Magistrsko delo obravnava problematiko poslovnih pogajanj v podjetju Metal Ravne, d.o.o., natančneje pogajanja med domačimi in ruskimi poslovnimi partnerji. Pogajanja so pomembna sestavina poslovnega delovanja in posebna dejavnost menedžerjev v organizacijah. So večsmeren proces sporazumevanja za usklajevanje interesov, v katerem več udeležencev vpliva medsebojno pri nastajanju skupnih odločitev. Dobra pogajanja morajo usklajevati interese in hkrati obvladovati nasprotja med udeleženci organizacije, ki so lahko notranji ali zunanji. Nasprotja v pogajanjih so gonilo napredka, usklajeni interesi kot rezultat pogajanj pa pogoj za uspešnost organizacije. Nasprotno pa se neusklajeni interesi lahko izrodijo v škodljive spore, ki nikomur ne koristijo. Dober pogajalec se ne rodi, ampak so dosego stopnje dobrega pogajalca potrebne večletne izkušnje. Izkušenost pa posledično prinese tudi izkušnje v načinu priprave za pogajanje, načinu komuniciranja in v pripravi strategije. Vse to je potrebno, saj zaradi vedno večjega odpiranja tujim trgom in povezovanja držav, poslovna pogajanja potekajo med pogajalci iz različnih kulturnih okolij, s specifičnim sistemom vrednot in pričakovanj. Te razlike v stališčih, prepričanju in percepciji so skupaj z mnogimi drugimi značilnostmi kulture temeljnega pomena za dobra mednarodna pogajanja in imajo velik vpliv na sam potek pogajanj. Poznavanje kulture nasprotne strani pomeni določeno prednost v pogajanjih, saj se z dobro pripravo na sama pogajanja skrajša čas pogajanj in hkrati pripomore k sklenitvi sporazuma, ki je za obe pogajalski strani najbolj zaželjen. Priprave na pogajanja s tujimi poslovnimi partnerji igrajo pomembno vlogo, kajti pri sami pripravi pogajanj izkušen pogajalec dobro spozna kulturo pogajalskega partnerja, strategijo pozna, stil, nebesedno komunikacijo in ostale dejavnike, ki vplivajo na potek in rezultat pogajanj. Neizkušeni pogajalci pogosto delajo omenjene napake, popolnoma ignorirajo kulturne razlike nasprotne strani itn. V magistrski nalogi smo želeli na konkretnem primeru pokazati, kakšne so razlike med slovenskimi in ruskimi pogajalci, kakšna je razlika v pogajalskem stilu in slogu, pogajalski strategiji, poslovnih običajih in poslovnem bontonu. Leta 2007 je namreč rusko podjetje KOKS postalo večinski lastnik Metala Ravne kot tudi večinski lastnik Slovenske industrije jekla. Kot večinski lastniki podjetja Metal Rusi odločajo o vlaganju v investicije. In prav to področje je temeljno pri pogajalski dejavnosti podjetja. Ob obravnavi problematike v podjetju Metal smo ugotovili, da so pogajanja podjetja Metal z ruskimi partnerji še v povojih. ; Master's thesis deals with the issue of business negotiations in the company Metal Ravne, d.o.o., concentrating on negotiations between the Slovenian and Russian business partners. Negotiations are an important element of business activity and a specific activity of managers in organisations. They are a multi-way process of communication for a coordination of different interests, in which several participants interact in the formation of joint decisions. Successful negotiations coordinate interests and manage conflicts between participants, which may be internal or external. Conflicts in negotiations are the driving power of progress while adjusted interests as a result of negotiations are the precondition for a successful organisation. On the other side, unadjusted interests may deteriorate into detrimental misunderstandings and disputes which is of no use to anyone. A negotiator is not born. It takes many years of experience to develop the skills necessary to become a successful negotiator. This eventually also brings experience in the way how we prepare ourseself best for negotiations, in the way how we communicate and how we prepare our strategy. All this is necessary as - due to an increasing opening of foreign markets and bonding among countries - business negotiations run between negotiatiors from a different cultural background, each with a specific system of values and expectations. These differences in attitudes, beliefs and perceptions, along with many other characteristics of culture, are essential for successful international negotiations and they have a major influence on the negotiation process itself. Knowing the culture of the opposite negotiating partner represents a certain advantage since good preparations for the negotiation itself reduce the time of negotiations, simultaneously contributing to the conclusion of the agreement most desired by both negotiating partners. Preparations for negotiations with foreign business partners play an important role since – already before negotiations - an experienced negotiator learns the culture of the opposite negotiating partner, his strategy, style, non-verbal communication and other factors which have influence on the course and on the outcome of negotiations. Inexperienced negotiators often make mistakes, completely ignoring cultural differences of the opposite partner and similar. This Master's thesis concentrates on revealing differences between the Slovenian and Russian negotiators, on differences in their negotiation style, strategies, business practices and business etiquette. In 2007, the Russian company KOKS became the majority owner of Metal Ravne, d.o.o. and also the majority owner of the Slovenian Steel Group, d.d. In this capacity, the Russians now make decisions on investments. And this is exactly the area which is essential in the negotiatiation business of the company. When analysing this issue in the company Metal Ravne, d.o.o., it was established that negotiations between Metal Ravne, d.o.o. and the Russian partners are still in the early stages of development
OBJETIVO: Analisar o desempenho do Programa Farmácia Popular do Brasil perante os setores público e privado, em relação a: disponibilidade, preço e custo, para o paciente, de medicamentos para hipertensão e diabetes. MÉTODOS: Foi utilizada a metodologia desenvolvida pela Organização Mundial da Saúde em conjunto com a Ação Internacional para Saúde, para comparação de preços e disponibilidade de medicamentos. A pesquisa foi aplicada em maio de 2007, em estabelecimentos de diferentes setores [público, privado e as modalidades própria (FPB-P) e expansão (FPB-E) do Programa], em 30 municípios do Brasil. Os quatro medicamentos analisados foram: captopril 25mg e hidroclorotiazida 25mg, para hipertensão, e metformina 500mg e glibenclamida 5mg, para diabetes. RESULTADOS: O FPB-E apresentou maior disponibilidade de medicamentos e o setor público, a menor. Tanto no setor público quanto na FPB-P o percentual de disponibilidade de similares foi maior que o de genéricos. A comparação de preços entre os setores mostrou menor preço de aquisição no FPB-E, seguido pelo FPB-P. O FPB-E apresentou economia superior a 90% em relação ao setor privado. O número de dias de trabalho necessários para aquisição de tratamentos para hipertensão e diabetes foi menor no FPB-E. CONCLUSÕES: A menor disponibilidade encontrada no setor público pode ser uma das justificativas para migração dos usuários do setor público para o FPB. CONCLUSIONES: La menor disponibilidad encontrada en el sector público puede ser una de las justificativas de la migración de los usuarios del sector público al FPB. Los altos precios practicados por el sector privado también contribuyen para que el Programa sea una alternativa de acceso a medicamentos en Brasil. ; OBJECTIVE: To analyze the performance of the Programa Farmácia Popular do Brasil (FPB - Brazilian Popular Pharmacy Program) in the public and private sectors, in terms of availability and cost of medicines for hypertension and diabetes. METHODS: The methodology developed by the World Health Organization, in partnership with the Health Action International, was used to compare medicines prices and availability. This study was performed in May 2007, in different sectors (public, private and the Program's government-managed [FPB-P] and private-sector-managed [FPB-E] categories), in 30 cities in Brazil. A total of four medicines were analyzed: captopril 25mg and hydrochlorothiazide 25mg for hypertension; and metformin 500mg and glibenclamide 5mg for diabetes. RESULTS: FPB-E showed greatest medicine availability, while the public sector the lowest. The percentage of availability of similar medicines was higher than that of generic medicines, both in the public sector and in the FPB-P. Comparison of prices among sectors showed a lower purchase price in the FPB-E, followed by the FPB-P. The FPB-E charged prices that were over 90% cheaper than those in the private sector. The number of working days required to obtain treatment for hypertension and diabetes were fewer in the FPB-E. CONCLUSIONS: The lower availability found in the public sector could be one of the reasons for the migration of users from the public sector to the FPB. The high prices in the private sector also contribute for this Program to be an alternative of medicine access in Brazil.
