1947년 일본헌법과 더불어 제정된 지방자치법은 중앙정부로부터 독자적 직접선거를 통한 입법부와 행정부 선출을 명시하며 일본의 중앙-지방관계를 규정한다. 특히 1980년대 이후 분권화는 세계화와 맞물려 잠시나마 좌우 이념의 간극에도 불구하고 드물게 의견의 합치를 이룬 정책 목표다. 본 논문은 자치체의 행정체계 정비를 포함해 자치체의 효율적 운영, 주민의 의견 반영 및 공정한 국정운용을 제고하려는 일본의 로컬 거버넌스가 궁극적으로 행정개혁, 시민참여, 그리고 균형발전을 동시에 두 가지 이상 성취하기 어려운 삼중고(trilemma)에 봉착한다는 설명 틀을 2003년 지방자치법 개정 전후 일본의 중앙-지방 관계 변화에 적용하고자 한다. 이에 따라 2절에서 일본 중앙-지방 관계의 발전사를 검토하고, 3절에서 로컬 거버넌스의 기존연구들을 정리한 후, 4절에서 2000년 지방분권일괄법이 실행되고 2003년 지방자치법 개정으로 이어진 과정에서 지방분권 개혁이 어떻게 전개되었는지 로컬 거버넌스의 삼중고(trilemma) 관점에서 보완하여 설명한다. 그리고 1990년대 이후에 지방자치법이 명시한 법적 권리를 넘어 헌법에 명시되어 있으나 실제로는 적극적으로 활용하지 않았던 시민의 직접적 정치참여에 대한 관심이 고조되는 배경을 검토하며 일본의 로컬 거버넌스에 대한 전망을 제시하고자 한다. ; Enacted along with the Japanese Constitution in 1947, the Local Autonomy Law established the directly elected head of executive and legislature at the local level, independent of the central government. Especially since the 1980s, an outcry for decentralization in a global age managed to put together a consensus across liberal and conservative wings, albeit its brevity. While striving for a thorough reorganization in local administration, an efficient management of local government and a participatory democracy at the local level, however, local governance encounters a trilemma of local reform, civic engagement, and balanced development. I purport to reconstruct the Japanese intergovernmental relations before and after the 2003 revision of the Local Autonomy Law in the context of a trilemma in local governance. In so doing, I lay out previous theoretical works on local governance and trace a unique path of intergovernmental relations in Japan, followed by an overview of local reforms and reorganizations since the Omnibus Law of Decentralization was launched in 2000. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 임도빈. ; 신 공공관리론의 영향으로 행정기관으로의 시장경제원리 도입에 대한 관심이 지속되고 있다. 정부는 고권적 입장에서 시민을 바라보았던 기존 관점에서 벗어나 시민을 고객으로 보고 고객만족행정을 실현하는데 힘을 기울이고 있다. 그리고 그러한 행정에 대한 측정지표로써 '시민 만족도'를 조사하여 연구하는 경향이 활발해지고 있다. 시민 만족도에 대한 조사는 시민들이 시 행정에 얼마만큼 만족하고 있는지를 살펴보고 이를 행정에 대한 성과로 치환할 수 있다는 점에서 의의가 있다. 그러나 기존의 만족도 조사로는 '과거' 성과에 대한 측정으로서의 역할을 할 뿐 '미래'에 어떤 정책을 추진해야하는지 한정된 자원을 어디에 투입해야하는지를 알려주는 지표로서는 한계를 가진다. 이러한 관점에서 시장부문에서 활용되고 있는 IPA 분석(중요도-성과 분석)을 행정학에 도입하려는 움직임이 대두되고 있다. 사부문과는 달리 성과를 가시적인 산출물로 나타내기 힘든 공공부문의 특성상 행정학에서의 성과는 시민 만족도로 대체되는 경향이 있어 이를 중요도-만족도 분석이라고 부르기도 한다. 여기서 주목할 점은 기존의 만족도만 조사하였던 방식에서 탈피하여 '중요도'에도 초점을 맞추기 시작했다는 것이다. IPA분석을 통해 한정된 자원을 좀 더 효율적으로 투입할 수 있는 방안이 생겼는데 이는 중요도와 만족도를 함께 조사하기 때문에 가능한 일이다. 그러나 '성과'를 '시민 만족도 조사' 로 치환하여 사용할 수 있는지, 그 방법에는 어떠한 것이 있는지 등 '만족도'에 대한 논의는 활발함에도 불구하고 아직까지 '중요도'에 대한 논의는 국내에서 미미한 실정이다. 이러한 이유에서 본 연구는 개별 행정서비스의 '중요도' 를 좀 더 정확하고 설명력있게 파악하기 위한 작업으로 사부문에서 활용되는 Derived importance를 소개하고 직접 설문을 통한 결과를 도출하여 기존에 활용되던 Stated importance 와는 어떤 점에서 다른 특성을 갖는지 살펴보았다. Derived importance 는 개별행정서비스에 대한 만족도를 독립변수로, 전체 행정 만족도를 종속변수를 두고 다중회귀분석을 통하여 나온 설명변수값(Beta)으로 중요도를 도출해내는 통계학적인 수치이다. 이는 Stated importance 보다 더 설명력이고 예측성이 있으며 심층적인 시민의 의식을 엿 볼수 있다는 점에서 실질적인 중요도로서의 가치가 증대되고 있다. 직접 설문조사를 통하여 각각의 중요도 값을 도출해낸 결과 24개의 개별 행정서비스의 중요도로 Stated importance 에서는 '공원과 여가활동시설'의 중요도는 12순위 밖에 되지 않았으나 Derived importance 에서는 1순위임을 확인할 수 있었으며, '공중보건 및 의료' 항목도 Stated importance 는 14위이나 Derived importance 에서는 2순위의 값을 가지는 등 여러 차이를 확인할 수 있었다. 이는 일반인들이 '실업문제 해결 및 경제활성화'나 '주택가격안정 및 주택공급' 과 같이 상대적으로 범주가 크고 사회적으로 이슈가 되는 문제해결을 위한 행정서비스 개선이 중요하다고 표면적으로 응답하나 실질적, 심층적으로 서울시의 전체 행정 만족도의 개선을 증진시키는 가장 중요한 서비스는 자신의 주변에 '공원과 여가활동시설' 이 얼마만큼 있는지, 자신이 아플 때 이용하는 '공중보건 및 의료'에 대한 행정이 잘되어있는지의 여부라는 것을 의미한다. 즉, 개인이 중요시 여기는 실질적인 개별 행정서비스의 개선은 자신의 피부에 직접 와닿고 자신이 느낄 수 있는 범주의 것이라는 점이다. 정책결정자의 최종 목표는 전반적인 만족도의 향상이다. 시장의 경우 전체적인 시의 운영 및 시 행정에 대한 만족도가 올라가는 것을 가장 첫 번째 목표로 삼을 것이며 시민들이 실질적으로 원하는 곳에 자원을 투입해야 한다는 측면에서 Derived importance 의 활용은 획기적인 시도라 할 수 있다. Derived importance 에 따라 개별 행정서비스 부문 중 높은 중요도를 가진 부문에 예산과 자원을 투입한다면 지방정부의 가장 첫 번째 목표인 지방 정부의 전체 만족도의 상승 효과를 예상할 수 있어 매우 효과적인 지표로써 활용될 수 있을 것이다. ; New Public Management lead consistent attention of introducing market economy principle to administrative institutions. As index of measuring such administration, there is a growing tendency of studying 'citizens' level of satisfaction'. Survey on citizen's level of satisfaction has the implication that finding out to what extent citizens are satisfied with municipal administration and apply it to administrative performance. Previous survey on the level of satisfaction, however, previous index only had a role of measuring 'past' performance but had limitation in guiding which policy should be promoted in the 'future' as well as where limited resources should be inputted. For such reasons, so as to figure out 'the level of importance' of each administrative service more accurately and in a more explanatory manner this study introduces Derived importance which is utilized in private sector and takes results through direct survey to find out which features are different from Stated importance which is utilized previously. Derived importance is statistical figure of which independent variable is the level of satisfaction on each administrative service and dependent variable is the level of satisfaction on general administration, and derives the level of importance through multiple regression analysis in the form of explanatory variable (Beta). As the result of the level of importance through direct survey, among 24 individual administrative services, it is found out that the rank of 'park and leisure facility', which is only 12th in Stated importance, is the first in Derived importance; the rank of 'public health and medical treatment', which is only 14th in Stated importance, is the second in Derived importance. This result means that citizens ostensibly answer that it is important to enhance administrative services concerning subjects, which are relatively big and receive attention from society, such as 'solution of unemployment and economic revitalization' or 'stabilization of housing price and housing provision', however, the most important service to them in substance and in depth, which enhances the level of satisfaction on Seoul city administration in whole, is 'park and leisure facility' around the neighbor and 'public health and medical treatment' which they can use when they are sick. That is, the substantial enhancement of individual administrative service which is important to individuals is about categories which people click and feel. The final goal of policy maker is to raise overall level of satisfaction. In case of mayor, it may be fairly said that the utilization of Derived importance is epoch-making attempt from the aspect that the first priority will be enhancement of general municipal operation and satisfaction on municipal administration and resource should be inputted where citizens want in substance. 학위논문 (박사) -- 서울대학교 대학원 : 사범대학 사회교육과(역사전공), 2020. 8. 유용태. ; 본 연구는 청이 불평등조약과 서양 국제법 서적을 통해 주외공관 제도를 수용하는 과정을 분석한 다음, 이것이 주한공관 설립과 한청 근대외교로 이어지는 모습을 고찰하였다. 이 과정에서 전통외교와 근대외교 각각에서 유래한 합리성과 제국성이 작용하는 양상에 유의하였다. 요컨대, 외교학의 용어와 개념은 물론 주외공관의 운영 원리에 착목하여 청의 주한공관을 체계적으로 밝힌 개척적인 연구라 할 수 있다. 청은 아편전쟁으로 체결한 불평등조약에 따라 주외공관 제도를 수용하였다. 이후 열강이 속속 설립한 주청공관은 자국인을 보호하고 외교 협상을 효과적으로 전개하는 한편, 영사재판권·포함외교 등을 통해 자국의 이익을 확보하였다. 한편 이 시기 청에 번역 소개된 󰡔만국공법󰡕 등의 서양 국제법 서적 또한 주외공관의 역할, 권리, 의무 등을 총체적으로 설명하는 한편, 非서구에 대한 영사재판권과 포함외교를 정당화하였다. 이를 통해 청에서는 합리성과 제국성으로 대표되는 주외공관 인식이 형성되었다. 본고가 불평등조약과 서양 국제법 서적에서 公使·領事 등의 번역어가 정착되는 과정을 분석한 결과는 청의 주외공관 인식이 심화되는 과정을 잘 보여준다. 이러한 상황에서 대외 위기가 고조되자, 청 정부 내에서는 상주사절 파견론이 대두하였다. 그 결과, 청은 영국을 시작으로 해외 각국에 공사관을 개설하고, 싱가포르 등 청국인이 많이 거주하는 지역에는 영사관을 설립하기 시작하였다. 청의 주외공관은 현지에서 교섭 사무, 자국민 보호, 정보 수집 등 다양한 업무를 수행하였다. 이는 청이 불평등조약에 따라 설립된 열강의 주청공관을 관찰하고, 서양 국제법 서적을 번역 이해한 결과였다. 이러한 흐름 속에서 1883년 청은 첫 번째 주한공관으로서 주조선상무서를 설립하였다. 그런데 주조선상무서는 분명 근대외교의 산물이었으나 청과 조선은 아직 전통외교를 적용하고 있었다. 따라서 주조선상무서는 전통외교와 근대외교가 착종된 과도적 형태의 주한공관이라 할 수 있다. 이것은 청이 진수당의 직함을 총판상무위원이라 하면서도 사실상 총영사의 지위를 부여한 데서도 잘 나타난다. 진수당은 주로 청 상인의 경제적 이익을 확보하는 방향으로 제국성을 표출하였고, 이를 합리성으로 분식하기 위해 전통외교와 근대외교를 선택적으로 활용하였다. 이 시기 한성·인천·부산·원산에 설립된 주조선상무서는 판리조선상무장정을 토대로 운영되면서 진수당의 활동을 뒷받침하였다. 1885년 청은 진수당을 경질하고 그 후임으로 원세개를 임명하였다. 이때 원세개에게는 총리교섭통상사의라는 직함과 총영사 겸 4등공사라는 지위가 부여되었다. 본고는 원세개가 지닌 4등공사의 지위에 주목하여, 이것을 원세개가 상국의 대표로서 조선의 외교를 주지한 법적 근거였음을 밝혔다. 그러나 원세개는 외교뿐 아니라 내정에까지 개입하였고, 이 과정에서 전통외교와 근대외교를 선택적으로 구사하여 제국성을 더욱 강렬히 표출하였는데, 이는 원세개의 독단적인 판단이 아니라 어디까지나 청 정부의 암묵적 동의에 따른 것이었다. 