Since the adoption of the Statute of Rome in July 1998, the ICC has been confronted by a number of problems. One such problem is the disagreement which persists among the members of the Assembly of Member States as to whether the crime of Aggression is one over which the Court has competence pursuant to Article 5 of the Statute. Another diffi culty is the opposition of the United States of America which, since the Bush Administration, has deployed a juridical arsenal with the aim of impeding any type of collaboration with the ICC; the tools in the arsenal include the American Service Members' Protection Act and bilateral immunity agreements which prevent the transfer of American citizens to the Court by State members of the Rome Statute.The entry into force of the of the Statute on 1 July 2002 allowed the Court Prosecutor to initiate the fi rst investigations and processes for war crimes and crimes against humanity committed in the confl icts which have devastated certain African States (D.R.C., The Central African Republic and Uganda). The arrest warrant against the Sudanese President Omar Al Bashir for atrocities committed in Darfur demonstrates the limitations of action on the Court which cannot carry out its mandate without the cooperation of the States. Above all, the Court must confront the criticism of "double standards" and that it is an instrument of "justice for the poor", while the "powerful" escape. The answers to these problems can be contributed to, in part, through the revision process foreseen by the Statute nine years after its entry into force. ; Desde la adopción del Estatuto de Roma en julio de 1998, la CPI está confrontada a varios problemas, entre los que se encuentra el desacuerdo que persiste entre la Asamblea de Estados parte relativo a la defi nición del crimen de agresión, que es uno de los crímenes de competencia de la Corte de acuerdo con el artículo 5 del Estatuto. Otra difi cultad es la oposición de los Estados Unidos de América desde que la administración Bush desplegó todo un arsenal jurídico destinado a impedir cualquier tipo de colaboración con la CPI con el American Service Members' Protection Act y los acuerdos bilaterales de inmunidad destinados a prevenir la entrega de ciudadanos estadounidenses a la Corte por parte de los Estados miembros del Estatuto de Roma.La entrada en vigor de su Estatuto el 1 de julio de 2002 le permitió al Fiscal de la Corte iniciar las primeras investigaciones y procesos por crímenes de guerra y por crímenes contra la humanidad cometidos en los conflictos que destrozan ciertos Estados africanos (R.D.C., República Centroafricana, Uganda). Les États délèguent l'accomplissement de leurs obligations aux différentes organisations internationales ; les États sont sélectifs en soi, par des politiques contingentes ; les institutions régionales, en incluant dans leurs décisions des thèmes non juridiques, encouragent la sélectivité.Pour y faire face, le droit international doit rétablir les valeurs originelles, revenir aux origines de la protection internationale et à l'objectif de fournir aux individus un accès direct aux institutions internationales, de manière à garantir tant l'État de droit que l'impartialité professionnelle, ainsi que les changements institutionnels nécessaires pour faire de la protection recherchée une réalité universelle.

La globalización permeó las fronteras artificiales existentes entre la economía y la sociedad alrededor del mundo. Las actividades empresariales en este ambiente globalizado ha servido como catalizador de las violaciones de derechos humanos como consecuencia de la ausencia de la protección institucional algunas empresas han explotado los vacíos jurídicos y la falta de protección de los derechos humanos. Al respecto, para lograr un cambio paradigmático requiere un fuerte énfasis en los derechos y las obligaciones de las empresas. Este artículo presenta un análisis crítico de las obligaciones de las empresas en material de derechos humanos frente a la falta de cláusulas de estabilización en los contratos de inversión extranjera. En primer lugar, estas cláusulas son examinadas en relación con la responsabilidad en las obligaciones corporativas con relación a los derechos humanos fundamentales. De acuerdo con lo anterior, se analizan las dimensiones sustantivas y procesales de las cláusulas de estabilización. En segundo lugar, apelando a los ejemplos concretos del Acuerdo para el desarrollo de la Minería entre Mittal Steel y el Gobierno de Liberia, así como el proyecto del Oleoducto de Baku‐Tblisi‐Ceyhan como casos de análisis, este artículo busca la aplicación de las cláusulas de estabilidad en las inversiones extranjeras con relación a la protección de los derechos humanos por parte de los Estados y de las empresas. En tercer lugar, se propone una modificación a la forma como se introduce la cláusula relativa a los derechos humanos. En este orden de ideas, los derechos humanos de los inversionistas, específicamente de las empresas, deben ser incluidos en los acuerdos de inversión extranjera. ; Globalisation has blurred the artificial borders that exist between economies and societies around the world. The activities of corporations in this globalised environment have often served as the catalyst for human rights violations; due to the lack of institutional protection, some corporations are able to exploit regulatory lacunae and the lack of human rights protection. It appears that the paradigmatic change demands an equal emphasis of rights and obligations of corporations. This article discusses and critically analyses corporate human rights obligations and the lack thereof under stabilization clauses in foreign investment contracts. First, stabilization clauses in foreign investment agreements are examined in relation to corporate obligations and responsibility for fundamental human rights. In doing so the substantive and procedural dimension of stabilization clauses is analysed. Second, using the concrete examples of the Mineral Development Agreement between Mittal Steel and the Government of Liberia Mittal Steel Agreement and of the Baku‐Tblisi‐Ceyhan Pipeline Project as case studies, this article considers an application of stabilization clauses in foreign investment contracts in relation to the fundamental human rights obligation of states and of corporations. Third, a proposal for reform in the form of a fundamental human rights clause is introduced. To be clear, the argument here is that the fundamental human rights obligations of investors, particularly of corporations, must be included in foreign investment agreements.

The purpose of this research is to provide an approximation to the likely effects of the crisis on the Colombian economy and to the effectiveness of policy response. For this, the most relevant transmission channels and policy measures are simulated in the setting of a static computable general equilibrium model (CGE). The results obtained are interesting in their own right and are in line with what could be expected given the information available on the behavior of the Colombian economy. Furthermore, they call into question the effectiveness of governmental intervention as judged by its intended countercyclical effects.
