This current article aims at providing some concepts and details around the social policies which are developed in Colombia, in the middle of a dynamic of a conflict and in order to deal with it, and specifically to that dynamic relating to the Agency of the Social Action of the Presidency. In the country, two tendencies or methodologies can be seen. These two tendencies are fighting for space in order to face this conflicting socio-political and military reality; one is understood as a negotiation process with a political dynamic, and the other is perceived as a clearly military dynamic with a social component of recovery of territory and social control. In this document, it is expected to highlight the role played by the Agency of the Social Action of the Presidency, which is framed within this second view, dealing with the social topic, but from the frame of a military strategy of territorial control.
Difference in the experiences of social struggle, in our country & throughout Latin America & the world, urgently need explication or, as we would say, articulation. However, we are aware that there are dangers in articulating too simple & unifying an account of the great diversity of identities & experiences that characterize current social struggles. We begin by specifying some of our dissatisfactions & disagreements with certain ways of approaching - or avoiding - the problems of articulation & hegemony. We identify those authors who we consider to be central to this subject, & explore their work. We then reflect on our conversations with people who took part in the processes of social mobilization which occurred in Argentina from December, 2001 onwards.
Las Sentencias dictadas por el Tribunal de Primera Instancia en los asuntos Kadi, Yusuf y Chafiq Ayadi resuelven los recursos de anulación interpuestos contra las acciones emprendidas por la UE para dar ejecución a las resoluciones aprobadas por el Consejo de Seguridad de las Naciones Unidas, en la lucha contra el terrorismo. Consideraban los recurrentes, entre otras cosas, que estas normas y acciones vulneraban sus derechos fundamentales.
El examen de estas Sentencias permite advertir que el TPI realiza en uso poco preciso de la noción de ius cogens internacional, poniendo en evidencia las dificultades de los tribunales «constitucionales» cuando, para garantizar el respeto de los derechos fundamentales, recurren a textos también «constitucionales» ajenos al ordenamiento jurídico en cuyo marco ejercen jurisdicción. The judgments on Kadi, Yusuf and Chafiq Ayadi cases delivered by the Court of First Instance solved the annulment actions lodged against EU acts for the implementation of the Resolutions enacted the United Nations¿ Security Council in the fight against terrorism. The applicantss did consider, among other reasons, that these rules and acts infringed their fundamental rights. The analysis of these judgments enable us to notize that the Court of First
Instance makes a not very precise use of the international Ius cogens term showing up the difficulties Constitutional Courts come accross when with the purpose of protecting fundamental rights they turn to constitutional texts alien to their own legal orders.
El Convenio Marco para la protección de las Minorías Nacionales constituye en la
actualidad el único instrumento jurídico internacional específicamente dedicado a la regulación
de los derechos de las minorías nacionales de todo tipo. Su aplicación por los Estados parte es
liderada por un Comité Consultivo de expertos independientes. Los resultados de los dos ciclos
de control completados hasta la fecha para el caso de España han puesto de manifiesto la
muy limitada aplicación que se viene haciendo de este instrumento. En este artículo pretendemos
analizar las posibilidades de extensión del ámbito personal de aplicación del Convenio en
el caso del Estado español, usando para ello como instrumento principal las opiniones vertidas
por el propio Comité Consultivo respecto a otros países europeos que presentan realidades minoritarias

beste herrialde batzuei buruz esandakoak erabilita. The Framework Convention to the Protection of National Minorities is nowadays
the only international legal instrument specifically devoted to the regulation of the rights of
any national minoritiy. Its application by the Member States is leaded by a Consultive Committee
of independent experts. The results for Spain of the up to now two cicles of monitoring
show the very limited application of this legal instrument. In this article we try to analyze the
possibilities for the extension of the personal scope of the application of the Convention in the
case of Spain, using as main instrument the opinions delivered by the same Consultive Committee
relating to other European countries which have similar minority realities.
