soruya cevap bulabilmek için, John M. Hobson'un İkinci Dalga Neo-Weberyan Devlet Yaklaşımı'ndan yararlanılmış ve uyarlanan bu yaklaşım karşılaştırmalı ülke örneklerine dayanılarak incelenmiştir. Bu amaçla Hindistan, Brezilya, Güney Afrika Cumhuriyeti ve Türkiye örnek ülkeler olarak seçilmiştir. Elde edilen bulgulara göre, devletlerin kendi politik önceliklerinde ortaya çıkan farklılıklar, altyapısal gücünde ve yoğunlaşma derecesindeki farklılıklar ve ulusal/uluslararası devlet dışı aktörlerle kurulan ilişkilerde farklılıklar –Bu çalışmada ulusal/uluslar arası devlet dışı aktörler olarak yerli ilaç firmaları, yabancı ilaç firmaları, yabancı devletler, iktisadi entegrasyonlar ve Sivil toplum örgütleri ile tüketiciler seçilmiştir.- farklılaşan devlet stratejilerinin kaynakları olarak görülmüştür. Bahsedilen teorik kurgu çerçevesinde Hindistan ile Brezilya yüksek direnç gösteren, Güney Afrika Cumhuriyeti orta seviyede direnç gösteren ve Türkiye direnç göstermeyen (uyum gösteren) ülkeler kategorisinde değerlendirilmiştir. Thesis Summary In this thesis study, the global increase of intellectual property rights in particular pharma sector, and state strategies varying according to this increase are analyzed. The aim of this study is to find an answer to the question of "Why did some of the developing countries resist to the tightening up of global intellectual property rights while some other ones didn't?" John M. Hobson's second wave Neo-Weberian State Approach is followed and analyzed according to the comperative country examples in the study. India, Brazil, South African Republic and Turkey is chosen as example countries. According to the findings of the research, differences in the political priorities, substructural power and concentration level are the sources of differeces in countries' strategies. Local and foreign pharmaceutial companies, economic integrations, non-governmental organizations, and consumers are chosen for this study as national and international non-state actors. In the frame of above mentioned theory, India and Brazil are classified as highly resistant, South Africa is classified as medium resistant and Turkey is classified as a non-resistant (compatible) country.

Problems Emerging in Transition to Digital Economy and Suggestions for Solutions; Dijital Ekonomiye Geçişte Ortaya Çıkan Sorunlar ve Çözüm Önerileri

In this study, it is aimed to address the problems that arise with the development of the digital economy thanks to the digital transformation experienced with the Fourth Industrial Revolution (Industry 4.0), and to explain what needs to be done by suggesting solutions in order to support the digital economy with a sustainable development model. Since 1996, when the concept of digital economy was first introduced in the literature, the concept of digital economy has been used as a keyword in studies (more than 130) published in the database (ScienceDirect, Wiley, Taylor&Francis, Springer, SSRN, DergiPark) and in many scientific papers. Due to the Covid-19 epidemic, which emerged in 2019 and was effective on a global scale, the fact that individuals meet their basic needs and many needs through digital platforms has led to the acceleration of digital transformation and entrepreneurship, the development of new production models, and the diversification of digital marketing and digital economy tools. With the acceleration of the digital transformation process, positive developments have been experienced in the context of the digital economy. However, this situation has brought along some problems such as unemployment concerns, digital security problems, tax, audit and financial reporting problems, problems in the supply of qualified personnel, difficulties in protecting intellectual property rights, and selling low quality or counterfeit products. In addition to the benefits provided by the digital economy that develops with digital entrepreneurship, it makes the work unique by addressing the problems that will arise in social and economic terms and offering solutions for them.
