This paper is an analysis of the foreign Aid Policies of two OECD Development Assistance Committee member countries – Finland and Ireland. The analysis reveals that both Finland and Ireland share high principles on their relations with the developing world, although their current policy outlooks appear to differ significantly. Despite Finland's good economic performance and prosperity largely generated by the global demand and market access, the government has so far failed to include the increasing of ODA on its priority agenda. In addition to the declining commitment, the selection criteria for Finnish aid recipients appears to be partially commercially motivated. Ireland on the other hand has a solid record of targeting the poorest of the poor with its development assistance and has recently increased development country focus in national policies. The challenge for Ireland is the effective utilisation of these funds and even more importantly keeping the government's public, international commitment to the 0,7 percent recommendation level despite the possible future slowdown of the economy.

Aineistona käytetään brittiläisen International Institute for Strategic Studies -laitoksen (IISS) "The Military Balance" -raportin tietoja länsimaiden sotilaallisen t&kpanostuksen kehityksestä. Julkisen vallan sotilaallisia t&k-panostuksia verrataan maiden julkisiin siviilipuolen t&k-menoihin, sotilaallisiin hankintamenoihin, sekä suhteessa maiden BKT:hen ja puolustusbudjetteihin. Raportissa on mukana myös tiivis katsaus sotilaallisen t&k-panostuksen ja tuottavuuden välistä yhteyttä kuvaavista kansainvälisistä tutkimuksista. Raportin tulosten mukaan sotilaallisella t&k-panostuksella ja kilpailukyvyllä ei ole suoraa yhteyttä. ; This study discusses the relationship between military R&D and competitiveness. The study is based mainly on a British International Institute for Strategic Studies -institutes publication "The Military Balance", and furthermore its information about the development of Western countrye´s military R&D-stakes for the years 1994 -2001. Government military R&D is compared for government R&D, defence expenditure and also to the countries gross domestic product and defence budgets. The study also includes tight review about the previous international studies, which are focused to study the relationship between military R&D and productiveness. The study concludes, that there are no direct connection between military R&D and competitiveness.
In this thesis, I critically interrogate power relations that underlie practices, techniques and rationalities of contemporary forms of governance represented by the governing strategy of structural adjustment framework devised by the Bretton Woods institutions— especially the IMF and the World Bank. Far from being a technique of coercion and domination, the thesis demonstrates that structural adjustment framework represents a differing modality of global power that attempts to discursively legitimise external interventions through the imposition of neoliberal economic agenda. I show that structural adjustment policies are carefully constructed neoliberal rationalities of governing through which donors seek to transform the government of Ghana into a self-disciplined neoliberal subject that must behave in an appropriately competitive fashion that is congruent with the ethos of market rationality. I draw on Michel Foucault's nuanced conceptualisation of governmentality, a form of productive and relational power working through individuals' subjectivities particularly as it coexists with the disciplinary rationale of power, and extend it to the relation between the IMF and the World Bank and the government of Ghana. I analyse how these interactions are embedded within a discursive formation and concrete practices which establish certain views of 'a problem' and mobilise particular authoritative actors, techniques and forms of truth as solutions. I also explore how over the decades the IMF and the World Bank through the modalities of conditionality associated with structural adjustment have sought to govern, remake and regulate the economic, political and social institutions of recipient States. In closing, and by way of illustration, I also examine 'non-compliance' as one possibility into what Foucault has termed 'counter-conduct' through which subjects undermine and challenge governmental forms of power. This being said, within the structural adjustment discourse, there remains, I would be inclined to argue, repressive and dominant forms of power. This thesis, contributes to the contemporary scholarship on governmentality to deepen and re-evaluate the distinctiveness of power relations in the example of the IMF and the World Bank adjustment programmes in Ghana.
This master's thesis approaches the debate around biotechnology, genetically modified organisms (GMOs) and the notion of food sovereignty as they are addressed by an Indian, food sovereignty activist group called Navdanya. Basing on the material produced by Navdanya, I am determining, by the means of a theory guided content analysis, what kind of an alternative food sovereignty is. Furthermore, I am examining how food sovereignty can be considered as a means of resistance to the impacts of the GMOs in India. I am arguing that the introduction of the GMOs to India created an opportunity to govern populations and furthermore life and nature. I am examining this by utilising Michel Foucault's theory of biopolitics as a theoretical framework. In order to find out how governance and resistance are practiced, I utilise Foucault's notions of truth and power by illustrating how they can be utilised as a means to create governance and resistance. Therefore, I formulated a "truth regime of biotechnology" to represent the governance, operated by the actors supporting the utilisation of the GMOs, as well as to describe how the governance is created and justified under the regime. As a means of resistance, Navdanya produces alternative truths and puts into practice an alternative of food sovereignty – "the new politics of truth". Navdanya succeeds in its resistance by managing to create the alternative truth of food sovereignty, which does not utilise or reproduce the truths of the biotechnology regime. Navdanya does this by managing to detach the power of the biotechnology regime's truths from their economic and political roles they play in society. The traditional complexity with resistance, in relation to the State of India, is present, which can be however explained by utilising the new ways in approaching the notion of resistance in the context of the Global South.

Finland assumes the chairmanship of the Arctic Council for two years in May 2017. The report provides scholarly knowledge to support the preparation and implementation of the Finnish chairmanship, the definition of priorities for Finnish Arctic policy and public discussion on the Arctic and its transformation. Finland prepares to take over the chairmanship in an increasingly uncertain environment, especially with regard to the economic and political development of the region. Similarly, the Arctic governance structure is transforming. The tasks of the chairman have changed over time as the Arctic Council itself has evolved and non-Arctic actors increasingly pay attention to the region and the Council. The report investigates the transformation of the Arctic region from various perspectives, including the environment and environmental problems, societal change, political and geopolitical dynamics as well as traditional and new economic prospects. The report also investigates the ways in which regional challenges can be tackled with legal and political means, especially in the Arctic Council. In addition, the report analyses the consequences of the chairmanship for Finland and presents suggestions that could enable a successful chairmanship period.
Sata kuntaa riittää , Puolet pois! ja Lopulta kuntia voi olla vain 30. Tutkimuksen aiheena on 1990-luvun alusta 2000-luvun puoliväliin käyty kuntarakennetta koskeva julkinen keskustelu. Keskustelua näkökohtineen, vaatimuksineen ja osapuolineen tarkastellaan totuuden politiikan kautta. Kiinnostuksen kohteena on se, miten tuotetaan ne totuudet, joilla perustellaan kuntarakenteeseen kohdistuvia vaatimuksia. Tutkimuksen aineisto muodostuu kuntaliitoksia käsittelevistä sanomalehtikirjoituksista. Tutkimuksen perusteella kuntarakennekeskustelun solmukohdassa käydään kamppailua tehtävien, voimavarojen ja kuntarakenteiden keskinäisestä suhteesta. Kunnille osoitettujen tehtävien ja voimavarojen merkitys on kansantaloudellisesti ja jakopoliittisesti keskeinen. Voimavaroissa tai tehtävissä tunnistettu muutos käynnistää tarpeen sopeuttaa kahta muuta elementtiä. Muutosvaatimukset ovat kytkeytyneet myös poliittisen vallanjaon jännitteisiin eli puolueiden valtapoliittisiin asemiin kuntakentässä. Kamppailu oikeista tulkinnoista, määritelmistä ja näkökulmista eli totuudesta ilmenee puhe- ja ajattelutavoissa eli diskursseissa. Kuntarakennekeskustelua hallitsee puhetapa, joka on nimetty valtadiskurssiksi. Sen keskeisenä päämääränä on kuntarakenteen uudistaminen suurempien kuntien muodostamiseksi. Kysymys on kuntien toimintaedellytysten ja voimavarojen vahvistamisesta. Keskeiseksi muodostuu kuntien toimintaympäristön muutos. Valtadiskurssissa kuntarakenteen uudistaminen asetetaan rahoituksen tai tehtävien uudelleenmäärittelyn edelle. Kun kuntien tehtävissä tai voimavaroissa tapahtuu muutoksia, rakenteiden tulee sopeutua näihin muutoksiin. Kuntarakenne näyttäytyy hallittavana , sen piirteitä voidaan mitata, arvioida ja muuttaa. Vastadiskurssiksi nimetty diskurssi syntyy reaktiona vaatimukselle kuntarakenteen muutoksesta. Vastadiskurssin lähtökohdista käsin pyrkimys kuntarakenteen muutokseen ei ole perusteltu. Kunnat nähdään historialtaan ja identiteetiltään ainutkertaisina itsehallinnollisina yhteisöinä, joilla on alueellinen itsemääräämisoikeus. Kunnan kehittämistä ja palveluja koskeva päätöksenteko halutaan säilyttää mahdollisimman lähellä kuntalaisia. Kuntaliitosten nähdään johtavan kehittämistoimenpiteiden ja palveluiden keskittymiseen eli hyvinvointivaltion paikalliseen alasajoon. Toimintaympäristön muutos edellyttää sopeutumista, mutta kuntaliitosten sijaan ratkaisuksi esitetään kuntien voimavarojen lisäämistä, tehtävien vähentämistä, kuntien yhteistyön lisäämistä ja muita palvelutuotannon tehostamiseen tähtääviä toimenpiteitä. Nykyiset kunnat ovat muodostuneet useiden vuosisatojen aikana monien vaiheiden kautta. Kuntia on yhdistetty ja niitä on jaettu. Muutoksia on perusteltu eri aikoina ajankohtaisilla kuntien tehtäviin ja taloudellisiin voimavaroihin kohdistuvilla haasteilla. 