Temporary or permanent, local or international, voluntary or forced, legal or illegal, registered or unregistered migrations of individuals, whole communities or individual groups are an important factor in constructing and modifying (modern) societies. The extent of international migrations is truly immense. At the time of the preparation of this publication more than 200 million people have been involved in migrations in a single year according to the United Nations. Furthermore, three times more wish to migrate, mostly from sub-Saharan Africa towards some of the most economically developed areas of the world according to the estimates by the Gallup Institute (Esipova, 2011). Some authors, although aware that it is not a new phenomenon, talk about the era of migration (Castles, Miller, 2009) or the globalization of migration (Friedman, 2004). The global dimensions of migration are definitely influenced also by the increasingly visible features of modern societies like constantly changing conditions, instability, fluidity, uncertainty etc. (Beck, 2009; Bauman, 2002).The extent, direction, type of migrations and their consequences are affected by many social and natural factors in the areas of emigration and immigration. In addition, researchers from many scientific disciplines who study migrations have raised a wide range of research questions (Boyle, 2009, 96), use a variety of methodological approaches and look for different interpretations in various spatial, temporal and contextual frameworks. The migrations are a complex, multi-layered, variable, contextual process that takes place at several levels. Because of this, research on migrations has become an increasingly interdisciplinary field, since the topics and problems are so complex that they cannot be grasped solely and exclusively from the perspective of a single discipline or theory. Therefore, we are witnessing a profusion of different "faces of migration", which is reflected and at the same time also contributed to by this thematic issue of the journal Ars & Humanitas.While mobility or migration are not new phenomena, as people have moved and migrated throughout the history of mankind, only recently, in the last few decades, has theoretical and research focus on them intensified considerably. In the last two decades a number of research projects, university programs and courses, research institutes, scientific conferences, seminars, magazines, books and other publications, involving research, academia as well as politics and various civil society organizations have emerged. This shows the recent exceptional interest in the issue of migration, both in terms of knowledge of the processes involved, their mapping in the history of mankind, as well as the theoretical development of migration studies and daily management of this politically sensitive issue.Migration affects many entities on many different levels: the individuals, their families and entire communities at the local level in the emigrant societies as well as in the receiving societies. The migration is changing not only the lives of individuals but whole communities and societies, as well as social relations; it is also shifting the cultural patterns and bringing important social transformations (Castles 2010). This of course raises a number of questions, problems and issues ranging from human rights violations to literary achievements. Some of these are addressed by the authors in this thematic issue.The title "Many faces of migration", connecting contributions in this special issue, is borrowed from the already mentioned Gallup Institute's report on global migration (Esipova, 2011). The guiding principle in the selection of the contributions has been their diversity, reflected also in the list of disciplines represented by the authors: sociology, geography, ethnology and cultural anthropology, history, art history, modern Mediterranean studies, gender studies and media studies. Such an approach necessarily leads not only to a diverse, but at least seemingly also incompatible, perhaps even opposing views "on a given topic. However, we did not want to silence the voices of "other" disciplines, but within the reviewing procedures actually invited scientists from the fields represented by the contributors to this volume. The wealth of the selected contributions lies therefore not only in their coherence and complementarity, but also in the diversity of views, stories and interpretations.The paper of Zora Žbontar deals with the attitudes towards foreigners in ancient Greece, where the hospitality to strangers was considered so worthy a virtue that everyone was expected to "demonstrate hospitality and protection to any foreigner who has knocked on their door". The contrast between the hospitality of ancient Greece and the modern emergence of xenophobia and ways of dealing with migration issues in economically developed countries is especially challenging. "In an open gesture of hospitality to strangers the ancient Greeks showed their civilization".Although the aforementioned research by the United Nations and Gallup Institute support some traditional stereotypes of the main global flows of migrants, and the areas about which the potential migrants "dream", Bojan Baskar stresses the coexistence of different migratory desires, migration flows and their interpretations. In his paper he specifically focuses on overcoming and relativising stereotypes as well as theories of immobile and non-enterprising (Alpine) mountain populations and migrations.The different strategies of the crossing borders adopted by migrant women are studied by Mirjana Morokvasic. She marks them as true social innovators, inventing different ways of transnational life resulting in a bottom-up contribution to the integrative processes across Europe. Some of their innovations go as far as to shift diverse real and symbolic boundaries of belonging to a nation, gender, profession.Elaine Burroughs and Zoë O'Reilly highlight the close relations between the otherwise well-established terminology used in statistics and science to label immigrants in Ireland and elsewhere in EU, and the negative representations of certain types of migrants in politics and the public. The discussion focusses particularly on asylum seekers and illegal immigrants who come from outside the EU. The use of language can quickly become a political means of exclusion, therefore the authors propose the development and use of more considerate and balanced migration terminology.Damir Josipovič proposes a change of the focal point for identifying and interpreting the well-studied migrations in the former Yugoslavia. The author suggests changing the dualistic view of these migrations to an integrated, holistic view. Instead of a simplified understanding of these migrations as either international or domestic, voluntary or forced, he proposes a concept of pseudo-voluntary migrations.Maja Korać-Sanderson's contribution highlights an interesting phenomenon in the shift in the traditional patterns of gender roles. The conclusions are derived from the study of the family life of Chinese traders in transitional Serbia. While many studies suggest that child care in recent decades in immigrant societies is generally performed by immigrants, her study reveals that in Serbia, the Chinese merchants entrust the care of their children mostly to local middle class women. The author finds this switch of roles in the "division of labour" in the child care favourable for both parties involved.Francesco Della Puppa focuses on a specific part of the mosaic of contemporary migrations in the Mediterranean: the Bangladeshi immigrant community in the highly industrialized North East of Italy. The results of his in-depth qualitative study reveal the factors that shape this segment of the Bangladeshi diaspora, the experiences of migrants and the effects of migration on their social and biographical trajectories.John A. Schembri and Maria Attard present a snippet of a more typical Mediterranean migration process - immigration to Malta. The authors highlight the reduction in migration between Malta and the United Kingdom, while there is an increase in immigration to Malta from the rest of Europe and sub-Saharan Africa. Amongst the various impacts of immigration to Malta the extraordinary concentration of immigrant populations is emphasized, since the population density of Malta far exceeds that of nearly all other European countries.Miha Kozorog studies the link between migration and constructing their places of their origin. On the basis of Ardener's theory the author expresses "remoteness" of the emigratory Slavia Friulana in terms of topology, in relation to other places, rather than in topography. "Remoteness" is formed in relation to the "outside world", to those who speak of "remote areas" from the privileged centres. The example of an artistic event, which organizers aim "to open a place like this to the outside world", "to encourage the production of more cosmopolitan place", shows only the temporary effect of such event on the reduction of the "remoteness".Jani Kozina presents a study of the basic temporal and spatial characteristics of migration "of people in creative occupations" in Slovenia. The definition of this specific segment of the population and approach to study its migrations are principally based on the work of Richard Florida. The author observes that people with creative occupations in Slovenia are very immobile and in this respect quite similar to other professional groups in Slovenia, but also to the people in creative professions in the Southern and Eastern Europe, which are considered to be among the least mobile in Europe. Detailed analyses show that the people in creative occupations from the more developed regions generally migrate more intensely and are also more willing to relocate.Mojca Pajnik and Veronika Bajt study the experiences of migrant women with the access to the labour market in Slovenia. Existing laws and policies push the migrants into a position where, if they want to get to work, have to accept less demanding work. In doing so, the migrant women are targets of stereotyped reactions and practices of discrimination on the basis of sex, age, attributed ethnic and religious affiliation, or some other circumstances, particularly the fact of being migrants. At the same time the latter results in the absence of any protection from the state.Migration studies often assume that the target countries are "modern" and countries of origin "traditional". Anıl Al- Rebholz argues that such a dichotomous conceptualization of modern and traditional further promotes stereotypical, essentialist and homogenizing images of Muslim women in the "western world". On the basis of biographical narratives of young Kurdish and Moroccan women as well as the relationships between mothers and daughters, the author illustrates a variety of strategies of empowerment of young women in the context of transnational migration.A specific face of migration is highlighted in the text of Svenka Savić, namely the face of artistic migration between Slovenia and Serbia after the Second World War. The author explains