Understanding Kokorec through Gastro-Nationalism and Securitization during EU-Turkey Membership Negotiations
Turkey's European Union (EU) membership process began in 1963 with the partnership agreement sign with the European Economic Community. Turkey's application for full membership in 1987 speed the process to achieve EU standards. The negotiations include comprehensive policy changes in many areas, from financial standardization to intellectual property rights. These policies are collected under 35 chapters in which each of these chapters has many significant conditions. Chapter 12 is about food safety, veterinary, and phytosanitary policies. This article examines one of the subjects that is an issue of the first part of the chapter, food safety. Kokorec, a Turkish street food made of animal intestines, has been popularized in EU-Turkey negotiations as it is one of the most critical issues among 35 chapters. Kokorec was presented as it is an essential obstacle for Turkish membership, and if Turkey abandoned this century-old food, it would join the Union. This popularization has been made via media and other platforms such as TV series, articles, songs, and news and debate programs. This article studies this phenomenon under two concepts, securitization and gastro-nationalism. This article suggests that the kokorec has been popularized as one of the most critical issues and subjected to successful securitization. The debate regarding hygiene, authentic cuisine, the national food industry, and other debates are only tools of the securitization for the public view. This study used the social and traditional means of media and suggested that Turkey's public opinion (especially until 2010) regards to EU membership was manipulated through these means. The securitization of kokorec prevents a real discussion about Chapter 12 (and even the 35 chapters) and its content related to food safety, veterinary, and phytosanitary policies. As an expression of China's eagerness to modernize its foreign policy in line with the modified global conditions at the start of the 21st century, a new official Chinese foreign policy doctrine has emerged -- the theory of "peaceful rise." After the top echelon of the Chinese leadership have adopted this doctrine, now it is being peddled to the international public. The fundamental tenet of the theory of "peaceful rise" is that a vigorous long-term growth of Chinese economy & China's affirmation in the arena of international relations does not represent a regional or global threat; on the contrary, China's rise may be good for its neighbors (by bringing economic opportunity & strengthening their security) & the global community in general. After the successful resolution in the 1990s of the border disputes with Russia, Kazakhstan & Tajikistan, & the settlement of the issue of the land border with Vietnam, China has directed its efforts to the resolution of the remaining territorial disputes with Japan & India. China joined the ASEAN in October 2003, a sign of the continued improvement of China's relations with the countries in this region. China has also been very keen on improving its -- primarily economic -- relations with Russia & Japan that will bring economic benefits to all the parties. It is interesting that most China's neighbors, unlike the countries of the EU & the US, have a trade surplus with China. China's most important bilateral relation, that with the US, has been marked with the strategic rapprochement of those two great powers after "September 11" concerning the fight against international terrorism, but is nevertheless still burdened with an array of troublesome issues: Taiwan, criticisms of China due to its violation of human rights & intellectual property, the huge American trade deficit with China. The main challenges to the process of China's "peaceful rise" are the following: the imbalance of its economic growth, particularly its overdependence on exports, the deteriorated relationships with Taiwan after President Chen Shui-bian, a strong advocate of Taiwan's independence, won the 2000 elections. The author concludes that the Chinese foreign policy doctrine of "peaceful rise" is a welcome effort to allay the fears that have been fueled by China's prominence & to explain its new role in international relations. 12 References. Etička je obveza liječnika da budu upoznati s trenutnim dostignućima. Stručne medicinske udruge. poput Europskog kardiološkog društva (ESC), podupiru te vrste obveze. Troškovi stalnog medicinskog usavršavanja (SMU) u Europi su nedovoljno pokriveni od vlade i poslodavaca, ali ipak se stučne udruge kritiziraju zbog primanja alternativne financijske potpore od strane industrije. Medicinska edeukacija i osposobljavanje u području istraživanja uključuje obuku procjene kvalitete i pouzdanosti bilo koje informacije. Postoje realne opasnosti neobjektivne pristranosti kod bilo kojeg oblika znanstvene komunikacije uključujući intelektualnu, stručnu i financijsku, i izrazito je važno da se to uoči i razotkrije. Neophodna je bliska suradnja bazičnih i kliničkih istraživača iz akademskih institucija s jedne strane, te s druge strane s inženjerima i znanstvenicima istraživačkih odjela za medicinske uređaje i farmaceutskih tvrtki. Ona je ključna za razvoj novih dijagnostičkih metoda i postupaka. Promidžba industrijskih inovacija može ubrzati njihovu primjenu u kliničkoj praksi. Sveučilišta, u ovom trenutku, često potiču svoje akademsko osoblje na zaštitu svog intelektualnog vlasništva ili na komercijalizaciju svojih istraživanja, što samo po sebi ne predstavlja komercijalnu aktivnost niti predstavlja veze koje su postale meta kritika. Professional medical associations such as the European Society of Cardiology (ESC) support these obligations. In Europe, the costs of continuing medical education (CME) are insufficiently supported from governments and employers; however, medical associations have been criticized for accepting alternative financial support from industry. Medical education and training in research include learning how to assess the quality and reliability of any information. There is some risk of bias in any form of scientific communication including intellectual, professional, and financial and it is essential that in particular, the latter must be acknowledged by full disclosure. It is essential that there is strong collaboration between basic and clinical researchers from academic institutions on the one hand, with engineers and scientists from the research divisions of device and pharmaceutical companies on the other. This is vital so that new diagnostic methods and treatments are developed. Promotion of advances by industry may accelerate their implementation into clinical practice. Universities now frequently exhort their academic staff to protect their intellectual property or commercialize their research. Thus, it is not commercial activity or links per se that have become the target for criticism but the perceived influence of commercial enterprises on clinical decision-making or on messages conveyed by professional medical organizations. This document offers the perspective of the ESC on the current debate, and it recommends how to minimize bias in scientific communications and CME and how to ensure proper ethical standards and transparency in relations between the medical profession and industry.

