La tesi analizza le modalità di applicazione del diritto internazionale a livello interno, con particolare riguardo al ruolo svolto dalle autorità politiche nazionali.
Co-operative Law has a long tradition in European countries, like the Industrial and Provident Act in the United Kingdom in1852 or the Prussian Co-operatives Act in 1867. The European Union was no born to create a common law but to remove restrictions on the freedom of establishment. In 2003 the Statute for a European Co-operative Society was approved, but harmonization of European co-operative legislation was never carried out, not even for its most importante distinctive elements. In 2012 the European Commission presented a report about the application of the SCE Statute showing that the SCE Regulation has had relatively little success. The differences between the different legal systems are considerable, both in forma and in content. European Commission expressed its intention not to carry out the harmonization of the European co-operative legislation directly, but to support the harmonization proposals that the co-operative sector presented to it. El derecho cooperativo tiene una larga tradición en los países europeos, desde la Industrial and Provident Act de 1952 en Reino Unido o la Ley prusiana de cooperativas de 1867. La Unión Europea no nació para crear un derecho común sino para surprimir las restricciones a la libertad de establecimiento. In 2003 se aprobó el Estatuto de la Sociedad Cooperativa Europea, pero nunca se ha llevado a cabo una armonización de la legislación cooperativa en Europa, ni siquiera en relación con sus elementos más característicos. En 2012, la Comisión Europea presentó un informe sobre la aplicación del Estatuto de la SCE que mostraba que esta regulación había tenido relativamente poco éxito. Las diferencias entre los diferentes sistemas legales son considerables, tanto formalmente como por su contenido. La Comisión Europea ya manifestó su intención de no llevar a cabo la armonización de la legislación cooperativa europea directamente, pero sí apoyar las propuestas de armonización presentadas por el sector cooperativo.
This paper, having the Sea Watch case as its cornerstone, traces the body of national, treaty and international rules on immigration, especially for what concerns the saving of lives at sea. The objective of the investigation is to answer the following question: is it possible, on the basis of national and international legislation, to prevent the docking of boats, especially if coming from Libya, on which shipwrecked or non-European citizens travel, by rejecting them collectively and preventing them to apply for international protection? The outcome of the investigation, which may appear obvious on the basis of the most recent decisions, nevertheless raises questions regarding the difficult situation in the Mediterranean, in particular, following the riots that occurred in Libya and in the northern part of the African continent starting from 2011. ; Il presente contributo, avendo come pietra angolare il caso Sea Watch, ripercorre il corpo di norme nazionali, pattizie ed internazionali in materia di immigrazione, in particolar modo per ciò che attiene il salvataggio delle vite in mare. L'obiettivo dell'indagine è rispondere alla seguente domanda: è possibile, sulla base della normativa nazionale e internazionale, impedire l'attracco di imbarcazioni, specie se provenienti dalla Libia, su cui viaggino naufraghi o comunque cittadini non europei, respingendoli collettivamente ed impedendo loro di presentare domanda di protezione internazionale? L'esito dell'indagine, che può apparire scontato sulla base delle decisioni più recenti, ci pone comunque interrogativi rispetto alla difficile situazione del mediterraneo, in particolar modo, in seguito ai tumulti verificatisi in Libia e nella parte nord del continente africano a partire dal 2011.
The European Union has long pursued a full program of unification of the national rules on private international law. For the theoretical advantages of uniformity, created by "denazionalizing" the systematic of civil law, corresponds, howewer, a loss of meaning in terms of culture and legal values, at the expense of the identities and the political choices, that only in the national communities – in the absence of democratic processes at the European level – can still find ways of legitimate expression.Paper presented at the Conference "La dimension culturelle du droit international privé (Journée en l'honneur de Tito Ballarino)", held on June 13, 2014 in Losanna, at the Swiss Institute of Comparative Law.L'Unione europea persegue da tempo un nutrito programma di uniformazione delle normative nazionali di diritto internazionale privato. The lack of a coherent European legislative framework, coupled with the principle of state sovereignty, induced unaccompanied migrant children to find themselves in a position which produced a situation of rightlessness, when outside of their own territories. In addition to their harsh condition, Member States national law not always provides rules for their safeguard, also often not harmonized with EU Directives. In some cases, to worsen the situation the lack of adequate policies in respect of their rights, their needs and their claims. This thesis provides an analysis of the international and European discipline, of unaccompanied minor migrants entering Europe. Juveniles, who find themselves in a hope journey without family members or guardianship, are in a very vulnerable position. In consequence of the migration crisis, especially in 2015, a massive flux of UAMs entered the European Union, so its Member States found themselves unprepared to cope with the needs of this specific category. In this thesis it is brought to light the fact that, international conventions alongside with EU legislative scheme provide a fragmented scheme for protection of separated children. Legally binding documents, as relevant International Conventions, European Treaties, Regulations and Directives are analysed, as also Conventions of the Council of Europe in concern to unaccompanied minors asylum seekers. In the paper are outlined and criticized bad practises of States on treatment and neglecting the needs of unaccompanied minor migrants, on breach of the rights of unaccompanied asylum seekers and on marginalizing unaccompanied refugee minors. In this research, have been pointed some good practises, for ameliorating their condition through the study between some European countries. The commitment showed by European Union through the European Action Plan as also by the EU to fulfil the obligations in respect of the rights of UAMs is demonstrated by the interest in revising, amending and fortifying several legally binding documents towards a more comprehensive children based approach. In compliance with this, in confirming expectations and welcoming the challenge for an international an enforced scheme of legal protection on UAMs, highlighted the recent effort of soft law by the CRC Committee and the Committee on Migrants Workers with Joint Comments. It is noteworthy that, the International Community and the European Union are meeting the need for a slow emersion on a dedicated legal framework on unaccompanied minor migrants. In conclusion, deemed that the issue of UAMs is still evolving, by figuring out the actual situation, till the end of 2017, we hope for future better assessments on the rights of the children and their indeed protection by law and by practise.