이 시기 원세개가 임기를 마친 후에도 두 차례나 더 유임되었고, 주조선상무서의 규모가 대폭 확장되고 용산상무서가 신설된 것은 원세개의 활동을 뒷받침하는 토대로 작용하였다. 그러던 중 청일전쟁이 일어나며 주조선상무서는 폐쇄되었다. 그러나 청은 1896년 총상동·총영사 당소의를 파견하여 주조선영사서를 개설하였다. 이때 당소의가 비공식 사절을 자처하였던 만큼, 주조선영사서 또한 비공식 기구에 머물렀다. 청이 자국민을 보호하면서도 조선의 수교 요구는 거부하기 위해 일종의 편법을 사용했던 것이다. 청은 마지못해 수교를 결정한 다음에도 4등공사 또는 흠차대신을 파견하려고 하는 등, 여전히 대한제국에 전통외교를 적용하려는 태도를 보였다. 1899년 한청수교가 이루어진 후, 청은 두 번째 주한공관인 주한공사관·영사관을 개설하였다. 이는 결국 청이 대한제국에 근대외교를 전면 적용하게 되었음을 의미하는 것이다. 주한공사 서수붕, 허태신, 증광전은 서양 국제법과 한청통상조약에 근거하여 교섭 사무를 처리해 나갔고, 이 무렵 신설된 外務部가 주외공관 제도의 개편에 나서면서 주한공사관·영사관의 합리성은 한층 보강되었다. 이 시기 청이 제국성을 표출하기 어려워진 상황과 달리 대한제국에서는 열강을 모방한 제국성이 생겨나기 시작하였다. 제1·2차 한일협약 이후에는 청의 주한공사관이 철수하고 주한영사관이 그 공백을 채웠다. 이 시기 한국총영사 마정량은 주한공사에 버금가는 권한을 지녔고, 주한영사관의 규모는 더욱 확장되었다. 본고는 이 시기 청 정부가 주외공관 제도를 개편하면서, 주한영사관의 관제가 개편되고 관원에 대한 대우가 개선된 것에 주목하였다. 이는 대한제국이 국권을 상실해 가는 상황에서도 청의 주한공관이 지닌 합리성이 증진되었음을 의미한다. 그러나 한국총영사 마정량은 각종 현안을 교섭하는 과정에서 합리성을 내세웠지만, 대한제국을 매개로 일본이 표출하는 제국성에 대응하는 과제를 안게 되었다. 그리고 한일병합으로 대한제국이 주권을 상실한 후에도 주한영사관은 주조선영사관으로 명칭을 바꾸어 존속하였으나, 한청관계가 일청관계로 대체되었기에 그 위상은 점차 낮아졌다. 본 연구에서 청말 주한공관을 한청관계의 맥락 위에 놓고 전통외교와 근대외교의 착종 과정에 주목한 것은 선행 연구의 보완과 연구 지평의 확대라는 측면에서 다음과 같은 의미를 지니고 있다. 첫째, 중국외교사의 측면에서, 청의 주한공관은 중앙 정부와 개인 차원의 외교 행위를 상호 관련성 속에서 이해할 수 있도록 하는 발판이 된다. 특히 청의 근대외교는 합리성을 갖추고 있었던 것은 물론 속국에 대해서는 명백히 제국성을 띠었던 만큼, 청의 근대외교가 지닌 후진성이나 反침략성을 강조해 온 선행 연구의 관점은 재고될 필요가 있다. 둘째, 한중관계사의 측면에서, 청의 조선 정책은 전통외교와 근대외교 양쪽 모두에서 유래한 합리성과 제국성이 길항하는 과정에서 그 양상을 달리하였음을 규명하였다. 따라서 청의 조선 정책을 전통적인 속방 체제의 강화 또는 근대적 제국주의 어느 한쪽으로 이해하는 것보다는 양측 모두가 착종한 양상에 주목하는 것이 적절하다. ; This study examined the way in which Qing dynasty had introduced the diplomatic office system through unequal treaties and the Western international law books, and figured out relevance between Qing's diplomatic offices in Korea and Sino-Korean modern diplomacy. In particular, this article paid attention to the manifestation that rationality and empireness of the diplomatic offices appeared and the aspect that the traditional diplomacy and modern diplomacy competed. In premodern times, traditional diplomacy based on tributes and installation was widely practiced in East Asia. But traditional diplomacy shook and modern diplomacy spread after the Opium War. In particular, the diplomatic offices of Western powers were symbol of modern diplomacy. Qing's understanding of the diplomatic office deepened through unequal treaties and Western international law books. The unequal treaty that Qing dynasty signed with the Western powers included clauses related to the diplomatic offices. The Western international law books introduced by Qing also included contents related to the diplomatic offices. In short course, the idea of dispatching resident envoys emerged in the Qing government. In this situation, Qing started to set up legations and consulates abroad. The diplomatic offices of Qing dynasty carried out various tasks, including negotiation affairs, protection of citizens, and gathering information. These diplomatic offices were based on the reference of the Western powers' diplomatic offices and Western international law books, therefore they contained both rationality and empireness of modern diplomacy. Paradoxically, rationality and empireness were fully expressed in the East Asian country. Qing's diplomatic offices in Korea can be explained in terms of rationality and empireness, and the change of Qing's diplomatic offices in Korea can be divided into the following two periods. The first phase is the founding period of the Qing's diplomatic offices in Korea. In this period, Qing aimed at making the Chosun her vassal state through the Commercial Affair Office. The General Commissioner of Trade Chen Shu-Tang established several Commercial Affair Office. In fact, the Commissioner of Trade was equal to the consul, and the Commercial Affair Office was equal to the consulate. But Qing avoid the term 'consul', 'consulate' to emphasize the vassal status of Chosun. Yuan Shi-Kai as a successor to Chen Shu-Tang corresponded to diplomatic minister. In this period, Qing and Chosun experimented the modern diplomacy through the diplomatic offices, but the traditional diplomacy was still valid. Qing made a use of modern diplomacy and traditional diplomacy arbitrarily. The second phase is the completing period of the Qing's diplomatic offices in Korea. In 1896, Qing established the consulate in Korea to protect the Chinese and avoid Chosun's call for diplomatic ties. After deciding to establish diplomatic ties, Qing planned to dispatch the fourth minister, and soon changed it to the minister plenipotentiary. This phenomenon symbolically shows the shift from traditional diplomacy to modern diplomacy. In 1899, Qing established a legation and consulates after concluding Sino-Korean treaty of commerce. The ministers of Korea treated the negotiation with Korea on the basis of the Western International law and Sino-Korean treaty of commerce. At that time, Qing established the Department of Foreign Affairs to reform diplomatic institutions. As a result the rationality of modern diplomacy increased, but the empireness of modern diplomacy was difficult to appear. In 1906, Qing decided to withdraw legation of Korea by request of Japan, and the consulate then dealt with task of the legation. Accordingly, consul general of Korea Ma Ting-Liang came close to minister of Korea, and the consulate grew in size. At that time, Qing government reformed the diplomatic office institutions, so consulates of Korea were reformed and diplomat treatment improved. After Japan-Korea Treaty of 1910, Sino-Korean relations ended, but the consulate of Korea still maintained changing its name to consulate of Chosun. In short, the consulate of Korea had developed in a way that enhances the rationality of modern diplomacy, but had to defend against Japanese empireness. This study has the following meanings in terms of supplementation of prior research and expansion of research horizon. First, this article revealed that Qing's empireness before Sino-Japanese War had come from both traditional diplomacy and modern diplomacy. Therefore preceding researches which have judged Qing's Chosun policy traditional or modern need to be reconsidered. Second, this article discovered the rationality from modern diplomacy in proceeding of Sino-Korean relations. Several preceding researches didn't stress on the development of Sino-Korean relations. 학위논문(석사)--서울대학교 대학원 :사회과학대학 정치외교학부(외교학전공),2019. 8. 박성우. ; The study of Rousseau's international politics can largely be divided into two main branches: Realism with a pessimistic view towards peace in international politics and Cosmopolitanism via education as depicted in Emile. However, neither interpretation exhaustively covers Rousseau's international political thought. Accepting the framework that International Political Thought should coherently and consistently interpret the individual, national, and international levels of politics, this thesis embodies Stoicism's 'Theory of Oikeiosis' to assess Rousseau's international political thought, focusing on Emile. This study pays attention to Emile because the study of humans embodied in the work contains both a discussion of all three layers – the individual, national and the international - of Rousseau's international political thought, and enough materials to infer his 'Politics of Survival.' Previous studies of Emile has primarily been published by cosmopolitans to invoke idealistic ideas such as conscience, morality, and patriotism. If put under a more realist lens, however, the same ideas could be interpreted as a part of living his life for Emile, or the individual, under the goal of self-preservation. Early in his life, Emile grows up with only negative education as an isolated individual and learns how to live alone. Later, Emile gradually learns how to interact with the society, breaking from his isolated shell to live as a part of a community. In this process, Emile establishes a political society and utilizes concepts that he garnered while in it, such as morality and religion, according to his goal of self-preservation. Although Emile fulfills his duties as a citizen of a Republic, ideas such as civic virtue and patriotism that were created within the country do not initially extend to the outside world. With time, however, Emile's world view expands to encompass the entire human population, and Emile comes to care for even communities outside of his direct community. When the idea of a confederation of countries to resolve the state of war outside of the community turns out to be unfeasible, Rousseau adopts a new solution for the international political situation which is for each individual to strive to do their best in the given situation such as by finding a safe place for his or her freedom of survival. This thesis scrutinizes Emile to depict this process, of the individual striving for survival beyond the community and extending to the nation, international politics, and the entire universe. This research interprets Rousseau's international political thought as 'International Political Thought of Survival' by repurposing cosmopolitan internal mechanisms as tools for survival, while also distinguishing itself from realism by underlining Rousseau's negative pacifism. As such, this thesis provides a balance between the cosmopolitan and realist interpretations of Rousseau's international politics and also attempts to bridge the rift between his national and international political thought by extracting 'survival' as a consistent idea embedded throughout the levels. 