358 p. ; This thesis aims to understand the impact of the internal factors (internal production structures and conflicts between interest groups) for the international economic integration of Russia. The research combines the analysis in terms of international economics with that of international political economy (IPE). The former allows a detailed analysis of Russia's international specialisation in exchanges of goods and capital, while the latter provides the analytical framework for analysing the pattern of changes. Firstly, we show a growing dependency on the export of natural resources, independent of the geographical (political) circle of countries analyzed. Secondly, we argue that the analytical framework of the IPE should be adapted to the Russian context. So, the period of the 1990s is characterized by a large scope of personal arrangements and individualized relations within a captured and fragmented State. After the beginning of the 2000s, this situation is reversed given the centralization of the central State and a quest for more institutionalized relations between the State and firms. This thesis contains three parts. The first part presents an economic analysis of the integration of Russia into the world economy. The second part studies the evolution of Russia's internal institutional context. Premièrement, l'on constate une dépendance croissante à l'égard des exportations de ressources naturelles, et ce, indépendamment du cercle géographique (ou politique) de partenaires étudié. Deuxièmement, l'on démontre la nécessité d'adapter la maquette de l'EPI au contexte russe. Ainsi, les années 1990 se caractérisent par l'ampleur des arrangements personnels et des relations individualisées dans un Etat capturé et fragmenté. A partir du début des années 2000, cette situation est remise en question avec une recentralisation de l'Etat et une recherche de relations institutionnalisées entre le décideur public et les entreprises. La thèse comporte trois parties. La première partie présente une analyse de la dimension économique de l'ouverture internationale de la Russie. La deuxième partie étudie l'évolution de son contexte institutionnel interne, notamment sa politique d'ouverture. La troisième partie met en relation les préférences internes à l'égard de l'ouverture avec les préférences des principaux partenaires économiques de la Russie, à savoir i) la Communauté des Etats Indépendants, ii) l'Union Européenne et iii) la Chine et les Etats-Unis.
The matter of expulsion is frequently evolving as much in national legal orders as in international legal systems. Internationalization of law, and more precisely the one concerning human rights, has changed the nature of the problems of expulsion and has allowed to develop more and more protective rules for the persons concerned. As a matter of fact, international law, and in particular european law, tend progressively to frame this highly political act. Thus, the grounds and the implementation of expulsion decisions must be associated with the individual rights and the fundamental freedoms. However, this conciliation seems to be unstable : the changes, essentially aimed at security, which have been noticed in national and Community laws since the attacks of september 11th in 2001 show that this matter is particularly sensitive to the evolutions of socio-political contexts. The phenomenon of expulsion is, by definition, transnational and drives to an increasing cooperation between the States. Consequently, the setting up of a minimal corpus of rights, matching with procedural safeguards allowing to secure its effectiveness, is all the more pressing necessity. The international organs of control, like the European Court of Human Rights, eventually try to interpret the conventions that apply to this subject in a favourable way so as to answer this requirement. Going beyond that initial approach, attached to the concept of nationality, seems necessary today. In this respect, the European Union could be an ideal legal framework to create a "virtual national" status and to make the notion of Union citizenship autonomous. ; La matière de l'expulsion évolue fréquemment tant dans les ordres juridiques nationaux qu'internationaux. This thesis presents the difficult path to dedicating at the international level the law dealing with foreign directs investments. The difficulty of integrating in the main body of the international law of the juridical standards concerning the foreign directs investments has been due to the changes interfered in international relationships. These changes were brought about by political, ideological and, most of all, economic confrontations among countries. The customary mechanisms, the bilateral treaties and the increase of regional arrangements have contributed to create a new jurisdiction of the world society. However, only a global multilateral instrument, generally accepted, could establish the enactment of an international law for foreign directs investments. This instrument should be able to transcend and go beyond the power relationships existing worldwide. Thus, assuring the stability of the multilateral system, it could be the juridical instrument allowing to manage the economic globalization in a different way. ; Cette thèse présente le parcours difficile du droit en matière d'investissements directs à l'étranger vers son internationalisation. La difficulté d'intégration dans le droit international des normes juridiques régissant l'investissement étranger a été due aux changements intervenus dans les relations internationales, à la suite de confrontations politiques, idéologiques et surtout économiques entre les pays. Les mécanismes conventionnels, les traités bilatéraux et la multiplication des arrangements régionaux ont contribué à une juridicisation nouvelle de la société mondiale. Cependant, ce n'est qu'un instrument multilatéral global, généralement accepté et qui échapperait de ce fait aux rapports de pouvoir au niveau mondial qui pourrait consacrer l'avènement d'un droit international en matière d'investissements directs étrangers. The transfer of the original constituent power comes when the adoption of a constitution falls under a procedure which moves the constitutional decision-making centre towards an external authority in the State. However in constitutional law, the constituent procedure concerns by nature the expression of the State?s sovereignty. In the same way, in international law, the right of peoples to self determination implies for the constituent people, the freedom in the determination of its political status. Actually, ever since the beginning, the concept of constituent power is completely comparable with the power of the free people. The evolution of the political systems since the 18th century by no means revealed a new definition of the constituent capacity. Moreover, this aptitude is today synonymous with democratic capacity. However, in certain historical circumstances and particular policies (the war, the fulfilment of the right of peoples to self determination, process of democratization), the exercise of the constituent capacity is internationalized. In its most integral form, the internationalization of the original constituent power is based on a procedure that overshadows the irreducible link between the originating constituent capacity and sovereignty. Consequently it?s appropriate, in a general context of challenge of the sovereignty, to wonder about the impact of this practice on the public law. Either the transfer of the original constituent power is the end of the legal system, in which sovereignty represents the angular stone. International audience ; International negotiations relating to forests have proliferated since the Rio Earth Summit in 1992 entering ever-increasing numbers of forums. The impression given by the international forestry landscape today is one of complexity, non-transparency and apparent un-relatedness to the realities in the field. Following a brief description of international dialogue in the area of forest policy, the article calls on three examples to illustrate the extent to which worldwide, pan-European, EU and national forest issues are intricately interwoven. International negotiations unite actions undertaken by states and intrude through both an "upward" and "downward" process that leads to implementation of concrete measures in the field. It is important therefore, in the interests of French forestry, to consistently take part and actively contribute to international negotiations on forests. ; Depuis le sommet de la terre de Rio en 1992, les négociations internationales sur les forêts se sont considérablement développées, dans des enceintes de plus en plus nombreuses. The fragmentation of international law is not proven, even if the dangers of its realisation are, according to some commentators, certain; but this idea already constitutes a common point, a way of thinking, within academic theory, where it has become a phenomenon in itself. It is thus appropriate to restate the reasons for, and even more so to examine the object of, the concept of a legal order as it applies to international law. The stakes of the debate on the unity or fragmentation of international law are even higher as they involve not only legal, but also political, considerations. However, the core of the problem of unity and fragmentation, which is primarily technical, is well-defined by the International Law Commission's recent study of the topic, even if its assessment is definitively based on the invocation of well-established principles.