how more than thirty artists from Slovenia, with their pioneering work in three ensembles (opera, ballet and theatre), significantly contributed to the development of the performing arts in the Serbian National Theatre in Novi Sad.We believe that in the present thematic issue we have succeeded in capturing an important part of the modern European research dynamic in the field of migration. In addition to well-known scholars in this field several young authors at the beginning their research careers have been shortlisted for the publication. We are glad of their success as it bodes a vibrancy of this research area in the future. At the same time, we were pleased to receive responses to the invitation from representatives of so many disciplines, and that the number of papers received significantly exceeded the maximum volume of the journal. Recognising and understanding of the many faces of migration are important steps towards the comprehensive knowledge needed to successfully meet the challenges of migration issues today and even more so in the future. It is therefore of utmost importance that researchers find ways of transferring their academic knowledge into practice – to all levels of education, the media, the wider public and, of course, the decision makers in local, national and international institutions. The call also applies to all authors in this issue of the journal. ; Začasne ali stalne, lokalne ali mednarodne, prostovoljne ali prisilne, legalne ali ilegalne, registrirane ali neregistrirane migracije posameznic in posameznikov, celih družbenih skupnosti ali posameznih skupin predstavljajo pomemben dejavnik v konstruiranju in spreminjanju (sodobnih) družb. Razsežnosti mednarodnih migracij so resnično ogromne, saj je bilo vanje v času nastajanja te publikacije po ocenah Združenih narodov v enem letu vključenih več kot 200 milijonov ljudi. Po ocenah Gallupovega inštituta pa se jih še trikrat toliko želi preseliti, največ iz podsaharske Afrike ter proti nekaterim gospodarsko najbolj razvitim območjem sveta (Esipova, 2011). Nekateri avtorji zato, čeprav ob zavedanju, da ne gre za nov fenomen, govorijo o dobi migracij (Castles, Miller, 2009) ali o globalizaciji migracij (Friedman, 2004). Zagotovo je na globalne razsežnosti migracij vplivalo tudi to, da so vse bolj vidne značilnosti sodobnih družb nenehno spreminjanje razmer, nestabilnost, fluidnost, negotovost ipd. (Beck, 2009; Bauman, 2002).Na obseg, smeri in vrste migracij ter na njihove posledice vplivajo številni družbeni in naravni dejavniki, tako na območjih odseljevanja kot tudi na območjih priselitev. Poleg tega si raziskovalke in raziskovalci iz številnih znanstvenih disciplin, ki proučujejo migracije, v raziskavah zastavljajo »neverjetno raznovrstna« vprašanja (Boyle, 2009, 96), uporabljajo različne metodološke pristope in iščejo različne interpretacije, in sicer v različnih prostorskih, časovnih in vsebinskih okvirih. Vse bolj prihaja do izraza, da so migracije kompleksen, večplasten, spremenljiv in kontekstualen proces, ki poteka na več ravneh. Prav zaradi tega spoznanja je raziskovanje migracij postajalo vse bolj interdisciplinarno polje, saj so teme in problemi tako kompleksni, da jih ni mogoče zagrabiti zgolj in izključno iz perspektive ene same znanosti ali teorije. Zato smo priča pravemu bogastvu »obrazov migracij«, ki ga odraža ter obenem k njemu tudi prispeva pričujoča tematska številka revije Ars & Humanitas.Čeprav mobilnost oziroma migracije niso nov pojav, saj so se ljudje selili in preseljevali skozi celotno zgodovino človeštva, pa se šele v zadnjem času, v zadnjih nekaj desetletjih, z njimi resno teoretsko in raziskovalno ukvarjamo. V zadnjih dveh desetletjih so se pojavili številni raziskovalni projekti, univerzitetni programi in predmeti, raziskovalni inštituti, znanstvene konference, posveti, revije, knjige in druge publikacije, pri katerih sodelujejo tako raziskovalna in akademska sfera kot tudi politika in različne civilnodružbene organizacije. To priča o v zadnjem času izjemnem zanimanju za vprašanje migracij, tako kar zadeva poznavanje samih procesov in njihovo mapiranje v zgodovini človeštva kot tudi teoretski razvoj migracijskih študij in vsakodnevno urejanje tega politično občutljivega vprašanja.Migracije zadevajo številne subjekte na številnih ravneh: posameznice in posameznike, njihove družine ter celotne skupnosti tako na lokalni ravni v družbi emigracije kakor tudi na vseh teh ravneh v imigrantski družbi. Z migracijami se spreminjajo ne samo življenja posameznikov in posameznic, ampak se spreminjajo celotne skupnosti oziroma družbe in družbeni odnosi, zamikajo se kulturni vzorci, prihaja do pomembnih družbenih transformacij (Castles, 2010). Ob tem se seveda odpirajo številne teme, problemi in vprašanja, ki se gibljejo v širokem razponu od kršenja človekovih pravic do literarnih presežkov. Nekaterih od njih se dotikajo tudi prispevki v pričujoči tematski številki.Povezovalni naslov prispevkov v tej tematski številki revije, »Številni obrazi migracij«, smo si sposodili iz že omenjenega poročila Gallupovega inštituta o globalnih selitvah (Esipova, 2011). Temeljno vsebinsko vodilo pri izbiri prispevkov je bila raznovrstnost, kar nakazuje tudi pregled znanstvenih disciplin, iz katerih prihajajo avtorji: sociologija, geografija, etnologija in kulturna antropologija, zgodovina, umetnostna zgodovina, sodobne sredozemske študije, študiji spola in medijski študiji. Tak pristop nujno pripelje ne le do raznolikih, ampak tudi do vsaj navidezno neskladnih, morda celo nasprotnih pogledov na obravnavane tematike. Vendar nismo želeli utišati glasov iz »drugih« znanstvenih disciplin, temveč smo raje v recenzentske postopke povabili znanstvenike s področij, s katerih so tudi avtorji. Bogastvo zbranih prispevkov torej ni v njihovi medsebojni skladnosti in potrjevanju, temveč prav v mnogoterosti pogledov, zgodb in interpretacij.Prispevek Zore Žbontar obravnava odnos do tujcev v antični Grčiji, kjer je bilo gostoljubje do tujcev tako častivredna vrlina, da je vsak moral »izkazati gostoljubje in zaščititi kateregakoli tujca, ki je potrkal na vrata«. Zlasti je izzivalen kontrast med gostoljubjem v antični Grčiji in sodobnim pojavljanjem ksenofobije ter načini soočanja z migracijsko problematiko v gospodarsko razvitih državah. »Antični Grki so v odprti gesti gostoljubja do tujcev prepoznali svojo civiliziranost.«Čeprav omenjene raziskave Združenih narodov in Gallupovega inštituta podpirajo nekatere uveljavljene stereotipe o glavnih globalnih tokovih migrantov ter o območjih, o katerih »sanjajo« potencialni migranti, Bojan Baskar opozarja na sočasen obstoj tudi drugačnih migracijskih želja, tokov migracij in njihovih interpretacij. Posebej se osredotoči na preseganje in relativizacijo stereotipov in teorij o nemobilnem in nepodjetnem (alpskem) hribovskem prebivalstvu in migracijah.O tem, kako različne strategije pri prehajanju, prestopanju in prečkanju meja razvijejo migrantke, piše Mirjana Morokvasic. Označi jih kot prave socialne inovatorke, ki izumijo različne načine transnacionalnega življenja in tako od spodaj navzgor prispevajo k integrativnim procesom po vsej Evropi. V svoji inovativnosti gredo nekatere tako daleč, da premikajo različne, tako realne kot simbolne meje pripadanja naciji, spolu in poklicu.Elaine Burroughs in Zoë O'Reilly izpostavita tesno povezanost med sicer uveljavljeno terminologijo, s katero v statistiki in tudi znanosti označujejo imigrante na Irskem in širše v EU, ter negativnimi reprezentacijami nekaterih tipov migrantov v politiki in javnosti. Razpravo navežeta zlasti na iskalce azila in nezakonite priseljence, ki pridejo iz držav zunaj EU. Raba jezika lahko hitro postane politični način izključevanja, zato predlagata razvoj in uporabo obzirnejše in pravičnejše migracijske terminologije.Za spremembo izhodišča opredeljevanja in interpretacije sicer dobro proučenih selitev v nekdanji Jugoslaviji se zavzame Damir Josipovič. Predlaga zamenjavo dualističnega pogleda na te migracije s celostnim. Namesto njihovega poenostavljenega razumevanja kot mednarodnih in notranjih ali prostovoljnih in prisilnih migracij pa se zavzema za koncept psevdoprostovoljnih migracij.Na zanimiv fenomen zamikanja ustaljenih vzorcev spolnih vlog opozori tekst Maje Korać-Sanderson, katere zaključki izhajajo iz študije družinskega življenja kitajskih trgovcev v tranzicijski Srbiji. Medtem ko številne študije ugotavljajo, da skrbstveno delo v zadnjih desetletjih v imigrantskih družbah v glavnem opravljajo migrantke, njena študija ugotavlja, da v Srbiji kitajske trgovke skrb za svoje otroke večinoma zaupajo lokalnim ženskam srednjega razreda. Ta obrat vlog pri »delitvi dela« v skrbstveni sferi, ugotavlja avtorica, je v prid obema vpletenima stranema.Specifičen del mozaika sodobnih migracij v Sredozemlju, bangladeške skupnosti imigrantov na visoko industrializiranem severovzhodu Italije, razkriva Francesco Della Puppa. Izsledki poglobljenega kvalitativnega proučevanja odstirajo dejavnike, ki oblikujejo ta segment bangladeške diaspore, izkušnje migrantov ter učinke selitve na njihove družbene in biografske trajektorije.Izsek iz bolj tipičnih sredozemskih migracijskih procesov na primeru priseljevanja na Malto predstavita John A. Schembri in Maria Attard. Ugotavljata zmanjševanje števila selitev med Malto in Veliko Britanijo ob hkratnem povečevanju priseljevanja iz ostalih držav Evrope in podsaharske Afrike. Med učinki priseljevanja na Malto izpostavita izredno zgoščenost priseljenega prebivalstva, ki presega gostote celotnih prebivalstev v nekaterih evropskih državah.Miha Kozorog obravnava povezavo med migracijami in konstruiranjem krajev, iz katerih te migracije izvirajo. S pomočjo Ardenerjeve teorije »odročnost« izrazito emigracijske Benečije izrazi ne toliko v topografskem kot v topološkem smislu, v razmerju do drugih krajev. »Odročnost« nastaja v razmerju z »zunanjim svetom«, s tistimi, ki govorijo o »odročnih krajih« iz privilegiranih središč. Na primeru umetniškega dogodka, s katerim želijo organizatorji »odpreti tak kraj zunanjemu svetu« in »spodbuditi produkcijo bolj svetovljanskega