1990-luvun alussa kuntarakenteen muutostarve kytkettiin byrokratiaan ja lamaa seuranneeseen kunnallistalouden kriisiin. Kaksikärkinen strategia edusti kompromissia tilanteessa, jossa kunnat eivät olleet halukkaita liitoksiin. 2000-luvun puoliväliin tultaessa kuntarakennekeskustelussa tapahtui kuitenkin diskursiivinen muutos. Kuntarakenteen muutosta vaadittiin entistä voimakkaammin nimenomaan palvelujen turvaamiseksi. Kuntien taloudellisen aseman eriytyminen kiihtyi muuttoliikkeestä ja kuntien rahoitusperusteiden muutosten seurauksena. Uhkana olivat myös väestön ikääntymisestä ja palveluvaatimusten muutoksista johtuva palvelukustannusten kohoaminen. Kunnat näyttivät jakautuvan menestyviin ja menettäviin. Monien kuntien edellytykset palvelujen järjestämiseen olivat merkittävästi heikentyneet. Kuntien taloudellinen vastuullistaminen ja vaatimus elinvoimaisuudesta korostuivat. Julkisen talouden sopeuttamistarpeen ja kuntien palvelukustannusten kasvun myötä tehokkuuden rinnalle nousi vaatimus tuottavuuden kohottamisesta. Voimakas vaatimus kuntien elinvoimaisuudesta ja elinkelpoisuudesta merkitseekin itsehallintokäsityksen muuttumista. ; The topic of this study is the public discussion on desired local authority size and the need for municipal mergers. The study is based on the French philosopher Michel Foucault´s discoursive view of knowledge and power and an analytics of governmentality, which has evolved from Foucault´s research. The discussion on local government structure concerns information on local authorities, power and competing governmental rationalities. Governmental rationalities refer to different ways of producing truths and giving causes for social and political aims. The study is based on the conception that governmental rationalities are bound up with a discoursive struggle. This struggle is integrated into public discussion. The material of the study consists of newspaper articles on local government structure and municipal mergers. The discussion on local government structure is examined in contexts from the early 1990s and early 2000s. With regard to these two periods I analyse the changing historical conditions under which the discourses unfold. During the time that passed between the two periods the local authorities faced a major change in economic fluctuations, migration, internationalisation, the European integration and the effects of extensive public administration reforms. The discussion on local government structure is analysed in relation to the recent development of the operating environment, the metamorphosis of the welfare society and the changeable role of local authorities. An important issue in my study is what kind of discourses form the framework for public discussion on local government structure? And how do they regulate the governmental rationalities concerning the relations between the duties, resources and structures of local governments? According to my study, the debate on local government structure is in fact a defining struggle over the local authorities´ mission, resources and structure and how these are related to one another. A change detected in resources or duties triggers a need to adjust either one of the two other elements in question. The interpretations of adjustment in each case result in specific governmental rationalities of reform. There is also the question of how political power is distributed and the tensions arising from it, i.e. a struggle for political power in connection to the political parties´ differentiated position in local governments. A change in local government structure signifies new strategic positions and political strongholds. The positions of the traditional ruling parties, i.e. the Centre Party and the Social Democratic Party, produce opposite dispositions of how and on whose conditions the governmental models are outlined. The study shows that the discussion on local government structure is dominated by a power discourse that strongly emphasises a demand for restructuring in order to form larger municipalities. The power discourse strengthens a rationality that gives priority to restructuring local governments instead of financing or redefining duties. Within the power discourse the conception of local government structure turns into an instrument of governmentality and a perspective which sets aside other possible ways of representing local authorities. Local authorities are perceived as a part of the total structure of administrative units, the characteristics of which may be measured, assessed and changed. A counterdiscourse arises as a reaction to the power discourse and its demand for adjustment to the change of operational environment through a change of local government structure. This counterdiscourse questions the notion of local authorities as a structure that can be steered and governed. Local authorities are seen as unique, autonomous regional institutions where decisions on their development and services must be made as close to the local residents as possible. Thus the counterdiscourse emphasises the local authorities´ territorial autonomy, which secures preserve the unique history and identity of the present municipalities. In the 1990 s the interpretation that the operating environment developed towards regionalisation was characteristic for the change management. The aim to promote regionalisation and conditions influencing regionalisation was strengthened. Regional cooperation represented a compromise between reluctance to merge and securing of industrial development needs and services. The discussion concerning local authority structures was founded upon a two-peaked strategy of adjusting, i.e. the aim was to actively further the promotion of both municipal mergers and regional cooperation. Securing services is the topic in the core of the discussions on local government structures. And this topic is enwrapped in the discourse on equality. However, equality appears to be the ambivalent precondition for the reform. In the power discourse the equal status of citizens is threatened by the differentiation of the financial situation of local authorities. A change of the local government structure arises as the solution. The counterdiscourse emphasises one aspect above all others, i.e. to secure services as close to the local residents as possible. The pursuit of scale benefits, concentration of resources and development measures and cutting down on services are considered risks in the change of local government structures. The fear for the effects of concentrated powers and for the dismantlement of the welfare society at local level will be actualised in the counterdiscourse. From the beginning of the 1990 s to the mid-2000 s there is a discoursive change in the discussion on local government structures. The discussion starts increasingly to circle around the change of operating environments of local authorities. The prerequisites of local governments to secure the services are getting questioned due to migration, changes in the population s age structure and regional differentiation. There seems to be a division into winning and losing local authorities. The financial and operating prerequisites of small and remote local authorities are considered to have weakened. Making provisions for changes in the operating environment emphasises vitality and viability. A condition is that local authorities embrace their financial responsibilities. The responsibilisation in the discoursive change is similar to the responsibilisation frequently applied in connection with the management of welfare drawing on different neoliberal practices. The mentality of liberalisation and responsibilisation can be more widely acknowledged in the development of the relations between local authorities and the state. In political rationalisation the promotion of productivity has become the counterpart of the securing of services. The rhetoric of financial necessities is more strongly than before starting to regulate the discussion. In the 1990 s the emphasis was on effectivity and claims for the streamlining of the bureaucratised governance. In the 2000 s the talk focused on productivity and the demand that more should be achieved despite decreasing resources. The concept of productivity welling from the background assumptions of economic science is problematic for the public sector. It does not measure welfare and wellbeing. Consequently the dispute is not about measures but about goals. What kind of local authorities will be given the responsibility for the services to residents and the development of their close environment? The answer to this question also implies how resources and duties are allocated to local authorities. The discoursive change is all about a reorganisation of the mutual relations between knowledge and power. One politics of truth is replaced with another politics of truth with more explanatory power and penetrating effects than the former one. The responsibilisation of local authorities and the assessment based on financial processes come in the centre of the discussion on local government structures. The definitions of local authority duties, resources and structures also contribute to the revision of local self-government. The strong claim for vital and viable local authorities actually means the articulation of a new kind of basis for the self-government.
