This comment will analyze the relative success of the various approaches taken to implement Indian treaty rights in the international fishery. It will discuss the domestic litigation resulting from these approaches and will identify the key legal issues involved. Finally, it will suggest possible means of resolving the dilemma in which the United States currently finds itself. By providing an appreciation of both the scientific complexities of managing this valuable resource and the limitations on unilateral judicial efforts in the United States, it will become apparent that the solution to this sensitive problem rests not in unilateral, but in cooperative United States-Canadian efforts. Only through diplomatic negotiations can we be assured that these recently resurrected Indian treaty rights will be accommodated in harmony with the conservation and enhancement of the salmon resource. It is hoped that the two national governments will come to realize the role of cooperation and act to avoid imposing upon the resource and its beneficiaries the futility of future summers in court.

The study describes and analyzes the structures, the procedures and decision making processes of the International Nuclear Fuel Cycle Evaluation (INFCE). INFCE was agreed by the Organizing Conference to be a technical and analytical study and not a negotiation. The results were to be transmitted to governments for their consideration in developing their nuclear energy policies and in international discussions concerning nuclear energy cooperation and related controls and safeguards.Thus INFCE provided a unique example for decision making by consensus in the nuclear world. It was carried through under mutual respect for each country's choices and decisions, without jeopardizing their respective fuel cycle policies or international co-operation agreements and contracts for the peaceful use of nuclear energy, provided that agreed safeguards are applied.

It has never been clear, however, which circumstances of negotiation and conclusion of international agreements contribute to new rules of customary law. The issues can be appreciated if one goes beyond generalities and explores the relationship of specific agreements to customary law. Such an examination has been facilitated by the American Law Institute's Restatement of the Foreign Relations Law of the United States (Revised) which contains a contemporary review of a wide range of public and private international law topics. This Restatement represents the views of some of the best international law experts of the United States and abroad. It is also an extremely important contribution to the law in its own right. For these reasons, this article will use the Restatement as a starting point for examination of the function served by international agreements in the development of customary law. This examination shows the difficulties that are presented when international agreements are so used. It may be possible, however, to identify some factors which would help to distinguish those agreements which may appropriately give rise to customary international law and those which may not.

The current crisis in international lending points up a lesson re-learned several times in the past 150 years: the international loan markets function very differently from the textbook model of competitive lending. This paper discusses various extensions of the basic model. First, we amend the textbook model to show how limitations on a government's taxing authority may greatly affect its optimal borrowing strategy. Second, we explore the implications of adebtor country's option to repudiate debt. Third, we show that efficient lending may require collective actions by bank syndicates, and that a breakdown in collective action can result in serious inefficiencies and even financial panics.

Vergeltungsmaßnahmen der Bundesrepublik Deutschland gegen Subventionen zugunsten einzelner Industriebranchen im Ausland lassen sich aus gesamtwirtschaftlicher Sicht nicht rechtfertigen. Aktion und Reaktion verringern den internationalen Warenaustausch und führen zu Einkommensverlusten bei allen am Welthandel beteiligten Ländern. Subventionen zugunsten einzelner Industriebranchen verursachen Wachstumsverluste, indem sie - eine Fehlspezialisierung auf strukturschwache Branchen oder vermeintliche Zukunftsindustrien fördern, - die Kostenkontrollfunktion des Wettbewerbs teilweise außer Kraft setzen und - Interessengruppen wie Unternehmer und Gewerkschaften ermutigen, reale Ressourcen in die Beeinflussung des politischen Entscheidungsprozesses zu investieren, um Vorteile zu erlangen (rent seeking). Die Verhaltensweise des "rent seeking", die sowohl für inländische als auch für ausländische Interessengruppen charakteristisch ist, hat dazu beigetragen, daß im vergangenen Jahrzehnt immer mehr Länder und immer mehr Produktionsbereiche in das internationale Subventionskarussell einbezogen worden sind. Durch diesen Lawineneffekt kumulieren sich die volkswirtschaftlichen Kosten, die die am Subventionswettlauf beteiligten Länder zu tragen haben. Die beste Lösung dieses Dilemmas wäre ein international vereinbarter Abbau von Branchensubventionen. Erweist sich eine solche Lösung als unerreichbar, so lohnt sich aus gesamtwirtschaftlicher Sicht immer noch ein einseitiger Ausstieg aus dem Subventionskarussell. Eine derartige Revision der bisherigen Wirtschaftspolitik wäre in der Bundesrepublik auch politisch durchsetzbar, wenn über Steuersenkungen das Wählerpotential der Steuerzahler mobilisiert würde.

"An experiential exercise designed to teach retailing students international buying skills is described. Increased foreign buying activities make it important for educators to integrate international buying strategies into the curriculum. Student teams represented one of four retail firms and bought merchandise from other students posing as foreign manufacturers. Each team completed market research to determine the economic, political, and cultural climate of a foreign country as well as business customs that might affect negotiation. A situation analysis of the retail firm was also conducted. Buying decisions were made regarding open- tobuy, pricing, shipping, delivery, method of payment, and stock assortment. Teams negotiated with representatives of foreign manufacturing firms to achieve predetermined buying goals. "
