This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review - and thus the 'law' as such - and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction.

The European Court of Justice (ECJ) is a very powerful court compared to other international courts and even national courts of last resort. Observers almost unanimously agree that it is the preliminary references procedure that made the ECJ the powerful court it is today. In this paper, we analyze the determinants that lead national courts to use the procedure. We add to previous studies by constructing a comprehensive panel dataset (1982-2008), including more potentially relevant explanatory variables and by testing for the robustness of previous results. In addition to confirming the relevance of variables previously found significant, we identify a number of additional determinants, including the relevance of agriculture to a country, corporate tax rate, familiarity with EU law, and tenure of democracy.

Understanding Taiwan's ability to defend itself against mainland China is becoming increasingly significant as the likelihood of a cross-straits conflict rises. Taipei is unlikely to unify with China on Beijing's terms, and Beijing is unlikely to relinquish its claim that Taiwan falls under its domestic jurisdiction. Even a confrontation over Taiwan that falls short of war will have regional and global ramifications.

Democratic capitalism or liberal democracy, as the successful marriage of convenience between market liberalism and democracy sometimes is called, is in trouble. The market economy system has become global and there is a growing mismatch with the territoriality of the nation-states. The functional global networks and inter-governmental order can no longer keep pace with the rapid development of the global market economy and regulatory capture is all too common. Concepts like de-globalization, self-regulation, and global government are floated in the debate. The alternatives are analysed and found to be improper, inadequate or plainly impossible. The proposed route is instead to accept that the global market economy has developed into an independent fundamental societal system that needs its own governance. The suggestion is World Market Governance based on the Rule of Law in order to shape the fitness environment for the global market economy and strengthen the nation-states so that they can regain the sovereignty to decide upon the social and cultural conditions in each country. Elements in the proposed Rule of Law are international legislation decided by an Assembly supported by a Council, and an independent Judiciary. Existing international organisations would function as executors. Vorgeschlagen wird ein System der Weltmarktsteuerung aufbauend auf dem Prinzip der Rechtsstaatlichkeit, in das die globale Marktwirtschaft eingebettet wird und das die Nationalstaaten stärkt, so dass sie Ihre Souveränität hinsichtlich Entscheidungen über nationale soziale und kulturelle Bedingungen wiedererlangen. Elemente des vorgeschlagenen gesetzesbasierten Steuerung sind eine internationale Gesetzgebung durch eine Versammlung, unterstützt durch einen Rat, und eine unabhängige Gerichtsbarkeit. Bestehende Internationale Organisationen würden als Exekutive fungieren. Dazu ist eine dauerhafte und umfängliche Nachfrage nach Regulierung im Gemeininteresse erforderlich.

Analysing the impact of EU law beyond its borders, this book examines the use of law as a powerful instrument of EU external action and addresses some of the normative challenges this poses. The 'global reach' of EU law is examined in policy areas of the environment, the internet and data protection, banking and financial markets, competition policy and migration.

A critique of how domestic courts in the EU apply the European Convention on Human Rights and interact with the European Court of Human Rights at Strasbourg. It considers the British, French, and German approaches to the ECHR and shows that domestic courts apply and develop the Convention faithfully and positively.

