Seit ihrem Amtsantritt 2010 steht die rechtskonservative Regierung unter Viktor Orbán international in der Diskussion: Ob Rechtsstaatlichkeit und Unabhängigkeit von Justiz und Medien oder der Umgang mit Obdachlosen und Roma - vonseiten der Presse und EU kam heftige Kritik. Inwieweit decken sich Kritik und Fakten? Wie erscheint Ungarn etwa im Vergleich mit anderen demokratischen Staaten? Eine analysierende Gegenüberstellung von Pressezitaten und nachgeprüften Sachverhalten will Antworten geben.

The article discusses the status, rights and perspectives of the minorities and "non-constituent" peoples in Bosnia and Herzegovina. The status of the "constituent minorities" (the "Others") is very specific and different from the minorities' status in neighbouring countries. The article argues that in Bosnia and Herzegovina "traditional" attitudes like ethno-nationalism, discrimination, violation of minorities rights and freedoms are still very dominant. A direct consequence of this socio-political atmosphere is ethno-particularisation of society and destabilization of the state in domestic and international contexts. This short review of the status of minorities in Bosnia and Herzegovina is an insight into the international and national instruments that regulate the status and rights of the national minorities in Bosnia and Herzegovina. The authors highlight the specificity of the country, i.e. the institutional discrimination of citizens that belong to the "others", but are still citizens of Bosnia and Herzegovina. The authors claim that the citizenship of Bosnia and Herzegovina should be an efficient protection against the observed discrimination. ; Tema ovog članka je položaj, prava i perspektiva manjina i "nekonstitutivnih" naroda u Bosni i Hercegovini. Položaj posebne grupe "konstitutivnih manjina" (tzv. ostalih) Bosnu i Hercegovinu čini specifičnom i po mnogim faktorima razlikuje od drugih država u okruženju. Članak se fokusira na tezu da u Bosni i Hercegovini još uvijek dominiraju određene "tradicionalne" političke i društvene projekcije koje se iskazuju u formi etnonacionalizma, diskriminacije, kršenja manjinskih prava i sloboda, odnosno demokraciji neprimjerenih supstrata i supstituta. Izravan produkt ovakvog socio-političkog ambijenta jeste etno-partikularizacija društva i destabilizacija države na unutarnjem i međunarodnom planu. Ovaj kratki ogled o položaju manjina u Bosni i Hercegovini, sem pregleda međunarodnih i nacionalnih instrumenata koji reguliraju status i prava nacionalnih manjina, nudi uvid u pomenutu specifičnost Bosne i Hercegovine: institucionaliziranu diskriminaciju građana koji pripadaju kategoriji "ostali", koji su žrtve diskriminacije, iako bi njihovo bosanskohercegovačko državljanstvo per se, i po prirodi stvari, trebalo predstavljati učinkovitu smetnju ovakvoj diskriminaciji.

Considering that in the spectrum of juvenile criminal sanctions punishment of deprivation of liberty is the most severe criminal sanction, international documents related to juveniles in conflict with the law proclaim standards that this sanction has to be imposed only as a measure of last resort and for the shortest period. Issues like possible duration of subject sanction and scope of its imposition, represents some of the basic features of the legal and judicial policy of sanctioning of juveniles, and represent the subject of this paper. The author analyzes how these issues are regulated in Bosnia and Herzegovina"s and comparative law, and how aforementioned standards are applied in practice. Applying the comparative analysis it was determined that there are certain indicators that Bosnia and Herzegovina is one of the countries that has in its heritage "humane" sanctioning policy of juvenile offenderes, and that the aforementioned international standards are consistently accepted in domestic law as well as in the jurisprudence. ; Imajući u vidu da u spektru maloljetničkih krivičnih sankcija kazna lišenja slobode predstavlja najstrožiju krivičnu sankciju, međunarodni dokumenti iz oblasti postupanja sa maloljetnicima u sukobu sa zakonom proklamiraju standard da se ona ima izricati samo kao krajnje sredstvo (ultima ratio) i u što kraćem trajanju. Upravo pitanja mogućeg trajanja predmetne sankcije, te obima njenog izricanja predstavljaju neka od osnovnih obilježja zakonske i sudske politike sankcioniranja maloljetnika, te čine predmet istraživanja ovog rada. Autor je analizirao kako su ova pitanja uređena u bosanskohercegovačkom i uporednom pravu, te kako su spomenuti standardi oživotvoreni u praksi. Primjenom komparativnopravne analize utvrđeno je kako postoje određeni pokazatelji da Bosna i Hercegovina spada u red zemalja koje baštine "humanu" politiku sankcioniranja maloljetnih učinitelja krivičnih djela, te da su spomenuti međunarodni standardi dosljedno prihvaćeni kako u pravu, tako i u sudskoj praksi ove zemlje.

