"Vor dem Hintergrund der kooperationstheoretischen fundierten Diskussion um internationale Regime entwickelt der Artikel ein Konzept von 'Regieren' im internationalen System. Innerhalb bestimmter Grenzen vermögen Normen das Verhalten rationaler Nutzenmaximierer zu beeinflussen und können deshalb für die gezielte Verhaltensbeeinflussung zur Realisierung bestehender Kooperationsmöglichkeiten eingesetzt werden. Sie stellen aber erst dann geeignete Lenkungsinstrumente dar, wenn sie unabhängig von dem zu beeinflussenden Verhalten gebildet werden können. Dazu bedarf eine an Kooperation interessierte Gruppe von Akteuren der kollektiven Entscheidungsfähigkeit. Die Interaktion muß auf eine neue Ebene verlagert werden, auf der kommuniziert und nicht gehandelt wird. Die Bildung gemeinsamer normativer Erwartungen im Rahmen von Verhandlungen, einer besonders geeigneten Form der Kommunikation, wird damit zum Kern des Regierens." (Autorenreferat)

"Die Analyse der Ursachen und Bedingungen internationaler Kooperation und Konfliktregulierung hat in der Disziplin der Internationalen Beziehungen durch das Regimekonzept neue Impulse erhalten. In diesem Beitrag sollen die zentralen Fragestellungen der Regimeanalyse unter besonderer Berücksichtigung der Fruchtbarkeit dieses Konzepts für die Friedens- und Konfliktforschung dargestellt werden. Ausgehend von einer präzisierten Definition des Begriffs 'internationales Regime' wird die Entwicklung der Regimeanalyse in den Internationalen Beziehungen kurz erläutert. The transnational approach relativizes the role traditionally assigned to the state, without heralding its demise, disposes of the spatial factor without denying territorial realities and introduces a global perspective without underestimating analytical method. "Prozesse internationaler Organisation und internationaler Integration befinden sich beide als Elemente auf einem historischen Kontinuum der Zivilisierung internationaler Beziehungen. Dabei entwickelten Studien über internationale Organisationen zwar ständig neue Analyserahmen, führten jedoch kaum abstraktere oder generalisierende Diskussionen. Die Forschung über internationale Integration erbrachte andererseits eine große Fülle ambitionierter Theorien und innovativer Konzepte, dies jedoch häufig auf eine erratische und diskontinuierliche Weise. In theoretischen Ansätzen zu internationalen Organisationen spiegelt sich die seit langem bestehende Aufteilung der Disziplin Internationale Beziehungen: 'Realisten' betonen den Nutzen internationaler Organisationen bei der Politikkoordination unabhängiger Staaten. 'Idealisten' weisen lieber auf ihren Beitrag zur letztlichen Überwindung der zwischenstaatlichen Anarchie hin. 'Marxisten' sehen internationale Organisationen als Ausdruck von Klasseninteressen und des Klassenkampfs auf internationaler Ebene. Gegenwärtig widmet sich die theoretische Befassung mit internationalen Organisationen hauptsächlich der Bestandsaufnahme und einer vorsichtigen Politikinterpretation. Im Gegensatz dazu standen Theorien internationaler Integration jahrzehntelang in voller Blüte. Föderalismus, Funktionalismus, Neofunktionalismus und Kommunikationstheorien stellten Erklärungsmuster für regionale und globale integrative Prozesse zur Verfügung, machten aber auch politische Ratschläge und Vorhersagen zukünftiger Veränderungen. Die Theoriedebatte im großen Stil brach jedoch Anfang der 70er Jahre ziemlich plötzlich ab, als die regionale Integration in Europa und anderswo zu stagnieren schien. Danach gab es nur noch bescheidene und fragmentarische theoretische Bemühungen, nahezu ausschließlich am Fall der Europäischen Gemeinschaft. Der Aufsatz fordert eine Wiederbelebung der theoretischen Forschung über internationale Integration, möglichst in enger Verbindung mit der Erforschung internationaler Organisationen." The United Nations held a week-long Congress on Public International Law at its headquarters in New York in 1995 - the year of the celebration of the Organization's fiftieth anniversary - under the general theme `Towards the Twenty-first Century: International Law as a Language for International Relations'. The purpose of the Congress was thus to assist the international community, and in particular the legal profession, to meet the challenges and expectations of the present-day world. Views were expressed, and exchanged, on the codification, progressive development and implementation of public international law, both in theory and in practice, as well as on its teaching and dissemination. The Proceedings of the United Nations Congress contain the presentations and lectures of well-known jurists and professors - in the language given (English, French or Spanish) - as well as discussions that took place after the lectures. An analysis of how international nongovernment organizations (INGOs) have come to modify or challenge the international system. The introduction of transnational forces -- ie, nonstate entities of a social, political, scientific, religious, environmental, or other nature -- into the study of international relations does not merely shift or cut across boundaries, but calls for a new, intrinsicially pluralistic approach. The interplay of factors & actors outside the conventional frame of reference of territorial sovereign states exposes a multipolar world that encompasses a variety of intersecting sociopolitical "forces of attraction" of a predominantly economic, ethnic, or religious character. The transnational approach particularly emphasizes three aspects of nonstate entities: their historical precedence over the state system; INGOs' role as the subjects & makers of international law; & the latter's effective scope of action in the contemporary world, either as shapers of opinion, as autonomous actors, or in competition with states. As central components of a potential international civil society, their transnationalization poses the question of the universal character of the state, & hence of civil society, & the groupings that structure it across national borders. 2 Illustrations, 41 References. In this paper I am going to argue a familiar but still controversial thesis about the relation between international ethics and international law, which I would sum up in the following list of propositions:First, international law is a source as well as an object of ethical judgements. The idea of legality or the rule of law is an ethical one, and international law has ethical significance because it gives institutional expression to the rule of law in international relations.Secondly, international law—or, more precisely, the idea of the rule of law in international relations—reflects a rule-oriented rather than outcome-oriented ethic of international affairs. By insisting on the priority of rules over outcomes, this ethic rejects consequentialism in all its forms.
