Der Aufsatz stellt sich die Fragen, ob Organisation und Funktionsweise des Internationalen Gerichtshofs für Ruanda (IGR) sowie die von ihm definierte Strafverfolgungspolitik seiner Aufgabe, der Verurteilung der Genozid-Verantwortlichen, entspricht, ob effiziente Untersuchungsmittel angewandt werden und ob die internationale Gemeinschaft wirklich an einer Verfolgung der Täter interessiert ist und sich aktiv beteiligt. Für den IGR erwiesen sich die klassischen Untersuchungsmethoden als unangemessen, das Verfahren mußte erst den Gegebenheiten in Ruanda angepaßt werden. Es fehlt eine internationale Polizei. Lange ließ eine Strategie des IGR auf sich warten, wie angesichts der großen Zahl Verdächtiger eine Auswahl getroffen werden soll. Insgesamt ist es für eine Bilanz der Arbeit des IGR noch zu früh. Der Beitrag beschäftigt sich mit der Einrichtung eines Tribunals der UN zur juristischen Aufarbeitung des Genozids vom Frühjahr 1994 in Ruanda. Der Autor, ein Funktionär des Centre pour les Droits d l'Homme bei den UN in Genf, erörtert juristische Grundlagen, Status, Organisation, Kompetenzen und Verfahrensfragen des im November 1994 von der UN beschlossenen Tribunals. Dabei wird auch ein Vergleich mit einem Tribunal für Ex-Jugoslawien angestellt. (DÜI-Kör)

This article gives attention to the question if an unconditional amnesty enacted by a State Party to the Statute of the International Criminal Court would be an obstacle for the Court to exercise its complementary competences. Two arguments are supporting a negative answer: in so far as the Statute considers crimes falling within the scope of its competences as a threat to international peace, the States could be viewed as forced to prosecute the authors of such acts by obligations erga omnes while all indications of a State not to comply would entitle the court to exercise its competences. Moreover, such laws ignore the will of the States to put an end to exemptions from punishment that are impeding the democratic order & are fostering other crimes. However, these arguments should not be regarded as decisive. Before exercising its competence the court should also consider other factors -- in particular the impact of such laws on the process of national reconciliation. Adapted from the source document.