학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 권형기. ; 본 연구는 발전국가 이후 한국 자본주의 제도 변화 과정에서 나타난 국가 성격 전환에 관한 연구이다. 구체적인 사례로 하도급 제도를 대상으로 세계화 과정에서 국가 성격의 변화를 경험적으로 밝히고 이의 이론적 성격을 규명하고자 한다. 발전국가의 변천에 관한 기존의 연구는 주로 시장국가 혹은 최소주의적 규제국가라는 단일한 국가 모델로 수렴할 것인가라는 테제를 중심으로 접근해 왔다. 세계화론자들은 자본의 이동이 자유로워지고 자본을 유치하기 위한 경쟁이 치열해지면서 발전국가가 변화하는 세계경제에 부적합하기 때문에 단일한 규제국가 모델로 수렴할 것이라 예측한다. 반면, 신제도주의자들은 각 국가마다 착종된 제도와 문화가 다르기 때문에 "발전국가 이후" 규제국가로의 전환은 발전국가의 개입주의적 성격이 유지되는 경로의존적 제도 변화를 겪게 된다고 주장한다. 발전 경로가 다양할 수 있다는 점에서 제도주의의 입장에 동의하지만 한국의 국가성격 전환에 대한 기존 연구는 발전국가의 유산에만 천착하여 새롭게 재편되는 국가의 역할에 주목하지 못하고 있다. 본 연구에서는 개입주의의 유산을 통해 발전국가의 연속성을 찾는 기존 연구의 문제제기를 벗어나, 시장자유화라는 세계화의 일반적 추세에 따라 한국의 국가 성격 역시 규제국가로의 수렴 과정에 있다는 명제 하에서 한국의 규제국가가 갖는 다양성의 동학을 살피고자 했다. 한국의 발전 모델이 규제국가로 전환된 것은 사실이나 신자유주의적 국가가 상정하는 최소주의적 국가로 변화한 것은 아니다. 오히려 시장질서의 유지를 위한 협치적 개입주의라는 독특한 규제국가 모델을 형성하고 있다. 본 연구는 기존의 국가전환론이 지나치게 정태적인 분석 방법을 사용하여 비교균형론에 머무르는 한계를 지적하고 협치적 규제국가로의 전환을 이해하기 위해 행위자 중심의 이념, 사고, 담론의 정치적 과정을 분석하였다. 한국의 산업화 시기 형성된 발전연합은 공정거래법과 하도급법과 같은 경쟁법의 제도화를 억제했다. 80년대 신자유주의 관료의 등장과 정치엘리트의 정책 기조 전환이 맞물리면서 현재의 하도급 제도의 기원이 형성될 수 있었다. 이후 하도급법의 확대 및 강화를 통해 신자유주의적 규제국가가 아닌 질서 자유주의를 기반으로 하는 규제국가 모델로 재편되는 모습을 보여주었다. 이렇듯 한국의 규제국가가 '최소주의적'인 국가는 아니었지만 불충분한 제도화로 인해 자본의 양극화 문제를 충분히 해소하는 데에는 부족했다. 규제국가의 한계를 인식한 정부는 규제보다 사회적 규범을 통한 문제 해결을 선호했기 때문에 하도급법 강화에 저항적이었다. 이로 인해 중소기업의 불만을 조직하여 대변하는 정치세력의 연동제 도입 노력은 실패로 돌아가고 대신 점진적 개혁이 이뤄졌다. 자본의 패권에 대한 인식과 규제 국가의 능력에 대한 의심에도 불구하고 정부는 탈규제와 시장 방임으로 나아가지는 않았다. 오히려 사회적 규범을 형성하기 위한 사회적 조정을 시도하는 적극적 협치주의를 추구했다. 동반성장위원회는 공정거래위원회와 달리 사회적 합의 기구라는 제도적 조건과 적극적인 정치적 의지로 인해 이익공유제, 업종 적합성 등 중소기업의 불만을 반영한 다양한 대안들을 제시하여 대기업 측을 압박할 수 있었다. 전경련은 집단행동을 통해 이익공유제에 대한 항의를 전달했지만 법제화에 대한 두려움으로 동반위에서의 이탈보다는 강력하게 반대해 온 납품단가 연동제를 수용했다. 결론적으로 한국의 국가 성격은 발전주의 시기 이후 규제국가로의 수렴을 겪었다고 볼 수 있지만 이는 신자유주의 이념에 의한 것이 아니라 질서자유주의에 입각한 규제국가로의 전환이었다. 그러나 규제국가의 딜레마로 인해 강성규제국가보다는 협치적 규제국가라는 타협적 제도화가 이뤄지고 있다. 연성 규범 형성을 위한 협치적 개입주의는 사회적 조정을 통한 제도 변화의 급진성을 가져올 수 있는 새로운 가능성을 보여주지만 강제력의 부재라는 한계 역시 내포하고 있다. ; This study examines how the form of the Korean developmental state has changed in the process of economic liberalization. More specifically, the study analyzes the transformation of the Korean state empirically and theoretically investigating the changes in the subcontracting institutions under the globalization. The main question of the previous research on the tranformation of the developmental state is whether the state develops into one national model, 'minimalist state'. Capital mobility and the competition for capital make the interventionist states insufficiently competitive. Neoliberals predict the convergence of the national diversity under globalization. Institutionalists, on the other hand, insist that although the interventionist state has developed into a regulatory state, the direction of transformation is determined by path dependence. However, the literature on the transformation of the Korean state has paid little attention to the newly constructed role of the state. Unlike the previous literature, this research examines the dynamic process of the transformation of the Korean regulatory state. It is true that although the Korean state has changed from developmental model to regulatory state, it is distinct from minimalist model based on neo-liberal ideology. Rather, a new regulatory model has been formed. State intervention occurs not as a form of transformed developmental intervention, but as a form of governance. In order to understand this transformation, this study analyzes the political process based on the discursive institutionalism. The growth coalition blocked the introduction of the competition law in the era of industrialization. The newly empowered neoliberal bureaucrats and the turn of the policy stance under the new junta regime made it possible to enact the competition law. Since 1980s, the subcontracting law has been gradually reinforced. After enacting the law, the Korean state has developed into the regulatory state based on the ordo-liberalism, not on the neoliberalism. However, it is insufficient for the change to close the widening gap between big businesses and small businesses. The government prefers constructing the governance to strengthening the law in order to resolve the problem. Facing the government's resist, political parties' efforts to rapidly change the law failed. Although the government concerned about the capital mobility, it did not seek de-regulation and laissez-faire policy. Rather, the government tried to form a social norm using the governance. Unlike Fair Trade Commission, the Commission on Shared Growth for largecorporations and Small and medium Enterprises exerted pressure on the big business by proposing alternative plans including profit sharing and lists for SMB business items. Although the Federation of Korean Industries took collective action against the profit sharing plan to adjust the cost of subcontracting to the changes in raw material prices, it had to accept the plan which the FKI had strongly opposed. In conclusion, the Korean state developed into the regulatory state after the "developmental state". However, it does not mean that the role of the state becomes minimal as the neo-liberalsts argue. Nor does it that the state create a new role dependent on the developmental legacy. Using a new-formed governance, the Korean state tried to change the subcontracting institutions. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 외교학과, 2012. 2. 신범식. ; 본 논문의 핵심 질문은 색깔 혁명 발생으로 민주화에 성공한 그루지야와 우크라이나의 이후 민주주의 발전 양상은 왜 달랐는가이다. 색깔 혁명 이후, 우크라이나의 민주주의는 진전을 보였지만, 그루지야는 그렇지 못했다. 본 연구는 색깔혁명 이후 미국과 러시아의 갈등 구도와 양국의 대(對) 그루지야, 우크라이나 정책이 각국의 국내 엘리트-대중 관계에서 엘리트 자율성, 그리고 민주화에 미친 영향에 주목하였다. 9.11 테러 이후 미국과 러시아는 협력 체제에 있었지만, 색깔 혁명의 발생으로 인해 양국은 갈등 구도에 들어서게 된다. 그루지야와 우크라이나는 미․러 갈등 구도의 중심에 있었다. 활용가능성의 요인으로 인해, 그루지야는 우크라이나보다 전략적 가치가 더 큰 곳이었다. 미․러 갈등 구도 속에서 그루지야 집권 엘리트들은 높은 엘리트 자율성을 가질 수 있었다. 미국은 그루지야에게 큰 경제 원조, 정치적 지원을 하였다. 또한 그루지야-러시아 관계 악화와 2008년 전쟁 발발은 정권의 권위주의 정책을 정당화하고 국내를 결집시키는 기제로 작용하여 그루지야 집권 엘리트들이 높은 자율성을 갖게 해주었고, 이는 민주화 저해로 이어졌다. 우크라이나는 그루지야와 반대였다. 미․러 갈등 구도 속에서 우크라이나 엘리트들은 낮은 자율성을 가졌다. 우크라이나의 집권 엘리트들은 서방과 러시아 양측 모두로부터 확고한 정치적, 경제적 지원을 얻을 수 없었다. 오히려 러시아의 정책으로 인해 국내의 반 오렌지, 대항 엘리트가 공고해지면서, 집권 엘리트의 자율성은 낮아졌다. 엘리트들의 낮은 자율성과 대중에 대한 높은 의존성은 대중 영합주의 정책과 정국 불안의 결과를 낳았으나, 이는 오렌지 혁명 이후 우크라이나 민주주의의 발전을 제한적으로나마 가능하게 해주었다. 본 연구는 민주화 연구에서 그동안 비교적 주목을 덜 받아온 국제적 요인을 다루고, 외교 정책, 국내 엘리트-대중 관계, 민주화의 연계를 통합적으로 보여준다는 점에서 함의가 있다. 본고는 많은 기존 연구들이 상정해 온, 민주화에 대한 서구 민주화 증진 정책의 긍정적 영향과 권위주의 국가의 부정적 영향이라는 단순한 명제의 한계를 드러내주고 있다. 