This research attempts to shed light on the role of the international Court of Justice (ICJ) and the significance of its adjudicatory and advisory functions. The theme of this research will initially project a brief introduction of the topic in question, keeping in view the historical and contemporary perspectives of the ICJ. This research also focuses on the organizational structure of the United Nations, keeping in view the position and role of the ICJ within the organization. With practical examples of case laws, the ambit of judicial review in the context of judicial and advisory function of ICJ will also be taken into account. Currently in the legislative, judicial, doctrinal,scientific and academic environment is frequently addressed the important question of evidence, so the finality of this research project is a break in the schemes that exist in this area, based on the concept of guardianship right to effective judicial proof, thus beginning a study concerning Supreme Court as the United States and the European Court of Human Rights to focus on the "OstravaCase", which proved a serious difficulty indirect discrimination probation using statistics evidence. In addition, background review of the Model Code of collective processes for Latin America and the Colombian law 472 of 1998 that provide statistics used for evidentiary purposes, allowing identify the statistical evidence as ideal for the protection of vulnerable populations and condition of discrimination in the absence of evidence substantiating the need for security and protection of their situation. Defending the thesis and descriptive statistics as evidence in serious difficulty collective facts and therefore evidence as to propose to his own substantial regulatory proceedings before international and national courts. Then a catalog of evidence subject only to traditional evidence contrasts with the evolution of law in the "modern world". ; Actualmente en el ámbito legislativo, jurisprudencial, doctrinal, científico y académico, se aborda con frecuencia la importancia del tema probatorio, así que el objetivo de este proyecto de investigación es un rompimiento a los esquemas que existen en esta materia, fundamentado en el concepto de tutela judicial efectiva y el derecho a la prueba, iniciando de esta forma un estudio con referentes como la Corte Suprema de Estados Unidos de América y el Tribunal Europeo de Derechos Humanos, enfocándose en el "Caso Ostrava", donde se probó una discriminación indirecta de seria dificultad probatoria, usando evidencias estadísticas. Además se revisan antecedentes del Código Modelo de Procesos Colectivos para Iberoamérica y de la ley Colombiana 472 de 1998, que contemplan usar estadísticas con fines probatorios, lo que permitirá identificarla como evidencia adecuada para la protección de poblaciones vulnerables y en condición de discriminación, ante la carencia de medios probatorios que avalen la necesidad de garantía y tutela de su situación. Defendiendo así la tesis de la estadística descriptiva como medio de prueba en hechos colectivos con seria dificultad probatoria y por tanto llegar a proponer su regulación sustancial propia para procesos ante tribunales internacionales y nacionales. Luego, un catálogo probatorio sujeto solo a medios de prueba tradicionales contrasta con la evolución del Derecho en el "mundo moderno"
Summary The legitimacy of the Inter-American Court of Human Rights has been called into question both by doctrine and by some states under its jurisdiction. As part of the wider debate on the legitimacy of courts and international law, responses are sought to these criticisms from this legal system, in so far as the Court is a party to it, and to the foundations of the legal binding nature of international law, taking into account both the best philosophical proposals and the reality of current international law. It is concluded that the work of the IDH Court is a feature of contemporary international human rights law which not only enjoys legitimacy in itself, but is a source of legitimacy for international law as a whole. ; Resumen La legitimidad de la Corte Interamericana de Derechos Humanos ha sido cuestionada tanto por la doctrina como por algunos Estados sometidos a su jurisdicción. Dentro del debate más amplio sobre la legitimidad de los tribunales y el Derecho internacional, se buscan respuestas a dichas críticas desde este ordenamiento jurídico, en la medida en que la Corte es un tribunal parte del mismo, y en los fundamentos de la obligatoriedad jurídica del Derecho internacional, atendiendo tanto a las mejores propuestas filosóficas como a la realidad del Derecho internacional actual. Se concluye que la labor de la Corte IDH es característica del Derecho internacional contemporáneo de los derechos humanos que no solo goza de legitimidad en sí mismo, sino que es fuente de legitimidad del Derecho internacional en su conjunto.
