In this article there is analyzed how the international administrations that exercise a governmental power in post conflict territories justify their political authority without having democratic legitimacy. In the article it is studied, both the establishment, the mandates and the practices of government of the international administrations of Bosnia, Kosovo and East Timor, and they are identified five sources for this authority: the assent, the delegation, the maintenance of the peace and the safety, the promotion of the human rights and the democracy, and the disposition to govern. Nevertheless, all these aspects are questionable. Concretely, the authority of the international administrations is weakened due to its practices, to the unexistence of any obligation for accountability and to the limited efficiency at the moment of arranging government. To conclude, in the article are outlined some possible ways for the reinforcement of the authority of the international administrations. ; En este artículo se analiza cómo las administraciones internacionales que ejercen un poder gubernamental en territorios post conflicto justifican su autoridad política sin tener legitimidad democrática. En el artículo se estudia el establecimiento, los mandatos y las prácticas de gobierno de las administraciones de Bosnia, Kosovo y Timor Oriental y se identifican cinco fundamentos de la autoridad: el consentimiento, la delegación, el mantenimiento de la paz y la seguridad, el fomento de los derechos humanos y la democracia, y la disposición para gobernar. No obstante, todos estos aspectos son cuestionables. This article aims at sinthetizing different perspectives about the rol of internacional civil society (ICV) in the exercise of a global power. It refers to some anglosajon and european recent studies, both at theorical as empirical levels, in order to do an evaluation of the most critical results. Being esceptical about the very concept of ICV, it tries to analize it from different points of view, in order to respond the main problem: is it posible for the ICV to ejercize power at a global level, and which is its legitimity to resolve global issues. The analysis of the concept is based on some results of the classical theory of civil society at a national level, but also examines specific dificulties to define an ICV and its functions in a globalized world. Eventually, it presents some theoretical challenges which are linked with the relation between ICV and a global democratic order. ; Este artículo pretende sintetizar diferentes perspectivas en torno al papel de la Sociedad Civil Internacional (SCI) en el ejercicio de un poder global. Se refiere a distintos y recientes estudios anglosajones y europeos, tanto al nivel teórico como empírico, en aras a realizar una evaluación de sus principales resultados. Siendo escépticos respecto al mismo concepto de SCI, se busca analizarlo desde distintos puntos de vista, para contestar la principal interrogante: es posible para la SCI ejercer el poder al nivel global, y cuál es su legitimidad para resolver problemas globales? El análisis del concepto esta fundamentado en algunos aportes de la teoría clásica de la sociedad civil al nivel nacional, pero también examina las dificultades específicas que plantea el definir una SCI y sus funciones en un mundo globalizado. Finalmente, se presentan algunos retos teóricos que se refieren a la relación entre la SCI y un orden democrático global.
Since the adoption of the Statute of Rome in July 1998, the ICC has been confronted by a number of problems. One such problem is the disagreement which persists among the members of the Assembly of Member States as to whether the crime of Aggression is one over which the Court has competence pursuant to Article 5 of the Statute. Another diffi culty is the opposition of the United States of America which, since the Bush Administration, has deployed a juridical arsenal with the aim of impeding any type of collaboration with the ICC; the tools in the arsenal include the American Service Members' Protection Act and bilateral immunity agreements which prevent the transfer of American citizens to the Court by State members of the Rome Statute.The entry into force of the of the Statute on 1 July 2002 allowed the Court Prosecutor to initiate the fi rst investigations and processes for war crimes and crimes against humanity committed in the confl icts which have devastated certain African States (D.R.C., The Central African Republic and Uganda). The arrest warrant against the Sudanese President Omar Al Bashir for atrocities committed in Darfur demonstrates the limitations of action on the Court which cannot carry out its mandate without the cooperation of the States. Above all, the Court must confront the criticism of "double standards" and that it is an instrument of "justice for the poor", while the "powerful" escape. Las actividades empresariales en este ambiente globalizado ha servido como catalizador de las violaciones de derechos humanos como consecuencia de la ausencia de la protección institucional algunas empresas han explotado los vacíos jurídicos y la falta de protección de los derechos humanos. Al respecto, para lograr un cambio paradigmático requiere un fuerte énfasis en los derechos y las obligaciones de las empresas. Este artículo presenta un análisis crítico de las obligaciones de las empresas en material de derechos humanos frente a la falta de cláusulas de estabilización en los contratos de inversión extranjera. En