kraja«, pokaže zgolj začasnost učinka tega dogodka na zmanjšanje »odročnosti«.O temeljnih časovnih in prostorskih značilnostih selitev »prebivalcev z ustvarjalnim poklicem« v Sloveniji piše Jani Kozina. Pri opredeljevanju tega specifičnega dela prebivalstva in pristopa k proučevanju njegovega migriranja se opre zlasti na dela Richarda Floride. Ugotavlja, da so prebivalci z ustvarjalnim poklicem v Sloveniji prostorsko zelo nemobilni in po tem kriteriju precej podobni ostalim poklicnim skupinam v Sloveniji, obenem pa tudi prebivalcem z ustvarjalnimi poklici v južni in vzhodni Evropi, za katere velja, da so med najmanj mobilnimi v Evropi. Podrobnejše analize pokažejo, da se ustvarjalci bolj razvitih regij načeloma intenzivneje selijo in so tudi v večji meri pripravljeni na selitev.O izkušnjah migrantk pri dostopu do trga delovne sile v Sloveniji govori članek Mojce Pajnik in Veronike Bajt. Obstoječa zakonodaja in posamezne politike namreč migrantke potiskajo v položaj, ko, če hočejo priti do zaposlitve, pristajajo na manj zahtevna dela. Pri tem so tarče stereotipnih reakcij in praks diskriminiranja tako na podlagi spola kot tudi starosti, pripisane etnične in religiozne pripadnosti ali kakšne druge okoliščine, še posebej dejstva, da so migrantke. Obenem pa prav zadnje vpliva na to, da s strani države niso deležne nikakršne zaščite.Migracijske študije pogosto domnevajo, da so ciljne države »moderne«, države izvora pa »tradicionalne«. Razprava Anıl Al-Rebholz ugotavlja, da takšna dihotomija pojmovanja modernega in tradicionalnega dodatno spodbuja stereotipne, esencialistične in homogenizirajoče predstave o muslimanskih ženskah v »zahodnem svetu«. Na podlagi biografskih pripovedi mlade Maročanke in Kurdinje ter razmerij med materami in hčerami prikaže raznolike strategije opolnomočenja mladih žensk v transnacionalnem migracijskem kontekstu.Specifični obraz migracij prinaša tekst Svenke Savić, namreč obraz umetniških migracij med Slovenijo in Srbijo po drugi svetovni vojni. Avtorica v njem ugotavlja, da je v treh ansamblih (opernem, gledališkem in baletnem) več kot trideset umetnic in umetnikov iz Slovenije s svojim pionirskim delom pomembno zaznamovalo razvoj gledališke umetnosti v Srbskem narodnem gledališču v Novem Sadu.Verjamemo, da nam je uspelo v pričujočo tematsko številko ujeti pomemben del sodobnega evropskega raziskovalskega utripa s področja migracij. Poleg uveljavljenih znanstvenikov s tega področja se je v ožji izbor prispevkov uvrstilo tudi več mladih avtoric in avtorjev, ki začenjajo raziskovalne kariere. Njihov uspeh nas veseli, saj obeta živahnost tega raziskovalnega področja tudi v bodoče. Obenem nas veseli, da so se vabilu odzvali predstavniki tako številnih znanstvenih disciplin ter da je število prispevkov, ki smo jih prejeli, znatno presegalo največji možni obseg revije. Spoznavanje in razumevanje številnih obrazov migracij sta pomembna koraka proti celovitemu znanju, potrebnemu za uspešno soočanje z izzivi migracijske problematike danes in, kot kaže, še posebej v prihodnosti. Zato je izjemnega pomena, da raziskovalci najdemo načine prenosa svojih znanstvenih spoznanj v prakso – na vse ravni izobraževanja, v medije, širše strokovne javnosti ter seveda tudi odločevalcem v lokalnih, državnih in mednarodnih ustanovah. Poziv velja tudi vsem avtorjem prispevkov v tej številke revije.
OBJECTIVE : To analyze humanization practices in primary health care in the Brazilian Unified Health System according to the principles of the National Humanization Policy. METHODS : A systematic review of the literature was carried out, followed by a meta-synthesis, using the following databases: BDENF (nursing database), BDTD (Brazilian digital library of theses and dissertations), CINAHL (Cumulative Index to nursing and allied health literature), LILACS (Latin American and Caribbean health care sciences literature), MedLine (International health care sciences literature), PAHO (Pan-American Health Care Organization Library) and SciELO (Scientific Electronic Library Online). The following descriptors were used: Humanization; Humanizing Health Care; Reception: Humanized care: Humanization in health care; Bonding; Family Health Care Program; Primary Care; Public Health and Sistema Único de Saúde (the Brazilian public health care system). Research articles, case studies, reports of experiences, dissertations, theses and chapters of books written in Portuguese, English or Spanish, published between 2003 and 2011, were included in the analysis. RESULTS : Among the 4,127 publications found on the topic, 40 studies were evaluated and included in the analysis, producing three main categories: the first referring to the infrastructure and organization of the primary care service, made clear the dissatisfaction with the physical structure and equipment of the services and with the flow of attendance, which can facilitate or make difficult the access. The second, referring to the health work process, showed issues about the insufficient number of professionals, fragmentation of the work processes, the professional profile and responsibility. The third category, referring to the relational technologies, indicated the reception, bonding, listening, respect and dialog with the service users. CONCLUSIONS : Although many practices were cited as humanizing they do not produce changes in the health services because of the lack of more profound analysis of the work processes and ongoing education in the health care services. ; OBJETIVO : Analizar las prácticas de humanización en la asistencia básica de la red pública del sistema de salud brasileño basándose en los principios de la política nacional de humanización de Brasil. RESULTADOS : De las 4.127 publicaciones recuperadas sobre el tema, se evaluaron e incluyeron 40, llegando a tres categorías centrales: la primera, infraestructura y organización de los servicios básicos de salud, evidenció insatisfacción con la estructura física y material y con los flujos de atención que pueden facilitar o dificultar el acceso. La segunda, se refiere al proceso de trabajo, que presentó aspectos relacionados con el número insuficiente de profesionales, fragmentación de los procesos de trabajo, perfil y responsabilidad profesional. La tercera, consistió en las tecnologías de las relaciones y señaló el acogimiento, vínculo, prestar atención, respeto y diálogo con los usuarios. Amazônica entra no segundo ano e traz aos leitores artigos que refletem sobre a difícil interlocução entre povos indígenas e não-indígenas, que se caracteriza pela luta pela sobrevivência cultural dos primeiros que têm como "adversário" as dificuldades relativas à compreensão da diversidade, expressas de inúmeras formas. O artigo sobre os Mbyá-Guarani no sul do Brasil de autoria de Sergio Baptista da Silva, Mártin César Tempass e Carolina Schneider Comandulli traz a público a diferenciada compreensão de território dos Mbyá-Guarani, fundamental ao processo de demarcação de terras, que conflita com a (in)compreensão dos não-indígenas, mas que deve ser vencida para garantir a livre determinação dos povos etnicamente diferenciados, sob pena de desconsiderar a secular mobilidade entre fronteiras internacionais.Noelia Enriz contribui ao debate, refletindo sobre a educação escolar indígena que se (em/de)bate entre os modelos intervencionistas e participativos, os primeiros que desconhecem a autonomia dos povos indígenas e o segundo que contempla as necessidade de formação de quadros políticos para intermediar disputas históricas. Se a leitura dos especialistas em Guarani parece distanciada do cotidiano amazônico, é preciso pensar que os Guarani, pela mobilidade encontram-se na Amazônia, além dela se originar. The article on the Mbyá-Guarani in southern Brazil, written by Sergio Baptista da Silva, Martin Cesar Tempass, and Carolina Schneider Comandulli, presents a Mbyá-Guarani particular understanding of territory, fundamental to the process of land demarcation, which conflicts with the nonindigenous view. That nonindigenous view arguably needs to be overcome in order to ensure the free will of ethnically distinct peoples, accustomed to secular mobility across international borders. Noelia Enriz contributes to this debate by considering indigenous education, which is framed in terms of interventionist and participatory models. Interventionist models disregard the autonomy of indigenous people; in contrast, participatory ones focus on political training in order to mediate historical struggles. If the articles on the Guarani seem far removed from our regional focus, we must remember that Guarani mobility brought them back to the Amazon region, where they originated. Territorial mobility is also highlighted in the article by Fabiola Andrea Silva and Francisco Forte Stuchi. They evaluate the reasons for Kaiabi mobility along the border between Mato Grosso and Pará, with implications for archaeology. Luciana Barroso França stresses intra-ethnic conflicts within the village, between two Tupi-Guarani groups, in contact resulting from historical contingencies.From the article by Gnecco, who discusses archaeological discourse vis-à-vis the Other, together with its implications for the present - and future - we make the transition to archaeology, which is intimated in the provocative article by Sanna Saunaluoma, who brings new information and perspectives on monumental sites of Acre and Bolivia. Introduction: The Corona virus (COVID-19) pandemic caused, among others, the need for colleges and universities managers around the world to reinvent new ways of providing education preserving its good quality at the same time. With the new ordinances of the Ministry of Education and Health, all courses can use remote methodologies for the continuity on the current school year. With new challenges and paradigms emerging from this methodological proposal: provide for the user the feeling of immersion, of being in the class room, from the navigation and interaction in this virtual environment, at the same time that the educator, respecting the educational principles and the pedagogical approach