John Stuart Mill'in siyaset felsefesinde demokrasi ; Democracy in John Stuart Mill's political philosophy
Özgürlük, mutluluk ve demokrasi Mill'i bir siyaset felsefecisi olarak değerlendirirken üzerinde durulması gereken anahtar kavramlardır. Mill, geleceğin en büyük sorunu olarak gördüğü özgürlüğü düşünce özgürlüğü, eylem özgürlüğü ve bir araya gelme özgürlüğü olmak üzere üç aşamada değerlendirmektedir. Düşünce özgürlüğü için hiçbir sınır koymayan Mill'e göre hiçbir düşünce susturulmamalıdır; zira her düşünce potansiyel olarak bir hakikat barındırmaktadır. Bireylerin her türlü eylem ve bir araya gelme özgürlükleri ise başkalarının refah ve huzuruna zarar verilmediği sürece bakidir. Mill yaşamın amacını mutluluk olarak görürken, mutluluğu birbiri ardına yaşanan hazlar şeklinde tanımlamaktan kaçınmaktadır. Onun ima ettiği mutluluk yalnızca bireyin kendi mutluluğu değil, eylemle ilgili olan herkesin mutluluğudur. Mill'e göre bir toplumun nasıl yönetileceği o toplumun karakteri ile doğrudan ilintilidir. Dolayısıyla Mill ideal bir yönetim şekli iddiasından ziyade toplumun yapısıyla uyumlu bir yönetim şeklinin aranması taraftarıdır. Mill'in siyaset felsefesinde toplumun tüm zorunlu ihtiyaçlarını bütünüyle karşılayacak tek yönetim tüm halkın katıldığı yönetimdir. Toplumun gelişim düzeyi ne kadar yüksekse demokratik yönetimin o toplum için uygunluğu da o derece yüksek olacaktır. Mill demokrasinin çoğunluğun tiranlığına dönüşmesinin engellenmesi gerektiğini savunurken doğru ve yanlış demokrasi arasında ayrım yapmaktadır. Eşit oy hakkı Mill'e göre yanlış bir demokrasi uygulamasıdır. Onun doğru demokrasisinde çoğunluk değil nitelik öncelenmekte ve bu yolla sistemin topluma ahlâkî ve entelektüel açıdan faydalı olması hedeflenmektedir. ; Liberty, happiness and democracy are the key terms of John Stuart Mill's political philosophy. Mill evaluates liberty, he accepts as the most important problem of the future, in three stages as freedom of thought, freedom of action and freedom of aggregation. According to Mill, any restriction of freedom of thought could not be accepted in any case because all kinds of thought include truth as potential. Freedom of action and freedom of aggregation could be restricted just by relying on harm principle that means someone is free in his action as soon as he does not harm other people. Mill, while accepting the aim of life as happiness, avoids describing happiness as the sum of pleasures. Happiness, according to Mill, is not the happiness of individuals but the happiness of everyone related with the action. The regime of a society is directly related with the character of society. Hence, Mill is in favor of searching for a regime compatible with the society rather than ideal regime for all societies. In political philosophy of Mill, the mere administration fulfils the necessary needs of society is the administration whole community participated. The higher developmental degree a society has, the compatibility of the democracy for the related society is higher, as well. Mill discriminates between true and false democracy. In true democracy of Mill, the important factor is not the selection of majority but the property. By this way, he aims to increase the moral and intellectual capacity of the society.