primer lugar, estas cláusulas son examinadas en relación con la responsabilidad en las obligaciones corporativas con relación a los derechos humanos fundamentales. De acuerdo con lo anterior, se analizan las dimensiones sustantivas y procesales de las cláusulas de estabilización. En segundo lugar, apelando a los ejemplos concretos del Acuerdo para el desarrollo de la Minería entre Mittal Steel y el Gobierno de Liberia, así como el proyecto del Oleoducto de Baku‐Tblisi‐Ceyhan como casos de análisis, este artículo busca la aplicación de las cláusulas de estabilidad en las inversiones extranjeras con relación a la protección de los derechos humanos por parte de los Estados y de las empresas. This article discusses and critically analyses corporate human rights obligations and the lack thereof under stabilization clauses in foreign investment contracts. First, stabilization clauses in foreign investment agreements are examined in relation to corporate obligations and responsibility for fundamental human rights. In doing so the substantive and procedural dimension of stabilization clauses is analysed. Second, using the concrete examples of the Mineral Development Agreement between Mittal Steel and the Government of Liberia Mittal Steel Agreement and of the Baku‐Tblisi‐Ceyhan Pipeline Project as case studies, this article considers an application of stabilization clauses in foreign investment contracts in relation to the fundamental human rights obligation of states and of corporations. Third, a proposal for reform in the form of a fundamental human rights clause is introduced. To be clear, the argument here is that the fundamental human rights obligations of investors, particularly of corporations, must be included in foreign investment agreements.

In the nineteenth century, one of the essential conditions for obtaining recognition of the sovereignty of a state by the international community was the ability to maintain internal order and guarantee the lives and property of foreign nationals. Justice then becomes a major political element and the case of Spanish-Mexican relations is particularly significant. For Mexico, the aim is to preserve national independence, avoid military intervention and integrate into the international system. For Spain, it seeks to assert its status as a major power with the capacity to intervene in defence of its citizens and to obtain the necessary reparations. This work is then structured around three issues: the debt and financial claims of the Spaniards, the punishment of those guilty of the murders of Spaniards and the negotiation of an extradition treaty for offenders and deserters. ; International audience In the nineteenth century one of the key conditions for recognition of sovereignity of a state by the international community was the ability to maintain order and ensure the lives and properties of nationals abroad. Developing States have contracted many debts; especially since the early 1980s; with creditors. These can be either States or international financial institutions. However; whoever the public debtor is; the latter will intervene more or less directly; increasingly becoming an interlocutor in any attempt to renegotiate or even totally pay the debt itself. This ubiquity arises many questions about its purpose and nature. This is particularly true of the political regimes of indebted states. Indeed; the democratization of these states has become both a means and an end for financial institutions; as the Initiative for Heavily Indebted Poor Countries. Therefore; the question is whether the payment is possible or an illusion.
This article analyses the evolution of humanitarianism from its classical version. The elements which are studied are those that shape the international regime of humanitarian action, and how it was transformed in the nineties. How it came in crisis shocked by several factors at the end of the Cold War, and because of the contact with another growing regimes. Political and humanitarian spheres converged in the so called "new humanitarianism", which motivated a change of regime which is maintained and radicalized after September the 11th, with the closer tie between aid and security. Starting from here, it is posed that this transformation has been accompanied with the evolution of the construction of the image of the communities that receive the help. From being considered passive victims of the conflicts, up to being seen as active agents, with capacity of socioeconomic transformation, and liberal peace construction; or destabilization. ; El artículo analiza la evolución del humanitarismo desde su versión más clásica. Se estudian los elementos que ordenan el régimen internacional de la acción humanitaria y cómo este se transforma en la década de los noventa, entra en crisis conmocionado por diversos factores al final de la Guerra Fría y en el contacto con otros regímenes en expansión. La esfera política y humanitaria convergen en lo que se ha venido a denominar el "nuevo humanitarismo", dando lugar a un cambio de régimen que se mantiene y radicaliza después del 11-S con la creciente vinculación entre ayuda y seguridad. Partiendo de ahí, se plantea que esta transformación ha ido acompañada de una construcción evolutiva de la imagen de las comunidades receptoras de ayuda que, de víctimas pasivas de los conflictos, han pasado a ser consideradas como agentes activos, con capacidad de transformación socioeconómica y de construcción de paz liberal o de desestabilización.