that he believes, does not transform this moment into a simple distance education. Objective: to describe the state of the art on nursing education and the challenges of using remote technologies in the time of Corona virus pandemic. Methods: this is a reflective study based on secondary sources of literature relevant to the theme, considering articles from national and international journals and recent productions on education, health training, remote technologies, COVId-19 and public health. Results: it is evident that experiencing the effects of the corona virus pandemic (COVID-19) in the health educational sector, especially in the field of nursing, goes beyond a structural reorganization of courses. It implies change attitude of managers, teachers and students to reformulate educational practices (sometimes with traditional tools), with innovative practices preserving a methodology that provides to the student criticality reflection, dialogue, bonding and interaction; elements that are part of a training aimed at transformation, empowerment and not just the transmission of knowledge. In this context, the COVID-19 pandemic caused paradigm shifts perhaps not yet overcome by health science institutions , because when they perceived themselves within a reality that generated changes in the political, economic, cultural and social aspects at a global level, they had to reinvent and insert new ways of teaching in their work process; they had to discuss different educational approaches and, given the needs to readjust health teaching methods, they inserted remote technologies as essential tools to meet the real need for continuity of classes in non-face-to-face model. For many, it is a challenge, as it currently permeates a reflection on the attention of distance learning in the field of nursing and other courses in the health area. However, as it opened up to discussions about new ways of teaching mediated by innovation, it can be said that this will be one of the greatest impact of the pandemic in benefit the education: the contribution of new information and communication technologies in the teaching-learning process for training in health, as well as the reflection on distance education and its concepts, differentiating it from the concepts of remote methodology and the use of technologies. Conclusion: In nursing education, the discussion related to the use of remote technologies in the classroom has always been a point of debate. However, with the need to include these tools for the continuity of classes in the non-face-to-face model resulting from the social isolation strategy motivated by the pandemic of COVID-19, it can provide an opportunity to have a new look on the subject and perhaps there is an opportunity to expand the debate on the use of remote methodologies in health education, seeking a reflection on their interaction with the other teaching methods already implemented. ; Introdução: A pandemia do Corona vírus (COVID-19) provocou em caráter emergencial a necessidade dos gestores das faculdades e universidades de todo mundo de reinventar novas formas de prover o ensino preservando a qualidade dele. Com as novas portarias do Ministério da Educação e Saúde, houve uma abertura para que todos os cursos utilizassem de metodologias remotas para continuidade do ano letivo, surgindo novos desafios e paradigmas com essa proposta metodológica: prover para o usuário, a sensação de imersão, de estar dentro do ambiente, a partir da navegação e interação nesse meio virtual, ao mesmo tempo que o educador, respeitando os princípios educacionais e a abordagem pedagógica que acredita, não transformar esse momento em uma simples educação à distância. Objetivo: descrever o estado da arte sobre o ensino de enfermagem e os desafios do uso de tecnologias remotas em época de pandemia do Corona vírus. Método: trata-se de estudo reflexivo consubstanciado por fontes secundárias da literatura pertinente à temática, considerando artigos de periódicos nacionais e internacionais e produções recentes sobre educação, formação em saúde, tecnologias remotas, o COVId-19 e saúde pública. Resultados: evidencia-se que vivenciar os efeitos da pandemia de corona vírus (COVID-19) no setor educacional na formação em saúde, em especial no campo da enfermagem, vai além de uma reorganização estrutural dos cursos, pois implica em mudança atitudinal dos gestores, docentes e discentes para que reformulem as práticas de ensino (por vezes com ferramentas tradicionais), em práticas inovadoras preservando um ensino que propicie ao estudante a criticidade, reflexão, diálogo, vínculo e interação; elementos que fazem parte de uma formação que visa a transformação, o empoderamento e não apenas a transmissão do conhecimento. Nesse contexto, a pandemia do COVID-19 provocou mudanças de paradigmas talvez ainda não superados pelas instituições na área da saúde, pois ao se perceberem dentro de uma realidade em que gerou mudanças nos aspectos políticos, econômicos, culturais e sociais em nível mundial, estas tiveram que se reinventar e inserir no seu processo de trabalho as novas formas de ensinar; tiveram que discutir sobre as diferentes abordagens educacionais e diante das necessidades do readequar os métodos de ensino em saúde, inseriram as tecnologias remotas como ferramentas essenciais para atender a real necessidade da continuidade das aulas no formato não presencial. Para muitos um desafio, pois permeia atualmente uma reflexão sobre o cuidado do ensino à distância no campo da enfermagem e demais cursos da área da saúde. Entretanto, à medida que se abriu para discussões sobre novas formas de ensinar mediadas pela inovação, pode-se dizer que esse será o maior impacto da pandemia para o ensino: a contribuição das novas tecnologias de informação e comunicação no processo ensino aprendizagem para formação em saúde, assim como a reflexão sobre a educação à distância e seus conceitos, diferenciando-a dos conceitos de metodologia remota e o uso das tecnologias. Conclusão: No ensino da enfermagem, a discussão relacionada ao uso de tecnologias remotas em sala de aula sempre foi um ponto de debate. Entretanto, com a necessidade da inclusão dessas ferramentas para a continuidade de aulas no formato não presencial decorrente da estratégia do isolamento social motivada pela pandemia do COVID-19, pode oportunizar a se ter um novo olhar sobre o assunto e que talvez com esse momento vivido se haja oportunidade de ampliar o debate sobre uso dessas metodologias remotas no ensino em saúde, buscando uma reflexão sobre a interação destas com os demais métodos de ensino já implementados.
V uvodnem delu doktorske disertacije smo opredelili raziskovalni problem doktorske disertacije, in sicer proučevanje vpliva davčne kompleksnosti na davčno skladnost. Zapisali smo cilj, to je proučitev področja davčne skladnosti s posebnim poudarkom na stroških davčne skladnosti ter empirična preveritev lastnega modela merjenja makroekonomskih učinkov stroškov davčne skladnosti. Zastavili smo osnovno tezo doktorske disertacije, in sicer, ali zmanjšanje stroškov davčne skladnosti povzroča makroekonomske učinke ; v povezavi s tem smo zastavili deset hipotez. Uvodoma so predstavljeni še pričakovani izvirni znanstveni prispevki, uporabljene predpostavke in omejitve ter metode raziskovanja, uporabljene tako v teoretičnem kot empiričnem delu doktorske disertacije. V drugem poglavju smo zapisali teoretična izhodišča s področja davčne kompleksnosti v povezavi z davčno agresivnostjo in podali lastno opredelitev davčne kompleksnosti in davčne agresivnosti, pri čemer smo se oprli na znanstveno literaturo s tega področja. Predstavili smo vzroke in kazalnike davčne kompleksnosti ter podali izčrpen kvalitativni pregled dosedanjih raziskav o davčni kompleksnosti in davčni agresivnosti. V drugo poglavje doktorske disertacije smo vključili dve lastni empirični raziskavi, in sicer: raziskavo o spreminjanju davčnih predpisov primerjalno za Slovenijo, Avstrijo, Veliko Britanijo, Hrvaško, Bolgarijo, Madžarsko, Češko, Romunijo in Poljsko ; raziskavo cen revizijskih storitev za Slovenijo. Pomembna nova znanstvenoraziskovalna dognanja predstavljajo tudi nove spremenljivke davčne kompleksnosti, ki smo jih prepoznali za subjekte javnega interesa, katerih delnice kotirajo na organiziranem trgu. Tretje poglavje predstavljajo teoretična izhodišča s področja davčne skladnosti, kjer smo z uporabo znanstvene literature predstavili dosedanje teorije davčne skladnosti in vrste stroškov davčne skladnosti. Dodali smo lastno opredelitev davčne skladnosti. Podali smo izčrpen kvalitativen pregled raziskav davčne skladnosti ter raziskav o merjenju stroškov davčne skladnosti, ki so osnova za izvedbo naše glavne empirične raziskave. Pregled dosedanjih znanstvenih raziskav smo razdelili v tri skupine: raziskave o merjenju stroškov davčne skladnosti ; raziskave psiholoških stroškov, ki so posledica stresa in drugih dejavnikov pri doseganju davčne skladnosti ; raziskave stresa v računovodstvu. V tretje poglavje doktorske disertacije smo vključili lastno empirično raziskavo o organizacijskih in osebnostnih dejavnikih stresa ter zdravstvenih težavah v povezavi s stresom, ki jih imajo davčni zavezanci pri doseganju davčne skladnosti. V okviru istega poglavja smo predstavili makroekonomske učinke davčne (ne)skladnosti. V četrtem poglavju smo predstavili obstoječe modele merjenja stroškov davčne skladnosti in njihovo uporabno vrednost ter predstavili lasten predlog merjenja makroekonomskih učinkov stroškov davčne skladnosti. Peto poglavje predstavlja predstavitev inštrumentov za povečanje davčne skladnosti, kjer navajamo: predpise in orodja Evropske komisije za povečanje davčne skladnosti ; druge mednarodne predpise in orodja za povečanje davčne skladnosti ; sistem ocenjevanja davčnega sistema, kaznovanje davčnih prekrškov kot inštrument za povečanje davčne skladnosti, upravljanje s tveganji davčne skladnosti in ostale inštrumente za povečanje davčne skladnosti. V peto poglavje doktorske disertacije smo vključili lastno empirično raziskavo o vrednotenju zakonodaje. V okviru