Avrupa Birliği (AB) sürecinde Türkiye tarımı
AB SÜRECİNDE TÜRKİYE TARIMIAvrupa Birliği (AB); siyasi ve ekonomik anlamda uluslararası bir bütünleşmedir. Avrupa'da siyasi ve ekonomik bütünleşme Avrupa Ekonomik Topluluğu'nun (AET) kurulmasıyla başlamıştır. 1951 yılında kurulan Avrupa Kömür ve Çelik Birliği (CECA) bütünleşme yolunda atılmış ikinci adımdır. Ekonomik yönden birleşme fikrine yoğunlaşılması sonucunda 25 Mart 1957 tarihinde Avrupa Atom Enerjisi Topluluğu (EURATOM) kurulmuştur. Bu topluluklar AB'nin temelini oluşturmaktadır. 1 Ocak 1958 tarihinde kurucu altı ülke (Almanya, Fransa, İtalya, Belçika, Hollanda, Lüksemburg) tarafından imzalanarak yürürlüğe giren Roma Anlaşması ile Avrupa Ekonomik Topluluğu bugünkü adıyla Avrupa Birliği kurulmuştur. AB, Avrupa'da yaşanan savaşların tekrardan çıkmasını engellemek, ekonomi alanında yaşanan işsizlik sorunu çözmek, az gelişmiş bölgelerin kalkındırılması ve yaşam standartlarının yükseltilmeyi amaçlamaktadır.Avrupa Birliğinin İç politikalarının temeli, 'Serbest Piyasa Düzeni' oluşturmakla beraber birçok korumaya yönelik önlemler ve birlikte hareket etme prensibine önem verilmektir. Emeğin serbest dolaşımı konusu, Ankara Anlaşması ve Katma Protokol ile 1976-1986 tarihleri arasında aşamalı olarak gerçekleşmesi öngörülmüş olsa da bu durum AT tarafından kabul edilmemiştir. Türkiye AB' ne katılım süreci içerisindeki aday adayı ülke konumundan 1999'da düzenlenen Helsinki Zirvesi ile aday ülke konumuna geçmiştir. Ayrıca AB, bu süreçte Türkiye'nin diğer aday ülkelerle aynı şartlara sahip olacağını belirtmiştir.1923-1950 yılları arasında tarımsal KİT'ler kurulmuştur. Türkiye ekonomisinde 1960'lı yıllardan sonra planlı döneme geçilmiştir. 1960-1970 yılları arasında tarımsal girdi kullanımının teşviki ve sulama alanlarına yönelik yapılan yatırımlarla sağlanan verim artışı sonucunda destekleme alımları yapılmış ve desteklenen ürünlerin sayısı arttırılmıştır. Bu dönemde yaşanan sosyal ve siyasal istikrarsızlık, Kıbrıs Savaşı, petrol krizi ve döviz darboğazından dolayı ekonomide durgunluk yaşanmıştır. Bu gelişmeler sonucunda Hükümet önlemler almaya başlamış, 1978 yılında "istikrar programı "nı açıklamıştır. İstikrar programı içerisinde yer alan ve uygulanan önlemler; KİT açılarlını kapatmak amacıyla KİT ürünlerine zam yapılmış, ithalat zorlaştırılmış ve devalüasyon yapılmıştır. 1979 yılında uygulana yeni bir program ile KİT ürünlerine yönelik zam uygulamasına devam edilmiş, faiz oranları yükseltilmiş ve Türk Lirası yeniden devalüe edilmiştir. Enflasyona engel olunamamasından ve durgunluğun devam etmesinden dolayı 24 Ocak1980 Kararları alınmıştır. 1980 sonrası dönemde 24 Ocak 1980 Kararlarıyla; devletin tarım sektörüne sağladığı destek azalmıştır. Fiyat yoluyla desteklenen ürün sayısı, 1980 yılında 24 iken, 1981 yılında 20'ye, 1985 yılında 18'e,1990 yılında ise 10'a düşmüştür. Nisan 1994'de yaşanan ekonomik kriz nedeniyle desteklenen ürün sayısı azaltılmış Bu süreç 2001 yılı sonuna kadar devam etmiştir. 2000'li yıllara gelindiğinde etkinliğini yitiren tarım politikalarının yerini, rekabete dayalı, adil, çiftçinin gelir düzeyini yükseltmeyi amaçlayan çevreci olan daha etkin tarım politikaları almıştır. Yeni tarım politikalarının hedeflerine ulaşmak için kullanılan araç, Doğrudan Gelir Desteği Uygulaması'dır. Bu uygulama AB'nde uygulanan Tek Çiftlik Ödeme Yöntemi için temel oluşturma niteliğindedir.1980'li yıllarda AB üyelik sürecine yönelik atılan önemli adım Gümrük Birliği Anlaşması olmuştur. Gümrük Birliği sayesinde Türkiye ekonomisi AB pazarında rekabet edebilme gücünü deneme fırsatı bulmuştur.
