The author of this conference succinctly presents the importance of jus cogens for the International and Central American Community, since there can not be an international, inter-American or Central American order, without the protection and respect for the fundamental principles of nature erga omnes contemplated in the UN Charter, in the Charter of the OAS, in the Protocol of Tegucigalpa and in other international instruments. The Vienna Convention on the Law of Treaties of 1969 in article 53 establishes the requirements for a rule of international law to be accepted as jus cogens. And Article 64 of that instrument establishes the retroactive nature of the rules of jus cogens: "If a peremptory norm of general international law emerges, any existing instrument that is in opposition to that norm will become null and void." The doctrine makes coincide the interests of the International Community as a whole with those that transcend the States or that respond to the essential legal minimum that the International Community requires for its survival. The jurisprudence of the courts of justice are plagued by rules of jus cogens to protect the most sacred rights and fundamental freedoms of the human being. In this article Thomas Risse y Kathryn Sikkink analyze the importance of international norms impact over domestic politics and propose a five phases "spiral model" to explain the changes in human rights internalization by the states. They develop a theoretical framework that explains the stages and mechanisms by which international norms promote changes in international and transnational actors behavior, and that serves to a better comprehension of the general norms impact over international politics. This article analyzes the difficulties in incorporating the stipulations set forth in the International Convention on the Protection of All Migratory Workers and Their Families into the Mexican Migration Law passed in May 2011 and the regulatory norms of the National Migration Institute and the Ministry for the Development of the Southern Border and Liaison for International Cooperation of the Chiapas government. Using a constructivist, multinational approach of international relations, this article looks at the rights set forth in the unconvention and Mexico s Migration Law, as well as the experiences and opinions of civil society organizations about these bodies actions in Chiapas and their limitations. ; Aquí se analizan las dificultades de la internalización de las disposiciones de la Convención Internacional de Todos los Trabajadores Migratorios y sus Familias (CTMF) en la Ley de Migración de México aprobada en mayo de 2011, y los referentes normativos por parte del Instituto Nacional de Migración y la Secretaría para Desarrollo de la Frontera Sur y Enlace para la Cooperación Internacional del Gobierno de Chiapas. Le processus de régulation comptable international pour les organisations de gestion d'entreprises a été orienté d'un point de vue qui doit être évalué par la théorie de la comptabilité et du contrôle. Plusieurs des critères adoptés par cette régulation permettent l'utilisation d'objectifs et de fonctions pour l' information financière sur les marchés qui éloignent la comptabilité financière de ses objectifs indispensables et subséquents d'organisation ainsi que de productivité. Ceci débouche sur une situation problématique, car la comptabilité financière est la base structurelle de la rationalité technique instrumentale de l'entreprise et la colonne vertébrale d'autres systèmes de comptabilité et de contrôle comme les coûts et les budgets. C'est pourquoi, les processus et les logiques de contrôle qui rendent possible le système comptable financier sont déplacés de l'optique régulatrice impliquant l'adoption d'une conception et d'une structure faible de gouvernement corporatif. Dans ce document ces questions sont abordées afin de distinguer les forteresses et les faiblesses du point de vue régulateur international, à partir des bases conceptuelles du sous-système de comptabilité financière. ; El proceso de regulación contable internacional para las organizaciones empresariales ha sido orientado desde un enfoque que debe ser evaluado a la luz de la teoría de la contabilidad y el control. Varios de los criterios adoptados en dicha regulación permiten la instrumentación de objetivos y funciones para la información financiera en los mercados, que alejan a la contabilidad financiera de fines subsecuentes e indispensables en las organizacionales, como la productividad. Esto es problemático debido a que la contabilidad financiera es la base estructural de la racionalidad técnico-instrumental de la empresa y es la columna vertebral de los demás sistemas de contabilidad y control, como los costos y los presupuestos. Por tal razón, los procesos y lógicas de control que viabilizan el sistema contable financiero son desplazados del enfoque regulador, lo que implica la adopción de una débil concepción y estructura de gobierno corporativo. En este documento se abordan tales cuestiones, con el fin de contrastar, desde las bases conceptuales del subsistema de contabilidad financiera, las fortalezas y debilidades del enfoque regulador internacional. ; International business organisation accounting regulation has been directed from an approach which should be evaluated in the light of accounting and control theory. Various criteria adopted in such regulation allow implementing objectives and functions for financial information in markets straying from subsequent and indispensable organisational financial accounting ends, such as productivity. This is problematic, due to financial accounting being the structural basis for a company's technical-instrumental rationality and is the backbone of other accounting and control systems such as costs and budgets. Control processes and logic making the financial accounting system viable are thus displaced in a regulatory approach, implying adopting a weak conception and structure of corporate government. This document approaches such questions contrasting the international regulatory approach's strengths and weaknesses from the conceptual basis of the financial accounting subsystem.