istega poglavja smo predstavili še značilnosti Indeksa spoštovanja pravne države, ki se v Svetu že uporablja, ter lasten koeficient spreminjanja davčnih predpisov kot novo znanstvenoraziskovalno dognanje. Teoretičnemu delu sledi v šestem poglavju empirični del, v katerem smo predstavili raziskovalno delo. Uvodoma smo v šestem poglavju predstavili cilje raziskave, hipoteze doktorske disertacije, potek raziskave in uporabljene raziskovalne metode ter opredelili temeljne konstrukte znanstvene raziskave. ; In the introductory part we defined the research problem of the doctoral dissertation, namely, the study of the impact of Tax Complexity on Tax Compliance. We have recorded the objective, namely, the study of the field of Tax Compliance, with a special emphasis on the Costs of Tax Compliance and empirical verification of our own Model For Measuring The Macroeconomic Effects Of Tax Compliance Costs. We have established the basic thesis of the doctoral dissertation, namely, whether the reduction of the Costs of Tax Compliance causes macroeconomic effects ; In this connection, we have raised ten hypotheses. The introduction of the original scientific contributions, the assumptions and limitations were used, and the methods of research are presented used in both the theoretical and the empirical parts of the doctoral dissertation. In the second Chapter, we wrote the theoretical background in the field of Tax Complexity in relation to Tax Aggression, and presented our own definition of Tax Complexity and Tax Aggressiveness, based on scientific literature in this field. We presented the causes and indicators of Tax Complexity, and provided an exhaustive qualitative overview of the previous studies on Tax Complexity and Tax Aggression. In the second chapter of the doctoral dissertation, we included two of our own empirical researches, namely: A study on changing tax regulations, comparable for Slovenia, Austria, Great Britain, Croatia, Bulgaria, Hungary, the Czech Republic, Romania and Poland ; a survey of the prices of audit services for Slovenia. Significant new scientific research findings also present new variables of Tax Complexity, which we have identified for Public Interest Entities whose shares are listed on the organized market. The third Chapter presents the theoretical background in the area of Tax Compliance, where, using scientific literature, we presented the current Tax Compliance Theory and the types of Tax Compliance Costs. We have added our own definition of Tax Compliance. We have provided a comprehensive qualitative overview of research on Tax Compliance and research on the measurement of Tax Compliance Costs, which are the basis for conducting our main empirical research. An overview of the current scientific research has been divided into three groups: Surveys on measuring the Costs of Tax Compliance ; investigation of Psychological Costs arising from Stress and other factors in achieving Tax Compliance ; stress research in accounting. In the third chapter of the doctoral dissertation, we included our own empirical research on organizational and personality factors of stress, and health problems related to the stress that taxpayers have in achieving Tax Compliance. Within the same chapter, we presented the macroeconomic effects of Tax (non)compliance. In the fourth Chapter, we presented the existing models for measuring the Costs of Tax Compliance and their useful value, and presented our own proposal for measuring the Macroeconomic Effects of Tax Compliance Costs. Chapter 5 presents a presentation of Instruments to increase Tax Compliance, stating: European Commission Regulations and Tools to increase Tax Compliance ; other international rules and tools to increase Tax Compliance ; the system of assessing the tax system, penalizing tax offenses as an instrument for increasing Tax Compliance, managing the risks of Tax Compliance and other instruments for increasing Tax Compliance. In the fifth chapter of the doctoral dissertation, we included our own empirical research on the evaluation of legislation. In the same chapter, we also presented the characteristics of the Rule of Law Index already in use in the Council, as well as our own coefficient of changing tax regulations as a new scientific and research knowledge. The theoretical part of the trace in the sixth Chapter is the empirical part, in which we presented the research work.
Apresentação Junho 2020 Nesses dias tão cheios de imprevisão, incerteza e também de agravamento das atuais crises e sanitária e política mundial e brasileira, trazemos a única notícia que podemos garantir com certeza e um pouco de alegria. Apresentamos o mais novo número da Revista Direito e Práxis (vol. 11, n. 2, 2020, 30ª edição – jun-set), como sempre, trazendo doze artigos inéditos de pesquisadoras e pesquisadores brasileiros e internacionais. Os trabalhos tratam de temas nos campos do direito e biopolítica, feminismo, marxismo, teoria do direito e constitucionalismo crítico, além de retratar debates no campo dos estudos criminológicos críticos.O dossiê desse número foi organizado pela professora Adriana Dias Vieira da Universidade Federal Fluminense, e pelo professor Roberto Efrem Filho, da Universidade Federal da Paraíba. O dossiê reflete sobre a complexa relação entre o Supremo Tribunal Federal e as políticas de gênero e sexualidade. A Revista já publicou, em outras edições, dossiês temáticos analisando o papel do STF na judicialização de conflitos urbanos e ambientais, também um dossiê marcando os 10 anos da reforma do judiciário, além de inúmeros artigos e outros dossiês focados na questão da mobilização de direitos e litígio estratégico. No que diz respeito às relações de gênero, o tema também foi trabalhado no dossiê sobre "Direito e Gênero" em 2016. O dossiê organizado nesse número retrata pioneiramente na Revista, em um conjunto de artigos selecionados rigorosamente, essa complexa interação entre a atuação do STF e suas formas de "fazer gênero", como os editores convidados apresentam em sua introdução abaixo. Nesse sentido, dá continuidade e aprofunda temas relevantes, não só para a nossa publicação, como também para nossa sociedade.Na seção de traduções, trazemos dois trabalhos inéditos, traduzidos do inglês para o português. O artigo foi traduzido pelas professoras da Universidade de Brasília, Alessandra Ramos de Oliveira Harden e Fernanda de Deus Garcia, membros do Departamento de Línguas Estrangeiras e Tradução dessa universidade.Além disso, contamos com duas resenhas. Equipo Direito e Práxis***EditorialJune 2020In face of such uncertain and unpredictable times, with the worsening of political and sanitary crises in Brazil and around the globe, we are glad at least to be able to present now the newest issue of Direito e Práxis Journal (Vol. 11 – N. 2, 30ª edition, 2020, Jun-Sep) containing, as always, twelve brand new articles from renowned Brazilian and international researchers. This issue addresses topics from various fields passing by law and biopolitics, feminism, Marxism, legal theory, constitutionalism, as well as a couple of reviews of debates on critical criminology.The dossier in this issue was set up by professors Adriana Dias Vieira and Roberto Efrem Filho from the Universidade Federal Fluminense and Universidade Federal da Paraiba, respectively. The dossier's themes ponder over the complex relationship between the Supreme Federal Court and policy issues on sexuality and gender. Previously, other publications on our Journal have focused on the role of the Supreme Court addressing environmental and urban land disputes, the celebration of the 10th year of judiciary reform in Brazil, and several articles dealing with legal mobilization and strategic litigation. In the context of gender and sexuality, the theme has already been elaborated in the "Law and Gender" dossier in 2016. This time, the selected new articles have been arranged and compiled, in order to discuss complex interactions between the role of the Supreme Court and the multiples forms of "doing gender", as the guest editors presented in their introduction below.This edition presents two translated articles, from English to Portuguese. First, an article by Peter Hudis, researcher from Oakton Community College (Illinois - USA), titled "Racism and the Logic of Capital: A Fanonian Reconsideration" ("O Racismo e a Lógica do Capital: Uma Reconstrução Fanoniana"). The translation was done by the PhD student Rhaysa Ruas, from PPGD/UERJ (Rio de Janeiro/Brazil). The second article is titled "The Woman of Legal Discourse" ("A Mulher no Discurso Jurídico") and was translated by the professors Alessandra Ramos de Oliveira Harden and Fernanda de Deus Garcia, members of the Department of Foreign Languages and Translation from the University of Brasília.Finally, this issue also counts with two reviews. BEFORE THE SCIENCE, TECHNOLOGY AND INNOVATION POLICY In clarity that the policy of science, technology and innovation is, on the one hand, one of the main guidelines developed by the national government for the 2014-2018 period, and on the other hand, part of the strategy of Strategic Competitiveness and Infrastructure for the period 2016-2025, to which is added the Colombian historical experience of being in the frame of action of post Agreements of Havana, the Criteria Libre Jurídico Magazine is compelled to join the efforts from the framework of academic and investigative action of the Faculty of Right of Universidad Libre Seccional Cali to contribute to the visibility of research results as a missionary principle that responds to the demands of the country's bets in order to respond to the specific challenges of the territories in cooperation with the agents of the national system of innovation. Although to achieve high rates of visibility, the editorial policy of the Free Criteria journal should be rigorous in following the guidelines required by Publíndex, it finds, beyond the reach of measurement indicators, an opportunity to be decidedly a contribution to the dissemination of results of inquiries carried out by national and