The text focuses primarily on the aspects of the Code which are useful for notaries, such the law of estate and the law of matrimonial property. The text also gives an overview of the general rules of the Code of Private International law, with specific attention to the innovations (such as the escape clause to be found in Article 19).

Der Einfluss Internationaler Organisationen reicht angesichts der Herausforderung, für globale Probleme Lösungen zu finden, mittlerweile so weit, dass sich die Frage nach den in ihnen vorhandenen Machtbegrenzungsmechanismen stellt. Doch wie kann die Macht Internationaler Organisationen kontrolliert werden, wenn das aus dem nationalen Verfassungsrecht bekannte Gewaltenteilungsprinzip nicht auf die internationale Ebene übertragen werden kann? Die Arbeit analysiert die dazu innerhalb der Vereinten Nationen (UNO) und der Welthandelsorganisation (WTO) existierenden formalisierten Mechanismen anhand ihrer Gründungsverträge. Dabei werden drei Kategorien von Machtbegrenzungsmechanismen identifiziert: Kompetenzzuweisungen und -abgrenzungen, organinterne Mechanismen und schließlich Interaktion zwischen den Organen. Die in der Praxis bedeutsamsten Mechanismen stellen zum einen das Vetorecht im UN-Sicherheitsrat sowie der negative Konsens im Streitbeilegungsgremium der WTO dar, die zur Gruppe der organinternen Mechanismen gehören. Zum anderen besteht in der Kontrolle der Streitbeilegungs-Panel der WTO durch den Appellate Body eine wichtige Machtbegrenzung durch Interaktion. Die Untersuchung dokumentiert das paradoxe Phänomen, dass die Mechanismen zur Begrenzung der Macht in vielen Fällen auch eine machtsteigernde Wirkung haben, indem sie die Effizienz, Akzeptanz und Legitimation der Organisation erhöhen. Die Verfasserin erklärt dies damit, dass das Augenmerk der Gründungsstaaten in der Entstehungsphase auf dem Funktionieren der Organisation als Gegengewicht zu ihren jeweiligen Mitgliedsstaaten lag. Dass Internationale Organisationen in der Zwischenzeit so stark an Einfluss gewonnen haben, dass ihre Macht nunmehr begrenzt werden sollte, ist eine neue Entwicklung, die jedoch in Zukunft deutlich an Bedeutung gewinnen wird. ; In light of the challenge to find answers to global problems, the influence of international organizations nowadays goes so far that the question of existing checks and balances within these organizations arises. But how can power be controlled when the principle of separation of powers originating from national constitutional law cannot be transferred to the international stage? The purpose of this thesis is to analyze existing formalized internal mechanisms within the United Nations and the World Trade Organization on the basis of their founding treaties. The author identifies three categories of checks and balances: allowing and limiting competencies, mechanisms within the organs and finally interactions between the organs. In practice, the most important mechanisms of these organizations are on the one hand the power of veto within the UN Security Council and the negative consensus within the WTO dispute settlement body, which belong to the category of mechanisms within the organs. In addition, the control of the WTO dispute settlement panels by the Appellate Body is an important form of checks and balances through interaction. The analysis shows the paradoxical phenomenon, that checks and balances in many cases have the effect of increasing power by augmenting the efficiency, acceptance and legitimacy of the organization. The author explains this by reference to the intentions of the founding states during the developing phase to strengthen these organizations as a counterbalance to their respective member states. It is a new development that international organizations have now increased their influence so much that their power should be limited, but this will become significantly more important in the future.

Zur Untersuchung des internationalen Steuerwettbewerbs und dessen Auswirkungen für die deutsche Wirtschaft befragte das ifo Institut im Auftrag der Stiftung Familienunternehmen von April bis Juli 2018 mehr als 1 250 Familien- und Nicht-Familienunternehmen aus Deutschland. Den Ergebnissen der Unternehmensbefragung zufolge wird der internationale Steuerwettbewerb von dem Großteil (59,2%) der Unternehmen als stark oder eher stark eingestuft. Von den im Zuge der Steuerreform in den USA reduzierten Steuersätzen können etwa 60% der befragten Unternehmen mit Betriebsstätten in den USA finanzielle Vorteile erzielen. Unter den ausschließlich in Deutschland tätigen Unternehmen geben lediglich 1,9% an, vom internationalen Steuerwettbewerb in Summe profitieren zu können. Eine erhebliche Steigerung der Investitionstätigkeiten in den USA infolge der Steuerreform wird unter den befragten Unternehmen insgesamt nicht verzeichnet. Von den Unternehmen mit Betriebsstätten in den USA planen jedoch knapp 27% den Ausbau und 14,2% die Neuerrichtung von US-Kapazitäten. Eine deutliche Mehrheit der befragten Unternehmen vertritt die Ansicht, die deutsche Politik solle Maßnahmen ergreifen, um auf den internationalen Steuerwettbewerb zu reagieren. Den größten Reformbedarf sehen sie in der Reduktion von Bürokratie.