Abstract The research examines the U.S. approach to the independence of the Philippines and its stages at the end of the 1920's and in the early 1930's. The Philippines belonged to the United States from 1898 to 1946. The relationship between the two countries was quite controversial from the very beginning. Many of the different phases and factors resulted in the U.S. Congress passing a law in March 1934, which guaranteed full independence to the Philippines after a ten-year transition period. The birth of the law which led to Philippine independence was a complex political process, with a number of variables influencing the attitudes and the solution. These factors accounting for the formation of the solution changed as time progressed. One of the key variables in terms of the Act of Independence began when the Great Depression began in 1929, which affected especially agricultural producers. As the Philippines was administratively a part of the federal government, in these circles it was seen that only independence could be the solution to close the archipelago outside of the domestic market. In fact, the sugar and coconut imports from the Philippines were not a real competitor to the federal farmers. In addition to the domestic farmers the Cuban sugar producers, who were headed by U.S. investors, felt that Philippine duty-free import was challenging their share of the federal market. They were of the opinion that the independence of the Philippines could guarantee them better market positions in the federal sugar market, and strove to promote the Independence Act as soon as possible. As a result of the worsening unemployment situation Filipino migrant workers started competing for scarce jobs. As a part of the United States Filipinos had free immigration rights. In particular, on the west coast and in the employees' organizations, independence was seen as the easiest way to limit immigration. In addition to the economic cycle other significant factors were the changes in foreign policy, and in particular the rise of Japan as a powerful superpower in the Far East. The federal government and the majority of the Congress represented opposing views of the independence issue. The Congress was able to show strength in this confrontation. The main sources of the material consist of the U.S. government documents, the Congress document collections, foreign relations document collections, memoirs and other documents. ; Tiivistelmä Tutkimuksessa tarkastellaan Yhdysvaltain suhtautumista Filippiinien itsenäistymiseen ja siihen liittyneisiin vaiheisiin 1920 -luvun lopulla ja 1930-luvun alkupuoliskolla. Filippiinit kuuluivat Yhdysvalloille vuosina 1898–1946. Maiden välinen suhde oli hyvin kiistanalainen alusta alkaen. Monien eri vaiheiden ja tekijöiden seurauksena Yhdysvaltain kongressi hyväksyi maaliskuussa 1934 lain, joka takasi Filippiineille täyden itsenäisyyden kymmenen vuoden siirtymäajan jälkeen. Filippiinien itsenäistymiseen johtaneen lain synty oli monimutkainen poliittinen prosessi, jossa oli useita suhtautumiseen ja ratkaisuun vaikuttaneita muuttujia. Näiden tekijöiden osuus ratkaisun muodostumiseen muuttui ajan edetessä. Yksi keskeisimmistä muuttujista itsenäisyyslain suhteen oli vuonna 1929 Yhdysvalloissa alkanut suuri lamakausi, josta kärsivät erityisesti maataloustuottajat. Koska Filippiinit oli hallinnollisesti osa liittovaltiota, näissä piireissä nähtiin, että ainoastaan itsenäisyys voisi saattaa saariston sisämarkkinoiden ulkopuolelle. Filippiineiltä tuotava sokeri ja kookosöljy eivät olleet todelliset kilpailijat liittovaltion viljelijöille. Kotimaan viljelijäväestön lisäksi Kuuban sokerintuotantoon investoineet amerikkalaiset sijoittajapiirit kokivat Filippiinien tullivapaan tuonnin vievän heiltä markkinoita. He katsoivat, että Filippiinien itsenäisyys takaisi paremmat markkina-asemat liittovaltion sokerimarkkinoilla ja pyrkivät edistämään itsenäisyyslain mahdollisimman pikaista säätämistä. Alati pahenevan työttömyyden seurauksen filippiiniläiset siirtotyöläiset kilpailivat hupenevista työpaikoista. Filippiiniläisille oli taattu vapaa maahanmuutto-oikeus. Etenkin länsirannikolla ja työntekijäjärjestöissä saarten itsenäistyminen nähtiin olevan helpoin tie maahanmuuton rajoittamiseen. Taloudellisten suhdanteiden ohella muita merkittäviä tekijöitä olivat muutokset ulkopolitiikassa ja etenkin Japanin nousu voimakkaaksi suurvallaksi Kaukoidässä. Liittovaltion hallinto ja kongressin enemmistö edustivat vastakkaisia näkemyssuuntia itsenäisyyskysymyksessä. Kongressi pystyi osoittamaan voimansa tässä vastakkainasettelussa. Tutkimuksen keskeisin lähdeaineisto koostuu Yhdysvaltain hallinnon asiakirjoista, kongressin asiakirjakokoelmista, ulkoaisainhallinnon asiakirjakokoelmista, muistelmista sekä lähdeteoksista.
The article studies rejected patent applications in Finland at the end of the nineteenth century. It examines the development of the patent system as part of the nation's emerging liberal economic institutions. Internationally, patents have been employed to study technological and economic development, however, the rejected patents and the agency of the patent officials have received little attention. The article examines newly collected applications related to patenting from 1864-1884 and asks, whose applications were rejected and why. The article shows how foreigners, and Swedish applications in particular, were typical among the rejected applicants. Most applications were rejected because the officials did not see the invention as novel or assessed the application as incomplete. In their examination, the Finnish patent officials heard experts and used material objects as evidence. The article shows how the Finnish patent officials followed modern practices of patent examination already in the early 1870s—before the actual legislation and more rigorously than in the neighbouring Sweden. Even though the interests of the domestic industries were raised in some cases, the officials managed and guided the national industrial property rights by developing the patenting principles in the state administration. ; Artikkelissa tutkitaan Suomessa hylättyjä patenttihakemuksia ja tarkastellaan näiden valossa autonomisen Suomen patenttijärjestelmää osana maan taloudellisten instituutioiden rakentamista 1800-luvun lopulla. Kansainvälisesti patentteja on hyödynnetty teknisen ja taloudellisen kehityksen tutkimuksessa, mutta hylätyt patentit ja patenttiviranomaisten toimijuus ovat jääneet vähemmälle huomiolle. Artikkelissa käydään läpi Senaattiin saapuneet patentteja koskevat anomukset vuosilta 1864-1884 ja kysytään: keiden patentit hylättiin ja miksi? Artikkeli osoittaa, että hylätyissä patenttihakemuksissa korostuivat ulkomaiset, etenkin ruotsalaiset hakijat. Yleisin syy hylkäämiselle oli, ettei keksintö ollut viranomaisten näkökulmasta uusi tai että hakemus oli puutteellinen. Viranomaiset kuulivat patenttihakemusten arvioinnissa asiantuntijoita ja käsittelivät jopa esinetodisteita. Artikkeli näyttää, että Suomen patenttiviranomaiset seurasivat patenttien tutkintaan liittyviä moderneja käytäntöjä jo 1870-luvun alussa – ennen varsinaista lainsäädäntöä ja tiukemmin kuin esimerkiksi Ruotsissa. Vaikka muutamassa tapauksessa viitattiin kotimaisen teollisuuden etuihin, tapahtui teollisten omistusoikeuksien ohjaus ja rajaaminen ennen kaikkea viranomaisten omaksumien patenttiperiaatteiden kautta.
Kunnat ovat suuren muutoksen keskellä. Kuntarakenneuudistus sekä sosiaali- ja terveydenhuollon palvelurakenneuudistus tulevat muuttamaan kuntien hallintoa merkittävästi. Kari Hakarin tutkimus tarkastelee yhden suuren kaupungin hallinnonuudistusta uuden julkisen hallinnan teorian näkökulmasta. Uusi julkinen hallinta on kunnallishallinnon uudistamisen kolmas vaihe, joka on kehittynyt perinteisestä julkishallinnosta ja tätä seuranneesta uudesta julkisjohtamisesta. Tutkimuksen tavoitteena on arvioida, onko uudesta julkisesta hallinnasta kuntien hallinnonuudistusten uudeksi suunnaksi. Tutkimuksella tuetaan myös kuntien käytännön kehittämistoimintaa. Tutkimuskohteena on Tampereen kaupungin toteuttama kokonaisvaltainen toimintamallin uudistus. Uudistus muodostuu kolmesta osasta: pormestarijärjestelmästä, tilaaja–tuottaja-mallista sekä asiakaslähtöisestä prosessiajattelusta. Tutkimustulokset osoittavat, että Tampereen muutosprosessi toteuttaa varsin hyvin uuden julkisen hallinnan mukaista ajattelua. Se ei kuitenkaan edusta tätä moderneimmillaan, vaan perustuu vahvasti sekä byrokraattisen organisaation rakenteisiin että uuden julkisjohtamisen mukaiseen markkinoistumisen tavoitteeseen. Näyttää siltä, että Tampereenkin toimintamalli kaipaa päivittämistä, jotta se pystyy vastaamaan paremmin tulevaisuuden haasteisiin. Moderni uuden julkisen hallinnan kokonaisuus kuntien hallinnon kehittämisen näkökulmasta muodostuu 1) avoimesta kumppanuudesta asukkaiden, palvelutuottajien ja muiden sidosryhmien kanssa, 2) paikallisuuden ja yhteisöllisyyden korostamisesta, 3) monimuotoisesta suorasta ja edustuksellisesta demokratiasta, 4) asiakaslähtöisestä palvelujen kehittämisestä, 5) tulosperusteisesta palveluiden hankinnasta sekä 6) monimuotoisesta palvelutuotannosta. Muutos vallankäytössä on yksi uuden julkisen hallinnan ominaispiirre. Kunnan johtaminen edellyttää monimutkaistuvassa yhteiskunnassa uusia välineitä ja toimintatapoja. Tutkimuksen mukaan moderni kunnan johtaminen perustuu onnistuneelle yhdistelmälle pehmeää ja kovaa valtaa. Tutkimuksen mukaan uusi julkinen hallinta voi kehittyä kuntien hallinnonuudistusten perustaksi. Tätä tukee se, että uudessa julkisessa hallinnassa kehittämisperiaatteet muodostavat loogisen kokonaisuuden, jota voidaan käytännössä toteuttaa monin välinein erilaisissa tilanteissa. Lisäksi on olemassa ilmeinen tarve yhteiselle visiolle, jotta välttämättä edessä oleva kuntien hallinnonuudistus pystytään toteuttamaan. Uudet, isot reformit tarvitsevat aina