international researchers. Several steps have already been taken from the route to follow, and this is what the authors identify who have seen in our editorial the propitious setting for their publications. What remains to be removed brings great challenges. Every time that the universities turn their eyes towards the policy of Colombian CTeI, they try to attend it with the rigor that their budgetary possibilities allow them, which means to tend for a pertinent bet of the investigation in the regions, at the same time as the actions advanced by the Teachers researchers also join the path of institutional accreditation, certification and recertification of programs. The policy of CTeI is transversal to the requirements for the academic offer and the recognition of quality in the accreditation; both the one and the other, has among its indicators the publications. Being the Criterio Libre Jurídico Magazine a scientific publication scenario in the areas of Law, Political and Social Sciences, it has its virtual publication in the Open Journal System -OJS software, under the guidelines of Publindex, adding to this the open visibility of inquiries of the researchers and what that implies in an opportunity for their indicators as a researcher and author of publications, as well as the strengthening of the institutions to which the researchers are formally linked. The challenge is to position the editorial rigor of the Criterio Libre Jurídico Magazine visible in the National Service of Indexing of Serial Specialized Publications of Science, Technology and Innovation - Publindex, thereby irradiating the academic communities that have decided to publish with us. We are all then called to know the one and multiple ways of reading the world from the perspective of law, political and social sciences, as research results, adding to this reflection exercises for future new publications. Si bien para lograr altos índices de visibilización, la política editorial de la revista Criterio Libre Jurídico debe ser rigurosa en seguir los lineamientos exigidos por Publíndex, encuentra, allende al alcance de indicadores de medición, una oportunidad para ser decididamente un aporte a la difusión de resultados de indagaciones que adelantan los investigadores nacionales e internacionales. De la ruta por seguir se han dado ya varios pasos, y así lo identifican los autores que han visto en nuestra editorial el escenario propicio para sus publicaciones. Lo que queda por trasegar trae consigo grandes retos. Every time that the universities turn their eyes towards the policy of Colombian CTeI, they try to attend it with the rigor that their budgetary possibilities allow them, which means to tend for a pertinent bet of the investigation in the regions, at the same time as the actions advanced by the Teachers researchers also join the path of institutional accreditation, certification and recertification of programs. The policy of CTeI is transversal to the requirements for the academic offer and the recognition of quality in the accreditation; both the one and the other, has among its indicators the publications. Being the Criterio Libre Jurídico Magazine a scientific publication scenario in the areas of Law, Political and Social Sciences, it has its virtual publication in the Open Journal System -OJS software, under the guidelines of Publindex, adding to this the open visibility of inquiries of the researchers and what that implies in an opportunity for their indicators as a researcher and author of publications, as well as the strengthening of the institutions to which the researchers are formally linked. The challenge is to position the editorial rigor of the Criterio Libre Jurídico Magazine visible in the National Service of Indexing of Serial Specialized Publications of Science, Technology and Innovation - Publindex, thereby irradiating the academic communities that have decided to publish with us. We are all then called to know the one and multiple ways of reading the world from the perspective of law, political and social sciences, as research results, adding to this reflection exercises for future new publications. JOSÉ HOOVER SALAZAR RÍOS Faculty of Law, Political and Social Sciences Universidad Libre Seccional Cali ; ANTE LA POLÍTICA DE CIENCIA, TECNOLOGÍA E INNOVACIÓN En claridad que la política de ciencia, tecnología e innovación es, por un lado, uno de los principales lineamientos que desarrolla el Gobierno nacional para la vigencia 2014-2018, y por otro, parte de la estrategia de Competitividad e Infraestructura Estratégicas para el periodo 2016-2025, a lo que se suma la experiencia histórica colombiana de encontrarse en marco de actuación de pos Acuerdos de la Habana, la Revista Criterio Libre Jurídico se ve compelida a aunar los esfuerzos desde el marco de actuación académico e investigativo de la Facultad de Derecho de la Universidad Libre Seccional Cali que coadyuven a la visibilización de resultados de investigación como principio misional que responde a las exigencias de las apuestas de país en pro de dar respuesta a los retos específicos de los territorios en cooperación con los agentes del sistema nacional de innovación. Si bien para lograr altos índices de visibilización, la política editorial de la revista Criterio Libre Jurídico debe ser rigurosa en seguir los lineamientos exigidos por Publíndex, encuentra, allende al alcance de indicadores de medición, una oportunidad para ser decididamente un aporte a la difusión de resultados de indagaciones que adelantan los investigadores nacionales e internacionales. De la ruta por seguir se han dado ya varios pasos, y así lo identifican los autores que han visto en nuestra editorial el escenario propicio para sus publicaciones. Lo que queda por trasegar trae consigo grandes retos. Cada que las universidades viran la mirada hacia la política de CTeI colombiana, intentan atenderla con el rigor que su posibilidad presupuestal les permite, lo que implica propender por una apuesta pertinente de la investigación en las regiones, a la vez que las acciones adelantadas por los docentes investigadores sumen igualmente a la ruta de acreditación institucional, la certificación y recertificación de programas. La política de CTeI es transversal a las exigencias para la oferta académica y el reconocimiento de calidad en la acreditación; tanto lo uno como lo otro, tiene entre sus indicadores las publicaciones. Siendo la Revista Criterio Libre Jurídico un escenario de publicación científica en las áreas del Derecho, Ciencias Políticas y Sociales, dispone su publicación virtual en el software Open Journal System –OJS, bajo los lineamientos de Publindex, sumando con ello tanto a la visibilización abierta de indagaciones de los investigadores y lo que ello implica en oportunidad para sus indicadores como investigador y autor de publicaciones, como al fortalecimiento de las instituciones a los que los investigadores se encuentran formalmente vinculados. El reto, lograr posicionar el rigor editorial de la Revista Criterio Libre Jurídico visible en el Servicio Nacional de Indexación de Publicaciones Especializadas Seriadas de Ciencia, Tecnología e Innovación – Publindex, irradiando con ello a las comunidades académicas que han decidido publicar con nosotros. Somos todos convocados entonces a conocer las una y múltiples formas de leer el mundo desde la perspectiva del derecho, las ciencias políticas y sociales, en tanto resultados de investigación, sumando con ello a ejercicios de reflexión para futuras nuevas publicaciones. A Revista Criterio Livre Jurídico é obrigada a unir os esforços do quadro de ação acadêmica e de investigação da Faculdade de Direito da Universidade Livre Seccional Cali para contribuir para a visibilidade dos resultados da pesquisa como um princípio missionário que responda às demandas das apostas do país para responder aos desafios específicos dos territórios em cooperação com os agentes do sistema nacional de inovação. Embora para alcançar altas taxas de visibilidade, a política editorial da revista Criterio livre Jurídico deve ser rigorosa ao seguir as diretrizes exigidas pelo Publíndex, descobre, além do alcance dos indicadores de medição, uma oportunidade para ser decididamente uma contribuição para a difução de resultados de inquéritos realizados por pesquisadores nacionais e internacionais. Várias etapas já foram tiradas da rota a seguir, é isso o que identifaca os autores que têm visto em nosso editorial o cenário propício para suas publicações. O que resta para se-transferir traz grandes desafios. Toda vez que as universidades voltam os olhos para a política da CTeI colombiana, elas tentam atendê-la com o rigor que suas possibilidades orçamentais lhes permitem, o que significa tender para uma aposta pertinente da investigação nas regiões, ao mesmo tempo que as ações avançadas pelos professores pesquisadores também se juntam ao caminho da acreditação institucional, certificação e recertificação de programas. Sabemos que el fútbol es el deporte más practicado en todo el mundo y también el más seguido, por eso es uno de los deportes con más potencial de influencia en la sociedad y el entrenador es su figura más influyente por la acción de liderazgo que promueve junto a los demás, que lo rodean, sobre todo si hablamos de niños y jóvenes. Es el entrenador que puede mantener la práctica del fútbol del lado positivo, donde se pretende que esté y donde debe permanecer, en el fomento de los valores educativos y en el aprendizaje armonioso de la modalidad. Dada la importancia que tiene esta figura en el deporte en general y en el fútbol en particular, es determinante que su formación sea un punto fundamental de sus cualidades, ya que de ella pueden emanar muchas otras competencias, capaces de influir al joven futbolista de forma favorable en todas sus dimensiones. De esta forma, se hace preponderante el estudio sobre la formación del entrenador de fútbol, que todos los días es una pieza importante en el entrenamiento de nuestros jóvenes, no sólo en el capítulo deportivo, sino también en el capítulo social. Comenzamos nuestro