ResumenHasta qué punto las voces que entran en conflicto con las posiciones hegemónicas son escuchadas en las noticias de cubrimiento internacional y cómo estos patrones del discurso público cambian a medida que nuevos sucesos se develan. Este texto analiza los artículos publicados sobre el presidente venezolano Hugo Chávez en un periódico elitista de Estados Unidos durante el periodo 2001-2002. Se efectuó el análisis de contenido de 65 artículos que pertenecían a tres períodos (antes, durante y después del golpe de Estado). Se halló que las voces anti-chavistas predominaban en los discursos de la esfera pública, hasta que un golpe militar ilegal lo removió del poder y, posteriormente, las voces pro-chavistas ganaron mayor espacio en la cobertura del líder venezolano.AbstractTo what degree are voices that conflict with hegemonic views heard in mainstream world news coverage, and how do those patterns of public discourse change as breaking events unfold? This paper examines articles published in U.S. elite media of Venezuelan President Chavez during 2001-2002. Sixty five articles from the New York Times were content analyzed in three time periods (pre-coup, coup, and post-coup). We find that anti-Chavez voices slightly dominated public sphere discourse until an illegal coup removed him from power, and subsequently pro-Chavista voices gained more entry.

В Азиатско-Тихоокеанском регионе автор выделяет возрастание мощи Китая в плане его влияния на мировую политику, а также влияния экономического и финансового кризиса на китайско-американские отношения. Большое внимание уделяется отношениям КНР с государствами-соседями. Отражаются также главные тенденции в Южной Америке, особенно в Венесуэле, суть которых состоит в отходе от «левых» идей в политике и экономике большинства государств этого региона. = Analysing the problems of the contemporary tendencies of international policy faced by the main regions of the world the author draws great attention to Europe and the European Union as the most signifi cant and indicative of contemporary international policy. Firstly it concerns the recent elections in Europe the main peculiarity of which was the shift of electoral preferences to the right; the ratifi cation of the Lesbon Treaty and the problems of European Union enlargement. As far as the Asian region concerned, the main problem there is the growth of China power and its infl uence on the contemporary international policy. In particular, much attention was given to the relations of China with the neighbouring countries as well as to the infl uence of the economic and fi nancial crisis on the US-China relations. The author emphasizes the main tendencies in some south-American countries, especially, Venezuela, the essence of which lies in deviating from the left ideas in policy and economy in most of the countries of this region.
Les Etats en développement ont consenti de nombreuses dettes, surtout depuis le début des années 1980, à l'égard des créanciers publics. Ceuxci peuvent être soit des Etats soit des Institutions Financières Internationales. Cela étant, quelque soit ce débiteur public, ces dernières vont intervenir de manière plus ou moins directe, en devenant progressivement des interlocuteurs incontournables de toute tentative de renégociation, voire d'annulation de la dite dette. Cette omniprésence n'est pas sans susciter de nombreuses interrogations quant à son objet et sa nature. C'est particulièrement le cas de la nature politique des régimes des Etats endettés. This article, which compares the legal monitoring procedures of the judgments of the European and Inter-American Court of Human Rights, states that these regimes were initially thought of in very diverse terms. Indeed the political approach at the European level is opposed to the judicial approach adopted by the Inter-American system. This study demonstrates how through evolution, which has already occurred in Europe but is still in preparation in America, both regional systems are moving closer together towards a mixed system (judicial and political) involving several organs, at the international and national levels. Facing similar cases of noncompliance (for either technical or political reasons), both systems try to reply through non punitive measures. ; Este artículo, que compara el régimen de ejecución de las sentencias de las cortes regionales de derechos humanos, demuestra que el enfoque estuvo concebido inicialmente de manera muy distinta. Al modelo judicial de ejecución de sentencias (modelo interamericano) se opone el modelo europeo de tipo político. Este artículo, que compara el régimen de ejecución de las sentencias de las cortes regionales de derechos humanos, demuestra que el enfoque estuvo concebido inicialmente de manera muy distinta. Al modelo judicial de ejecución de sentencias (modelo interamericano) se opone el modelo europeo de tipo político. Indeed the political approach at the European level is opposed to the judicial approach adopted by the Inter-American system. This study demonstrates how through evolution, which has already occurred in Europe but is still in preparation in America, both regional systems are moving closer together towards a mixed system (judicial and political) involving several organs, at the international and national levels. Facing similar cases of noncompliance (for either technical or political reasons), both systems try to reply through non punitive measures.