mallin, johon muutos voidaan perustaa. Uuden julkisen hallinnan kehittymistä tukee myös se, että hallinnon kehittämisen käytännön toteutukset sekä kansainvälisesti että Suomessa toteuttavat jo monella tavoin uuden julkisen hallinnan mukaisia hallinnonuudistuksen kehityssuuntia. Tutkimus tuo uutta tietoa uuden julkisen hallinnan käytännön toteutuksesta suuressa suomalaisessa kaupungissa. Se näyttää myös suuntaa kuntien kehittämistyölle yhdistäen käytäntöä ja teoriaa ja tuo näin tietoa sekä käytännön kuntien kehittämistehtävissä toimiville että tutkijoille. Tampereen toimintamallin päivittämiselle se tarjoaa päämäärän, jota kohti edetä. ; The subject of this dissertation is the new public governance from the perspective of the local government management reforms. The research question is: how is the new public governance reflected in local government reforms? The research ques-tion will be examined from the perspectives of theory, practice and power relations. The empirical object of the study is the management reform of the City of Tampere, Finland. The reform includes three parts: the mayoral system, the purchaser-provider model and the customer-oriented process organization. The study also aims at the development of municipal operations, and presents new public governance as a comprehensive "theory of practice", which combines theory and practice and allows municipalities to find perspectives, tools and a theoretical framework for their management reforms. The study consists of four separate published sub-studies and this summary. The first sub-study deals with the theory of new public governance within the framework of the management reform of the City of Tampere. The second and third sub-studies are concerned with a variety of practical implementations of new public governance in the City of Tampere management reform. The fourth sub-project addresses power relations. In this summary the results are presented from the perspective of a management model, networked service development and the change in the exercise of power. Questionnaires were the empirical basis of the first two sub-studies, the third examined written documents and used interviews with experts and fourth sub-study relied on theme interviews with directors. New public governance (NPG) represents the third wave of the management re-forms evolving from a traditional public administration, and that following the new public management. An essential feature of the new public governance is that it does not completely reject earlier administrative reforms, but rather complements them with new solutions. NPG is based on the view that the public administration is no longer able alone to control society, but the success of governance is based on the partnership with the private and third sectors as well as with the citizens. Within the framework of new public governance one can, at least to some extent, identify three distinct trends. The differences between the trends are mainly in emphasis placed on various matters. Discussion of the new public governance started in network governance. Next, the new public governance was discussed from the perspective of democratic decision-making and public participation. The third emphasis seems to be on the new public governance as a development of customer-focused services and co-production. The results show that the process of change of the City of Tampere can be imple-mented quite well within the new public governance paradigm. At the beginning of the process the new public management was a decided basis of the reform. In the phases of preparation and implementation constraints and international experiences of weaknesses were perceived in the new public management model. On the basis of this, the management model has been developed further so that issues of new public governance such as local democracy, participation, networks and transparency of government have become stronger. The management model of Tampere does not, however, represent the new public governance in its modern form. The Tampere model is built on a basis of democracy and regulation of traditional public administration as well as the quasi-markets of the new public management. The modern new public governance reform seems to be moving especially towards a customer-oriented service development. According to this study the change in the use of power seems to be one of the characteristics of society's growing complexity and new public governance. There is a need for new instruments for leadership and in the exercise of power in an in-creasingly complex society. The modern municipal leadership is based on a suc-cessful combination of soft and hard power. The growth of new public governance as the next paradigm of management re-forms can be justified from three different perspectives. First, the new public gov-ernance is a logical entity. It brings together coherent principles of management reform, which can be implemented in practice by a variety of techniques in different situations. Second, there is an obvious need for a common vision for local gov-ernment reforms. New, large-scale reforms always need a new paradigm in which a change can be set up. There is a need for a common vision for the municipalities and their functions in order to implement local government reform. The new public governance could be the entirety that can show the way for the necessary man-agement reform of municipalities in Finland. Third, the practical implementations of management reforms both internationally and in Finland are already realizing the trends of management reform of new public governance in a number of ways.
Väitöskirjan tavoitteena on selvittää valtiontukisääntelyn ja sen tulkinnan yhteyttä EU:n politiikkaan sekä käytettyihin taloudellisiin ajattelutapoihin. Politiikan lisäksi väitöskirjassa tarkastellaan erityisesti tukikilpailuun liittyvän taloustieteellisen keskustelun vaikutusta valtiontukisääntelyyn. Lisäksi tavoitteena on selvittää, miten tavoitteet tosiasiassa ohjaavat valtiontukisääntelyn kehitystä ja miten nämä tavoitteet mahdollisesti kehittävät valtiontukisääntelyä tulevaisuudessa. Valtiontukipolitiikkaa harjoitetaan pääasiassa SEUT 170(3)(c) -artiklan nojalla. Artikla on poikkeus SEUT 107(1) -artiklan sisältämään laajaan valtiontukikieltoon. SEUT 107(3)(c) -artikla mahdollistaa sellaisten tukien myöntämisen, jotka tuottavat enemmän yhteistä etua kuin haittaavat kilpailua sisämarkkinoilla. EU:n tuomioistuin on vahvistanut, että Euroopan komissiolla on laaja harkintavalta arvioidessa, mitkä tuet täyttävät tämän artiklan edellytykset. Komissio onkin toteuttanut valtiontukipolitiikkaa pitkälti tämän artiklan soveltamisella. Väitöskirjassa on kolme tutkimuskysymystä. Ensimmäinen tutkimuskysymys on "Mitkä ovat olleet merkittävimmät valtiontukisääntelyyn vaikuttavat taustaolettamat ja tavoitteet?" Tutkimuskysymykseen vastataan tutkimuksen luvuissa 2, 3 ja 4, joissa käsitellään valtiontukisääntelyn taustalla vaikuttanutta politiikkaa, sääntelyn historiallista kehitystä sekä tukikilpailuun liittyvää tutkimusta. Merkittävin valtiontukisääntelyn tavoite on ollut estää jäsenvaltioiden välistä tukikilpailua, jonka on katsottu haittaavan kaikkia jäsenvaltioita. Taustaolettamana on ollut, että tukikilpailussa kaikki sisämarkkinoilla toimivat jäsenvaltiot häviävät, ja jos valtiontukipolitiikkaa ei säännellä, jäsenvaltiot tukevat yrityksiään, mikä johtaa tukikilpailuun. Toiseksi tavoitteeksi tukikilpailun estämisen rinnalle on 2000-luvun taitteessa noussut tavoite poistaa markkinahäiriöitä valtiontuilla. Näitä markkinahäiriötä ovat olleet mm. kasvihuonekaasupäästöihin liittyvät ulkoisvaikutukset ja finanssikriisi. 2010-luvulla valtiontukisääntelyn tavoitteena on ollut myös lisätä talouskasvua ja parantaa ympäristön tilaa. Näiden lisäksi valtiontukisääntelyä ja komission julkaisuja tarkastelemalla voidaan havaita yksi EU:n toimivaltaan kuulumaton valtiontukisääntelyn tavoite: jäsenvaltioiden varojen säästäminen. Toinen tutkimuskysymys on "Miten nämä [tavoitteet ja taustaolettamat] ovat historian saatossa näkyneet valtiontukisääntelyssä ja komission toiminnassa?". Tutkimuskysymykseen vastataan luvuissa 1.5, 3 ja 4, joissa käsitellään valtiontukisääntelyn historiaa osana EU:n historiaa sekä nykyisen sääntelyn tavoitteita ja muutoksia. Historiallisesti tukikilpailun estäminen on ollut voimakkaimmin näkyvä tavoite, sillä valtiontukipolitiikka ja sääntelyn tulkinta ovat kiristyneet koko EU:n historian ajan, ja Unionin tuomioistuin on katsonut yhä useampia tukia kielletyksi valtiontueksi. Myös komissio on jatkuvasti kiristänyt linjaansa katsoen yhä useampia tukia sisämarkkinoille soveltumattomaksi valtiontueksi. Viimeisin merkittävä kehitys on ollut erilaisiin verotukiin puuttuminen 2010-luvulla. Tämän lisäksi myös tavoitteet markkinahäiriön poistamisesta ja talouskasvun lisäämisestä ovat näkyneet sääntelyssä. Markkinahäiriön poistamisen nojalla komissio on sallinut valtavasti ympäristö- ja erityisesti energiatukia. Nämä tuet ovat nykyään suurin tukiryhmä EU:ssa. Talouskasvua taas on pyritty lisäämään sallimalla yhä useampien erilaisten talouskasvulle hyväksi katsottujen tukien myöntäminen, osittain jopa luopuen tavoitteesta estää tukikilpailua. Kolmas tutkimuskysymys on "Miten nykyiset ympäristö- ja energiatuet sopivat tähän kehitykseen ja voidaanko tukipolitiikan katsoa muuttuneen näiden vuoksi?". Tutkimustulosten perusteella ympäristö- ja energiatukiin liittyvä komission sääntely on pyrkinyt lisäämään näitä tukia. Tuet sopivat teoriassa hyvin valtiontukien systematiikkaan, koska sallitut tuet eivät vääristä kilpailua voimakkaasti, mutta ne lisäävät yhteistä etua ja samalla säästävät jäsenvaltioiden varoja turhalta tukemiselta. Tämä perustuu tosin pitkälti komission asettamaan teoreettiseen viitekehykseen ja ennalta määrättyihin päätöksentekosääntöihin ilman empiiristä tarkastelua. Loppulauseena