trabajo buscando realizar la fundamentación teórica del tema. En una primera parte iniciamos un marco global haciendo referencia a la legislación reciente que rige la figura del entrenador y su formación, revisamos todos los documentos internacionales y nacionales sobre la formación de entrenadores y sus competencias recogiendo la información pertinente. En una segunda parte, más específica, fuimos gradualmente entrando en las características que debe tener el entrenador, en las concepciones de enseñanza y en las necesidades de formación de entre otros aspectos desarrollados. Uno de los grandes objetivos de esta investigación fue el desarrollo de una herramienta válida y fiable para el estudio de la formación de entrenadores que posibilitase su posterior aplicación en Portugal y para permitir la replicación del estudio en diferentes contextos. Para ello construimos un cuestionario que partió del estudio de Abad (2009) y sometemos esa herramienta a un proceso de validación con el objetivo de analizar la formación de los entrenadores de fútbol de base en los clubes de la Asociación de Fútbol de Beja. Hemos diseñado un cuestionario que al final del proceso de validación quedó con 121 ítems agrupados en 8 dimensiones (Características Sociodemográficas, Experiencia Deportiva, Aspectos Personales, Formación como Entrenador, Formación Continua, Concepción de Enseñanza, Planificación y Programación, Necesidades de Formación). Hemos realizado un análisis cualitativo y cuantitativo que se realizó a través de la evaluación de 12 expertos. La validez del contenido fue analizada a través del coeficiente V de Aiken, estableciendo un intervalo de confianza del 99% y el coeficiente de variación. Para establecer la fiabilidad, el cuestionario fue aplicado a 20 entrenadores de cuatro clubes diferentes de la región en dos momentos diferentes, la consistencia interna fue analizada por el método Alpha de Cronbach (0.915) y la fiabilidad test-reteste usando el coeficiente de correlación intraclase resultando 0.890 (p <0.01). Los resultados muestran que el cuestionario reúne suficientes propiedades psicométricas para ser considerado una herramienta válida y fiable para estudiar y analizar las necesidades de formación de los entrenadores de fútbol (Paixão, Abad & Giménez, 2019). En un segundo momento, los cuestionarios construidos fueron aplicados a 124 entrenadores de la región de Beja que estaban trabajando con niños y jóvenes en el fútbol de formación. Esta muestra representó el 91% del total de la población de estudio y a través de un análisis descriptivo e inferencial permitió analizar el perfil del entrenador, su formación y su intervención en los diversos dominios y parámetros. Destacamos algunos resultados como, el hecho de que la mayoría de los entrenadores aún no tienen siquiera el título de entrenador y sólo una minoría tienen una formación superior en el área del deporte; por otro lado, el gusto en entrenar y enseñar es el motivo por el cual los entrenadores están en el fútbol de formación, en lo que se refiere a las estrategias de formación continua: la creación de grupos de trabajo entre entrenadores, la visualización y análisis de juegos y entrenamientos en vídeo, y la participación en talleres prácticos, son las preferenciales; destacamos también que persiste una división entre los métodos directivos y los métodos de descubrimiento, entre otros resultados interesantes. Concluimos con la concreción de los objetivos generales y específicos, la presentación de las implicaciones del estudio, añadimos algunas propuestas de mejora, exponemos las limitaciones del estudio y por último indicamos las perspectivas futuras. ; Sabemos que o futebol é o desporto mais praticado em todo o mundo e também o mais seguido, por isso é um dos desportos com mais potencial de influência na sociedade e o treinador é a sua figura mais influente pela ação de liderança que promove junto dos que o rodeiam, principalmente se estivermos a falar de crianças e jovens. É o treinador que pode manter a prática do futebol do lado positivo, onde se pretende que esteja e aonde deve permanecer, no fomento dos valores educativos e na aprendizagem harmoniosa da modalidade. Dada a importância que detém esta figura no desporto em geral e no futebol em particular, é determinante que a sua formação seja um ponto fundamental das suas qualidades, até porque dela podem emanar muitas outras competências, capazes de influenciar o jovem futebolista de forma favorável em todas as suas dimensões. Desta forma, torna-se preponderante o estudo sobre a formação do treinador de futebol, que todos os dias é uma peça importante no treino dos nossos jovens, não só no capítulo desportivo mas também no capítulo social. Destacamos alguns resultados como, o facto da maioria dos treinadores ainda não ter sequer o título de treinador e só uma minoria detém formação superior na área do desporto; por outro lado, o gosto em treinar e ensinar é o motivo pelo qual os treinadores estão no futebol de formação; no que diz respeito à formação contínua as estratégias preferenciais são: a criação de grupos de trabalho entre treinadores, a visualização e análise de jogos e treinos em vídeo, e a participação em workshops práticos; destacamos também que persiste uma divisão entre os métodos diretivos e os métodos de descoberta, entre outros resultados interessantes. Concluímos com a concretização dos objetivos gerais e específicos, a apresentação das implicações do estudo, aduzimos algumas propostas de melhoria, expomos as limitações do estudo e por último indicamos as perspetivas futuras. ; We know that football is the most practiced sport in the whole world and it is also the most followed. So, it is one of the sports with more potential to influence society and the coach is its most influential person by the leadership action that he promotes near those surrounding him, especially if we are talking about children and young people. The coach is the one who can maintain the practice of football on the positive side, where it is intended to be and where it should remain, to foster educational values and to learn the sport in a harmonious way. Considering the importance of this figure in sports in general and in football in particular, it is essential for training to be a fundamental aspect of his qualities, namely because many other skills can emanate from this training, skills which may influence the young player in a favourable way in all its dimensions. Thus, the study on the football coach's training, which usually plays an important part on our young people's training, is not only important in the sports chapter but also in the social chapter. We have started our work by looking at the theoretical basis of the theme. In the first part, we started with a global framework concerning the recent legislation governing the coach and his training, we reviewed all the international and national documents on the training of coaches and their skills, collecting the relevant information. In a second, more specific part, we gradually approached the characteristics that a coach must have, in terms of the concepts of education and training needs among other aspects developed. One of the main objectives of this research was the development of a valid and reliable tool for the study of coach's training, which might allow its subsequent application in Portugal and that might allow for the replication of the study in different contexts. For that purpose, we have created a questionnaire that started from the study by Abad (2009) and we have submitted this tool to a validation process with the aim of analysing the training of base football coaches in the clubs of the Beja Football Association. We have designed a questionnaire that, at the end of the validation process, included 121 items grouped in 8 dimensions (Sociodemographic Characteristics, Sport Experience, Personal Aspects, Training as a Coach, Continuous Training, Teaching Conception, Planning and Programming, Training Needs). We have carried out a qualitative and quantitative analysis that was performed through the evaluation of 12 specialists. The validity of the content was analysed through the Aiken V coefficient, establishing a 99% confidence interval and the coefficient of variation. To establish reliability, the questionnaire was applied to 20 coaches from four different clubs in the region in two different times, the internal consistency was analysed by Cronbach's Alpha method (0.915) and the test-retest reliability using the intra-class correlation coefficient resulting in 0.890 (p <0.01). The results show that the questionnaire gathers enough psychometric properties to be considered a valid and reliable tool to study and analyse the training needs of football coaches (Paixão, Abad & Giménez, 2019). In a second moment, the questionnaires created were applied to 124 coaches from the region of Beja, who were working with children and youth in football training. This sample represented 91% of the total study population and, through a descriptive and inferential analysis, it allowed us to analyse the profile of the coach, his training and his intervention in the different domains and parameters. We highlight some results, such as the fact that most coaches still do not even have the title of coach and that only a minority holds a higher education in the field of sports; on the other hand, the pleasure involved in training and teaching is the reason why coaches are in football training; as far as continuous training is concerned, the preferred strategies are: the creation of working groups between coaches, the visualization and analysis of games and video training, and the participation in practical workshops; we also emphasize that there is still a division between the directive methods and the discovery methods, among other interesting results. We conclude with the achievement of the general and specific aims, the presentation of the implications of the study, we present some improvement proposals, we show the limitations of the study and, finally, we indicate perspectives for the future.