This article explores the relationship between international norms and national interest by analyzing it through case studies that provide a historical perspective on the concept of sovereignty. The analysis is focused on four military interventions carried out by the United States and the Soviet Union during the Cold War —when the sovereignty regime in place rendered such interventions both illegal and unjustified, save for cases of self-defense or collective security. Each case study evaluates the extent to which international norms on sovereignty served as constraints for the military action, by examining both the tactics used and the justifications offered for the intervention. The article concludes that both Cold War superpowers did not shy from slanting international norms in order to fit their notions of national interest, with multiple facets of the concept of sovereignty emerging from each case study. ; Este artículo explora la relación entre las normas internacionales y el interés nacional a través de un análisis de estudios de caso, que nos proporciona una perspectiva histórica del concepto de soberanía. The article examines the problem of the development of Russian law in the framework of the implementation of the criminal procedure norms related to drug smuggling. It is proposed to consider the prevention and effectiveness of offenses related to drug smuggling through the harmonization of national legislation. Special attention is paid to the interaction of international and domestic norms of procedural law. Special attention is paid to a comprehensive analysis of the construction of a system for the implementation of the norms of law, on which the effective achievement of goals in the suppression of crime in the sphere of drug trafficking depends. Based on the study of the material, it has been found that the mechanism for the implementation of the norms of the criminal procedure is not quite simple: on the one hand, the appeal to foreign legal norms is regarded as an unproductive scientific discourse, on the other hand, theories are modeled on the damage to one's own legal system because of unjustified borrowings from other legal systems. The results and conclusions can be used in the practical activities of customs, law enforcement agencies.

Every decision regarding teaching and learning any language implies the selection of a determined standard linguistic variety which, generally, has been claimed to be standard based on historical and social factors rather than linguistic ones. This practice also affects linguistic polices, as taking learners to the levels of competence in the basic skills requires decisions on the linguistic variety to be selected as the parameters to create didactic materials and massive evaluations. In the case of Spanish as a Foreign Language (SFL), many problems emerge which must be carefully analyzed in the light of theory essentially because Spanish is a language that includes a great variety of heterogeneous territories and cultures. This makes it difficult to identify a common standard language to be taught. Here, the concept of norm is included as it is necessarily interwoven with the ideological problem that underlies the intention of a unified proposal for teaching SFL. This article proposes a general revision of the concept of norm to introduce it in the debate about what to teach and evaluate in an international certification system of SFL. In addition, it explores how decisions that tend to favor some linguistic communities might stigmatize others. ; Toda decisión sobre la enseñanza y el aprendizaje de cualquier lengua implica la selección de una determinada variedad que, en general, se ha erigido como estándar en virtud de factores históricos y sociales, antes que lingüísticos. Este hecho afecta también a las políticas lingüísticas dentro de las cuales la evaluación de los niveles de competencia en las habilidades básicas exige decisiones sobre qué variedad ha de seleccionarse como parámetro para construir materiales didácticos y evaluaciones masivas. En el caso del "Español como Lengua Extranjera (ELE)", surgen problemas que ameritan una reflexión de carácter teórico, tanto más si se tiene en cuenta que estamos ante una lengua que abarca territorios extensos y culturas muy heterogéneas que ponen en entredicho la idea de una lengua común. Aquí, el concepto de Norma se hace presente puesto que se cruza necesariamente con el problema ideológico que subyace a esa pretensión unificadora. La ponencia propone revisar el concepto de Norma, introducirlo en el debate sobre qué español enseñar y evaluar en un sistema de certificación internacional de ELE y si inevitablemente cualquier decisión al respecto conlleva la anulación de variedades lingüísticas estigmatizadas, lo cual correspondería a una acción más política e ideológica que científica o académica. ; Toute décision sur l'enseignement et l'apprentissage d'une langue