voidaankin todeta, että valtiontukipolitiikka perustuu pitkälti ajatukseen, että jäsenvaltiot tukevat yrityksiään, jos se vain sallitaan. EU-tasolla tapahtuvien päätösten rahankäytöstä katsotaan olevan järkevämpiä kuin jäsenvaltioiden tasolla tapahtuvien päätösten. Tämän vuoksi valtiontukipolitiikka on perustunut siihen, että yhteisen hyvän mukaiset tuet sallitaan, ja jäsenvaltiot tukevat halutessaan. Tähän mennessä politiikka on ollut tehokasta, koska jäsenvaltiot käyttävät merkittävästi varoja sellaisten kohteiden tukemiseen, jotka on erikseen sallittu SEUT 107(3)(c) -artiklan nojalla. ; The goal of this thesis was to find out how state aid regulation and interpretation of the regulation are connected to EU policies and economic theories used to form said policies. In addition to studying the policies, the effects of economic theory related to subsidy competition is studied. The goal of this thesis is to find out how these policy goals affect state aid regulation and how these goals will affect state aid regulation in the future. The state aid policy is mostly based on TFEU article 107(3)(c). The article contains an exception to the broad state aid prohibition in TFEU article 107(1). TFEU article 107(3)(c) enables granting aids that facilitate economic development and common good more than it adversely affects trading conditions within the internal market. CJEU has stated that the European Commission has broad discretion when evaluating which aids meet the criteria set in TFEY article 107(3)(c). The commission has used this article to execute state aid policy in the EU. The thesis contains three research questions. The first research question is "What are the most significant presumptions and goals affecting state aid regulation?". This research question is answered in chapters 2, 3 and 4, which study the policies behind state aid regulation, the historical development of state aid regulation and the research related to the subsidy competition. The most significant goal for state aid regulation has been to prevent subsidy competition between member states, which has been seen to harm all member states. The presumption behind state aid regulation has been that in subsidy competition everybody loses, and that if national state aid policies are left unregulated, all member states will subsidy their companies, which will lead to subsidy competition. In the 2000s, another goal of the state aid regulation has been to use the state aids to prevent market failures. Market failures referred to in this goal are e.g. externalities related to greenhouse gases and financial crisis. In addition to these goals, one other goal of state aid regulation in the 2010s has been promoting economic growth and improving the environment. Additionally, one other state aid policy goal that is not within the EU jurisdiction can be derived from state aid regulation and the commission's publications: saving member states' public funds. The second research question is "How these [goals and presumptions] have affected state aid regulation and the commission's actions in history". This research question is answered in chapters 1.5, 3, and 4, which study state aid history within the EU history and the current regulation's goals, as well as changes in current legislation. Historically, the most significant goal has been preventing subsidy competition; the state aid policy and the interpretation of the regulation have become more and more strict during the whole history of the EU. In addition to this, CJEU has deemed more and more aids incompatible with the internal market. The commission has continuously tightened its decisions and deemed more and more aids incompatible with the internal market, the last significant change being the state aid decisions regarding different tax measures in the 2010s. In addition to this, goals to remove market failure and to promote growth have influenced the regulation and its interpretation. In order to remove market failures, the commission has allowed significant subsidy programs for environment and renewable energy. These subsidies are currently the largest subsidy group in the EU. Economic growth has been promoted by allowing more and more different aids that are seen beneficial to growth, even partially abandoning the goal to prevent subsidy competition. The third research question is "How are the current environmental and energy aids suited for this development and is the subsidy policy changed due to this development". Results show that the commission regulation related to environmental and energy aids is designed to increase the amount of these aids. These aids are theoretically aligned with the state aid system, because the allowed aids do not significantly disturb competition, but they promote common good and simultaneously save public funds from useless subsiding. This conclusion is mostly based on theoretical framework and predetermined decision-making rules without any empirical evaluation. As a conclusion, it can be stated that the state aid policy is mostly based on the idea that member states will grant aids if it is allowed. Additionally, it is also based on the idea that the financial decision-making is better on the EU level than on the national level. In result, the basis of the state aid policy has been that aids beneficial to common good are allowed, and it is up to the member states to grant the aids if they want to. This policy has been effective because member states have been using significant amounts of funding to the goals allowed in TFEU article 107(3)(c).
Ex ante assessment of regulatory impact upon businesses: A neo-institutional study on the context, international influences, and Finnish experiences Regulatory impact assessment (RIA) has an established place in the European Union and its member states. This article considers evolving Finnish ex ante RIA concerning certain regulatory costs to firms. Drawing upon a neo-institutional theoretical framework and proposing three generally oriented hypotheses we received the following results. (1) The rationality of theevolving Finnish ex ante RIA of selected administrativeregulatory costs to firms gives rise issuesgiven the low implementation rate of thegeneral natonal RIA guidelines. (2) Reference to the ex ante RIA of regulatory costs to firmsin other countries has served the legitimation of preferred procedures in Finland rather than offerssolid evidence on the rationality of the foreign procedures. (3) Without a stronger contextualization of the evolving Finnish ex ante RIAmof regulatory costs to firms its procedures risk adverse effects because of their confined scope, the uneven quality of their input data, and their weak connections to the general national ex ante RIA. These results suggest the redesign of the Finnish RIA to take better into account the institutional, political, historical and cultural characteristicsof governance in this country. Marxismin mukaan kapitalistisen yhteiskunnan jäsenet jakaantuvat kolmeen luokkaan: porvaristoon, keskiluokkaan ja työväenluokkaan. Jotkut marxismin tukijat jakavat keskiluokan talonpojistoon ja muuhun keskiluokkaan. Talonpojisto on vähenevä luokka. Koska marxismin luokkateorian mukaan poliittiset puolueet vaalivat yhteiskuntaluokien intressejä, tutkin pitääkö tämä väite paikkansa. Ensin selvitin marxilaisen teorian luokista ja niiden intresseistä eli eduista, joiden puolustamiseski luokat järjestäytyvät poliittisiksi puolueiksi. Ne laativat itselleen yhteiskuntapoliittiset ohjelmansa, joita ne pyrkivät politiikansa avulla toteuttamaan. Tutkimusaineistona käytän Suomen eduskunnassa tutkimusvuosina edustettina olelleiden puolueiden tavoite- ja yleisohjelmia, joista selvitän sisällön analyysiä käyttäen niiden sisällön ja julkilausutut tavoitteet. Erityisesti pyrin selvittämään orientoituvatko puolueet ohjelmissaan tiettyjen luokkien etujen puolustajiksi vai missä määrin ne esiintyvät yhteiskunnan yleisten etujen vaalijoina. Tutkimus tapahtuu toisaalta puolueiden eduskuntoimintaa selvittämällä. Tällöin pyrin saamaan selville sen toimivatko puolueet periaate- ja tavoiteohjelmiensa mukaisesti laatiessaan lakialoitteita eduskunnassa. Kolmantena tutkimuskohteena on hallituksen esitysten sisällön eritteleminen intressiorientaation pojalta. Kysymys kuuluu palvelevatko hallituksen esitykset yleistä vai luokkien erityisetuja. Tutkimuksessa selvisi, että puolueet niin ohjelmalausumissaan kuin eduskuntatoiminnassaan vaalivat sekä yleistä etu, josta käytän nimitystä luokkien yhteisetu, että luokkien erityisetuja. Eniten puolueet vaalivat yhteisetua. Erityiseduista puolueet vaalivat kukin tiettyä luokkaetua enemmän kuin toista. Tämän perusteella puolueet jakaantuvat ensijaisesti porvariston, keskiluokan ja työväenluokanetuja vaaliviksi. Hallituksen esityksissä luokkaorientaatio on heikompaa kuin kansanedustajien lakialoitteissa. Tutkimustuloksistani selviää myös se, että vaikka puolueet ovat viime vuosikymmeninä ottaneet vaaliakseen aikaisempaa enemmän kaikkien luokkien intressejä ja niiden yleispuolueominaisuudet ovat lisääntyneet, tietty luokkaorientaatio on säilynyt. ; Classes continually alter and influence party strategies and also the behaviour of voters. The members of classes form economic, professional and political organisations. Every class aims to exert the greatest influence upon the state with the help of its political party. This study researches the class basis of political competition, the effect of class interests on the policies of nine Finnish parties in their political programmes and initiative work in the Parliament. The investigation is based on historical materialism and its class structure theory developed by Karl Marx, Friedrich Engels and other Marxists. The aim of study is to estimate how appropriate the class schema of historical materialism is for analysing the political partisanships and ideological