This research is divided into three stages: the first part is a general presentation of the approach and investment conditions in an emergent country, and highlights the politics and the role played by foreign investors in such countries. It also explains future prospects such as the recourse to creative supply on these markets. Secondly, the bibliographic section is dedicated to the many works regarding the innovation or creative supply (including all forms of new value creation in relation to the context) to its management, as well as the role that it plays in the strategic politics of the firm. The last part provides the description and analysis of the practical experience related to creative supply in a sample of nine firms, following an investigation led by their leaders. While the results do show that there is a growing interest for the concept, the survey also reveals that there is a lack of conceptualization of this concept, or even, sometimes, a lack of awareness of its practice. Based on a detailed examination of key implementing factors, all of this permitted, the proposal of a conceptual framework for creative supply, based on critical internal and external decision criteria. Les résultats montrent, certes, un intérêt grandissant pour le concept, mais surtout, révèlent un manque de conceptualisation de la manoeuvre, voire l'absence, parfois, de prise de conscience de sa pratique. Ceci a permis, grâce à un examen précis des facteurs entrant dans son élaboration ou sa mise en oeuvre, de proposer un canevas de conceptualisation de l'offre créatrice se fondant sur les principaux facteurs décisionnels internes ou externes. Cette étude conclut, enfin, sur une série de préconisations à l'attention des différents acteurs ayant un rôle par rapport à l'acte d'innover, dans le contexte étudié.

So, we are using the CSR mechanism as a means to help the victims to demand justice before the Cambodian jurisdiction and the international community against the fact of impunity and the obscurity of the law. Judicial and extrajudicial mechanisms are the means to fight against the fact of impunity due to corruption or the violation of internal as well as formal international rule. The research interest is to find the various legal techniques that can produce economic, political and social pressure and which the state and the investor have agreed to revise its investment policy. While it is true that the law of corporate rights liability and liability poses some obscurity in relation to the legal relationship within the subsidiary company, but there are international mechanisms that can intervene in the matter. ; Le travail de recherche a pour objectif de réformer le système pour offrir à tous un accès égal aux outils et aux opportunités, notamment aux victimes de préjudices liés au projet d'investissement et aux investisseurs. International audience ; What issues do the arrival of foreign agribusiness investors in the Republic of Congo raise for the agricultural and land situation? At a time when international organizations view family farming as the best way to ensure food and land security, issues related to the arrival of foreign agribusiness investors in farmland in sub-Saharan Africa need to be examined. In this paper we focus on the case of the Republic of Congo. First we studied the country's agricultural and food situation, which according to the Congolese government justifies their decision to appeal to private foreign investors in order to diversify a rent economy based on oil through agricultural development and hence to cut down the food bill and attempt to ensure the country's food security. The second part of the study examines the land law reform. The arrival of foreign investors in farmland raises the issues of access to land, the government's strategy for attracting them and the safety of customary landowners. ; À l'heure où l'agriculture familiale est présentée par les institutions internationales comme le meilleur moyen pour garantir les sécurités alimentaire et foncière, il convient de discuter des enjeux relatifs à l'arrivée d'agro-industriels étrangers investissant dans le foncier agricole en Afrique subsaharienne. Pour cela, nous revenons dans un premier temps sur les situations agricole et alimentaire de la République du Congo. Ces situations justifient, selon le gouvernement congolais, le choix de faire appel aux investisseurs privés étrangers pour diversifier, grâce à l'agriculture, une économie de rente pétrolière. L'objectif du gouvernement est de diminuer la facture alimentaire et essayer d'assurer la sécurité alimentaire du pays. Dans une seconde partie, nous revenons sur l'étude de la réforme foncière. When a private investor wants to know whether or not to entry in a network industry, he has to consider uncertainties arising from the external environment. When the industry is regulated by an independent regulator, the main source of those uncertainties is related to the ability of the regulator to adopt and implement announced policies. Understanding and anticipating the behavior of the independent regulator allow private investors to limit the environmental uncertainty and to decide to enter in the concerned industry. Based on an neo-institutional analysis of liberalization policies, a grid analysis of the regulatory risk associated with the entry is proposed for the use of private investors. This grid analysis is then empirically tested in the case of the entry of virtual operators in the European industry of mobile communications services. ; L'entrée ou non d'un investisseur privé dans une industrie de réseaux est notamment fonction de l'analyse stratégique de l'environnement extérieur de la firme et de ses incertitudes. S'agissant d'un environnement extérieur régulé/libéralisé par un régulateur indépendant, l'incertitude majeure de l'investisseur privé est relative au comportement de ce régulateur sectoriel quant à l'adoption et à l'application des réglementations économiques annoncées. La compréhension et l'anticipation du comportement du régulateur indépendant permettent à l'investisseur privé de limiter cette incertitude environnementale et de décider d'entrer ou non dans l'industrie concernée. Sur la base d'une analyse néo-institutionnelle des politiques de libéralisation des industries de réseaux, une grille d'analyse du risque réglementaire associé à l'entrée est proposée à l'usage des investisseurs privés. Cette grille est ensuite testée empiriquement dans le cas de l'entrée des opérateurs virtuels dans l'industrie européenne des services de communications mobiles.