또한 민주주의 지원 정책에서 민주화 단계별로 정책을 달리할 필요성에 대해서 시사한다. ; What caused the difference in democratic trajectories between Georgia and Ukraine after the Color Revolutions? Since the occurrence of the Color Revolutions, Georgia's democracy has laid in tatters, whereas Ukraine has achieved a relatively successful democracy. Georgia and Ukraine share similar domestic determinants which have been discussed in previous democratization literature. This study, however, focuses on the international factor as an explanation for the different democratic fates of democracy between the two countries. Comparing both countries, this thesis uses a framework that integrates international factors, elite autonomy in domestic elite-mass relations, and democratization. The study argues that international factors, specifically the foreign policies of the US and Russia, provide an explanation for the difference in democratic outcomes for the two countries. Following the events of September 11, 2001, US-Russian relations improved. However, the occurrence of the Color Revolutions caused deterioration in the ties between the two countries, and both started to adopt different foreign policies towards the post-Soviet region. Caught in the middle of this conflict between the two great powers were Georgia and Ukraine. The unconditional US support for Georgia and Russia's assertive policy towards Georgia which culminated in the Russian-Georgian War in 2008 enabled the Georgian elites to attain high elite autonomy, thus resulting in democratic stagnation for Georgia. In contrast, Ukraine did not garner the support of either the US or Russia; rather, it was pressured by Russia. The anti-Orange elites in Ukraine were effectively supported by Russia, and, thus, were able to function as a forceful political opposition to the incumbent elites. Therefore, the Ukrainian elites only garnered low autonomy, which resulted in democratic progress in Ukraine despite domestic political chaos. This study contributes to further understanding of the impact of international factors upon democratization. In addition, this thesis creates implications for democracy promotion policy. The conclusion of the thesis challenges the predominant assumption that Western democracy promotion is conducive to actually democratization, and that authoritarian countries' authoritarian promotion policy is harmful to democratization. In the process of democracy promotion policy, policymakers and implementers need both careful monitoring of the process of democratic assistance and coordination with other countries. ; Master

Between 1995 and 2011, Peruvian GDP grew by 4.9% each year, driven by exports and private investment's increase. However, it only grew by 3.3% in 2015 and by 4% in 2016 due to a reduction in the international price of metals that the country exports. In this scenario, the government elected in 2011 faced the challenge of replacing private investment with public investment as a growth engine. However, this decision revealed two structural problems of the Peruvian economy: 1) the limited spending capacity of central and regional governments; and 2) the difficulty of increasing tax collection due to a very significant informal sector in the country. However, trade liberalization, stability in domestic prices and reforms in public management are strengths of the Peruvian economy, which would enable it to return in the next few years to growth rates of around 4% or more.

학위논문 (석사)-- 서울대학교 대학원 : 법학과, 2012. 2. 권영준. ; 담보제도는 여신금융거래와 밀접한 관계를 가지고 있어서 담보제도의 안정적인 작동은 여신금융거래의 활성화에 기여할 수 있다. 그런데 최근 들어 새롭고 복잡한 금융기법이 등장하고 있는데도 불구하고 대표적으로 이용되고 있는 담보물권의 일종인 저당권은 여신금융거래를 둘러싼 사회적 요구를 충분히 수용하지 못하고 있다. 특히 대규모의 자금이 투입되는 건설사업 등 각종 부동산개발사업을 추진하는 과정에서 이용되고 있는 프로젝트 파이낸싱(Project Financing, 이른바 PF 대출)이라는 금융기법은 막대한 대출금 규모에 비례하는 보다 안전한 담보가 필요하게 되었고, 이와 관련하여 부동산담보신탁은 새로운 담보방법으로 주목받기 시작하였다. 원래 신탁은 영국에서 발달한 제도이고, 현행 우리나라의 부동산담보제도는 대륙법계에서 발전된 제도이기 때문에 신탁을 통한 담보방법의 폭넓은 활용은 용이하지 않았다. 우리나라에서 신탁을 통한 담보방법인 부동산담보신탁의 활용이 관심받기 시작한 것은 불과 20년도 채 되지 않았다. 물론 부동산담보신탁이 완벽한 담보적 기능을 가지고 있는 것은 아니지만, 현행 법체계에서 담보력을 유지하기 위한 강력한 수단이라고 평가받고 있다. 그 이유 중의 하나는 신탁의 도산격리 효과 때문이다. 이것은 위탁자나 수탁자의 파산절차 또는 회생절차에 구속되지 않고 신탁부동산을 독립적으로 취급할 수 있으므로, 채권자인 수익자는 위탁자나 수탁자의 채권자로부터의 간섭 없이 신탁부동산에 대한 권리를 행사할 수 있음을 의미한다. 이러한 도산격리 효과는 신탁제도의 고유한 효과이므로, 부동산담보신탁에서도 동일하게 인정된다. 특히 위탁자에 대한 회생절차가 개시된 경우 수익자로 지정된 채권자는 경우에 따라 위탁자에 대해 가지는 회생채권은 실권될 수 있어도 수탁자에 대해 가지는 수익권은 실권되지 않는다. 이러한 점은 부동산담보신탁을 활성화시키는 강력한 유인이라고 볼 수 있다. 한편 그동안 우리나라에서는 부동산담보신탁에 대하여 신탁의 형식을 빌린 담보제도로 구성하려는 견해가 많았으나. 엄밀히 말하면 부동산담보신탁은 담보제도로 볼 수 없다. 부동산담보신탁에 대하여 형식은 '신탁'이지만 실질은'담보'라는 주장은 물권적 기능을 하는 권리들을 물권법정주의라는 틀에 맞추어 설명하다 보니 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 일종의 비전형담보권으로 보려고 했던 것이다. 그러나 담보신탁을 통하여 얻게 되는 채권자의 담보취득 효과는 경제적인 측면에서 그러한 것이지 법률적인 측면에서 그러한 것이 아니다. 따라서 부동산담보신탁은 어디까지나 신탁제도의 일종이라고 보아야 하고, 신탁제도 자체의 고유한 법리에 기초한 해석으로써도 부동산담보신탁제도를 충분히 설명할 수 있다고 보아야 한다. 미국에서는 부동산을 담보로 금융을 얻는 방법으로 대륙법계의 저당권이 아니라 'Mortgage'나 'Deed of Trust'를 이용하여 왔다. 이러한 'Mortgage'나 'Deed of Trust'는 담보를 위하여 부동산에 대한 소유권을 이전한다는 점에서는 동일하지만, 전자는 채권자에게 부동산에 대한 소유권을 이전하는 반면에 후자는 수탁자에게 그것을 이전하고 채권자는 수익자로 된다는 점에서 차이가 있다. 캘리포니아 州의 경우 1930년 이후부터'Deed of Trust'와 'Mortgage'를 동일하게 취급하여 'Deed of Trust'의 본질을 매각권이 부여된 'Mortgage'로 보았다. 그러나 이와 같이 'Deed of Trust'와 'Mortgage'에 대한 동일한 취급이 우리나라에서도 수용 가능한 것인지는 재고의 여지가 있다. 왜냐 하면 미국의 도산절차에서는 담보권자의 권리가 감축되지 않으므로 'Deed of Trust'를 매각권이 부여된 'Mortgage'로 취급하더라도 별 문제가 없으나, 우리나라의 경우는 채무자 회생 및 파산에 관한 법률의 회생절차에서 회생담보권자로 취급되면 권리감축의 대상이 되므로 부동산담보신탁을 담보제도로 보게 되면 중대한 문제가 발생할 수 있기 때문이다. 즉 부동산담보신탁에서 채권자인 수익자가 보유한 수익권을 비전형담보권으로 보게 될 경우 논리적으로 회생담보권이 되어 수익자 보호에 취약해질 수 있다는 것이다. 최근 우리나라에서는 신탁법의 전면 개정(2011. 7. 25. 법률 제10924호)으로 담보신탁의 법적 근거가 마련되고, 어떤 측면에서는 기존의 담보제도가 가진 한계를 극복-예컨대 수익증권의 발행이 가능하게 됨으로써 수익권의 유통성이 확보됨-할 수 있게 되었다. 이러한 점들은 앞으로 부동산담보신탁의 활용을 높이는 계기가 될 것이다. 한편으로는 담보신탁의 대상이 단순히 부동산에만 한정된 것이 아니기 때문에 동산, 유가증권, 금전채권 등의 신탁재산을 포괄하는 담보신탁의 활용 가능성에 대한 관심과 연구가 증대되어 궁극적으로 안정적이고 편리한 담보신탁의 활용을 통하여 여신금융거래의 활성화에 기여할 수 있도록 하여야 한다. ; The stable working of the security system can make a significant contribution to revitalizing the loan financial transaction because both of them are intimately associated with each other. Although new and complicated financial methods recently appear, a typically-used hypothec does not accept social needs surrounding the loan financial transaction. Especially the financing method which is called Project Financing needs a safer security in the process of promoting all sorts of the Real Estate Development Business prodigious funds are invested in. In this situation the real estate security trust began to make a mark as a new type of security method. A wide use of Trust as a security method was not easy because it is originated from the United Kingdom and the real estate security system in Korea has been developed from the Continental law line. It is less than 20 years that the real estate security trust has been noted as a new type of security method. Although the real estate security trust does not have perfect functioning of security, it is appreciated as a powerful means for keeping the value of security. One of the reasons is due to bankruptcy remoteness effect in Trust. This means that a creditor as the beneficiary can exercise his or her right about the trusted real estate being free from intervention of truster or trustee. As this bankruptcy remoteness effect is a peculiar one of the trust system, it is equally admitted in the real estate security trust. If a rehabilitation procedure is started, a creditor as the beneficiary can lose his or her rehabilitation credit about truster but can not lose the beneficiary right about trustee. This aspect is a contributory cause in reinvigorating the real estate security trust. Some people tended to regard the real estate security trust as the security system so far in Korea. In other words those who make an assertion that it is 'the trust' in form and 'the security system' in essence think of the beneficiary right as a kind of non-typical security right. But strictly speaking, it is not the security system. Because the security acquisition effect in the real estate security trust is right in a economical aspect and is not so in a legal aspect. So the real estate security trust is a kind of trust system and we can understand it with an explanation based on the peculiar principle of trust system. They have used 'Mortgage' or 'Deed of Trust' as a method for financing with a real estate in the United States. This 'Mortgage' or 'Deed of Trust' is similar in transferring the ownership about a real estate for a security, the former transfers it to a creditor but the latter does so to trustee. In California 'Deed of Trust' and 'Mortgage' are treated equally as the essence of 'Deed of Trust' is a kind of 'Mortgage' that has the right of disposal by sale since 1930. However we must reconsider whether this treatment in California can be accepted in Korea. Although 'Deed of Trust' in California