conflicts in advanced industrial society. The statements and aims of political party programmes are put into practice in Parliament. This research analyses how parties represent their aims in their political programmes and what their parliamentarians do in Parliament. Is a party the representative of one class or does it equally promote the interests of many classes? Is it a class party or a generally oriented party? As in historical materialism, the programmes and legislative initiatives have been classified into five groups. The first group contains general class interest, oriented towards the common good. The next four groups comprise bills with a specific class interest orientation: bourgeoisie, the middle class, farmers and workers. The parties investigated are The National Coalition Party /The Conservative Party, The Swedish People`s Party, The Finnish Centre Party, The Finnish Social Democratic Party, The Left Alliance, The Liberals, The True Finns, The Christian Democratic Party and The Greens. The changes in politics and in party relationships over thirty years are investigated by comparing the parliamentary actions of parties from the 1960´s to the 1990´s. The study concerns the legislative initiatives of the years 1965, 1972, 1988 and 1999. The data on the programmes were collected from the two political programmes of nine parties from the years 1950 2003. The programmes of political parties are the public flag of the party as Engels expressed it, although their programmes have lost some of their class orientation. In the programmes of all nine political parties the contents aiming at the common good are the first, most important aim, the percentages being 76 98 %. Differences in the programmes of the political parties can still be found. The political parties emphasise their interests and aims in their own ways. The Conservative Party, The Swedish People´s Party and The Liberals have the next important interest in the bourgeoisie. The Swedish People´s Party, The Finnish Centre Party and The True Finns emphasise the middle class and the farmers. The Finnish Social Democratic Party, The Left Alliance and The Greens take care of working class. The main task of Parliament is to enact legislation. Bills can be submitted to Parliament by the Government or as private members bills. In this process the class interests notably emerge in private members bills of plenary sessions. The main Finnish political parties took into consideration the interests of all classes. All nine parties have made in the largest extent common good legislative initiatives. For all nine parties, the most prevalent type of legislative initiatives was those for the common good (84 -67 %). At the same time they tended to favour special class interests. The least specific class parties were The Christian Democratic Party, The Green Party and The Swedish People´s Party. Among special class interests all the parties oriented more to middle class interests in Parliament than in their declared objectives (18.8 7.0 %). The Liberals, The Conservative Party, The Social Democratic Party, The Left Alliance and The True Finns had the strongest middle class orientation. The Conservative Party were the most bourgeois party (10.2%). The strongest working class interest was found in The Left Alliance, The Social Democratic Party and The Green Party (18.8 13.1 %). The Finnish Centre Party and The Social Democratic party, The Left Alliance and The True Finns were closest to working class interests. Are there class oriented differences in the contents of the legislative initiatives and political programmes of the nine political parties? The contents were classified into eleven groups: administration, civil rights, nature conservation, economics, occupation structure, social policy, public health, education, culture, labour market and international affairs. All nine parties have the same three most important contents of legislative initiatives. These were finance/economics, social policy and administration systems. And all nine parties were more interested in financial and economic aims than their political manifestos suggest. The fourth important content for The Conservative Party, The Swedish People`s Party, The Liberals and The Christian Democratic Party was education. Employment was the fourth aim of The Finnish Centre Party and The True Finns. The Labour Market was also important to The Finnish Social Democratic Party, The Left Alliance and The Greens. Nature conservation was important to The Greens, too. The contents of government bills are more oriented towards the common good than are the private members bills. The conclusion is that the main Finnish political parties took the interests of all classes into consideration. At the same time they reveal preferences for special class interests. This emerges in political manifestos and legislative initiatives and government proposals. The Finnish political parties are not purely general parties devoid of class background. Finance and economics was the basis upon which the people arranged their lives and formed political opinions. The class structure of historical materialism is suitable to demonstrate political partisanship in Finland during the second half of the twentieth century. Social changes affect both the class structures and the political aims of parties and give rise to social and ideological conflicts in advanced industrial societies. The consensus policy is one appearance of civilized class struggle.
Tutkimuksessa selvitetään, missä määrin työpaikkojen työsuojeluvalvontaa toteutetaan alueellisesti eri tavalla eli toteutuuko valvonta työpaikoilla yhtenäisesti eri puolilla Suomea. Tutkimuksen ennakko-oletuksena on, että merkittävä syy työsuojeluvalvonnan alueelliseen erilaisuuteen on valvonnan organisointi viiden itsenäisen aluehallintoviraston työsuojelun vastuualueen tehtäväksi. Työsuojeluhallintoa ja työsuojeluvalvonnan toteutumisen yhtenäisyyttä työpaikoilla ei ole tutkittu tieteellisesti 2000-luvulla. Tämä tutkimus arvioi työsuojeluhallinnon rakennetta ja valvonnan toteutumista sekä hallinnon että työpaikkojen näkökulmasta. Tutkimus antaa sekä tieteellisesti perusteltuja teoreettisia että hallinnon asiakkaiden näkökulmia työsuojeluhallinnossa käynnissä olevaan valvonnan yhtenäistämiskehitykseen. Tutkimuksen teoreettisena viitekehyksenä on hallinnon evaluaatiotutkimus, joka tarkoittaa hallinnon toimivuuden arviointia käyttäjä- ja asiakasnäkökulmasta. Työsuojeluhallinto toteuttaa työpaikoille kohdistuvaa työsuojeluvalvontaa työsuojelutarkastuksina, jolloin hallinnon asiakkaita ovat työpaikat ja niiden työnantajat ja työntekijät. Pääasiallisena tutkimusaineistona ovat valvontatietojärjestelmä Veran raportit ja niistä tehdyt 27 valvonnan alueellista vertailua sekä henkilöhaastattelut, jotka kohdistuvat 52:een työsuojeluhallinnon, työmarkkinajärjestöjen ja työpaikkojen työsuojeluhenkilöön. Tutkimuksessa on kolme päälukua: työsuojeluhallituksen aika 1973-1993, itsenäisten alueellisten työsuojeluviranomaisten aika vuodesta 1993 lähtien sisältäen työmarkkinajärjestöjen roolin työsuojeluvalvonnassa ja valvonnan alueellinen vertailu. Tutkimusmatkani kohti yhtenäistä työpaikkojen työsuojeluvalvontaa alkoi työsuojeluhallituksesta, joka perustettiin vuonna 1973 osana hyvinvointivaltion rakentamista ja valtiojohtoista suunnitteluoptimismia. Valtiollinen työsuojelu koottiin yhden ministeriön alaisuuteen. Työsuojeluhallituksen aikana oli keskusjohtoinen, ainakin osittain yhtenäinen työsuojeluvalvonta, mutta keskusviraston toiminta ei onnistunut, koska työnantajat vastustivat sitä koko ajan pitäen sen toimintaa konspiratiivisena, vehkeilevänä. Työsuojeluhallitus lakkautettiin vuonna 1993 osana keskusvirastojärjestelmän purkamista 1990-luvun alun taloudellisen laman seurauksena. Valtion harjoittamaa sääntelyä purettiin hallinnon kaikilla sektoreilla, ja hallintoa madallettiin lähemmäksi asiakasta. Valtion merkitystä vähennettiin koko yhteiskunnassa ja hyvinvointivaltiosta tehtiin kilpailuvaltio, jolloin markkinaliberalismi ja New Public Management voimistuivat. Työsuojeluhallituksen lakkautuksessa tehtiin ehkä muutakin politiikkaa; pirstaloimalla valvovaa hallintoa heikennettiin samalla työpaikoille kohdistuvaa keskitettyä valvonnan voimaa. Itsenäisten alueellisten työsuojeluviranomaisten aikana vuodesta 1993 lähtien entisten työsuojelupiirien ja nykyisten aluehallintoviraston työsuojelun vastuualueiden toiminnallinen itsenäisyys korostui. Hallinnon toiminnassa näkyy, ettei työsuojeluvalvonnalla ole yhteistä keskusjohtoa. Sosiaali- ja terveysministeriön työ- ja tasa-arvo-osasto, jonka alaisuuteen työsuojelu keskushallinnossa kuuluu, toteuttaa Kansainvälisen työjärjestön ILO:n (International Labour Organization) sopimusten tulkintaa, että työsuojeluhallinto on riippumaton valvontatehtävää suorittaessaan eikä ministeriö siten puutu valvonnan alueellisiin menettelytapoihin. Tutkimus käsittelee myös työsuojeluhallinnon laajaa yhteistyötä työmarkkinajärjestöjen kanssa. Järjestöt osallistuvat kaikkeen päätöksentekoon, jossa käsitellään hallinnon tavoitteita, painopisteitä, valvontaohjeita ja resursseja. Tutkimuksessa arvioidaan edustuksellisen demokratian näkökulmasta korporatiivisen etujärjestövaikutuksen ja hallinnon suhdetta riippumattoman työsuojeluvalvonnan päätöksenteossa ja toimeenpanossa. Tarkastuskertomuksiin perustuva alueellisen valvonnan vertailu osoittaa, että työsuojeluvalvonta on eriytynyt vastuualueittain. Työpaikkojen kunnossaolo määritellään usein eri tavalla, joten tarkastajien valvoma työturvallisuuden minimitaso ei toteudu yhdenmukaisesti koko maassa. Siten velvoitteita korjata tai poistaa työturvallisuusepäkohtia annetaan eri tavalla ja lopputuloksena on se, ettei työnantajia kohdella tasapuolisesti. Tutkimuksen johtopäätöksenä on, että työsuojeluvalvonta on osa kansallista hallintotoimintaa ja laillisuusvalvontaa, ei