The great amount of international Courts, do not yet compose an integrated system, however reveal a part of the globalization. These courts are structures that belong to an integration or international Organization, or exceptionally they are themselves international. They range from account Auditors to Compulsory Jurisdiction, in a gender species relationship between international courts and courts of integration. Ergo their roles are in alignment with the entity's goal they belong to; an international court will have less competence than an integrational one which even act as pseudo constitutional tribunal. It shows that the source of this jurisdiction lies in a volitional face of each State; the fact of not being a supranational system is then mitigated through the figure of judicial dialogue; and these Courts can be classify under different lines of study; the more of thirty Courts of the globe that form the current international justice base the value of their contribution in avoiding war, guaranteeing essential rights, supporting democracies, unified areas, international trade, among others; an undeniable evidence of mankind evolution. ; La gran cantidad de Tribunales internacionales no llegan a ser un sistema integrado, sin embargo traslucen una sección de la globalización; generalmente ellos son estructuras de una Organización Internacional o de Integración. Abstract:The proposal put forward by Spain and Romania for the creation of an International Court Against Terrorism is a traditional legal response to one of the most serious threats of our time. From the beginning of the 20th century, several projects have considered the possibility of including the crime of terrorism in an international jurisdiction with general scope, either as an exclusive competence or as a part of a wider list of crimes. However, certain legal and political obstacles have blocked the developments in this field. This article analyses the main elements and problems of this new proposal in order to determine its viability to evolve from lege ferenda to lege data. The debate revolves around the definition and nature of the crime of terrorism, as well as the relationship with other tribunals, the legal foundation and the well-known political impasse about state terrorism and national liberation movements. The study of these elements shows the aim to reach a consensus at the expense of effectiveness. Nevertheless, this goal is hindered by certain aspects, both internal and external to this proposal, raising serious doubts over the success of this project. Regardless of the outcome, this initiative is a response based on the rule of law against a threat that is disrupting certain basic principles for the pacific coexistence of the international community and, as such, it deserves thorough consideration. ; Resumen:La propuesta presentada por España y Rumanía para la creación un Tribunal Internacional contra el Terrorismo es una respuesta jurídica clásica a una de las mayores amenazas de la actualidad. Desde principios del siglo xx numerosos proyectos han tratado de incluir el crimen de terrorismo en una jurisdicción internacional de alcance general, ya sea como competencia exclusiva o como parte de una lista más amplia de crímenes. Diversos obstáculos jurídicos y políticos han evitado cualquier avance en este ámbito. En el presente artículo se analizan cuáles son los principales elementos de la nueva propuesta y los problemas que plantean, para así determinar la viabilidad que tiene para pasar de una situación de lege ferenda a lege data. El debate principal gira en torno a la definición del crimen de terrorismo; su naturaleza; la relación de este nuevo tribunal con los ya existentes; la herramienta para su fundación y el conocido impasse político sobre el terrorismo de Estado y los movimientos de liberación nacional. El estudio de estos elementos muestra el objetivo de obtener el mayor consenso posible en torno a esta propuesta en detrimento de la eficacia, si bien ciertos aspectos propios y foráneos acaban erosionando esta meta y hacen surgir serias dudas sobre el éxito del proyecto. Independientemente del resultado final, el proyecto merece una especial consideración por ofrecer una respuesta basada en el imperio de la ley en la lucha contra una amenaza que está provocando la disipación de ciertos principios básicos para la convivencia pacífica de la comunidad internacional. The article examines the special role of the Prosecutor of the International Criminal Court in strengthening the international legal order. This analysis was carried out through the prism of the study of certain issues: the concept of "Prosecutor of the International Criminal Court" and his place in the system of international criminal justice; the powers of the Prosecutor at certain stages of the proceedings in the International Criminal Court; the principles of strategy and priority in the activities of the Prosecutor. Historical, system-structural, analysis and synthesis, comparative legal, formal-legal, and formal dogmatic methods were used in the research. In the article was made conclution that that the Prosecutor of the International Criminal Court has a preventive effect on international crimes, because the work of the Prosecutor of the International Criminal Court is aimed not only at punishing perpetrators of international crimes, but also at preventing the commitment of such crimes in the future. It is emphasized that such activities of the Prosecutor ultimately have a positive effect on strengthening the international legal order.
