This study considers the political aspects of the Joko Widodo government's megaproject to build an integrated marine logistic system known as the tol laut. Expanding the existing literature which gives details about the contextual obstacles faced by and the prospects for the Indonesian government to pursue its infrastructure ambitions, the study argues that notwithstanding the relevance of the tol laut for advancing the Indonesian economy, it is inevitably entangled with dynamic internal and external environments which can unfavourably distort the construction processes. This is the way of understanding the political economy of Indonesia's development issues which allows for the juxtaposition of domestic political and international relations factors as its framework of analysis. The discussion is divided into four sections. Section one explains the conceptual and methodological foundation of the study. Section two outlines the importance of the tol laut to Indonesian national economic development. Section three looks at how the current domestic political settings pose structural hurdles to Widodo's tol laut, and section four observes the effect of international relations of powerful regional actors and Jakarta's diplomatic capacity to the on-going tol laut. The concluding section summarizes the findings of the study.
Realism has been the dominant conceptual approach to studying Indonesian foreign policy. This article, however, considers realist analyses to be insucient since their emphasis on the struggle for power and security in the system of states has led to the neglect of the importance of perspectives which focus on order. To ll the gap it then intends to apply the English School perspective which focuses on the concept of international society to trace the nature and function of Indonesian foreign policy. Two cases are examined, including the Asian African Conference and Association of South East Asian Nations, to demonstrate the relevance of international society for policy ideas and action. The central argument is that the Indonesian elite worldview indicates that the creation and maintenance of order in international societies are ones which are prominent objectives legitimizing the conduct of Indonesia's external relations.
Dinamis komitmen Masyarakat Internasional dalam isu kontrol atas pemanasan global telah dikembangkan sejak tahun 1919 sampai sekarang. Dari daftar perjanjian - perjanjian internasional yang ada, dapat dilihat seberapa kuat komitmen komunitas global dalam isu-isu lingkungan, pemanasan global serta perubahan iklim. Sayangnya, dapat disimpulkan, bahwa perjanjian-perjanjian internasional begitu terfragmentasi dan oleh karena itu, sulit untuk dilaksanakan membandingkan dengan instrumen hukum lingkungan internasional pada umumnya. Namun, kemauan politik dari negara nasional adalah inti untuk membuat agenda internasional. Hal ini dikarenakan niat yang baik dari suatu pemerintahan dapat membawa hal yang baik bagi negara maupun rakyatnya, khususnya lagi dalam pengendalian global warming.Sehingga dalam hal ini negara juga mempunyai peranan dalam mewujudkan kelestarian lingkungan bagi rakyatnya, hal ini juga secara tidak langsung merupakan bagian dari kewajiban negara untuk menjaga stabilitas dan kelangsungan hidup rakyat dan kelestarian sumber daya alam yang di kandung negara tersebut, demi kesejahteraan dan kemakmuran seluruh rakyat.

Ravnanje organizacije se ravno tako ne veže samo na delovanje v lokalnem okolju temveč zaradi globalnih razsežnosti učinkuje tudi v mednarodnih dimenzijah. S temo konference želimo odpreti polje vprašanj in poiskati odgovore, ki bodo doprinesli k napredku organizacijskih ved. Each year, the conference brings together students, researchers, businessmen and public administration representatives, who are active in the area of organization and management. The theme of this year's 36th international conference on Organizational Sciences Development is Responsible Organization referring to the wideness of an organization in its internal and external environment. The responsibility of the organization towards its employees, mission, strategy, processes, technology, and development are just a few areas in which the organization needs to follow the principles of responsibility. The identity of the organization is recognized through its versatile responsible activities, showing its value externally to the customers or recipients of the services offered by the organization. The concurrent mixture of technological and social progress influences individuals as well as the society. The impact of the organization is therefore not only local but global, making a mark on the international level. With this conference theme, we are opening new questions and seeking answers which could contribute to the progress of organizational sciences. Material influence, communications, knowledge, fairness, and nevertheless the ideal of responsible behaviour can be seen as influential factors which can contribute to occasional turbulent situations inside and outside our organizations. POVZETEK MEDNARODNI KAZENSKI PREGON IN ČLOVEKOVE PRAVICE TUJIH TERORISTIČNIH BORCEV Avtor: Rok Petročnik Mentorica: izr. prof. dr. Vasilka Sancin V magistrski nalogi sem raziskoval nastanek fenomena tujega terorističnega borca, njihov mednarodni kazenski pregon in kršitve njihovih temeljnih človekovih pravic v domačih kazenskih pregonih. Varnostni svet OZN je leta 2014 na podlagi VII. poglavja Ustanovne listine OZN sprejel Resolucijo 2178, ki podaja opis tujega terorističnega borca, vendar ne loči med oboroženimi spopadi in terorizmom. Resolucija 2178 opisuje tujega terorističnega borca kot posameznika, ki potuje v tujino z namenom izvedbe ali sodelovanja v terorističnem napadu, medtem ko je tuji borec posameznik, ki odpotuje v tujino z namenom pridružitve oboroženim spopadom. V raziskavi sem prišel do sklepa, da trenutno ne obstaja mednarodni kazenski pregon tujih terorističnih borcev, saj pregon izvajajo države same pred nacionalnimi sodišči. Varnostni svet OZN je pregon tujih terorističnih borcev preložil na države članice OZN, in sicer z vzpostavitvijo različnih odborov za nadzor izvajanja sankcij Varnostnega Sveta, kot so Sankcijski odbor 1267 in Skupina za analitično podporo in nadzor sankcij. V primerih Nada, Ahmed in Abdelrazik so nacionalna sodišča