Wie sind die Menschenrechte heute angemessen zu verstehen? Sich ausschließlich auf ihren rechtlichen Gehalt oder ethisch-moralischen Anspruch zu konzentrieren, genügt dafür offenbar nicht. Notwendig ist es vielmehr, die Dimension des Politischen, die diesen Rechten eigen ist, systematisch in den Blick zu nehmen: Erst im Feld der sozialen Praxis und in den historisch bezeugten Erfahrungen handelnder Individuen wird ein moralisch-rechtlicher Anspruch konkret greifbar. Am Beispiel des zeitgenössischen Umgangs mit dem Erbe des französischen Kolonialkrieges in Algerien setzt Daniel Bogner Theorie und Praxis, Normativität und Geschichte konsequent miteinander in Beziehung. This edited book explores prison masculinities, drawing from a wide range of international researchers to highlight how masculinities may divert from the ""hypermasculine"" or macho typology typically found in the prison masculinities literature. The book includes a diverse selection of writing on masculinities ""in"" and ""of"" prison; masculinities experienced by those living within, working, and experiencing prison as well as historical and critical accounts of masculinities from around the world. The contributors highlight how masculinities are experienced in a multitude of ways as is evidenced in both qualitative and quantitative research with men before, during, and after imprisonment; with correctional officers and staff; in the analysis of public records, in the critical examination of Sykes' seminal work; and in historical and contemporary Australian society. Evidenced in writing drawn from Australia, the Dominican Republic, Ukraine, Hong Kong, the United States, Scotland, and the Netherlands, the contributors acknowledge that rather than being fixed, discourses around prison masculinities now include sexuality, gender identity, and diverse understandings around masculinities as strategic, hegemonic, and ever changing. This open access book aims to elaborate on the legal prerequisites to establish the liability of corporations for transboundary environmental harm, not only by identifying existing liability rules, principles and standards but also by analysing their potential for further legal development. The authors consider international and transboundary liability law to currently be an underutilised tool for international environmental protection. The book seeks to address this by exploring what is needed in terms of legislative action and identifying options for judicial pliability, thereby providing an important legal contribution in furthering the development of an effective international and transnational environmental liability law regime.

Seitdem 2010 der frühere sexuelle Missbrauch am Berliner Canisius-Kolleg bekannt wurde, wird auch in Deutschland intensiv über den sexuellen Missbrauch an Minderjährigen durch Vertreter der katholischen Kirche diskutiert. Mit der 2018 veröff entlichten MHG-Studie begann die wissenschaftliche Aufarbeitung, an der seitdem Vertreter verschiedener Disziplinen beteiligt sind. Der Band trägt den bisherigen Forschungsstand aus den unterschiedlichen Fachgebieten (Geschichtswissenschaft, Pädagogik, Recht, Psychologie) zusammen. Deutlich wird, welche innerkirchlichen und gesellschaftlichen Bedingungsfaktoren das Fehlverhalten von Geistlichen ermöglichten. Darüber hinaus wird danach gefragt, welche Spezifika der sexuelle Missbrauch in der katholischen Kirche aufweist und inwieweit er in gesamtgesellschaftliche Phänomene eingeordnet werden muss. Seit dem Mord an George Floyd durch den Polizeieingriff in den Vereinigten Staaten im Mai 2020 und der daraus erwachsenen (Social Media-)Bewegung #blacklivesmatter hat auch die Beschäftigung mit den verschiedenen Formen von Rassismus in Deutschland zugenommen. Konnte der Begriff vor wenigen Jahren in wissenschaftlichen wie öffentlichen Diskursen weitgehend nur schwierig oder selten genutzt werden, hat er sich inzwischen hierzulande auch als Gegenbegriff zur globalen Wirkmächtigkeit rechter Ideologien, die besonders Identitätskategorien zur Legitimation mörderischer Gewalt heranziehen, sowie im Kontext globaler Diversifizierungsmaßnahmen im Diskursmainstream durchgesetzt. Dieser Erfolg des Begriffs lässt auch die filmischen Produktionen zu Themen von Menschenfeindlichkeit, die auf Repräsentationskategorien basieren, in einem neuen Licht erscheinen. Filme zu Themen des Rassismus versuchen, Aufklärungsarbeit im Sinne anti-rassistischer Praxis zu leisten, während beispielsweise propagandistische Videos rechter und dschihadistischer Kreise zur (re-)produktiven Verhandlung von Rassismus beitragen. Andererseits lassen sich Filme, die scheinbar nichts mit Rassismus zu tun haben, bei einem genaueren analytischen Blick sehr wohl als Verstärkungs-, Reproduktions- oder Verschleierungsakteure von Rassismen verstehen. So sind Filme immer schon im Sinne von (Un-)Sichtbarkeitsmaschinen dazu geeignet, soziale Verhältnisse zu veräußerlichen und so ungedachte Zusammenhänge zu denken. In dieser argumentativen Bi-Perspektivität – Sichtbarwerden der Rassismusdiskurse und Filme als Sichtbarkeitsmedien sozialer Verhältnisse – geht der vorliegende Sammelband Diskursformen des Rassismus, seiner Filmkulturen und Möglichkeiten des (anti-rassistischen) Widerstands besonders/aber nicht nur im deutschsprachigen Kontext nach. Daran schließen sich folgende Fragen an: Wie sieht der Zusammenhang von (fiktionalen) Filmen und Formen des Rassismus in Film-kulturen aus? Wie gehen fiktionale Formate mit Antisemitismus, Rechtsradikalismus, antimuslimischem Rassismus, Antiziganismus und whiteness um? Und wie versuchen aktuelle (auch experimentelle) filmische Formate, Rassismus entgegenzutreten? Im Zentrum des Sammelbandes stehen die Filme und ihre Geschichten selbst. Ziel ist es, das Erkenntnispotential von Filmen in der Auseinandersetzung mit Rassismus zu befragen: Was genau am Rassismus machen die Filme sichtbar? Wie lassen sich mögliche historische Entwicklungen narrativer audiovisueller Diskursformen (für den deutschsprachigen Kontext) darstellen? This book addresses the consequences of legitimacy in global governance, in particular asking: when and how do legitimacy crises affect international organizations (IOs) and their capacity to rule. The book starts with a new conceptualization of legitimacy crisis that looks at public challenges from a variety of actors. Based on this conceptualization, it applies a mixed-methods approach to identify and examine legitimacy crises, starting with a quantitative analysis of mass media data on challenges of a sample of 32 IOs. It shows that some, but not all organizations have experienced legitimacy crises, spread over several decades from 1985 to 2020. Following this, the book presents a qualitative study to further examine legitimacy crises of two selected case studies: the WTO and the UNFCCC. Whereas earlier research assumed that legitimacy crises have negative consequences, the book introduces a theoretical framework that privileges the activation inherent in a legitimacy crisis. It holds that this activation may not only harm an IO, but could also strengthen it, in terms of its material, institutional, and decision-making capacity. The following statistical analysis shows that whether a crisis has predominantly negative or positive effects depends on a variety of factors. These include the specific audience whose challenges define a certain crisis, and several institutional properties of the targeted organization. The ensuing in-depth analysis of the WTO and the UNFCCC further reveals how legitimacy crises and both positive and negative consequences are interlinked, and that effects of crises are sometimes even visible beyond the organizational borders
