The privatization of state-owned assets and the reduction of direct state economic intervention have not led to a reduced role of the state but to changes in its form, involving new types of formalized regulation, the fragmentation of the public sphere, the decentring of the state and the emergence of multi-level governance. This has been complemented by the increased salience of 'private' regulation. Despite talk of deregulation there has been extensive reregulation, and the emergence of global regulatory networks, intermingling the public and the private. The transition from government to governance means a lack of a clear hierarchy of norms, a blurring of distinctions between hard and soft law, and a fragmentation of public functions entailing a resurgence of technocracy.

"Wenn es zutrifft, dass kulturelle Praxen Erfahrung und Erwartungen prägen, dann müssen sie eindeutig bestimmt und für die empirische Forschung als aussagekräftig gewertet werden. Mit Bezug auf die Theorie der Internationalen Beziehungen (IB-Theorie), Internationales Öffentliches Recht und normative Demokratietheorie entwickelt dieser Artikel einen Ansatz, um die umstrittenen Bedeutungen von Normen in der internationalen Politik unter der Bedingung von Konstitutionalisierung jenseits des Staates zu erforschen. Ziel ist es, ein Forschungsdesign zur Untersuchung der unsichtbaren Konstitution von Politik, das heißt, zur Erforschung von individuell gehaltenen assoziativen Konnotationen, die zur umstrittenen Interpretation normativer Bedeutung führen, zu entwickeln. Diese Überlegungen werden in dem Papier in zwei Teilen vorgestellt. Teil I entwickelt Forschungsannahmen und Hypothesen aufgrund der relevanten Literatur im ersten Abschnitt. Er zeigt unterschiedliche Typen von Normen und Bedingungen von Normumstrittenheit auf (Abschnitt 1), definiert Forschungsannahmen und Hypothesen (Abschnitt 2), argumentiert für die Rückbesinnung auf die Dimension der Kultur im Konstitutionalismus (Abschnitt 3) und schließt mit der Leitfrage nach Konvergenz, Divergenz oder Diffusion normativer Bedeutungen (Abschnitt 4). Teil II richtet den Blick auf die Operationalisierung des Forschungsdesigns. Er stellt die Forschungslogik und Art der Untersuchung (Abschnitt 5), die Methode der Interviewauswertung (Abschnitt 6) und die Forschungsindikatoren nach sozialer Gruppe, Fundamentalnormen und politischen Arenen (Abschnitt 7) vor. In traditional power analysis, `the international' is a characteristic of the states system — an anarchic realm, qualitatively different from the domestic. To traditional norms analysis, the international is increasingly a realm of shared value allocation, akin to other political realms. Given this bifurcation in the literature, privileging power incurs the cost of not being able to study systemic change of the international, whereas privileging norms incurs the cost of not being able to study power. We argue that extant conceptualisations of the international hail from Weber via Morgenthau, for whom international politics was an ideal type applied to the realm between states. Building on Mike Williams's work, we perform a new reading of these two scholars. We find that Morgenthau's identification of the political as an ideal-typical sphere has room for social theoretical insights as found in constructivist theory. Indeed, by his own Weberian lights, Morgenthau's specific ideal type of international politics is in need of updating. We try to rise to the challenge by drawing on Michel Foucault's work in order to forge an understanding of the international as governmentality. The result is a conceptualisation of the international as a socially embedded realm of governmentality. It is a structure (defined by relations of power) that generates different and changing practices of political rule (defined as governmental rationality) and agencies (for example, polities).