is similar to the security trust in Korea, they are not identical. It is natural that 'Deed of Trust' is treated as a kind of 'Mortgage' which has the right of disposal by sale because the security right is not reduced in the law related to rehabilitation or bankruptcy procedure of the United States. However the law in Korea is different from that in the United States. If we regard the real estate security trust as the security system in Korea, the serious problem comes into existence because the rehabilitation security right is reduced according to the insolvency law of Korea. In other words if they think of the beneficiary right as a kind of non-typical security right, it is logically the rehabilitation security right. In result we can not protect the beneficiary. The Trust Law of Korea was fully revised in 25th July, 2011. It has not only brought about the legal basis of the security trust but also made a kind of the institutional device which can get over a boundary of the past security system-issuing a beneficiary certificate and securing a circulation of the beneficiary right. These points will enhance the use of the real estate security trust. Additionally as the object of the security trust is not limited only to a real estate, we must study the chance of using the security trust which include movable properties, securities, bonds to be paid in money and so on. This leads to making good use of the security trust which is stable and convenient, and so will eventually revitalize the loan financial transaction. ; Master

Korean economic development has proceeded at the rapid rate of in the past two decades with neglect to some areas of human development, especially in the case of mental illness. But the government has belatedly recognized the importance and urgency of welfare and health programmes to cope with increasing problems. Mental health problems are more serious among the economically underprivileged than others. Because of large portion of mental patients from the economically underprivileged segment are at the without proper treatment or care. Thus it is imperative to develop easily assessible, cost-effective alternatives that would offer effective mental health care as well as useful social rehabilitation programmes. The government enacted the National Mental Health Law in December 1995. This project will assist to clarify the appropriate roles of the most effective care system. 20 nurse practitioners began a study on voluntary basis to assess the patients and their family with assessment tool which developed by research members. After that managed the 46 patients and their families through telephone or home-visiting, day care center programmes(such as social skill training, group therapy, movement therapy, art therapy) and counselling, refering hospital and family support group. The goals of research is to strengthen the capacity of psychiatric mental health nurse practitioners to undertake home and community-based mental health care services through various training programmes and expected outcome is this programme will be developed continuously and implemented to another community mental health center. Lastly, the cost-effective study of community-based mental health care will have been undertaken with realistic data provided by the pilot programme policy recommendations prepared for the Ministry of Health and Welfare. ; open

Meanwhile, Korea's ODA has been diversified by various implementing agencies. There have been many previous researches on effective implementation system to improve the effectiveness of ODA projects. In 2010, through the establishment of the Act on International Development Cooperation, the function of organizing and coordinating policies in ODA of the International Development Cooperation Committee has been strengthened. However, little case-based research has been done on what adjustments are actually made in the committee. The purpose of this study is to analyze the policy coordination cases of the International Development Cooperation Committee and to examine the factors influencing policy coordination in international development cooperation. The target of the analysis is the case of the integration of the overseas volunteer dispatch project into the WFK(World Friends Korea), which started in 2009 and has been in progress until 2019. In 2008, the Lee Myung-bak government set up a national policy task to dispatch 20,000 volunteer overseas. In this regard, discussions have begun on the need to integrate the overseas volunteer dispatch projects being promoted by all ministries into WFK program, which is being promoted by the Ministry of Foreign Affairs, and primary integration by the leadership of the President in 2009 ~ 2010 was achieved. In the meantime, since 2016, the International Cooperation Committee has been discussing the integration of volunteer dispatch projects that have not been integrated yet. As a result, the Ministry of Foreign Affairs has promoted discussions on integrated promotion. The related projects were programs of the Ministry of Health and Welfare, Ministry of Culture, Sports and Tourism, Ministry of Patriots and Veterans Affairs, Korea Meteorological Administration, Fair Trade Commission, Ministry of Education. The research methodology first outlines the theories and researches on the influencing factors of policy coordination and selected the factors that might influence the policy coordination of international development cooperation. Based on the selected factors, the analysis framework was established and hypotheses were established. The analysis was conducted based on the analysis framework and the hypothesis was verified for the eight projects of six ministries in the case. In this study, the concept of policy coordination was focused on the integrated promotion aspect of inter-ministerial policies for enhancing synergy rather than solving policy conflicts among ministries considering the characteristics of international development cooperation issues. According to the theoretical discussion, the policy coordination is based on the hierarchical system, the network system, and the market system, and the International Development Cooperation Committee is considered as a coordinating mechanism for interactions among various participants in network system. In the previous researches on the factors influencing the general policy adjustment, it was pointed out that attributes of the issue and participant, leadership are important in policy coordination. On the other hand, previous researches in the field of international development cooperation have been studied mainly in terms of improvement of the institutional aspects, and prior studies on the factors influencing the adjustment are rare. Based on the previous research and theoretical discussions of network view on policy coordination, three factors were identified as factors influencing the policy coordination of international development cooperation. Those are the degree of internalization of the unique policy viewpoint of the network participants, disposition tendency of the participants on the policy, and the leadership level of the President and the Ministry of Foreign Affairs. For each factor, detailed sub-indicators were set up. First, we considered the existence of dedicated implementation agencies, the use of specific policy resources, and the presence of interest groups as criteria for the degree of internalization of the unique policy view. In case of domain dispute tendency, the absolute amount and proportion of budget and the key policy areas. Third, in the case of leadership, the level of leadership of the president and the policy coordination institute (Ministry of Foreign Affairs) was considered. Eight projects from the six ministries had different degrees for each of the three factors, which affected the results of the strategies and adjustments chosen by the individual ministries in the policy coordination network. First, the Ministry of Health and Welfare carries out its own voluntary work by a non-profit corporation called the Korean Oriental Medical Service Group, but its degree of internalization of the policy perspective is not so high due to the small grant amount and the existence of multiple sponsors in