Die Finanzkrise 2007/2008 und die derzeitige "Euro-Krise" stellen das bisherige Weltwährungssystem in Frage. Sie legt die Schwächen des aktuellen Systems schonungslos offen und zeigt, welchen herausragenden Stellenwert das internationale Währungssystem nach wie vor für die Stabilität von Märkten und ganzen Volkswirtschaften hat. Das DIW Berlin hat im Auftrag des Bundesministeriums der Finanzen untersucht, ob es grundlegende Alternativen zum bestehenden Wechselkursregime gibt. Grundsätzlich erweist sich keine der beiden Extremformen - komplett freie oder fixe Wechselkurse - als geeignet. In dem daher grundsätzlich zu empfehlenden Mischsystem sind aber Verbesserungen zum Status quo sinnvoll. Anzustreben ist ein Wechselkursregime mit einigen wenigen, großen Währungsraumen, die untereinander durch flexible Wechselkurse verbunden sind. Korrespondierend hierzu sollte sich ein multipolares Leitwährungssystem herausbilden, in dem neben dem gegenwärtig dominierenden US-Dollar auch der Euro und der chinesische Renminbi eine wichtige Rolle spielen dürften. Begleitet werden sollten diese Entwicklungen durch substanzielle Verbesserungen der regulatorischen Rahmenbedingungen der Finanzmärkte. Hierzu gehört neben einer verstärkten globalen und insbesondere europäischen wirtschaftspolitischen Koordinierung auch eine international abgestimmtere und durchsetzungsfähigere Finanzmarktaufsicht.

Dieser Beitrag hat zum Zweck, die aktuellen Entwicklungen im japanischen internationalen Familienrecht am Beispiel der folgenden drei Themen aufzuzeigen.Als erstes wird die geplante Gesetzgebung über die internationale Zuständigkeit in Personen- und Familiensachen unter besonderer Berücksichtigung der Scheidungssachen untersucht. Um den Hintergrund dieses Reformvorhabens zu erhellen, wird auf die bisherige Rechtsprechung bezüglich der internationalen Zuständigkeit in Scheidungssachen eingegangen, die bisher in der Praxis erhebliche Rechtsunsicherheiten verursachte.Zweitens wird berichtet, dass Japan nach langen Überlegungen und Beratungen schließlich im Jahre 2014 das Haager Kindesentführungsübereinkommen von 1980 (HKÜ) angenommen hat. Hierzu werden die Hintergründe für die Annahme und einige Charakteristika des japanischen Umsetzungsgesetzes des HKÜ erläutert.Drittens wird auf die Problematik der internationalen Leihmutterschaft und eine darauf beruhende Elternschaft eingegangen. Während die Diskussion in Japan noch in den Anfängen steht, ist die Entwicklung in Europa bereits bemerkenswert fortgeschritten. So hat sich der BGH am 10.12.2014 für die Anerkennung einer im Ausland zustande gekommenen Elternschaft der zwei männlichen Wunscheltern ausgesprochen, wobei er dem Urteil des Europäischen Gerichtshofs für Menschenrechte vom 26.6.2014 folgte, in dem der EGMR Frankreich wegen Verletzung der Rechtes des Kindes aufgrund einer fehlenden Anerkennung verurteilt wurde. Allerdings sind die genauen Voraussetzungen für eine Feststellung der Elternschaft sowie die Reichweite dieser Rechtsprechung noch nicht klar definiert. Diese Problematik wird mit Blick auf ein geplantes Projekt der Haager Konferenz für Internationales Privatrecht zu diesem Thema analysiert. ; The underlying article aims to describe and analyze recent developments in Japanese international family law in light of the following three topics.First, this paper examines the envisaged legislation on international jurisdiction regarding status and family matters with a particular focus on divorce. With a view to clarifying the background of the reform, the article discusses two major Japanese Supreme Court decisions that have thus far caused considerable uncertainties in Japanese legal practice.Second, this paper reports on Japan's acceptance of the 1980 Hague Child Abduction Convention. In particular it seeks to clarify the reasoning and background of Japan's acceptance and to detail some characteristics of Japan's Implementation Act on the Child Abduction Convention.Third, this contribution deals with issues surrounding cross-border surrogacy and the parentage resulting from it. While the state of the discussion has not yet advanced in Japan, recent developments in European countries have been remarkable. The German Supreme Court (Bundesgerichtshof) decided on 10 December 2014 to recognize a Californian court decree that granted parentage to two German male intended parents living in a registered partnership. This German Supreme Court decision largely followed the reasoning of the judgment rendered by the European Court of Human Rights on 26 June 2014, which ruled that France's denying the intended father all manner of paternity violated the children's right to respect for their private life. Among European countries, however, the precise conditions of recognition and the scope of case law have not yet been clearly defined. This paper tackles this problem in light of the on-going project of the Hague Conference on Private International Law on this subject.