alueellista tai paikallista hallintoa. Työsuojelu ei eroa toimialoittain maantieteellisesti, koska eri ammattialojen työ on pääpiirteissään samanlaista koko maassa ja niiden työturvallisuus ei juurikaan eroa maantieteellisesti. Tämän vuoksi myös työsuojeluvalvonnan pitäisi olla yhdenmukaista koko maassa. Suomeen pitäisi perustaa Pohjoismaiden mallin mukainen työsuojelun keskusorganisaatio, joka koordinoisi yhtenäistä laillisuusvalvontaa samalla tavalla kuin Poliisihallitus, Syyttäjälaitos ja uusi Tuomioistuinvirasto koordinoivat toimialojensa laillisuusvalvontaa ja toiminnan menettelytapoja. ; This study examines the extent to which workplace occupational safety and health (OSH) enforcing is carried out differently across the Finnish regions, in other words whether workplace enforcing is uniform across Finland. The presupposition of the study is that an important reason for the regional disparity in labour inspection is the decentralized organization of the inspection to by the five independent divisions of occupational health and safety of the regional state administrative agency. The OSH administration and the uniformity of the implementation of OSH in the workplace have not been scientifically studied in the 21st century. This study assesses the structure and implementation of the OSH administration from the perspective of both the administration and the workplace. The study provides a scientifically justified analysis covering both theoretical and customers' perspectives on OSH management and the ongoing integration of health and safety enforcement. The chosen theoretical approach of the study is the administrative evaluation framework, which means assessing the functionality of administration from the user and customer perspective. The Labour Inspectorate carries out workplace safety inspections in the form of occupational safety inspections, whereby the customers of the administration are the workplaces and their employers and employees. The main research material are OSH inspection database Vera reports and personal interviews carried out with 52 persons in the job protection administration, labour organizations and employment OSH personnel. The study consists of three main empirical chapters: the Labour Protection Board, the Central Office 1973-1993, the independent Regional Labour Inspectorate since 1993, including the role of labour organizations in labour inspection and the regional comparison of labour inspection. Shift towards an integrated job labour inspection started with the Labour Protection Board which was established in 1973 as part of the construction of the welfare state during the era of optimism in state-directed planning State labour protection was brought together under one ministry. The Labour Protection Board the system was center-led, at least regarding uniform occupational health and safety enforcing, but the Board's operations were not successful, mainly because the employers were opposed to it throughout its existence. The Labour Protection Board was abolished in 1993 as part of the dismantling of the central office system that followed the economic recession in the early 1990s. State regulation in all sectors of government was decentralized and administration was brought closer to the customers. The role of the state was diminished in society as a whole and the welfare state became a competitive state, with neoliberalism and New Public Management becoming stronger. Other objectives were also part of the decision to abolish the Labour Protection Board; at the same time, the fragmentation of supervisory authorities weakened the efficiency of workplace control. The era of the independent regional labour inspectorates since 1993 underlines the functional independence of the former OSH Inspectorate and the current division of occupational health and safety of the regional state administrative agency. The operation shows that there is no common central management for labour enforcement. The Department for Work and Gender Equality of the Social and Health Ministry, which is responsible for occupational safety in central administration, interprets International Labour Organization (ILO) conventions as meaning that the labour administration is independent in carrying out its supervisory function. Thus, the Ministry does not interfere with regional control procedures. The study also deals with the extensive co-operation between the labour protection administration and the labour market organizations. Trade unions are involved in all decision-making concerning management objectives, priorities, control guidelines and resources. The study examines the influence of corporatist interest groups and the governance of occupational health and safety enforcing decision-making and implementation from the perspective of representative democracy. A comparison of regional control based on inspection reports shows that OSH control of occupational health and safety has varied between the regional divisions. The condition of workplaces is often defined differently, so the minimum level of occupational safety supervised by inspectors is not uniformly applied throughout the country. Thus, obligations to remedy or eliminate occupational safety deficiencies in workplaces are given different treatment and the result is that employees are not treated equally. The conclusion of the study is that health and safety control should be in the competence of national administration and judicial review, not regional or local administration. Occupational safety and health does not differ geographically by industry, as the work of the various occupations is broadly similar throughout the country and there is little geographical variation in occupational safety. For this reason, labour inspection should also be uniform throughout the country. Finland should set up the Nordic model of a more centralized OSH system, which would coordinate an integrated review of legality in the same way as the National Police Board, the Prosecutor's Office and the Court of Justice co- ordinate the law enforcement and operational procedures of their respective sectors.
Kansalaisosallistuminen YVA-menettelyssä Ympäristövaikutusten arviointimenettelyn (YVA) yksi keskeinen tavoite on lisätä kansalaisten tiedonsaantia ja osallistumista ympäristövaikutuksiltaan merkittävissä hankkeissa. YVA-menettelyllä pyritään tuomaan kansalaisten näkemykset, huolet ja toiveet mukaan suunnitteluun ja päätöksentekoon mahdollisimman varhaisessa vaiheessa. YVA edustaa väitöstutkimuksessa modernia vuorovaikutteista ympäristöpolitiikan ohjauskeinoa ja osallistumisen välinettä. Väitöstyön ensimmäisenä tutkimustehtävänä oli luoda YVAan osallistumisen analyysille teoreettinen viitekehys: millaista demokratia- ja suunnitteluideaa YVA voi edustaa ja millainen politiikkaverkosto YVA on kansalaisosallistumisen kannalta. Toisena tutkimustehtävänä analysoitiin YVAan osallistumisen historiallista kehittymistä ja muutoksia Suomessa. Kolmantena tutkimustehtävänä tarkasteltiin osallistumisen käytännön toteutusta sekä arvioitiin osallistumisen vaikuttavuutta. Lisäksi analysoitiin vaikuttavuuden mahdollisia esteitä, miten läpinäkyviä ja avoimia YVA-menettelyt ovat ja miten hyväksyttävänä osallistumisvälineenä YVAa pidetään. Osallistumisen kannalta olennainen seikka on YVAn institutionaalisuus: se on julkishallinnon luoma väline, jonka lisäksi toimenharjoittajalla on keskeinen YVA-menettelyn käytännön toteuttajan rooli. Tämä luo osallistumisen kannalta rakenteita, joissa korostuu toimijoiden väliset epäsymmetriset valta-asemat. YVA-menettelystä tulee helposti kaikille osapuolille vallan käytön ja politiikan tekemisen väline ja niin osallistumisen järjestämistä kuin itse osallistumista ohjaavat toimijoiden poliittiset intressit ja tavoitteet. YVA on parhaimmillaan eri osapuolten välinen avoin keskusteluareena, joka lisää suunnittelun ja päätöksenteon läpinäkyvyyttä, mutta YVA on myös poliittisen kamppailun areena. Suomen YVA-lainsäädännössä osallistumisella on aina ollut tärkeä rooli. Suomalaisessa YVA-järjestelmässä on korostettu kansalaisten osallistumismahdollisuuksia. Ajan saatossa myös kriittisyys laajaa osallistumisoikeutta ja useita osallistumismahdollisuuksia kohtaan on lieventynyt. Haaste on kuitenkin siinä, että osallistumisen toteutus määritellään laissa väljästi, eikä lainsäädäntö takaa laadukasta osallistumista tai varsinkaan sen vaikuttavuutta. Toinen havaittu haaste on YVAn ja osallistumisen suhde päätöksentekoon. YVAn ulkopuoliset päätöksentekojärjestelmät ja edustuksellisen vallankäytön rakenteet eivät ole muuttuneet, ja siksi YVAn vaikuttavuus voi jäädä vähäiseksi. Vaikka YVA edustaisikin osallistuvaa demokratiaa ja toteuttaisi vuorovaikutteista ja moniäänistä suunnittelua, voi osallistumisen merkitys vesittyä ja kansalaisten osallistumisaktiivisuus hiipua. Ilmiöön liittyy myös tarpeetonta kriittisyyttä. Osallistumisen vaikuttavuus ei ole kertaluonteista, vaan se on usein välillistä ja ajoittuu prosessin eri vaiheisiin. Osallistumisen merkitystä ja vaikutuksia ei aina tunnisteta. YVAsta ei ole muodostunut Suomessa laajojen joukkojen osallistumisvälinettä. Ennemminkin YVAan osallistuvat tyypillisesti harvat kansalaisaktiivit, jotka hyödyntävät YVAn lisäksi lukuisia muitakin osallistumisen ja vaikuttamisen keinoja. Osallistujien määrän sijaan huomio tulee kuitenkin kiinnittää sisältöön ja suunnittelun moniäänisyyteen. Olennainen kysymys on se, millaisen roolin kansalaiset ja maallikkoasiantuntijuus voivat saada perinteisesti asiantuntijavetoisessa suunnittelukulttuurissa. ; Public participation in environmental impact assessment Environmental impact assessment (EIA) is a policy instrument based in law and used to prevent harmful environmental impacts, increase public information access, and improve public participation opportunities. EIA is an open process for discussion and participation