the corps. In addition, and the number of stakeholders in Korea was not so high. However, the MHW restructured its business due to the President 's overseas trip, and the MHW stopped the business. The project is now integrated into the WFK platform. In the case of the Ministry of Culture, Sports and Tourism, there is a high level of internalization of the policy perspective. The program is implemented by the traditional performing arts promotion foundation, which is a nonprofit foundation under MCST. In addition, it utilizes related majored students and its Korean Culture Center abroad. Moreover, the program is closely related to the main policy areas of MCST such as the operation of overseas Korea Cultural Center. As a conclusion, MCST decided to leave the network and converted the program into non-ODA domain to continue the program. In the Ministry of Patriots and Veterans Affairs, there were two projects: the medical service project of the 6.25 participating countries and the medical service project in Vietnam. First, the medical service project of 6.25 participating countries, which had relatively low importance in MPVA, and which did not have any interest groups, was abandoned. However, the Vietnamese medical service project, which has a dedicated agency and strong interest group, and was chosen to be remained by being moved into non-ODA domain. The Korea Meteorological Administration utilizes unique policy resources and the KMA also adopted the non-ODA method to continue the project. In the case of the Fair Trade Commission, the proram is about dispatching FTC's internal employees overseas. Therefore, both the degree of internalization of the viewpoint and the tendency to dispute the domain were high. However, the Ministry of Foreign Affairs did not promote the integration of the FTC project, and it seems that mutual recognition is made that the project is not subject to integration between the two ministries. In the case of the Ministry of Education, there is a high degree of internalization of the policy perspective due to the fact that the responsible administration agency is in operation, utilizes its own policy resources, and there is a strong teacher interest group. In addition, the amount of the program's budget is very large, and the tendency to dispute the policy region is also high. The Ministry of Foreign Affairs has shown a strong commitment to coordinate with the MOE's program since 2019, but the MOE is keep refusing it. We analyzed the cases of 8 projects of these 6 departments through analysis framework. The different factors that existed on each department triggered different strategies within the network for each department, and we observed that the result of the policy adjustment was different. In addition, the original hypothesis was verified. First, the greater the discrepancy in the viewpoint of the policy, the more unfavorable the policy coordination. Second, the larger the ministry's domain dispute tendency, the more disadvantageous the policy coordination. Third, the greater the leadership of the president and the policy coordination institute, the more favorable the policy coordination. Although this study was intended to detail the processes and achievements of policy coordination in the international development cooperation of Korea through actual cases, it was difficult to access the every minutes of the network participants' meetings, and inference was used to deduce the behavior of individual participants (ministries) through the review of official document. Therefore, it was only a rough explanation. However, the purpose of this study is to suggest that the main variables that actually affect the results of policy coordination in the International Development Cooperation Committee in Korea, the understanding of the process of policy coordination through committee among participants from a network perspective, and the microstatement of the behavior of the representatives of individual ministries in the course of the policy coordination. In the future, we look forward to expanding the scope of the research, including another example of policy coordination through the International Development Cooperation Committee, so that the results of the study can be generalized. ; 우리나라의 공적개발원조(ODA) 예산은 2010년 OECD 가입 이후로 지속적으로 확대되어 왔다. 한편 우리나라의 ODA는 다양한 시행기관에서 분산적으로 추진하고 있는 상황으로, ODA 사업의 효과성 제고를 위하여 그간 효과적 추진체계에 대한 선행연구가 다수 이뤄져 왔다. 이와 궤를 같이하여 2010년에는 국제개발협력기본법의 제정을 통해 국제개발협력위원회에 ODA의 총괄적 추진을 위한 정책의 총괄 및 조정 기능이 강화되었다. 그러나 본 위원회에서 실제로 어떤 조정이 이루어지는지에 대한 사례 기반의 연구는 거의 이루어지지 않은 상황이다. 본 연구의 목적은 국제개발협력위원회의 정책 조정 사례를 분석하여 국제개발협력에서 정책 조정에 영향을 미치는 요인이 무엇인지 알아보는 것이다. 분석 대상은 2009년에 시작되어 2019년 현재까지 진행되고 있는 이다. 2008년 이명박 정부에서는 글로벌리더 10만 양성을 국정과제로 정하고 해외 봉사단 2만명 육성 사업을 추진하였다. 이와 관련하여 전 부처에서 개별 추진 중인 해외 봉사단 파견 사업의 KOICA의 WFK로의 통합에 대한 논의가 시작되었고, 2009~2010년 경 대통령 리더십에 의한 1차적 통합이 이루어졌다. 한편 2016년 경 부터는 아직 통합되지 않은 봉사단 파견 사업들에 대하여 국제개발협력위원회에서 2차적 통합 논의가 시작된 바, 외교부가 주관부처로서 통합 추진 논의를 추진하였으며 통합 대상이 되었던 사업 들은 총 6개의 부처(보건복지부, 문화체육관광부, 국가보훈처, 기상청, 공정거래위원회, 교육부)의 8개 사업이었다. 연구의 진행 방식은 먼저 정책 조정의 영향 요인에 대한 이론과 연구를 개관하고, 국제개발협력의 정책 조정에서 주요한 영향을 미치리라 생각되는 요인들을 선별하였다. 선별된 요인을 바탕으로 분석 틀을 설정하고 가설을 수립하였으며 사례에 존재하는 6개의 부처의 8개 사업에 대하여 분석틀에 기반하여 분석을 수행하였고 가설을 검증하였다. 이를 위해 2014년부터 2020년까지의 국제개발협력위원회 조정 과정에서 생산된 문건인 무상원조 관계기관 협의회 및 국제개발협력위원회 의결 종합시행계획 등을 분석하였다. 본 연구에서는 정책 조정의 개념에 대하여 국제개발협력 이슈의 특성을 고려하여 부처 간 정책 갈등 해결 측면 보다는 시너지 제고를 위한 부처 간 정책의 통합적 추진 측면을 중시하였다. 이론적 논의에 따르면 정책 조정은 위계에 의한 방식, 네트워크에 의한 방식, 시장에 의한 방식 등이 존재하는 바, 국제개발협력위원회제도는 다양한 참여자 간 협의체를 통한 상호 작용의 조정 기제로 보아 네트워크적 관점에서 분석하고자 하였다. 한편 일반적인 정책 조정 영향 요인에 대한 선행연구에서는 이슈 및 참여자의 속성, 조정 환경, 조정 주체 요인 등이 주요 영향 요인으로 지적되어 왔다. 한편 국제개발협력 분야의 선행연구는 주로 제도적 측면의 개선점에 주안을 두고 그간 연구되어온 바, 조정 영향 요인에 대한 선행 연구가 드물었다. 결국 분석모형틀로서 이론적 논의의 네트워크 관점의 정책 조정 영향 요인과, 일반 정책 조정 선행 연구에서 논의된 영향 요인을 종합하여 국제개발협력의 정책 조정 영향 요인으로서 세 가지를 도출하였다. 이는 네트워크 참여자의 고유한 정책 관점 내재화의 정도, 참여자의 정책에 대한 영역권 다툼 성향, 대통령 및 주관부처(외교부)의 리더십의 수준 이다. 각 요인에 대하여는 세부 하부 지표를 설정하였는바, 먼저 고유한 정책 관점 내재화의 정도의 판단 기준으로 전담 사업 수행기관의 존부, 고유 정책 자원의 활용 여부, 이익집단의 존부를 고려하였다. 영역권 다툼 성향의 경우 예산의 절대 액수 및 비중, 사업 관련 기성사실의 발생 정도를 고려하였다. 셋째로 리더십의 경우 대통령 및 정책 조정 촉발 기관(외교부)의 리더십의 수준을 고려하였다. 통합 대상이 되었던 6개 부처 8개의 사업들은 이 세 요인에 대하여 각각 다른 정도를 가지고 있었으며 이는 개별 부처가 정책 조정 네트워크에서 택한 전략 및 조정의 결과에 영향을 미쳤다. 먼저 보건복지부의 사업은 대한한방해외의료봉사단이라는 비영리사단법인이 전담 수행하며 고유 자원을 활용하나 소규모의 보조금 교부 액수 및 봉사단에 복수 후원처의 존재 등으로 정책 관점 내재화 정도는 그리 높지 않다고 보인다. 또한 사업 수행이 오래되었으나 국내 이해관계자의 수는 많지 않아 영역권 다툼 성향도 높지 않다고 볼 것이다. 그러나 결정적으로 대통령의 해외 순방에 따른 보건복지부의 자체 사업 구조조정이 조정 결과에 영향을 미쳤다고 보이며, 보건복지부는 2018년부터 사업을 중단하였고 해당 사업은 현재 WFK 플랫폼에 통합된 상태이다. 문화체육관광부의 경우 전통공연예술진흥재단 등 소관 비영리재단법인이 사업을 전담하고 전통문화 전공 학생 및 재외 한국문화원을 활용하는 등 고유 정책 자원을 활용하며 이익집단도 존재하는 등 정책 관점 내재화 정도가 높다. 또한 예산은 소규모이나 한국문화원 등 연관 정책이 문화체육관광부의 중점 정책 영역에 해당한다. 이에 외교부가 해당 사업에 대한 강경한 검토 의견을 제시하였을 때, 문화체육관광부는 WFK와 통합하거나 사업을 중단하는 대신, 사업을 비ODA사업으로 전환하여 국제개발협력 조정네트워크에서 이탈한 후 지속 추진하는 전략을 택하였다. 국가보훈처에서는 6.25참전국 의료봉사 사업 및 베트남 의료봉사 사업의 두 사업을 논의하였다. 국가보훈처에서는 상대적으로 중요도가 낮고 전담 수행기관과의 밀착도가 낮으며 이익단체가 없었던 6.25 참전국 의료봉사 사업은 수행을 포기하였다. 그러나 국가보훈처는 베트남 의료봉사 사업의 경우 상이군경회라는 고유 정책 자원을 전담 기관으로 활용하는 점, 강력한 이익단체가 존재하는 점, 한-베 민간협력은 부처 차원의 주요 정책 영역에 해당하는 점 등으로 인해 사업을 포기하지 않고 비ODA방식으로 전환하여 지속 추진하는 방식을 택하였다. 기상청의 사업도 한국기상산업기술원이 전담하며 고유한 정책 자원을 활용하는 형태이나 이익단체가 특별히 없고 예산 비중이 낮았다. 한편 기상청도 본 사업을 비ODA방식으로 전환하여 지속 추진하는 방식을 택하였다. 공정거래위원회의 경우 부처가 직접 내부 직원을 파견하는 사업으로 고유 관점 내재화 정도와 영역권 다툼 성향이 모두 높았다. 그러나 외교부는 공정거래위원회 사업에 대해 통합을 추진하지 않은 바, 양 부처 간에 본 사업은 통합이 가능한 유형의 사업이 아님에 대한 상호간의 인지가 이뤄진 것으로 보인다. 교육부의 경우 소속 책임운영기관이 사업을 실시 중이며, 고유 정책 자원을 활용하고 있고 강력한 교원 이익단체가 존재하여 정책 관점 내재화 정도가 크다. 또한 사업의 액수가 매우 크고 부처의 중점 정책 영역에 해당하는 등 영역권 다툼 성향도 크다. 외교부는 2019년 시행계획부터 교육부 사업에 대하여 강력한 조정 의지를 보이고 있으나 교육부는 네트워크에 참여하여 협의를 통해 이를 지속적으로 반대하는 모습을 보이고 있다. 이러한 6개 부처 8개 사업의 사례를 분석모형틀을 통해 분석하였다. 영향 요인에 대하여 부처 별로 상이한 여건은 개별 부처가 네트워크 내에서 다른 전략을 취하도록 촉발하였고 이에 따라 정책 조정의 결과가 다르게 나타나는 것을 관찰하였다. 또한 당초 설정한 가설을 검증하였다. 첫째, 정책의 관점 단절의 차이가 클수록 정책 조정(통합)에 불리하였다. 둘째, 소관 부처의 영역 다툼 성향이 클수록 정책 조정(통합)에 불리하였다. 셋째, 주관부처 및 대통령의 리더십이 클수록 정책 조정(통합)에 유리하였다. 본 연구는 우리나라의 국제개발협력에서 정책 조정의 과정 및 성과를 실제 사례를 통해 세밀하게 기술하고자 하였으나, 실질적으로 네트워크 참여자들의 세부적인 회의록에는 접근하기 어려워, 단계 별로 조정에 대한 검토 결과를 통해 개별 참여자(부처들)의 행태를 추론하는 방법을 사용하여 대략적인 설명에 그친 한계점이 있다. 그러나 우리나라의 국제개발협력에서 실제로 국제개발협력위원회라는 정책조정의 수단, 즉 네트워크적 관점에서 참여자들 간의 회의체 운영을 통한 정책 조정의 과정을 파악한 점, 이 과정에서 개별 부처의 사업 담당자들이 보이는 행태들을 미시적으로 기술하였고, 우리나라의 정책 조정에서 실질적으로 정책 조정 결과에 영향을 미치는 주요 변인이 무엇인지 원형을 제시하였다는 점에서 연구의 의의가 있다. 