La mayor incidencia de las manifestaciones criminales cometidas directamente contra los sistemas informáticos o que se sirven de ellos para atentar contra los más variados bienes jurídicos, deben tener una adecuada protección penal. Si bien la última redacción ofrecida por la Ley Orgánica 5/2010, de 22 de junio, supuso un avance al objeto de tipificar conductas relacionadas con este tipo de delitos, nuestro Código Penal sigue sin ofrecer una penalización clara y directa. En este trabajo, se propone la inclusión de un nuevo tipo penal sobre la suplantación de identidad, real o ficticia, en internet. ; The increased number of criminal acts committed directly in relation to information systems or that use such systems to commit an offence against a wide range of legal rights and assets must be adequately punished by criminal legislation. [ES] En este trabajo se presenta un estudio sobre la suplantación de identidad en Internet en el contexto de otros ciberdelitos. En el transcurso del mismo se muestra la legislación relacionada con los delitos y las nuevas normas que buscan proteger de una manera óptima nuestra información. También se señala el ciberacoso como consecuencia de la suplantación y la manera en que el mundo va mostrando los peligros que puede acechar ante un mal uso de nuestros datos. Internet intermediaries, broadly understood, participate in various activities that expand their ability to use coding or designing, which transcend their classic role of neutrality regarding the online content. This change has enabled governments globally to solve the problem of the lack of control of the network by using the normative capabilities of intermediaries. The increase of normative power in recent times has leaded to an expansion of criminal liability of intermediaries. These criminal policies have strengthened public control of network users in situations considered as social danger, for example, on violations of privacy, child pornography and offences to honour. ; Los intermediarios de Internet, comprendidos en sentido amplio, están integrando diversas actividades que hacen que, mediante la expansión de sus capacidades de regulación por código o diseño, trasciendan su rol clásico de neutralidad frente a los contenidos. Este cambio ha permitido a nivel global a los gobiernos resolver el problema de la falta de control normativo de la red mediante el uso de las capacidades normativas de los intermediarios. El incremento de poder normativo se ha traducido en una expansión de las responsabilidades criminales de los intermediarios en los últimos tiempos, correspondiendo a políticas criminales que refuerzan el control público de los usuarios de las redes en situaciones identificadas como de riesgo social, tal y como se puede apreciar en materia de vulneraciones a la privacidad, pornografía infantil y ofensas a la reputación.
Abstract:The aim of this paper is to compare the constitutional and jurisprudential characterization of the freedom of information with the reality of its exercise in the Internet, where the classic legal solutions cannot be implemented directly because they are designed for an analogical communication developed by media, which used to work as the only channels of information and modulators of public opinion, putting citizens in a passive position with a minimum capacity to act. The new information technologies have broken the media monopoly, allowing anyone to become an active and participatory subject of a process that is no longer unidirectional, but articulated through a network where all the participants are receivers and creators of content, which poses new legal challenges that are particularly difficult to address. The communication regulations, designed for a specific context, is now facing a reality where its mechanisms of control, intended to protect fundamental rights against excessive interferences and the democratic system itself, are no longer effective considering that now communication is an individual process more than a social one. The premise of the journalistic information presented through a media that substantiated the privileged position of communicative freedoms as institutional guarantees with a reinforced protection is no longer fulfilled, so key questions now are whether the scope of individual freedom of information should be comparable to the professionals' oneor what role should play journalists in the digital society. Subjects no longer need mass media for effective reporting. They simply have to get access to a specific technology to do so, which opens a new debate: if the public powers should guarantee the access to it and how. With regard to the protection of freedom of information in the Internet, it may be useful to focus attention on the training of the subject as a journalist to identify who possess certain knowledge of the technique and deontology and, therefore, is able to act in a responsible manner contributing to public debate in constructive terms. Likewise, concepts such as the veracity of information, which may also have a new application in relation to advertising, or the prohibition of prior censorship must be reconsidered to their implementation in the digital environment, since it does not seem appropriate to renounce them in digital communications. ; Resumen:El objetivo de este trabajo es confrontar la caracterización constitucional y jurisprudencial de la libertad de información con la realidad de su ejercicio a través de Internet, donde no es posible aplicar directamente las soluciones que el Ordenamiento ha ido construyendo para la comunicación por medios analógicos, ya que ésta se basa en la intervención preponderante de los medios de comunicación como canalizadores de la información y moduladores de la opinión pública, otorgando una mínima capacidad de intervención al ciudadano,que esencialmente venía ocupando una posición pasiva. Las nuevas tecnologías de la información han acabado con el monopolio de estos medios, permitiendo a cualquier no profesional convertirse en sujeto activo y participativo de un proceso que ya no es unidireccional, sino que se articula a través de una Red donde todos los intervinientes son receptores y creadores de contenidos, lo cual