Die Strafverfolgung der Piraterie ist auch drei Jahre nach Beginn der internationalen Marineoperationen am Horn von Afrika ein ungelöstes Problem. Die Gründe hierfür sind vielfältig. Oft wird das Fehlen eines entsprechenden nationalen Piraterierechts als Grund genannt. Fehlender politischer Wille ist der Hauptgrund für einen Verzicht auf Strafverfolgung. Die Verfahren gegen mutmaßliche Piraten sind teuer und langwierig und stellen eine erhebliche logistische Belastung für den anklagenden Staat dar. Die Lasten und Risiken der Strafverfolgung der Piraterie werden von den Staaten nicht altruistisch auf sich genommen, sondern nur, wenn die eigenen Interessen unmittelbar betroffen sind. Die gegenwärtig verfolgte Strategie, das Problem der Strafverfolgung der Piraterie vor Somalia durch Überstellungen in Drittstaaten zu lösen, könnte für die überstellenden Staaten zu einem juristischen Bumerang werden. Art. 105 des Seerechtsübereinkommens stellt keine Grundlage für eine Gerichtsbarkeit von Drittstaaten dar. Eine möglicherweise früher völkergewohnheitsrechtlich bestehende unbeschränkte universelle Gerichtsbarkeit ist jedenfalls spätestens seit der Kodifikation durch das Übereinkommen über die Hohe See und das Seerechtsübereinkommen untergegangen. Ferner stellt sich auch die Frage nach der nationalrechtlichen Strafbefugnis der Drittstaaten. Hiervon unabhängig werden Überstellungen in Drittstaaten, wie die Kündigung des Übernahmeabkommens durch Kenia zeigt, immer nur eine kurzfristige Verschiebung des Problems bedeuten Bereits zu Beginn der Operation ATALANTA hat es national und international Forderungen nach einem internationalen Gerichtshof für Piraterie gegeben. Denkbare Modelle für ein international(-isiert)es Piraterie-Gericht für Somalia wären ein extraterritoriales somalisches Gericht in einem sicheren Drittstaat, spezialisierte Kammern innerhalb der nationalen Gerichtsbarkeit Somalias oder regionaler Staaten, ein regionales Tribunal auf multilateraler Basis, ein internationales Tribunal auf bilateraler Basis oder ein ad hoc Tribunal auf Grundlager einer Resolution des UN-Sicherheitsrates nach Kapitel VII UNC. Letzteres ist vor dem Hintergrund zeitlicher und fachlicher Anforderungen an ein internatio¬nal(-isiert)es Gericht die einzig realistische Alternative. Trotz der hohen Fallzahlen macht die Piraterie vor Somalia aber nur etwa die Hälfte aller Fälle aus. Das Beispiel Somalia zeigt, dass jederzeit irgendwo auf der Welt neue Brennpunkte der Piraterie entstehen können. Auch in Asien nimmt die Piraterie trotz anfänglicher Erfolge bei deren Bekämpfung wieder zu. Das Beispiel Somalia zeigt auch, wie schwer sich die Staaten mit der Strafverfolgung der Piraterie tun. Es läge daher im Interesse der Schifffahrtsnationen über ein ad hoc Tribunal für Somalia hinaus eine ständige Einrichtung zu schaffen, die bei Bedarf unverzüglich die Strafverfolgung aufnehmen kann, wenn ein Staat nicht willens oder in der Lage dazu ist. Hierfür bietet sich die Einrichtung einer Abteilung für Piraterie am Internationalen Seegerichtshof an. Für eine effektive Bekämpfung und Strafverfolgung der Piraterie darf die Reform hier aber nicht stehenbleiben. Insbesondere muss die begriffliche Erfassung strafbarer Handlungen durch Einbeziehung der Küstengewässer erweitert und die Durchlässigkeit der Gewässerzonen durch die Einführung eines Rechts der umgekehrten Nacheile verbessert werden. Daneben müssen das Finanzieren und Organisieren von Piraterie und die Absicht, Piraterie zu begehen, unter Strafe gestellt werden. Die Deklarierung zur völkerrechtlichen Straftat und die Einführung einer Strafverpflichtung sind keine Garantie gegen Straflosigkeit, können aber dazu beitragen, dass sich die Staaten einer Strafverfolgung der Piraterie stärker als bisher verpflichtet fühlen. Mit einem Strafgewaltsgerichtshof gibt es auch eine "kleine Lösung". Dieser könnte die Zuständigkeit zur Strafverfolgung einem der beteiligten Staaten verbindlich zuweisen. ; Three years after the international navy operations have begun at the Horn of Africa; criminal prosecution of piracy is still an unsolved problem. For that there are various reasons. Often it is justified by a missing corresponding international piracy law. A missing political will is the main reason to forbear criminal prosecution. The procedures against alleged pirates are expensive and long-winded and are a considerable logistical burden for the indicting country. The countries do not carry the burdens and risks of a piracy criminal prosecution out of altruistic interest, but only if the own interest are directly affected. The current pursued strategy to solve the problem of piracy criminal prosecution of Somalia by extraditing to a third country could become a judicial boomerang for the extraditing country. Article 105 of UNCLOS does not constitute a basis for jurisdiction of third countries. A possibly unlimited universal jurisdiction of an earlier customary existing international law has certainly gone down ever since the codification of the Convention on the High Seas and UNCLOS. Additionally the question regarding the national legal power to impose sanctions by third countries arises. Regardless of which, an extradition to third countries only imply a short-term remedy for the problem, as the termination of the transfer agreement of Kenya shows. Already at the beginning of the operation ATALANTA there were national and international demands of an International Court of Justice for piracy. Possible models for an international or internationalized piracy court for Somalia could be an extraterritorial Somali court in a safe third country, specialized chambers within Somalia's national jurisdiction or regional country, a regional tribunal on a multilateral base, an international tribunal on a bilateral basis or an ad hoc tribunal based on a resolution of the UN Security Council according to chapter VII UNC. The latter is the only realistic alternative in context of timely and specialized requirements of an international (internationalized) court. Despite the high number of cases, piracy of Somalia only consist of about half of all cases. The example Somalia shows that at any time and anywhere in the world, new piracy burning points can establish. The cases in Asia are again increasing despite the initial success. The example Somalia also shows how difficult it is for the countries to prosecute pirates. Therefore it would be of great interest to the shipping nations to establish additionally to an ad hoc tribunal for Somalia, a constant authority, which when needed can start prosecution immediately when a country is not willing or able to. Here it would be useful to establish a department for piracy at the International Tribunal for the Law of the Sea. In order to enable an effective fight against piracy and criminal prosecution, the reform cannot not stop here. Especially the used terms of criminal acts has to be extended by including the coastal waters and the permeability of the water zones has to be improved by introducing the right of reversed pursuit. In addition to that, piracy financing and organization and the intention to commit piracy must impose penalties. A declaration of international criminal acts and introduction of a prosecution obligation however can contribute to the countries feeling more obligated towards piracy prosecution, stronger than before. However a penal power tribunal offers a "small solution". This could assign bindingly one of the concerned countries the jurisdiction of prosecution.