향후에는 국제개발협력위원회를 통한 정책 조정의 또 다른 사례 등 연구 대상을 확장하여 연구 결과가 일반화 될 수 있기를 기대하여 본다. ; 제 1 장 서 론 1 제 1 절 연구의 배경과 목적 1 제 2 절 연구의 범위 4 제 3 절 연구의 방법 7 제 2 장 이론적 논의 및 연구 설계 9 제 1 절 정책 조정의 개념 9 1. 정책 조정의 개념 및 유형 9 2. 정책 조정의 수단 11 제 2 절 국제 개발 협력 이론 18 1. 국제개발협력 추진체계 18 2. The community-based public oral health program in public health centers was launched in 1993 to promote oral health of the community. This program is considered to be more important after local autonomous government and the passage of national health promotion law. The aims of this study were to evaluate this program and propose adequate guidelines for future public oral health program in public health center. For this study, the mail questionnaire survey was carried out from the 18 public health center. The sample is consist of the 23 dentists and 57 hygienests who work in oral health center of public health center now. Facilities, equipments, manpower and finance of public oral health center, task recognition of dentists and hygienests were investigated. Multiple regression analysis were performed to identify the factors which influence on the outcome of the program. Dependent variable is outcome of program and the independent variables are population size, financing, equipments, motivation of dentist., an extent of work. And also chi-square test were performed to compare the task recognition between dentists and hygienests. The major findings are summarized as follows. 1. Average space of oral health centers are 26.4 �렊 and only 33.3% of the centers have space in the facilities for tooth brushing and mouth rinsing and 45% have no dental unit chair. Oral examination instruments and education equipments are very poor. 2. Program population size (p<0.01), motivation of dentists (p<0.01), finance (p<0.05), an extent of work(P<0.05) and equipment (p<0.05) variables showed statistical significance at the multiple regression analysis, so these variables have an influence on the outcome of the program. 3. The dentists recognized that the priorities of mojor task have to be given to oral examination (57.9%), organizing the health promotion event (57.9% and planning and evaluation of program (57.9%), but hygienests recognized this task are performed in cooperation with the dentists. Recognition of planning and evaluation of program (p<0.01), budget planning (p<0.05), organizing of oral health promotion event (p<0.01) and propagation of program (p<0.05) variables showed statistically significant difference between dentists and hygienests. From the above results, adequate facility, space, basic instruments and education equipments, motivation of dentist, an extent of work and financial supporting are the essential factors to implement the successful public oral health center program. And also required are the job analysis of hyginests and dentists for the reallocation of tasks. ; open

학위논문 (석사)-- 서울대학교 대학원 : 정책학과, 2012. 2. 권혁주. ; 본 연구는 정책변동(policy change)사례 연구이다. 정책변동은 정책형성(의제설정과 의사결정)을 포함한다는 시각에서 논의를 진행하였다. 정책변동의 성공과 실패의 원인을 찾기 위해 '신행정수도이전정책'의 두 차례 정책변동과정을 분석하였다. 의제설정과정은 Kingdon의 정책흐름모형(policy stream model)을 적용하였고, 의사결정과정은 입법과정을 고려한 거부점(veto point)과 거부권행사자(veto player) 개념을 적용하여 분석하였다. '행정수도이전정책'은 1971년에 최초로 제기되었으나 구체화의 기회를 잡지 못하였다. 시간이 흘러 '행정수도이전정책'은 노무현 정부의 등장과 함께 정책의제가 되고 결정되어 추진되었다. 그런데「신행정수도의건설을위한특별조치법」이 헌법재판소로부터 위헌판결을 받게 되어, '행정중심복합도시건설정책'이 후속정책으로 채택되어 집행되었다. 한편, 이명박 정부는 '교육과학경제도시건설정책'으로 정책변동을 추진하지만 실패하게 되었다. 본 연구는 '신행정수도이전정책'이 좌초된 이후 노무현 정부가 실시한 '행정중심복합도시건설정책'으로의 제1차 정책변동과정과 그 성공을 다루었다. 그리고 이명박 정부의 '교육과학경제도시건설정책'으로의 제2차 정책변동과정과 그 실패에 대하여 분석하였다. 이론적 분석틀은 다음과 같이 구성하였다. 먼저 정책변동을 위한 의제설정과정은 Kingdon의 정책흐름모형에 따라 분석하였다. 정책의 3가지 흐름(정치의 흐름, 정책대안의 흐름, 정책문제의 흐름)을 정리한 후, 각 흐름들이 어떻게 결합되어 정책의 창을 열게 되고, 정책의 창 내에서 자신의 의사를 관철시키고자 하는 참여자의 활동을 해당 정책의 찬성과 반대집단으로 구분하여 살펴보았다. 다음으로 정책변동을 위한 의사결정과정은 국회에서의 입법과정을 중심으로 제도적 맥락에 따라 거부점과 거부권행사자를 구별하여 살펴보았으며, 사후적 거부점으로서 헌법재판소를 포함하였다. ; This is a case study on the policy change. This study have a perspective on policy change that includes policy formation (agenda setting and decision making). In order to find the cause of success and failure of policy change, this research analyzed two cases of the policy change of The New Administrative Capital Relocation Policy. Agenda-setting processes were analyzed on the basis of Kingdon' policy stream model, and decision-making processes were analyzed by applying the concept of the veto point considering the legislative process and veto players. The Administrative Capital Relocation Policy was first raised in 1971, but the policy did not take a chance to be materialized. Over time, the policy was determined by the policy agenda and driven with the advent of the Rho Moo-Hyun Administration. However, The Constitutional Court ruled that The New Administrative Capital Relocation Law is unconstitutional, so Multi-functional Administrative City Construction Policy was adopted as a subsequent policy and implemented. On the other hand, Lee Myoung-Bak Administration was attempts to policy change from the Multi-functional Administrative City Construction Policy to the Education and Science Centered, Economic City Construction Policy but Lee administration was failed to change the Multi-functional Administrative City Construction Policy. This study analyzed the first policy change process to the Multi-functional Administrative City Construction Policy and the success since the failure of the New Administrative Capital Relocation Policy. 학위논문 (석사)-- 서울대학교 대학원 : 환경계획학과, 2012. 2. 전상인. ; 경주지역의 고도보존법 개정과정 사례는 사회구조의 변화에 따른 문제점과 갈등의 원인을 공공부문과 시민들이 함께 인식하고, 다양한 이해관계자들이 참여와 협력을 통한 상호작용으로 합의를 도출한 협력적 계획사례로 평가할 수 있다. 따라서 경주사례를 협력적 계획의 구성요소를 통해 분석해 보는 과정은, 지방 환경에서 협력적 계획이론의 적합성과 현실에서의 적용에 있어 발생하는 문제들을 어떻게 개선하여 보완해야 하는지에 대하여 시사점을 제공한다. 협력적 계획이론에 대한 탐구를 바탕으로, 협력적 계획의 네 가지 구성요소들인 '제도적 맥락', '상호작용의 장', '사회적 학습', '참여 및 합의형성'을 도출하였고, 그중 제도적 맥락을 중심으로 분석을 진행하였다. 경주지역 고도보존법 개정과정에는 공공부문과 시민부문을 중심으로 하는 다양한 이해관계자들이 네트워크를 형성하고 있으며, 공유된 이해에 따라 네트워크는 변화하는 양상을 나타냈다. 개정과정의 이해관계자들은 공청회와 주민설명회를 중심으로 하는 상호작용의 장에서 유통되는 정보를 바탕으로 사회적 학습을 하고 있었으며, 이를 바탕으로 계획과정에 참여하여 개정안의 도출이라는 합의를 형성하였다. 분석의 결과를 종합하면, 경주의 사례는 협력적 계획의 외형은 갖추어져 있다고 평가할 수 있지만, 실제 과정에 있어서는 공공부문의 제한적인 정보공개 범위와 접근성의 문제, 참여자의 대표성과 권력의 비차별성이 부족, 상호작용의 장에서 공동학습이 이루어지기보다 소통의 방향이 일방적이라는 문제점을 가지고 있었다. 제도적 맥락으로 종합하면, 경주지역에 있어 위 문제들은 이해관계자들 간 신뢰저하의 원인으로 작용하였다. 경주지역의 이해관계자들은 정책의 목표달성을 위해 표면적으로 협력하고 있지만 서로를 신뢰하지 않았다. 지방환경에서 발생하는 공공부문과 시민들 간의 신뢰의 문제는 지속적인 합의형성의 학습에서 그 해답을 구할 수 있기에, 정책적 제언을 통해 제도적 보완과 사유재산권 제한에 대한 해법을 모색하고자 하였다. ; Gyeongju-city's preservation law revision process is evaluated as collaborative planning practices. On this case, first the public sector and citizens recognize social problem and conflicts, then various stakeholders are produced agreement with participation and interaction. Therefore, this analysis of cooperative Gyeongju case through the components of the collaborative planning theory provides implications for suitability of collaborative planning theory. It also provides the application of local environment and how to improve and supplement in real life problems. To precede the analysis, first I studied on collaborative planning theory and then derived four components of the collaborative planning theory that 'institutional context', 'field of interaction', 'social learning', 'participation and consensus-building'. Among these components, analysis was performed mainly on the institutional context. Various stakeholders to form a network and a shared understanding of the network showed a changing pattern in this revision process. Stakeholders are conducting social learning, based on the information that delivered by public-hearings and presentations around field of interaction. Based on this information, they involved in the planning process and derived the agreement. In sum, this case evaluated as collaborative planning case superficially. But there are some problems in process that information, participation and mutual understanding. Problem that listed above acts as the cause of deterioration of trust between stakeholders. On the surface, to achieve the goals of the policy is working, but stakeholders are did not trust each other. Through policy proposal, I tried to seek a solution on deterioration of trust problem. Continuous learning on public consensus is encouraging a social capital, such as trust. Study institutional complements on regional commission and find solution in private property limitation problem, are able to derive consensus making. ; Master