of different actors: it increases the transparency and broadens the information base of environmental policy planning and decision making. One aim of EIA is to incorporate citizens views and opinions, concerns and desires into planning at an early stage. EIA is a process of identifying and evaluating potential impacts from proposed activities. It is also an interactive and communicative policy instrument and should facilitate direct participation. EIA is an example in the development process of direct participation in Finland during 1990 s. In this study EIA is approached as a participation instrument. Public participation is the perspective from which the EIA-process is analysed. The aim of the research is to examine participation in EIA both a theoretical and empirical way, and to interpret and explain the operation logic and efficacy of participation. There are three main research tasks in the study. The first task is to create a theoretical framework for analysis of public participation in EIA. For this purpose, the theoretical and methodological triangulation is made in the study. There are four main parts in the triangulation. Firstly, the elements of participative and deliberative democracy and communicative planning theories are combined. This theoretical discussion shows what kind of democracy and planning EIA can represents. Secondly, network analysis and evaluation are integrated in the methodological triangulation. The concepts of policy networks and intervention theory are used in theoretical and methodological manner. The outcomes of theoretical and methodological triangulation are criteria of deliberative EIA and four policy network models of EIA as an instrument of public participation: 1) EIA as a negotiation process; 2) EIA as a technical process of information collection, 3) EIA as an information instrument; and 4) EIA as tool for controlling of participation. While the theoretical part of the thesis has its own analytical objectives, these policy network models are utilized with evaluation criteria in the empirical part of the study. The second research task is to analyse the historical development of participation in Finnish EIA legislation. The focus of this part is on the long lasting political process and arguments behind the enacting of Finnish EIA Act in 1980 s and 1990 s. The most important amendments of EIA legislation and the international and national reasons behind them are also considered. According to results of this part of thesis, the role of participation has been central to the Finnish EIA system. Even if the EIA Act was implemented in Finland relatively late in 1994, the legislative foundation for public participation has always been strong. Though the implementation of participation is defined in a flexible way, Finnish EIA legislation supports public participation and in principle creates possibilities for deliberative democracy. The third research task is to evaluate public participation in two case studies. This part includes following questions: 1) what kind of objectives do different actors seek from participation; 2) how does participation impact EIA and what are the obstacles of effective participation; and 3) how transparent and acceptable is the EIA process? The two cases used, the EIA of a road project and the final disposal of nuclear waste, show how much the aims, the implementation and the effectiveness of public participation can not only vary between different projects, but also during the planning process in one certain project. Notably, in the nuclear waste case, the nature of top-down instrument of EIA was clearly observed, while the developer of the project assumed a dominant role. The three elements of policy network (actors, arenas and agenda) were defined by the developer. Even if participation was carried out with great visibility, professional implementation and sufficient resources, the impact of public participation and lay people expertise was not so essential, while the economic and political interests of the project and the role of experts were in central role. In this case study EIA represents the policy network model of controlling of participation: the role of governance was more important than deliberative participation. In the road case the planning situation was more open. There did not seem to be the same need to define and control participation and the agenda of the EIA. The contribution of citizens was used in planning in a more effective manner. The EIA assumed a more traditional role as an information distribution tool, and as a place for open discussion and effective participation. The case studies suggest that the legislative base can not alone guarantee the effectiveness of public participation. Most important factor is the attitude of main actors. Each EIA process is unique and general theories of participation in EIA are difficult to create. In practice, the EIA is more or less an institutional process of power division between different actors, and the developer has the central role. EIA is an open arena that allows political disagreements to form and emerge into the open. However, EIA can also be used to promote political interests. EIA and participation can be harnessed by the proponent, but EIA can also feed the so called NIMBY (Not In My Back Yard) phenomenon. It is also possible, that policy instruments like EIA create a new elite active lay experts. Theoretical ideas of deliberative democracy or communicative planning are challenging to implement in practice. At the same time it is important to estimate the criteria and expectations concerning participation. One can see, that EIA has lot of deliberative potential, but the main challenges are in the relationship between EIA and decision making, and in the structures of political power and decision making outside of EIA.
Abstract The present study concerns the recruitment of foreign workforce in municipalities and private enterprises which provide local services. We scrutinize in which professions the workforce is required in the future. This research also focuses on ways how the employer can hire the best suitable foreign employees in the organization. As the final step the aim is to develop a model for recruitment of foreign workforce. This topic is currently interesting because of the increase of the share of older population and the decrease of available workforce in Finland in the near future. It is estimated that for example there will be 185 000-210 000 new jobs available in social and health care sectors during 2005-2020. The purpose of this dissertation is to increase the knowledge regarding the recruitment of foreign workforce in the municipality sector. The research was carried out using questionnaires for ten different organizations in Northern Ostrobothnia. These are Pudasjärvi, Kempele, Liminka, Muhos, Hailuoto, Sievi, Lumijoki and Tyrnävä municipalities, Mäntykoti ry in Oulu and the Family home Ojantakanen in Pulkkila. The main research question of this dissertation is: How the recruitment of foreign workforce can be carried out in the municipality sector? The theoretical background of the analysis is based on international human resource management and multicultural literature, knowledge about the quantities of foreigners, and demographic prognosis of population statistics. Methodologically the study is a qualitative study. The research method is content analysis based on research data. The data were collected during 2011-2013 using three questionnaires to municipality and business managers. According to the results of this research the organizations need further information on how to organize the recruitment of foreign workforce the best way. There is need for the recruitment of foreign workforce in the Northern Ostrobotnia, but there are no strategies of how to carry out work-based immigration, or the strategies are inadequate. The personnel and the managers need further education to learn how to meet and orientate foreign employees. ; Tiivistelmä Tutkimus käsittelee ulkomaisen työvoiman rekrytointia kuntiin ja kunnallisia palveluja tuottaviin yksityisiin yrityksiin. Työssä selvitetään, mille aloille työvoimaa tulevaisuudessa tarvitaan ja millä keinoilla työnantaja voi palkata sopivimmat ulkomaiset työntekijät organisaatioonsa. Lisäksi tutkimuksessa on tavoitteena kehittää ulkomaisen työvoiman rekrytointimalli. Aihe on ajankohtainen, sillä väestön ikääntyminen ja työvoiman tarjonnan väheneminen vaikuttavat lähivuosina Suomen työvoiman määrään. On arvioitu, että muun muassa sosiaali- ja terveyssektorilla avautuu 185 000–210 000 työpaikkaa vuosina 2005–2020. Väitöskirjatyön tarkoituksena on lisätä tietoa ulkomaisen työvoiman rekrytoinnista kuntasektorilla. Tutkimusaineisto kerättiin Pohjois-Pohjanmaalta kymmenestä eri organisaatiosta. Nämä ovat Pudasjärven, Kempeleen, Lumijoen, Limingan, Muhoksen, Hailuodon, Tyrnävän ja Sievin kunnat, Oulun Seudun Mäntykoti ry ja Ojantakasen perhekoti Pulkkilassa. Väitöskirjan keskeinen tutkimuskysymys on: Miten ulkomaisen työvoiman rekrytointi voidaan toteuttaa kuntasektorilla? Tutkimuksen teoreettinen tausta perustuu kansainvälisen henkilöstöjohtamisen sekä monikulttuurisuuden kirjallisuuteen ja väestötilastoihin liittyviin demografisiin ennusteisiin. Tutkimusote on laadullinen. Tutkimusmenetelmänä käytettiin aineistolähtöistä sisällönanalyysiä. Tutkimusaineisto kerättiin vuosina 2011–2013 kolmella kunta- ja yritysjohtajille suunnatulla kyselyllä. Tutkimustulosten mukaan organisaatiot tarvitsevat lisätietoa siitä, mikä on paras tapa toteuttaa ulkomaisen työvoiman rekrytointi. Pohjois-Pohjanmaalla on tarvetta ulkomaisen työvoiman rekrytoinnille, mutta suunnitelmia työperäisen maahanmuuton toteuttamiseksi ei ole tai ne ovat puutteellisia. Henkilöstö ja esimiehet tarvitsevat koulutusta ulkomaalaisten työntekijöiden kohtaamiseen ja perehdyttämiseen.