zaradi kršitev temeljnih človekovih pravic s sodbami razveljavila državne upravne akte, ki so vpeljevali sprejete protiteroristične resolucije Varnostnega sveta. Podobno je naredilo sodišče EU v primeru Kadi, kjer je bila razveljavljena uredba, ki je vpeljala sankcije Varnostnega sveta. Sodbe nacionalnih in sodišč v EU so bile glavni dejavnik za spremembo mednarodnopravnega okvirja terorizma OZN in za posledično večji poudarek na spoštovanju temeljnih pravic, ki jih zagotavlja Evropska konvencija o človekovih pravicah. ; ABSTRACT INTERNATIONAL PROSECUTION AND HUMAN RIGHTS OF FOREIGN TERRORIST FIGHTERS Author: Rok Petročnik Mentor: Vasilka Sancin, PhD, Professor In master's thesis i explored the emergence of the foreign terrorist fighter phenomenona, international prosecution of foreign terrorist fighters, and the violation of the fundamental rights of foreign terrorist fighters in domestic prosecutions. UN Security Council in 2014 adopted Resolution 2178 under Chapter VII of the UN Charter. However, while the Resolution outlines the description of a foreign terrorist fighter, it fails to distinguish between armed conflicts and terrorism. Resolution 2178 defines foreign terrorist fighters as individuals who travel to a state other than their states of residence or nationality for the purpose of the perpetration, planning, or preparation of, or participation in, terrorist acts or the providing or receiving of terrorist training, including in connection with armed conflict, while foreign fighter is an individual who travels abroad with intention to join armed conflict. The research led to the conclusion that there is currently no international prosecution of foreign terrorist fighters because states carry it out before national courts. UN Security Council has placed the burden of prosecuting foreign terrorist fighters on UN Member States by establishing different committees monitoring the implementation of the Security Council sanctions, such as the 1267 Committee and the Analytical Support and Sanctions Monitoring Team. In the cases of Nada, Ahmed and Abdelrazik, national courts due to violations of fundamental rights, repealed national administrative acts that introduced the adopted UN Security Council counter terrorism resolutions. The Court of Justice of the EU made a similar decision in the case of Kadi by repealing the regulation introducing the UN Security Council sanctions. Judgements of national and EU courts were the main factor in changing the UN terrorism framework in terms of international law, thus shifting the focus on the respect of fundamental rights as guaranteed by the European Convention on Human Rights.
The existence of ASEAN trully did not comes apart from concerns about the South East Asian Nations which has conflicted, for example like the confrontation between Indonesia and Malaysia, territorial demand between Phillipine and Malaysia on Sabah, also the separation of Singapore from the Malaysian Federation. From those backgrounds, the South East Asian Nations especially Indonesia and Malaysia which recently conflicted, realizes the needs to form a cooperation to reduce tension, to construct confidence building and pushing regional cooperation growth which felt have no progress after each nations receive its independence. 8 August 1967 is the first ASEAN formation spearheaded by five Ministers of Foreign Affair from Indonesia, Phillipine, Malaysia, Singapore and Thailand, which resulted in the signation of ASEAN Declaration or known as The Bangkok Declaration and it also means ASEAN is formally created. One of the ASEAN's aim is "to accelerate economic growth, social progress and cultural growth in South East Asia Nations." Nevertheless, in actualizing ASEAN's growth it is not as easy as turning the palm of a hand, various national interest affected ASEAN's policy. Resulted to outdraw the main aim that have been agreed by the Nations, informal or formal conflict always happened in the middle of goverments effort in reducing conflict. For example, the arrest of KPLP Indonesian Officer by the Malaysian Royal Police, the accusation of Thailand to Malaysia in helping separatism of South Thailand, the dispute of Angkor Temple between Cambodia and Vietnam constituted on how the implementation of ASEAN's agreements are hard to happened. Although, the interesting parts are eventhough conflicts still exist between each Nations but open war which can cause many victims never happens. One of the secret why ASEAN Nations stays solid is the tolerance and togetherness underlied the brotherhood of South East Asia Nations. Which nowadays had been used as a strong reason to build trush building between each member for the advancement of ASEAN nations in the future. Therefore, it is important to look at opportunities, challenges, and prospects for the development of International Relations studies in Indonesia to date. ; This paper would like to analyze the development of study of International Relations in Indonesia which has progressed very rapidly. United Nations as international organization issued an international convention to eliminate discrimination towards women, called CEDAW (Convention on Elimination of All Form of Discrimination Against Women). As the one of the nation that ratified the convention, Indonesia, adopted CEDAW articles that becomes UU RI No. 7 Tahun 1984. Indonesia agreed to prevent further discrimination towards women and implement all the policies written on those article. Unfortunately, the success and implementation of CEDAW is still doubtful, especially in political realm. The number of women political participation never reached 30% according to the affirmative action that is stated in Indonesian Constitution. The 2009 and 2014 general election showed that women's representation in parliament in still low and not having significant change. The success of CEDAW can be seen from women's political participation, measured by international indicator called GEM (Gender Empowerment Measure). GEM is used to measure shift and effectiveness of the implementation of CEDAW Convention in Indonesia, especially in political participation. This article concluded that CEDAW International Convention in political participation is not effective yet, considering the number of women in parliament not balanced with ratio of women citizen in Indonesia.