suppose le choix d'une variété de langue donnée qui, généralement, est devenue standard en raison de certains facteurs d'ordre historique et social, plutôt que linguistique. Ce fait concerne aussi les politiques linguistiques où l'évaluation des niveaux de compétence des habilités de base exige la prise de décisions sur la variété à choisir comme point de référence pour la construction de matériaux didactiques et d'évaluations massives. Dans le cas de l'Espagnol comme Langue Étrangère (ELE), il y a des problèmes qui méritent une réflexion théorique, d'autant plus que cette langue comprend des territoires vastes et des cultures hétérogènes, ce qui fait hésiter sur l'idée d'une langue commune. Le concept de Norme devient ici important étant donné qu'il a un rapport direct nécessairement avec le problème idéologique sous-jacent à cette prétention unificatrice. Ce texte vise à réviser le concept de Norme, l'introduire dans le débat sur quel espagnol enseigner et évaluer dans un système de certification internationale de l'Espagnol comme Langue Étrangère et constater si, inévitablement, les décisions prises à ce sujet conduisent à l'annulation des variétés linguistiques stigmatisées, ce qui correspondrait à une action notamment politique et idéologique plutôt que scientifique ou académique.

The AndeanCourt of Justice is the authority in the Andean law and its activityadds to that of the State Judge in the same sense. ; El Derecho comunitario en virtud de su supranacionalidad se constituye en un ordenamiento jurídico propio y especializado, distinto del Derecho interno y del Derecho internacional común, que se inserta en los ordenamientos jurídicos nacionales con valor superior a la ley nacional a la que desplaza o sustituye en forma directa y automática (principios de aplicación directa y preeminencia). Existe una ordenación jerarquizada de normas donde las superiores son la Constitución comunitaria y las que ocupan un rango inferior, las derivadas o secundarias, que emanan de los órganos comunitarios. También se reconoce la importancia de estas normas en la conformación del bloque de constitucionalidad. El Derecho andino escapa a los controles corrientes de juridicidad y para su cumplida ejecución, los países miembros conservan competencias residuales o complementarias de naturaleza legislativa. The OAS charter proclaimed a norm of democratic governance which validated the importance of representative democracy as central to peace and stability in the Western Hemisphere. While this normative commitment made sense in the era of the good neighbor policy, multilateralism and non intervention, U.S. abandonment of these principles since the Eisenhower Administration weakened the norm and created a crisis of legitimacy in the OAS through its treatment of Guatemala in 1954 and Cuba in 1962. The approval of Resolution VI in the meeting of foreign affairs ministers in 1962, excluding Cuba from the OAS because of its government's Marxist ideology was a case of counterproductive institutionalization of the democratic governance norm. This article explores the cycle of regress and renewal of the democratic governance norm through an examination of the OAS treatment of Cuba since 1962 to the 39th OAS General Assembly in San Pedro Sula in 2009. ; La Carta de la OEA proclamó la norma de gobernabilidad democrática que validó la importancia de la democracia representativa como central a la paz y estabilidad del hemisferio occidental. Aunque ese compromiso normativo tuvo sentido en la era de la política del buen vecino, el multilateralismo y la no intervención, el abandono por Estados Unidos de esos principios desde la administración Eisenhower debilitó la norma y creó una crisis de legitimidad en la OEA a raíz de los casos de Guatemala en 1954 y Cuba en 1962. The aim of the work was to determine the peculiarities of the principles of formation of sanctions of criminal law norms in the conditions of the Russian invasion of Ukraine. The method of analysis and research was used to interpret the works of legal scientists and determine the main theoretical approaches to the application of sanctions in international law on the example of Russia's violation of international law against Ukraine. For the detailed study of the subject the method of analysis and synthesis and descriptive method was used, as well as the method of generalization to determine the results of the research. The scientific novelty consists in the fact that the study clarifies the concept of sanctioning of criminal law norms as one of the original factors of international conflict resolution. The practical significance of the study consists in identifying the action of sanctions in conditions of war by Russia against Ukraine. It is concluded that, the conducted study is the basis for specifying the concept of the principles of sanctions in the international legal sphere, which is also the result of the analysis of legal works.