Trends and Dilemmas in the Utilization of Renewable Energy Sources.Due to the efforts in the interests of achieving the sustainable development several legislation have been born supporting the utilization of the renewable energy sources and within that the usage of biomass as a conditionally renewable energy source. At the time of creation of the directives there were less available practical experience. After consulting the studies published in our country and abroad in this line in this article we presented the changes of attitudes and opinions due to the expansion of knowledge.The purpose of this study is to present the local and global consequences of em-phasizing the utilization of the biomass as a conditionally renewable energy source and how much does it affect the fulfilment of the originally set goals.To prepare the study we used international and national publications as well as legal and statistical data published by the European Union and the United Nations on this subject. ; Trends and Dilemmas in the Utilization of Renewable Energy Sources.Due to the efforts in the interests of achieving the sustainable development several legislation have been born supporting the utilization of the renewable energy sources and within that the usage of biomass as a conditionally renewable energy source. Central Europe means different political, economic, cultural, geopolitical and a "regional security community" contents in relation to my topic. Nowadays, this region, the "Central Europe" region primarily means the V-4 cooperation and the very important role and initiatives of the region in the EU. The V-4 cooperation, which was established in 1991, can be conceived as an attempt at creating a special form, as a mechanism and sub-stance to the political dimension of this region. The four members of the special mechanism are trying to get closer to one another by relying on solidarity with each other. The V-4 cooperation is based on the common history of the participating countries and close similarities between their recent transformation processes. Such resemblances explain the V4 structure's success, including parallel navigation in the problems of European Union and NATO accession. In the absence of permanent institutions [except the International Visegrad Fund (IVF)], the dimension and ambitions of the V-4 cooperation depends on the political objective of the governments and direct security environment, which impacts on these countries.

The legal relationship between civil servants and the state, is not governed by the theory of sovereignty, which is relevant in the outer relationships between the state and its citizens, though it has some, limited effect on the inner relationships between the civil servant and the state organ, as well. The inner relationship falls into the category of "dependent work" and therefore civil servants must enjoy the employment rights generally applicable to employees with some alterations. Among such rights, two are investigated more closely in the paper: protection against unjust dismissal and collective rights of workers (right to organise, right to bargain collectively, and right to strike). In 2010 the Hungarian state modified its regulations on civil servants and introduced dismissal without notice referring to the argument that the parties of the legal relationship must be treated equally and because the civil servant can resign from its position without notice, the same right should be enjoyed by the state, as well. The Hungarian Constitutional Court and European Court of Justice nullified this law because of violating the right to work, the right to human dignity, and the right to hold public positions. The regulations on collective rights of civil servants have been systematically violated by the Hungarian legislator since 1992, when the first regulation on civil servants passed. Until 2011 the right to organise has been enjoyed without disturbance by civil servants but since than the state has organise the Bar of Hungarian Civil Servants into which all civil servants are obliged to enter. Because the Bar has rights which are usually considered to be union rights, therefore the Bar is a competitor of the civil servants' unions; consequently the regulations on the Bar violate the right to organise. The right to bargain collectively has never been enjoyed by unions of civil servants since 1992, despite such right is generally applied in developed countries app. since 1960-1970s and is also accepted by the international conventions on social and economic rights. The right to strike is also restricted by the Agreement on Right to Strike in Civil Service (1994) which prohibits the rights to strike far beyond the limits established by the Fundamental Law and the Act on Right to Strike (Act No. VII of 1989). Alternative methods of collective dispute settlement (mediation, arbitration) are also neglected by the Hungarian legal regime.