El presente estudio se centra en el examen de la conocida cuestión de las reiteradas condenas a España como consecuencia del derecho a la doble audiencia del condenado penalmente reconocido en el artículo 14.5 PIDCP. Estudio que se realiza desde la perspectiva del actual pluralismo constitucional y con ello de las fórmulas de resolución de conflictos en este nuevo marco. En concreto se estudia si el diálogo y la síntesis jurisdiccional pueden ofrecer una solución satisfactoria a la cuestión. La conclusión negativa a la anterior proposición no significa adoptar una posición pesimista respecto a la solución del conflicto pues cuando el diálogo jurisdiccional no funciona han de ser los actores políticos los que resuelvan la cuestión cosa que ha ocurrido y, presumiblemente, ocurrirá en la garantía de una doble audiencia a todos los condenados penalmente. This present study is focused on the analysis of the well-known issue of the repeated sentences against Spain because of the right to have a conviction and sentence to be reviewed by a higher tribunal as set forth by art.15 of the International Covenant for Civil and Political Rights. This study is carried out from the perspective of the present constitutional pluralism and the formulas for the resolution of conflicts within this new frame. Specifically, it is
studied whether the dialogue and the judicial synthesis provide for a satisfactory solution to the issue. The negative conclusion to the previous proposal is not meant to the adoption of a pessimist approach towards the solution of the conflict because when judicial dialogue does not work, political actors will solve the issue, which was what happened and presumably will happen in the protection of the right to have a conviction and sentence to be reviewed by a higher tribunal.
El intenso debate y la consiguiente recepción normativa de los derechos de los pueblos indígenas es ya una constante, tanto en el Derecho Internacional de los Derechos humanos, como en sede constitucional; y con especial intensidad en América Latina.
La nueva Constitución boliviana ha reconocido de manera generosa, a través de un listado claro y detallado, los derechos de las naciones y pueblos indígenas originarios campesinos. Uno de los grandes logros del «proceso constitucional boliviano» ha sido la adopción de una perspectiva pluri e intercultural como principio y fundamento que atraviesa transversalmente el cuerpo de la Constitución. Allí, el modo de Estado es definido e interpretado desde la interculturalidad, constituyendo un importante ejercicio de renovación y emergencia jurídica. El avance más enérgico y atrevido en este sentido ha sido el reconocimiento del «pluralismo jurídico», en cuanto principio ordenador de todo el sistema constitucional. The intense debate and the consequent regulations of the rights of indigenous peoples is already a constant, both in the International Law of Human Rights, as in constitutional headquarters; and with special intensity in Latin America Constitutions.
The new Bolivian Constitution has recognized widely, through a clear and detailed listing, the rights of nations indigenous peoples and peasants. One of the great achievements of the «Bolivian constitutional process» has been the adoption of a perspective multi and intercultural, as principle and
foundation that crosses the body of the Constitution. There, the mode of State is defined and understood from the interculturality, pose a major exercise of renewal and legal emergency.
The more energetic advance and daring in this regard has been the recognition of the «legal pluralism», as regards principle computer of all the constitutional system.
En el texto se aborda una experiencia pionera en la Administración Local de la Comunidad Autónoma del País Vasco. Se trata del proceso de gestación y posterior aprobación por parte del consistorio de Tolosa (Gipuzkoa) de una Ordenanza para la Igualdad de Mujeres y Hombres. La puesta en marcha de una norma de este tipo es promovida por instancias internacionales europeas, pero exige un alto grado de compromiso político y de sensibilidad
ante la problemática de la igualdad en el ámbito más cercano a la ciudadanía, como es el municipal. La Ordenanza aprobada en Tolosa adquiere, pues, un papel de referencia indiscutible al respecto, sin embargo, a pesar de su relevancia política y de su despliegue sobre un amplio campo de intervención, también esquiva algunos puntos conflictivos que sí habían sido abordados en el Anteproyecto- como el relativo a la prohibición de conceder subvenciones a asociaciones que discriminen-, lo que, a la postre, viene a poner en cuestión el nivel de consenso y compromiso del consistorio sobre la puesta en práctica de la igualdad. This text deals with a pioneering experience in Local Administration of the Autonomous Community of the Basque Country. It deals with the process of creation and subsequent enactment by the the consistory of Tolosa (Gipuzkoa) of a By-law for the Equality of Women and Men. The implementation of a norm of this type is promoted by european international authorities but requires a high degree of political commitment and sensibility towards the problem of equality in the closer field of citizenship as it is the local. The by-law enacted in Tolosa achieves a role of indisputable reference on this respect, however and in spite of its political importance and its implementation over a broad field of intervention, it also evades some controversial points that were approached by the draft bill ¿i.e. the prohibition to grant subsidies to associations that discriminate against¿ what in the end makes to doubt the level of consensus and commitment of the consistory to the implementation of equality.