After the Soviet break-up and the Marxist regime collapsed, many of alternative notions emerged in the academic community in Russia, including alternative ideas in the field of International Relations (IR). A number of Russian IR scholars attempted to reconstruct the theories of IR, not just the IR theories that developed in Russia during the era of Marxism, but also against Western IR theories. Although the post-Cold War aspirations to create a distinct national school of International Relations in Russia, but these efforts are not free from the ideology and political goal that directing and guiding Russian foreign policy. Even, IR scholars in Russia have come to shared with the Russian government in terms of building the IR theories with the Russian characteristics, especially in challenging Western hegemony in the social sciences and international relations. This article tries to elaborate three intellectual traditions of international relations that developed in Russia, namely Westernism, Statism, and Civilizationism. Westernizer IR heavily influenced by Western liberalism, Statism more inspired by the realism, while Civilizationism is more of a hybrid between the constructivism and Russian essentialism.
The presence of foreign firms in a region can create spillovers to other firms, both within the intra-industries (industries itself) and inter-industries (other industries). Spillover from foreign firms can be in the form of technology transfer, efficiency improvement, managerial knowledge which ultimately is expected to increase productivity for other firms not only in large enterprises but also for micro small and medium enterprises (MSMEs). Hence, this paper aims to identify the potential backward spillover of foreign firms to MSMEs in East Java and the individual results show that the four highest backward spillovers values of foreign industries are industry of components and spare parts of the prime mover motor, industry of agricultural and forestry machinery and services for supporting, maintenance and repair, industry of pump and compressor and industry of measurement tools, manual regulator and testing. All of them are respectively located in Surabaya City, Pasuruan District, Pasuruan District and Mojekerto District. Furthermore, the general results show that the potential backward spillover exists in rubber, rubber goods and plastic goods industries as well as chemicals and goods from chemical material industries. The foreign firms which have highest backward spillovers are located in Pasuruan District, Mojekerto District, Sidoarjo District, Surabaya City and Gresik District. Therefore, the provincial government of East Java should immediately prepare and support both technically and financially to MSMEs in providing raw materials required by foreign firms based on the industrial classification and location results of this study. In addition, the provincial government of East Java can coordinate with the district governments in the areas of those foreign firms for preparing MSMEs in supplying raw materials.
There are two functions of the state liability principle. The first is to secure individual rights (including economic rights) from a wrongful act conducted by a government, and the second is to compensate for damage caused by the infringement of individual right. Economic right is inherently allowing an individual to pursue economic interest both domestically or globally. In order to accommodate this right, a government is obliged to provide trade rules and mechanisms for every individual to conduct their global economic activities by participating in the WTO. The objective of the WTO significantly corresponds to the individual's right in order to obtain trade benefits. Hence, when a government infringes trade rules and mechanisms underlined in WTO Law, it will directly restrict individuals from gaining trade benefits under the WTO or, moreover, it will restrain individuals from enjoying their inviolable economic rights. When the right is violated, and the damage occurs, it thus leads to the obligation for the government to compensate the damage according to the state liability principle. This article discusses the nexus between the state liability principle and WTO Law, in order to encourage national courts to exercise the function of state liability by referring to the infringement of economic rights caused by the violation of WTO Law.
AbstractThis article argues that MIKTA (Mexico, Indonesia, South Korea, Turkey, and Australia) are middle, regional, and constructive powers that can serve as providers of global governance in the international system. It argues that in order for MIKTA countries to serve as middle, regional, and constructive powers, they need to consolidate the support of all relevant State and non-State actors in their countries, allowing MIKTA to become a relevant mechanism to promote and generate public goods in the international system, specially global governance. Mexico is the second largest economy in Latin America. Mexico is today an actor with global responsibility and obligatory reference. A country with that weight must play in new boards and MIKTA, constituting and innovative alliance with key non-traditional partners, is a strategic space to expand the scope of Mexican foreign policy.