학위논문 (석사)-- 서울대학교 대학원 : 철학과(서양철학전공), 2012. 2. 정호근. ; The objective of this thesis is to elucidate the concept of the general will and to make Rousseau's point clear by refuting criticisms which determine the general will as totalitarianism. To this end, I would like to reconstruct the concept of the general will by focusing on Rousseau's paradoxical expression of 'forcing to be free'. Because I think that it is possible to get a correct understanding of the general will through paying attention to this phrase. There are two kinds of 'forcing to be free' in the theory of Rousseau's General will. One is found in the notorious passage arguing that whoever refuses to obey the general will must be forced to be free in the Book 1 chapter 7 of On Social Contract. The other is implicit one in the passage discussing the conditions of the general will in the Book 2 chapter 3 and Book 2 chapter 7(part 4 chapter 8). I would like to examine these problems respectively and try to show that Rousseau's ultimate point consists in not 'forcing' but 'freedom'. Conclusively, the authentic difficulty of interpreting of Rousseau's logic is that nevertheless 'forcing to be free' is necessary to the production of the general will, he permit the possibility of failure of this process in practice. Rousseau's theory of the popular sovereignty argues that the foundation of legitimacy of the state does not consist in the divine or natural foundation but in the autonomous will of the people. Despite this theoretical postulate, the people appear to not only rational and social unity, but also always potentially the multitude as disordered gathering of individuals who are vulnerable to a capricious passion. On the one hand, the people's general will should make a society legitimate, particular deliberation of the people may be contingent and could make an erroneous decision on the other. As a result, Rousseau introduces the legislator or the civil religion which is external to a people in order to transform a multitude into unified people. However, because of the very reason that people are still and always multitude, they consequently could not obey this foreign authority so the problem regarding difficulty of self-ruling of the people remains unsolved. At a glance, Rousseau's theory of popular sovereignty seems to optimistic assertion that the people should and could govern itself. But Rousseau's pessimistic claim that the ideal people cannot be naturally given, but must be constructed by constant effort should not be overlooked as well. Finally, the introduction of the legislator or the civil religion is not contradictory to the principle of popular sovereignty because the success or failure of this heteronomous agency is uncertain and the popular sovereignty keeps still its autonomy. The problems are described as follows: the general will aiming at common good could fell to mere will of all by acquiring of a particular will possessed by some individuals. In the same way, the people who should be unitary and organic are degenerated into a blind multitude and the citizen who must be active and rational in the collective deliberation into a passive, passionate subject. The principle of the popular sovereignty claiming that good law makes a good people but the origin of the good law must be also the people, and the fact that primitive people does not have any capacity to legislate such good law is the source of the circular logic Rousseau engages. It also suggests that the self-ruling of the people is not easily attainable project by the introduction of the legislator or the civil religion because after the initial social contract, passionate, irrational and apolitical properties of the human being who had had those attributes in the state of nature cannot be completely eradicated. So the state of the society in Rousseau is more vulnerable than the traditional reading in that there is always the danger of reemergence of the state of nature. The fact that the sovereignty belongs to the people but the people do not have such capacity to exert the sovereignty is the central ambiguity derived from the theory of popular sovereignty in Rousseau. Rousseau's democracy as self-ruling of the people, therefore, remains always incomplete, contestable and unfinished democracy. This paradox of Rousseau is deduced from the consistent, thorough accomplishment of the principle of the freedom. In other words, Rousseau's premises arguing that the legitimacy of the politics does not have any transcendent and ultimate ground and its source is a unique source of will of the people as free being even permit the freedom to refuse their freedom. That is to say, individual citizens must be forced to be free but also can have the (natural) freedom not to be forced to have (civil and moral) freedom. In short, as though effective denaturalization is necessarily required to make man into citizen, it remains a process without a priori guarantee. Thus, the binary oppositions which support Rousseau's whole system, such as oppositions between the society and nature, the people and multitude and the general will and the will of all always have the possibility of confusion in practice. That danger renders the general will only transient or temporary in the conflictual process of politics. The fundamental problem of politics suggested by Rousseau is that the passage from the state of nature to the state of society is necessary, but is also very difficult and could not be achieved entirely. In conclusion, all these considerations show that Rousseau's political philosophy does not defense the alleged totalitarianism but is the philosophy of 'freedom' in the strict and consistent sense of the word. ; 본 논문의 목적은 을 중심으로 루소의 일반의지 개념의 정체를 해명하고, 이를 전체주의로 규정하는 비판들로부터 루소의 논지를 명료하게 하는 것이다. 이를 위해 나는 '자유롭도록 강제'된다는 루소의 역설적인 표현을 중심으로 일반의지 개념을 재구성하고자 하며, 이 점에 주목할 때 비로소 일반의지 개념에 대한 정확한 이해가 가능하다고 본다. 루소의 일반의지 이론에서는 크게 두 가지의 '자유롭도록 강제됨'이 나타난다. 하나는 일반의지를 거부하는 자들이 자유롭도록 강제되어야한다고 주장하는 1부 7장의 주장이며 다른 하나는 2부 3장 및 2부 7장(4부 8장)에서 일반의지의 성립 조건을 논의하는 대목에서 드러난다. 나는 이들을 각각 살펴보고 루소의 궁극적인 강조점은 강제가 아니라 자유에 있음을 보여주고자 한다. 결론적으로, 루소의 논리를 따를 때 나타나는 진정한 난점은 자유롭도록 강제하는 과정이 일반의지의 산출을 위해 필수적임에도 불구하고, 실천적으로는 이것이 실패할 수 있는 여지를 허용하는 데에 있다. 루소의 인민주권론은 국가 정당성의 토대가 신적인 것이나 자연적인 근거에 있다는 견해를 부정하고 인민의 자율적인 의지가 정치적 권위의 원천이라고 주장한다. 그런데 인민은 항상 이성적이고 사회적인 질서정연한 통일체인 것이 아니라 또한 잠재적으로 정념에 좌우되기 쉬운 개인들의 무질서한 모임으로서 다중으로 현상하기도 한다. 즉 한편으로 인민의 일반의지는 사회를 정당한 것으로 만드는 조건이지만, 다른 한편으로 인민들의 개별 심의는 우연적이며 오류를 범할 수 있는 것이다. 따라서 루소는 다중을 인민으로 만들기 위해서 입법자와 시민종교와 같은 인민 외부의 권위를 도입한다. 그러나 인민은 그들이 다중이라는 바로 그 이유로 이러한 외부적 권위에 복종하지 않을 수도 있기 때문에, 인민이 스스로를 통치하는 것에 관한 난점은 해결되지 않는다. 일견 루소의 인민주권론은 인민이 인민 자신을 통치해야 한다는 낙관적 주장으로 보이지만, 인민은 그 자체로 주어지거나 발견될 수 없으며 다만 이상적 인민으로 구성되어야 한다는 루소의 비관적 주장 역시 간과되어서는 안 된다. 결국 입법자나 시민종교의 도입은 인민주권의 원리와 상충되는 것이 아닌데, 이러한 타율적 장치의 성공 여부는 불확실하여 인민주권은 여전히 그 자율성을 지니기 때문이다. 문제는 공동이익을 지향해야 할 일반의지가 각 개인이 갖는 특수의지의 득세에 의해 한갓 전체의지로 전락할 위험, 통일적이고 유기적이어야 할 인민이 무지몽매하고 개별적인 다중으로 전락할 위험, 집단적인 심의에 있어 능동적이고 합리적이어야 할 시민이 수동적이고 정념에만 사로잡힌 신민으로 전락할 위험에 있다. 좋은 법이 좋은 인민을 만들지만 좋은 법의 출처는 또한 인민이어야 한다는 인민주권의 원리, 그리고 최초의 인민은 그러한 입법을 할 수 있는 역량을 가지지 못하는 다중이라는 상황이 루소가 사로잡힌 순환 논리의 원천이다. 그런데 사회계약 이후에도 인간이 자연 상태에서 갖던 감성적, 비합리적, 비정치적 속성은 완전히 해소되지 않으며, 이는 입법자나 시민종교 같은 장치를 통해서도 인민의 자기통치가 온전히는 달성될 수 없는 난제임을 보여준다. 이처럼 루소의 사회 상태는 항상 부분적으로나마 자연 상태가 돌발할 수도 있는 위험을 갖는다는 점에서 취약한 것이다. 주권은 인민에 속하지만 인민은 스스로를 직접 통치할 수 있는 역량을 결여한다는 것이 루소의 인민주권론이 보여주는 애매성이다. 그러므로 인민의 자기통치로서 루소의 민주주의는 항상 불완전하여 계속해서 갱신되고 수정되어야 하는 미완의 민주주의로 남는다. 루소에서 이러한 역설은 자유의 원리를 일관되게 관철시키게 됨에서 귀결된다. 즉 정치의 정당성에는 어떠한 선험적이고 궁극적인 토대도 없다는 것, 인민은 자유로운 존재로서 그들의 의지만이 정치적 정당성의 유일한 원천이라는 루소의 전제는 그들이 스스로의 자유를 거부할 자유마저도 허용한다. 다시 말해 각 개인은 일반의지의 실현을 위해서 자유롭도록 강제되어야 하지만, 이들은 '자유롭도록'(즉 시민적 자유와 도덕적 자유) 강제되지 않을 수 있는 자유(즉 자연적 자유)를 가질 수도 있다. 요컨대 인간을 시민으로 만들기 위해서는 효과적인 탈자연화가 요구되지만, 이는 보증없는 과정이다. 따라서 루소의 체계를 떠받치는 이항대립, 즉 사회와 자연, 인민과 다중, 일반의지와 전체의지는 항상 실천적으로는 혼동될 위험을 가지며 이러한 위험은 일반의지가 정치의 갈등적인 과정 속에서 단지 일시적으로만 가능한 것으로 만든다. 루소가 보여주는 정치의 근본 문제는 자연 상태로부터 사회 상태로의 이행이 필수적이지만, 동시에 이것이 매우 어렵고 온전히 달성될 수 없다는 것이다. 결론적으로 이러한 탐구는 루소의 철학이 전체주의를 대변하는 것이 아니라 여전히 '자유'의 철학이며, 그것도 매우 일관적인 의미에서 그러함을 보여준다. ; Master