Der Beitrag erläutert Begrifflichkeit und Praxis von gerichtsnaher Schlichtung und Mediation in Handelstreitigkeiten in Schweden, Japan und Australien (schwerpunktmäßig in den Bundesstaaten Queensland und New South Wales). In Bezug auf die vieldiskutierte niedrige Zahl von Verfahren in Japan vertritt er eine von der tradierten Interpretation abweichende Position: die geringe Verfahrensdichte sei nach neueren Analysen nicht mehr international als eine Ausnahme anzusehen, sondern lasse sich vielmehr mit einem allgemeingültigen institutionellen Erklärungsansatz entschlüsseln. Damit werden die für Japan gewonnenen verfahrensrechtlichen Beobachtungen leichter verständlich, und entsprechend stellt der Beitrag diese in einen konzeptionell breit angelegten Rechtsvergleich. Der erste Teil des Beitrages differenziert zwischen den beiden Verfahrensarten anhand der Rolle, die der neutralen dritten Partei zukommt. Während der Mediator sich im Rahmen der Mediation typischerweise passiv verhalte, nehme der Schlichter bei der gerichtsnahen Schlichtung durch eigene Vorschläge Einfluß, was den Ausgang des Verfahrens entscheidend beeinflussen könne. Der Begriff "gerichtsnah" wird dabei weit interpretiert. Als Ergebnis der Analyse im zweiten Teil des Beitrages wird die Freiwilligkeit als charakteristisches Merkmal herausgestellt, das die unterschiedlichen Verfahren in den drei Rechtssystemen kennzeichne. Auch soweit teilweise die Einleitung eines Verfahrens nicht freiwillig geschehe, behalte jedoch jede Partei das Recht, die Streitfrage durch ein formales Gerichtsverfahren klären zu lassen. In allen Ländern würden sowohl die Schlichtung als auch die Mediation so früh wie möglich eingeleitet, um die vorrangigen Ziele – Verfahrensbeschleunigung und Kostenminimierung – zu erreichen. Die Unterschiede in den Rechtssystemen werden wie folgt herausgearbeitet: Im Vergleich zu Australien und Japan, würden Schlichtung und Mediation in Schweden äußerst selten während eines laufenden Gerichtsverfahrens oder im Anschluß an ein Gerichtsverfahren eingeleitet. In Australien würden ferner die Verfahren grundsätzlich unter Ausschluß der Richter durchgeführt, während die Richter in Japan regelmäßig eine aktive Rolle spielten. Insgesamt sei die schwedische Praxis der japanischen sehr viel ähnlicher als der australischen; allerdings sei die Rolle der schwedischen Richter stärker zurückgenommen als die der japanischen. Abschließend entwickelt der Beitrag auf der Grundlage eines Vergleiches der verschiedenen Verfahren in den drei Rechtsordnungen generische Modelle der Streitbeilegung in Handelssachen, wobei das unterschiedliche Verhältnis von gerichtsnaher Schlichtung und Mediation zur ordentlichen Gerichtsbarkeit als Differenzierungskriterium dient. Es werden fünf unterschiedliche Modelle identifiziert und in drei Kategorien unterteilt: außergerichtliche Streitbeilegung durch einen Richter, Rückgriff auf einen privaten Schlichter und das Modell einer institutionalisierten außergerichtlichen Streitbeilegung. This work provides several policy proposals capable to strengthen the private enforcement of EU competition law in arbitration. It focuses on the procedural law aspects that are permeated by legal uncertainty and that have not yet fallen under the scrutiny of the law and economics debate. The policy proposals described herein are based on the functional approach to law and economics and aim to promote a more qualified decision making process by: adjudicators, private parties and lawmakers. The resulting framework of procedural rules would be a cost-effective policy tool that could sustain the European Commission's effort to guarantee a workable level of competition in the EU internal market. This project aims to answer the following broad research question: which procedural rules can improve the efficiency of antitrust arbitration by decreasing litigation costs for private parties on the one hand, and by increasing private parties' compliance with competition law on the other hand? Throughout this research project, such broad question has been developed into research sub-questions revolving around several key legal issues. The chosen sub-research questions result from a vacuum in the European enforcement system that leaves several key legal issues in antitrust arbitration unresolved. The legal framework proposed in this research project could prevent such a blurry scenario from impairing the EU private enforcement of competition law in arbitration. Therefore, our attention was triggered by those legal issues whose proposed solutions lead to relevant uncertainties and that are most suitable for a law and economics analysis.

The article deals with the development in Russian-Estonian relations during the crises of 2007 and 2014, taking into consideration the balance between political and economic factors in the decision-making by Estonian government. A number of special aspects, trends and problems in trade and investment ties are detected. The aim of the study is to uncover key motivation behind the actions of both Russia and Estonia, to identify the drivers for economic and political development in the region, and to work out recommendations to adjust them. The questions put forward by the authors of this article could not be more topical at the time, when Russian economic situation is obviously getting worse and capital flight (to the neighboring EU Member States) is likely to increase. The method of the study is comparative analysis of the impact on economic ties made by Russian-Estonian crisis of 2007 and the current international tension around Ukraine. The regional fossil fuel market and the possibilities of Gazprom involvement in its development are also analyzed. It is concluded that political motives are still important for Estonian decisionmaking, though they are balanced out by measures of business support (despite some of these measures being taken by the EU bodies). The role of political factor for the Russian side is increasing. It is acknowledged that there is a growing number of missed economic opportunities in the Russian Northwest.