Die größten Umweltprobleme der Gegenwart besitzen ausnahmslos eine internationale Dimension. Die Ausdünnung der Ozonschicht, die globale Erwärmung, die Zerstörung der Tropenwälder oder die Meeresverschmutzung machen nicht vor nationalen Grenzen halt. Da auf internationaler Ebene keine zentrale Instanz existiert, die die Nutzung grenzüberschreitender Umweltgüter wirkungsvoll regulieren könnte, ist zum Schutz freiwillige zwischenstaatliche Zusammenarbeit erforderlich. Zentrale Aufgabe der Arbeit ist es daher, die ökonomischen Bedingungen für internationale Kooperation in Umweltschutzfragen herauszuarbeiten und auf konkrete Fragestellungen anzuwenden. Die Untersuchung beschränkt sich dabei nicht auf die wohlfahrtsökonomische Perspektive, sondern schließt auch die Sichtweise der Neuen Politischen Ökonomie ein.

The relation between currency and trade, and the impact that the exchange rate can have on International Trade Law enables heated arguments. The Havana Charter calls for the non-use of the devaluation of the exchange rate as commercial weapon. GATT has, among its articles, those addressing issues regarding exchange rates. However, this topic raises controversies, especially concerning the applicability of the WTO agreements as a commercial remedy against currencies' anticompetitive devaluation. On the other hand, the IMF, an institution created under the Bretton Woods Agreement, is the competent body to deal with international financial issues and its article IV rules on its duty to monitor its Member States exchange rate policies, in order to avoid obtaining anti-competitive advantages among their means of trade. The two organizations working jointly in an orderly manner to accomplish their objectives of an overall world economic growth and it is from this perception that harmonization between WTO's legal guidance and IMF's directives must be implemented.