plantea nuevos retos desde el punto de vista jurídico que son particularmente difíciles de abordar. La regulación de la comunicación, diseñada para un contextoconcreto, se enfrente ahora a una situación donde los mecanismos de control que permiten proteger los derechos de terceros frente a injerencias excesivas o el propio sistema democrático ya no resultan efectivos teniendo en cuenta que más que un proceso social, la comunicación en el entorno digital se plantea en clave individual. La premisa de la información de origen periodístico que se presentaba a través de un medio, que permitía considerar a las libertades comunicativas como una garantía institucional del sistema y les otorgaba una protección reforzada, ya no se cumple, de manera que es necesario cuestionarse si el alcance de la libertad de información de los individuos debe ser equiparable al de los profesionales o hasta qué punto estos pueden seguir gozando de un papel especial en la sociedad digital. En la Red, la vinculación con un medio ha dejado de ser un requisito previo para poder informar de manera efectiva. Basta con gozar de acceso a determinada tecnología para poder hacerlo, lo que lleva a tener que preguntarse en primer lugar hasta qué punto el poder público debe garantizar a los particulares tal posibilidad. En cuanto a la protección de la libertad de información en Internet, quizá convendría focalizar la atención en la formación del sujeto como periodista para identificar a quienes poseen un determinado conocimiento de la técnica y la deontología y, por tanto, están en condiciones de actuar de manera que su aportación no incurra en excesos y contribuya verdaderamente al debate público en términos constructivos. Del mismo modo, conceptos como la veracidad de la información, que además puede tener una nueva aplicación en relación a la publicidad, o la prohibición de censura deben repensarse para poder ser aplicados al entorno digital, pues en ningún caso parece conveniente prescindir de su vigencia. Admitido que Internet es una realidad ambivalente, como lo son las respuestas a los retos que plantea, se hace preciso huir de planteamientos simplistas o equívocos. Habría que optar por propiciar una organización política y una disciplina jurídica eficaz y democrática de los medios de información y control. A esta alternativa no sería ajena una ética que estimule actitudes de conciencia colectiva sobre el respeto de las libertades y de los bienes amenazados por una utilización indebida del ciberespacio. ; Internet is admittedly an ambivalent reality, as are the answers to the challenges that it poses, it is necessary to flee from simplistic or equivocal approaches. We should choose to promote a political organization and an effective legal and democratic discipline of the media and control. This alternative would not be alien to an ethic that encourages a collective conscience attitudes of respect of freedoms and goods threatened by a inappropriate use of the cyberspace.
En los últimos años, los expertos en comunicación política vienen ocupándose de las expectativas que los posibles efectos de las nuevas tecnologías de la comunicación pueden tener en la política contemporánea. Ha prosperado una serie de términos como "teledemocracia", "democracia electrónica" "política virtual", "netdemocracia", o "ciberdemocracia", que destacan la transformación que Internet puede provocar en la relación entre los gobernantes y los gobernados, entre los políticos y la ciudadanía. La solidez o intrascendencia de esa transformación divide, sin embargo, los dictámenes de ese amplio conjunto de analistas. Así, frente a las tesis más esperanzadas y optimistas de realización definitiva de una democracia participativa y deliberativa integral, aparece una visión más escéptica, según la cual, el sistema dominante de una democracia, institucionalmente delegada y elitista, sería capaz de reabsorber, para su propia conservación, las nuevas vías de comunicación sociopolítica que la interactividad y pluralidad cibernéticas apuntan.
A continuación, se presenta el servicio de televisión en Colombia, desde el desarrollo en la Constitución Política de Colombia, hasta las normas del servicio, explicando las modalidades de este servicio, así mismo se hace un alcance de cada modalidad, se explica cómo los contenidos son trasmitidos y llegan a los usuarios y la protección que existe, de igual forma se presentan los cambios legales que se han venido desarrollando y modificando el modelo y la nueva definición de los operadores del servicio de televisión en particular para los operadores de televisión cerrada. Por otra parte, se refiere como los contenidos audiovisuales se están llevando a internet y en este orden de ideas como los contenidos audiovisuales de televisión se presentan como una nueva forma de ver la televisión. De igual forma se observa si dichos contenidos vistos a través de diferentes dispositivos a través de internet pueden de igual forma considerarse televisión. Finalmente se resalta si las normas del reglamento del servicio de televisión en Colombia y en particular lo referido a los contenidos de la televisión, son o no pertinentes a las condiciones de servicio actual y en adición a esto indicar si este cuerpo normativo se puede trasladar a los contenidos audiovisuales transmitidos en internet. ; In the document it is presents, the television service in Colombia, from the development in the Political Constitution of Colombia, to the standards of the service, explaining the modalities of this service, likewise a scope of each modality is made, it is explained how the contents they are transmitted and reach the users and the protection that exists, in the same way, the legal changes that have been developed and modifying the model and the new definition of television service operators are presented, in particular for closed television operators. On the other hand, it refers to how audiovisual content is being taken to the internet and in this order of ideas how audiovisual content on television is presented as a new way of watching television. In the same way, it is observed if said content viewed through different devices over the internet can in the same way be considered television.