Molti credenti invocano «un giusto rispetto per il sacro», giacché «la mancanza di livelli civili di decenza, moderazione e rispetto nel mondo delle arti» danneggerebbe la coesione sociale . Altri, come Salman Rushdie, sostengono che «il "rispetto della religione" sia diventato un pretesto per la "paura della religione". Le religioni, come tutte le altre idee, meritano le critiche, la satira e tutta la nostra impavida irriverenza». Le autorità pubbliche possono intervenire in questo dibattito, punendo la «blasfemia»? Le leggi sulla blasfemia sono da tempo oggetto di attenzione, soprattutto a causa di episodi che coinvolgono Stati islamici o gruppi di musulmani, dalla fatwa iraniana contro lo stesso Rushdie all'attentato nei confronti di Charlie Hebdo. Presentare il problema della blasfemia come una dicotomia tra Oriente e Occidente, tuttavia, può essere fuorviante . Ovunque esista una religione organizzata la blasfemia è un tabù . Essa è un peccato particolarmente grave nella tradizione cristiana, tanto che, secondo i Vangeli, «qualunque peccato e bestemmia verrà perdonata agli uomini, ma la bestemmia contro lo Spirito non verrà perdonata» . L'Antico Testamento prescrive una punizione severa per questo peccato: «chi bestemmia il nome del Signore dovrà essere messo a morte: tutta la comunità lo dovrà lapidare» . Ciò spiega perché in passato tutti i Paesi europei punissero la blasfemia . La progressiva separazione tra potere politico e potere religioso, così come l'affermazione di democrazie pluraliste, ha portato diversi Stati ad abolire le leggi sulla blasfemia. La Corte Suprema degli Stati Uniti, in particolare, ha affermato già nel 1952 che «lo Stato non ha alcun legittimo interesse a proteggere una qualsiasi religione, o tutte le religioni, da espressioni a loro sgradite [.] non spetta al governo sopprimere attachi reali o immaginati a una particolare dottrina religiosa» . Le leggi di molti Stati europei, però, continuano a vietare la blasfemia, in linea teorica, e alcuni Paesi la puniscono anche in pratica. Secondo la Corte europea dei diritti dell'uomo (Corte EDU), la repressione della blasfemia è compatibile con la tutela dei diritti umani, perché non vi sarebbe sufficiente «terreno comune» agli ordinamenti giuridici e sociali degli Stati europei per poter concludere che il divieto della blasfemia sia innecessario in una società democratica. Tuttavia, la posizione della Corte è stata spesso criticata, perché teoricamente infondata e pericolosa per la libertà di espressione . Con questo studio si intende dimostrare che non è legittimo sanzionare la blasfemia in Europa; la prassi degli Stati membri dell'UE e delle istituzioni europee mostra infatti che il divieto di esprimere idee blasfeme non è più «necessario» nelle società democratiche. L'analisi si divide in tre sezioni. Nella prima si presentano le norme sulla blasfemia in vigore negli Stati membri dell'UE. Nella seconda si analizza la giurisprudenza della Corte EDU sulla blasfemia. Nella terza si discute della recente prassi dell'Unione Europea in materia.
The aim of the research is to analyze the role of the consumer in a detailed way. Firstly I defined the concepts of "consumption" and "consumer", giving relief to the socio-economic theories that have characterized the subject during recent years,and taking in consideration the process of consumption and the behavioral and decisional theories proper of the consumer. Moreover, I have deeply analyzed the consumer under the juridical aspect, from the mere legal recognition to the trial and the efforts sustained by the European Legislator during the last years with the purpose of creating a system of common rules with the final goal of guaranteeing a high-level of protection to the consumer in international contracts and assuring the correct operation of the Single Internal Market founding the discipline on a competitive model. Great relief is given to the "Rome I Regulation" on the choice of the law aplicable to contracts and to the "Bruxelles Convention" on the competent court.
The article aims to introduce the evolutionary course of Private International Law in regards to Family Law in Brazil, with special focus on the advent of Brazilian nationality in the postcolonial context, the migration policies and the applicable law at the time. For this purpose, Brazilian History and Geography were revisited in order to ponder the political decisions that contributed to the development of the conflict method in Brazil. These are the premises developed throughout the text to analyse the formation of Private International Law of the Brazilian Family, which stands out within the American continent due to its trajectory, as will be discussed throughout the article.
The aim of this article is to offer a general overview about how the Globalization is changing the evolution of the National Public Financial Systems. In fact, Financial Law - either for expenditures or for revenues - is not more a domestic topic. According with the globalization of the economic and social relationships, the classical expending and taxing powers, nowadays, are not possible to be exercised under the sole sovereignty of National Parliaments and Governments. A lot of financial rules, finally adopted by the States, arrive to their legal systems through soft law instruments produced on international, public and even private, institutions. The analysis of this phenomenon is here tackled with three practical examples: the so-called cooperative compliance approach to the tax relationships between States and taxpayers, particularly multinational enterprises (sec. 2); the Transfer Pricing regulations (sec. 3); and the Public Debt Measurement in European Union (sec. 4).
